High court: Smell of burnt cannabis is not cause for warrantless vehicle search

State supreme court rules unanimously in case stemming from 2020 traffic stop

Law enforcement officers in Illinois cannot rely on the smell of burnt cannabis alone to justify searching a vehicle without a warrant, the Illinois Supreme Court ruled on Thursday.

The decision was unanimous, though Justice Lisa Holder White did not take part in it. Writing for the court, Justice P. Scott Neville pointed to Illinois’ landmark 2019 law legalizing recreational cannabis, which decriminalized the possession of the drug up to 30 grams.

“The laws on cannabis have changed in such a drastic way as to render the smell of burnt cannabis, standing alone, insufficient to provide probable cause for a police officer to search a vehicle without a warrant,” Neville wrote in a 20-page opinion.

The case stems from September 2020, when Ryan Redmond was pulled over by an Illinois State Police trooper on Interstate 80 in Henry County, just east of the Quad Cities. Redmond’s license plate was allegedly not properly secured to his vehicle, and he was driving three miles above the speed limit, according to court records.

But during the interaction, the trooper allegedly smelled burnt cannabis in Redmond’s vehicle and upon searching

YORKVILLE, ILLINOIS

the vehicle, he found approximately a gram of cannabis in the car’s center console.

Redmond was later charged with a misdemeanor for failure to transport cannabis in an odor-proof container.

The court found that the trooper’s detection of the “burnt cannabis” odor in the vehicle “certainly established reasonable suspicion to investigate further,” but noted that the officer’s further investigation yielded nothing more, including no signs that Redmond’s driving was impaired. Therefore, Neville wrote, the officer’s reasonable suspicion should have never advanced to “probable cause to search.”

Though the court acknowledged the trooper’s initial suspicion that Redmond could’ve “smoked cannabis in the car at some point” was not out of the realm of possibility, Neville pointed out that the officer not only “observed no signs of impairment” but also found no drug paraphernalia or evidence of cannabis use in the car on further investigation.

The trooper “also did not smell the odor of burnt cannabis on Redmond, which undercuts the reasonable belief that Redmond had recently smoked cannabis inside the vehicle while on an Illinois highway,” the opinion said.

The court heard Redmond’s case in January, alongside arguments in a related case focused on the section in Illinois law that requires cannabis be stored in a sealed, odor-proof container if being transported in a car.

In that case, an Illinois State Police trooper pulled over a car for speeding in rural Whiteside County, also near the Quad Cities, and then arrested the passenger of the vehicle for unlawful possession of cannabis. According to court records, Vincent Molina’s December 2020 arrest came after the officer found a small box of rolled joints in a vehicle search predicated on the smell of raw cannabis in the car, though Molina told the officer he had a medical cannabis card. Though the Supreme Court heard the cases in consolidated arguments earlier this year, the justices only ruled on Redmond’s case Thursday. The decision briefly mentioned the Molina case in a footnote saying the court was not addressing “the validity of the odor-proof

container requirement” in the Redmond decision.

Ahead of the joint oral arguments in January, national and state-level chapters of the American Civil Liberties Union and the National Association of Criminal Defense Lawyers filed a brief in support of Molina and Redmond, writing that allowing the odor of cannabis as cause for searching a vehicle will lead to biased enforcement against Black and Latino Illinoisans.

“There is a decades-long pattern of police in this state using pretext like cannabis odor to disproportionately stop and search Black and Latino drivers,” the brief reads. Illinois’ stop and search policy “unfairly subjects (Black and Latino drivers) to at-will intrusions of their privacy and relegates them to second-class citizenry.”

The organizations argued the legalization of cannabis means its presence is not indicative of contraband or crime.

Thursday’s opinion also noted that other states agree, holding up a Kansas Supreme Court decision from earlier this year as an example. High courts in other states, including Minnesota, Delaware, New Jersey, Pennsylvania and Vermont have ruled similarly, though Wisconsin’s Supreme Court decided the opposite in a 2023 ruling.

Other states have also passed laws prohibiting warrantless searches of vehicles based solely on the smell of cannabis. But a similar effort in Illinois stalled last year as the Redmond and Molina cases were pending.

