SPRINGFIELD – Within five miles of the scene of a 2019 workplace mass shooting that left six people dead and five law enforcement officers injured, Gov. JB Pritzker signed a wide-ranging bill reforming the state’s gun laws Monday at the Aurora Police Department. Advocates for the new law – including Illinois State Police Director Brendan Kelly – hailed it as a measure that would provide the statutory backing and funding necessary to retrieve guns from those with revoked Firearm Owners Identification cards, while also streamlining the application and renewal process for law-abiding gun owners. “I will never forget those images, nor will I ever forget the look in the eyes of the officers of the Aurora PD. I will forever live with the scars of that day,” Kelly said during the bill signing Monday, speaking of the Aurora shooting. “Nor can any of us forget the weaknesses in the firearm safety system that were exposed.” Kristen Ziman, police chief in Aurora, recalled how the community was “ripped apart” by the shooting at Henry Pratt Company, calling it the “defining moment”

in her career ahead of her scheduled retirement at the end of the week. “What has kept me up at night since that horrific day is that the shooter used a gun he never should have had. He used that gun to steal these precious lives,” she said. “He had a revoked FOID card, which should have rendered him unable to continue owning a firearm, but a broken system caused the revocation to fall through the cracks.” Her officers “immediately began working with lawmakers” to try to fix the system, she said. Following the shooting, Kelly began a push to seek what he called “modernization” of the FOID system, while ISP also began serving more firearms enforcement details – more than 450 since the shooting, “with over 1,300 prohibited persons placed directly in compliance,” according to Kelly. Kelly said those actions were made possible by stable state government budgets, and the pace of revocations could be accelerated with the new law’s dedicated revenue streams for those actions. The new law, which was supported by gun reform advocates while the Illinois State Rifle Association remained neutral, creates a number of changes to gun statutes, including: Within 90 days of the bill’s Jan. 1, 2022, effective date, State Police must create a “prohibited persons portal” to track people who have had their cards revoked or suspended. Law enforcement agencies, state’s attorneys and the attorney general would have access to that portal. The bill also requires ISP to establish the Violent Crime Intelligence Task Force to aid in enforcement of FOID card revocation or suspension enforcement. The task force would “conduct enforcement operations” for those with suspended or revoked licenses, with a priority on individuals “presenting a clear and present danger to themselves or to others,” according to the bill. The $10 renewal fee for FOID cards will remain the same under the law, but beginning in 2022 half of it will go to the State Police Firearm Services Fund which oversees applications and renewals, and half to the State Police Revocation Enforcement Fund. Previously, $6 of that fee went to the state Fish and Wildlife fund while $3 went to the Firearms Services Fund and another $1 went to the State Police Services Fund. FOID card applicants would not be required to submit fingerprints, but if they

do, or they share with the Illinois State Police the fingerprints they filed to receive their Concealed Carry License, they would be eligible for automatic renewal without a renewal fee, provided they purchased a gun sometime within the 10-year period between renewals and passed the ISP background check in the process. That process is to be established by 2023. Starting in 2024, private sellers and buyers of guns will be required to keep a record of the sale for 20 years, unless they go through a federal firearm licensed dealer. Sellers will either have to work with federal licensees, paying a fee not to exceed $25, or with ISP to “determine the validity” of the purchaser’s Firearm Owners Identification Card “under state and federal law including the National Instant Criminal Background Check System.” Beginning in January 2022, State Police must develop a stolen gun database through which potential buyers may search the serial number of a gun to determine whether it is stolen. The measure also requires the State Police to monitor state and federal databases for residents charged with firearm-related crimes and to correlate the records with FOID and Concealed Carry Licenses to identify individuals who should not be allowed to own a gun. The bill also creates a FOID Card Review Board to consider appeals on denied or revoked cards. The bill also authorizes ISP to produce an electronic FOID and Concealed Carry License, allows the agency to provide a single card for FOID and CCL, and would update FOID and CCL renewal dates to be the same for one cardholder. The state’s concealed carry law directs funding to a state Mental Health Reporting Fund, and the new law stipulates that if there is a surplus in the fund, half will go to community-based mental health programs aimed at reducing gun violence, and half will go to award grants that use and promote the National School Mental Health Curriculum model for school-based mental health support, integration, and services. Landlords, tenants fill courts as eviction moratorium ends BY MICHAEL CASEY AND PHILIP MARCELO ASSOCIATED PRESS

