Legislature approves bill to tighten restrictions on red-light camera industry

Bill hailed as first step toward broader ethics reform

SPRINGFIELD — Lawmakers in Springfield have unanimously approved a measure that would place new restrictions on the red-light and speed camera industry’s involvement in state and local elections and government.

House Bill 3903 would ban automatic traffic enforcement companies or their officers from donating to candidates for public office at the state and local level. It would also prevent state and local government officials from accepting jobs or contracts with those companies while in office or for two years after leaving office, a kind of “revolving door” ban.

Sponsors praised the bill as much-needed ethics reform after several public officials in the past decade have been caught by federal investigators engaging in bribery deals and kickback schemes involving red-light camera companies.

“What this does is it tightens up the ethics surrounding the red-light camera corruption and scandals,” Rep. Bob Rita, D-Blue Island, said during the House debate on Thursday.

Rep. Patrick Windhorst, R-Metropolis, called the two-year revolving door ban “a good step.”

HB 3909 received unanimous approval in the House on Thursday after a similar unanimous vote in the Senate last week.

The bill would also grant the Illinois Department of Transportation new authority to review and either approve or revoke approval for automated traffic enforcement systems under certain circumstances, such as if a public official is charged with bribery.

The measure would also require that local governments review the safety impacts of automated enforcement systems every two years. Local governments would also have the sole authority to decide to issue tickets, ending their current ability to delegate that decision to the red-light and speed camera companies they contract with.

Bribes in the legislature, local government

The spate of indictments and convictions of public officials caught up in bribery schemes with automated traffic enforcement companies was alluded to during debate on the bill at the Capitol.

“We’ve had issues with this and I think the bill is a great first step,” Sen. Jil Tracy, a Quincy Republican and member of the legislature’s ethics commission, said.

Tracy has seen two of her Senate colleagues indicted on such charges in the last four years.

In September of last year, Sen. Emil Jones III, D-Chicago, was charged with bribery for a scheme connecting him to red-light camera company SafeSpeed LLC in exchange for shielding the organization from a study of red-light systems in the state. Jones has pleaded not guilty and remains in the Senate. He voted in favor of the measure last week.

The late Sen. Martin Sandoval, D-Chicago, also admitted to accepting bribes from the company and falsifying tax returns in 2020. Sandoval died of COVID-19 complications later that year while he was awaiting sentencing.

“The public deserves to have the utmost trust in their government and their law enforcement,” bill sponsor Sen. Laura Murphy, D-Des Plaines, said in a news release. “We need to ensure that there is accountability and honesty on all levels.”

Two former suburban Chicago mayors, a former Cook County commissioner and his chief of staff have also pleaded guilty to charges involving bribes or kickbacks from SafeSpeed.

In 2016, former assistant Chicago transportation commissioner John Bills was convicted of accepting lavish gifts and $600,000 in exchange for pushing the city to accept contracts from the red-light camera company Redflex. Bills received a 10-year prison sentence, the longest sentence so far handed down to an Illinois official in connection with a red-light camera company. Federal prison records show he’s moved on to a halfway house.

A first step?

The General Assembly is facing pressure to enact ethics reforms in response to federal probes beyond those involving

red light camera companies. Earlier this month, three ex-lobbyists and the former CEO of electric utility Commonwealth Edison were convicted of orchestrating a bribery scheme to curry favor with former House Speaker Michael Madigan, who was himself indicted on related corruption and racketeering charges last year.

In mid-May, former Democratic Gov. Pat Quinn made an appearance in Springfield to call for a special legislative session to consider ethics reform, noting that the ComEd verdict revealed a “grievous breach of public trust.”

“If you take a look at the indictments that have been made that are going to be tried next year, the allegations include violations of conflict of interest,” Quinn said. “That’s just not right. It’s not right for anybody in Illinois who’s a taxpayer to have legislators voting on bills where they have a financial interest.”

Ryan Tolley, the policy director for the government reform group CHANGE Illinois, noted that HB 3909 marks the first time the legislature has enacted a two-year revolving door ban, an idea that was contentious even when the General Assembly passed a six-month ban on lawmakers leaving for lobbying gigs in 2021.

