Rare and historic handwritten ledger by George Washington, taking slaves as collateral at Mount Vernon in 1769

1. George Washington Autograph Document Signed. ADS, signed “Go: Washington,” two pages on two adjoining sheets, 6 x 7.5, September 19, 1769. A financial ledger docu ment headed “Capt’n Posey,” transactions made between 1765 and 1769, including “Security on his Lands and Negroes for £750,” “A subsequent & further security on ye above Negroes for £70,” and “a Bill of Sale for Sundry stock, goods & chat tels as a…security to me against a joint bond of his & mine to Colo. Mason for £200.” On the right side, a £3 cash payment is recorded, below which Washington writes: “Note, besides ye above Capt’n Posey may have some trifling demands against me that I know nothing of at present & which may be showed when properly ascertained.” Washington signs at the conclusion with errors excepted, “E. Excepted pr Go: Washington, Copy of an Acc’t given to Mr. Grayson, Sept’r 19th 1769.” Professionally restored to near fine condition, with toning, light foxing and staining, and professional repairs to two areas of paper loss (which affect none of the handwriting).

Captain John Posey was George Washington’s next-door neighbor at Mount Vernon, and the two formed a friendship. However, Posey was a heavy drinker and failure in business, constantly falling behind in his debts and frequently turning to Washington for loans. Some of their several transactions—

which often included slaves as collateral—are recorded here. In one instance in 1767, Posey made a bond with Col. Mason with George Washington as security, much to Washington’s reluctance—in exchange for Washington’s participation, Posey executed a bill of sale which covered 25 slaves, 40 head of cattle, 20 horses, 40 sheep, 80 hogs, and lots of household goods including silver of various descriptions. Washington acquired his slave Hercules Posey as part of these transac tions, who went on to become one of eight enslaved Africans brought by President Washington to Philadelphia to serve in the executive mansion during his presidency.

Capt. John Posey was never financially solvent enough to make good on his obligations to Washington, and his account with the future president was settled by the forced sale of property in October 1769—just weeks after Washington penned the present document. Hercules Posey, after serving as a cook during Washington’s term in office, would escape to New York City in February 1797, where he remained a fugitive slave until January 1, 1801, when he was manumitted under the terms of Washington’s will. 2. George Washington Autograph Letter Signed as President. ALS as president, signed “Go: Washington,” one page, 7.25 x 9, March 30, 1795. Letter to General ‘Light Horse’ Harry Lee. In full: “If this letter should be received by you, it will be from Mr. Strickland, a gentleman of fortune from England who is desirous of seeing a little of Virginia (having already passed through the Eastern States) before returning to his own country. As you are now returned, or returning to the pursuits of rural life, Mr. Strickland who is in that line himself can give you some useful information in the practice of husbandry, but not so much on that as on acc’t of his merits I beg leave to introduce him to your civilities.” Second integral page bears a panel addressed in Washington’s hand, “Gen’l Lee, Richmond, Virgina,” and in the lower left of the panel, “Favored by Mr. Strickland.” Another portion of the second integral page is docketed in Lee’s hand. In very good to fine condition, with scattered light staining, minor edge chipping, and seal-related paper loss to the integral address leaf. Starting Bid $2500

3. James Madison and James Monroe Document Signed as President and Secretary of State. Partly-printed vellum DS, signed “James Madison” as president and “Jas. Monroe” as secretary of state, one page, 10.75 x 15, February 14, 1815. Scalloped-top ship’s pass issued to the “Brig Avon, Joel Manlove master of commander…To Pass with her Company Passengers Goods and Merchandize without any hinderance seisure or molestation.” Signed at the conclusion by President Madison and Secretary of State Monroe. The white paper seal affixed to the lower left remains intact. Handsomely mounted, cloth-matted, and framed with portraits and engraved nameplates to an overall size of 30.5 x 21.5. In very good to fine condi tion, with overall wrinkling and rippling, and all of the handwriting a couple of shades light. Starting Bid $200

4. Andrew Jackson Document Signed as President. Partly-printed vellum DS as president, one page, 14.75 x 18.25, December 22, 1832. President Jackson appoints Peter Turner as “Lieutenant in the Navy, to rank as such from the 20th of December 1832, in the service of the United States.” Signed at the conclusion by Andrew Jackson and countersigned by Secretary of the Navy Levi Woodbury. The embossed Navy Department seal remains affixed to the lower vignette. In fine condition, with the signature several shades light, but entirely legible. Starting Bid $200

