SPRINGFIELD – A new state task force continued discussions Thursday as to what changes could be made to the way state law approaches qualified immunity for law enforcement officers. Qualified immunity is a court doctrine granting protection for law enforcement officers and other government officials from certain civil lawsuits seeking monetary damages for civil rights violations that occurred during the course of their regular duties. Courts have ruled that unless a plaintiff can prove the officer has violated a “clearly established” right – meaning a court has ruled on a case that’s almost exactly similar to the one it is considering – qualified immunity can be used as a defense to shield the officer from civil liability. The Illinois Constitutional Rights and Remedies Task Force was created under the SAFE-T Act, a criminal justice reform omnibus bill that became law earlier this year. It met virtually Thursday in its second of four meetings. Scholars seeking to end qualified immunity told the task force reforms are necessary to ensure that all individuals who believe they’ve had their rights violated by police officers have the opportunity to seek justice in court. But police group representatives painted qualified immunity as a little-used defense that’s been “blown out of proportion” and “manipulated in the press.” Ending qualified immunity, the law enforcement-affiliated panelists said, would make it more difficult to retain police officers by making them live in fear of frivolous civil lawsuits. It could also increase financial pressures on municipal budgets by increasing litigation and insurance rates. Both sides agreed that cases dismissed on qualified immunity grounds are a “relatively small” fraction of the overall cases focusing on rights violations by officers. Larry James, a partner at the Crabbe, Brown & James law firm in Columbus, Ohio, and general counsel for the National Fraternal Order of Police, noted qualified immunity doesn’t protect against termination or discipline for officers, but protects against only civil suits. It protects officers who had to make “split-second” discretionary decisions based on training they received and the limited information available. He also said the Supreme Court, which has largely affirmed qualified immunity as a defense, denied two cases of qualified immunity in recent months. “They said where it is so egregious, that it
is obvious that these officers have violated someone’s civil rights, they’re not going to grant qualified immunity,” James said. “What you’re seeing around the country in these egregious cases, the officer is terminated, the officer’s indicted, and, of late, you’re seeing convictions and you’re seeing officers do time.” If an officer is fired by a department and criminally indicted, he said, “the government is not going to afford him or her any defense whatsoever.” “So qualified immunity is not going to even come into play,” he said. John Murphey, with the firm Odelson, Sterk, Murphey, Frazier, McGrath, Ltd., frequently represents cities and police departments. He said one of the most important components of the SAFE-T Act is the accelerated requirement of adoption of body cameras, which will “resolve a great deal of the litigation.” “But qualified immunity in the excessive force context is important too, because officers typically are reacting,” he said. “They don’t know for the most part what is behind that door, they don’t know what’s in the front seat of that car, or what’s in that glovebox. So these are truly split-second decisions that police officers have to make.” Larry Rogers, a Cook County Board of Review commissioner and attorney at Power Rogers LLP, said, “the real issue is protecting individual civil rights,” and qualified immunity creates circumstances where officers “don’t feel they’re going to be held accountable.” Joanna Schwartz, a UCLA law professor who has published reports on the subject, said the main problem with qualified immunity is that cases dismissed on the precedent “are cases that could not be dismissed on any other grounds.” “They are cases where there has already been proof of a constitutional violation. And the reason that they’ve been dismissed is because there happens to not be a prior similar enough incident of unconstitutional plaintiffs,” she said. She said arguments that municipalities will be bankrupted and officers will leave the field if qualified immunity is repealed are overstated. That’s because in the vast majority of cases officers are indemnified by state law, meaning municipalities pay civil penalties, and her research showed “lawsuits in police misconduct cases amount to well less than 1 percent of most cities’ and counties’ budgets.” “It would mean that for the relatively small percentage of cases where people have shown constitutional violations, but there happens to not be a prior case on point, those people would be able to get justice through the courts,” she said of
ending qualified immunity. William Baude, a professor at the University of Chicago Law School, said he was previously a clerk with Chief Justice John Roberts, and he views qualified immunity as “problematic” based on constitutional concerns. He said one of the country’s “fundamental principles of the rule of law” is that a person whose rights have been violated should have the opportunity to remedy the situation. One of the most important remedies is being able to bring the issue before a judge and jury. Fred Smith, a professor at Emory University School of Law in Atlanta, said qualified immunity creates distrust in the rule of law. “When people don’t view the law as fair, they’re less likely to comply with the law,” he said. “So that is to say that it actually kind of it creates its own public safety problem.” Baude said while qualified immunity is a federal court doctrine, the Supreme Court has, to some extent, left it in place because it is “counting on the democratic deliberations to investigate what the doctrine should be.” The scholars agreed that any changes at the state level would largely affect state courts as opposed to federal precedent. When asked for potential changes to the state’s approach to qualified immunity, Schwartz said it should either be eliminated or made an “affirmative defense” for the officer, and Smith and Baude agreed. “If there is concern about eliminating qualified immunity entirely, then make it an affirmative defense where the defendant really has to come forward and show the policy, the training or the law that they relied upon, that they were trained about, that they received, that made them think that what they were doing was constitutional,” she said. Lance LoRusso, a lawyer and law enforcement officer who has trained officers in more than 30 states, for federal agencies and in nine countries, suggested task force members take part in use-offorce decision-making and scenario-based trainings that law enforcement officers must take. “If you could see the absolute decision making that has to take place in a compressed time space,” he said, “you would understand why the courts created a concept of qualified immunity for discretionary acts.” The task force will next meet on Oct. 21, and task force members requested staff prepare a review of how many cases have been dismissed under qualified immunity in Illinois in recent years and how many misconduct cases have been filed.