“Hopefully this can be a first step moving forward,” Tolley said in an interview.

Tolley noted that he believes further action is needed on ethics reform, such as giving the Legislative Inspector General, the General Assembly’s top ethics official, more independent authority to investigate potential wrongdoing.

Former LIG Carol Pope cited her lack of power to conduct investigations or impose sanctions as a reason for her 2021 resignation, calling the office a “paper tiger.”

GOP-controlled Texas House impeaches Republican AG Ken Paxton, triggering suspension

AUSTIN, Texas (AP) — Texas’ Republican-led House of Representatives impeached state Attorney General Ken Paxton on Saturday on articles including bribery and abuse of public trust, a sudden, historic rebuke of a GOP official who rose to be a star of the conservative legal movement despite years of scandal and alleged crimes.

Impeachment triggers Paxton’s immediate suspension from office pending the outcome of a trial in the state Senate and empowers Republican Gov. Greg Abbott to appoint someone else as Texas’ top lawyer in the interim.

The 121-23 vote constitutes an abrupt downfall for one of the GOP’s most prominent legal combatants, who in 2020 asked the U.S. Supreme Court to overturn President Joe Biden’s electoral defeat of Donald Trump. It makes Paxton only the third sitting official in Texas’ nearly 200-year history to have been impeached.

Paxton, 60, decried the move moments after scores of his fellow partisans voted for impeachment, and his office pointed to internal reports that found no wrongdoing.

“The ugly spectacle in the Texas House today confirmed the outrageous impeachment plot against me was never meant to be fair or just,” Paxton said. “It was a politically motivated sham from the beginning.”

Paxton has been under FBI investigation for years over accusations that he used his office to help a donor and was separately indicted on securities fraud charges in 2015, though he has yet to stand trial. His party had long taken a muted stance on the allegations — but that changed this week as 60 of the House’s 85 Republicans, including Speaker Dade Phelan, voted to impeach.

“No one person should be above the law, least not the top law officer of the state of Texas,” Rep. David Spiller, a Republican member of the committee that investigated Paxton, said in opening statements. Another Republican committee member, Rep. Charlie Geren, said without elaborating that Paxton had called some lawmakers before the vote and threatened them with political “consequences.”

Lawmakers allied with Paxton tried to

discredit the investigation by noting that hired investigators, not panel members, interviewed witnesses. They also said several of the investigators had voted in Democratic primaries, tainting the impeachment, and that they had too little time to review evidence.

“I perceive it could be political weaponization,” Rep. Tony Tinderholt, one of the House’s most conservative members, said before the vote. Republican Rep. John Smithee compared the proceeding to “a Saturday mob out for an afternoon lynching.”

Paxton is automatically suspended from office pending the Senate trial. Final removal would require a two-thirds vote in the Senate, where Paxton’s wife’s, Angela, is a member.

Representatives of the governor, who lauded Paxton while swearing him in for a third term in January, did not immediately respond to requests for comment on a temporary replacement.

Before the vote, Trump and U.S. Sen. Ted Cruz came to Paxton’s defense, with the senator calling the impeachment process “a travesty” and saying the attorney general’s legal troubles should be left to the courts.

“Free Ken Paxton,” Trump wrote on his social media platform, Truth Social, warning that if House Republicans proceeded with impeachment, “I will fight you.”

In one sense, Paxton’s political peril arrived with dizzying speed: The House committee’s investigation came to light Tuesday, and by Thursday lawmakers issued 20 articles of impeachment.

Rice University political science professor Mark P. Jones said the swift move to impeach kept Paxton from rallying significant support and allowed quietly frustrated Republicans to come together.

“If you ask most Republicans privately, they feel Paxton is an embarrassment. But most were too afraid of the base to oppose him,” Jones said. By voting as a large bloc, he added, the lawmakers got political cover.

To Paxton’s longstanding detractors, however, the rebuke was years overdue.

In 2014, he admitted to violating Texas securities law, and a year later he was indicted on securities fraud charges in his hometown near Dallas, accused of defrauding investors in a tech startup. He

pleaded not guilty to two felony counts carrying a potential sentence of five to 99 years.