5. John Tyler Signed Free Frank. Handaddressed and free franked mailing envelope, 5 x 3, addressed in Tyler’s hand to “Thomas Bradford, Esq’r, Philadelphia,” and franked in the upper right, “J. Tyler.” Postmarked “Free” at Washington, March 6, [no year]. In fine condi tion, with two stains, one of which touches the signature. Starting Bid $200

6. Millard Fillmore Autograph Letter Signed. ALS signed “Fillmore, Hall & Haven, Per. Millard Fillmore,” one page both sides, 7.5 x 9, July 19, 1836. Addressed from Buffalo, New York, a handwritten letter from Fillmore to William Campbell, the Surveyor General, inquiring whether his client can obtain title to a small portion of land then owned by the state. At the conclu sion, Fillmore signs in his capacity as the partner handling the case. In fine condition. Starting Bid $200

7. Abraham Lincoln Autograph Document Signed.

ADS, signed “Lincoln,” one page, 7.75 x 4, no date but circa 1855. Handwritten legal document accomplished entirely in the hand of Abraham Lincoln, in the case of Samuel Hitchcock, administrator of Isabella Hitchcock, v. William C. Glasgow, an action of “debt upon record.” In full: “And the said defendant comes and defends, the wrong and injury, when, where &c. and says the plaintiff actio now because he says there is no such record, as the plaintiff in his declaration, has alledged; and this he prays may be enquired of by the court &c.” In fine condition, with trimmed edges. Encapsulated in a PSA/DNA authentication holder.

Lincoln had appeared for Glasgow in two cases heard before the Tazewell County court in October 1854. The court decided against Glasgow in one decision, awarding the plaintiff $387.45 plus costs. The second case, Hitchcock v. Glasgow, was con tinued until spring 1855, when Lincoln filed this pleas, arguing that the Hitchcocks could not recover “Debt upon Record” as there was no valid “record.” Glasgow was an Illinois resident at the time the Ohio court awarded the Hitchcock estate its judgment, and had ‘never appeared in person to said suit, nor authorized any person to appear for him, therein; and this he is ready to verify.’ As a result of Lincoln’s successful defense, the plaintiff dismissed the action on May 1, 1855.

Uncommon matte-finish 5.5 x 8 head-and-shoulders photo of McKinley by Courtney of Canton, Ohio, affixed to its original 8.5 x 11 mount, signed and inscribed in ink, “For Miss Mary Harter, With sincere regards, W. McKinley.” In fine condition, with some subtle soiling to the mount and evidence of mounting to reverse. An unusually large and well-preserved signed portrait of the president. Start ing Bid $200

8. U. S. Grant Signature. Choice ink signature, “Yours truly, U. S. Grant, Lt. Gen. U.S.A., Washington, D.C., March 31st 1866,” on an off-white 4.25 x 3 slip. Mounted, matted, and framed with a carte-de-visite portrait of Gen. Grant to an overall size of 10.5 x 13.5. In fine condition, with light toning along the left edge. Starting Bid $200

Truman”; and a vintage matte-finish 10.5 x 13.25 photo of Mrs. Truman by Chase of Washington, signed and inscribed in fountain pen, “With love to Louise, from Bess.” In overall fine condition, with trimmed edges. 12. Harry S. Truman and Thomas E. Dewey Signed Newspaper. Incredibly rare front page of the Chicago Daily Tribune of November 3, 1948, 16.5 x 23.25, featuring the iconic banner headline “Dewey Defeats Truman,” signed below their respective surnames in black ink by the two candidates: “Tru man hasn’t found it out, Harry S. Truman” and “Thomas E. Dewey.” Rolled and in very good to fine condition, with small areas of paper loss, and expertly reinforced via professional silking to both sides.

When the decision to print this paper was made, returns were coming in very slowly and time was running out before the deadline for the edition. The Tribune staff, based on the early returns, decided Dewey would be the next President. After the newspaper was delivered to the street, more returns came in and showed that Truman would in fact be reelected, winning the electoral vote with a 303-189-39 majority over Dewey and

Dixiecrat candidate Strom Thurmond. Widely regarded as the most notorious journalistic blunder in the history of American newspapers, the ‘Dewey Defeats Truman’ front page holds a unique place amongst the long list of famous front page headlines. This example being signed by its two subjects can be chalked up as an inconceivably rare occurrence—this is the only Truman-Dewey dual-signed item we have ever en countered. Starting Bid $1000

13. Jacqueline Kennedy (3) Autograph Letters Signed. Three ALSs from Jacqueline Kennedy Onassis sent to Meredeth Price, the house counselor of John F. Kennedy, Jr., during the latter’s tenure at Phillips Academy in Andover, Massachusetts, from 1977 to 1980. The correspondence consists of three handwritten letters, two full and one partial (missing the first page), six total pages, signed either as “Jacqueline Onassis” or “Jacqueline Kennedy Onassis.” Letter highlights:

July 13, 1977: “I think that the year ended on a pretty good note…it seems to me to have been a year of enormous growth for John. He has matured so much.”

