Appellate court declines to block enforcement of vaccine, testing mandate Ruling says enforcement of mandates doesn’t equate to quarantine By Peter Hancock

SPRINGFIELD – A state appellate court ruled this week that it will not block enforcement of the Pritzker administration’s mandate that certain categories of public employees either be vaccinated against COVID-19 or undergo regular testing. The 2-1 ruling by the 4th District Court of Appeals upheld a Sangamon County judge’s decision on April 1 not to issue a temporary restraining order blocking enforcement of the policy. The decision involved three consolidated cases in which public employees are seeking to overturn the mandate. The cases include suits against Gov. JB Pritzker, various state agencies, the Pekin Fire Department and the Deland-Weldon school district. Pritzker first issued a vaccine mandate on Aug. 26, 2021, through an executive order that applied to health care workers, school employees, higher education personnel and students, and state employees who work in congregate facilities. The order also authorized other entities, both public and private, to enact their own vaccination and testing requirements. The employees sued to block enforcement of the order citing the state’s Health Care Right of Conscience Act which, among other things, makes it illegal to
discriminate against anyone for refusing to receive any particular form of health care that they find contrary to their conscience. That law was originally enacted to shield health care workers from liability for refusing to perform or assist in abortions. During last year’s fall veto session, however, lawmakers passed an amendment to that law making a specific exception for health care measures that are intended to prevent the spread of COVID-19. That provision does not officially go into effect until June 1. But lawmakers inserted language in the measure stating the section “is a declaration of existing law” rather than a new enactment. In other words, the General Assembly said it was only clarifying something that was ambiguous in an existing law, which in this case involved the word “discriminate.” The Sangamon County circuit court cited that law in denying the plaintiffs’ request for a temporary restraining order, saying that even though it hasn’t taken effect yet, it can still be used as an aid in understanding the original statute. But the plaintiffs appealed, noting that the new law has not yet gone into effect while also arguing that even though the amendment claims to be a declaration of existing law, the legislature cannot retroactively change the meaning of an otherwise unambiguous statute. In their appeal, the plaintiffs cited a 2020 decision from the 2nd District Court of Appeals involving the same statute that said there was nothing ambiguous about the word “discriminate.” “To the contrary, the ordinary meaning

of the word is set forth in its dictionary definition,” the 2nd District court wrote. That case involved a nurse in a public health clinic who claimed religious objections to providing family planning services or referring patients for abortions. In its ruling Wednesday, however, the 4th District appellate court said that simply because a word has a dictionary definition does not make its meaning within a statute unambiguous. In this case, the court said, it would only be discriminatory if an employer punished workers who refused to be vaccinated or tested as a matter of conscience but did not punish those who refused for other reasons. The vaccine and testing requirements, the court wrote, could actually be seen as merit-based policies because those who are vaccinated or tested are less likely to spread COVID-19 in the workplace. The plaintiffs also challenged the vaccine and testing mandates under the Illinois Department of Public Health Act, which gives that agency “supreme authority in matters of quarantine and isolation.” But the appellate court rejected that argument as well, saying that the employers in the three cases had not quarantined or isolated anyone, but had instead only threatened loss of employment. “To be fired is not to be quarantined or isolated from the community at large,” the majority wrote. The opinion was written by Justice Peter Cavanagh, with Justice James Knecht concurring. Justice Robert Steigmann wrote a dissenting opinion. He argued that the word “discriminate” has a clear and understandable meaning and that the legislature included in the statute numerous examples of the kinds of discrimination that are prohibited. He also argued that the 2021 amendment to the Health Care Right of Conscious Act could be used as an “interpretive aid” in understanding the original statute because he found nothing unambiguous about the original law. Russia hits Lviv, prepares for assault in eastern Ukraine By Yuras Karmanau Associated Press