How the Chicago Rockford International Airport Can Be The Hero and Save the Bell Bowl Prairie FROM KERRY LEIGH

On behalf of all concerned citizens for the protection of an ancient, unique and very special Rockford, and Illinois habitat, the Natural Land Institute (NLI) would like to o�er a proposal to the airport for protecting an ancient gravel prairie with creative design solutions to their expansion plans. The following solutions are proposed to avoid the destruction of the Bell Bowl Prairie that is proposed at the Chicago Rockford International Airport. As a start, opening a dialogue with representatives of the local environmental groups in the region would go a long way to reducing the mistrust that is accumulating. Additionally, there are a number of creative site design and engineering approaches that could substantially reduce the required footprint of the project and thereby reduce the need to impact the prairie. • All of the parking lots (and perhaps a portion of the roadways) could be designed w ith permeable paving. Stormwater detention for the entire site could potentially be accommodated by over-sizing the storage in the void spaces in the permeable paving sub-base. (As an aside, the design of the site for the new Food Shed Co-op in Woodstock will incorporate all site stormwater detention needs beneath permeable paving, thereby eliminating the need for a stand-alone detention basin.) • Onsite landscape areas could be considered for rain gardens and bioswales, thereby providing an opportunity to infiltrate and filter polluted runo� before it is routed to detention storage underlying the permeable paving. • Consideration should also be given to utilizing green roofs for proposed buildings to reduce stormwater runo� and associated detention basin capacity. • Site design criteria could be evaluated to look for opportunities to reduce the size and dimensions of parking lots and roadways. In particular, it is known that roadway width criteria and parking lot
sizing (e.g., the number of parking stalls and their dimensions) often are very conservative leading to over-sized facilities. • These green infrastructure design approaches would then allow space for the building to be sited to avoid impacts to the prairie. These types of green infrastructure and innovative site design approaches are broadly referenced in the Kishwaukee Corridor Green Infrastructure Plan that was developed for the multi-thousand acre landscape immediately east of the Rockford Airport. This plan also discusses the economic benefits and tradeo�s in implementing green infrastructure design approaches. These green infrastructure policies and site design concepts were widely shared with local government o�cials from Rock ford, Winnebago County and neighboring jurisdictions and the concepts are relevant to this project. The Executive Summary and the full plan are available at: https://www.naturalland. org/quick-links/ We understand that there is significant federal investment in this expansion, and that this economic development and the jobs created will be an economic boon to the area. We also believe that the airport expansion doesn’t have to occur at the expense of this ancient, and very special fragment of all that is left of the original Illinois. The old thinking of ‘us’ verses ‘them’, or the environment versus progress, has been replaced with the concept of ‘both, and’. Conservationists recognize that they are no longer just protecting an individual species, or a habitat, but that we are, ultimately, saving us. We are not separate from nature, we are a part of nature and the benefits that nature provides us are valuable. The vast array of ecosystem services for prairie that includes carbon sequestration, rainfall and runo� infiltration, erosion control and nutrient reduction are valued at several thousand dollars per acre. We are asking that our Governor, Senators and Representatives facilitate a conversation with the Airport Authority, Illinois Department of Transportation, a nd t he eng i neer i ng consu lt a nt s, Crawford Murphy Tilley, and our engineering consultant to seriously look at the site design and incorporate green infrastructure practices to allow the
prairie to become part of an established approach to protecting this special place. The Airport Authority could be the hero of this story. These practices are not new and are used widely across the country. Lastly, let us consider and discuss ways that this prairie can be protected. NLI and its partners have managed this prairie for the Airport for several years, and we pledge to continue that partnership and activity. The Mayor of the City of Rockford has signed a resolution on October 5th to support Rockford as a Bird City which is a state designation that recognizes municipalities for their work to protect bird habitat. California oil spill legal fight likely to last years By Jonathan Lemire Associated Press
LOS ANGELES (AP) — It took little more than 48 hours from the moment a major oil spill was discovered off Southern California until the first lawsuit was filed against the Houston company that owns and operates the ruptured pipeline. Finding the cause, who is to blame and if they will be held accountable will take much longer. Several federal and state agencies are investigating in parallel as they seek the cause of the pipe rupture, how quickly pipeline operators responded and determine whether criminal charges are warranted. Coast Guard Capt. Jason Neubauer said investigators are trying to find which ship among thousands of possibilities may have snagged the pipeline with its anchor in the past year, possibly during rough seas and high winds in January. “We are not ruling out anybody at this time,” Neubauer said. A possible leak off the Orange County coast south of Los Angeles was first reported Oct. 1. The