State Reopening

State releases Phase 4 guidance as hospitalization numbers continue to decline Restaurants can offer indoor dining with restrictions in place By Jerry Nowicki

SPRINGFIELD – Restaurants across the state are set to open for indoor dining Friday among other additions to allowable activities under the state’s Restore Illinois plan. The state released new guidance for reopening businesses Monday. Restaurants must arrange their seating facilities so that tables are 6 feet apart, and parties larger than 10 people will not be allowed, per state guidelines. Standing areas such as bars will be allowed to operate at no more than 25 percent of capacity, and staff is required to wear face coverings when serving customers. As well, gatherings of 50 people – up from 10 – will be allowed in Illinois, including at weddings and funerals; and fitness centers, movie theaters, museums and zoos will be allowed to reopen with capacity limits and health guidelines in place. Industry-specific guidelines from the state can be found at Illinois.gov/ businessguidelines. The state continues to see downward trends in hospitalizations and positivity rate of those tested for the COVID-19 virus. The number of new cases has leveled off to about 450 to 700 daily over the past 10 days, even as more businesses and activities get the green light to reopen. Hospital bed, intensive care bed and ventilator use by COVID-19 patients on Monday all were at lows since the state began reporting the numbers daily on April 12, with 1,628, 419 and 256, respectively. The state continues to report about 18,000 to 30,000 test results daily, and the positivity rate for tests conducted over the past seven days is approximately 2 percent, according to the Illinois Department of Public Health. Monday’s 462 new cases among 18,219 tested made for a positivity rate of about 2.5 percent, and the new cases reported were the lowest in one week’s time. There were 26 more COVID-19-related deaths reported

to bring the total to 6,671 among 137,224 confirmed cases since the pandemic began, and the recovery rate is 94 percent for those 42 days removed from a positive test, according to IDPH. “The state of Illinois has made great progress in slowing the spread of COVID19, largely because of the measures our administration enacted to protect residents and communities during this public health crisis,” IDPH Director Dr. Ngozi Ezike said in a news release. “Our strategy to encourage social distancing and expand testing and contact tracing will enable Illinois communities to continue to take steps to reopen, to return to work and to resume daily activities.” While some – including business groups and legislative Republicans – have urged Gov. JB Pritzker’s administration to expedite entry into the fourth phase of his five-phase reopening plan due to the progress being made, he has strictly adhered to the original timeline – with some revisions such as allowing outdoor dining earlier in the process – of the plan that he announced on May 5. While each of the second, third and fourth phases of the plan lasted 30 days, there is no timetable for moving from Phase 4 to Phase 5, the final phase of the plan when the state’s economy fully reopens, including conventions, festivals and large events. Per the current plan, Phase 5 cannot begin without a coronavirus vaccine or “highly effective treatment” being widely available, or without new cases of the virus being eliminated for a sustained period. When Phase 4 begins Friday, venues will be able to host up to 50 people or 50 percent of their overall room capacity – whichever number is less. Multiple groups are permitted at certain facilities as long as there is space to social distance and limit interaction between groups. Bowling alleys, skating rinks and clubhouses are on the list of allowable indoor and outdoor recreation under Phase 4, provided they also operate at the lesser of 50 customers or half capacity. Groups of 50 will be allowed for outdoor recreation, and multiple groups can gather if they can

