State Supreme Court reviewing FOID law constitutionality White County case draws national attention from gun rights and gun control advocates By Peter Hancock

SPRINGFIELD – The Illinois Supreme Court is being asked for a second time to decide whether a state law requiring gun owners to have a firearm permit is unconstitutional – a question the court previously declined to answer. The case involves a White County resident, Vivian Claudine Brown, who was charged in March 2017 with possession of a firearm without a Firearm Owner’s Identification, or FOID card. The charge was filed after her husband had called the White County Sheriff’s Office to report that she had fired a gun in their home. When officers arrived, they found a rifle beside her bed but no evidence that she had fired it. Nonetheless, she was charged with the crime. But a circuit judge in White County threw out the charge, saying the Illinois law requiring potential gun owners to fill out a form, provide a picture ID, undergo a background check and pay a $10 fee to obtain a FOID card was unconstitutional, at least as it applied to Brown. The judge said it imposed a burden on Brown’s Second Amendment right to keep a firearm in her own home for self-defense. The circuit court went on to say, even though Brown’s attorneys never raised the issue, that it is impossible to comply with the act in one’s own home. That’s because it would mean anybody who had knowledge of a firearm in the home and exclusive control over the area where it was kept could be construed as possessing the gun and therefore would have to have their FOID card on their person 24 hours a day. The state appealed that decision directly to the state Supreme Court, but in April 2020, the high court declined to answer the question of the law’s constitutionality. Instead, it said the White County court had rushed to rule on the law’s constitutionality when it could have decided the case on other grounds, namely that the General Assembly never intended the FOID Card Act to apply in the home. The Supreme Court then sent the case back to White County with instructions to enter a modified order that did not touch on the constitutionality question. The White County court did that, but then in an unusual move, Brown’s
attorneys asked the court to reconsider, arguing that the modified order forced Brown to take a position she didn’t want to take and one that would ultimately be overturned on appeal, thus delaying any final resolution of the case, possibly for years. The circuit court agreed and reinstated the charges against her. Brown’s attorneys then filed a new motion to dismiss on constitutional grounds. The judge then upheld that motion, finding that “any fee associated with exercising the core fundamental Constitutional right of armed self-defense within the confines of one’s home violates the Second Amendment.” The state then appealed that decision back to the Illinois Supreme Court. During oral arguments Wednesday, Assistant Attorney General Garson Fischer argued that the law imposes only a minimal burden on people wishing to own firearms and it serves a legitimate state interest of keeping guns out of the hands of felons and mentally ill individuals. “It imposes a de minimis burden on law-abiding citizens to allow the state to determine whether they are, in fact, a law-abiding citizen who has the absolute right to possess a firearm in their home for self-defense, or falls into one of these high-risk categories,” he said. “The FOID Card Act is the mechanism by which the state answers that question.” Fischer also noted that Brown never applied for a FOID card in the first place and therefore should not be allowed to argue that the law was overly burdensome. Appellate defense attorney David Sigale, however, argued that the law imposes a significant burden because it provides for criminal penalties against those who don’t comply, even if they are otherwise entitled under state and federal law to own a firearm. In addition, he argued that the law is duplicative because there are already state and federal laws prohibiting people with felony convictions or certain kinds of mental illness from owning a gun. He also noted that the screening process the state uses to determine whether someone falls into one of those categories is fallible, which results in people who are eligible for a FOID card having to file appeals, and sometimes even hire attorneys, to overturn a wrongful denial. “So the burden is not de minimis, and the effect is not de minimis,” Sigale said. “It is not quick, it is not easy.” Some of the justices, however, still
