SPRINGFIELD – Illinois Attorney General Kwame Raoul and Gov. JB Pritzker’s administration are asking a state appellate court to set aside a lower court order from late Friday that invalidated the mask and vaccine mandates that the state imposed last year for public schools. On Friday, Sangamon County Circuit Judge Raylene Grischow granted a temporary restraining order blocking schools from enforcing those mandates, saying the mitigation rules amounted to a kind of “quarantine” and that the Pritzker administration overstepped its bounds by issuing those mandates through emergency rules. “The judge’s decision cultivates chaos for parents, families, teachers and school administrators across the state, and I’ve asked Attorney General Kwame Raoul to seek to have the ruling overturned with all possible speed,” Pritzker said during a news conference Monday. Beginning in August 2021, Pritzker issued a series of executive orders related

to the reopening of public schools. They included a requirement that schools enforce a mask mandate for all students, staff and visitors; that they require all school personnel either be vaccinated or submit to weekly testing, and that they exclude from school premises for specified periods of time any student or staff member who tests positive for COVID-19 or who has been in close contact with someone who has. The Illinois Department of Public Health and the Illinois State Board of Education then issued a series of emergency rules to implement the executive orders. Parents, students and, in some cases, teachers sued roughly 170 school districts across the state seeking to block those mandates. Those cases were eventually consolidated and transferred to Sangamon County. In her ruling Friday, Grischow said that at the time the emergency rules were issued, the Department of Public Health had known about COVID-19 for well over a year and a half and that vaccines had been around for more than nine months. She then questioned why the rules could not have been developed under the normal process which would have allowed for public comment and legislative review.

She also noted that state law gives the Department of Public Health authority to issue vaccine mandates. But in this case, IDPH did not issue such a mandate, the governor did, and then the State Board of Education issued rules to carry out the governor’s order – something she said was an improper delegation of an executive branch agency’s authority. “The court cannot find (nor did any party provide) any law enacted by the state Legislature that grants the IDPH the authority to delegate and transfer its duties and responsibilities to ISBE and local school districts,” Grischow wrote. She also found that exclusion from school buildings was a form of quarantine, and under state law, people who are ordered quarantined have a right to challenge the order in court and receive due process. Her order strikes down several provisions of the emergency rules IDPH and ISBE issued in September and specifically restrains the agencies from requiring school districts to enforce mask mandates without a lawful quarantine order from a local health department. It also restrains them from requiring districts to exclude unvaccinated individuals from the premises who object to weekly testing without first providing them due process. And it restrains them from excluding individuals who are deemed a close contact with a confirmed or probable COVID-19 case without providing them due process. The attorney general’s office filed immediate notices of appeal in the cases and on Monday filed motions asking for an emergency stay of the order pending the appeal. “These requirements – which have provided safety and stability to students, teachers, and schools for months – allow schools to protect their students and staff while providing an opportunity to return to in-person learning,” the motion stated. As of Monday afternoon, the 4th District Court of Appeals had not yet ruled on the motion for an emergency stay. Bell Bowl Prairie is the last local refuge for a large number of species, and its destruction would doubtlessly seal their fate. Ed is a popular speaker on the flora of Winnebago
County. From Roscoe, Illinois, he is currently the Plants Program Manager and Restoration Project Manager at Coos Watershed Association in Coos Bay, Oregon. He learned about the local flora of working for the Forest Preserve District and as the restoration ecologist with the Natural Land Institute. He graduated from Montana State University in 2013 with degrees in land rehabilitation and wildlife habitat ecology and management. Retired pope asks pardon for abuse, but admits no wrongdoing By Nicole Winfield Associated Press
ROME (AP) — Retired Pope Benedict XVI asked forgiveness Tuesday for any “grievous faults” in his handling of clergy sex abuse cases, but denied any personal or specific wrongdoing after an independent report criticized his actions in four cases while he was archbishop of Munich, Germany. “I have had great responsibilities in the Catholic Church. All the greater is my pain for the abuses and the errors that occurred in those different places during the time of my mandate,” the retired pope said. But Benedict’s lack of a personal apology or any admission of guilt was likely to rile survivors and further complicate efforts by German bishops re-establish credibility with the faithful. Demands for accountability have only increased as the church has come to terms with decades of sexual abuse by priests and cover-up by their bishops. Benedict, 94, was responding to a Jan. 20 report from a German law firm that had been commissioned by the German Catholic Church to look into how cases of sexual abuse were handled in the Munich archdiocese between 1945 and 2019. Benedict, the former Cardinal Joseph Ratzinger, headed the archdiocese from 1977 to 1982. The report faulted Benedict’s handling of four cases during his time as archbishop, accusing him of misconduct for having failed to restrict the ministry of the priests in the cases even after they had been convicted criminally. The report also faulted his predecessors and successors, estimating there had been at least 497 abuse victims over the decades and at least 235 suspected perpetrators. The Vatican on Tuesday released a letter that Benedict wrote to respond to the allegations, alongside a more technical reply from his lawyers who had provided an initial 82-page response to the law firm about his nearly five-year tenure in Munich. The conclusion of Benedict’s lawyers was resolute: “As an archbishop, Cardinal Ratzinger was not involved in any coverup of acts of abuse,” they wrote. They criticized the report’s authors for misinterpreting their submission, and asserted that they provided no evidence that Benedict was aware of the criminal history of any of the four priests in question. Benedict’s response was far more nuanced and spiritual, though he went on at length to thank his legal team before even addressing the allegations or the victims of abuse.
