State regulators work to avoid federal Clean Air Act sanctions

SPRINGFIELD – Illinois faces a deadline next month to either change the way it enforces air pollution emission limits on heavy industries or face federal sanctions that could eventually result in restricted access to billions of dollars in federal highway funding.
But state agencies are working to avoid that as they rush to meet an Aug. 12 deadline imposed by the federal government to put a new regulatory framework in place that will comply with the federal government’s current interpretation of the Clean Air Act.
Those rule changes, which come from the Illinois Pollution Control Board, are up for review on Tuesday, July 18, before the General Assembly’s Joint Committee on Administrative Rules, a 12-member group that exercises oversight over the state’s administrative rulemaking process.
“At this point, any future course for this rulemaking depends entirely on JCAR’s review and decision-making on this proposal,” IPCB staff attorney Tim Fox said in a phone message. “The board awaits that review and decision-making at its meeting on Tuesday.”
At issue is a policy Illinois has had since the 1970s that allows factories, power plants, and other industries with air pollution emission permits to exceed their emission limits during startups, shutdowns, or malfunctions, or SSM events.
The so-called “SSM exemption” is written into a facility’s emission permit and provides the facility’s owners a level of immunity from civil lawsuits if they are sued for violating their emission limits.
The policy is based on the idea that no machine works perfectly all the time and there are occasionally unforeseeable events such as power outages or floods that will force a facility to shut down for a period of time and then restart, which can result in short-term excess emissions.
But it’s a policy that courts have said since 2008 violates the federal Clean Air Act, and it’s one that the U.S. Environmental Protection Agency has been telling Illinois and other jurisdictions since 2015 that they need to repeal.
Now, Illinois faces an Aug. 12 deadline to repeal the regulations that allow SSM exemptions and submit to the EPA a new state implementation plan, or SIP – a document that spells out the policies and regulations the state will use to implement the Clean Air Act. Otherwise, failure to comply will trigger federal sanctions against the state.
Jack Darin, executive director of the Illinois chapter of the Sierra Club, an environmental group that has been pushing for regulatory
changes at both the state and federal level, said in a phone interview that the change is needed to protect public health.
“The public health can be subjected to a lot more significant pollution during these events, and that’s why the Clean Air Act requires that facilities have plans in place to deal with that,” he said. “It could be additional pollution controls or other steps to make sure that we’re not putting even more pollution into the air we breathe during these startup, shutdown, and malfunction events. And Illinois rules have been lacking these requirements for over a decade.”
But Donovan Griffith, vice president of government affairs for the Illinois Manufacturers’ Association, said the issue is not that simple, and that removing legal protections against SSM events could dramatically increase the risk of doing business.
“You’re going to have companies that are going to have to make a decision,” he said in a separate interview. “I mean, you can’t plan for a storm to knock out your power. You can’t plan for certain things that happen. They’ll have to make the decision whether or not they’re going to restart their operations and just be out of compliance or not operate at all.”
Years of controversy
Controversy over SSM exemptions goes back as far as the 1970s. But for Illinois, the issue has been percolating for about the last dozen years, spanning the course of three presidential administrations.
In 2011, the national Sierra Club filed a petition with the U.S. EPA asking that it take stronger action to disallow SSM exemptions and affirmative defense provisions. In 2013, the agency announced that it was considering taking action on that petition. In 2015, during the Obama administration, EPA issued an “SIP call” for 36 states and nine additional local jurisdictions, including Illinois, to submit new state implementation plans.
That occurred during the early months of Republican Gov. Bruce Rauner’s administration, which did not immediately respond to the SIP call. According to testimony filed at a public hearing earlier this year, IPCB officials said the agency sought additional guidance from U.S. EPA about how to establish alternative limits for SSM events, but it did not receive a response before the Obama administration ended in January 2017.
In April 2017, the then-new Trump administration put the SIP call on hold so it could reevaluate the issue. Three years later, in October 2020, EPA issued what it called a nonbinding “guidance memorandum” suggesting that policies such as those in place in Illinois and elsewhere would be permissible in some circumstances.
One month later, however, Democrat
Joe Biden defeated Donald Trump for reelection. Soon after he took office, EPA issued a new memorandum withdrawing the Trump administration’s memo and reasserting the policy that SSM exemptions were no longer acceptable.
Looming sanctions
Finally, in January 2022, EPA issued a new SIP call, starting a clock for Illinois and several other state and local jurisdictions to come into compliance or face mandatory sanctions.