Daytripping

Doors Open Milwaukee

For many people in Northern Illinois, Milwaukee is an often-unfamiliar place, yet Milwaukee sits just north of Chicago and ranks as the 40th largest metropolitan area, with a population of over 1.5 million people. It’s about 90 minutes from Northern Illinois to Milwaukee via Interstate 43, and it is an easy day trip.

Once a year, Historic Milwaukee sponsors a weekend called “Doors Open Milwaukee.” This weekend, September 28-29, over 150 places generally not open to the public will be open for visitors and absolutely free. While it’s an annual event, the available venues change from year to year.

Cities worldwide offer similar programs. Open House Chicago is scheduled this year on October 19-20 and will feature over 250 free venues throughout the city. It’s also a rewarding experience.

Taking full advantage of a program like Doors Open Milwaukee requires a little advance planning. With 155 locations on offer, you definitely have to make some choices. Hours at the attractions vary; some are only open on Saturday or Sunday, while others are open on both days. You can comfortably visit a half-dozen or more of these sites in a day. Traffic in Milwaukee

is generally not heavy; parking is not a problem, and usually free, particularly on weekends.

Individual tastes will vary and taking a few minutes to review the venues and map out your route is highly recommended. These are all listed (along with hours and brief descriptions) at https://historicmilwaukee.org/

To get you started, we asked several native Milwaukeeans, who offered their suggestions.

Milwaukee Art Museum, 700 N Art Museum Dr., Sat/Sun., 10-5. Designed by architect Santiago Calatrava, this is one of Milwaukee’s most distinctive and recognizable buildings. The lakefront building is the architect’s idea of a modern Gothic cathedral and has a 90-foot ceiling. Two signature wings on the building open and close depending on the time or day and the weather. Architectural tours will be available in the Quadracci Pavilion.

Turner Hall, 1034 N Vel R Phillips Ave., Sat/Sun., Building 10-5; Ballroom Sat. 10-2, Sun. 10-4. Turner Hall was constructed in 1883, and is the home of the Milwaukee Turners, the oldest civic organization in Milwaukee, active since 1853. The Turners are based on the 19th-Century German Turnverein societies. The Turners offer

gymnastics and opportunities to advance social justice. This unique building, with its murals and stained glass, is on the National Register of Historic Places. Beside many other social gathering spaces, it has a gymnasium featuring a climbing wall, a restaurant, and a ballroom.

Frank Lloyd Wright’s Burnham Block, 2714 W Burnham St., Sat/Sun., 10-5. Frank Lloyd Wright designed an “American System” for mass-produced houses. Six of these were built on one block of Burnham Street in 1916 and are on the National Register of Historic Places. Over 100 years ago, Wright saw factory-built homes as a way to make housing more affordable for the masses, which has recently become a hot topic in the residential construction industry. The home at 2714 W Burnham will be open for guided tours. This is a popular venue with limited capacity. There may be lines, and it may sell out. Wright fans should also consider the round Annunciation Greek Orthodox Church, 9400 West Congress St., Wauwatosa, Sat. only, 10-5. This church was Wright’s last commission and completed in 1961. It is also a popular attraction, and seldom open for tours.

Pritzlaff Building, 315 N Plankinton Ave., Sat. only, 10-5. The Pritzlaff Buildings

are a complex of 6 buildings constructed between 1875 and 1920 for Pritzlaff Hardware, a leading wholesaler of the day. The heavy timber buildings illustrate an excellent example of Milwaukee cream city brick. The original 3 buildings are Italianate design by architect John Rugee. The buildings are currently multiuse, featuring restaurants on the ground floor and apartments on upper floors.

Basilica of St. Josaphat, 601 W Lincoln Ave., Sat. 10-12:30 and 2:30-4; Sun. 1:30-5. Like Chicago, Milwaukee is a city of amazing church buildings, and St. Josaphat doesn’t disappoint. Built in 1901, this baroque church has one of the world’s largest copper domes and is modeled after St. Peter’s Basilica in Rome. The church is highly ornamented and an excellent example of the Polish cathedral style prevalent in large Midwestern cities, particularly Chicago. The basilica is listed on the National Register of Historic Places. While in Milwaukee, we also suggest taking Lincoln Memorial Drive for the 3-mile scenic drive along Lake Michigan north from the Art Museum. This spectacular vista is worth both a north and southbound drive.