spill was confirmed the next morning, and crude came ashore on Huntington Beach and then spread south to other beaches. Much of the coastline nearby was shut down more than a week, crippling businesses that cater to beachgoers and boaters. The Coast Guard has estimated between about 25,000 gallons (94,635 liters) and 132,000 gallons (495,889 liters) spilled. It could take a long time for investigators to comb through marine tracking data to see which ships passed over and anchored near the Amplify Energy pipeline running from platform Elly to the Long Beach port. Investigations by federal prosecutors, the Coast Guard and several other federal agencies, including the National Transportation Safety Board, could lead to criminal charges, civil penalties and new laws or regulations. “Criminal charges — when they’re warranted — you absolutely want to go after for all the reasons that you pursue criminal charges: accountability, deterrence, punishment,” said attorney Rohan Virginkar, a former assistant U.S. attorney who helped prosecute BP for the Deepwater Horizon oil spill in the Gulf of Mexico in 2010. “But really in these environmental cases, it’s about finding somebody who’s going to pay for the cleanup.” Coast Guard investigators already
have boarded two vessels and plan to track down others, many from overseas, Neubauer said. They will inspect anchors for damage and review all logs kept by the captain, deck officers and engineers, and the voyage data recorder — the equivalent of the so-called black box on airplanes. They will also interview crew. Under some environmental laws, prosecutors only have to show negligence to win a conviction, Virginkar said. That could lead to a charge against a shipping company for anchoring outside an assigned anchorage or too close to a pipeline marked on nautical charts. The accident occurred where huge cargo ships anchor waiting to unload at the Los Angeles-Long Beach port complex — the nation’s largest. Other investigators, including federal pipeline regulators, will focus on Amplify Energy, which owns the three offshore oil platforms and the pipeline. They will review pipeline inspections for evidence of corrosion that might show it was being operated negligently and seek any information that records were falsified, which is what they found in the BP case, said attorney William Carter, a former federal environmental crimes prosecutor. A forensic analysis will be performed after the cracked is retrieved from 100 feet (30 meters) of water. The Amplify pipeline was required to have thorough inside and outside checks on alternating years. The most recent showed no issues requiring repairs, according to federal documents. Prosecutors will also scrutinize control room data to see if there were pipeline pressure drops that would have indicated a possible leak and what was done to respond, Carter said. The company could be prosecuted if it realized there was a leak and did not quickly call state and federal hotlines to alert the Coast Guard, fish and wildlife officials and multiple other agencies that respond to spills, Carter said. Prosecution for an untimely response is fairly common in spills, he said. “The elements necessary for that violation are: I knew there was a release, and I didn’t immediately report it — regardless of the cause,” Carter said. “I mean, it could have been lightning or an earthquake did it and you knew it, and you didn’t report it in a timely fashion.” Plains All American Pipeline was convicted for that crime for a breach in a pipe on land that sent tens of thousands of gallons of crude pouring onto a Santa
Barbara beach and into the ocean in 2015. In the Amplify pipeline leak, federal regulators said a low-pressure alarm at 2:30 a.m. Oct. 2 alerted control room operators on platform Elly to a possible leak. The Pipeline and Hazardous Materials Safety Administration said the line wasn’t shut down until 6:01 a.m. and the Coast Guard wasn’t notified until 9:07 a.m. Amplify CEO Martyn Willsher has refused to answer questions about the reported pressure drop, including the fact that the first report to authorities made on behalf of the company listed the incident at 2:30 a.m. He has insisted the company didn’t know of the spill until a company inspection boat saw the sheen at 8:09 a.m. Carter said lawyers probably told Willsher not to discuss the timeline because he could incriminate himself. If charged with failure to report the spill quickly, the company could also face charges for allowing oil to harm endangered species and other wildlife that might have been saved by a more prompt response. Federal prosecutors have five years to bring felony charges. Carter said they would likely wait until they know the cost of the damage to demand restitution. Federal penalties for failing to notify authorities can be $500,000 or it could be as much as double the total damage. State penalties could run up to $10 per gallon spilled that wasn’t recovered. Regardless of whether a ship is ultimately found to be the cause of the spill, the Oil Pollution Act of 1990 requires whoever spills the oil to pay for the cleanup, said attorney James Mercante, a maritime lawyer. Amplify, however, can later seek to recover its losses from other liable parties. Mercante said the law was passed in the wake of the Exxon Valdez tanker spill in Alaska in 1989 to speed the cleanup without finger-pointing. “The spirit and purpose is to get the oil cleaned up and then fight it out,” Mercante said. “It will take years and years and years to be resolved.” So far, two proposed class-action lawsuits have been filed on behalf of a disc jockey who runs beachfront events in Huntington Beach and a surf school that operates in the city known as “Surf City USA.” Those cases will rely heavily on government investigations and will take years to play out.

