Fed Up DBP Shareholders File Lawsuit Against HPD By Kami-Leigh Agard

Last Friday, March 8, the afternoon was biting cold, but Dayton Beach Park (DBP) shareholders were beyond heated as they came out full force on the steps of the boardwalk in front of 8800 Shore Front Parkway to announce that they are suing HPD (NYC Department of Housing Preservation and Development) for its lack of oversight in regulating the DBP’s board of directors, which shareholders largely accuse of nepotism and negligence for years. With the support of local pols, Assemblywoman Stacey Pheffer Amato, Senator Joseph Addabbo and District Leader Lew Simon—attorney, Mike Scala, announced that he was representing the shareholders and filing an Article 78 motion against HPD in a Queens Supreme Court on Monday, March 11. In addition to the lawsuit, the shareholders are also requesting that HPD remove the Board

of Directors in its entirety. In December of 2017, The Rockaway Times reported a story on shareholders accusing the board of illegally renting apartments. Then in January 2018, we reported on when the board was under further scrutiny after two residents died in an apartment fire, which shareholders accused the board of not doing annual inspections, and HPD for overlooking the board’s negligence. as elected officials to listen. I am proud of the shareholders coming forward today to make their voices heard.” Assemblyman Blake said, “This is a collaboration that we all have to have as legislators, and to reassure that we are here standing with you. This is not about us, just being here today. This is about us as elected officials being consistently here for you. That’s the reason you elected us. I’m just coming from a convening we had in Brooklyn, where we were standing with Mitchell-Lama shareholders like you, who are also very frustrated, asking questions such as: Why HPD is not being transparent when it comes to information? Why are board meetings consistently closed? People are sick and tired of games where we see these games being played repeatedly. That’s why we are grateful to you for stepping out, and when you have good

lawyers that step in, then good things can happen. Your block won’t block your blessing, your zip code won’t deny your destiny, and this Article 78 will be the first step in demonstrating that your destiny is going to be with you.” According to Scala, HPD tried to fight against the location of the case when he filed on Monday, but ultimately, he overcame the hurdle. “At a hearing before a Queens Supreme Court justice on Monday, HPD contended the matter should be filed in Manhattan, since there is a related action in that county regarding

voter eligibility of shareholders,” Scala said. “I argued that the shareholders have not had a voice in the process and their case belonged in Queens. The judge signed an order granting a return date in Queens. We cleared the first hurdle. The board hasn’t yet been removed or even suspended, so we have a ways to go. But the shareholders are getting what they deserve, and that is a chance to make their case.” The Rockaway Times reached out to HPD for a statement regarding the lawsuit and the status of the shareholder list audit, to which they said, “We

don’t comment on things in active litigation, and will not comment while this case is pending. We are currently being sued by the board of directors regarding the election, in addition to the current lawsuit brought by Michael Scala. HPD takes its supervisory role seriously and wants to ensure Dayton Beach Park remains in a strong physical and financial condition.” After the rally, folks were shouting, “Get them out,” and “Lock them up!” One resident, who wished to remain anonymous, said, “I’m encouraged by what I heard today. I’ve been a resident of Dayton for almost 40 years. The conditions here have increasingly gotten worse under this board. We do need someone to step in and help us. It used to be a real family community, where everybody knew and looked out for each other. Now, there are all these subletters. It’s a shame. 120 Or Bust There’s no pleasing me. I’m glad we’re getting the extra hour of sunlight with Daylight Savings but losing an hour is kind of a steep price at my age. Though some would tell me I’ve got the wrong outlook. Age is a mindset, they say. Kind of like back pain; it’s all in your head. Don’t worry, I’m not gonna go all jump-off-a-cliff like Lazer did in his column a couple of weeks back. No, quite the opposite. I was listening to a couple of guys on some podcast and they made the case that you should

think you’re going to live to 120 years old. Your lifestyle, your investments, your ambition, your outlook on everything changes. You’re 70? You got 50 years left. Get moving. Ew, right? Can you see yourself at 120? How much further can body parts sag? But their point is if you aim for 120, you’ll likely live a longer, more vigorous life. One of these guys is 74 and he says he figures on living to 156. I’m embarrassed to say, he almost has me convinced. He said for every

year you live, technology can extend your life by a bunch of years more. You might not have any original parts left but maybe you’ll be around for jetpacks. These longevity guys say the basics, eating and sleeping well and exercise, are keys but so is your mindset. They reject golf. Just sayin,’ dudes. They say golf is like sending an email to the body that you’ve started checking out. Hello, Florida readers. The younger dude on the podcast, who’s 58, says 120 is completely manageable and you can even find precedence in the Bible. Turns out, Moses died at 120. Moses clocked 120 but there’s a mystery what happened to life expectancy between him and his forbearers like Methuselah who lived to 969. Which is kind of a choke. You get all the way to 969 and you can’t do 31 more years? Plenty of people know Methuselah but how many know the guy who comes in second? This dude named Jared made it to 962. Bit of a late bloomer, this