In the letter, Benedict issued what he called a “confession,” recalling that daily Mass begins with believers confessing their sins and asking forgiveness for their faults and even their “grievous faults.” Benedict noted that in his meetings with abuse victims while he was pope, “I have seen at first hand the effects of a most grievous fault. “And I have come to understand that we ourselves are drawn into this grievous fault whenever we neglect it or fail to confront it with the necessary decisiveness and responsibility, as too often happened and continues to happen,” he wrote. “As in those meetings, once again I can only express to all the victims of sexual abuse my profound shame, my deep sorrow and my heartfelt request for forgiveness.” The law firm report identified four cases in which Ratzinger was accused of misconduct in failing to act against abusers. Two cases involved priests who offended while Ratzinger was archbishop and were punished by the German legal system but were kept in pastoral ministry without any limits on their ministry. A third case involved a cleric who was convicted by a court outside Germany but was put into service in Munich. The fourth case involved a convicted pedophile priest who was allowed to transfer to Munich in 1980, and was later put into ministry. In 1986, that priest received a suspended sentence for molesting a boy. Benedict’s team had earlier clarified an initial “error” in their submission to the law firm that had insisted Ratzinger was not present at the 1980 meeting in which the priest’s transfer to Munich was discussed. Ratzinger was there, but his return to ministry was not discussed, they said. Benedict said he was deeply hurt that the “oversight” about his presence at the
meeting had been used to “cast doubt on my truthfulness, and even to label me a liar.” But he said he had been heartened by the letters and gestures of support he had received, including from his successor. “I am particularly grateful for the confidence, support and prayer that Pope Francis personally expressed to me,” he said. The Vatican had already strongly defended Benedict’s record in the aftermath of the law firm report, recalling that Benedict was the first pope to meet with victims of abuse, that he had issued strong norms to punish priests who raped children and had directed the church to pursue a path of humility in seeking forgiveness for the crimes of its clerics. The Vatican’s defense, however, focused primarily on Benedict’s tenure as head of the Holy See’s doctrine office, from 1982 until he was elected pope in 2005. Benedict reflected on his legacy at the end of his letter, noting that he is at the end of his life and will soon be judged by God. “Quite soon, I shall find myself before the final judge of my life,” he wrote. “Even though, as I look back on my long life, I can have great reason for fear and trembling, I am nonetheless of good cheer. For I trust firmly that the Lord is not only the just judge, but also the friend and brother who himself has already suffered for my shortcomings.” The head of the German bishops conference, Limburg Bishop Georg Baetzing, had previously said that Benedict needed to respond to the report by distancing himself from his lawyers and advisers. “He must talk, and he must override his advisers and essentially say the simple sentence: ‘I incurred guilt, I made mistakes and I apologize to those affected,” Baetzing said. “It won’t work any other way.” Baetzing didn’t immediately comment Tuesday on Benedict’s response.