He opened a legal defense fund and accepted $100,000 from an executive whose company was under investigation by Paxton’s office for Medicaid fraud. An additional $50,000 was donated by an Arizona retiree whose son Paxton later hired to a high-ranking job but was soon fired after displaying child pornography in a meeting. In 2020, Paxton intervened in a Colorado mountain community where a Texas donor and college classmate faced removal from his lakeside home under coronavirus orders.

But what ultimately unleased the impeachment push was Paxton’s relationship with Austin real estate developer Nate Paul.

In 2020, eight top aides told the FBI they were concerned Paxton was misusing his office to help Paul over the developer’s unproven claims that an elaborate conspiracy to steal $200 million of his properties was afoot. The FBI searched Paul’s home in 2019, but he has not been charged and denies wrongdoing. Paxton also told staff members he had an affair with a woman who, it later emerged, worked for Paul.

The impeachment accuses Paxton of attempting to interfere in foreclosure lawsuits and issuing legal opinions to benefit Paul. Its bribery charges allege that Paul employed the woman with whom Paxton had an affair in exchange for legal help and that he paid for expensive renovations to the attorney general’s home. A senior lawyer for Paxton’s office, Chris Hilton, said Friday that the attorney general paid for all repairs and renovations.

Other charges, including lying to investigators, date back to Paxton’s still-pending securities fraud indictment.

Four of the aides who reported Paxton to the FBI later sued under Texas’ whistleblower law, and in February he agreed to settle the case for $3.3 million. The House committee said it was Paxton seeking legislative approval for the payout that sparked their probe.

“But for Paxton’s own request for a taxpayer-funded settlement over his wrongful conduct, Paxton would not be facing impeachment,” the panel said.

Nighttime Russian air campaign terrorizes citizens in Ukrainian capital

KYIV, Ukraine (AP) — The attacks come at night, when most in Kyiv are sound asleep. The sirens wail across the Ukrainian capital, rousing bleary-eyed residents, who, after 15 months of war, have customized individual routines to cope with Russia’s latest air campaign.

In the recent escalation of Russian attacks, Olha Bukhno, 65, a cleaner, says a prayer every night. “Please,” she asks, closing her eyes and addressing the heavens, “Let it be quiet.”

By her bedside is a bag packed full of essentials: documents, dry foods and water. At the sound of the alarm, she dashes downstairs to her building’s basement and takes shelter. Nearly two weeks ago, debris from a shot-down missile landed on the roof of a building next to hers in Kyiv’s Darnytsia district, causing a large fire.

“Every night, we are afraid,” she said, tearing up.

When the alarm blares, some in the city are consumed by fear, imagining the worst-case scenarios that could unfold; displacement, being trapped under rubble, being killed. Others embrace apathy, lying awake in bed, as the sounds of explosions ricochet across the skies.

But in the past month, when Russian air attacks escalated to near-nightly raids, most people are complaining of sleeplessness. In the war-defying bustle of Kyiv’s cafes, restaurants and salons, business goes on despite the ongoing war, but everyone has a story about how tired they feel.

“What is there to say? Everyone is exhausted,” said Oleksandr Chubienko, a pharmacist in Darnytsia, describing the recent temper of his customers.

Russia launched another wave of attacks on Kyiv in the early hours of Monday using a combination of drones and cruise missiles. More than 40 air targets were brought down in what was the 15th nighttime attack on the capital in May, head of the Kyiv Military Administration Serhii Popko said in a Telegram update. Falling debris broke through the roof of a residential building in the Podlisk district but there were no immediate reports of casualties

“One more di�cult night for the capital,” said Kyiv Mayor Vitali Klitschko.

Often the explosions are the sounds of Ukraine’s air defense systems successfully targeting the deadly cocktail of missiles and drones Russia has sent into Ukraine. On May 16, Russia launched an exceptionally intense bombardment, sending 18 missiles Ukraine’s way, 14 of which targeted Kyiv

according to Ukraine’s air force spokesman. Ukraine said it shot down six hypersonic Kinzhal missiles that night, a capability it did not have last year.

