

Supreme Court considers legality of law banning ‘venue shopping’ in constitutional challenges
Case stems from a claim against unrelated firearms regulation

The Illinois Supreme Court on Wednesday heard arguments in a case centered on whether a state law passed in 2023 violates the due process rights of Illinoisans outside Sangamon and Cook counties.
A 2023 law restricts certain types of lawsuits – namely challenges to a law’s constitutionality – to courts in those two counties. The law came in response to challenges to the state’s COVID-19 response, a state law ending cash bail and the state’s ban on assault weapons, among others.
These lawsuits – often filed in jurisdictions with sympathetic judges – became a way for some conservatives to make a name for themselves at the state level. Former governor candidate and state Sen. Darren Bailey, R-Xenia, and former attorney general candidate Thomas DeVore both backed high-profile lawsuits challenging the constitutionality of state laws.
“There has been considerable judge shopping as a tactic that has been used by litigants to secure sweeping court orders blocking state policies by steering cases to judges perceived to be sympathetic to these causes,” the bill’s sponsor, Rep. Jay Hoffman, D-Swansea, said during debate over the bill two years ago.
The practice of choosing where to file a lawsuit based on a judge’s record or



political leanings is sometimes called “forum shopping” or “venue shopping.”
In March 2024, the Judicial Conference of the United States – which makes policy for federal courts – moved to require random judge assignments for civil cases in federal court that might bar or mandate government action.
The case before the Illinois Supreme Court was brought by Piasa Armory, an East Alton gun store. It challenged the constitutionality of an unrelated firearms regulation, the Firearm Industry Responsibility Act, which was also signed into law in 2023. That law subjects firearms groups to civil penalties for violating consumer protection laws.
Piasa Armory almost immediately filed a lawsuit challenging that law in Madison County, about a 30-minute drive from the gun store. The state then tried to move the case to Sangamon County – about 90 minutes from East Alton – citing the then-new law.
But a Madison County judge rejected the state’s attempt to move the case, saying that the law violated the due process rights of residents of other counties by “depriving” them of their ability to mount their best possible case.
“The Circuit Court did so on the thinnest possible record,” Deputy Solicitor General Alex Hemmer argued on behalf of the state. “Two declarations asserting that it would be more quote ‘convenient’ to litigate this case in Madison County rather than here in Sangamon County, an additional hour away. That showing cannot be enough to establish that a venue rule violates the due process clause.”






Hemmer said the court should “at minimum” rule narrowly against Piasa Armory based on the record of the case, although the state “would welcome” an opinion on the law’s constitutionality.
More broadly, the state argued that the law falls within the bounds of other laws that restrict where certain types of lawsuits can be filed. These “venue statutes” are generally constitutional under a 1990 Illinois case Williams v. Illinois State Scholarship Commission. That case carves an exception for laws that are “so arbitrary and unreasonable as to deprive defendants of due process.”
“The Supreme Court has never held — or even hinted — that a State could impair a litigant’s right of access to courts simply by setting venue in an inconvenient forum,” the state argued in a written brief.
In oral arguments, Hemmer also hinted at the policy implications of striking down the law, noting that the large number of COVID-related constitutional cases caused “chaos and uncertainty.”
Piasa Armory, represented by Thomas Maag, pointed to the same decision and the same federal legal test around due process as to why the state’s venue law is inappropriate.
“It is far more difficult to litigate hours away from your home forum than it is in your home forum, especially when there’s no compelling interest or reason to force you to litigate in a foreign jurisdiction or in a foreign county,” Maag said Wednesday.
Maag’s written briefs also noted that the Williams court case allows a court to strike down venue statutes when “constitutional provisions are violated.”
Several advocacy groups filed “friend of the court” briefs presenting arguments about a related legal doctrine allowing judges to dismiss cases that could be more conveniently heard somewhere else that some hope to see overturned.
The case is now under review by the court, which has not indicated when it will release a decision.