Jared. He had a kid when he was 162. Imagine him taking his kid to school. Other kids wouldn’t ask, is that your father or grandfather. They’d ask if that was your ancestor. I couldn’t stop with Jared. I felt like Sean McVeigh, The Rockaway Times factologist, looking for facts you probably don’t need. I learned, for example, that Abel, you know the guy who got knocked off by Cain, he outlived Moses. He was 122 when his brother killed him. One hundred and twenty-two years with somebody. I dunno, I’m starting to think about Cain in a whole new light. “I’ve put up with your crap for a hundred and twenty-two years…” Cain ate well and exercised and murdering his brother didn’t seem to affect his positive mindset. He lived to 730. And might have lived longer except his house fell on him. It’s like that old line, somebody looks at a 120-year-old and says, “Gawd, who would want to be 120?” The answer: the guy who’s 119.

The time to chime in on the Williams pipeline is now. The last day to submit comments to the NYS Department of Environmental Conservation is Friday, March 15 at 5 p.m. Last Wednesday, March 6, the DEC held a public hearing for people to express their thoughts on the latest proposed Williams natural gas pipeline. According to Williams, the company is developing the “Northeast Supply Enhancement project to expand the existing Transco natural gas pipeline system by the 2020 winter heating season to provide important gas supply that will help the City reach its clean air goals.” However there is staunch opposition against the 23-mile pipeline that would stretch from New Jersey to the waters off of Rockaway, and they made it clear at the hearing held at the Beach Channel Educational Campus last week. Despite the inconvenient meeting time of 5 p.m., which many pointed out as a time that people are traveling home from work, there was a strong showing of people on both sides of the issue, but a majority showed opposition. A coalition of environmental groups such as Sane Energy Project, Surfrider and Food & Water Watch, along with residents from across the peninsula, who believe the pipeline poses a threat against the area and local marine life, showed up to battle it out with those who support the project and believe it is necessary to provide natural gas to New York City, and it will be beneficial as it would create jobs. Among those against it were Assembly District Leader Lew Simon, who said the DEC has been anything but friendly toward the area. “You guys come here looking for support, but you don’t help us. We have projects in Breezy Point and in Broad Channel that we’d like to move forward and you don’t

allow it, but yet you come here looking for our support. The last time you proposed the original Williams pipeline, not many of us were able to get out and speak because it was right after the hurricane. DEC was pushing this through and no one was aware. Shame on DEC and shame on Williams, that likes to throw money and buy support. They’re not buying me off,” Simon said. “My message is clear: Governor Cuomo, veto this and all my state electeds, stand with us together. United we stand, divided we fall. Hell no to Williams Pipeline.” Those in opposition are hoping that the DEC will either deny the permit for the project, or that Governor Andrew Cuomo will veto it, as he has done for similar projects in the past. A coalition of those showing opposition have organized a last-minute rally at City Hall at 11 a.m. on Friday, March 15. They will be joined by some elected officials who have signed letters to Governor Cuomo, asking him to veto the project. Around 50 elected officials have signed opposition letters. They are also requesting that people call Cuomo’s office directly to ask him to veto the pipeline at 877-2356537. For more information about the project, see www.northeastsupplyenhancement.com. Chris O’Reilly (some of you will remember his dad, Mike O’Reilly, who starred back in the day at the Summer Classic), hit the clinching free throws. ***** Staying on hoops, Far Rockaway High School, a 17th seed, knocked off top-ranked Brooklyn High School for Law and Technology, 58-50 last Wednesday. ***** On Wednesday, the House Financial Services Committee held full committee hearing on flood insurance reauthorization entitled “Preparing for the Storm: Reauthorization of the National Flood Insurance Program.” Among the items discussed were: allowance for premiums to be paid monthly; increased coverage limits for homes and businesses, with limits for homes increasing

from $250,000 to $500,000 and commercial policy limits increasing from $500,000 to $1,500,000; improved mapping; and allowance for communities to adopt portions of new flood maps while continuing to appeal others. St. Paddy’s Day in Rockaway By Katie McFadden

Rockaway’s parade day may have come and gone, but the official St. Patrick’s Day is this Sunday, and Rockaway will keep the party going, celebrating Irish culture and fun all weekend long. While the New York City St. Patrick’s Day Parade may be taking place in Manhattan on Saturday, March 16, RBQ’s, the new barbecue hotspot and bar, will give those celebrating, a reason to stay in town with its first St. Patrick’s Day Irish Festival. From 1 p.m. to 11 p.m., in the tent in the parking lot, there will be plenty of tunes to keep people doing a jig. Gerald Bair, The Gobshites and a popular band full of local Irish lads, Wine with Sue, will be playing throughout the day. If that wasn’t enough, RBQ’s will be serving up what they call, “The best Corned Beef you have ever tasted” to pair with your favorite brew. Tickets are just $25, but there’s a limit-