At the UN, world leaders try to lay out a vision for the futureand actually make it happen

UNITED NATIONS (AP) — The U.N. General Assembly adopted a “Pact for the Future” to meet the challenges of the 21st century. Now comes the hard part: uniting the world’s divided nations to move quickly to implement its 56 actions.

As Czech President Petr Pavel put it Monday at the summit meeting surrounding the pact: “Our work begins at home.”

The 193-member world body approved the pact Sunday. The document is meant to link nations in tackling challenges ranging from climate change and artificial intelligence to escalating conflicts and increasing inequality and poverty — and improve the lives of the world’s more than 8 billion people.

NEED CASH? NEEDCASH?

The 42-page pact was adopted at Sunday’s opening of a two-day “Summit of the Future,” which continued Monday as leaders of countries around the world gave their views on the challenges facing the world.

And with them, the leaders gave something of a a preview of themes to expect at the assembly’s big annual meeting, which gets into full gear Tuesday.

In Monday’s remarks, Ecuadoran President Daniel Noboa Azin exhorted the world to lower youth unemployment. The president of the Federated States of Micronesia, Wesley W. Simina, said the pact needed to be backed by “robust and lasting commitments” to end fossil fuel use.

Slovak President Peter Pellegrini worried about the spread of disinformation. Angolan President João Manuel Gonçalves Lourenço warned that “it is not possible to build a balanced, safe and sustainable world in which dignity and access to opportunity are the exclusive benefit of a small group of people.”

Among leaders slated to speak later were Iran’s Masoud Pezeshkian, Ukraine’s Volodymyr Zelenskyy, U.S. Secretary of State Antony Blinken and Russian Deputy Foreign Minister Sergey Vershinin.

Russia tried to change the pact

Whether the pact would be adopted was still a question when the assembly meeting began on Sunday. In fact, there was so much suspense that U.N. Secretary-General António Guterres had three prepared speeches, one for

approval, one for rejection, and one if things weren’t clear, U.N. spokesman Stephane Dujarric said.

Russia’s Vershinin proposed an amendment that would have significantly watered down the agreement. “No one is happy with this pact,” he said.

It turned out he was wrong. Africa’s 54 nations opposed Russia’s amendments. Speaking on Africa’s behalf, the Republic of Congo countered with a motion not to vote on the amendments. Mexico supported the Africans, and in a vote on their motion, the Africans got support from 143 countries. Only six countries supported Russia -- Iran, Belarus, North Korea, Nicaragua, Sudan and Syria. 15 countries abstained.

Assembly President Philémon Yang then put the pact to a vote and banged his gavel, signifying the consensus of all U.N. member nations that was required for approval — to vigorous applause.

Russia has made significant inroads in Africa, in countries such as Mali, Burkina Faso, Niger and Central African Republic. The rejection of Russia’s amendments by African countries and Mexico, a major Latin American power, was seen as a blow to Moscow by some diplomats and observers.

The secretary-general issues a challenge

Guterres, clearly relieved at the outcome, then issued a challenge to the leaders: Implement the pact. Prioritize dialogue and negotiations. End “wars tearing our world apart” from the Middle East to Ukraine and Sudan. Reform the powerful U.N. Security Council. Accelerate reforms of the international financial system. Ramp up a transition from fossil fuels. Listen to young people and include them in decision-making.

The U.N.’s main bloc of developing countries — the Group of 77, which now has 134 members, including China — echoed Guterres in a speech by Ugandan Prime Minister Robinah Nabbanja.

“This pact should not become another futile exercise, but must garner political will and commitment across all levels of global leadership to pragmatically address current issues and lay a foundation for solutions for our future global progress and challenges,” he said.

The G77 regrets that the pact doesn’t recognize actions that developed countries should take to close the widening

gaps between them and developing countries, Nabbanja said.

In a rare move at a high-level U.N. meeting where leaders often exceed the announced time limit, speeches were muted after five minutes. Among those who kept talking after their mics were silenced: Brazilian President Luiz Inacio Lula da Silva, Kuwait’s Crown Prince Sheikh Sabah Khalid Al Sabah and Irish President Michael Higgins.