On Saturday night, local o�cials in Kyiv said that Ukraine’s capital was subjected to the largest drone attack since the start of Russia’s war. At least one person was killed. It came on the eve of Kyiv Day, which marks the anniversary of the city’s founding.

The increasingly regular series of strikes are part of a new Russian air campaign targeting Ukrainian countero�ensive capabilities, experts and Ukrainian o�cials said. The uptick was noticed after April 19, right after Ukraine announced it had received Americanmade Patriot missiles, a long-sought new shield against Russian airstrikes. Observers said the renewed intensity of Russian attacks appears to be aiming to overwhelm and target these new systems.

The May 16 attack caused “minor” damage to one Patriot air defense system near Kyiv, U.S. o�cials said, adding that it was still operational.

The latest string of attacks also come after a previous winter-time escalation in air raids this year targeted critical infrastructure, including power stations and military logistics facilities. Ukrainian forces have become more effective in shooting down Russian missiles compared to earlier in the year, with many crediting the American systems.

But the defense systems can’t shield civilians from every harm. The debris from destroyed Russian missiles have rained down on civilians, causing fi res and injuries.

For many in the city, the sound of the air raid alarm is accompanied by the constant ring of Telegram, the preferred app in Ukraine for sharing updates about the airstrikes. With every update — “Another coming from East,” “More launched from sea! Take cover!” — people respond with an emoji expressing expletives.

But the calculations that civilians make about what to do next is often very di�erent across all walks of life, with some staying at home, resigned to their fate and others speeding toward safer spaces.

In Darnitsya, leftover debris from the fi re was piled inside a large garbage can. Charred pieces of wood and insulation lie under the springtime sun, as parents stroll by with their children and neighbors exchange the latest gossip.

Pavlo Chervinskyi, 45, tells his 4-yearold daughter that it’s all a game when their apartment windows rattle with the distant boom of the nighttime explosions. Every time there is an air raid, he carries her to

the corridor and waits for the all-clear.

With every bang, he tells her “Putin is making a racket again,” referring to Russian President Vladimir Putin. It’s better than to try to explain to her what is really going on, he said, watching her make sand castles in the family’s neighbourhood playground. It’s not exactly a lie, he explained. “We are being subjected to a game of Russian roulette every night.”

But still, it’s better to avoid telling his child the whole truth. “It’s better that it’s a joke between us,” he said. “Now she is used to it, and she isn’t afraid.”

She slept right through the weekend attacks, the businessman said. “At least someone is getting rest,” he added, with a weary smile.

Mariana Yavolina, a physical therapist, had the misfortune of moving to the residential compound in Darnitsya the day of the attack. She returned to her new apartment after midnight that night. The air raid alarm was blazing, but Yavolina had had enough.

She lay on her sofa and looked up at the ceiling; her fi rst moment’s rest from the long day. In the distance, explosions resounded.

One, then another. She looked at her Telegram app for updates.

“I try not to take it so seriously,” Yavolina said. “It’s so annoying, and if you want to live yourself you can’t be consumed by it all the time.”

Bit by bit that night, she convinced herself that it was ok to sleep.

The next blast shook the entire apartment, jolting her awake. Outside, plumes of smoke clouded the view as flames raged from the roof of the building beside her. The stench of burning was overwhelming.

Soon fi refighters and police arrived at the scene, forbidding anyone to take video of the wreckage. But Yavolina filmed anyway and sent the footage to a friend serving in the army.

“Just flowers,” he responded — a local idiom meaning it could have been much worse.

House gives final OK to $50.6 billion spending plan

SPRINGFIELD – The 2023 spring legislative session came to an end in the early hours of Saturday morning after the Illinois House gave its approval to a $50.6 billion spending plan for the upcoming fiscal year that begins July 1.

The 73-38 party-line vote came around 2:30 a.m. after lengthy debate during which Democrats called the budget “balanced” and “compassionate” while Republicans claimed it masks hidden costs and fails to address the state’s most urgent priorities.

“This budget rea� rms our shared commitment to fiscal responsibility while making transformative investments in the children and families of Illinois that will be felt for years to come,” Gov. JB Pritzker said in a statement after the vote. “I look forward to signing this budget making childcare and education more accessible, healthcare more a�ordable, and our state’s business and economic position even stronger.”