Exploring the Land of Lincoln

If you’ve spent any time in Illinois, then you know that Abraham Lincoln is revered here. Many historians regard him as the greatest American President, given that he saved the union and helped free millions of enslaved people. He was one of the most eloquent Presidents and one of the world’s most studied figures of the Nineteenth Century.
Lincoln spent most of his adult years in Central Illinois, first at New Salem, and later as a lawyer in Springfield. One of his principal legal clients was the Illinois Central Railroad. He was married to Mary Todd and the father of four children. By every indication, Lincoln was successful and prospered in Illinois, despite his humble upbringing in Indiana and Kentucky.
Given the homage paid to Lincoln after he was assassinated, it may come as a surprise that Lincoln was not a particularly popular President while he was in office. He won a four-way race for the Presidency in 1860. While President, he was frequently criticized by both the left and the right. His cabinet meetings were often stormy affairs, particularly when it came to the timing and issuing of the
Emancipation Proclamation. Moreover, several modern-day historians have taken a more derogatory tone toward Lincoln and discussed his perceived shortcomings at length. A trip to Springfield provides some perspective.
If you have ever wanted to know more about Illinois’ favorite son, it might seem difficult to know where to start.
There are many monuments to Lincoln. One could spend days in the Springfield area checking out the Lincoln sites, not to mention others scattered throughout Illinois and beyond.
For a day trip, I suggest visiting three sites in Springfield. Lincoln’s home, his tomb, and the Abraham Lincoln Presidential Museum. If time permits, the Presidential Library is just across the street from the museum. Springfield is about a three-hour drive from Northern Illinois, and while it makes for a long day, one gets a good look at the 16th President. All three destinations are a short drive from each other. Arriving early at the Lincoln Home is advisable, as wait times for the free tour can increase as the day goes on, and, at peak times, the tours sell out.
Start at the Lincoln Tomb State Historic Site in Oak Ridge Cemetery, 1500
Monument Avenue. Lincoln’s tomb is a huge granite structure, with an inside gallery containing replicas of many Lincoln statues. Lincoln, his wife and three of his four children are buried here. The grandeur of the tomb reflects the public respect for Lincoln after his assassination. Because of Lincoln’s grave, this is the second-most visited cemetery in the US.
Next is the Lincoln Home National Historic Site, 426 South Seventh Street. The site, operated by the National Park Service, contains a two-block square around the home, consisting of several historic homes. Lincoln moved to this home in 1846. At the time, he was married with one son and practicing law. Initially, the home was much smaller, originally resembling the house which sits to the south across the street. Lincoln expanded the house several times, employed servants, and bought his wife a top-of-the-line stove for the kitchen. The Lincolns lived in the home until he was elected President in 1860.
The third stop is the Abraham Lincoln Presidential Museum at 212 North Sixth Street in Downtown Springfield. The museum is an independent state agency. Its campus consists of three
buildings, the museum, library, and the original Springfield Union Station. The museum contains life size dioramas of various times in Lincoln’s life. The museum’s permanent exhibits are divided into two stages of the president’s life, called “Journey One: The Pre-Presidential Years”, and “Journey Two: The Presidential Years.” Journey One feels selective in what it covers, and it seems like there are gaps in the story. Despite being one of the most visited Presidential museum/libraries, the museum has attracted some controversy for “21st Century showmanship techniques,” and been called “Six Flags Over Lincoln.” The museum has been accused of allowing showmanship to trivialize the subject and collection. An example of this controversy is an exhibit discussing the election of 1860, presented by Tim Russert in a fictional, televised format. Regardless of how you feel about the presentations, after this agenda, one will leave Springfield with a greatly expanded knowledge of Abraham Lincoln. Museum admission is $15. Admission to the home and tomb are free. All three sites are open daily.

Rise in diagnoses is prompting more US adults to ask: ‘Do I have ADHD?’

NEW YORK (AP) — Allison Burk’s teenage daughter struggled with uncontrolled emotions, a shrinking attention span and a growing tendency to procrastinate. A family doctor suggested ADHD testing, which led to an unexpected discovery: The teen had ADHD, and Burk did too.

During her daughter’s evaluation, Burk thought, “Wait a minute. This sounds familiar,” she recalled.
“I was able to piece together that this might be something I was experiencing,” said Burk, of Columbus, Ohio. She subsequently underwent her own testing and was diagnosed with ADHD — at age 42.
More adults are being diagnosed with attention-deficit/hyperactivity disorder. Diagnoses have been rising for decades but seem to have accelerated in the last few years.
A recent study suggested that more than 15 million U.S. adults — roughly 1 in 17 — have been diagnosed with ADHD. The condition always starts in childhood, but about half of adults with it are diagnosed when they are 18 or older.
Some doctors say the number of people coming in for evaluation is skyrocketing.