There’s a long list of things to tackle

The Pact for the Future says world leaders are gathering “at a time of profound global transformation,” and it warns of “rising catastrophic and existential risks” that could tip people everywhere “into a future of persistent crisis and breakdown.”

Guterres singled out a number of key provisions in the pact and its two accompanying annexes, a Global Digital Compact and Declaration on Future Generations.

The pact commits world leaders to reform the 15-member Security Council, to make it more reflective of today’s world and “redress the historical injustice against Africa,” which has no permanent seat, and to address the under-representation of the Asia-Pacific region and Latin America.

It also “represents the first agreed multilateral support for nuclear disarmament in more than a decade,” Guterres said, and it commits “to steps to prevent an arms race in outer space and to govern the use of lethal autonomous weapons.”

The Global Digital Compact “includes the first truly universal agreement on the international governance of artificial intelligence,” the U.N. chief said.

As for human rights, Guterres said, “In the face of a surge in misogyny and a rollback of women’s reproductive rights, governments have explicitly committed to removing the legal, social and economic barriers that prevent women and girls from fulfilling their potential in every sphere.”

Lebanon sees deadliest day of conflict since 2006 as Israeli strikes kill more than 270

MARJAYOUN, Lebanon (AP) — Israeli strikes on Monday killed more than 270 Lebanese in the deadliest barrage since the 2006 Israel-Hezbollah war as the Israeli military warned residents in southern and eastern Lebanon to evacuate ahead of a widening air campaign against Hezbollah.

Thousands of Lebanese fled the south, and the main highway out of the southern port city of Sidon was jammed with cars heading toward Beirut in the biggest exodus since the 2006 fighting. More than 1,000 people were wounded in the strikes — a staggering one-day toll for a country still reeling from a deadly attack on communication devices last week.

The death toll surpassed that of Beirut’s devastating port explosion in 2020, when hundreds of tons of ammonium nitrate stored in a warehouse detonated, killing at least 218 people and wounding more than 6,000.

In a recorded message to Lebanese civilians, Israeli Prime Minister Benjamin Netanyahu urged them to heed Israeli calls to evacuate, saying “take this warning seriously.”

“Please get out of harm’s way now,” Netanyahu said. “Once our operation is finished, you can come back safely to your homes.”

The Israeli military said Monday evening it had carried out a targeted strike in Beirut. It did not give details.

Lebanon’s state-run National News Agency reported the Beir al-Abed neighborhood in southern Beirut was hit with three missiles. Hezbollah’s Al-Manar TV said six people were wounded. The area was cordoned off and journalists were not allowed access.

Lebanese Health Minister Firass Abiad told a news conference in Beirut that the earlier strikes hit hospitals, medical centers and ambulances. The government ordered schools and universities to close across most of the country and began preparing shelters for people displaced from the south.

The Israeli military announced it hit some 800 targets, saying it was going after Hezbollah weapons sites. Some strikes struck residential areas of towns in the south and the eastern Bekaa Valley. One hit a wooded area as far away as Byblos in central Lebanon, more than 80 miles from the border north of Beirut.

The military said it was expanding the airstrikes to include areas of the valley along Lebanon’s eastern border with Syria. Hezbollah has long had an established

presence in the valley, where the group was founded in 1982 with the help of Iran’s Revolutionary Guards.

Israeli military spokesman Rear Adm. Daniel Hagari repeated warnings urging residents to immediately evacuate areas where Hezbollah is storing weapons, including in the valley. The warnings left open the possibility some residents could live in or near targeted structures without knowing they are at risk.

Meanwhile, Hezbollah said in a statement that it fired dozens of rockets toward Israel, including at military bases. It also targeted for a second day the facilities of the Rafael defense firm, headquartered in Haifa.

As Israel carried out the attacks, Israeli authorities reported a series of air-raid sirens in northern Israel warning of incoming rocket fire from Lebanon.

The evacuation warnings were the first of their kind in nearly a year of steadily escalating conflict and came after a particularly heavy exchange of fire on Sunday. Hezbollah launched around 150 rockets, missiles and drones into northern Israel in retaliation for strikes that killed a top commander and dozens of fighters.

