A W��� ���� O�� BAM P�������� I hope this message finds you so busy with work you barely have time to read it! Every day, you make business decisions, often prefaced with the question “why is this good for my company?” It’s important to know the “why” regarding your business decisions and one of those “why” questions may be about your membership the builders association. My membership “why” boils down to excellence and being the best builder I can. With my builders association membership I’ve built business relationships in my community and across the state. I receive the inside track on industry information and trends and I’ve influenced the politicians and regulators that make decisions on how we do business every day. BAM exists to unify the statewide home building industry and help you be the best you can as a home building professional. It was created to bring the state industry together and amplify the sound of our voices together, and that’s exactly what we do today. BAM represents you and your business at the State’s Capitol, regulatory agencies and in the courts because industry unity and doing business with members is good business. Simply put, we are stronger and have a louder voice together. Protecting Your Business at the Capitol If you haven’t seen it yet we put together a great summary of what happened this session and what might affect your business. Wins this year include mitigation of what would have been an expensive radon requirement, protection of the industry’s warranties and general liability coverage, and preventing hidden fees such a street improvement districts from becoming law. [BAM Legislative Summary] There were many other pieces of legislation that we worked on and we will continue to work on, but one thing I learned from being at the Capital this year was, although we have the facts, politicians often times side with emotion and disregard the facts. I guess it’s called Politics. $10,000 in Legal Resources One of the big benefits of BAM membership are legal resources such as the set of six contracts available for free to members and estimated to be worth over $10,000. This year, BAM has updated the contracts to reflect the changes made to state law. As a bonus, a sample change order document has also been added to the set. Legal Protection Membership with the builders association means collective legal protection. BAM’s Legal Action Fund takes on cases with statewide significance, meaning if successful the case will help home building professionals in all corners of the state. There are several examples of legal wins that benefit the industry. One in particular is the building permit fee win against the city of Shakopee. Since that case, my local city tried to raise building permit fees above the cost of providing the service. We used this industry win to keep them from doing so.

Ultimately, the more involved you get, the more you learn – from the business contacts you meet, from the experience you have at the Capitol, from participating in events and on BAM’s working teams (committees) – the more value you are able to provide your customers. It is hard to believe that summer is mostly behind us! The Fall Showcase of Homes and Remodelers Tour are upon us and I congratulate all the builders, developers and remodelors who worked hard to prepare their homes for the public to view! I am praying for beautiful weather and lots of buyers! Good luck to all of you ! There are many challenges that face our industry every day. Lately, for me the challenge has been in the form finding framing crews that are not buried up to their necks in work, skilled workers to hang sheetrock in a timely fashion and the shortage of sod!! Who would have though we would run out of grass?! This is certainly the downside of a busy building season. I am sure many of you are having some of your own challenges. Remember, always end the day with a positive thought. No matter how hard things were, tomorrow is a fresh opportunity to make it better! The challenge that RAB faces year in and out is building our membership base. Although our retention rate hovers around 90% (which is excellent for an association like ours) we always need new members! Throughout the year, we have lost some old friends, but we continue to acquire new ones. Without members, our association can not survive. I challenge all of you to bring in one new member by the end of the year! Our goal in 2013 was to have 500 members and we are now at 455. If just 10% of our members brought in one new member, we could meet or exceed our goal! I hope you will consider becoming an active participant in shaping RAB’s future and think about the positive impact you can make on our industry through RAB. The future is ours to create. Let’s do it! Let’s build this house together!