Lawmakers had to jump through some procedural hoops to meet constitutional requirements while still passing the bill in time to leave Springfield for the bulk of Memorial Day weekend. That’s because the Illinois Constitution requires bills to be read into the record by title on three di�erent days before a vote can be taken.

The Senate passed the budget bill late Thursday night, sending it to the House where it got its fi rst reading shortly thereafter. The House reconvened Friday evening, gave the budget a brief hearing

before reading it into the record for a second time, and finally adjourned shortly after midnight Saturday morning. Eight minutes later, the House reconvened yet again for a final vote.

The final spending plan looked substantially like the one Pritzker outlined in his February budget proposal. It contains several new initiatives he asked for, including investments in pre-K through 12th grade education, child welfare, combating poverty and homelessness, and increasing state spending on higher education.

“Smart Start Illinois” is a multi-year plan that aims to make childcare and preschool available to every three- and four-year-old whose family wants those services. For the upcoming fiscal year, that includes $250 million to increase the number of preschool slots available, stabilize the early childhood workforce and expand the Early Intervention and Home Visiting Programs.

The budget also includes Pritzker’s “Home Illinois” initiative – an $85 million increase in funding to support homelessness prevention, affordable housing, outreach and other programs aimed at reducing homelessness.

It also includes a $100 million increase in funding for public universities and community colleges, along with a $100 million increase in Monetary Award Program financial aid grants for low-income college students. Pritzker has said that will e�ectively make a two-year community college education available tuition- and fee-free for every working-class student in Illinois.

And it includes a $350 million increase in the Evidence Based Funding formula for K-12 education, the minimum amount

called for under the law that lawmakers passed in 2018.

“We should not have to choose between being responsible for being a responsible state and being a compassionate one,” Speaker Pro Tem Jehan Gordon-Booth, D-Peoria, the top Democratic budget negotiator, said on the House floor. “We can do both. I dare say we have to do both.”

House Republicans, however, had announced earlier in the day that they would not provide any votes to pass the bill, calling it “one of the largest spends in Illinois history.”

“Our shared priorities, surprisingly, were not included and our o�ers to work with Democrats were ignored,” House Republican Leader Tony McCombie, of Savanna, said during an early afternoon news conference. “We cannot trust the majority party with more money when all they o�er is so little in return to tangible benefits for Illinois families.”

Republicans cited several concerns with the budget, such as its continued funding of Medicaid-like health care for undocumented immigrants aged 42 and over, which has grown well past original projections. GOP members also objected Democrats’ refusal to address the Jan. 1, 2024 sunset of a $75 million tax credit program that funds scholarships for private and religious schools.

Republicans also disapproved of the budget package’s allowance for the automatic inflation-determined growth of lawmakers’ base salary for next year from $85,000 to nearly $90,000 – a cost of living adjustment that McCombie argued violates the Illinois Constitution. They also criticized the budget’s failure to address needed funding for pay raises for state workers whose union contracts are up for renewal in the upcoming fiscal year.

“In our eyes, this isn’t a budget that provides for the future of Illinois,” Rep. Norine Hammond, R-Macomb, the House Republicans’ chief budget negotiator, said Friday afternoon ahead of the final vote.

But Democrats countered that the budgets they have pushed through since Pritzker became governor in 2019 have not only been balanced but have resulted in multiple credit upgrades from the three major rating agencies.

“If you want to vote for credit upgrades for the state of Illinois, vote aye,” GordonBooth said in her closing speech just before the final vote. “If you want to vote to fund the public school children in your district, vote aye. If you want to vote to fund the cities, towns and villages in

your district, vote aye. If you want to vote to give low income and middle-income college students and your district the opportunity to go to college without being overburdened with college debt, vote aye.”

Passage of the budget allowed the House to adjourn its 2023 spring regular session.

According to legislative records, more than 560 bills passed both chambers and will eventually be sent to Pritzker’s desk. Lawmakers are not scheduled to return to Springfi eld until their traditional two-week fall veto session, which has not yet been formally scheduled.

