State Supreme Court rules on pair of gun cases Deerfield assault weapons ban upheld; Putnam County man granted gun rights restoration By Jerry Nowicki

SPRINGFIELD – In its latest round of opinions Thursday, the Illinois Supreme Court upheld a Village of Deerfield assault weapons ban and restored a Putnam County man’s right to a Firearm Owners Identification card over the objections of the Illinois State Police. The decision in the Deerfield case was split 3-3, with Justice Michael Burke abstaining from the vote, meaning an appellate court’s ruling that allowed the ban was upheld as the final decision. Burke was part of the 2nd District Court of Appeals which heard the case previously. The case centered around a narrow window written into a state’s amendment to the FOID Act in 2013, which allowed home rule municipalities to adopt stricter gun laws if they passed an ordinance within 10 days of the law’s effective date, July 9, 2013. Deerfield did so within the law’s parameters, but the court was asked to decide whether the village’s 2018 amendment to its ordinance that banned civilian use of assault weapons and large capacity magazines was an extension of the 2013 action or a new law altogether. In 2019, a Lake County judge ruled in favor of gun rights groups and Deerfield resident Daniel Easterday, who sued to block the ordinance and claimed it was in violation of the state’s FOID and concealed carry laws. But the 2nd District Appellate Court later overturned that decision, ruling that the 2013 FOID amendment created “a hybrid balance of regulatory power between the state and local governments,” and “Deerfield preserved its power to regulate

assault weapons concurrently with the state when it enacted its 2013 ordinance.” While the Supreme Court agreed to hear the appeal, the 3-3 deadlock means the appellate court decision remains in effect.

Gun rights are civil rights

A 2020 ruling by the Illinois Supreme Court which declared gun rights to be civil rights was key to a Thursday decision which restored Putnam County man Thomas Brown’s right to a FOID card. Brown was a FOID cardholder for several years, most recently applying for and being granted renewal in 2013. But in 2016, he tried to purchase a gun at a federal firearm licensee, leading the Illinois State Police to conduct a background check. That unearthed a 2001 conviction in California on a “misdemeanor offense of inflicting corporal injury on a spouse” that he did not disclose on his FOID application, according to a court filing. California law provides that after a period of 10 years a person convicted of a misdemeanor can no longer be penalized for gun possession. Brown’s lawyers argued that because Brown was eligible to own a gun in California after 10 years, that means he had his “civil rights restored,” satisfying a specific exemption in federal law that allows for his gun ownership. The court agreed, stating that “California law does not apply to Brown in a vacuum,” and he does not have to show an “affirmative statement of restoration” from the state of California in order to show that he had his civil rights restored. The court dismissed ISP’s argument that that Brown should have sought a pardon from the California governor to receive an affirmative statement of restoration, stating Brown would have needed a pardon only if the firearm ownership prohibition was still in effect in California.