As Shatner heads toward the stars, visions of space collide By Ted Anthony Associated Press
“Risk is our business,” James T. Kirk once said. “That’s what this starship is all about. That’s why we’re aboard her.” More than a half-century later, the performer who breathed life into the fabled Enterprise captain is, at age 90, making that kind of risk his own business and heading toward the stars under dramatically different circumstances than his fictional counterpart. And in doing so, William Shatner is causing worlds to collide, or at least permitting parallel universes to coexist – the utopian spacefaring vision of “Star Trek” and the evolving, increasingly commercial spot that “space” holds in the American psyche. When Shatner boards Jeff Bezos’ Blue Origin NS-18 in Texas at around dawn Wednesday, his one small step into the craft creates one of the ultimate crossover stories of our era. It’s about space and exploration, sure, and certainly about capitalism and billionaires and questions of economic equity. But it’s also about popular culture and marketing and entertainment and nostalgia and hope and Manifest Destiny and, and, and … well, you get the idea. “What will I see when I’m out there?” Shatner wondered last week, talking to Anderson Cooper on CNN. An equally valid question is this: What will WE see when he’s out there? It will be a complex blend of human dreams superimposed upon technology and hope, braggadocio and cash, and the notion that space travel elevates us – all orchestrated by a company under criticism for what some call the decidedly un-utopian, tech-bro ways that it operates. Is all that and “Star Trek” a good fit?
THE WORLD OF `STAR TREK’
Since its 1966 premiere with one of the most diverse casts TV had ever seen, “Trek” has grown from Gene Roddenberry’s fever dream of a “’Wagon Train’ to the stars” into an intricate transmedia universe full of subtleties and traditions and rules. Among them: Human beings avoid killing each other. Money is generally outdated, as are hunger and poverty. Greed is aberrant. Noninterference in other cultures is the most sacred principle of all. And within the United Federation of Planets, the spacefaring United Nations of “Star Trek,” exploration, not domination, is the coin of the realm. In short, unlike a lot of humanity right now. That 1966-69 original series used allegory to evade network censors and tell stories about racism and xenophobia
and even the Vietnam War. How could they get away with all that? Because the adventures of Kirk’s Enterprise took place against a backdrop of 23rd-century space travel – something directly relevant to the world as well, given that humans first set foot on the moon 47 days after the original series’ final episode. Over the next half century, backed by a vocal fan base, “Star Trek” roared back for more and, in the process, led the way in cementing space travel as an ideal canvas for relevant storytelling. Even as NASA’s Apollo era ebbed into the space shuttle program (where an early craft was named “Enterprise”) and eventually into uncertainty, “Trek” remained one of the culture’s central vehicles for a spacefaring future. Nichelle Nichols, who played Lt. Uhura on the show, was a particularly tireless advocate, working with NASA to recruit Americans of color and women and make sure they could occupy the center of such ambitions as the missions marched forward. In the 1980s, movies about the original crew dealt with aging and regret. “Star Trek: The Next Generation” offered a more cerebral but still utopian vision. Another spinoff, “Star Trek: Deep Space Nine,” set at an outpost preserving a delicate detente, presented a darker take – but still one in which avarice was anomalous and worthy of scorn. And “Enterprise,” a 2001-2005 prequel, offered a season-long arc about the aftermath of a 9/11-style extraterrestrial attack on Earth. Two of the latest iterations of the myth, “Star Trek: Discovery” and “Star Trek: Picard,” have dipped deeper into darkness than their predecessors and have toyed with the notion that not all humanity wants to be quite that utopian. In all that varying storytelling, though, one constant remained: the notion that human space travel would become a vector of ethics and goodness that elevated the galaxy rather than plundered it.