PROVIDENCE, R.I. (AP) — Gabe Imondi, a 74-year-old landlord from Rhode Island, had come to court hoping to get his apartment back. He was tired of waiting for federal rental assistance and wondered aloud “what they’re doing with that money?” Hours later, Luis Vertentes, in a di�erent case, was told by a judge he had three weeks to clear out of his one-bedroom apartment in nearby East Providence. The 43-year-old landscaper said he was four months behind on rent after being hospitalized for a time. “I’m going to be homeless, all because of this pandemic,” Vertentes said. “I feel helpless, like I can’t do anything even though I work and I got a full-time job.” Scenes like this played out from North Carolina to Virginia to Ohio and beyond Monday as the eviction system, which saw a dramatic drop in cases before a federal moratorium expired over the weekend, rumbled back into action. Activists fear millions will be tossed onto the streets as the delta variant of the coronavirus surges. The Biden administration allowed the federal moratorium to expire over the weekend and Congress was unable to extend it. Historic amounts of rental assistance allocated by Congress had been expected to avert a crisis. But the distribution has been painfully slow: Only about $3 billion of the first tranche of $25 billion had been distributed through June by states and localities. A second amount of $21.5 billion will go to the states. More than 15 million people live in households that owe as much as $20 billion to their landlords, according to the Aspen Institute. As of July 5, roughly 3.6 million people in the U.S. said they faced eviction in the next two months, according to the U.S. Census Bureau’s Household Pulse Survey. In Columbus, Ohio, Chelsea Rivera showed up at Franklin County court Monday after receiving an eviction notice last month. A single mom, she’s behind $2,988 in rent and late fees for the onebedroom apartment she rents for herself and three young sons. The 27-year-old said she started to struggle after her hours were cut in May at the Walmart warehouse where she worked. She’s applied to numerous agencies for help but they’re either out of money, have a waiting list, or not able to help until clients end up in court with an eviction notice.

Rivera said she’s preparing herself mentally to move into a shelter with her children. “We just need help,” she said, fighting back tears. “It’s just been really hard with everyday issues on top of worrying about where you’re going to live.” But there was more optimism in Virginia, where Tiara Burton, 23, learned she would be getting federal help and wouldn’t be evicted. She initially feared the worst when the moratorium lifted. “That was definitely a worry yesterday,” said Burton, who lives in Virginia Beach. “If they’re going to start doing evictions again, then I’m going to be faced with having to figure out where me and my family are going to go. And that’s not something that anyone should have to worry about these days at all.” She was relieved to learn she was approved for assistance through the Virginia Rent Relief Program. Her court hearing was postponed 30 days, during which time she and her landlord can presumably work things out. “I’m grateful for that,” she said. “That’s another weight lifted o� of my shoulders.” For some tenants, getting assistance has proven impossible. After her landlord refused federal assistance to cover $5,000 in back rent, Antoinette Eleby, 42, of Miami, expects an eviction order within two to three weeks. She is sending her five children to live with her mother in another county. “My main concern is that now that I have an eviction, how will I find another place? Some places will accept you and some will not,” said Eleby, whose entire family got COVID-19 earlier this year. Around the country, courts, legal advocates and law enforcement agencies

were gearing up for evictions to return to pre-pandemic levels, a time when 3.7 million people were displaced from their homes every year, or seven every minute, according to the Eviction Lab at Princeton University. Some cities with the most cases, according to the Eviction Lab, are Phoenix with more than 42,000 eviction filings, Houston with more than 37,000, Las Vegas with nearly 27,000 and Tampa more than 15,000. Indiana and Missouri also have more than 80,000 filings. While the moratorium was enforced in much of the country, there were states like Idaho where judges ignored it, said Ali Rabe, executive director of Jesse Tree, a non-profit that works to prevent evictions in the Boise metropolitan area. “Eviction courts ran as usual,” she said. That was much the way things played out in parts of North Carolina, where on Monday Sgt. David Ruppe knocked on a weathered mobile home door in Cleveland County, a rural community an hour west of Charlotte. “We haven’t seen much of a di�erence at all,” he said. He waited a few minutes on the porch scattered with folding chairs and toys. Then a woman opened the door. “How are you?” he asked quietly, then explained her landlord had started the eviction process. The woman told Ruppe she’d paid, and he said she’d need to bring proof to her upcoming Aug. 9 court date. Ruppe, who has two young sons, said seeing families struggle day-after-day is tough. “There’s only so much you can do,” he said. “So, if you can o�er them a glimmer of hope, words of encouragement, especially if there’s kids involved. Being a father, I can relate to that.”