If the state does not come into compliance by Aug. 12, EPA will impose what are called “offset sanctions,” meaning any new or significantly modified sources of pollution for which a permit is required will come under significantly stricter emission limits.
And if the state does not comply by Feb. 11, 2024, its access to federal highway funds will be restricted to safety projects, capital programs for public transit and a select few other categories of funding.
Those sanctions would be lifted once the U.S. EPA determines the state has submitted an acceptable new SIP.
Because of the looming deadline, the rule change has been put on a “fast track” schedule, but that has irritated industry officials who say they haven’t had enough time to submit comments or try to negotiate an agreement.
“I think we’ve known since January 2022 that this was coming, which is why there was a lot of communications from the regulated community to the agency about discussing this issue,” Griffith, of the Illinois Manufacturers’ Association, said. “We didn’t hear much from them until November of 2022, when they basically said, ‘here’s our proposal that we plan on filing.’”
The compressed timeline also upset some members of JCAR, which previously discussed the proposed rule change at its June 13 meeting.
“It was Nov. 17 that you reached out and asked for comments. That’s a week before Thanksgiving,” Rep. Curtis Tarver, D-Chicago, told IPCB and IEPA officials during that meeting. “You allowed 10 business days. The 11th, it was due. That’s absolutely – I hope that’s uncommon.”
Jack Jennings, deputy director of the IEPA, explained that the agencies at first tried to get clarification from the U.S. EPA about what would be acceptable, and it wasn’t until later in the year that the agencies learned that they needed to completely repeal the language allowing SSM exemptions.
JCAR and the agencies agreed at the June meeting to extend the rulemaking period for 45 days, during which time they hoped to work with U.S. EPA and industry groups to reach an agreement.

LONDON (AP) — Russia halted a breakthrough wartime deal on Monday that allows grain to flow from Ukraine to countries in Africa, the Middle East and Asia where hunger is a growing threat and high food prices have pushed more people into poverty.
Kremlin spokesman Dmitry Peskov said Russia would suspend the Black Sea Grain Initiative until its demands to get its own food and fertilizer to the world are met. While Russia has complained that restrictions on shipping and insurance have hampered its agricultural exports, it has shipped record amounts of wheat since last year.
“When the part of the Black Sea deal related to Russia is implemented, Russia will immediately return to the implementation of the deal,” Peskov said.
The suspension marks the end of an accord that the U.N. and Turkey brokered last summer to allow food to leave the Black Sea region after Russia’s invasion of its neighbor worsened a global food crisis. The initiative is credited with helping lower soaring prices of wheat, vegetable oil and other food commodities.
Ukraine and Russia are both major global suppliers of wheat, barley, sunflower oil and other affordable food products that developing nations rely on.
The suspension of the deal sent wheat prices up about 3% in Chicago trading, to $6.81 a bushel, still about half what they were last year during last year’s peaks, but fell later in the day.
Analysts don’t expect more than a temporary bump to global food commodity prices because places like Russia and Brazil have ratcheted up wheat and corn exports. But food insecurity worldwide is growing as developing countries also struggle with climate change, conflict and economic crises. Finding suppliers outside Ukraine that are farther away also could raise costs.
The grain deal provided assurances that ships won’t be attacked entering and leaving Ukrainian ports, while a separate agreement facilitated the movement of Russian food and fertilizer. While Western sanctions do not apply to Moscow’s agricultural shipments, some companies may be wary of doing business with Russia.
Ukrainian President Volodymyr Zelenskyy said he wanted to keep the
initiative going even without Russia’s safety assurances.
“We are not afraid,” he said. “We were approached by companies that own ships. They said that they are ready, if Ukraine gives it, and Turkey continues to let it through, then everyone is ready to continue supplying grain.”
Turkish President Recep Tayyip Erdogan said the country’s foreign minister would speak with his Russian counterpart Monday — and that he was hopeful the deal would be extended.
The Black Sea Grain Initiative has allowed three Ukrainian ports to export 32.9 million metric tons of grain and other food to the world, according to the Joint Coordination Center in Istanbul.
Russia has repeatedly complained that the deal largely benefits richer nations. JCC data shows that 57% of the grain from Ukraine went to developing nations, with the top destination being China, which received nearly a quarter of the food.
The agreement was renewed for 60 days in May, but in recent months, the amount of food shipped and number of vessels departing Ukraine have plunged, with Russia accused of preventing additional ships from participating.
The war in Ukraine sent food commodity prices to record highs last year and contributed to a global food crisis also tied to other conflicts, the lingering effects of the COVID-19 pandemic, droughts and other climate factors.