THE PROFITABLE FRONTIER
Which brings us to companies like Blue Origin, Elon Musk’s SpaceX and Richard Branson’s Virgin Galactic — endeavors that build their brands not upon countries but corporations. They offer the culture a late-stage capitalism variation on the theme — a narrative that space travel isn’t just for scientists and diplomats but for you and me, too. If, that is, you and me happen to have a few hundred thousand dollars or more of walking-around money on hand. “The United States always has had
private people working for the public purpose,” says Ravi S. Rajan, president of the California Institute for the Arts and a “Trek” fan since childhood. “But how much is done privately and how much is done publicly, that changes.” Many have impugned the billionaire space moguls’ actions, including the secretary-general of the United Nations, and the troubles of Blue Origin’s corporate culture are well-documented of late. But the motives of the Amazon founder himself remain unclear. It is evident, though, that the popular culture of space travel has influenced him deeply. Bezos, who tells a story of exploring space to help ensure Earth’s continued prosperity, is a longtime “Trek” fan. He made a cameo as an alien Starfleet official in the 2016 movie “Star Trek Beyond.” And according to biographer Brad Stone, Bezos even fleetingly considered calling Amazon “Makeitso.com,” after Capt. Jean-Luc Picard’s favorite command in “Star Trek: The Next Generation.” “The whole ethos of `Star Trek’ showed people who were different-looking, with different skills, working together. We are in the opening moments of something like that,” says Richard B. Cooper, vice president of the Space Foundation, a nonprofit that advocates for the global space industry. “People can look at this environment and say, `Hey – I belong there, too.’” Prohibitive costs aside (and that’s a big aside), Cooper has a point. Though the likes of Shatner may not be “regular people,” the shift from the dominance of the test pilot and the scientist tracks with the populism of our era, where – it must be said – the exactitude of science is being called into question as never before. And as Cooper points out, “it gives people hope. And if there’s one thing the world’s in short supply of, it’s that essential payload.” That kind of storyline – hope, heroism, competitive dominance and an unerring sense of competence that can at times overlap with testosterone – could be one key reason why the commercial space outfits are thriving. At a moment when NASA and nation-focused space travel lacks a compelling Hollywood narrative, the entrepreneurs and their marketers step right in. “American dominance in space, nobody cares about it. It’s Bezos who says, `We can’t go on living like this. We have to save the planet,’” says Mary-Jane Rubenstein, a professor of religion and science in society at Wesleyan University. What results, she says, is “a kinder, gentler colonialism” in which humans take to orbit under premises
that seem justifiable but require closer scrutiny. “It’s the billionaires who have the utopian visions,” says Rubenstein, author of the upcoming book “Astrotopia: The Dangerous Religion of the Corporate Space Race.” “The states can’t muster them,” she says. “They have no story.”
LAUNCHING SHATNER
We live in an era where the fictional and the real have an intricate relationship, and sometimes it’s hard to separate them. Something like this, a collision of dreams and real-life ambition and achievement, couldn’t have a more effective ambassador than the outsized personality that is William Shatner. “I was there last week rehearsing, whatever they call it,” Shatner told Anderson Cooper. “Training I think is what they call it,” Cooper said, to which Shatner responded: “I think of it as rehearsal.” And there it is again — the storyline, compelling as ever, stealing oxygen from other important questions. Should we even be colonizing space? Don’t we have enough going on here at home to worry about? Aren’t there people with problems more pressing than this who could use the cash? And what if we encounter life that’s not life as we know it, and harm it out of obliviousness or greed? It’s not as if that hasn’t happened countless times here on the ground, in the land that put a man on the moon but still grapples with a history brimming with horrors from slave markets to smallpox blankets. These are only some of the questions that will ascend and descend with Shatner on Wednesday. Is it a stunt? Sure. Is it a genius marketing ploy? Absolutely. Is it cynical and self-aggrandizing and designed solely to make more money and grab more attention for the world’s richest man? You’re going to have to decide that one yourself. In the meantime, consider the autobiographical song called “Real” that Shatner recorded in 2004 with country singer Brad Paisley. “I’d love to help the world and all its problems. But I’m an entertainer, and that’s all,” he says in it. “So the next time there’s an asteroid or a natural disaster, I’m flattered that you thought of me – but I’m not the one to call.” Turns out, he is – this time. But next time? In the future of the final frontier and the culture that has grown up around it – in this unusual realm where risk IS the business — that’s eventually going to have to be addressed.