Community Comes Down on DHS Over Shelter Proposal By Katie McFadden

“Audit DHS.” That was the main message sent at Tuesday night’s Community Board 14 monthly meeting. With a big topic at hand, a larger venue, the Scholars’ Academy auditorium was chosen as the scene for the community to release a full on attack on the Department of Homeless Services (DHS) over their proposed shelter for Beach 101st Street. With speeches loaded with facts and figures, from those in the community and those from other neighborhoods facing similar shelter proposals, a clear message was sent that these shelters are not welcome and that these communities are fed up with the shady dealing of DHS, shelter developers and service providers. Before representatives from DHS even got to say a word about the shelter proposed for 120 homeless men at 226 Beach 101st Street, the public made it clear that it was not welcome. The meeting immediately opened with a public speaking session, which more than 40 people signed up for, with most focusing on the shelter issue. Many of those who spoke came armed with facts that would set the tone for the rest of the meeting and would leave CB14 passing a motion to demand an audit on DHS and the service provider, Black Veterans for Social Justice (BVSJ). Local CPA Sarah Kenny riled up the crowd and ruffled feathers when she spoke about findings from tax returns for Black Veterans for Social Justice, the group selected to run the proposed shelter for Rockaway. “The 2016 Form 990 showed grants received from the government of $7.4 million, salaries and expenses of $5.2 million, other expenses of $2 million and program expenses, which is what us in the nonprofit area call ‘what we actually spend on the mission’--$289,000,” Kenny said to a shocked audience. “When you look at the actual

program expenses, they comprise less than 10 percent of the revenue that this group gets from the government and other sources. Less than 10 percent is so terrible, it wouldn’t even measure on charity watch organization rating sites, where organizations like Wounded Warriors, and American Cancer Society and the Parkinson’s Foundation spend 80 percent on programs and services.” Kenny then turned to members of CB14, requesting a formal audit of the organization. Adding more fuel to the fact fire, local resident Torey Schnupp referenced reports that summarized how much DHS spends on the homeless population. “The DHS spends $117 per day on average for every homeless individual. That’s $3,510 a month, $42,120 a year. And the best we can do is put them in a warehouse on a cot, in a place with no transportation, no jobs?” Schnupp said, before addressing the members of DHS directly. “You people need a conscience. You need to think it through. If this isn’t criminal, I don’t know what is. is. One hundred and twenty men times $42,000 a year. I would like to know what percentage of this goes to Liber-

We now know that Black Vets for Social Justice pretty much spends nothing on these people and if this isn’t criminal, I have no idea what is.” Schnupp ended her speech, calling for an audit of DHS, which led the crowd to chant, “Audit, Audit…” With this information, others started to call out DHS and demand audits. When local, Paddy Tubz got up to speak, he asked the DHS representatives to identify themselves, saying, “I want to look LIARS in the eyes.” He continued, “I’m calling on Community Board 14 to write a letter to Scott Stringer, calling for an audit of DHS. They are shady, shady, shady. It seems in all of this regarding 226 Beach 101st Street, there have been shady dealings. Where is the money going? Seven million to Black Vets for Social Justice, $5 million in salaries, $289,000 for services? Where is the social justice there?” Besides looking at numbers and calling for an audit, many cited reasons for why Rockaway may not be the best place for a homeless shelter due to a lack of sufficient transportation, a lack of services, a high unem-

ployment rate, only one hospital in town, and the shelter in question being proposed in an area surrounded by schools. Many spoke of the nearby schools as a reason to oppose the shelter. Speaking on behalf of the Channel View School for Research PTA, local Alison Kase spoke specifically about the school’s population, 13 percent of which are special education students, many on the autism spectrum. “You’re packing a shelter close to socially disabled students. I beg you, do not let this happen. Do not put a vulnerable population into an exponentially dangerous situation,” Kase said. Irene Dougherty of Assemblywoman Stacey Pheffer Amato’s office, instead came to speak as a member of the PTA for Scholars’ Academy. She called all surrounding schools to ask for their population, which she found to be more than 4,000 students in the area. “We know firsthand what it was like to be homeless, what is was like to try to build our lives in a different community after Sandy. Rockaway is still recuperating. We’re not there yet, and to put a vulnerable population of people in this close proximity to so many children, is wrong. I was told that when someone is in a homeless shelter, they don’t have to register as a sex offender because it’s considered temporary housing,” she said, stirring the crowd. A local 10th-grade student named Lily expressed her concerns regarding the potential shelter population. “As a female student, I’m very concerned about the potential of an allmale homeless shelter coming into my school community,” she said, before following up with vital questions. “I ask, where will these men spend their time when not in the shelter? Does Meghan’s Law apply to DHS? Where are these 120 men coming from? Without answers to these questions, Continued on page 13

how can me and my peers feel safe in my school community? I call on the Community Board to audit DHS.” The young student wasn’t the only one to pose important questions to the DHS representatives. After the public speaking segment, the representatives were given an opportunity to present information on the shelter, but through interruptions of jeers from the crowd, they weren’t able to present much before Community Board members started asking questions. Jocelyn Carter, Administrator for DHS, tried explaining their intentions. She didn’t get to say much after explaining that these shelters are being set up in communities to help people nearby and that there are more than 1,000 homeless people in Community Board 14. “So none of you have experienced this, but there are over a thousand..” she said before

