SPRINGFIELD – Attorneys in the offices of Attorney General Kwame Raoul and Cook County State’s Attorney Kim Foxx made similar arguments in recent court filings as both defend bans on assault weapons and large-capacity magazines against constitutional challenges.
In separate cases at different levels of the federal court system, both offices are trying to make the case that the laws under challenge – a state law enacted in 2023 and a county ordinance that dates to 1993 –fall within the bounds of the U.S. Supreme Court’s most recent interpretation of the Second Amendment right to keep and bear arms.
Raoul’s office filed its final written arguments Monday, Oct. 21, in the Southern District of Illinois, where an in-person trial was held in September on multiple challenges to the state’s Protect Illinois Communities Act. That’s the weapons ban state lawmakers passed in 2023 in the wake of a mass shooting at a Fourth of July parade the previous summer in Highland Park.
Foxx’s office made its argument in briefs filed with the 7th Circuit Court of Appeals, where a three-judge panel will hear oral arguments Nov. 12 in a challenge to the county’s assault weapons ban.
First adopted in 1993, that law was strengthened in 2006, and again in 2013. It is now known as the Blair Holt Assault Weapons Ban, named after a Chicago teen who was killed in a 2007 shooting while protecting a high school classmate.
Both cases are among the numerous challenges to assault weapons bans that have been filed in recent years in Illinois and elsewhere. Those cases come as state and local governments look for ways to control the proliferation of increasingly deadly weapons on their streets while a conservative majority on the U.S. Supreme Court takes an increasingly expansive view of the Second Amendment’s protection of gun rights.
The court’s current standards for judging Second Amendment cases are spelled out in the 2008 decision District of Columbia v. Heller, and the 2022 decision in New York State Rifle & Pistol Association v. Bruen.
The Heller case held the right to bear arms is an individual right, not a collective right, and that the Second Amendment protects an individual’s right to own and carry weapons such as handguns that are commonly used for self-defense and other lawful purposes.
In the Bruen decision, the court went further to say that for a gun control
law to pass constitutional muster, the government must show that the law is consistent with the nation’s “historical tradition of firearms regulations.”
In both pending cases, attorneys for the plaintiffs argue the weapons banned under the laws are among the most popular firearms in America and are commonly used for self-defense and other legal activities such as hunting and target shooting.
Attorneys for the state and Cook County, however, argue the assault weapons covered under the laws are modern variations of guns first developed in Nazi Germany during World War II, the Sturmgewehr 44. That weapon’s design was later adapted and modified by the U.S. military into a weapon known as the AR-15, which was later “rebranded” as the M-16 rifle.
Briefs filed in both cases also offer graphic descriptions of mass shootings in which assault weapons have been used to illustrate how their lethal power is many times that of smaller weapons like a 9 mm handgun.
Cook County’s brief, for example, begins with a description of the 2022 mass shooting at Robb Elementary School, in Uvalde, Texas, where 19 children and two teachers were killed by a man wielding an AR-15.
“Afterward, a pediatrician observed that the children ‘had been pulverized by bullets fired at them, decapitated,’ their ‘flesh had been ripped apart’ to such an extent ‘that the only clue as to their identities was blood-spattered cartoon clothes still clinging to them,’” the county’s brief states.
Cook County’s brief also includes a list of 17 mass shootings in the United States involving assault weapons between 1984 and 2022, as well as the July 13, 2024, attempted assassination of former President Donald Trump.
The state’s brief begins with a description of the Highland Park mass shooting, noting that “(i)n less than 60 seconds, the shooter fired approximately 83 shots into the families and community members gathered to celebrate the nation’s birthday. Seven people died, and an additional 48 people were wounded.”
Both the state and county argue the military origins of assault weapons, combined with their lethal impact when used in mass shootings, place them in the category of “dangerous and unusual” weapons which, under the Heller decision, are outside the scope of Second Amendment protection.
Both the state and the county also argue there is a long, historical tradition of regulating weapons that posed particular threats to public safety. They both
cite laws from the first half of the 19th century banning Bowie knives, as well as later laws regulating pistols, revolvers, and “Tommy guns.”
Plaintiffs in both cases, however, argue there is a fundamental difference between the assault weapons banned under the state and county laws and the type of weapons used in the military – namely, that the laws ban “semiautomatic” weapons, which fire only one round with each pull of the trigger, while the military uses weapons that can fire in either semiautomatic or fully automatic mode, meaning they fire continuously with a single pull of the trigger until the trigger is released or the ammunition is depleted.