The fact that California does not consider gun ownership a civil right did not matter in this case, because, the court wrote, “this court unanimously concluded (in the 2020 Johnson case) that restoration of firearm rights under the FOID Card Act constitutes ‘civil rights restored’ for purposes of federal law” It was necessary for Brown to show that he satisfied that exception in federal law, because the state’s FOID Act specifically states that granting relief to a person who is appealing their denial cannot be done in violation of federal law. Outside of that question, the Supreme Court determined that the Putnam County court did not abuse its discretion in determining that Brown met all the other criteria to have his gun rights restored. The Supreme Court noted it had to rule only on whether the circuit court abused its discretion in determining whether Brown met the criteria, which also state that an applicant must not be dangerous and that granting them a FOID card cannot be against the public interest. “Again, our sole task is to determine whether the trial court’s decision was arbitrary, fanciful, or one that no reasonable person would make,” the court wrote. “Not only was the trial court’s decision not arbitrary, fanciful, or one that no reasonable person would make, it was well supported by the evidence.” ISP had argued that granting Brown a FOID card would be against the public interest, citing his 2001 arrest, a 2005 DUI conviction in Bureau County, a 2005 arrest for battery in LaSalle County that did not lead to criminal charges, and a 1997 conviction for misdemeanor assault that occurred when he was a minor. But the Supreme Court determined none of those cases indicated he would be a danger, particularly in light of a letter from Brown’s ex-wife, the victim of the 2001 incident, which indicated “that no weapon was involved in the incident, she was not injured, nor did she believe that Brown intended to injure her.” The fact that Brown omitted the 2001 conviction from his 2013 FOID application could be overlooked as well, according to the court, because he was “under the impression that the charge in California was disposed of with court supervision and that, if he completed his sentence without incident, that was the last he would hear of the matter.” Capitol News Illinois is a nonprofit, nonpartisan news service covering state government and distributed to more than 400 newspapers statewide. WASHINGTON (AP) — President Joe Biden on Tuesday ordered 50 million barrels of oil released from America’s strategic reserve to help bring down energy costs, in coordination with other major energy consuming nations, including China, India and the United Kingdom. The move is aimed at global energy markets, but also at U.S. voters who are coping with higher inflation and rising prices ahead of Thanksgiving and winter holiday travel. Gasoline prices are at about $3.40 a gallon, more than 50% higher than a year ago, according to the American Automobile Association. Administration officials said that reports of a possible release and consultations with other countries ahead of the announcement had caused oil prices to drop nearly 10% in anticipation of the news. The government will begin to move barrels into the market in mid to late December. But the actions are unlikely to immediately bring down gas prices significantly as families begin traveling for the holidays. Administration officials noted that gasoline usually responds at a lag to changes in oil prices, and they suggested this is one of several steps in ultimately bringing down costs. There was no discernable impact on the price for a benchmark barrel of U.S. crude right after the announcement. Prices have been up and down all month, and were up less than 1% so far in this holiday shortened week. The actions by the U.S. and others risk counter moves by Gulf nations, especially Saudi Arabia, and by Russia. Saudi Arabia and other Gulf countries have made clear they intend to control supply to keep prices high for the time being. As word spread in recent days of a coming joint release from U.S. and other countries’ reserves, there were warnings from OPEC interests that those countries may respond in turn, reneging on promises to increase supplies in coming months. Biden has scrambled to reshape much of his economic agenda around the issue of inflation, saying that his recently passed $1 trillion infrastructure package will reduce price pressures by making it more efficient and cheaper to transport goods. Republican lawmakers have hammered the administration for inflation hitting a 31-year high in October. The consumer price index soared 6.2% from a year ago

— the biggest 12-month jump since 1990. Senate Republican Leader M itch McConnell tore into the White House in a floor speech last week, saying the victims of higher prices were middle class Americans. “The three biggest drivers of the staggering 6.2% inflation rate we logged last month were housing, transportation, and food,” the Kentucky senator said. “Those aren’t luxuries, they’re essentials, and they take up a much bigger share of families’ budgets from the middle class on down.” The Strategic Petroleum Reserve is an emergency stockpile to preserve access to oil in case of natural disasters, national security issues and other events. Maintained by the Energy Department, the reserves are stored in caverns created in salt domes along the Texas and Louisiana Gulf Coasts. There are roughly 605 million barrels of sweet and sour petroleum in the reserve. “As we come out of an unprecedented global economic shutdown, oil supply has not kept up with demand, forcing working families and businesses to pay the price,” Energy Secretary Jennifer Granholm said in a statement. “This action underscores the president’s commitment to using the tools available to bring down costs for working families and to continue our economic recovery.” The Biden administration has argued that the reserve is the right tool to help ease the supply problem. Americans used an average of 20.7 million barrels a day during September, according to the Energy Information Administration. That means that the release nearly equals about two-and-a-half days of additional supply. The pandemic made energy markets — like everything else — haywire on multiple fronts. As the closures began in April, 2020, demand collapsed and oil futures prices turned negative. Energy traders did not want to get stuck with crude that they could not store. But as the economy recovered, prices jumped to a seven-year high in October. U.S. production has not recovered. Energy Information Administration figures indicate that domestic production is averaging roughly 11 million barrels daily, down from 12.8 million before the pandemic started. Republicans have also seized on Biden’s efforts to minimize drilling and support renewable energy as a reason for the decreased production, though there are