being cut off by the loud audience. Jelani Masheriki, regional director of Shelter Operations for BVSJ, then attempted to provide some information about the organization. Trying to address concerns about the homeless men being forced to leave the building during the day, Masheriki tried to clarify, explaining that the men are offered a full schedule of services and recreational activities to deter them from loitering outside all day, if they’re not at work. He began to cite BVSJ’s oldest shelter in Bed-Stuy, to which someone shouted out calling it a “sh*thole.” Masheriki immediately responded, “It’s not a shi*hole,” but as the crowd got louder, they made it clear they didn’t want to hear what he had to say, so the discussion turned to the board members, who began to question all of the reps. After board members had an opportunity to ask a few questions, an official motion was made to request a forensic audit of both DHS and the service

Councilman Eric Ulrich has put out a call for action, to take the protests outside of Rockaway. “I want to make sure our frustrations, anger and concerns, which are valid and legit, are channeled in the right direction. If you’re angry and upset and genuinely concerned, join me in bringing this protest to the source of where it’s coming from,” Ulrich said. He then announced that there will be a protest on the steps of City Hall in Manhattan on Sunday, March 24 at noon, to send a message to Mayor Bill de Blasio, that his homeless policies aren’t working. Additionally, there will be a protest outside of the home of DHS Commissioner Steven Banks’ home at 7 p.m. on Monday, March 18, at Sherman Street, between 10th Avenue and 11th Avenue in Windsor Terrace, Brooklyn. All are encouraged to join in both protests.

At one point, a board member reiterated the concern about the $5 million spent on salaries out of $7 million given to BVSJ. A representative responded that those salaries account for case managers, social workers, housing specialists, employment specialist, retention workers, security, cooks, cleaners and more. “It is for salary of the staff that is in there providing social services for our clients,” she explained. “Go look at what the salary is for and what the money is going for and what people are being paid for,” the rep said, responding to the audit request. Just 10 days after local Gavriella Navarez launched Facebook page, “Bad Moms of Rockaway,” she was featured in New York Post article (March 9, 2019), “Bad Moms’ let loose in raunchy Facebook groups.” Though Navarez was the cover mom for the article’s photo, the storyline mainly focused on titillating and raunchy Facebook comments from “Bad Moms” groups in Long Island and New Jersey, that reference their sex lives as a parent and other hot topics. Many of the groups were inspired by the 2016 movie, “Bad Moms.” However, according to Navarez, though she appreciates the exposure and thinks some of the raunchy moms in other groups are hilarious, her intentions for Rockaway’s ‘bad’ group are good. “I started this group, because as wife and mom of two boys, I wanted to create a platform where local moms feel supported throughout the mayhem of our daily lives. Though we doubt ourselves and feel imperfect, we are good moms at heart, and sometimes just need an avenue to share, vent, learn and of course laugh with each other,” Navarez said. The 28-year-old mother grew up in Far Rockaway and moved to Rockaway Park with her husband, Danny, in 2015. She has two boys, seven-year-old Gavin and two-year-old Ethan. Navarez and her husband actually tied the knot at Whit’s End, when the popular foodie establishment was located in Riis Park. The working mom frankly stated, “My kids know how to drive me insane!” While The Rockaway Times was speaking with Navarez, Ethan was in his crib singing, “Mommy, mommy where are you?” Navarez laughed, “You see what I mean, but my two boys are my world, and every day I earnestly try to be a better mom, and berate myself when I lose my patience or temper.” Navarez said for years, she tried other Facebook mom support groups with the sole mission

to learn how other parents balanced motherhood— however she felt alienated. “I’ve always had issues with other mom groups. There was always a problem with posting questions and concerns you have about your children and balancing our daily lives. I feel that in a mom group, there should be a degree of compassion and understanding that we could be completely open and share our struggles and concerns. In previous groups I joined, I felt like there was always the grammar police and the eating police. For example, if I said, ‘I fed my son a peanut butter sandwich for dinner because he refused to eat anything else,’ I would get a response like, ‘Oh my goodness! How could your child just eat peanut butter sandwiches for dinner? How horrible!’ “These kind of comments irked me because every mom knows what raising a child is really about. Every mom knows that your children don’t always listen to everything you say or ask them to do. Your children decide they want to do things their way. I know as mommies, we have to put our foot down and demand that they obey, but it’s not always that easy. Motherhood is hard. It’s not an easy job at all,” Navarez said. Page 15 a good job as a mom, and this is something I know all mothers want,” she said. As of press time, “Bad Moms of Rockaway” already has 85 members. According to Navarez, only moms are allowed on the Facebook group, not dads. “I know great dads out there who are trying their best to be the best caregivers for their family, but us moms, we need our own outlet. We do share some funny anecdotes that only we can appreciate and laugh,” Navarez said. The plucky mother said she hopes “Bad Moms of Rockaway” grows beyond Facebook. “It would be fun to do a Bad Moms of Rockaway night out, where we can get other, drink some wine, bond and form long-lasting relationships. Other Bad Moms pages are calling me a copycat. That’s not the case. They do not understand the dynamic of Rockaway. We are a support group for motherhood—where we come together and give strength to all moms feeling overrun by their precious little angels,” Navarez said.