remain separated. Museums and zoos can reopen at 25 percent capacity or less, but interactive exhibits and rides must be closed. Guided tours will be allowed but must be limited to 50 people or fewer per group. Indoor exhibits at zoos will remain closed as well. Indoor-seated theaters and performing arts centers would be allowed to open with 50 guests maximum or 50 percent capacity, whichever is less, in each of the theater’s screening rooms or performance spaces. Outdoor capacity would be limited to 20 percent of overall theater or performance space capacity. Concessions would be permitted if: delivered by a server who takes orders from guests while seated with distancing guidelines followed, or purchased pre-packaged via “grab and go” function at an outdoor kiosk or indoor service areas. The guidelines also included revisions for youth and recreational sports. Those include allowing competitive gameplay and tournaments with venues operating at half capacity and 20 percent seating capacity for spectators. Group sizes of up to 50 would be allowed with multiple groups permitted during practice and competitive games as long as interaction between groups is limited. Gyms and fitness centers can open at half capacity and can have group fitness classes of up to 50 people with new indoor safety guidelines. Multiple groups, provided interaction between them is limited, would be permitted at these facilities as well As well, seating capacities of 20 percent would be allowed at outdoor spectator sports, and film production could resume at no more than half capacity of the sound stage or filming location. Water-based activities would be permitted at day camps in accordance with IDPH guidelines, half facility capacity and with a group size of no more than 15 participants. BERLIN (AP) – Renewed lockdown measures in a German region where hundreds of coronavirus cases sprung up at a slaughterhouse and news that the world’s top-ranked tennis player has also been infected provided a stark reminder to Europeans on Tuesday that the pandemic is far from gone. Meanwhile, Britain, which has recorded the most coronavirus-related deaths in Europe, pressed on with its easing of the lockdown by confirming that restaurants, bars, hair salons and cinemas can reopen on July 4. By contrast, Germany was reimposing some lockdown restrictions in North Rhine-Westphalia state after more than 1,550 people have tested positive for coronavirus at the Toennies slaughterhouse in Rheda-Wiedenbrueck and thousands more workers and family members were put into quarantine to try to halt the outbreak. On Tuesday, North Rhine-Westphalia Gov. Armin Laschet said people in Guetersloh and parts of a neighboring county will now face the same restrictions that Germany saw in March and April, including curbs on social gatherings and bar closures. “The purpose is to calm the situation, to expand testing to establish whether or not the virus has spread beyond the employees of Toennies,” Laschet said. Laschet expressed frustration at the company’s handling of the outbreak, saying authorities had to order Toennies to release the names of its employees. “The readiness to cooperate could have been greater,” he said. Union officials have blamed poor working and living conditions that migrant workers faced under a loosely regulated sub-contractor. Word of Novak Djokovic’s infection again illustrated that there’s little room for complacency in doing what’s necessary to beat back the disease. The world’s number one tennis player, said he and his wife contracted the coronavirus after he played in a series of exhibition matches he organized in Serbia and Croatia with zero social distancing. The announcement by Djokovic who stands third in men’s tennis history with 17

Grand Slam titles has put into question the wisdom of a full-fledged return of tennis, including the U.S. Open in August. The Serb tennis star is the fourth player to test positive for the illness after participating in the matches held in Belgrade and Zadar, Croatia. “Unfortunately, this virus is still present, and it is a new reality that we are still learning to cope and live with,” Djokovic said in a statement released Tuesday. In Britain, Prime Minister Boris Johnson announced a major rollback of lockdown measures that will let millions in England back into pubs, cinemas, churches and hair salons starting July 4. The move came amid strong pressure from businesses to ease social distancing rules. Although gyms, pools, spas and tattoo parlors will remain shut, Johnson told lawmakers that “our long national hibernation” was coming to an end. Pubs and restaurants wanted the government to cut its social distancing requirements in half to 1 meter (3 feet) between people indoors, and said many businesses wouldn’t be able to survive without the change. But some scientists worried the move is too hasty, especially since measures like a track-and-trace system to stamp out any outbreaks isn’t yet in place. “This is far too premature,” said David King, a former chief scientific adviser to the government. “To come out of (lockdown) too early is extremely risky.” The World Health Organization says the pandemic is still in its ascendancy. “The epidemic is now peaking or moving towards a peak in a number of large countries,” said Dr. Michael Ryan, WHO’s emergencies chief. South Africa braced for an anticipated surge of COVID-19 cases by opening a large field hospital with 3,300 beds in a converted car manufacturing plant. The field hospital has been constructed in the city of East London in the Eastern Cape province, one of the country’s centers of the disease. South Africa has now reported a total of 101,590 coronavirus cases, including 1,991 deaths. India has been recording about 15,000 new infections each day, and some states Tuesday were considering fresh lockdown measures to try to halt the spread of the virus among the country’s 1.3 billion people.