In earlier proceedings, Judge Stephen P. McGlynn, who is presiding over the case in the Southern District of Illinois, issued a preliminary injunction blocking enforcement of the Protect Illinois Communities Act, saying the plaintiffs were likely to win on the merits of the case.
But the 7th Circuit Court of Appeals reversed that decision and the U.S. Supreme Court declined to review the case at this juncture, opting instead to remand it back to district court for full proceedings. The trial in that case ended Sept. 19, and McGlynn is expected to issue his ruling soon.
In the case challenging the Cook County ordinance, U.S. District Judge Rebecca R. Pallmeyer ruled March 1 in favor of the county, noting the 7th Circuit has ruled several times that assault weapons bans are constitutional, including an earlier challenge to the Cook County law. The plaintiffs are now appealing that decision. The appellate court will not release the names of the three judges assigned to hear the case until the morning of oral arguments Nov. 12.
Both lawsuits have backing from national gun rights organizations such as the Second Amendment Foundation, the Firearms Policy Coalition, Federal Firearms Licensees, and the National Shooting Sports Foundation.
National gun control advocates such as Everytown for Gun Safety and Giffords Law Center to Prevent Gun Violence have also filed briefs in support of the weapons bans.

Renewable energy installations are increasingly common and visible across all 50 states including this area of Illinois. A recent report: Renewables on the Rise 2024 from the Environment America Research and Policy Center and Frontier provides some numbers illustrating their growth. In 2023 the U.S. tripled the amount of energy produced from solar, wind and geothermal power it produced in 2014.
The report covers the progress made in wind, solar, electric vehicle charging, energy efficiency and battery storage in the effort to transition to a future based entirely on clean and renewable energy sources.
We slightly modified some of the major findings cited by the report to highlighting the growth in cleaner energy sources: Nearly 18% of national retail electricity
sales came from wind, solar and geothermal sources in contrast to only 6% in 2014.
In 2014 only 2 states produced 30% or more of their electricity they used from renewables while15 states achieved that goal in 2023.
At the end of 2023, America had 15 gigawatts of battery storage which was 97 times more than existed in 2014 for backing up the electric grid.
From 2014 to 2023 the southeast states of Florida, Georgia, North Carolina, South Carolina, Tennessee and Virginia experienced a 33 fold increase in solar electricity. The increase could supply power to more than 4.6 million average US households.
From 2014 to 2023 America experienced an 8 fold increase in electrical production from solar energy sufficient to power 22 million homes. Over the same time period wind energy increased by 2.3 times which could provide power to meet 39 million typical household electric needs.
From 2014 to 2023 EVs on American roads experienced a 25 fold increase along with a nearly seven fold increase in electric vehicle charging ports. To date 3.3 million electric vehicles are on our roads and over 176,000 charge ports are located across the country.
For the transition to cleaner energy sources to continue, supportive national, state, and local policies are essential. Much of the growth in renewable energy over the past couple of years was made possible by the passage of the national Inflation Reduction Act. Billions in tax breaks and incentives were designed to cut national carbon emissions 40% by 2030.
Given that Republican-led states secured substantial benefits from the federal government incentives, it is assumed that those states will continue to support the energy transition even if they win the upcoming presidential race.
The United States still gets nearly 60% of its electricity from fossil fuel sources. The demand for electricity is increasing due to population growth, the transition to electric vehicles, increasing heat pump installations for heating and cooling homes and buildings and the expansion of data processing centers.
Questions remain regarding the ability of renewable energy sources to provide sufficient energy to meet the existing and growing demand for electricity. Some data centers being established are planning to use existing nuclear plants or building new ones to provide sufficient electricity to operate continuously for 24 hours per day seven days per week.
Beyond the quest for additional sources of energy is the continuous pursuit of economic growth on a finite planet assuming technology will provide appropriate solutions to our human and environment problems.

DUBAI, United Arab Emirates (AP) — An
Israeli attack on Iran damaged facilities at a secretive military base southeast of the Iranian capital that experts in the past have linked to Tehran’s onetime nuclear weapons program and at another base tied to its ballistic missile program, satellite photos analyzed Sunday by The Associated Press show.