multiple market dynamics at play as fossil fuel prices are higher around the world. “P r e sident Biden’s p ol ic ie s a r e hiking inflation and energ y prices for the American people. Tapping the Strategic Petroleum Reserve will not fix the problem,” said Sen. John Barrasso, R-Wyoming. “We are experiencing higher prices because the administration and Democrats in Congress are waging a war on American energy.” Meanwhile, Biden and administration officials insist that tapping more oil from the reserve is not a contradiction with the president’s long-term climate goals, because this is a short-term fix to meet a specific problem, while climate policies are a long-term answer over decades. They argue that because they are pushing to boost renewable energy, there will eventually be less dependence in the U.S. on fossil fuels. But that’s a politically convenient argument - in simple terms, higher prices reduce usage, and significantly higher gasoline prices could force Americans into less reliance on fossil fuels. The White House decision comes after weeks of diplomatic negotiations. Biden and China President Xi Jinping talked over steps to counter tight petroleum supplies in their virtual meeting earlier this month, when the two “discussed the importance of taking measures to address global energy supplies,” according to the White House account of the conversation. Japan and South Korea are also participating. Administration officials say it’s the biggest coordinated release from global strategic reserves. The U.S. Department of Energy will make the oil available from the Strategic Petroleum Reserve in two ways; 32 million barrels will be released in the next few months and will return to the reserve in the years ahead, the White House said. Another 18 million barrels will be part of a sale of oil that Congress had previously authorized. White House Press Secretary Jen Psaki said Monday evening that the White House would also keep tabs on the oil companies, too. “We will continue to press oil companies who have made record profits and are overseeing what we consider to be price gouging out there when there’s a supply of oil or the price of oil is coming down and the price of gas is not coming down,” Psaki said. “It does not take an economic expert to know that’s a problem.”

Waukesha parade crash suspect’s bail raises questions By Scott Bauer, Bernard Condon and Mike Householder Associated Press

WAUKESHA, Wis. (AP) — The suspect in a Christmas parade crash in suburban Milwaukee that killed five people was free on $1,000 bail posted just two days before the deadly event, a fact that is leading to a review of what happened and renewed calls for giving judges more power to set higher bails. One pending case against Darrell Brooks Jr. included an allegation that he deliberately hit a woman with his car in early November after a fight. Prosecutors in Milwaukee County on Monday called their bail recommendation “inappropriately low” given the facts of that case and the Sunday crash, and said they would review it. Julius Kim, a defense attorney and former assistant prosecutor, said the bail could easily have been set more than twice as high. “He was accused of running over the mother of his kid, and to put it at $1,000 strikes me as low,” Kim said. “It could have been an inexperienced attorney who happened to be reviewing cases that day.” Police said Brooks, 39, was behind the wheel of the SUV that sped through the parade route in Waukesha on Sunday, killing five and injuring 48 others. Waukesha Police Chief Dan Thompson said Brooks was leaving the scene of a domestic dispute that had taken place just minutes earlier. Brooks has been charged with crimes 16 times since 1999 and had two outstanding cases against him at the time of the parade disaster. That included resisting or obstructing an officer, reckless endangering, disorderly conduct, bail jumping and battery for the Nov. 2 incident. Thompson said police were going to recommend he face five charges of first degree intentional homicide, which is punishable by life in prison. He was to appear in court Tuesday afternoon. Legal experts cautioned that one extreme case should not be reason to push for higher bail amounts that would keep poorer defendants behind bars longer while they await trial. “We don’t want to have a kneejerk reaction here and say ‘Let’s lock up a lot of people pretrial,” said John Gross, a law professor at the University of Wisconsin Law School and also director of its Public Defender Project. “I’m sure the district attorney’s office is going to look back at this and ask