Macron on diplomatic shuttle to Kyiv to ease Ukraine crisis By Sylvie Corbet and Dasha Litvinova Associated Press
KYIV, Ukraine (AP) — French President Emmanuel Macron brought his diplomatic effort to defuse the crisis over Ukraine to its capital of Kyiv on Tuesday, a day after hours of talks with Russian President Vladimir Putin yielded no apparent breakthrough. Macron met with Ukrainian President Volodymyr Zelenskyy as fears of a possible Russian invasion mount. Moscow has massed over 100,000 troops near Ukraine’s borders, but insists it has no plans to attack. The Kremlin wants guarantees from the West that NATO will not accept Ukraine and other former Soviet nations as members, that it halt weapon deployments there and roll back its forces from Eastern Europe — demands the U.S. and NATO reject as nonstarters. Western leaders in recent weeks have engaged in multiple rounds of diplomacy in the hope of de-escalating the tensions and preventing an attack. High-level talks have taken place against the backdrop of military drills in Russia and Belarus. On Tuesday, Russia’s Defense Ministry said six large landing ships were moving from the Mediterranean to the Black Sea for exercises. Macron’s talks with Putin on Monday lasted more than five hours, and the French leader told reporters that they allowed him to ensure that “there’s no degradation and no (further) escalation.” He said he did not expect Putin to make any “gestures”, saying his objective was to “prevent an escalation and open new perspectives. ... That objective is met.” Macron said Putin “set a collective trap” when he initiated the exchange of written documents with the U.S. Moscow submitted its demands to Washington in the form of draft agreements that were released to the public, and insisted on a written response, which was leaked to the press. “In the history of diplomacy, there was never a crisis that has been settled by exchanges of letters which are to be made public afterward,” he said, adding that is why he decided to travel to Moscow for direct talks. Putin said after the meeting that the U.S. and NATO ignored Moscow’s demands, but signaled his readiness to continue talking. NATO, U.S. and European leaders flatly reject the demands that they say challenge NATO’s core principles, like shutting the door to Ukraine or other countries that might seek membership; but they have offered to talk about other Russian security concerns in Europe.
Putin warned that Ukraine membership in NATO could trigger a war between Russia and the alliance should Kyiv move to retake the Crimean Peninsula, which Moscow annexed in 2014. In that case, he said, European countries would be drawn into a military conflict with Russia where “there will be no winners.” U.S. President Joe Biden has said that any prospect of Ukraine entering NATO “in the near term is not very likely,” but he and other NATO member nations and NATO itself refuse to rule out Ukraine’s entry into the alliance at a future date. Biden met in Washington on Monday with German Chancellor Olaf Scholz, who also will travel to Kyiv and Moscow on Feb. 14-15. Biden vowed that the Nord Stream 2 Russia-to-Germany gas pipeline, which has been completed but is not yet operating, will be blocked “if Russia invades, that means tanks and troops crossing the border of Ukraine again.” Halting the pipeline’s operation would hurt Russia economically but also cause supply problems for Germany. Scholz warned Moscow that “a lot more could happen than they’ve perhaps calculated with themselves” in case of an invasion. British Prime Minister Boris Johnson warned Russia that an invasion of Ukraine will only make NATO stronger, but said he still believes “principled and determined diplomacy” could defuse the crisis. Writing in The Times of London, Johnson urged allies to finalize plans for heavy economic sanctions that would come into effect if Russia crosses the border into Ukraine. He said the U.K. is ready to bolster NATO forces in Latvia and Estonia as he prepared to meet the Lithuanian prime minister in London on Tuesday to show support for the Baltic nations. Johnson said he was considering dispatching RAF Typhoon fighters and Royal Navy warships to southeastern Europe. Britain said Monday it is sending 350 troops to Poland to bolster NATO’s eastern flank. It already has sent anti-tank weapons to Ukraine. More than 100 U.S. military personnel have arrived in Romania ahead of a deployment of about 1,000 NATO troops expected in the country in the coming days, Romania’s Defense Minister Vasile Dincu said, adding that “it won’t be long before the rest of the troops arrive.” U.S. officials have said that about 1,000 alliance troops will be sent from Germany
to Romania, a NATO member since 2004. Romania borders Ukraine to the north. U.S. officials have portrayed the threat of an invasion of Ukraine as imminent — warnings Moscow has scoffed at, accusing Washington of fueling tensions. Russia and Ukraine have been locked in a bitter conflict since 2014, when Ukraine’s Kremlin-friendly president was ousted, Moscow annexed Crimea and then backed a separatist insurgency in the east of the country. The fighting between Russiabacked rebels and Ukrainian forces has killed over 14,000 people. In 2015, France and Germany helped broker a peace deal, known as the Minsk
agreements, that ended large-scale hostilities but failed to bring a political settlement of the conflict. The Kremlin has repeatedly accused Kyiv of sabotaging the deal, and Ukrainian officials in recent weeks said that implementing it would hurt Ukraine. After meeting Macron, Putin said without elaboration that some of the French president’s proposals could serve as a basis for a settlement of the separatist conflict, adding that they agreed to speak by phone after Macron’s visit to Kyiv. Ukraine’s Foreign Minister Dmytro Kuleba said Kyiv was “open to dialogue,” but would not cross its own “red lines.”