The increasing strikes and counterstrikes have raised fears of an all-out war, even as Israel is still battling Hamas in Gaza and trying to return scores of hostages taken in Hamas’ Oct. 7 attack. Hezbollah has vowed to continue its strikes in solidarity with the Palestinians and Hamas, a fellow Iran-backed militant group. Israel says it is committed to returning calm to its northern border.

Associated Press journalists in southern Lebanon reported heavy airstrikes targeting many areas Monday morning, including some far from the border.

Lebanon’s state-run National News Agency said the strikes hit a forested area in the central province of Byblos, about 130 kilometers (81 miles) north of the IsraeliLebanese border, for the first time since the exchanges began in October.

Israel also bombed targets in the northeastern Baalbek and Hermel regions, where a shepherd was killed and two relatives were wounded, according to the news agency. It said a total of 30 people were wounded.

The Lebanese Health Ministry put the death toll at 274. It asked hospitals in southern Lebanon and the eastern Bekaa Valley to postpone surgeries that could be done later. The ministry said its request aimed to keep hospitals ready to deal with people wounded by “Israel’s expanding aggression on Lebanon.”

An Israeli military official said Israel is focused on aerial operations and has no immediate plans for a ground operation. The official, speaking on condition of anonymity in keeping with regulations, said the strikes are aimed at curbing Hezbollah’s ability to launch more strikes into Israel.

Lebanese media reported that residents received text messages reading: “If you are in a building housing weapons for Hezbollah, move away from the village until further notice.”

Lebanon’s information minister, Ziad Makary, said in a statement that his office in Beirut had received a recorded message telling people to leave the building.

“This comes in the framework of the psychological war implemented by the enemy,” Makary said, and urged people “not to give the matter more attention than it deserves.”

Communities on both sides of the border have largely emptied out because of the near-daily exchanges of fire.

Israel has accused Hezbollah of transforming entire communities in the south into militant bases, with hidden rocket launchers and other infrastructure. That could lead the Israeli military to wage an especially heavy bombing campaign, even if no ground forces move in.

An Israeli airstrike on a Beirut suburb on Friday killed a top Hezbollah military commander and more than a dozen fighters, as well as dozens of civilians, including women and children.

Last week, thousands of communica-

tions devices, used mainly by Hezbollah members, exploded in different parts of Lebanon, killing 39 people and wounding nearly 3,000, many of them civilians. Lebanon blamed Israel for the attacks, but Israel did not confirm or deny any responsibility.

Hezbollah began firing into Israel a day after the Oct. 7 attack in what it said was an attempt to pin down Israeli forces to help Palestinian fighters in Gaza. Israel has retaliated with airstrikes, and the conflict has steadily intensified over the past year. Israel has vowed to push Hezbollah back from the border so its citizens can return to their homes, saying it prefers to do so diplomatically but is willing to use force. Hezbollah has said it will keep up attacks until there is a cease-fire in Gaza, but that appears increasingly elusive as the war nears its anniversary.

Hamas-led militants stormed into southern Israel on Oct. 7, killing some 1,200 people, mostly civilians, and abducting around 250. Some 100 captives are still held in Gaza, a third of whom are believed to be dead, after most of the rest were released during a weeklong cease-fire in November. Israel’s offensive has killed over 41,000 Palestinians, according to the Gaza Health Ministry, which does not differentiate between civilians and fighters. It says women and children make up a little over half of those killed. Israel says it has killed over 17,000 militants, without providing evidence.

Making your compost pile

With recent drought conditions in the area, your growing season may have concluded earlier than you would have liked. As you decide to shut down the garden, this may be a good time to make your first compost pile since you now have a needed ingredient, green plant material. While raking up the leaves from trees in your yard later this month, you will have your brown material. So, all that’s needed is to get these together to start the process of compost.