The government had lifted a nationwide lockdown to restart the ailing economy and give hope to millions of hungry, unemployed day laborers. India’s huge virus caseload is highlighting the country’s unequal society, where private hospitals cater to the rich and public hospitals are so overwhelmed that many people fear to enter them. In Pakistan, the government is determined to buoy the frail economy by opening up the country even if overcrowded hospitals are turning away patients. New cases have also been rising steeply in Mexico, Colombia and Indonesia. Concerns over the spread of the virus prompted Saudi Arabia’s unprecedented decision to limit the number of people performing the hajj pilgrimage this year to only a few thousand. The pilgrimage usually draws up to 2.5 million Muslims from all over the world. Saudi Arabia has one of the highest infection rates in the Middle East, with more than 161,000 confirmed cases so far, including 1,307 deaths. In the U.S., rapid increases in cases across the South and West are raising fears that progress against the virus is slipping away. The United States has the most infections and deaths by far in the world, with 2.3 million cases and over 120,000 confirmed virus-related deaths, according to a tally by Johns Hopkins University. Dr. Anthony Fauci, the government’s top infectious disease expert, was testifying before a House committee just days after President Donald Trump told an Oklahoma rally that he had asked officials to slow down testing because too many positive cases were turning up. Trump’s office later claimed he was joking. Worldwide, more than 9 million people have been infected and more than 472,000 have died, according to the Johns Hopkins tally. Experts say the true numbers are much higher because of limited testing and cases in which patients had no symptoms. WHO Director-General Tedros Adhanom Ghebreyesus said it took more than three months for the world to see 1 million confirmed infections but just eight days to see the most recent 1 million cases. “The greatest threat we face now is not the virus itself. It’s the lack of global solidarity and global leadership,” he said.

Policing Bills

A side-by-side look at police reform bills in Congress By Michael Balsamo Associated Press

WASHINGTON (AP) – As congressional lawmakers work toward one of the most ambitious policing overhauls in decades, there is increasing division between Republicans and Democrats about how to accomplish a common goal. Top Democratic leaders in the Senate said Tuesday that a Republican policing proposal is “not salvageable” and demanded new negotiations on a bipartisan legislative package after protests over racial inequality and the death of George Floyd and others at the hands of police. They want something similar to a far-reaching proposal from House Democrats – the Justice in Policing Act – that would create a national database of excessive-force encounters, limit legal protections for police and ban police chokeholds. The bill is expected to pass the House later this week. The Republican proposal in the Senate calls for an enhanced use-of-force database, restrictions on chokeholds and new commissions to study law enforcement and race. Senate Republicans say it would limit the federal government’s role while still making significant changes in policing. It remains to be seen whether the parties can bridge their differences. Here’s a look at the two competing proposals:

POLICE MISCONDUCT & USE-OFFORCE DATABASES

Many officers who wind up involved in fatal incidents have a history of misconduct, including Derek Chauvin, the Minneapolis officer charged with murder in Floyd’s death. He had at least a dozen complaints made against him, according to records. But those records are often not made public, making it difficult to know if officers have such a record. President Donald Trump signed an executive order earlier this month requiring the attorney general to create a database tracking terminations, criminal convictions and civil judgments against law enforcement officers for excessive use of force. It encourages participation by providing certain grants only to those agencies that submit the required information. — Democrats’ bill: Calls for a national registry including complaints, disciplinary records and termination records. It also would require states to report to the Justice Department any incident in which force is used against a civilian or law enforcement officer. The proposal would require the agencies to report the reason force was

used and the national origin, sex, race, ethnicity, age, disability, English language proficiency and housing status of each civilian against whom a law enforcement officer used force. — Republicans’ bill: Would require state and local governments to report all use-of-force incidents that result in serious injuries or death to the FBI on an annual basis. Municipalities that fail to comply could see a reduction in federal funding.

CHOKEHOLDS

There’s a notable difference. The Democrats’ bill would specifically ban the use of chokeholds and carotid holds at the federal level, while the Republican bill incentivizes police departments to ban the practice through grant funding. Trump’s executive order also encourages such bans through financial incentives. — Democrats’ bill: Would ban chokeholds and carotid holds and would condition law enforcement funding for state and local law enforcement agencies on establishing a law to prohibit the use of chokeholds and carotid holds. — Republicans’ bill: Would condition certain Justice Department funds on a police department having specific policies restricting the use of chokeholds, except in situations in which deadly force is authorized.

NO-KNOCK WARRANTS

There has been a growing call to ban no-knock warrants since 26-year-old Breonna Taylor was killed in her Louisville, Kentucky, home by officers in March. Democrats have proposed a ban on the practice, typically executed in some of the most dangerous investigations conducted by police departments. A no-knock warrant, as its name implies, is an order from a judge that allows police to enter a home without ringing a doorbell or banging on the door. Critics have said the use has increased dramatically, and some departments use them routinely in cases that don’t merit such an exception. — Democrats’ bill: Would specifically ban no-knock warrants for all federal drug cases and would require local and state law enforcement agencies to prohibit their use to qualify for some federal funding. Oregon and Florida are the only states that have outlawed such warrants. — Republicans’ bill: GOP senators argue there is no conclusive data on how, why and how often no-knock search warrants are used and have proposed requiring state and local law enforcement agencies to report specific data to the Department of Justice

each year. The department would then be required to make a public report.