High costs for grain needed for food staples in places like Egypt, Lebanon and Nigeria exacerbated economic challenges and helped push millions more people into poverty or food insecurity.
Rising food prices affect people in developing countries disproportionately, because they spend more of their money on meals. Poorer nations that depend on imported food priced in dollars also are spending more as their currencies weaken and they are forced to import more because of climate change.
Under the deal, prices for global food commodities like wheat and vegetable oil have fallen, but food was already expensive before the war in Ukraine and the relief hasn’t trickled down to kitchen tables.
The end of the initiative creates “instability and uncertainty” in global food markets that could raise prices and increase food insecurity for vulnerable nations already seeing their local crops
die because of climate change, said Shashwat Saraf, the International Rescue Committee’s regional emergency director for East Africa.
Sudan, Somalia and Ethiopia, for instance, are dependent on food imports from Ukraine, he said.
The U.N. Food and Agriculture Organization said this month that 45 countries need outside food assistance, with high local food prices “a driver of worrying levels of hunger” in those places.
Now, it’s key to watch whether Russia “weaponizes” its wheat exports, said Simon Evenett, professor of international trade and economic development at the University of St. Gallen in Switzerland.
Being the world’s largest wheat supplier right now, Russia could hike its export taxes, which “would raise world grain prices as well as allow Russia to finance more of its military campaign in Ukraine,” Evenett said. He noted that Moscow already raised them slightly this month.
The grain deal has faced setbacks since it was brokered by the U.N. and Turkey: Russia pulled out briefly in November before rejoining and extending the deal.
In March and May, Russia would only renew for 60 days, instead of the usual 120. The amount of grain shipped per month fell from a peak of 4.2 million metric tons in October to over 2 million metric tons in June.
Ukraine has accused Russia of preventing new ships from joining the work since the end of June. Joint inspections meant to ensure vessels only carry grain and not weapons that could help either side also have slowed considerably.
Asked Monday whether an attack on a bridge connecting the Crimean Peninsula to Russia was a factor in the decision on the grain deal, the Kremlin spokesman said it was not.
Meanwhile, Russia’s wheat shipments hit all-time highs following a large harvest. It exported 45.5 million metric tons in the 2022-2023 trade year, with another record of 47.5 million metric tons expected in 2023-2024, according to U.S. Department of Agriculture estimates.
WASHINGTON (AP) — Another experimental Alzheimer’s drug can modestly slow patients’ inevitable worsening — by about four to seven months, researchers reported Monday.
Eli Lilly and Co. is seeking Food and Drug Administration approval of donanemab. If cleared, it would be only the second Alzheimer’s treatment convincingly shown to delay the mind-robbing disease — after the recently approved Leqembi from Japanese drugmaker Eisai.
“Finally there’s some hope, right, that we can talk about,” Lilly’s Dr. John Sims told reporters Monday at the Alzheimer’s Association International Conference in Amsterdam.
“We don’t cure the disease,” he said. “Diabetes doesn’t have a cure either — it doesn’t mean you can’t have very meaningful treatments for patients.”
Lilly announced in May that donanemab appeared to work, but on Monday the full results of a study of 1,700 patients was published by the Journal of the American Medical Association and presented at the Alzheimer’s conference.
Both donanemab and Leqembi are lab-made antibodies, administered by IV, that target one Alzheimer’s culprit, sticky amyloid buildup in the brain. And both drugs come with a serious safety concern — brain swelling or bleeding that in the Lilly study was linked to three deaths. Scientists say while these drugs may mark a new era in Alzheimer’s therapy, huge questions remain about which patients should try them and how much benefit they’ll really notice.
“The modest benefits would likely not be questioned by patients, clinicians or payers if amyloid antibodies were low
risk, inexpensive and simple to administer. However, they are none of these,” Dr. Eric Widera of the University of California, San Francisco, wrote in a JAMA editorial accompanying Lilly’s new data.
Lilly’s study enrolled people ages 60 to 85 who were in early stages of Alzheimer’s. Half received once-a-month infusions of donanemab and half dummy infusions for 18 months.
The study had a few twists. Patients were switched to dummy infusions if enough amyloid cleared out — something that happened to about half within a year. And because amyloid alone doesn’t cause Alzheimer’s, researchers also tracked levels of another culprit in the brain — abnormal tau. More tau signals more advanced disease.