That’s not my reality, I don’t know any mom like that!” Navarez exclaimed. On top of everything, Navarez said she is going through a horrific five-year custody battle with her ex for her older son. “Everything I’ve done, fought, cried for my Gavin has been criticized. So when I get the opportunity to vent and share with a mom going through a similar ordeal, it means so much,” she said.

Navarez said recently, after a long day—getting the children out the door for school, getting herself dressed for work, coming home, cooking and serving dinner, giving her children their baths, doing the laundry and still cleaning up—ready to drop from exhaustion, her son, Galvin, asked her for a snack. “I just gave him a look, like, ‘Seriously!’ His response, ‘A mother’s job is never done.’ I looked at him and said, ‘You couldn’t be more right.’ And to be honest he was so helpful that day, and

I felt guilty for not being able to stretch myself even more, and of course, I gave him his snack,” Navarez said. According to Navarez, there’s no such thing as the perfect parent or perfect mom. “This is expressly why I created this Facebook page. As women, we need to support each other. All we know is that at the end of the day, our job as mom is to raise a happy, healthy child who will mature into a self-sufficient, independent adult. That is my goal. If I reach that, then I know I did

Concerns Grow Over Beach 61st Speeding By Katie McFadden

While the homeless shelter subject took front and center at Tuesday’s Community Board 14 meeting, another important subject was put on the back burner—speeding on Beach 61st Street. For several months, residents of Beach 61st Street and the surrounding area have come out to demand speed control devices for the residential block that continuously sees speeding cars, attempting to bypass traffic lights on Rockaway Beach Boulevard. On Tuesday, March 14, many of those residents came to the CB14 meeting to once again bring attention tothis issue, as it was supposed to be discussed as part of the Transportation Committee’s report. However, due to the change of location to Scholars’ Academy, which only allowed for a permit for the meeting to continue until 9:30 p.m., the subject was shafted un-

til next month’s Community Board meeting, with the hot topic homeless shelter taking precedence. However, during public speaking, residents got a chance to express their frustrations.

“No one cares about the speed. This is a residential street with families that most people had never gone down until the last three to five years, with the placement of traffic lights near Stop and Shop, the YMCA and the stores like Boardwalk Pizza. We need a better handle on this. We’ve asked for changes and have sent e-mails. Beachfront road got speed bumps, which is great, but we need our street to be taken off of the map for traffic. There was just a crash at Beach 62nd Street yesterday and we’re afraid that someone’s child is going to get killed,” the Beach 61st resident said. Pastor JD Williams of St. John’s Baptist Church, also a resident of Beach 61st expressed his displeasure in the issue being sidelined. “Every morning, from 6 a.m. to 9 a.m., I see that street changed to a speedway. I spoke with Captain Hall of the 100th

Precinct about this and he sent patrol units, which I’m grateful for, but if we don’t do something about this, someone is going to get killed,” he said. “This should be one of the main agenda items for today. All of my neighbors with cars are afraid to go into their driveways head first because coming out, we’re afraid of getting hit, so we have to go in backwards. If we come back here during the next meeting and someone is dead, it’s going to be a tragedy.” Other residents suggested that a major change that should take place to alleviate some of the traffic issues, is the reopening of Rockaway Freeway between Beach 59th and 62nd Streets. “If we’re gonna consider anything, we need to consider opening up Rockaway Freeway,” local Florence Ferguson said. The discussion is expected to be at the top of the agenda for the April Community Board 14 meeting.

Bridge Woes Construction. Construction. Construction. I was almost late to work one day last week and my secretary said, “Beth, you are never this late. Is everything okay?” I replied, “Everything is fine, just my ramp is closed to get onto the Cross Bay Bridge.” She replied, (and she does not live in the Rockaways), “Isn’t that the Marine Parkway Bridge that is always closed?” I told her that “yes that bridge is also an issue for my friends who must commute to Brooklyn from Rockaway, but now they

are working on this bridge as well.” It actually has not been that bad. I simply take the road past Madelaine Chocolate and go under the El and make the left to get onto the bridge. I leave pretty early for work so it is not that bad, but from what I heard on Facebook, it gets quite hectic at busier times of the day with people running the light, and making the left turn to get onto the bridge from the right lane. The word is even yellow buses are not following traffic laws.