LVIV, Ukraine (AP) — Russian forces launched missile attacks on the western city of Lviv and pounded a multitude of other targets across Ukraine on Monday in what appeared to be an intensified bid to grind down the country’s defenses ahead of an all-out assault on the east. At least seven people were reported killed in Lviv, where plumes of black smoke rose over a city that has seen only sporadic attacks during almost two months of war and has become a haven for civilians fleeing the fighting elsewhere. To the Kremlin’s increasing anger, Lviv has also become a major conduit for NATO-supplied weapons and foreign fighters joining the Ukrainian cause. In other developments, a few thousand Ukrainian troops, by Russia’s estimate, remained holed up at a mammoth steel mill in Mariupol, the last known pocket of resistance in the devastated southern port city after seven weeks of bombardment. The holdouts ignored a surrender ultimatum from the Russians on Sunday. And Ukrainian President Volodymyr Zelenskyy submitted a filled-out questionnaire in the first step toward obtaining accelerated membership in the European Union — a desire that has been a source of irritation to Russia for years. Zelenskyy, though, has offered to drop any effort to join NATO, one of the Kremlin’s key demands. The Russian missile strikes on Lviv hit three military infrastructure facilities and an auto mechanic shop, according to the region’s governor, Maksym Kozytskyy. He said the wounded included a child. Lviv, the biggest city and a major transportation hub in western Ukraine, is about 80 kilometers (50 miles) from Poland, a NATO member. Russia has strongly complained about the increasing flow of Western weapons to Ukraine. On Russian state media, some anchors have charged that the supplies amount to direct Western engagement in the fight against Russia. Lviv has also been seen as a relatively safe place for the elderly, mothers and children trying to escape the war. A hotel sheltering Ukrainians who had fled fighting in other parts of the country was among the buildings badly damaged, Mayor Andriy Sadovyi said. “The nightmare of war has caught up with us even in Lviv,” said Lyudmila Turchak, who fled with two children from the eastern city of Kharkiv. “There is no longer anywhere in Ukraine where we can feel safe.” A powerful explosion also rocked
Vasylkiv, a town south of the capital of Kyiv that is home to a military air base, according to residents. It was not immediately clear what was hit. Kharkiv, Ukraine’s second-largest city, was hit by shelling that killed at least three people, according to Associated Press journalists on the scene. One of the dead was a woman who appeared to be going out to collect water in the rain. She was found lying with a water canister and an umbrella by her side. Military analysts say Russia is increasing its strikes on weapons factories, railways and other infrastructure targets across Ukraine to wear down the country’s ability to resist a major ground offensive in the Donbas, Ukraine’s mostly Russianspeaking eastern industrial heartland. The Russian military said its missiles struck more than 20 military targets in eastern and central Ukraine in the past day, including ammunition depots, command headquarters and groups of troops and vehicles. It also reported that its artillery hit an additional 315 Ukrainian targets and that warplanes conducted 108 strikes on Ukrainian troops and military equipment. The claims could not be independently verified. Over the weekend, Russia also claimed to have destroyed Ukrainian air defense radar equipment. Gen. Richard Dannatt, a former head of the British Army, told Sky News that Russia is waging a “softening-up” campaign ahead of the offensive in the Donbas, whose capture has become the Kremlin’s main goal since its attempt to storm Kyiv failed. “We are doing everything to ensure the defense” of eastern Ukraine, Zelenskyy said in his nightly address to the nation on Sunday. Ukraine halted civilian evacuations for a second day on Monday, saying Russian forces were shelling and blocking the humanitarian corridors. Deputy Prime Minister Iryna Vereshchuk said Ukraine had been negotiating safe passage from cities and towns in eastern and southeastern Ukraine, including Mariupol and other areas in the Donbas. The government of the Luhansk region in the Donbas said four civilians trying to flee were shot and killed by Russian forces. Vereshchuk warned Russia on social media: “Your refusal to open these humanitarian corridors will in the future be a reason to prosecute all involved for war crimes.” The Russians, in turn, accused “neo-Nazi nationalists” in Mariupol of hampering the evacuation.
The capture of Mariupol, where Ukrainians estimate 21,000 people have been killed, is seen as a key step in preparations for any eastern assault since it would free Russian troops up for that new campaign. A pro-Russian Ukrainian politician who was arrested last week on a treason charge appeared in a video offering himself in exchange for the evacuation of Mariupol’s trapped defenders and civilians. Ukraine’s state security services posted the video of Viktor Medvedchuk, the former leader of a pro-Russian opposition party with personal ties to Russian President Vladimir Putin. It was not clear whether Medvedchuk was speaking under duress. Putin, meanwhile, repeated his insistence that the Western sanctions “blitz” against Russia has failed. He said the West has not managed to “provoke panic in the markets, the collapse of the banking system and shortages in stores,” though he acknowledged a sharp increase in consumer prices in Russia, saying they rose 17.5%.