“Just in our clinic, requests for assessments have doubled in the last two years,” said Justin Barterian, a psychologist based at Ohio State University.
Here’s a look at the phenomenon, and how to know if you might have the condition.
ADHD symptoms in adults
ADHD makes it hard for people to pay attention and control impulsive behaviors. It can be inherited, and is often treated with drugs, behavioral therapy, or both.
“It’s like there’s an engine in you and you feel like it’s always running, and you can’t turn it off except with medication,” said Judy Sandler, a 62-year-old Maine woman who was diagnosed in her 50s.
ADHD has been called the most commonly diagnosed mental health disorder in U.S. children, with more than 7 million kids diagnosed. Historically, it was thought to mainly affect boys (perhaps because boys with ADHD were seen as more disruptive in school) and to be something that kids grew out of.
But experts believe many people aren’t diagnosed as kids and live with symptoms into adulthood.
Adults with the condition talk about having trouble focusing on tasks, juggling responsibilities, and planning and managing their time. Some talk about not putting things away, and straining personal relationships with their restlessness, mood swings and impulsiveness.
Burk said she was grouped with talented and gifted students in grade school but didn’t complete college until her 30s because, “when I was 19, I hitchhiked across the country on a whim” and ended up a single mother in her early 20s. She now works in marketing and media relations for Ohio State University’s College of Veterinary Medicine.
Diagnoses have been rising
Diagnoses have been climbing in both kids and adults, and the recent government report found adult ADHD was more common than earlier estimates.
“We haven’t had (federal) adult ADHD data in a long time,” said one of the study’s authors, Angelika Claussen of the Centers for Disease Control and Prevention.
There were indicators of the rise, she added. Increasing demand for ADHD medication led to widespread shortages after the COVID-19 pandemic hit in March 2020. A 2023 study showed the rise in prescriptions was particularly notable in adults — especially women.
ADHD diagnoses and prescriptions were increasing before the pandemic, due partly to a change in general diagnostic criteria in 2013 that broadened the definition of ADHD and reduced the number of symptoms a patient needed to have.
But case counts really seemed to jump in 2020, when schools were closed and many adults were forced to work from home.
“It’s very difficult to focus when you are home and you have kids,” Claussen said. “That may have exacerbated the symptoms for people who’d had mild ADHD but were able to cope” before the pandemic.
How ADHD is diagnosed in adults
The last few years have seen growing cultural acceptance and curiosity about
the condition, fueled by a proliferation of “I have ADHD” social media videos and online medical start-up companies offering 5-minute diagnostic quizzes.
Indeed, the long-held belief that ADHD was underdiagnosed in adults has given way to recent debates about whether it’s become overdiagnosed.
There’s no blood test or brain scan for ADHD. Experts say it is diagnosed when symptoms are severe enough to cause ongoing problems in more than one area of life, and when those symptoms can be traced to pre-adolescent childhood.
Ideally, a psychologist or psychiatrist diagnoses it by taking careful histories from patients and from people who know them, experts say. They also might ask patients to take tests designed to check their memory and ability to concentrate. Doctors also must rule out anxiety, depression and other conditions that can have similar symptoms.
But getting an appointment with a mental health professional can take months, and intensive ADHD evaluations can cost thousands of dollars. Many patients turn to family doctors or even online diagnostic quizzes, some of them connected to telehealth companies that prescribe medications.
“There is wide variability in this country in how people diagnose, how strict they are, and who they diagnose,” said Margaret Sibley, a University of Washington psychologist.
The American Professional Society of ADHD and Related Disorders is drafting a first national set of diagnosis and treatment guidelines for health professionals who treat adults, and expects to release them later this year.
The goal is “to improve the accuracy of diagnoses in this country,” said Sibley, who is leading the work on the guidelines.