I also hear that it is hectic by the Bungalow Bar where people are whipping the U-turns to get onto the ramp either right after the divider or are driving through McDonald’s. This area was dangerous before the bridge closings. I just hope no one gets hurt. I am curious though, why the bridge needs these repairs? Wasn’t the bridge just redone about ten years ago? Why do we have to have multiple ramps closed that are part of an evacuation route? Allegedly they are replacing joints, barriers and pavement. I am also curious how long this construction is going to take? According to the MTA notification alert, it will continue through the spring… vague. Can you imagine the traffic by the Bungalow Bar in the summer if the ramps are still closed? I can only imagine the accidents that will take place when people want to make a U-turn to get onto the ramp. And I hope there is not a major emergency and emergency vehicles need to

Page 17 get into or out of Rockaway quickly. I tweeted the MTA and a few of our elected officials. The MTA immediately got back to me and attached the notification handout. From what I read, the notification is incorrect. It states that the northbound ramp from the east will be closed at first and I believe that is the ramp that is open…I commented on the tweet and asked to who I could speak to in more detail and that tweet went unanswered. I also did my tweeting and emailing late as I am not as prepared as my colleague, Dr. Peter Galvin. He writes his columns in advance. I am always getting the column in just in the nick of time. For most of recorded human history, personal health information has been collected, maintained, and analyzed mostly by healthcare professionals within the scope of diagnosis and treatment. This has been codified in our laws, especially by the Health Insurance Portability and Accountability Act, better known as HIPAA. The law governs the use, storage, and sharing of health records and it applies only to healthcare providers, insurance plans, and the plans’ “business associates.” Unfortunately, recent technological advances have shattered this sphere of protection of personal health information. Take, for example, last year’s Facebook fiasco involving Cambridge Analytica. The company used private data from millions of Facebook users, allegedly without their consent. Most people were not aware that Cambridge Analytica’s client

Privacy At Risk list included the political campaigns of Donald Trump, Ted Cruz, NYU’s Langone Hospital, and another major insurance provider, London-traded Hiscox Ltd. The public remains largely unaware of the threats to their personal health information from new and developing technologies. Many people, especially younger people, use fitness trackers, smartphones, and smartwatches that collect and record biometric data. Direct-to-consumer genetic testing is available, and these services analyze and sell our entire family history. Software applications and websites are used by consumers to motivate, monitor, and share their progress toward a healthy lifestyle. All these internet-based devices and services share one thing in common – namely that HIPAA does not apply to them. There is essentially no protection from their collecting and sharing of personal health information. We are increasingly sharing our most sensitive personal information with

corporations, governments, and neighbors—sometimes knowingly, often unwittingly—without any of the protections we previously demanded when the same data was in the hands of licensed medical experts. There are a number of risks and potential harms included in this phenomenon. The first type of harm is the very act of privacy violation itself. Confidentiality is a cornerstone of our healthcare system. Without it, patients lose trust in physicians and medical institutions and shy away from participating in research studies. Secondly, firms may have greater opportunities to discriminate against employees and job applicants based on preexisting conditions, disabilities, or genes. While this discrimination is prohibited under the Affordable Care Act, the Americans with Disabilities Act, and the Genetic Information Nondiscrimination Act, these laws share one exception. Employers are allowed to collect data from “voluntary” workplace programs, many of

which use digital devices and websites that track private behavior. Even if the data is used illegally, it will be hard to prove it wasn’t obtained legally. Thirdly, new technologies may have adverse health impacts if they are used without medical oversight, construed as a medical device, or are tied to a medical diagnosis or treatment without demonstrating necessary efficacy. By one estimate, 70 percent of these devices share user information without encryption. Also, the digital health movement may wind up penalizing those who do not use or understand it. Employers may reward those who use it to the detriment of those who do not. Instead of starting endless investigations, Congress needs to start doing its job and update existing laws or write new ones that will protect the people they are supposed to represent from harm from emerging and new technologies. Tax Day (Monday, April 15) is fast approaching. Taxpayers who have not yet filed should be preparing to submit returns or visit tax preparers. While you’re scurrying around to make the deadline, look out for IRS impersonation scams that escalate during tax season and put taxpayers at risk. In these schemes, callers impersonate IRS agents. They provide false names and badge numbers and can alter their phone number to make caller ID display that the call is coming from the IRS. Victims are told often in a threatening manner that they owe money to the IRS and must pay promptly. These scams frequently target the elderly, students, and recent immigrants.

In one scam, a fake “IRS agent” calls and tells the victim that she owes delinquent taxes, and demands that she pay immediately by prepaid debit card, gift card, or wire transfer. The caller threatens arrest, deportation, fines, or suspension of a business or driver’s license in the event the victim doesn’t comply. In another scheme, a scammer calls and tells the victim that he can obtain a tax refund for her. The scammer asks for banking and other personal information, and then uses it to commit identity theft. In another variant, a fraudster calls, gets the victim’s personal info, files for a refund, supposedly on her behalf, but routes it to a fraudulent account. Yet another phone scam targets students, involving impersonators demanding payment for a fabricated “Federal Student Tax.” If the victim does not agree to pay, the impersonator says he will report the student to the police.