Mass shooting wave rattles communities large and small in US By The Associated Press
Three mass shootings in the U.S. over the Easter holiday weekend capped a monthlong spate of gun violence that has touched both big cities and small, rural communities across the nation. The gunfire has rattled large population centers such as Dallas, Pittsburgh and Sacramento, California, as well as much smaller communities, including Hampton County, South Carolina, which has a population of 18,000, and Dumas, Arkansas, which is home to about 4,000 people. A look at some of the major shootings:
DALLAS, March 19
Ten people were shot at a teen spring break party in Dallas and several others were injured as they tried to escape the chaos. One of the injured, an 18-year-old man, later died of his injuries. The gunfire happened at The Space Dallas event venue. Joe Morgan, who was working crowd control, told reporters that he heard gunshots being fired from outside the venue and later saw people with gunshot wounds to the chest, arms and legs.
DUMAS, Arkansas, March 19
More than two dozen people were hurt and one man was killed when two people got into a gunfight during a car show that’s part of an annual community event. Innocent bystanders were sprayed by gunfire, among them several children, two of whom were under the age of 2, Arkansas State Police Col. Bill Bryant said.
DALLAS, April 3
One person was killed and 15 others were wounded by gunfire during a concert at an outdoor field. The victims ranged in age from 13 to 29, Dallas Police Chief Eddie Garcia said. One person fired a gun into the air, then an argument broke out and another person fired in the crowd’s direction, Garcia said. The event didn’t have a permit, he said.
SACRAMENTO, California, April 3
Six people were killed and 12 wounded outside bars located a few blocks from the state Capitol in a gunfight involving at least five shooters from rival gangs, Sacramento police said. More than 100 rapid-fire gunshots echoed through the streets as terrified patrons ran for their lives and others were hit by bullets. Police said they identified at least five gunmen, but there may have been more. Police said at least two gangs were involved.

A shooting at a nightclub wounded at least nine people. The attack happened at Cara’s Lounge in Hampton County, according to South Carolina’s State Law Enforcement Division. Hampton County is located about 80 miles (130 kilometers) west of Charleston.
PITTSBURGH, April 17
Two teenage boys were killed and at least eight people were wounded when a shooting broke out during a party at a short-term rental property. Pittsburgh Police Chief Scott Schubert said there was gunfire both inside and outside the rental home, “potentially back and forth.” Bullet casings found at the scene indicated handguns and one rifle were used, he said. Police believe there were multiple shooters.
A shooting inside a crowded nightclub in Cedar Rapids left a man and a woman dead and 10 others wounded. More than 100 people were inside the Taboo Nightclub and Lounge at the time, police said. Officers helped treat the people who were wounded and used their squad cars to rush several of the victims to hospitals.
NEW YORK CITY, April 12
A gunman set off smoke bombs and opened fire in a crowded subway car in Brooklyn, wounding 10 commuters and leaving the train car and a subway platform splattered in blood. After a 30-hour manhunt, police arrested a suspect near a McDonald’s on Manhattan’s Lower East Side after a tip led them there. Part of the evidence in the case includes YouTube videos in which the suspect rants about race, violence and his struggles with mental illness.
COLUMBIA, South Carolina, April 16
A gunman opened fire at a busy shopping mall in South Carolina’s capital city, wounding nine people, police said. Five other people were injured while trying to flee the Columbiana Centre. The victims ranged in age from 15 to 73, but none of their injuries was considered life-threatening, Columbia Police Chief W.H. “Skip” Holbrook said Saturday. Investigators

‘Amorous’ exhibition opens at Kortman From Doc Slafkosky

Margret Hynes, John Lamar, and Marilyn Lamar have well established themselves in the Rockford arts community as accomplished artists. The three artists approached the Kortman Gallery with the idea of curating an exhibit featuring local artists creating works art with an erotic theme…a subject rarely explored in the local art scene. From that concept came “Amorous” a group exhibition opening Friday, April 22nd in the Kortman Gallery. Along with Hynes and the Lamars, other participat-