Spooky Season talk with Rick Hale BY GARY HILL CONTRIBUTOR
Rick Hale is a Northern Illinois author and paranormal investigator. Just in time for spooky season, he talked to Rockford Rocked Interviews about the paranormal, his own experiences, some spooky Rockford and Northern Illinois locations and more. Gary Hill: First o�, let’s talk about your experience with the paranormal. How did you get involved, and what is the basis for your expertise? Rick Hale: My interest in the paranormal began at a very young age. I witnessed and interacted with an apparition in my grandparent’s Franklin Park, Illinois apartment. She was a kindly old ghost who was a former resident. My grandma saw her regularly, and various other relatives had experiences they’ve reported to me over the years. After that, I read anything I could get my hands on at the Round Lake Beach and Chicago public libraries. This was back in the early ‘80s where books were sparse. I learned from the books of Hans Holzer, Brad Steiger and (my favorite) Peter Underwood. I feel their books gave me a solid foundation in my paranormal education. My first investigation happened quite by accident in September 1991. I was a senior in high school, and a family friend was experiencing poltergeist activity when

she welcomed a 16-year-old troubled girl into their house. They were religious people and believed it was something satanic. I still believe to this day; the activity was psychic unrest caused by the girl. GH: You have written several books on the subject. Could you tell the readers about those? RH: My first book is The Geeks Guide to the Strange and Unusual: Poltergeists, Ghosts and Demons. It’s basically a retelling of famous cases throughout history and my thoughts on them. My second book, Behold! Shocking True Tales of Terror... ...And Some Other Spooky Stu�!:... includes detailed accounts of my own investigations over the last 30 years and some things I’ve learned along the way. My third book, Bullets, Booze & Babes: The Haunted History of Chicago & Illinois is about some of the famous haunts in the Chicagoland area as well as throughout Illinois. GH: You have a new book in the works, too, right? What can you tell us about that? RH: My fourth book, which won’t be out until next year, is called “Ghost Watch.” The idea for this book came from a segment on my show, “The Shadow Initiative Paranormal TV with Rick Hale and Stephen Lancaster.” It’s inspired by a show Peter Underwood recorded for BBC Radio back in 1980. GH: With Spooky season in e�ect, a lot of people are wanting some spooky experiences. Do you know of some locations open to the public either in or a short drive from Rockford that you could recommend - particularly ones you have some personal experience with? speaking engagement there last year with my friend and colleague Michael Kravchuk. It’s a beautiful house with an amazing history, and it is most definitely haunted. And the Coronado Performing Arts Center is another great place for history and hauntings. If you’re willing to make the drive to the south side of Chicago, check out Bachelor’s Grove Cemetery. I’ve always come away from there with a creepy experience. GH: What recommendations would you give people wanting to visit haunted locations, to maximize both their experience and their safety? RH: If you visit haunted locations just keep in mind, forget everything you see on TV. It’s not a scare-a-minute, and you may not experience anything. but that doesn’t mean you shouldn’t enjoy the experience. Always be respectful of the place and the ghosts who live there. The paranormal has received a number of black eyes over the last two decades from so-called ghost hunters vandalizing haunted places. Never trespass - no ghost is worth going to jail. Keep an open mind and, most importantly, have fun. GH: Is there anything else you’d like to add? Voices from the Grave
Ice cold betrayal By Kathi Kresol Contributor
It was January 1, 1884 and George realized he had been wrong. He thought this day would be easier than the past few. But as he stood by the coffin, he knew that this day would be the hardest. Today was the day that he would bury his young wife. George was glad that they had traveled from their home in Osceola, Nebraska to bring her back to Rochelle. George looked around the room and was struck by the thought that it was good to be surrounded by all these people who also loved his wife. But Catherine was easy to love. The year that they had since their wedding had been amazing. They left Rochelle shortly after the wedding to create a life in the small town of Osceloa. She was so supportive and a hard worker. Even when they found out they were expecting, she didn’t slow down. And when little Joseph was born on November 19, 1893, the young couple was so happy. Even when the doctor took George aside to warn him that there were some complications that could turn severe, he didn’t worry. But that all changed quickly. George stood as everyone came to pay their respects. One of the last to approach was a man that George was surprised to see. His name was J. N. D. Shinkel and George thought he was in Chicago, going to school to be a doctor. Newt (as Catherine called him) was once a close friend of Catherine’s. In fact, their families had hoped that Catherine and Newt might be more than friends. But luckily for George, that didn’t happen. Newt shook George’s hand and then moved on to Catherine’s parents. Martha and Joseph were both devastated by their daughter’s death. Shinkel shook Joseph’s hand and then moved away. The blizzard that folks said was on the way arrived in earnest by the time the family left the cemetery. George was glad to arrive back to the house where he had left his newborn son. Little Joseph was all George had left of Catherine now. Later George would say that it didn’t surprise him that he dreamed of Catherine that night. But it did surprise him that it would disturb him so much. Catherine kept calling to him in the dream. It seemed that she was lost and afraid and needed George to find her. It was the first of many disturbing dreams. The day after the funeral the rumors made it to the family. Friends and family were passing along stories of bodies of the freshly dead being ripped right out the ground. The bodies were used by the medical schools in Chicago for the students. George didn’t give it much thought at first. He made his way to the cemetery to visit with Catherine, trying to find some peace. George didn’t see any disturbances in the deep snow that fell during the storm