Scammers even call attempting to “verify” tax return information. Another common impersonation scam involves fake IRS emails from thieves pretending to be the IRS. In these “phishing” schemes, scammers use the IRS name, logo, fake employee names and badge numbers to steal taxpayers’ money and identities. Some emails link to authentic-looking sham websites. The scammers’ intent is to entice you to give up personal information online that they will use for identity theft. The IRS advises that it will never: • Call about delinquent taxes or to demand payment without having mailed a bill first; • Threaten to call law enforcement immediately to arrest you; • Demand that you pay tax without providing the opportunity to question or appeal the amount it claims you owe; • Require you to use a specific payment method, such as a prepaid debit card; or

• Request credit or debit card numbers by phone. If you get a call from someone claiming to be from the IRS asking for money, the IRS advises that you should not give out any information and should hang up immediately. Contact the Treasury Inspector General to report the call through https://www. treasury.gov/tigta/contact_report_scam.shtml or by calling 800-366-4484. Report the scam to the FTC through FTC.gov by filing a consumer complaint. If you think you might owe taxes or need tax assistance, call the IRS at 800-829-1040. If you get a phishing email, don’t reply or provide any information. The IRS advises it will never initiate contact via email about a bill or refund. Forward the email to phishing@irs.gov and then delete it. Don’t open attachments or click on links. Impersonation schemes top the IRS’s Dirty Dozen list of tax scams. Stay alert. Scams can occur any time of year, not just at tax time.

HOW NY IRISH CHANGED TRAFFIC LAWS - 1925 By Katie Lucev

The City of Syracuse, New York installed a traffic signal at the main intersection of Tompkins Street and Milton Avenue in 1925. Irish families had settled on Tipperary Hill for almost 100 years previous, but the deep-rooted, politically-fueled resentment that many Irish felt toward Britain hadn’t faded a bit. The idea that a red light appeared above the green on the traffic signal was interpreted by many in the neighborhood to mean that Britain (red) was in some way superior to Ireland (green). Neighborhood pride rallied immediately and the red light of the traffic signal was knocked out by thrown rocks repeatedly.

Therefore, a red-on-bottom traffic light in Tipperary Hill, Syracuse, NY was installed. A local alderman named, John “Huckle� Ryan proposed that the green and red light positions in the signal be switched, so green would appear above the red and the Irish pride would be put to ease. The town agreed that it was a good solution and it worked perfectly until the State of New York overruled the idea and made them change it back. State officials highly underestimated the hubris of the neighborhood, because taking away the solution only caused the vandals to become even more enraged than before, and the light was broken each time it was replaced.

Finally, on March 17, 1928, a meeting took place with local residents and city officials, where the residents stated in no uncertain terms that the light would continue to be broken if it remained with the red appearing above the green in the signal. Government officials caved, and the light was changed back to showing green on top, yellow in the center, and red on the bottom, the configuration that remains to this day. We start with our palms facing up and hearts open to what is present in the moment. This is a gesture of

Plan on Less Anxiety Dear Enchantress, I’m a planner, I plan everything. My husband and I planned our whole life on our second date. I planned having my kids and everything in between. It used to be fun to plan with my husband, I’ll leave him out of it for now, this is all about me. My planning has turned into anxiety. My daughters are annoyed at me for asking about their plans and their planning. They are in their 20s now, so I’m not planning that much for them anymore. When we do have to plan something together, they are aloof and tend to ignore or walk away from me. Then my heart races and I cannot stop obsessing. HELP! Dear Anxious Annie, Anxiety is a major issue for, dare I say ALL women? It’s our own individual thoughts, the input from local and national and world news, and the lives of those we care about. Raising children, especially daughters, these days can be understandably overwhelming. It’s a passion of mine to help women who suffer from anxiety, learn to manage it. It may never go away, but you can absolutely work with it so it doesn’t overwhelm you with overwhelm. I have some great videos on Youtube.com/EnchantressShane that give you tools to use ASAP, and my e-book, “From Anxiety to Ease, The Feminine Way.” I offer activities to work with anxiety in under 10 minutes. If you email me, I’ll send you a copy if you want it. So, the first step is ALWAYS, notice. Notice as soon as your mind begins to race or contemplate an unknown future event. The future thinking, (if not pleasant) is fear inducing.

Next step is move. Depending on how you feel about movement, it could be as minimal as doing a tense and release of your body, or body parts, (face, hands, shoulders and feet are a good start, one or all) or shake your body out, like animals do, after having stress. A mantra that I love, (a phrase or sentence that helps redirect your mind), is “All is well, I am ok.” So when your thoughts are spinning, you can say this out loud, in whispers to begin, use it in your conversations when people ask you mindlessly, “how are you?,” that is your new response. I hear so many women answering the mindless, “how are you?,” by sharing ALL of what’s going on, and that induces more anxiety because not everyone who asks, is actually listening. Recap of Champ Up Speech at St. Camillus in Rockaway Beach Former Muay Thai champion, author, coach, and CROM owner, Chris Romulo presented his Champ UP message on Thursday, March 7 at St. Camillus. He spoke to fifth- through eighth-grade students about the importance of getting back up when life puts you down. Romulo started off by telling the children that he was there to show them how to fight, but not with their hands and feet, but how to fight with their minds, the most important weapon of all. He stressed that we all have champions inside of us fighting to win at life. Romulo explained to the students that there’s nothing that he did in his life that they can’t do in theirs, but it takes change—change of action, change of their environment, change of the people around them, but most importantly, change of their mindset. He showed the students how he accomplished many great things in his life like winning championship titles, build-