seemed to question whether the Supreme Court even needs to address the constitutional question. Chief Justice Anne Burke questioned why Brown’s attorneys asked the White County court to reconsider a decision that effectively dropped the charges against her. “Is it ethical for a criminal defense attorney to move to vacate an order that grants his client complete relief?” she asked. Attorneys on both sides, however, argued that it was because the order that the White County judge would have issued – dismissing the charge on the grounds that the FOID Card Act doesn’t apply to possessing a gun in one’s own home – probably would not stand on appeal. Justice Mary Jane Theis also hinted that the court could send the case back to White County as it did before. She then asked Sigale what his ethical obligation would be in defending Brown before an appellate court if the White County court dismissed the charge on statutory grounds and the state appealed to the Fifth District Court of Appeals. “I guess, at best, I would have to say something ethically along the lines of, if the Fifth District agrees with the position of the circuit court and that original order, then we’ll take the dismissal and go home,” Sigale said. “But I would not argue that the trial court was correct.” The court took the case under advisement but did not indicate how long it might take to issue a decision. The case has drawn the attention of national gun control advocates such as the Giffords Law Center to Prevent Gun Violence and Everytown for Gun safety, along with gun rights advocacy groups like Guns Save Life Inc., and the Firearms Policy Foundation, all of whom submitted or contributed to amicus briefs in the case. The city of Chicago and Cook County also filed an amicus brief in support of the FOID law, saying it has been an effective tool in helping them combat gun violence. Hearing opens for Jackson with pointed comments from GOP By Mark Sherman and Mary Clare Jalonick Associated Press
WASHINGTON (AP) — The Senate Judiciary Committee opened Supreme Court confirmation hearings Monday, with Republicans promising pointed questions for Judge Ketanji Brown Jackson and Democrats full of praise for the first Black woman nominated for the nation’s highest court. Jackson, 51, was to give her opening statement later Monday and answer questions on Tuesday and Wednesday from the panel’s 11 Democratic and 11 Republican senators. Barring a significant misstep by the 51-year-old Jackson, a federal judge for the past nine years, Democrats who control the Senate by the slimmest of margins intend to wrap up her confirmation before Easter. She would be the third Black justice, after Thurgood Marshall and Clarence Thomas, as well as the first Black woman on the high court. “It’s not easy being the first. Often, you have to be the best, in some ways the bravest,” Democratic Sen. Dick Durbin of Illinois, the committee chairman, said in support shortly after the proceedings began. Democrats sought to preemptively rebut Republican criticism of her record on criminal matters as a judge and before that, as a federal public defender and a member of the U.S. Sentencing Commission. “Judge Jackson is not anti-law enforcement. She’s not soft on crime,” Sen. Pat Leahy, D-Vt., said, noting that members of Jackson’s family have worked in law enforcement. The committee’s senior Republican, Sen. Chuck Grassley of Iowa, promised Republicans would “ask tough questions about Judge Jackson’s judicial philosophy,” without turning the hearings into a “spectacle.” Sen. Lindsey Graham, R-S.C., noted that Democrats had opposed some past Republican judicial nominees who were Black or Hispanic, and he said that he and his GOP colleagues wouldn’t be deterred from asking probing questions by Jackson’s race. He said of some criticism from the left: “Bottom line here is, It’s about ‘We’re all racist if we ask hard questions.’ That’s not going to fly with us.” Gra ham has voted for pre v ious Democratic nominees for the Supreme Court and was one of three Republicans to support Jackson’s confirmation as an appellate judge last year. But he suggested
he might vote against her this time. Jackson’s testimony will give most Americans, as well as the Senate, their most extensive look yet at the Harvardtrained law yer with a resume that includes two years as a federal public defender. That makes her the first nominee with significant criminal defense experience since Marshall. Jackson will be introduced on Monday by Thomas B. Griffith, a retired judge for the U.S. Court of Appeals for the District of Columbia Circuit, and Lisa M. Fairfax, a professor at the University of Pennsylvania Carey Law School. Jackson appeared before the same committee last year, after President Joe Biden chose her to fill an opening on the federal appeals court in Washington, just down the hill from the Supreme Court. The American Bar Association, which evaluates judicial nominees, on Friday gave Jackson’s its highest rating, unanimously “well qualified.” Janette McCarthy Wallace, general counsel of the NAACP, said she is excited to see a Black woman on the verge of a high court seat. “Representation matters,” Wallace said. “It’s critical to have diverse experience on the bench. It should reflect the rich cultural diversity of this country.” It’s not yet clear how aggressively Republicans will go after Jackson, given that her confirmation would not alter the court’s 6-3 conservative majority. Still, some Republicans have signaled they could use Jackson’s nomination to try to brand Democrats as soft on crime, an emerging theme in GOP midterm election campaigns. Biden has chosen several former public defenders for life-tenured judicial posts. In addition, Jackson served on the U.S. Sentencing Commission, an independent agency created by Congress to reduce disparity in federal prison sentences. Sen. Josh Hawley, R-Mo., highlighted one potential line of attack. “I’ve noticed an alarming pattern when it comes to Judge Jackson’s treatment of sex offenders, especially those preying on children,” Hawley wrote on Twitter last week in a thread that was echoed by the Republican National Committee. Hawley did not raise the issue when he questioned Jackson last year before voting against her appeals court confirmation. The White House pushed back forcefully against the criticism as “toxic and weakly presented misinformation.” Sentencing expert Douglas Berman, an Ohio State law professor, wrote on his blog that Jackson’s record shows she is skeptical of the range