ing artists include Ruth Ebersoll, Nikki Hollander, Javier Jimenez, Ron Rawhoof, and Ted Simmering. “Since mankind began to visually communicate their thoughts, sexually charged images have been used in art, even appearing on prehistoric cave walls,” says co-curator Marilyn Lamar. “However, social constraints have always influenced what is acceptable in the visual arts over the centuries. We are still having to sometimes contend with Victorian era attitudes.” “We wanted to challenge artists to create works that may be out of their comforts zones,” said Hynes, co- curator. “Anything
that has a sexual element can certainly be stimulating not only visually, but also intellectually, inspiring conversations on censorship, social mores, and how the arts affect our cultural attitudes.” “We thought it was a great idea to explore the realm of erotic art with these talented artists,” says Kortman Gallery director Doc Slafkosky. “There is a definitely a distinction between what is erotic and what is pornographic. The works of art presented in this gallery exhibit are esthetically pleasing and can be viewed and enjoyed by a general audience.” The “Amorous” exhibition will feature

ROCKFORD – On Sunday, May 1st, 2022 from 2-4 p.m., the Hispanic Gallery of the Ethnic Heritage Museum will unveil its newest exhibit, “Early Mexican Settlers of South Rockford”. This exhibit will examine the life and history of five Mexican families that settled in Rockford’s southwest quadrant. The families honored are Maurilio & Carmella “Carmen” Cruz, Frank & Mary Carmona, Dolores & Maria “Jesse” Mendez, Armando & Rebecca Luna and Esteban & Lucille Martinez. This exhibit will be on display until July. Maurilio & Carmen Cruz - Carmen was born in Rockford in 1927 and married Maurilio in 1946. She taught children at St. Elizabeth’s Center about the Mexican culture and instructed them in Mexican
folk dances in the 1950s and ‘60s. In 1992, La Voz Latina honored Carmen for her outstanding community service. Frank & Mary Carmona - Frank came to Rockford at 17 in 1922. He worked on the railroad in his early years, then at Mattison Machine. Frank and Mary were very active in the community and St. Anthony Church. Frank lived to be almost 101 years old. His son Frank Jr. was able to open his own business, “Carmona Gear” in South Rockford. Dolores & Maria “Jesse” Mendez Dolores and Jesse lived in Minnesota for about 8 years, then decided to come to Rockford for work. They arrived in South Rockford with 3 young children in 1936. Dolores found a job at Mattison Machine, but was tragically hit by a car a few years later. Jesse was known to the Mexican community as “the Best Cook in South
Rockford”. Armando & Rebecca Luna - Armando arrived in Rockford at the age of 14 in 1937. He came all the way from the Texas area by train alone at the age of 10. He was all alone in this new country until he met a nice couple who raised him. He married his wife Rebecca in 1942. They both served in the US Armed Forces. Esteban & Lucille Martinez - Esteban and Lucille both came to Rockford at very young ages. Esteban arrived when he was 12 years old in 1924 and Lucille came to Rockford when she was 1 year old in 1917. Esteban worked at Camp Grant. He was in charge of the German prisoners of war and helped trained soldiers. He served on the Board of Trustees for the St Elizabeth’s Center, Hildago Society, CPM Club on Central Avenue, and helped with
special events at St. Anthony and St Mary’s Churches. The Hispanic Gallery will host a special presentation of each family’s life and history. Earth Day’s roots go back to 1970 and Wisconsin Senator Gaylord Nelson, who came up with the idea when an oil spill occurred in Santa Barbara, California. At the time, many environmental issues were not enough of a concern to bring about any effective change. The Senator, however, had an idea to direct some of the energy and enthusiasm of the anti-war movement toward issues regarding pollution. He promoted an event designed to create an appreciation and awareness of the Earth’s environment. The event, which was the first Earth Day, took place on April 22, 1970.