August 6, 1978: “He certainly has grown up so much—and is so much happier in his shaky semi maturity…What pleases me most about John is that he no longer looks on figures of authority as his natural enemies, but now more as his allies.”

No date: “I hope that in his great relief, he won’t revert to his breezy ways. Please remind him for me, that though this makes life easier for him in one way, it makes it more difficult in another.” In overall fine condition, with some light creasing, and small smudges to two words on the last letter. 14. Jacqueline Kennedy Signed Photograph. Outstanding glossy 7.5 x 9.5 close-up photo of President John F. Kennedy, signed and inscribed in black felt tip to his esteemed White House photographer by the former first lady, “For Cecil Stoughton, whose talent and friendship meant so much to President Kennedy and myself, always devotedly, Jacqueline Kennedy.” In very fine condition, with uniform light fading to the image. Cecil W. Stoughton (1920–2008) served as the official White House photographer throughout Kennedy’s administration, capturing some of the most iconic and intimate moments of JFK’s historic term in office. 16. John F. Kennedy Typed Letter Signed. TLS signed “Jack Kennedy,” one page, 7.25 x 10.5, North Ocean Boulevard, Palm Beach letterhead, December 9, 1946. Letter to Bill Kelly in Boston, in part: “I received your letter in regard to the celebra tion of the 75th Anniversary of the first Branch Library in the United States...As you know, for the last year or so this Kennedy family has been channeling all its resources into the Joseph P. Kennedy, Jr. Foundation, which gave its first donation to the Archbishop last August and will give a large gift to some organizations every year on the anniversary of my brother’s death. For this reason, I have been forced to turn down most requests because I think it more important to help the Foundation on a few big projects...However, because I recognize that this district has in it the first Branch Library, which is certainly something which we should all be proud of, I shall be glad to make some personal contribution to the project. If you will tell me how much you are planning to pay for the victrola, I will work out some sort of contribution which I hope will be helpful.” In fine condition, with two file holes to the top edge. 17. John F. Kennedy Handwritten Speech Draft. Partial handwrit ten draft by John F. Kennedy, one page, 8 x 11.5, no date but possibly for a speech during his 1960 presidential campaign. Kennedy writes, in full: “If foreign countries wish private foreign capital invested, and this must be their decision, then I would think they have give reasonable assurances against confiscation. I emphasize that this is a decision for the country involved.” He strikes through the final phrase: “Private capital is free to invest or not to.” In very good to fine condition, with an old tape stain along the repaired tear at the top. Kennedy” memo paper, stationery which dates to Kennedy’s tenure as a Massachusetts congressman; Kennedy’s stationery as a U.S. Senator was imprinted with his senatorial title letterhead. The handwritten note, in full: “Langdon, This is what I was talking about. J. K.” Matted and framed with a photo of Kennedy and his wife Jackie to an overall size of 14.75 x 12.25. 20. John F. Kennedy Original Homicide Report. Original homi cide report (form OP HB-403), one page, 8.5 x 11, November 23, 1963, documenting the assassination of President Kennedy. The form is filled out in type with relevant information and a description of the incident. The “Details of Offense,” in full: “The expired was riding in motorcade with wife and Governor John Connally, and his wife. Witnesses heard gun shot and saw the expired slump forward. More shots were heard and the expired fell into his wife’s lap. Governor Connally was also shot at this time. Car in which they were riding was escorted to Parkland Hospital.” The bottom of the report lists the suspect as “Lee Harvey Oswald,” a 25-year-old white male, arrested by officers “Lt. E. L. Cunningham 464” and “MN McDonald 1178,” charged with “Murder.” In fine condition. Starting Bid $200

Letters Signed. Unique archive of eight ALSs by Alexander Graham Bell, including four standard letters (totaling seven pages) plus four postcards, dating from 1872 to circa 1874, all to Prof. Abel S. Clarke at the American Asylum in Hartford, now known as the American School for the Deaf. Bell writes regarding ‘visible speech’ and the ‘Visible Speech Pioneer,’ a periodical circulated to schools and institutions to promote his father’s ‘visible speech’ system. Two of the letters are written and signed using visible speech symbols—a novel and appeal ing rarity as the only such Graham Bell autographs we have ever encountered—and one remains untranslated. All four letters include their original mailing envelopes, addressed in Bell’s hand, and all of the postcards are addressed to Clarke by Bell on the reverse.