of prison terms recommended for child pornography cases, “but so too were prosecutors in the majority of her cases and so too are district judges nationwide.” Hawley is one of several committee Republicans, along with Sens. Ted Cruz of Texas and Tom Cotton of Arkansas, who are potential 2024 presidential candidates, and their aspirations may collide with other Republicans who would just as soon not pursue a scorched-earth approach to Jackson’s nomination. Biden chose Jackson in February, fulfilling a campaign pledge to nominate a Black woman to the Supreme Court for the first time in American history. She would take the seat of Justice Stephen Breyer, who announced in January that he would retire this summer after 28 years on the court. Jackson once worked as a high court law clerk to Breyer early in her legal career. Democrats are moving quickly to confirm Jackson, even though Breyer’s seat will not officially open until the summer. They have no votes to spare in a 50-50 Senate that they run by virtue of the tiebreaking vote of Vice President Kamala Harris. But they are not moving as fast as Republicans did when they installed Amy Coney Barrett on the court little more than a month after the death of Justice Ruth Bader Ginsburg and days before the 2020 presidential election. Barrett, the third of President Donald Trump’s high court picks, entrenched the court’s conservative majority when she took the place of the liberal Ginsburg. Last year, Jackson won Senate confirmation by a 53-44 vote, with three Republicans supporting her. It’s not clear how many Republicans might vote for her this time. Jackson is married to Patrick Johnson, a surgeon in Washington. They have two daughters, one in college and the other in high school. She is related by marriage to former House Speaker Paul Ryan, R-Wis., who also was the Republican vice presidential nominee in 2012. Ryan has voiced support for Jackson’s nomination. Jackson has spoken about how her children have kept her in touch with reality, even as she has held a judge’s gavel since 2013. In the courtroom, she told an audience in Athens, Georgia, in 2017, “people listen and generally do what I tell them to do.” At home, though, her daughters “make it very clear I know nothing, I should not tell them anything, much less give them any orders, that is, if they talk to me at all,” Jackson said.

All eight of the regional semifinal matchups are set after a wild opening weekend that saw seven double-digit seeds win in the first round and four of them move on. This is the second year in a row a No. 15 seed has captured the imagination of basketball fans. Last year, it was Oral Roberts, which came within a missed 3-pointer at the buzzer from beating Arkansas and going to the Elite Eight. This time, it’s those lovable Saint Peter’s Peacocks, who knocked off Kentucky and Murray State and don’t have a single player that made the All-Metro Atlantic Athletic Conference first team.

The Red Raiders, with first-year coach Mark Adams, made it past the second round for the first time since their run to the 2019 national championship game.

AT&T Center, San Antonio Thursday-Saturday No. 11 Michigan (19-14) will face second-seeded Villanova (28-7) in a rematch of the 2018 national championship game won by the Wildcats. Like Saint Peter’s, the Wolverines are a pretty good story, too. They underperformed in the regular season, coach Juwan Howard was suspended five games for a postgame dust-up with Ohio State and going one-and-done at the Big Ten Tournament made for a nervous Selection Sunday. Here they are in a fifth straight Sweet 16 after rallying to beat Colorado State and then revving up in the second half to knock out third-seeded Tennessee. No. 5 Houston (31-5), despite having been bitten hard by the injury bug this season, just keeps rolling along under Kelvin Sampson and will play Arizona (33-3). It’s the Cougars’ 14th Sweet 16, and third since 2019. The Wildcats nearly got tripped up on their way to the Sweet 16 in coach Tommy Lloyd’s first season. Thanks to a combined 58 points from Bennedict Mathurin and Christian Koloko in an 85-80 overtime win over ninth-seeded TCU, Arizona will be playing on the tournament’s second weekend for the first time since 2016.

United Center, Chicago Friday-Sunday No. 1 seed Kansas (30-6) will face a physical challenge against No. 4 Providence (27-5), which took care of business against South Dakota State and blew out Richmond. The other Midwest semifinal pits two double-digit seeds: No. 11 Iowa State (22-12) against No. 10 Miami (25-10). The Cyclones, who won just two games last season, are in for the first time since 2016 under first-year coach T.J. Otzelberger. They’ve given up just 103 points in two games — 49 in their upset of Wisconsin, the Badgers’ lowest total since 2018. Miami’s 79-61 takedown of No. 2 Auburn puts the Hurricanes in a regional semifinal for the third time under Jim Larrañaga, who would love to recapture the magic of his 2006 George Mason team’s run to the Final Four as a No. 11 seed.