The seedlings are being donated by the Winnebago County SWCD, which sells bare root and transplant shade trees, evergreens, and shrub seedlings; in an effort to increase efforts to provide energy conservation and/or habitat cover for wildlife in the rural setting. Choose to plant a tulip poplar, white spruce or nannyberry seedling in your own yard. Planting instructions will be provided. “For many of us, it has been
a long season of spending more time in our homes and redefining how we use our living and work spaces. Our hope is that spring will bring a sense of renewal and people are able to feel their house become a home again,” Gummow said. “These seedlings are very easy to grow and can adapt to a range of soil and light conditions.” The seedlings are between 12 and 18 inches tall and have been harvested when dormant and without soil around the roots, making them easy to transport and plant. Getting a Soil Test BY GRANT MCCARTY CONTRIBUTOR
Spring is a perfect time to get a soil test for the backyard garden. With the information from a soil test, you can determine what changes you need to make for the upcoming season. You may also find that the soil test provides you with a conclusion as to why your garden may have performed poorly last year. A soil test can be performed for a troubling area and/or new garden space. This test will reveal the soil pH, soil organic matter, and certain soil nutrients. As a reminder, soil pH is a soil measurement that will allow or limit nutrients to be
taken up by the plant while soil organic matter is tied to nitrogen and soil biology. At the University of Illinois Extension o�ce, we recommend soil tests to help rule out garden problems like nutrient deficiency or disease. It is important to collect your soil sample throughout the growing area with 8-10 samples collected. You will not be sending o� all the samples but will mix them in a bucket and send in a collective sample, usually about half a cup. With a bucket and shovel, go about 6 inches into the soil. Remove any grass and place this sample in the bucket. You will want to zig-zag around di�erent parts of the
growing area. Mix these samples together and submit to a soil lab. If you have areas of your growing area that are problematic, that will be a separate sample. If you want soil results for your lawn and vegetable garden, those will be separate samples since those are di�erent types of plants. The form you fill out for soil testing is crucial. It will ask you to list what you are growing. This ensures that the recommendations you get back are for the appropriate plants. Results will come back to you between 1-3 weeks. These results will tell you whether you need to raise/lower the pH, what rate of fertilizer you need to apply,
and whether your soil nutrients are in the right range. If you have questions, you can ask your soil testing lab for clarity. University of Illinois Extension does not recommend a particular soil testing lab. With energy prices rising, it appears the developed world is about to learn how much energy we will have available for a good life. Some energy pundits have indicated that as cheap energy supplies continue to disappear, the nation’s economy might fall to levels common in the 1990s. Federal policies could facilitate a quicker transition to a less energy intensive economy. Incentives for upgrading energy conservation and e�ciency in industry, buildings and transportation are e�ective tools. Rising prices can encourage appropriate energy behaviors to stimulate change, which could take time since advertising encouraged Americans to embrace consumption. Higher prices and disruptions in global supply chains and the economy are slowing the transitioning to cleaner energy sources while demand for renewable energy sources remains strong. A recent article in Renewables Now points out that renewable energy prices have risen along with other increased costs and could slow
the energy transition. Another factor which has slowed the transition is the backlog of thousands of interconnection application awaiting PJM ISO approval to connect to the grid which also adds to the cost of renewable projects. In late January, Jan Pepper, CEO of Peninsula Clean Energy, wrote a short paper, Our Path to 24/7 Renewable Energy by 2025. In 2021 they provided all of their 300,000 customers with 100% carbon free power and developed a model to achieve their commitment to 24/7 carbon free energy. It is widely recognized that conservation and e�ciency are the quickest and least costly options to cut energy consumption and associated pollution, including carbon emissions, but people seldom act until a crisis hits. The last U.S. President who called for such actions was Jimmy Carter who only remained in o�ce for one term. With energy prices already high, if the Russian-Ukrainian war continues or expands, energy restrictions could force even higher energy prices. One way of addressing the potential of living with less energy than we currently do is by addressing the question of how
much energy we think we need to live a good life. A recent National Public Radio article by Laura Bensho� cited a new Stanford University study reporting that the average American could use far less than they do and still have a good, healthy life. By comparing energy use and quality of life in 140 countries the study found that roughly 75 GJ (gigajoules) a year was su�cient. In contrast, Americans used an average of 284 GJ a year. To put that figure in perspective, a GJ is roughly equivalent to 8 gallons of gasoline. While average numbers have limited usefulness in describing reality, they provide another perspective on the ine�ciency of the American economy. Households can reduce their energy demand by low cost strategies such as lowering whole house heating levels and providing supplemental heat in specific rooms in winter and accepting a warmer house and providing fans in selected areas in summer. Other low cost strategies include using cold water for laundry, hanging it on a line and abandoning multiple clothing changes in a day. It was common to have good clothes to wear to school, better clothes
to wear on Sundays and special clothes for work or play. Clothing was washed once a week. Worn out clothes were washed and cut into patches for quilts. Such simple energy savings strategies were common in earlier times. During the 1930s Depression energy conservation and e�ciency were widely practiced as people were forced to restrict consumption based on a lack of funds. When WWII followed, consumption was limited due to government restrictions. As children during those times we were well fed, healthy and happy. The recent focus on utilizing cleaner energy sources such as wind and solar to replace fossil fuels overlooks the role that conservation and e�ciency can play in curbing energy use. With deteriorating economic and environmental conditions, curbing excessive consumption is a proven way to use less while continuing to live well. Considering all the existing uncertainties it remains an auspicious time to implement conservation, energy e�ciency and cleaner energy sources to provide more energy security in our lives and communities.