In overall fine condition. Visible Speech is a system of written symbols that represent sounds capable of being made by the human voice. This system, which can be used with not only English, but also with foreign and obscure languages, was developed by Alexander Melville Bell, father of Alexander Graham Bell, and became popular with the publication of the latter’s book ‘Visible Speech’ in 1867. Alexander Graham Bell began teaching his father’s system upon his arrival in Boston in April 1871, and by March-June 1872, he was providing the same training to teachers at the Clarke School for the Deaf in Northampton, Mass., and the American Asylum for the Deaf in Hartford, Conn. You are also aware that an objec tive investigation of the case, suggested by the International Red Cross, which was to be carried out by the Red Cross of neutral countries, has been rejected by the North Korean side. I believe that transnationally minded intellectuals can only serve the good cause effectively by advocating negotia tion, understanding and transnational solution of the security problem, but not by engaging in such propaganda ventures as the present one. I find that the Quacker organization [sic!]

Hadamard published an open letter to Einstein in March 1952, accusing the Americans of developing biological weapons for use during the Korean War. Einstein responded privately on March 26, 1952, writing in a letter that has since been published: ‘I am really the last person who would excuse these abomi nable weapons, whether they are atomic bombs or biological means of destruction.’ Einstein went on to urge constructive supranational security action. Hadamard evidently asked to publish the letter, which Einstein here declines. A fascinating piece of correspondence between leading intellectuals on the topic of international peace. 115. Mohandas Gandhi Signed Photograph. Vintage matte-finish 3.5 x 5.25 photo of Gandhi seated and spinning cot ton, boldly signed in fountain pen, “M. K. Gandhi.” The reverse is annotated, “Through, Rajkumari Anmrit Kaur, 2-Aug-1935.” In fine condition.

After assuming control of the Indian National Congress in December 1921, Gandhi expanded his nonviolence program to in clude the swadeshi policy—the boycott of British goods. From this originated his spinning wheel, as he encouraged all Indians to wear khadi (homespun cloth) instead of British-made textiles. Thus, the picture of Gandhi at his spinning wheel has become one of the iconic images of the 20th century.

Rajkumari Amrit Kaur was an important political and social activist who joined Gandhi as his secretary in 1929, and worked for him for 17 years. Of noble birth, the princess helped establish the AIWC in 1927 dedicated to women’s empowerment in India, and in 1947 Nehru called her into the first government of India as Minister of Health. Lifesaving ‘Schutz-Pass’ issued to a Budapest native by Raoul Wallenberg during World War II

DS in German and Hungar ian, quickly signed by Raoul Wallenberg with an ink scribble (as he commonly did on documents of this type), one page, 8.25 x 13.25, September 28, 1944. Blue and gold two-language Schutz-Pass issued to “Aurel Feld geb. Serena Sziklai” of Budapest. Upper left provides her personal information including her 1879 birth date, height, eye and hair color. Her passport-style photograph is affixed to the upper right, signed below in purple ink. Bottom portion bears printed statements in German and Hungarian, hastily signed in the lower left corner by Wallenberg, and countersigned by Swedish Minister to Budapest, Carl Ivan Danielsson. In very good condition, with intersecting folds, and wear and creasing the the edges.

Wallenberg arrived in Hungary in July 1944 as the country’s Jewish population was under siege. Nearly every other major Jewish community in Europe had already been decimated, and the Nazis were dispatching more than 10,000 Hungarian Jews to the gas chambers daily. With time of the essence, he de vised and distributed thousands of these ‘Schutz-Passes’—official-looking, but essentially invalid, Swedish passports granting the Hungarian bearer immunity from deportation. Nazi officials readily accepted the paperwork. Thus, with his simple, nondescript scribble on this offered page, Wallenberg saved the life of Aurel Feld—just as he had done with tens of thousands of other Jews in Hungary. Starting Bid $500

Exceedingly rare vintage ballpoint signature of Mao Tse-tung on the reverse of a 6.75 x 4.5 Chinese dinner invitation to a Buffet Party hosted by the China-Latin America Friendship Association at the Xinqiao Fandian (Hotel) on Thursday, 27 October 1960 at 6:30 pm, “in order to kindly see off the cultural friendship delegations of Latin American countries.” In fine condition, with minor soil ing. In 1960, Mao was hard at work cultivating relationships with foreign nations as he planned to develop China from an agrar ian economy to a socialist world power. Latin American nations leapt to the forefront of potential partners after the Cuban Com munist revolution of 1959. The China-Latin America Friendship Association had been established in Beijing earlier that same

year, in March 1960, and soon became the general fortress of cultural infiltration into Latin America. The U.S. diplomat Roy R. Rubottom Jr., who served as Assistant Secretary of State for Inter-American Affairs (1957-60), noted that, also in 1960, Mao Zedong appeared to have ‘gone out of his way’ to receive Latin American Communist leaders and to exhort them to give their full backing to the kind of revolution he favored.