Catching up with photographer Eric Meli By Gary Hill Contributor
Whether you have heard Eric Meli’s name or not, if you follow local bands, you’ve probably seen his photographs. You might have seen him at the local clubs taking those pics. He’s a prolific photographer with a focus on local bands. Full disclosure here, he’s also one of my best friends and a frequent collaborator both at Music Street Journal and in a series of books on local bands we’ve been publishing. I had the chance to pose some questions to him about music, photography and the combination of the two. Gary Hill: You are known among local music circles as a guy who photographs a lot of bands. How did you first get interested in music? Eric Meli: I remember when I was about ten, listing to the a.m. radio and the way the music would make me feel. At about 13 I had a huge 45 collection and then I moved on to buying albums. Nowadays I listen to a wide variety of music. GH: The other end of that equation is the photography component. What prompted your interest in photography and how has it evolved over time? EM: Back in the late ‘80s, early ‘90s I was
working as a delivery helper. One day I was staring out the window, and the driver said “If you like it so much, take a picture of it.” I thought to myself, “That’s a good idea.” So, I got a camera and started shooting whatever looked nice to me. GH: How did you transition into photographing bands? EM: When I was younger, I would see all the photos of bands in magazines like “Rolling Stone” and wished I could do that one day. So, a few years later I gave it a try and was getting what I thought were not so good pics. I stopped for a while and did bands off and on, trying things I would read about. Then about 15 years ago I took some of a band and they loved them. GH: What are some of your favorite concerts you’ve seen (whether you’ve shot them or not), and what was so special about them? EM: Well, Styx - Paradise Theater tour (my first concert) Alice Cooper - always a great show. Albert Collins - one of his last shows was recorded in Rockford and ended up on a CD. Lita Ford also puts on a good show. Also any local Rockford band. We have a lot of great talent in this town. GH: Speaking of those local bands,
since you see a lot of them, who would you suggest to someone not from this area? EM: Well, as I said, there’s a lot of talent in this town and I don’t really like to rank one above the other. Plus, there are a lot I haven’t seen yet. Given that, I would suggest some I like to watch and shoot. The local band AudioDrive is great. They play lots of ‘80s music and makes me feel like I’m at a concert. Also, the band Shifty Shafer does stuff from the ‘60s on up and has a good connection with the audience. If you like ‘80s hair metal, Sunset Strip captures that feel quite well. If you like your music heavy, I would suggest the bands So Called Saints and 99 Proof Devils. GH: How have your photos been received by the acts you shoot? EM: They seem to like them. It’s a thrill to see my photos being shared or used as profile pics. It’s also a good feeling when strangers know who I am from the photos I’ve taken GH: What have been some of the highlights for you in terms of your photography? EM: Shooting some big-name bands, being in a couple of art shows and selling some prints of my landscape photos. I love hearing how much someone likes my photos from seeing them online. Seeing a
photo, I took of Saving Abel being used in an online blog was a really big one for me. GH: What other types of photography do you do beyond music photography? EM: I like to take nature and landscape photos, I also like to mess around with macro shots with flowers, I have done some portrait photography, as well. GH: What advice would you have for people starting to get into photography? EM: Read as much as possible. Learn about the exposure triangle and composition. Also get out and shoot as much as you can. Experiment with different settings. Don’t worry about not getting great pics right away, it takes time and practice. nomination for himself. The best actress category was especially brutal this year, leaving out Lady Gaga for “House of Gucci,” Jennifer Hudson for “Respect” and Caitriona Balfe for “Belfast” and Renate Reinsve for “The Worst Person in the World.”
WHAT ARE THE PREDICTIONS FOR THE WINNERS ON OSCAR NIGHT?
“The Power of the Dog” is the presumed frontrunner for best picture and best director, for Jane Campion, but there is also the possibility that “CODA” will take best picture, especially after it won at the Producer’s Guild Awards. Either way, it’ll be the first time a streaming service has won best picture. Other likely winners include Will Smith for best actor (“King Richard”), Jessica Chastain for best actress (“The Eyes of Tammy Faye”), Troy Kotsur for best supporting actor (“CODA”) and Ariana DeBose for best supporting actress (“West Side Story”).
WHAT ELSE CAN WE EXPECT FROM THE OSCARS?