The results: Both groups declined during the 18-month study but overall those given donanemab worsened about 22% more slowly. Some patients fared better — those with low to medium tau levels saw a 35% slower decline, reflecting that the drug appears to work better in earlier stages of the disease.
How much di�erence does that make? It means donanemab slowed patients’ worsening by about four to seven months, the JAMA report concluded.
Another way of measuring: Among the donanemab recipients with lower tau levels, 47% were considered stable a year into the study compared with 29% of those who got the dummy version.
The main safety concern is brain swelling or bleeding, which often causes no symptoms but sometimes can be serious, even fatal. About a quarter of donanemab recipients showed evidence of that swelling, and about 20% had microbleeds.
Scientists already know that patients getting any amyloid-targeted therapy
need repeat brain scans to check for those side e�ects — a costly and time-consuming hurdle.
Widera noted that the possibility of stopping donanemab treatment at least temporarily in people who respond well would help limit some of those challenges. For comparison, Leqembi is given by IV every two weeks and researchers didn’t test a similar stoppage.
It’s too soon to know if some patients might need to resume donanemab, said Lilly’s Dr. Mark Mintun. But the amyloid “doesn’t come back with any sort of vengeance,” he said, speculating that might take several years.
Another concern: More than 90% of the study’s participants were white, leaving little data about how other populations might respond, Alzheimer’s specialist Jennifer Manly of Columbia University
wrote in JAMA.
Scientists have long tried and failed to slow Alzheimer’s with amyloid-targeting drugs — and the FDA’s contentious 2021 conditional approval of a drug named Aduhelm soon fi zzled amid lack of evidence that it really worked. The approval of Leqembi and promising data for donanemab have reignited interest in attacking amyloid buildup.
But Mintun acknowledged additional approaches are needed, saying Lilly expects results of a late-stage study of a tau-fighting drug next year.

If you are growing garlic this season, it may be time to harvest. Following the removal of the scapes in mid-June, I noticed the leaves of my garlic plants begin to yellow and brown during the first week of July. This is an expected process as the garlic bulb begins to concentrate on developing those cloves between scape removal and harvest. If this is your fi rst year growing garlic, proper harvest and curing will ensure that your garlic bulbs are suitable for planting next year’s crop
and cooking this fall.
Garlic should be harvested when at least 50% of the leaves are brown/yellowing. It may be di�cult to judge this but recognize that a large percentage of green leaves signifies that the garlic is not ready and needs more time. Further, you do not want complete dieback of these leaves. If you harvest garlic too early, your cloves may be small with weak flavor and unable to be stored long-term.
Garlic harvest is easy. Tugging the leaves of the garlic should remove the entire bulb. You may find you need to use a
shovel but with our recent rains this past week, the bulbs should dislodge easily. From there, you may consider removing all or leaving some soil around the bulb. Each grower has a preference and may depend on how much soil is caked on your bulb. If the bulb had a substantial amount, you may want to wash it o� but dry it soon after as this could allow mold to grow.
Your next step is curing. This process takes 4-6 weeks and allows for a concentration of flavor and the garlic to be ready for storage. You need to find a place that provides a dry, dark, and well-ventilated
area with moderate temperatures. The plants needs to be laid in a way that allows good airflow. This might mean hanging them up in an area of your house or laying on an old window screen.
Once this curing stage is complete, you can trim the bulb leaves back and remove any soil that has dried. Store them in an area that is similar to where you cured. These bulbs can then be used for cooking and planting your 2024 garlic bulbs.

We occasionally receive an email from a retired engineer who provides us with his energy views. He has a large solar electric system with south, east and west facing panels to secure maximum energy. He is grid connected so has 24 hours of electric service. He appreciates the economic benefits of his solar system but advocates the use of a broader mixture of cleaner energy sources. He considers it essential to continue working on geothermal, fusion, thorium and upgraded uranium plants.
He expressed being amused by the hype surrounding the arrival of additional electrical buses for public transit in Rockford. He remembered visiting Rockford in the 1950s when electric buses were in wide use but not powered by batteries. They drew their power from a maze of overhead wires.
Growing up in Milwaukee, we travelled
by streetcars which were later replaced by trackless trolleys similar to those in Rockford in the 50s. Later they were replaced with diesel powered buses; many people objected to the odor from diesel exhaust. Ironically, when the streetcars were being abandoned in the Midwest, Toronto bought them and installed them as an integral part of their public transit system. While teaching in Toronto, we enjoyed our rides on their recycled streetcars. It is questionable if all of the changes in public transit constitute progress.