FEDERAL CIVIL RIGHTS LAW

— Democrats’ bill: Would amend the federal civil rights law that governs police misconduct to no longer require prosecutors to prove that an officer’s actions were willful, a high burden of proof. The law would allow an officer to be charged for acting with reckless disregard for someone’s life, causing that person’s death. — Republicans’ bill: Would not amend that section of the law.

QUALIFIED IMMUNITY

Police officers are generally not held personally liable for anything that happens on the job, including when someone dies. The concept of qualified immunity has long been a way to protect police from unnecessary lawsuits and to give them the freedom to police without fear of unnecessary retribution.

— Democrats’ bill: Would amend federal misconduct statutes to make it easier for courts to find officers personally liable for the violation of civil rights. Officers might think twice before abusing their power, but it could make it more difficult to recruit police nationwide. It could also potentially lead to officers being held financially liable. — Republicans’ bill: They say this is a step too far. As an alternative, the lead senator on the bill, Tim Scott of South Carolina, has suggested a “decertification” process for officers involved in misconduct. The president’s executive order instructs the Justice Department to push local police departments to be certified. Under the order, Justice would ensure a department could only be credentialed if its use-offorce policies adhered to federal, state, and local laws. White House press secretary Kayleigh McEnany has said the qualified immunity provision in the House Democrats’ bill “is a total and complete nonstarter.”

Trellising tomatoes BY GRANT MCCARTY CONTRIBUTOR

It is probably time to trellis those tomatoes if you have not already. I am on my third string row of trellising tomatoes this year and in a visit to a home and garden center this week, I saw a sign declaring that they were sold out of tomato cages. Cages or stakes are the two most common supports given to a tomato plant. As a reminder on determining your trellis needs, these are dependent on the type of tomato and number of plants you are growing. If you have one, small tomato plant, a tomato cage would be suitable. If I was growing many

indeterminate/ determinate tomato plants, staking will be the best. Staking requires either metal or wooden stakes with one at the start of the row and the next one after every two plants when plants are spaced 18-24 inches. A benefit to the staking system is that it allows you to adjust the string level instead of depend on set spacing from a tomato cage. Metal stakes like t-posts provide considerable more support for tomatoes than wooden stakes can. Some growers may also start their row with a metal stake and use wooden stakes the rest of the row. Whichever spacing and stakes that you

decide on, you’ll need to use heavy duty string to support them. Look towards a cotton string which can provide greater support to your plants as they grow. In trellising your tomatoes, your first string line usually needs to be in place under the first branches of your tomato plant. This is typically needed when your tomato reaches close to 10 inches in height though you may find that this needs to be in place much sooner. Trellising is fairly easy to do this early on in the season. Tie your string at the start of your row, working past your first two tomatoes to ensure the string is underneath

their branches. Once you reach a stake, loop your string, and continue to the next tomatoes on the same side. When you reach the end of your row, loop again and do the same actions on the other side. When you’ve gone down the other side, cut and tie the string to the stake started with. Add an additional string line as new branches grow on the plant. You may find that this is weekly. T he rene w able energ y i ndust r y represents an economic challenge to fossil fuel interests and the business model of many utilities. The utilities are not necessarily opposed to renewable energy but some would prefer to install solar systems as a part of their business rather than having customers secure installations from other sources. Utilities have been known to challenge the existence or terms of net metering which help support customers securing solar electric systems. Consumers with solar systems usually remain connected to the grid which allows them to secure utility electrical service when the solar system does not produce su�cient power to meet their energy needs. Net metering and Federal subsidies and environmental concerns have stimulated customers to have solar systems installed on their property. It allows their electric bill to be credited for the electricity their solar or other energy sources generated as