Organizers have promised that they will keep the broadcast to three hours and Packer (whose films include crowd pleasers like “Girls Trip”) wants to make it as entertaining as possible while still
honoring the nominees and winners. “The show will flow, not unlike a movie, in that there will be different themes and a different feel and different energy throughout the night,” Packer said in an interview with IndieWire. “It will not feel or look or sound like one show for three hours. It’s taking you through the course of this cinematic journey.” Best song nominees like Beyoncé, Van Morrison and Billie Eilish are also in talks to perform.
ARE THERE ANY CONTROVERSIES THIS YEAR?
The Oscars are so high profile that every year someone is upset about something (especially when changes are involved) but this year the biggest controversy is over the decision to present some awards before the live broadcast begins and edit them into the show later. The eight awards are for shorts (live action, animated and documentary), editing, score, hair and makeup, sound and production design. The decision has its defenders, but also an army of high-profile detractors, including Campion, Villeneuve, Steven Spielberg, Chastain and Penelope Cruz.

Getting soil ready for spring BY GRANT MCCARTY CONTRIBUTOR
With spring o�cially here, you are probably thinking about what plants you will grow, seeds you will start, and getting the garden up and running. Your soil will also need to get prepared for the season too. One of the first pieces of advice is to get a soil test. This is especially important if you are planting any perennial plants like fruit trees and brambles. Because these plants will come back season after season, it is important to know what the soil pH is which can limit the productivity of your plants by making soil nutrients
unavailable. In addition, it is very hard to modify a soil pH once your plants have been planted. Established gardens would benefit with an addition of compost. Compost can feed soil microbes as the soil warms up which will then be active and ready to help your plants get the soil nutrients they need once they are planted. Most soil problems like compaction and water infiltration can be addressed with an addition of compost. You want your compost to come into contact with the soil and usually this will mean turning it into the soil. Most composts are very similar in overall quality. If you are growing perennial
plants with an established wood mulch, consider pulling the mulch back, adding compost, and returning the mulch layer. Raised beds can be established before planting. You can build your beds 4-6 weeks before planting. Many home and garden centers will sometimes have a raised bed soil mix (sand, compost, organic matter) that is really designed for raised beds to ensure proper drainage. You may also find bagged mixtures too. An established raised bed would also benefit with an addition of compost. If making new vegetable beds this year, you want to try to reduce your tillage, avoid compaction, keep weeds from germinating,
and add compost to the soil. One method that is used often is a double-dig method. While it requires labor, it can be a way to quickly create a growing without a tiller. There are many guides online that can explain these steps. If using a tiller, you want to focus on those 0-6 inches. Once the bed is tilled, you should come back with compost and rake into the soil. As you can see, whether established for years or a new growing area in 2022, our best recommended practice is to add compost before the season begins. We have written about Earth Hour for several years but some of our friends are still surprised when we talk about it. Experiencing an hour of natural darkness will also allow people to enjoy
the wonder and beauty of the night, stargazing, lighting candles, reading books or sitting near the fireplace. The International Dark Sky Society suggests that people report how many stars they see in the constellations the Little Dipper and Orion that night as opposed to the rest of the year. Earth Hour will also allow people to reconnect with each other without the intrusion of electronic diversions. Urge your community to participate in Earth Hour. Organize your own family and friends. Enjoy an hour together in the natural dark of night, considering and planning how you can do your part. In 2022, Earth Overshoot Day will occur in about four or five months. What would happen if we continued our Earth Hour beliefs, actions and dedication so that Earth Overshoot Day will no longer exist?

For the past 15 years, each year at the end of March, people around the globe observe Earth Hour, the largest grassroots environmental event ever. This year, it will be celebrated on Saturday, March 26. Beginning at 8:30 p.m. local time, and lasting for an hour, lights will go out around the globe in honor of the Earth and as a pledge to do our best to protect and preserve our precious planet. Started in Australia in 2007, it quickly spread through the world. Lights that are not needed for health or safety will be darkened; a rolling blackout travelling round the world that could be seen from space. How much more impressive it would be if the lights stayed out throughout
the night - not only a rolling blackout, a progressive one. Although turning lights o� for only one of the 8,760 hours of the year is a symbolic gesture, it reveals “an unprecedented global mandate for action on climate change.” Earth Hour is a collective statement by people worldwide, showing that they can work together and make a di�erence. Some years ago, a well-meaning friend sent us the photo of Earth from space at night - with densely populated areas brilliantly illuminated. His comment was “This is awesome!” How much more “awesome” to see all of the Earth’s lights, from the Ei�el Tower through the Empire State Building and Chicago’s iconic skyline to the Sydney Opera House extinguished for an hour each – a voluntary rolling blackout by