Some of the buildings damaged sat in Iran’s Parchin military base, where the International Atomic Energy Agency suspects Iran in the past conducted tests of high explosives that could trigger a nuclear weapon. Iran long has insisted its nuclear program is peaceful, though the IAEA, Western intelligence agencies and others say Tehran had an active weapons program up until 2003.
The other damage could be seen at the nearby Khojir military base, which analysts believe hides an underground tunnel system and missile production sites.
Iran’s military has not acknowledged damage at either Khojir or Parchin from Israel’s attack early Saturday, though it has said the assault killed four Iranian soldiers working in the country’s air defense systems. Iran announced Sunday a civilian also had been killed, but provided no details.
Iran’s mission to the United Nations did not respond to a request for comment. The Israeli military declined to comment.
However, Iranian Supreme Leader Ayatollah Ali Khamenei on Sunday told an audience that the Israeli attack “should not be exaggerated nor downplayed,” while stopping short of calling for an immediate retaliatory strike. Israeli Prime Minister Benjamin Netanyahu separately said Sunday that Israel’s strikes “severely harmed” Iran and that the barrage “achieved all its goals.”
It remains unclear how many sites in total were targeted in the Israeli attack. There have been no images of damage so far released by Iran’s military.
Iranian officials have identified affected areas as being in Ilam, Khuzestan and Tehran provinces. Burned fields could be seen in satellite images from Planet Labs PBC around Iran’s Tange Bijar natural gas production site in Ilam province on Saturday, though it wasn’t immediately
clear if it was related to the attack. Ilam province sits on the Iran-Iraq border in western Iran.
The most telling damage could be seen in Planet Labs images of Parchin, some 40 kilometers (25 miles) southeast of downtown Tehran near the Mamalu Dam. There, one structure appeared to be totally destroyed while others looked damaged in the attack.
At Khojir, some 20 kilometers (12 miles) away from downtown Tehran, damage could be seen on at least two structures in satellite images.
Analysts including Decker Eveleth at the Virginia-based think tank CNA, Joe Truzman at the Washington-based Foundation for Defense of Democracies and former United Nations weapon inspector David Albright, as well as other open-source experts, first identified the damage to the bases. The locations of the two bases correspond to videos obtained by the AP showing Iranian air defense systems firing in the vicinity early Saturday.
At Parchin, Albright’s Institute for Science and International Security identified the destroyed building against a mountainside as “Taleghan 2.” It said an archive of Iranian nuclear data earlier seized by Israel identified the building as housing “a smaller, elongated high explosive chamber and a flash X-ray system to examine small-scale high explosive tests.”
“Such tests may have included high explosives compressing a core of natural uranium, simulating the initiation of a nuclear explosive,” a 2018 report by the institute says.
In a message posted to the social platform X early Sunday, the institute added: “It is not certain whether Iran used uranium at ‘Taleghan 2,’ but it is possible it studied the compression of natural uranium hemispheres, which would explain its hasty and secretive renovation efforts following the IAEA’s request to access Parchin in 2011.”
It’s unclear what, if any, equipment would have been inside of the “Taleghan 2” building early Saturday. There were no Israeli strikes on Iran’s oil industry, nor its nuclear enrichment sites or its nuclear power plant at Bushehr during the assault.
Rafael Mariano Grossi, who leads the IAEA, confirmed that on X, saying
“Iran’s nuclear facilities have not been impacted.”
“Inspectors are safe and continue their vital work,” he added. “I call for prudence and restraint from actions that could jeopardize the safety & security of nuclear & other radioactive materials.”
Other buildings destroyed at Khojir and Parchin likely included buildings where Iran used industrial mixers to create the solid fuel needed for its extensive ballistic missile arsenal, Eveleth said.
In a statement issued immediately after the attack Saturday, the Israeli military said it targeted “missile manufacturing facilities used to produce the missiles that Iran fired at the state of Israel over the last year.”
Destroying such sites could greatly disrupt Iran’s ability to manufacture new ballistic missiles to replenish its arsenal after the two attacks on Israel. Iran’s paramilitary Revolutionary Guard, which oversees the country’s ballistic missile program, has been silent since Saturday’s attack.
Iran’s overall ballistic missile arsenal, which includes shorter-range missiles unable to reach Israel, was estimated to be “over 3,000” by Gen. Kenneth McKenzie, then-commander of the U.S. military’s Central Command, in testimony to the U.S. Senate in 2022. In the time since, Iran has fired hundreds of the missiles in a series of attacks.