themselves, ‘Did we get this wrong?’ said Gross, the law school professor. “This is such an extreme incident ... could they reasonably expect he would get behind a vehicle and run people down on a parade route? What would have alerted you to the capacity he would have had for this kind of violence?” Some Republicans were quick to jump on the case as an example of a broken legal system. Republican Rebecca Kleefisch, a former Wisconsin lieutenant governor who is running for governor in 2022, called the killings “yet another avoidable tragedy that occurred because a violent career criminal was allowed to walk free and terrorize our community.” And Republican state Rep. Cindi Duchow said she was reintroducing a constitutional amendment that would change the bail process in Wisconsin to allow judges to consider a defendant’s danger to the community when setting bail. Judges currently are only allowed to consider the possibility that defendants might not show up for a court appearance when setting bail. “He tried to run over his girlfriend with his car -- that’s attempted murder,” Duchow said. “If you’re a danger to society, you should have to work hard to get out.” Thompson, the police chief, said that there was no evidence the bloodshed Sunday was a terrorist attack or that Brooks knew anyone in the parade. Brooks acted alone, the chief said. Brooks had left the site of the domestic disturbance before officers arrived, and was not being chased by police at the time of the crash, according to the chief, who gave no further details on the dispute. Brooks is an aspiring rapper. On a YouTube page, a video that has since been removed showed him rapping in front of a red Ford SUV resembling the one at the parade. The rapper uses the name MathBoi Fly on his Twitter and other social media accounts. On Sunday, a joyous scene of marching bands and children dancing in Santa hats and waving pompoms gave way in an instant to screams and the sight of crumpled bodies as the SUV sped through barricades and struck dancers, musicians and others in the community of 72,000. Police identified those killed as Virginia Sorenson, 79; LeAnna Owen, 71; Tamara Durand, 52; Jane Kulich, 52; and Wilhelm Hospel, 81. Sorenson, Owen and Durand were members the Dancing Grannies club,

and Hospel helped out with the group. “It looked like dummies being thrown in the air,” said Nicole Schneiter, who was there with her children and grandchildren. “It took a second to register, like, ‘Is that what we really just saw?’ And then you looked in the road and there were just people laying in the road.” At least nine patients, most of them children, were in critical condition Monday at two hospitals, and seven others were reported in serious condition. Hundreds gathered at a downtown park Monday night in Waukesha, Wisconsin, for a candlelight vigil in honor of those lost and hurt in a deadly Christmas parade crash a day earlier. A pair of clergy solemnly read the names of those who died. Volunteers handed out sandwiches,

hot chocolate, and candles at the vigil, which was attended by interfaith leaders and elected officials. “We are parents. We are neighbors. We are hurting. We are angry. We are sad. We are confused. We are thankful. We are all in this together. We are Waukesha Strong,” said a tearful Amanda Medina Roddy with the Waukesha school district. The chief said that police weren’t pursuing Brooks before he entered the parade route, but n officer did fire a shot to try to stop him. The officer stopped firing because of the danger to others. Brooks was not injured. Mayor Shawn Reilly described the parade as a “Norman Rockwell-type” event that “became a nightmare.”

Progress toward cleaner energy sources By Drs. Robert & Sonia Vogl

As indicated in earlier articles the transition to cleaner energy sources at the state level in Illinois and at the Federal level has garnered substantial support. At the international level progress has been slow in materializing given the huge number of participants and their diverse interests. When we were doctoral students, we took a course from Dr. Stanley Cain who returned to the University of Michigan after serving as the head of the U.S. Department of Interior during the 1960s. He indicated that a decision was made to strengthen the role of the United Nations in international affairs by having the organization develop environmental research projects which would document global environmental conditions. The projects helped develop scientific understandings which form the basis of today’s efforts to fight climate change and other deteriorating environmental conditions. indicated that a council of scientific advisors to President Johnston issued a report declaring that continued use of fossil fuels would cause climate change by the year 2000. It took until1992 for the United Nations Framework Convention on Climate Change to create a treaty that required every country to “avoid dangerous climate change” (The Guardian) and find ways to reduce greenhouse gases. The treaty was signed in 1994; studies and meetings have occurred continuously since then. In 2015, 195 countries and the European Union signed the Paris agreement to keep global warming below 2°C or 3.6°F. and make every effort to limit it to 1.5°C or 2.7°F. Long term goals were set to guide actions of nations. Included were requirements to limit greenhouse gas emissions, review each country’s commitment every five years, provide financing to developing countries to mitigate climate change, strengthen resilience and enhance abilities to adapt to climate impacts. The agreement is a legally binding international treaty. The latest meeting, held in Glasgow, Scotland, was called COP26; COP meaning Conference of the Parties. Civic interests are not allowed to participate in the meetings so they register their concerns as supporters and protestors outside. A major goal of the UK presidency of COP26 was the goal of keeping the 1.5°C goal alive to limit some of the most destructive impacts of climate change. As reported by writers for Carbon Brief, whether that goal was achieved remains debatable as few if any countries have met their goals for reducing carbon emissions. One positive outcome of the meeting was a commitment to double the amount of funding for adapting to climate change. A second was a request that counties present more aggressive pledges to reduce their carbon emissions. A major disappointment expressed by developing countries was that developed countries failed to provide vulnerable nations with funds needed to rebuild and respond to the adverse impacts of climate change. Some money was provided but has fallen short of the $100 billion pledge that was made. Those receiving such funds have also expressed the desire to have more autonomy in determining which projects will be funded in their countries. The core concern was around the fact that developed countries released the vast majority of the climate changing gases to achieve their standards of living while countries that released miniscule amounts of climate changing gases suffer the most from existing devastat-