that hit the day Catherine was buried. But he just couldn’t shake the feeling that something was not right. And every night he woke with the sound of Catherine’s pleas hanging in the air. Finally, George couldn’t take it any longer. He approached Joseph with his fears and found that he, too had been having nightmares about his daughter. The men decided to hire a detective and went to speak to the sexton at the cemetery. The sexton called the grave digger into his office to discuss whether he had seen anything odd at the cemetery. The grave digger offered to check his tools and was back quickly with the strange news that his tools had been used and returned dirty, which was not how he left them. George, Joseph, and the detective convinced the sexton to grant permission to open Catherine’s grave. The group gathered by the mound to conduct their horrible business. At first, there was no indication that anything was out of the ordinary. But as the digger neared the coffin, there were clues that George was correct. They found Catherine’s funeral shroud in the dirt about a foot above the coffin. Even with this clue, they were all shocked when the coffin was exposed. The entire top of the head area of the coffin had been smashed in by force and Catherine’s body was gone. The authorities told the family that it must have happened the very day Catherine was buried. The blizzard would have offered perfect cover, making it impossible for anyone to see the evil deed that was committed that night. The authorities also felt that the body snatchers must have been to the funeral since they knew exactly where to find the snow-covered grave and the tools that they borrowed from the shed. The family refused to believe that anyone who knew Catherine could be so heartless. But they did believe the police that whoever took Catherine away would make their way to Chicago. There were five Medical Colleges in Chicago during this time and the men swore to visit every single one of them. It had been so many days that the detective warned them that this trip might not end the way they wanted. It was at the Chicago Homeopathic Medical College that their quest finally ended. The detectives had been correct when they warned the family, that this might not end the way the family hoped. In the seven days that it took to locate Catherine, the students had worked on her. The damage to her face and head was extensive and her father wept when he saw her. The somber group returned to Rochelle where Catherine was once again buried in her family’s plot in the little cemetery. George later said it was the first time he had slept in a very long time.
But unfortunately, George’s peace would once again be disturbed. The story soon broke that the authorities had two men in custody. It shook the entire community when one of the men turned out to be Catherine’s childhood friend, Newt Shinkel. His accomplice was another medical student named Waterman. The trial just about tore Rochelle apart and the judge granted a change of venue for the defendants. The trial was held in Rockford and though the prosecutors felt they had a strong case, the men on the jury disagreed. Both men were acquitted but were soon arrested for another case of grave robbing, this time in Sycamore. There had been five cases of grave robbing found in small towns all over the area. The two men had gotten a break in Rockford, but their luck finally ran out in Sycamore. Waterman was put on trial first and found guilty. He was sentenced to a year in prison. Newt Shinkel was out on bail when the news reached him. He swore that he would never stand trial for the charges against him. Newt Shinkel jumped bail and ran. He would never stand trial for the other cases. Newt Shinkel and Waterman returned
to medical school and became doctors. Shinkel was never convicted in a court of law for body snatching but he could never run awayfrom what his former neighbors and friends knew to be true. He became the black sheep of his family and the newspapers of the day all talked of the awful character of the man who once had so much potential. Catherine was laid to rest in the Craft family plot. George remarried and when he died in 1931, he too returned to Rochelle. He was buried next to his own family a few rows away from Catherine. When Shinkel died over 20 years after the incident with Catherine, the papers didn’t talk of all the people that he helped as a doctor. They all mentioned the fact that he had been accused of betraying a family who once thought the best of him. The papers mentioned that when Shinkel broke into Catherine’s coffin that he broke the heart of the community that had embraced him as one of their own. It is ironic that while Shinkel thought he had left no trace of his horrible crime, the impact of that crime out lasted any good that he might have accomplished. He too is buried in the cemetery in Rochelle.