Before the 2:30 a.m. vote on the spending plan, House members also voted on eight other bills Friday night. Those measures included a controversial bill that would give Ameren Illinois, the electric utility for the southern half of the state, the “right of fi rst refusal” on the construction of transmission lines.

Another pair of bills that received only Democratic votes concern health insurance – one would give the state’s Department of Insurance the power to review and reject insurance rates, and the other would create a new state-based insurance marketplace.

A few of the late-night bills received unanimous votes in the House, including one that would create a tax credit program aimed at eventually attracting one of the six to 10 “hydrogen hubs” the federal government hopes to place around the U.S. as hydrogen clean energy technology continues to evolve.

After lengthy debate on the budget package, a bipartisan majority of House members approved one final measure before adjourning, which would permanently establish a previously experimental diversion program for fi rst-time gun o�enders. The pilot program was only open to those under the age of 21, but all fi rst-time o�enders would be eligible for the permanent program. It was also modified to allow for greater prosecutorial and judicial discretion in those cases.

Increasing solar energy

We have taught university energy, environmental and ecological restoration courses for years. In the early years we knew of Australia’s and Israel’s early use of solar hot water systems. Later Germany and California became known for their pioneering work installing solar electricity systems on homes and public buildings.

When we started the Illinois Renewable Association some state funds were available to initiate the solar revolution. At the legislative level the Environmental Law and Policy Center initiated state policies which supported the installation of renewable energy systems. The Illinois Clean Energy Foundation was also very active supporting renewable energy. With the passage of additional state and federal support for renewable energy the installation of solar systems is increasing dramatically in the United States. Another important supporter of renewable energy in Illinois has been the Citizens Utility Board which has a new solar guide available to the public which addresses basic questions citizens might have regarding solar energy. There are similar efforts across the globe.

While questions are being raised about solar energy’s ability to support a global energy system based on renewable energy sources and do it in a sustainable fashion, photovoltaics has become the fastest growing global energy technology.

An optimistic outlook for the growth of solar energy was recently written

a Professor of Engineering at the Australian National University. He claims that the growth in solar installations is proceeding at a rate to completely replace fossil fuels in the global economy before 2050.

At the time of his article total global solar capacity had exceeded 1 terawatt and was growing at a rate of 20% per year. If it continues to grow at that rate it reach 6 terawatts by 2031. By that time its capacity will exceed that of the combined total of coal, gas, nuclear and hydro.

He points out that 99% of new generation capacity is solar and wind due to their low cost. Blakers believes that the new solar developments in Australia are important to the world because of its location. Australians live at low to moderate latitudes which receive ample amounts of sunshine throughout the year. Their location is similar to where 80% of the world’s population lives. He thinks that the developments in Australia could be readily adopted by the majority of the world’s population.

The transition to renewable solar and wind energy would include electric vehicles, heat pumps, electric furnaces and the electrolysis of water to release hydrogen for multiple industrial uses. He sees few if any obstacles to a renewable energy future, and claims the materials for solar panels are abundant, the panels are recyclable, and energy storage is a solved problem. He claims that solar offers a cheap, unlimited, energy available forever with minimal resource, environmental and social constraints.

His optimistic perspective on our solar

future ignores some of the concerns others raise. At a fundamental level multiple environmental issues beyond solving the carbon emissions problem by replacing fossil fuels with solar and wind exist. Environmental costs are associated with the implementation of any energy source. As the late physicist Al Bartlett pointed out, it is important to understand the impact of steady economic growth on the environment, resources and human well-being.

To calculate the doubling time of compound growth, 70 is divided by the rate. If the economic growth rate of installed solar energy is 20% annually, in 3.5 years the amount would double. This projected growth rate is hard to sustain, and as critics are quick to point out, would place an enormous demand on existing resources.

There are other factors to consider as well. Blakers believes we are not build-

ing new power lines quickly enough to support the rapid energy transition. But the power lines are often controversial. California environmentalists are suing the California Public Utilities Commission to remove cuts to solar incentives as they weaken the case for rooftop solar and efficiency. The cuts in support for rooftop solar increases the opportunity for the creation of large scale utility solar farms. Plans to ship solar energy from the Imperial Valley farming region to the California coast requires a new transmission line at an estimated to cost of $2 billion.