Oil remains a key source of energy and finding a suitable replacement for it raises various recommendations. Currently society is replacing the combustion of oil with electrical energy produced from renewable sources which are dependent on fossil fuels for their creation, installation and maintenance so they remain vulnerable to the depletion of oil. As it is depleted, society continues to develop other energy sources.
One energy source being expanded is hydrogen. Europe was very dependent on
Russia for natural gas so sanctions left them searching for alternatives. In the south of Europe and the northern parts of Africa, hydrogen is being produced by renewable energy sources and shipped to northern Europe. These e�orts are targeting sectors of the economy not suitable for electrification.
Last summer Germany installed a small fleet of hydrogen powered passenger trains in Lower Saxony, replacing some existing diesel powered trains. Frankfurt has ordered 27 of the trains and France and Italy are expected to add them as well.
Canada is also exploring using hydrogen to power trains, buses and trucks. Quebec has North America’s fi rst hydrogen powered passenger train in operation this summer. It consists of two passenger cars capable of carrying 120 people for a 2-1/2 hour trip. Some 94% of the hydrogen is produced by an electrolyser powered by Hydro, Quebec, with another 5% produced from wind power making it a green hydrogen operation. Hydrogen
advocates are eager to demonstrate the use of hydrogen to power trucks as well.
Alberta is also working on initiating the development of the hydrogen economy. They are already testing hydrogen fueled buses; in Edmonton the world’s largest net-zero hydrogen plant in the world is being constructed. The hydrogen is released from natural gas with the carbon component stored in an underground reservoir.
Part of their concern is the looming competition from US e�orts to accelerate the hydrogen economy’s development by providing funding covering up to 75% of the cost of projects to produce low carbon hydrogen.
We are in the early stages of the transition to using hydrogen in our economy. It will take time to assess hydrogen’s performance and the endeavor’s economic and environmental costs. The initial e�orts are interesting but whether they scale up to meet the goals of a sustainable energy system will be revealed over time.
At least two big things happened in the entertainment world last week. One involves people throughout the television industry nominating their peers for Emmy awards, while the other may change the fi lm and television landscape forever.
That “other” thing, of course is the Screen Actors Guild/American Federation of Television and Radio Actors (SAG-AFTRA) voting unanimously to go on strike against the all-powerful studios, thereby o�cially joining their counterparts in the Writers Guild of America (WGA) who’ve already been on strike over two months.
Normally, outlets that cover television spend the week after Emmy nominations interviewing nominees to get their perspective on various categories and their competition. Publicists are usually quick to get nominees on the phone for
a quick comment or two. But this year is di�erent: due to the WGA and SAG-AFTRA strikes, writers or actors aren’t currently promoting their work.
As an outside observer, I really hope the studios and streaming services – under the banner of the Alliance of Motion Picture and Television Producers (AMPTP) – and the unions will hold meaningful negotiations and find a fair and equitable compromise. But the both sides need to participate in the talks, and earlier this week Deadline reported sources a� liated with the AMPTP saying that instead of negotiating, their plan is to drag things out until fall, hoping the increased financial strain will force writers to buckle.
Writers are used to being taken for granted. Studio heads gloss over the fact that without writers there would be no stories, characters, movies, or TV shows for them to produce. But striking actors are harder for the AMPTP to ignore.
Ronald Reagan was the president of the Screen Actors Guild the last time writers and actors had a simultaneous strike. That was 1960, and the strike ran from January to June, ultimately securing health insurance for union members.
In 2023, the use of artificial intelligence (AI), is a major point of contention. Another is financial inequity. While famous actors and screenwriters might make millions of dollars per year, the vast majority of working actors and screenwriters struggle to make enough money to live in Los Angeles; many rely on residual payments – small fees paid when older shows or fi lms are broadcast or repeated – to make ends meet between jobs. The problem is streaming services pay next to nothing for residuals.
Why are these issues so important?
Because the last time these contracts were negotiated, no one knew that streaming would become such a popular way of consuming fi lm and TV, or that
AI would be at a point where it threatens job security.
Most writers, actors, and artists who go from job to job know how to be frugal. I’m not sure the same can be said for executives making tens of millions of dollars per year. With production stopped, and without actors out promoting their latest fi lms and series, those executives might have to figure out how to live on less, too.
These strikes could go on for months, so get ready for an onslaught of more cheaply-produced reality shows, game shows, foreign productions, and talk shows. The Primetime Emmy Awards – which as of now are scheduled for September 18 – might be postponed until after the strikes are resolved.