Bipartisan bill leaves out key climate, clean energy steps BY MATTHEW DALY ASSOCIATED PRESS

WASHINGTON (AP) — The $1 trillion bipartisan infrastructure package unveiled by the Senate includes more than $150 billion to boost clean energy and promote “climate resilience” by making schools, ports and other structures better able to withstand extreme weather events such as storms and wildfires. But the bill, headed for a Senate vote this week, falls far short of President Joe Biden’s pledge to transform the nation’s heavily fossil-fuel powered economy into a clean-burning one and stop climate-damaging emissions from U.S. power plants by 2035. Notably, the deal omits mention of a Clean Electricity Standard, a key element of Biden’s climate plan that would require the electric grid to replace fossil fuels with renewable sources such as solar, wind and hydropower. Nor does it include a Civilian Climate Corps, a Biden favorite and a nod to the Great Depression-era New Deal that would put millions of Americans to work on conservation projects, renewable energy and helping communities recover from climate disasters. The White House says the bipartisan deal is just the first step, with a proposed $3.5 trillion, Democratic-only package following close behind. The larger bill, still being developed in Congress, will

meet Biden’s promise to move the country toward carbon-free electricity, make America a global leader in electric vehicles and create millions of jobs in solar, wind and other clean-energy industries, supporters say. While the bipartisan plan is “a good start,” lawmakers will “deal with the climate crisis in the magnitude, scope and scale that’s required’’ in the Democraticonly bill, said Sen. Ed Markey, D-Mass. For now, the focus is on the bipartisan deal, which includes $550 billion in new spending for public works projects, $73 billion of that to update the electric grid and more than $50 billion to bolster infrastructure against cyberattacks and climate change. There’s also $7.5 billion for electric charging stations. Citing the deadly Texas power outages earlier this year, the White House touted spending to upgrade the nation’s power grid and boost renewable energy. An Energy Department study found that power outages cost the U.S. economy up to $70 billion a year. The bill also invests in demonstration projects for advanced nuclear reactors, carbon capture and storage and so-called clean hydrogen that can be burned with few emissions. Still, the measure falls far short of meeting Biden’s promise to address the climate crisis, even as triple-digit temperatures across the West caused hundreds of deaths this summer and a

busy Atlantic hurricane season causes extensive damage. “It is clear that the deal does not meet the moment on climate or justice,’’ said Tiernan Sittenfeld, a senior vice president of the League of Conservation Voters. “This looks like the Exxon Infrastructure Bill,’’ said Janet Redman of Greenpeace USA. “An infrastructure bill that doesn’t prevent a full-blown climate catastrophe by funding a swift transition to renewable energy would kill millions of Americans.’’ The bill o�ers “glimmers of hope” such as a multibillion-dollar commitment to clean up and remediate old oil wells and mines, Redman said, calling on Democrats to demonstrate “the courage to be visionary and go bigger” in the partisan bill expected later this year. One of the lead negotiators, Sen. Rob Portman, R-Ohio, acknowledged that no one got everything they wanted in the bipartisan bill. “But we came up with a good compromise that’s going to help the American people,’’ he said. “T h is is about i n frast r uc t ure,’’ Portman said at the White House. “This is roads and bridges, but also lots of other kinds of infrastructure, including broadband, our water system and our rail system — all of which is good for the economy. This will lead to more e�ciency and higher productivity, more economic growth.’’ The plan includes $21 billion to clean

up brownfields and other polluted sites, reclaim abandoned mine land and cap orphaned oil and gas wells. The plan will help communities near contaminated industrial sites and rural areas where abandoned oil wells pose a continuing a hazard, the White House said. The Senate voted, 66-28, Friday to advance the bill, but it’s unclear if enough Republicans will eventually join Democrats to support fi nal passage. Senate rules require 60 votes in the evenly split 50-50 chamber to advance the bill but a simple majority to pass it. The measure also faces turbulence in the closely divided House, where progressives are pushing for increased spending on climate change and other issues and centrist lawmakers are wary of adding to the federal debt. Rep. Peter DeFazio, D-Ore., chairman of the House Transportation and Infrastructure Committee, called the Senate bill inadequate and pledged to push for changes in the House, which passed a separate, $715 billion transportation and water bill in early July. Transportation is the largest contributor to greenhouse gas emissions in the U.S. DeFazio, the House bill’s lead sponsor, said his bill “charts our path forward,’’ adding that he is “fighting to make sure we enact a transformative bill that supports our recovery and combats the existential threat of climate change.’’