While we enjoy the benefits of solar in our own lives, we also recognize that at the current stage of its development it seems premature to claim such a rosy future for solar energy. While energy is fundamental to our way of life there are other important environmental considerations that should be addressed as well.

WHEREAS, the Board of Trustees of the New Milford Fire Protection District of Winnebago County, Illinois, and Ogle County, Illinois, has made a copy of a Tentative Budget and Appropriation Ordinance and has kept it available for public inspection at the New Milford Fire Protection District Fire House in Winnebago, Illinois, for at least thirty (30) days prior to final action thereon; and

WHEREAS, a public hearing was held on said Budget and Appropriation Ordinance on the 17th day of April, 2023, notice of the time and place of such public hearing having been given at least thirty (30) days prior thereof by publication in a newspaper in general circulation within the District, and all other legal requirements having been complied with;

AN ORDINANCE authorizing the NORTH PARK PUBLIC WATER DISTRICT of Machesney Park, Winnebago County, Illinois, to borrow funds from the Public Water Supply Loan Program

WHEREAS the NORTH PARK PUBLIC WATER DISTRICT of Machesney Park, Winnebago County, Illinois, operates its public water supply system (“the System”) and in accordance with the provisions of the Public Water District 70 ILCS 370S/ and the Local Government Debt Reform Act, 30 ILCS 350/1 et seq. (collectively “the Act”); and

WHEREAS , the BOARD OF TRUSTEES of the NORTH PARK PUBLIC WATER DISTRICT (“the Corporate Authorities”) have determined that it is advisable, necessary, and in the best interest of the public health, safety, and welfare to improve the System, including the following:

NPPWD Per – and Polyfluoroalkyl (PFAS) Removal Phases I, II, III together with any land or rights in land and all electrical, mechanical or other services necessary, useful or advisable to the construction and installation (“the Project”), all in accordance with the plans and specifications prepared by the consulting engineers of the Stantec Consulting Services, Inc., which Project has a useful life of fifty (50) years; and

WHEREAS, the estimated cost of construction and installation of the Project, including engineering, legal, financial and other related expenses is $57,372,000, and there are insufficient funds on hand and lawfully available to pay these costs; and

WHEREAS, the loan shall bear an interest rate as defined by 35 Ill. Adm. Code 662, which does not exceed the maximum rate authorized by the Bond Authorization Act, as amended, 30 ILCS 305/0.01 et seq., at the time of the issuance of the loan; and

WHEREAS the principal and interest payment shall be payable semi-annually, and the loan shall mature in 20 years, which is within the period of useful life of the Project; and

WHEREAS the costs are expected to be paid for with a loan to the NORTH PARK PUBLIC WATER DISTRICT from the Public Water Supply Loan Program through the Illinois Environmental Protection Agency, the loan to be repaid from revenues of the system and the loan is authorized to be accepted at this time pursuant to the Act; and

WHEREAS , in accordance with the provisions of the Act, the NORTH PARK PUBLIC WATER DISTRICT is authorized to borrow funds from the Public Water Supply Loan Program in the aggregate principal amount of $57,372,000 to provide funds to pay the costs of the Project; and

WHEREAS, the loan to the NORTH PARK PUBLIC WATER DISTRICT shall be made pursuant to a Loan Agreement, including certain terms and conditions between the NORTH PARK PUBLIC WATER DISTRICT and the Illinois Environmental Protection Agency; NOW THEREFORE, be it ordained by the Corporate Authorities of the NORTH PARK PUBLIC WATER DISTRICT of Machesney Park, Winnebago County, Illinois, as follows:

SECTION 1. INCORPORATION OF PREAMBLES

The Corporate Authorities hereby find that the recitals contained in the preambles are true and correct and incorporate them into this Ordinance by this reference.