ing consequences. Such concerns are expressed by island nations being flooded by rising ocean levels which could destroy their homes and damage their lives. Similar calls for social justice have been made by countries such as India insisting on their right to continue burning fossil fuels in order to lift the standard of living for their vast population in poverty. While a “call to phase down unabated coal use” inserted in place of a more aggressive statement on reducing the use of coal was viewed with disappointment by many, others point out that mere mention of reducing coal use represented the first time such a statement appeared in the UN Climate process. The long delayed assertion around the use of coal illustrates the difficulty of securing actions to limit climate change on a global scale. At the close of the meetings “UK prime minister Boris Johnston launched what he called the ‘Breakthrough Agenda.’” It calls for a decade of international efforts to accelerate the development and deployment of clean technologies and sustainable solutions to meet “Agreement goals, ensuring they are [attainable] and accessible to all.” “More than 40 [nations] - including the UK, US, China, Australia and India - endorsed the agenda.” The agenda targeted for 2030 includes the following areas presented in an abbreviated form: • Power: Clean power to meet national power needs • Road transport: Zero emission vehicles in all regions • Steel: Near zero emission steel increasing in every region • Hydrogen: Renewable and low carbon fuel globally available • Agriculture: “Climate-resilient, sustainable agriculture” widely adopted The Carbon Brief initial paper detailing

interactions and issues regarding climate served as the key source for this article. It provides insights into the complex process of reach ing inter nat iona l agreements. The paper, over 100 pages long, is well worth reading to grasp the complexity of reaching and fulfilling international agreements.

The return of U-Cut-It Christmas trees!

After a much too long two-year hiatus in response to Covid precautions, the moment we’ve been waiting for: U-CutIt Christmas trees are again available at Sand Ridge, 2879 S. Daysville Rd. Years of traditions will be re-kindled. Families can again enjoy hunting together for their perfect tree. On the day after Thanksgiving, the Prairie Preservation Society of Ogle County (PPSOC), a non-profit organization, will begin sales at 10 a.m. Sales will continue for the weekends of November 6-8 and December 4-5 between 10 a.m. and 4 p.m. Fir ($60), white pine ($40), and spruce ($40) are available. Tall trees for cathedral ceilings can also be found for an additional fee. Trees are sold by PPSOC as a service to the public and to pay for necessary maintenance on the natural areas in the preserve. Sand Ridge is a great place to visit even without the bonus of Christmas trees. With hills of waving prairie grasses and forbs (wild flowers) and stands of evergreen, it provides a quiet beauty and sense of peace to those fortunate to stop there. The sound of the breezes in the trees and their invigorating scent provide moments transported to the north woods. Surrounded by towering white pines which block the sight of cornfields and houses, it is a place set apart – a peaceful sanctuary from the everyday. Visit, enjoy, and take the feeling with you.