As part of National Hispanic Heritage Month, which is celebrated annually from September 15-October 15, the Rockford Area Convention & Visitors Bureau (RACVB) is continuing to honor the histories, cultures, contributions, and influence of Hispanic Americans to the history, culture, and achievements in the United States. And in that spirit, we want to shine a light on some of our region’s Hispanic leaders as part of the GoRockford Hispanic Heritage Interview Series. The second leader we would like to introduce to you is Melissa Santillan. Melissa is a local entrepreneur in the region. Through her craft and passion for the arts, Melissa has helped to be a voice and impactor by developing experiences that showcase creativity, art, and women empowerment in our community. We are excited for you to meet Melissa Santillan.
Melissa: How diverse our region is, and that gives us all opportunity to learn about other cultures. GoRockford: What Does Hispanic Heritage Month mean to you? Melissa: It’s a celebration of many contributions, diverse cultures, and extensive histories of the American Latino community. GoRockford: Can you tell us what you are working on to help create and influence history or culture in our community? Melissa: I was so honored to be a part of The Friends of the Coronado presents
Breaking Chains, Healing Wounds & Making change project. In addition, I have coordinated events that celebrate diverse cultures. GoRockford: How do you plan to celebrate Hispanic Heritage Month? Melissa: I plan to attend art shows, local events and continue to share my own art with my unique hairstyles, photoshoots, and showcasing. GoRockford: What do you encourage others to do to learn more about this month, the history, and the contributions of our Hispanic community?
Melissa: Become more involved. It’s easier than you think. Attend local events, art shows and support new local businesses. Rockford has so much talent, and entrepreneurship is at an all-time high in these challenging times, but it’s happening in our city. I will continue to be active in the community, giving back, mentoring, and collaboration with existing organizations working on bringing talent and more events to Rockford in the upcoming year. We have lived in the country since we moved to this area of Northern Illinois in 1965. We have had excellent electrical service since then with an occasional loss of power. The longest time we can remember being without grid electricity was for around eight hours several years
ago. We made it through a hot summer night based on the backup electricity in our battery system charged by our solar panels. The loss of electrical service is critical as modern society depends on it for lights, heating, cooling, air conditioning and communications. Before moving to this area from Palatine, we also lived in the country. Our home was heated with propane which kept
living conditions comfortable even if the electricity went out as the units were not dependent on electronic ignition. They were lit by continuously burning pilot lights which could be restarted with a match if needed. We had a measure of autonomy. Several times when electrical service was lost around us friends came to stay at our home for comfort and warm food. A propane fueled refrigerator kept food fresh. The most extreme weather we experienced was during the winters of 1978 and 1979 when deep snows limited travel. Friends brought us basic food items by snowmobile. Our daughter and her friend stayed overnight when roads were not open. One local man bought a large snow blower to attach to his tractor to clear his farm drive as well as those of the neighbors. Ironically such solutions relied on supplemental supplies of energy to overcome temporary inconveniences which have become more common as the climate becomes more unstable. During the energy crisis of the 1970s a former professor of ours had multiple sources of heat to keep him comfortable. He had a gas furnace, electric baseboard heating and a wood burning stove. Last winter, Texas experienced a massive loss of heating and electrical service, illustrating the vulnerability of modern existence. A similar disruption to the UK could occur if the expected natural gas shortage leaves them and other European countries ill prepared for a long cold winter. Last year’s cold spell apparently left much of Europe without sufficient gas reserves stored in time for their anticipated use this coming winter. The UK is portrayed as especially vulnerable as they now import natural gas since North Sea oil and gas supplies are no longer able to fulfill their own needs. Their homes are poorly insulated and funds for loft or attic insulation are far too meager for the many properties which could benefit from it. The truck driver strike and driver shortage limit fuel deliveries. In this area of Illinois we know people who prepare in advance for a few days of severe weather conditions. Several couples store food and water to tide them over if they lose power. While natural gas and propane supplies appear adequate for winter they are more costly. Maintaining furnaces could be a challenge with the disruption in global supplies of components, particularly computer chips. Waiting for parts for cars, lawn mowers, appliances and furnaces delays their repair. The dependency on global supply chains,
complex technologies and the loss of manufacturing capacity within countries involves the loss of autonomy, independence and resilience. Their loss highlights the need for community responses. Increasing personal resilience is desirable but the problem calls for actions beyond that of individuals. We need less complex local solutions featuring efficiency, renewable energy, food and local manufacturing. Global problems such as climate change also require international complementary actions. Living sustainably continues to be a major challenge for society as it evolves but remains obscured until a catastrophe reminds us of our vulnerability. Fortunately such catastrophes have stimulated compassionate responses from the public. But compassion must be ongoing rather than a sporadic response.