Code 662, which does not exceed the maximum rate authorized by the Bond Authorization Act, as amended, 30 ILCS 305/0.01 et seq., at the time of the issuance of the loan; and WHEREAS, the principal and interest payment shall be payable semi-annually, and the loan shall mature in 30 years, which is within the period of useful life of the Project; and WHEREAS, the costs are expected to be paid for with a loan to the NORTH PARK PUBLIC WATER DISTRICT from the Public Water Supply Loan Program through the
Illinois Environmental Protection Agency, the loan to be repaid from revenues of the system and the loan is authorized to be accepted at this time pursuant to the Act; and WHEREAS, in accordance with the provisions of the Act, the NORTH PARK PUBLIC WATER DISTRICT is authorized to borrow funds from the Public Water Supply Loan Program in the aggregate principal amount of $69,000,000 to provide funds to pay the costs of the Project; and WHEREAS, the loan to the NORTH PARK PUBLIC WATER DISTRICT shall be made pursuant to a Loan Agreement, including certain terms and conditions between the NORTH PARK PUBLIC WATER DISTRICT and the Illinois Environmental Protection Agency; NOW THEREFORE, be it ordained by the Corporate Authorities of the NORTH PARK PUBLIC WATER DISTRICT of Machesney Park, Winnebago County, Illinois, as follows:
SECTION
1. INCORPORATION OF PREAMBLES
The Corporate Authorities hereby find that the recitals contained in the preambles are true and correct and incorporate them into this Ordinance by this reference.
SECTION 2.
DETERMINATION TO BORROW FUNDS
It is necessary and in the best interests of the NORTH PARK PUBLIC WATER DISTRICT to construct the Project for the public health, safety, and welfare, in accordance with the plans and specifications, as described; that the System continues to be operated in accordance with the provisions of the Illinois Environmental Protection Act, 415 ILCS 5/1 et seq.; and that for the purpose of constructing the Project, it is hereby authorized that funds be borrowed by the NORTH PARK PUBLIC WATER DISTRICT in the aggregate principal amount (which can include construction period interest financed over the term of the loan) not to exceed $69,000,000.
SECTION 3. ADDITIONAL ORDINANCES
The Corporate Authorities may adopt additional ordinances or proceedings supplementing or amending this Ordinance, providing for entering into the Loan Agreement with the Illinois Environmental Protection Agency, prescribing all the details of the Loan Agreement, and providing for the collection, segregation and distribution of the revenues of the System, so long as the maximum amount of the Loan Agreement as set forth in this Ordinance is not exceeded and there is no material change in the project or purposes described herein. Any additional ordinances or proceedings shall in all instances become effective in accordance with the Act or other applicable laws. This Ordinance, together with such additional ordinances or proceedings, shall constitute complete authority for entering into the Loan Agreement under applicable law.
However, notwithstanding the above, the NORTH PARK PUBLIC WATER DISTRICT may not adopt additional ordinances or amendments which provide for any substantive or material change in the scope and intent of this Ordinance, including but not limited to interest rate, preference or priority of any other ordinance with this Ordinance, parity of any other ordinance with this Ordinance, or otherwise alter or impair the obligation of the NORTH PARK PUBLIC WATER DISTRICT to pay the principal and interest due to the Public Water Supply Loan Program without the written consent of the Illinois Environmental Protection Agency.
SECTION 4. LOAN NOT INDEBTEDNESS OF NORTH PARK PUBLIC WATER DISTRICT
Repayment of the loan to the Illinois Environmental Protection Agency by the NORTH PARK PUBLIC WATER DISTRICT pursuant to this Ordinance is to be solely from the revenue derived from the revenues of the System, and the loan does not constitute an indebtedness of the NORTH PARK PUBLIC WATER DISTRICT within the meaning of any constitutional or statutory limitation.
SECTION 5. APPLICATION FOR LOAN
The Chief Executive Officer is hereby authorized to make application to the Illinois Environmental Protection Agency for a loan through the Public Water Supply Loan Program, in accordance with the loan requirements set out in 35 Ill. Adm. Code 662.
SECTION 6. ACCEPTANCE OF LOAN AGREEMENT
The Corporate Authorities hereby authorize acceptance of the offer of a loan through the Public Water Supply Loan Program, including all terms and conditions of the Loan Agreement as well as all special conditions contained therein and made a part thereof by reference. The Corporate Authorities further agree that the loan funds awarded shall be used solely for the purposes of the project as approved by the Illinois Environmental Protection Agency in accordance with the terms and conditions of the Loan Agreement.
SECTION 7. OUTSTANDING BONDS
The NORTH PARK PUBLIC WATER DISTRICT has no outstanding bonds that are payable from revenues of the system.
SECTION 8. AUTHORIZATION OF CHIEF EXECUTIVE OFFICER TO EXECUTE LOAN AGREEMENT
The Chief Executive Officer is hereby authorized and directed to execute the Loan Agreement with the Illinois Environmental Protection Agency. The Corporate Authorities may authorize by resolution a person other than the Chief Executive Officer for the sole purpose of authorizing or executing any documents associated with payment requests or reimbursements from the Illinois Environmental Protection Agency in connection with this loan.
SECTION 9. SEVERABILITY
If any section, paragraph, clause or provision of this Ordinance is held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this Ordinance.
SECTION 10. REPEALER
All ordinances, resolutions, orders, or parts thereof, which conflict with the provisions of this Ordinance, to the extent of such conflict, are hereby repealed.