Growing strawberries: Selecting Varieties BY GRANT MCCARTY CONTRIBUTOR
Once you’ve decided whether you’ll grow Day-Neutral or June-Bearing, there are some additional decisions you’ll need to make when it comes to managing them. First though, let’s discuss recommended varieties. Most of the time when you order strawberries you are purchasing them as bare roots. They’ll arrive mid to late April without much growth to them. Over the season, they’ll grow for you and if they are the Day Neutral, produce strawberries for you. You might also find strawberries as transplants at home and
garden centers this season. Whether you choose bare-root or transplants, both should work fine for you. If you purchase them as transplants, inspect them to ensure that there are not any diseased/ infected leaves. A single strawberry plant tends to yield 1 ½ lbs of strawberries over the course of it’s season. For June-Bearing, this would be over 3-4 weeks while Day-Neutral would be that longer season from end of June to October. If you are to plant 10 strawberry plants, you might expect 15 lbs of strawberries. You should recognize though this is in a perfect growing season. Recommended June-Bearing straw-
berries include ‘Jewel’, ‘Honeyoye’, ‘Annapolis’, ‘Earliglow’, and ‘Cabot’. Most of these tend to be very vigorous which means they’ll grow well but would also produce a number of runners and you would need to remove some of these runners as needed. ‘Earliglow’ is one that produces early but also is recommended for beginners. If growing in an area you feel stays cooler, ‘Cabot’ is one that is very adapted to colder climates. Day-Neutral strawberries that would grow well in our area include ‘Albion’, ‘Seascape’, ‘Evie 2’, ‘Porotola’, and ‘San Andreas’. Some of these are less sensitive to heat such as ‘Evie 2’. One that has high
yields and large berries is ‘Albion’ but it does need consistent watering. ‘Porotola’ has great yields but flavor has been noted to be muted. What you’ll find with any variety of strawberry is that it can have some issues. They may be sensitive to heat, cold, rain, and other conditions that may be out of your control. You can help address some of this through your planting location, spacing, and consistent water/fertilizer. Next week we’ll continue our strawberry discussion with management. The transition to cleaner energy sources has run into some bumps in the road. One of them involves securing open space to install large scale solar and wind farms. Open space has often been targeted for developments by other interests. We once considered accepting a position with a Minnesota Park District which involved defending parkland from being enveloped by transportation projects. In Chile a group of thousands of poor people from the impoverished countryside arrived overnight and established a community in a park on the fringes of an urban setting. The expansion of utility scale wind and solar farms along with new power lines occupies substantial amounts of open space. In some areas they are welcomed but in others they are resisted. An example of this is in Indiana. In northern Indiana a 1,300 acre solar park was approved for construction over some local resistance. In another area of the state 34 counties have ordinances either restricting or blocking utility scale renewable energy projects. An e�ort in Indiana to transfer authority over siting utility scale projects from county o�cials to state o�cials was rejected by state legislators. Given the substantial economic incentives involved for land owners, taxing bodies and
utilities, e�orts to pass legislation more favorable for solar and wind projects are continuing. In Florida citizens succeeded in blocking two utility scale solar projects on the county level and soon after authority for approving siting projects was taken away from counties and transferred to the state level. In Illinois authority over siting such facilities remains at the county level. In England a project involving installing solar panels on 2,800 acres of crop producing farmland has met resistance from some local farmers. They pointed out that England currently only produces 60% of the food they consume and losing productive farmland increases the need for importing food adding to their carbon footprint. During the housing boom over a decade ago concern was raised over the loss of farmland and e�orts were made to protect it from development. Installation of a subdivision provides substantial economic benefits to land owners in a limited area but incentives for solar and wind farms create far more opportunities to convert farmland into developments. The search for sites for large scale installations has primarily focused on flat lands; grading the land to achieve that end has been a common practice. Developers are now adapting equipment to fit the land whether a wetland, hillside or mountain side.