There have been no videos or photos posted to social media of missile parts or damage in civilian neighborhoods following the recent attack — suggesting that the Israeli strikes were far more accurate that Iran’s ballistic missile barrages targeting Israel in April and October. Israel relied on aircraft-fired missiles during its attack.
However, one factory appeared to have been hit in Shamsabad Industrial City, just south of Tehran near Imam Khomeini International Airport, the country’s main gateway to the outside world. Online videos of the damaged building corresponded to an address for a firm known as TIECO, which advertises itself as building advanced machinery used in Iran’s oil and gas industry.
Officials at TIECO requested the AP write the company a letter before responding to questions. The firm did not reply to a letter sent to it.

BRUSSELS (AP) — North Korea has sent about 10,000 troops to Russia to train and fight in Ukraine within “the next several weeks,” the Pentagon said Monday, in a move that Western leaders say will intensify the almost three-year war and jolt relations in the Indo-Pacific region.
Some of the North Korean soldiers have already moved closer to Ukraine, Pentagon spokeswoman Sabrina Singh said, and were believed to be heading for the Kursk border region, where Russia has been struggling to push back a Ukrainian incursion.
Earlier Monday, NATO SecretaryGeneral Mark Rutte NATO confirmed recent Ukrainian intelligence reports that some North Korean military units were already in the Kursk region.
Adding thousands of North Korean soldiers to Europe’s biggest conflict since World War II will pile more pressure on Ukraine’s weary and overstretched army. It will also stoke geopolitical tensions in the Korean Peninsula and the wider Indo-Pacific region, including Japan and Australia, Western officials say.
Russian President Vladimir Putin is keen to reshape global power dynamics. He sought to build a counterbalance to Western influence with a summit of BRICS countries, including the leaders of
China and India, in Russia last week. He has sought direct help for the war from Iran, which has supplied drones, and North Korea, which has shipped large amounts of ammunition, according to Western governments.
Rutte told reporters in Brussels that the North Korean deployment represents “a significant escalation” in Pyongyang’s involvement in the conflict and “a dangerous expansion of Russia’s war.”
President Joe Biden also called the deployment “dangerous. Very dangerous.”
Defense Secretary Lloyd Austin and Secretary of State Antony Blinken will meet with their South Korean counterparts later this week in Washington.
Singh said Austin and Defense Minister Kim Yong-hyun will discuss the deployment of North Korean soldiers in Ukraine. There will be no limitations on the use of U.S.-provided weapons on those forces, Singh said.
“If we see DPRK troops moving in towards the front lines, they are co-belligerents in the war,” Singh said, using the acronym for the Democratic People’s Republic of Korea, or North Korea. “This is a calculation that North Korea has to make.”

signed a joint security pact last June. He stopped short of confirming North Korean soldiers were in Russia.
Lavrov claimed that Western military instructors long have been covertly deployed to Ukraine to help its military use long-range weapons provided by Western partners.
Ukraine, whose defenses are under severe Russian pressure in its eastern Donetsk region, could get more bleak news from next week’s U.S. presidential election. A Donald Trump victory could see key U.S. military help dwindle.
In Moscow, the Defense Ministry announced Monday that Russian troops have captured the Donetsk village of Tsukuryne — the latest settlement to succumb to the slow-moving Russian onslaught.
Rutte spoke in Brussels after a high-level South Korean delegation, including top intelligence and military officials as well as senior diplomats, briefed the alliance’s 32 national ambassadors at NATO headquarters.
Rutte said NATO is “actively consulting within the alliance, with Ukraine, and with our Indo-Pacific partners,” on developments. He said he was due to talk soon with South Korea’s president and Ukraine’s defense minister.
“We continue to monitor the situation closely,” he said. He did not take questions
after the statement.
The South Koreans showed no evidence of North Korean troops in Kursk, according to European officials who were present for the 90-minute exchange and spoke to The Associated Press about the security briefing on condition of anonymity.
It’s unclear how or when NATO allies might respond to the North Korean involvement. They could, for example, lift restrictions that prevent Ukraine from using Western-supplied weapons for long-range strikes on Russian soil.
Ukrainian President Volodymyr Zelenskyy, citing intelligence reports, claimed last Friday that North Korean troops would be on the battlefield within days.
He previously said his government had information that some 10,000 troops from North Korea were being readied to join Russian forces fighting against his country.
Days before Zelenskyy spoke, American and South Korean officials said there was evidence North Korea had dispatched troops to Russia.