Even as a kid I didn’t understand why anyone would put a Christmas tree up before Thanksgiving, but for some folks, having – or decorating – a tree is one of their Thanksgiving traditions. Plenty of people watch Christmas movies for Thanksgiving, too. Hallmark Channel and Lifetime made family-friendly Christmas movies a holiday tradition – one that has grown to fill all of November, December, part of October, and of course Hallmark has its Christmas in July programming stunt. Once other networks realized there was a strong demand for heartwarming holiday fare, they starting making original yuletide movies, too. Hallmark Channel, Hallmark Movies & Mysteries, Lifetime, OWN, UPtv, GAC Family, Netflix, BET+, Disney+ and

pretty much any network or streamer that wants to spread a little joy has new, original holiday movies out this year. Even Comedy Central. According to Entertainment Weekly, 146 new Christmas movies will premiere in 2021 alone. The popularity of the genre is expanding beyond the familiar framework of a busy city woman winding up in a small town around the holidays, falling for a local guy, realizing an obstacle threatens to keep them apart, and reuniting in time for Christmas – always surrounded with fake snow, an overload of red and green, Christmas lights, caroling, and the sound of jingle bells. Thankfully, over the past couple of years Christmas movies have become more diverse and inclusive. Each year you see more people of color in lead roles. Last year Lifetime’s “Christmas Ever After” centered on a bubbly, Christmas-loving heroine

(Tony-winning actress Ali Stroker) who just happens to be in a wheelchair. Some Christmas movies are even played for laughs. In 2019, UPtv’s “A Christmas Movie Christmas” playfully – and lovingly – skewered all of the familiar Christmas movie tropes. This year Comedy Central is bringing us “A Clüsterfünke Christmas,” a Christmas movie parody from SNL alums Rachael Dratch and Ana Gasteyer. Dratch and Gasteyer are in the movie, but they wrote and executive produced it, too. Imagine the fun they had brainstorming ideas and pitching the concept to Comedy Central execs? Another Christmas movie I’m really looking forward this year is a musical: Roku’s “Zoey’s Extraordinary Christmas.” This extension of the delightfulbut-canceled-by-NBC series “Zoey’s E x t raord i na r y Playl ist,” pic k s up

with Zoey (Jane Levy) facing her first Christmas since her father’s death. The entire cast returns for the event – even Peter Gallagher as Zoey’s late after, Mitch. If there’s any cast I want to hear caroling, it’s this one. Who wouldn’t want to see Mo (Alex Newell) singing “It’s the Most Wonderful Time of the Year” in a bustling shopping mall? This holiday season, instead of brushing o� made-for-TV Christmas movies as all being basically the same, why not check out some of the ones that are challenging and changing the genre?

ROCKFORD – On Saturday, November 27, 2021 from 1–3 p.m., the Polish Gallery of the Ethnic Heritage Museum will honor Irena Nierzwicki and Małgorzata Czajkowski for their contributions to St. Stanislaus Church and the Polish community. Irena Nierzwicki was born in Przelek, Poland, and came to the United States in 1987. She completed vocational school, where in addition to training as a seamstress, she earned a certificate as a leather smith; learning to design, create, repair, and restore products made from leather. In 1971 Irena married the love of her life, Franciszek Nierzwicki (who passed away in 2003), with whom she had 2 daughters and two sons. Her motto is “giving back” to her community and the Polish parish. M a ł gor z at a C z ajk ow sk i w a s b or n in Łomża, Poland, and came to the United States in 1991. She met her husband, in 1994, with whom she has a son. Małgorzata feels passionate about

keeping her Polish traditions and heritage alive for future generations. In addition to honoring these amazing women, this celebration will showcase Polish music. This event is free (donations are greatly appreciated) and open to all audiences. The Heritage Museum Park is a historical campus containing the Ethnic Heritage Museum and Graham-Ginestra House. The Ethnic Heritage Museum is a cultural center and museum, featuring six ethnic galleries: African American, Hispanic, Irish, Italian, Lithuanian and Polish. The Graham-Ginestra House, built in 1857, was Rockford’s first commissioned historic landmark and is on the National Register of Historic Places. This beautiful home features Italianate and Greek Revival Architecture and provides unique insight into the lives of some of early Rockford’s most prominent.