ing his own gym with over 300 members, authoring his own book, and starting and growing his own loving family. He made it clear to the kids that all of that didn’t come without a price and that he fell down numerous times in pursuit of his goals and dreams. During his interactive presentation, students battled

self-doubt, fear, and ego by jumping on stage with Romulo to show off their basketball and dancing skills—helping the kids understand that life is a fight and that we all have a primal choice. “Only you can decide to lay down and give up or stand and fight with all your heart.” Romulo’s lesson comes at a bittersweet time. The Board of Members and Board of Directors of St. Camillus Catholic Academy have voted to close the school at the end of this school year. The difficult decision was made due to declining enrollment and the severe budget deficits that have resulted. With the announced closing of St. Camillus, Romulo believes that his presentation not only addressed the challenges of cyberbullying, but has also helped the students and staff understand no matter how much disappointment and hardship one faces, we can all use it as fuel to move forward in life.

Romulo’s appearance was sponsored by the Program for the Development of the Human Potential, more commonly known as PDHP, founded in the mid-1970s. PDHP is the drug, alcohol, and gambling prevention program that services the students in the Catholic elementary and high schools in the boroughs of Brooklyn and Queens. It is an organization that is part of the Department of Education, Diocese of Brooklyn and receives its funding from NYS Office of Alcoholism and Substance Abuse Services.

Turkey Meatloaf with Spinach, Garlic and Ricotta Salata By Sharon Feldman

Serves: 4 Ingredients: 1 pound of ground turkey ½ sweet onion, finely chopped 3-4 handfuls of baby spinach, chopped ½ cup garlic ricotta salata cheese, cubed 4-5 cloves garlic, diced 1 egg ¼ cup seasoned panko crumbs Salt and pepper to taste 2 tablespoons unsalted butter 1 tablespoon olive oil Directions: Heat butter and oil in large pan. Add onions and cook until translucent. Add the garlic and stir, cooking another minute.

The Rockaway Times Season with salt and pepper. Add the spinach until it starts to wilt. Mix all together and remove from heat. In a large bowl, add the ground turkey, one egg and ¼ cup panko crumbs. Mix thoroughly. When the pan mixture is a little cooler, combine with the turkey mixture. Use your hands to mix it through, but do not over mix. Add 1/2 cup ricotta salata cheese. Mix. Lightly oil a rimmed baking sheet (or 9-inch by 13-inch baking pan) lined with aluminum foil or parchment paper or use a loaf pan. Pour the mixture on to the pan and make a loaf. Put in preheated 350-degree oven. Cook uncovered for one hour. The turkey loaf should read at 165 degrees. Enjoy!

Freeze For a Reason at Riis By Katie McFadden

The weather might not be quite warm enough for an ocean dip, but doing it for a good cause may be good enough to warm your heart. The Freezin’ For a Reason polar plunge for Special Olympics New York is next weekend. On Saturday, March 23 at noon, hundreds will jump into the chilly ocean at Riis Park Bay 9 to raise money for a good cause. Now in it’s fifth year, the Queens Polar Plunge aims to raise money for Special Olympics athletes across New York. “We serve individuals with intellectual disabilities and provide them with opportunities to train and compete in 22 Olympic-style sports. Through New York, we have 71,000 athletes in the program, with 40,000 of

those in New York City. So we raise money so that the athletes and their families are never charged to participate,” Pamela Parker, associate director of development for Special Olympics New York said. In past years, the event has raised more than $50,000. Passing the $50,000 mark is a big goal, as according to Parker, with at least that much, 125 athletes can participate in one sport for one season. “It costs $400 per athlete per season in one sport and most participate

in multiple sports throughout the year. So it’s important that we raise as much as possible so we can continue supporting our current athletes and bring new athletes to our program,” Parker said. Fundraising for the event is off to a positive, but slow start, with about $12,000 raised as we go to press. So far the top individual fundraiser is Thomas Quinn, who has raised more than $1,200. The top team, raising more than $2,700, is the Cross Island Plungers,

made up of members of the Cross Island YMCA, which hosts programs for athletes with special needs. All are welcome to participate in Saturday’s plunge and there’s still time to register online or in person. Day-of registration begins at 10 a.m. at Bay 9 in Riis Park (in front of Riis Park Beach Bazaar). Any dollar raised helps, but plungers are encouraged to raise a minimum of $100, plus there are many great incentives for raising higher amounts. Those too chicken to plunge are encouraged to show up and cheer the plungers on. Those who want to volunteer to help with the event are also welcome and can contact Parker at pparker@nyso.org or 646-491-6035.