SECTION 2. DETERMINATION TO BORROW FUNDS

It is necessary and in the best interests of the NORTH PARK PUBLIC WATER DISTRICT to construct the Project for the public health, safety, and welfare, in accordance with the plans and specifications, as described; that the System continues to be operated in accordance with the provisions of the Illinois Environmental Protection Act, 415 ILCS 5/1 et seq.; and that for the purpose of constructing the Project, it is hereby authorized that funds be borrowed by the NORTH PARK PUBLIC WATER DISTRICT in the aggregate principal amount (which can include construction period interest financed over the term of the loan) not to exceed $57,372,000.

SECTION 3. ADDITIONAL ORDINANCES

The Corporate Authorities may adopt additional ordinances or proceedings supplementing

or amending this Ordinance, providing for entering into the Loan Agreement with the Illinois Environmental Protection Agency, prescribing all the details of the Loan Agreement, and providing for the collection, segregation and distribution of the revenues of the System, so long as the maximum amount of the Loan Agreement as set forth in this Ordinance is not exceeded and there is no material change in the project or purposes described herein. Any additional ordinances or proceedings shall in all instances become effective in accordance with the Act or other applicable laws. This Ordinance, together with such additional ordinances or proceedings, shall constitute complete authority for entering into the Loan Agreement under applicable law.

However, notwithstanding the above, the NORTH PARK PUBLIC WATER DISTRICT may not adopt additional ordinances or amendments which provide for any substantive or material change in the scope and intent of this Ordinance, including but not limited to interest rate, preference or priority of any other ordinance with this Ordinance, parity of any other ordinance with this Ordinance, or otherwise alter or impair the obligation of the NORTH PARK PUBLIC WATER DISTRICT to pay the principal and interest due to the Public Water Supply Loan Program without the written consent of the Illinois Environmental Protection Agency.

SECTION 4. LOAN NOT INDEBTEDNESS OF NORTH PARK PUBLIC WATER DISTRICT

Repayment of the loan to the Illinois Environmental Protection Agency by the NORTH PARK PUBLIC WATER DISTRICT pursuant to this Ordinance is to be solely from the revenue derived from the revenues of the System, and the loan does not constitute an indebtedness of the NORTH PARK PUBLIC WATER DISTRICT within the meaning of any constitutional or statutory limitation.

SECTION 5. APPLICATION FOR LOAN

The Chief Executive Officer is hereby authorized to make application to the Illinois Environmental Protection Agency for a loan through the Public Water Supply Loan Program, in accordance with the loan requirements set out in 35 Ill. Adm. Code 662.

SECTION 6. ACCEPTANCE OF LOAN AGREEMENT

The Corporate Authorities hereby authorize acceptance of the offer of a loan through the Public Water Supply Loan Program,

Section 2. That there is hereby appropriated for use for fire protection purposes for use of New Milford Fire Protection District in the County of Winnebago and County of Ogle and State of Illinois for corporate purposes for the fiscal year of May 1, 2023 to April 30, 2024, the sum of $731,500.00, said total being divided among the purposes and amounts specified above as estimated expenditures, hereby incorporated by reference as part of this Section 2 and shall be and is the Annual Appropriation Ordinance for this District for said fiscal year commencing May 1, 2023 and ending April 30, 2024.

Section 3. All unexpended balances of any item or items by this Ordinance appropriated may be expended in making up any deficiencies in any item or items aforesaid.

Section 4. This Ordinance shall be published in a newspaper having a general circulation in said District, and shall take effect ten (10) days after being so published.

The Chief Executive Officer is hereby authorized and directed to execute the Loan Agreement with the Illinois Environmental Protection Agency. The Corporate Authorities may authorize by resolution a person other than the Chief Executive Officer for the sole purpose of authorizing or executing any documents associated with payment requests or reimbursements from the Illinois Environmental Protection Agency in connection with this loan.

SECTION 9. SEVERABILITY

If any section, paragraph, clause or provision of this Ordinance is held invalid, the invalidity of such section, paragraph, clause or provision shall not affect any of the other provisions of this Ordinance.

SECTION 10. REPEALER

All ordinances, resolutions, orders, or parts thereof, which conflict with the provisions of this Ordinance, to the extent of such conflict, are hereby repealed. PASSED by the Corporate Authorities on May 24, 2023.