Intensified interest has turned to utilizing U.S. coastal waters. The Biden administration has set a goal of 30,000 MW of o�shore wind installations by 2030 which has met with some resistance. Interest in siting renewable installations in the Great Lakes also remains. The focus on o�shore installations could lessen some of the pressures for installations on open lands. In earlier articles we indicated our support for rooftop solar installations and mini grid developments in urban settings where the massive consumption of electricity occurs. Illinois already allows municipalities to generate some of their own electricity and some 40 operations exist but more could be created. Some utilities continue to use their monopoly powers to block innovations in electrical systems. If successful, a California initiative could dramatically undermine the economic benefits for rooftop solar. The utilities point out that rooftop installations pass their costs onto customers without solar systems. Ignored are the benefits to all other customers from the presence of rooftop systems. New Jersey legislators are also considering ways to cut solar subsidies indicating the industry has matured to the point where subsidies are no longer needed. The desire to upgrade the national grid is raising the cost of electricity for
all consumers while benefitting utility interests including those in Illinois. Only some of those costs can be attributed to the presence of renewable installations. Properly sited rooftop solar systems can reduce the need for grid expansions. Building massive facilities to accommodate the distribution of goods and services provides substantial amounts of roof space to accommodate solar panels. Such space should be utilized leaving more land for ecological services, species diversity, agricultural purposes and aesthetic considerations. Given the threats to human welfare and the environment from climate change, a transition to cleaner energy sources remains essential. While we continue to support renewable energy it is only a partial solution to our economic and environmental challenges and imposes its own set of social, economic and environmental impacts. The fi rst Earth Day celebration in 1970 explained the massive threat to the environment and human welfare from the endless pursuit of economic growth on our finite planet. While some modest reforms were implemented the magnitude of the threat was ignored, dismissed or minimized accelerating the destructive trends. We are now living with some of the consequences of the ongoing pursuit of economic growth.

The Nation’s Largest Auto Show is back in its usual slot on the calendar, this Saturday, February 12 through Monday, February 20 at Chicago’s McCormick Place. There will be hundreds of cars on display in over 1 million square feet of exhibit space. A few companies have cut back or are no longer participating, but you’ll find hundreds of cars to choose from, all under one roof. If you are thinking about buying a car, this is the best place to screen the various makes and models. Like many others, we wish Tesla, Rivian and BMW North America would participate in the show. Sadly, they are not. Admission. General admission is $15. Seniors and children $10. You can buy online or at the door. There are sometimes discount o�ers floating around, particularly from car dealers. Dealing with Covid protocols. While many in the State Line Region take a “live
and let live” attitude locally, be advised that these rules are taken seriously (and enforced) in Chicago. This year outside food and beverages are not permitted inside the Chicago Auto Show. Masks are required for all attendees age 2 and over, except when eating and drinking. Masks must cover the nose and mouth. Remember, if you ride Metra or CTA to get to the show, masks must be worn at all times there, too. Proof of COVID-19 vaccine will not be required for admission to the show, but see the rules for food service below. Food service. Designated food service areas will be set up at the Auto Show. Proof of COVID-19 vaccine will be required, as well as a photo ID for everyone over 16 for entry into those areas. Many Chicago restaurants are following the same rules for dine-in service. Carry-out is generally exempt, but you are expected to wear your mask when ordering.

Avoid tra�c, tolls and high parking fees at McCormick Place. Parking at McCormick Place is $25. One option is to take Metra from Woodstock, Crystal Lake or Elgin. Special Auto Show buses will operate between the Ogilvie Transportation Center/Union Station and McCormick Place. These buses will have either “To Auto Show McCormick Place” or “Metra Stations/ Via Downtown” in their destination signs depending on the direction of travel. This bus charges the regular CTA fare, which is $2.25 each way, exact change required. Generally, outside of the auto show times, there is no direct bus from either Ogilvie or Union Stations to McCormick Place. During the weekday, we suggest you use the Park and Ride at I-90 and Randall Road. Parking is free. Round trip to the Chicago Auto Show will cost you about $5 with your Ventra card. If you don’t have a Ventra card, you can pay an exact cash fare of $2.25 on the express bus and buy a Ventra card at the Blue Line for the rest of your trip. The express bus (which has
reclining leather seats and free wifi) will take you to an easy transfer to the Blue Line at Rosemont. At Clark and Lake, take the escalators up to the Green Line. Ride the Green Line to the 22nd Street/ McCormick Place Station. McCormick place is a short walk. In the evening or on the weekend, we suggest you drive to the CTA Park and Ride at Cumberland Avenue and the Kennedy Expressway. Parking is $6 for 12 hours. Take the Blue Line to Clark and Lake, where you’ll transfer to the Green Line as described above. Round trip fare to McCormick Place from Cumberland is also $5. Ventra cards can be purchased or fare added at Rosemont, Cumberland or any CTA Rapid Transit station. There are plenty of CTA personnel at all of the rapid transit stations, who will happily give you directions if you need them.