ROCKFORD – On Sunday, August 15th, from 2-4:00 pm, the African American Gallery will unveil its newest exhibit honoring the life and career of Lee Marks, former track and field coach for Guilford High School. This exhibit will be on display until the end of October. Lee Marks, the son of Otis and Corine Marks, was born in Carthage, Arkansas on November 17, 1944. His family moved to Rockford, Illinois when he was three years old. As a youngster, Lee participated in baseball, football, and track. Lee attended Rockford Public schools. After graduating from West High School in 1962, he attended Sioux Falls College where Lee ran track and played football. After earning a Bachelor of Arts degree, Lee began his teaching career as a fifth grade teacher in the Rockford

Public School District in 1966. In 1967, Lee was hired at Guilford High School as a physical education teacher as well as an assistant football and assistant track coach. Lee served thirty-five years as a teacher. The position of the Head Boys Track Coach began in 1969, making Lee the first African American head coach of any sport in the Rockford Public Schools. Lee devoted forty-seven years coaching track at Guilford High School. Over those years, he received a Master’s Degree from the University of Illinois as well as several awards. Most recently Lee was awarded the Rockford Register Star Distinguished Service Award in 2016 prior to his death. Recently, the Rockford School District #205 Board of Education officially named the outdoor track at Swanson Stadium The Lee Marks Memorial Track. Lee was married to his wife Karen for fifty years. To this union they had three

daughters Cynthia, Valerie, and Allison. Lee died June 17, 2017. His family is excited for the fact that Lee’s legacy will remain in the community forever. On Sunday, August 15th, the African American Gallery will host a special presentation featuring Karen Marks, his widow at 2:15. Jazz saxophonist Harlan Jefferson, a Rockford native will perform at 2:30. This event is free to the public but donations are greatly appreciated. The Heritage Museum Park is a historical campus containing the Ethnic Heritage Museum and Graham-Ginestra House. Our mission is to preserve the cultural history of all nationalities, especially those of southwest Rockford, where the city began. The Ethnic Heritage Museum is a cultural center and museum, featuring six ethnic galleries; African American, Hispanic, Irish, Italian, Lithuanian and Polish. The Graham-Ginestra House, built

in 1857, was Rockford’s first commissioned historic landmark and is on the National Register of Historic Places. This beautiful home features Italianate and Greek Revival Architecture and provides unique insight into the lives of some of Early Rockford’s most prominent. General admission to both museums is only $5 student, $7 individual, $15 per family or free to members. The Heritage Museum Park has re-opened safely and responsibly. Masks are optional on the museum campus. The Ethnic Heritage Museum is handicap accessible. The heatwave we have experienced in the last couple of weeks has led to some unusual issues in vegetable gardens in the Rockford area. While there are some issues we see every year, you might be encountering some challenges that you have not seen before. Especially if this is your second year of growing a vegetable garden for your family, it may be hard to compare. If your plants look health and you are not seeing any vegetables, it may be a couple of reasons. Over-fertilization is common for vining vegetables which leads to lush plants but a lack of flowers-vegetables. I

even encountered this with green beans last summer. Another culprit can be hot day and night temperatures that will lead to flowers dropping. This happens when temperatures are between 75-95 F. Hot temperatures may also impact the type of flowers on your vining vegetables like squash, pumpkins, and melons. These produce male and female flowers. When temperatures are above 90 F during the day and over 70 F at night, the plants develop more males than females. I have noticed this in the last week as I have some zucchini ready to be harvested but not as much as I would expect. Heat will further impact your pollinators.

Bees like temperatures between 60 to 90 F. Once temperatures are above 90 F, many bees slow down and pollinate less. This leads to a lot of problems with cucumbers as the bees are less likely to pollinate cucumbers due to their less appealing flower. Pollination may still occur but leads to deformities of these vining crops. What about vegetables that are developing but aren’t ripe? Yet again, it can be heat impacting pollination. Pollinators may not pollinate these crops properly and lead to small-misshapen squash and pumpkins that die o� quickly. You may be encountering green tomatoes hanging on the vine that aren’t ripening. I

Earth Overshoot Day came and went again this year. Few noticed it other than members of the Global Footprint Network. We weren’t sure of the date, but wanted to know. Surprise! It was the day that we started to write this week’s column. We quickly placed that topic in our next week file and went to work on Earth Overshoot. This year, it came and went again with no fanfare, no celebration, no parades. Just as silently as extinction, it came and went. Most people didn’t notice; many didn’t care. Yet it should be the most important day in our calendar, alerting us to potential disaster. In recent years, exacerbated by climate change, we are experiencing the results of Earth Overshoot. Recent months have set records as the hottest months in the history of weather recording. Earth Overshoot Day marks the date when humanity’s demand for ecological resources and services in a given year exceed what earth can regenerate that year. Between January 1 and July 29, 2021,