Compost is a great ingredient to use in the garden. It tends to feed the micro-or-

ganisms in the soil that are involved in soil nutrient cycling. Compost adds to the soil organic matter, helping your soil do a better job for you. Poorly compacted soils can usually be addressed overtime with adding compost to your soil. One of the few weaknesses of compost is that it has low N-P-K. Usually I do not recommend it for a seasonal fertilizer as the N-P-K values are sometimes 0.25-0.25-0.25 and by comparison, your vegetable plants depend on a fertilizer of say 10-10-10. To start a compost pile, you will want a ratio of 2 parts green to 1 part brown. The green ingredients will be your vegetable debris, kitchen scraps, and others. As

you decide on your green ingredients, make sure to avoid any that are heavily diseased. While compost should reach the right temperature to kill off any of those pathogens that cause disease next summer, you will still want to be vigilante. Grass and weeds could also be added to the compost as long as you are leaving out the weed seed heads. Of kitchen scrapes, avoid any that include dairy, fats, and oils as these do not compost. Your brown ingredients are leaves, twigs, and other wood products. These will need to be cut up/shredded in order to create a more even layer and to get your compost started. Compost can be made in a pile in your

growing area. You can add to it overtime. You can also purchase a compost bin or make your own three compost system. A bin can work well as most are designed for you to easily turn. They have ventilation and you can place it near a hose to add water. A three bin compost system is usually designed with the ease of adding large amounts of compost ingredients. This system works well when you have manure or a lot of green material to get rid of. With the three bin design, you’ll have one that is ready, another that is mid-compost, and another that is just getting started. Energy & Environment

The Importance of trees and forests

People have long used forests as a source of wood and fuel with efforts to turn them into energy to meet the demands of increasing populations. Large areas of trees have been and continue to be cleared to meet the demands of human consumption. As other energy sources continue to become depleted people commonly turn to forests and trees as sources of energy.

Forests are often cleared to increase farmland for growing crops for human consumption and energy. Harvested wood can be used for building homes and construction materials or burned for heat as logs, pellets and sawdust.

Ongoing massive forest fires consume trees and release carbon to the atmosphere. It is estimated that the global amount of standing forest is about 1/3 the size it was when the agricultural revolution began. Additionally, with the beginning of the war between Ukraine and Russia

people turned to wood for heat; firewood became a scarce commodity across parts of Northern Europe.

Drought and damaging storms in this area of Illinois appear to have produced a glut of firewood judging by the abundance of firewood for sale signs and stacked wood along roadways.

While firewood supplies locally are abundant at the moment, there are multiple examples of excessive human consumption. The Easter Island forest was denuded and remains an historic example of excessive consumption which apparently ended human occupation. Continuous clearing of the Amazon rainforest is a current example of how clearing has turned it from an ecosystem storing carbon to a source of carbon emissions.

As wildfires, extreme weather, invasive species and human consumption continue to damage trees and forests adversely impacting people and other life forms within them, efforts increase to protect and restore them.

One regional effort to restore our

woodlands is the Million Trees Project of the Living Land and Waters organization which provides saplings grown in their nursery to people willing to plant them.

The Rock River Trail System has been receiving trees from the organization for years and distributes them through existing organizations along the Rock River corridor in Illinois and Wisconsin.

Steve Rypkema of Oregon, Illinois, coordinates the distribution effort along the Rock River corridor.

Some interesting research projects are increasing our understanding of the importance of river forests. Our Mississippi newsletter recently noted a study ”Where and Why of large Wood Occurrence in the Upper Mississippi and Illinois Rivers.” Large trees in the four to 40 inch range are described as having an important ecological role in rivers and floodplains by shaping diversity and abundance of habitats and filtering nutrients. The study concludes that forested floodplains are important for sustaining large wood in great rivers.

The study might also provide another justification for preserving wooded floodplains along other rivers like the Rock River.

The Climate Water Project explains how plants and trees seed clouds with airborne water droplets. A simplified interpretation of the process is that forests release terpenes, volatile organic compounds that can attract water molecules forming small clouds over the forests. The report suggests that terpenes may play a role in regulating climate change. When trees become hot and stressed they release more terpenes. More clouds are formed which would help cool the planet.

Forests are a large source of carbon storage and provide a leading sanctuary for plants, insects, birds, mammals and other organisms. Protecting and restoring them remains an important conservation strategy and something individuals and groups can support by simply planting trees and supporting such efforts.