Help RAB Decorate our Tree! For the first time ever, RAB will be decorating a Christmas tree for the Festival of Trees. A CONCRETE CONCERN Construction sites can be contributors to urban runoff pollution if proper pollution prevention practices are not in place. One of the most common illegal discharges from construction sites is cleanout from concrete installations1. Concrete washout results from washing concrete trucks, mixers, chutes, and tools. It can also be the result of saw cutting, grinding, coring, and grooving as well as from cementitious products like grout, mortar, plaster, and stucco. Concrete washout is highly alkaline (pH 12), caustic and corrosive. Without proper management, it can pollute surface water and ground water by increasing the pH, decreasing water clarity, and harming aquatic life and their habitats. Concrete washout can also leave a lasting effect on the soil. Future vegetation may be stunted or not grow at all, and existing vegetation can become damaged. The US Environmental Protection Agency (EPA) and the Minnesota Pollution Control Agency (MPCA) require best management practices (BMP’s) for concrete washout so that it is not discharged onto the ground or into surface waters. There are two choices when considering how to keep concrete washout off your site. One option is sending all waste from concrete activities back to the concrete supplier. The other is to manage it appropriately on the construction site. The following information details how to properly manage concrete washout on-site: Educate Your Concrete Contractors: The success of your on-site washout area depends on good communication with your concrete contractors. Clarify the concrete waste management techniques you expect, including not dumping concrete washout on the ground or allowing it to enter storm drains, open ditches, streets, and waterways. A concrete washout sign must be installed at each temporary washout facility to inform the concrete equipment operators to use the designated facilities. If concrete washout will be managed on-site, you can either: 1. Use a prefabricated washout container that is designed to resist damage and protect against spills and leaks, or 2. Build your own facility that is properly sized to contain all liquid and solid concrete waste that you expect to generate in between cleanout periods. For onsite management, locate the washout area at least 50 feet from storm drains, open ditches, or water bodies. If no pavement exists, construct a stabilized vehicle entrance to the containment area.
Chute washwater leaking from a roll-off bin being used as a washout container When on-site management is used, follow these operational guidelines: • Inspect the containment facility daily to determine if it has been filled to 75% capacity. The facility needs to be cleaned or changed when 75% full. • Inspect containment facilities daily to ensure they are not leaking. For self-installed facilities, check the plastic linings and sidewalls to make sure they are intact. You may need to provide more education, install additional signs, or add more washout areas if construction activities have been damaging to your containment facility. • Cover the containment facility before rainstorms to prevent overflows. Material Removal: • If the containment facility is nearing capacity, manage the waste in an appropriate manner. Do not discharge it to waterways, storm drains, or directly onto ground. • Evaporate the liquid portion and reuse or dispose of hardened concrete. • When you remove materials from the washout containment facility, inspect it for signs of weakening or damage, and rebuild the structure or make repairs if needed. Install a new plastic liner after every cleaning.

Regulation, and Its Unintended Consequences Elliot Eisenberg, Ph.D.
Looking around the United States there are cities like Boston, Los Angeles and Washington, DC that have very high house prices. Yet there are equally successful cities like Austin, Dallas, Louisville and Oklahoma City that have much more affordable home prices. Why the difference? Of course the surf is better in L.A. than in Dallas, but it has always been better, and 40 years ago L.A. was not an expensive city. The reason for this disparity is regulation. Simply put, each piece of legislation that becomes law, and each regulation promulgated by the bureaucracy, regardless of how well-meaning, increases home prices. Sure, having a 30-foot setback looks nicer than a 20-foot setback, but it makes lots more expensive. And while requiring a brick façade may add gravitas to a house, it too raises its price, and the list goes on. Worse, as housing prices are artificially pushed up, distortions are introduced that have negative unintended economic consequences. Imagine yourself new to town and looking to buy a house. Happily, you quickly find your dream house, but it costs $205,000 and all you can afford is $200,000. Turns out the house you love was built in 2009, the first year houses were required to have cement driveways and picket fences, which raised the price of those houses and all subsequent ones by, you guessed it, $5,000. The solution, look for a house built before 2009. But just like you, everyone else in your situation is doing the same thing. As that happens, the price of homes built prior to 2009 rises. After all, demand for them is suddenly up, way up. And presto, the house that used to sell for $200,000 now costs $203,000.
An alternative is to look for a house in a neighboring town where asphalt is still allowed and picket fences are optional. And as luck would have it, you find a beautiful $200,000 house and move in. The only problem; your commute to work is now twice as long as it would have been if you had been able to buy that original house. And that increases CO2 emissions, causes needless wear and tear to roads and infrastructure, requires you to buy a new car more often, and hire a sitter for your kids, as you are all too often caught in traffic driving home. But wait, it gets worse; suppose your uncle owns a huge parcel of land and planned to build entry-level houses on it for $200,000. He can’t now because of the cement driveway and picket fence rules which force the price up to $205,000. The problem is folks like you can’t afford those houses, so he goes upscale and builds $225,000 houses, and in that way does well, but contributes to the affordability problem. To review, forcing anyone to do something they otherwise would not have done makes whatever it is more expensive. In this case, it raises the price of new entry-level houses. In addition, it raises the price of houses built prior to the law, which in turn pushes home construction into neighboring areas which adds to sprawl and boosts CO2 emissions. The moral of this sad tale, think twice before reflexively solving problems through regulation and legislation. The consequences can be quite far-reaching and unintended.