Earth’s human population has used all of the resources that Earth can produce and dumped all of the waste treating capacity that Earth can process this year and there are still 155 days left in 2021. Five months of drawing down and dumping are still ahead. We will be again dipping into future resources, causing a mounting ecological debt. Into the 1960s, people used about three-quarters of the earth’s capacity to both produce and absorb, leaving enough to serve future years. During the 1970s, resources were used at a rate and waste products were produced at a rate that exceeded Earth’s capacity to produce and process. Now, humanity uses the equivalent of 1.5 Earths, but we have only one Earth. In 2019, Earth Overshoot Day fell on August 20. This year, we used 22 more days’ worth of Earth’s resources than two years ago. (It was later last year, primarily due to the Covid-19 pandemic lockdown slowing economic activity.) We are gradually depleting resources that would have been used in the future. It has been made possible by using fossil

What is Geocaching?

Geocaching is a treasure hunt that can be as fun for the hider as it is for the seeker. Any given treasure, known as a geocache, has specific coordinates of longitude and latitude to which seekers must travel in order to locate the treasure. Geocaching is an outdoor recreational activity, in which participants use a Global Positioning System (GPS) receiver or GPS-enabled smartphone and other navigational techniques to hide and seek containers, called “geocaches” or “caches”, anywhere in the world. If you are not already signed up, go to www.geocaching.com and start today. Here are some tips for those of you that have never tried geocaching before, these are a must if you want to have a good time and find the most caches possible. 1. Do not rely 100% on the coordinates given to you in the cache description. If you get within several feet of the exact

coordinates then it is time to start looking around. Many factors could cause the location to be slightly off. 2. Don’t expect the cache to be hidden in plain sight, expert cachers are known for hiding something using the native camouflage of the environment. Look up, down, below the ground, at eye level. One example could be, if there is a tree 2 - 3 feet within the coordinates then chances are the object is tied up in the tree. 3. If the geocache location is on or near a business or private property then be sure to not let your kids run all around the place because it could be very dangerous. 4. Read the hints in the description very carefully, often there are clues contained in the description that don’t mean anything until you actually get to the location. So read and then reread once you get to the spot.

5. If possible, take a smartphone on which you have downloaded one of the geocaching apps so that you can look up the description of each geocache location before you get to it. Otherwise, you won’t have all of the hints (if any) available and you may get frustrated not being able to find the geocache. An alternative to this would be to print out all of the cache spots you want to visit before you leave the house but that requires a printer and paper. 6. Remember that it’s just a game and don’t get too annoyed by all of the geek speak of stuff like muggles.

geocaches sprinkled in all parts of the region, from the bustling downtown to the quieter parks. New and experienced Geocachers looking for spaces to find a lot of geocaches in one area will enjoy visiting Severson Dells, a 369-acre forest preserve. The forest preserve features 2.5 miles of self-guided nature trails and a hard-surfaced trail accessible year-round. Also hidden along these paths are over a dozen geocaches just waiting to be found! Another location for excellent geocaching is Anna Page Park. This expansive park boasts three separate 18-hole disc golf courses, and just about as many geocaches as there are disc golf holes! Said trust is not clear on when the principal is to be distributed, but the Will is unequivocal that the residuary estate passes to Zion Evangelical United Brethren Church (now Beth Eden United Methodist Church). 11. The court has jurisdiction relative to this matter pursuant to 760 ILCS 3/202 and 760 ILCS including 3/400 et seq. 12. That pursuant to 760 ILCS 3/201(a) and (c), legislative history and common law provides that the Court has the authority to interpret trusts, including the subject trust herein, pursuant to normal common law rules of construction in the State of Illinois. 13. That the Trust (Article Fourth) does not contain a specific distribution of principal clause, but the Will does have a provision to provide that the church is a residual beneficiary. Therefore, it follows that an interpretation of the Will and Trust herein allows distribution of the Trust principal at a future date.

14. That the Trust has been held by the church trustees for many years. Given the passage of time and that the assets have been held by the beneficiary pursuant to the Trust provision in an account at Edward Jones, account no. 905-16020-1-0 (a copy of which statement is incorporated herein as Exhibit B and made a part hereof), the logical course of action should be for the trust to distribute the principal and be closed. 15. That the investment account referred to above as of March 26, 2021 had a value of $55,327.11 which continues to accrue interest at a fairly nominal rate. 16. That continuation of the account makes no logical sense going forward, and the Petitioner requests that the Court rule: (a) that the Will and Trust do allow for distribution of the principal at this time; and (b) that said account after distribution shall be closed. 17.