long as that electricity does not exceed the amount used during the billing period. The Federal Regulatory Commission (FERC) reached that decision supporting net metering in 2001 and rea�rmed it in 2009. A few years ago a National Renewable Energy Laboratory study indicated nearly 40% of the roofs in Illinois were suitable sites for solar installations. Net metering and other subsidies would facilitate that transition. For years utilities have tried to eliminate net metering on the grounds that it was an unfair subsidy undermining the utilities’ role and raising costs of those customers without renewable energy systems. In most cases the utilities have had limited success in convincing state regulators to eliminate net metering. A new challenge to net metering comes from The New England Rate Payers Association (NERA) The organization petitioned FERC seeking to assert federal jurisdiction over net metering based on the unfair subsidy argument. As a remedy they seek to have net metering compensated

at the lower rate based on avoided cost, not at the higher cost customers pay for electricity. The petition has stimulated a debate regarding whether FERC has jurisdiction over state net metering policies. If FERC is granted federal jurisdiction, it would end a longstanding legal precedent of states’ rights to regulate retail electrical service. A broad coalition of renewable energy interests and political leaders including governors, mayors and some conservative politicians has developed to defend existing net metering policies and the rights of states to regulate electrical service. A group of investors in solar systems filed comments with FERC claiming that the proposal would insert the commission directly into numerous retail supply and self-supply arrangements over which the commission has no legal jurisdiction. Questions were raised regarding whether the assumption of Federal authority over net metering might also impact battery storage, including using electricity stored in the batteries of electric vehicles. The

defenders of existing net metering policies are more numerous and diverse than members of NERA. Public Citizen filed a motion with FERC documenting that 15 interested parties have made donations ranging from $5,000 to $20,000 annually to the organization. The monetary value of their contributions gives the appearance of an industry trade group and not that of a consumer group defending household interests. The decision by FERC is coming soon. The period for comment submission is over so no additional input will be accepted. The situation illustrates why environmental and energy interests are increasingly involved in legal proceedings and helps explain why they are seeking contributions to support their e�orts. The tendency to transfer political power over decisions from the local to state and federal levels is a concern. It concentrates political power at higher levels of government and reduces the opportunity for citizens to influence the rules that impact their lives.

Keeping Active Outdoors This Summer By Elizabeth Miller Rockford Area CVB

Now that the state is opening up more, it’s time to get out of the house and soak up the sun…still socially distant of course! There are tons of locations in the Rockford region you can go to get some fresh air and exercise while still being safe around others. Get ready to brush off those sneakers and stretch those legs as you enjoy the summer sun this season!

Rock Cut State Park

One of my favorite outdoor activities in the area is to go kayaking or paddle boating on Pierce Lake at Rock Cut State Park. Not only is it a great way to get outside, but it’s a great workout for your arms (if you choose the kayak) or legs (if you choose the paddleboat). Both of these kinds of boats are available to rent at Rock Cut, and it’s pretty easy to keep 6 feet away from others when you’re in the middle of the lake! My one piece of advice is to not venture out on a really windy day unless you’re prepared to paddle or peddle really hard to get back

to the dock (unfortunately speaking from experience here).

West Rock Wake Park

If you’re looking for a little more thrill as you venture out of the house, head on over to West Rock Wake Park and try your hand at wakeboarding! No boats are used for this unique wakeboard experience because you’ll be gliding across Levings Lake by a series of cables. It doesn’t matter your skill level, so you can come in as a beginner (don’t worry, you’re not obligated to attempt the jumps and rails). I’m not athletic at all and I was able to figure it out a few years ago…so you can too!

Golf

I may not be a golfer (unless you count mini putt), but I’m married to one! If you’re looking for some course recommendations, there are a few my husband recommends. If you’re a little rusty or just starting out, check out Sandy Hollow Golf Course. My husband says it’s one of the easier 18-hole courses, plus as a bonus, there is plenty of

Another great course in the area is Sinnissippi Golf Course, which my husband says is a very forgiving course (sounds like something I would need if I was golfing!). Fun fact, that’s the course my husband got his first Eagle in a game! One other course recommendation is Elliot Golf Course. This course is a little more challenging for someone just learning the sport, but the greens are meticulously maintained which keeps golfers coming back.

Tennis

If you’re looking to play a sport with others but still want to stay socially distant from others, tennis is the sport you’re looking for! Even if you’re playing doubles, there’s a good chance you’re still going to stay 6 feet away from your partner through the match. The US Constitution requires that we count EVERYONE in our country every 10 years. With all of us challenged by the COVID-19 crisis, it’s more important than ever that we truly count EVERYONE. • Completing the Census is mandatory. It’s a way to say “I count!”

• Census data is used to distribute federal and state funds during an emergency, such as COVID-19.