Chairman Mao met with multiple Latin American delegations in May 1960, and would go on to host Che Guevara in No vember. These discussions frequently revolved around the shared struggle against American imperialism, as well as general Communist ideals. As a piece linking Mao to ideo logical revolutions abroad, this is an extremely desirable and exceptionally rare signature from one of the major political and cultural figures of the 20th century. King George VI died in his sleep at Sandringham House on February 6, 1952, after battling various ailments for several years. From February 8th to 11th, George VI’s coffin rested in St Mary Magdalene Church, Sandringham, before lying in state at Westminster Hall from February 11th to 15th. Following the state funeral at St George’s Chapel in Windsor Castle, the king was interred in the royal vault. Creating this mourning message, expressing gratitude to those who kept vigil over the king at his first resting place, would have been one of Queen Elizabeth II’s first official acts as sovereign—a poignant and remarkably historic piece. 133. Howard Carter’s Personally-Owned Tape Measure. Howard Carter’s personally-owned 100-foot measuring tape by Chesterman of Sheffield, England, the fine leather-wrapped case measuring 6˝ in diameter and embossed with the maker’s name on both sides. At the side is a brass tag, which is used to draw the tape out; at the center is a brass catch used to wind the tape back in. The tape itself is rather toned, and has clearly been put to much use, with the first dozen numbers worn and reinforced in mapping ink—one can only imagine the journeys it undertook as part of Carter’s kit, and what treasures of Egyptian antiquity it might have measured. In overall very good to fine condition, with expected wear from heavy use and scuffing to leather.

134. Howard Carter Handwritten Autobiographical Notes. Handwritten autobiographical notes in pencil by Howard Carter, unsigned, 16 pages (mostly single-sided), 4.5 x 6.25, no date. The account begins with episodes of his life as Chief Inspector of the Upper Nile, a post in which he served from 1899 to 1904, opening: “Perhaps the reader may not be displeased if I here attempt to acquaint him with something of the life during summer residence in Upper Egypt.” He writes of the oppres sive heat in the summertime at Thebes and recalls encountering the “destruction of ancient monuments,” in particular “the cutting out of sculptures, reliefs and fresco-paintings from the walls of tomb-chapels to sell to the unsuspecting collector whose primary appeal was the acquisition of antiquities.”

He goes on to describe the excavation process, in part: “Clearing that shaft took the greater part of another two months. My description can give you no idea of the tediousness of the work: the fact, for instance, there was no means of arriving at any conclusion as to how deep we should have to go, nor the amount of material that would be required, made it all the more wearisome. However, at the end of November, the good news at last came. At the depth of more than 100 feet, the work men reached the bottom, and revealed a doorway carefully sealed up with slabs of limestone. I examined it & found that the masonry by which it was closed had been built with due care. I said to the foreman ‘this, without doubt, is the entrance to the Tomb-chamber’ He nodded his assent, and muttered a prayer. My desire to remove a stone and peep through was almost irresistible. 135. Howard Carter’s Personally-Owned Thermos Set. Howard Carter’s personally-owned set of two Thermos Model No. 15Q flasks, housed in a handsome form-fitting brown leather carrying case. Each Thermos measures approximately 13.5˝ tall, 3.5˝ in diameter, and features a cork stopper with screw-on teacup-style lid. The leather case, with buckled closure strap/ carrying belt, measures 9˝ x 13.75˝ x 4.75˝. In overall fine condition, with expected wear from use, and some scuffing to the leather case. It is easy to envision the parched Egyptologist turning to these Thermoses for some relief from the desert heat.

136. Howard Carter’s Hand-Annotated Lecture Notes.

Howard Carter’s hand-annotated typed notes for three lectures (two about his discovery of King Tut’s tomb, and one on the subject of color), totaling 36 pages housed in a leather binder, with his pencil annotations throughout. The first text relates to his discovery of the tomb of Tutankhamun, beginning: “In nearing the tomb of Ramses VI, we found a very intriguing buried heap of flint boulders which suggested the proximity of a tomb. Our work progressed, and at the level of the twelfth step there was disclosed the upper part of a doorway, blocked, plastered and sealed…It was with reluctance that I reclosed the excavation…Little knowing that had I gone a few centimeters deeper in that excavation, the name of Tut.ankh.Amen upon the seals of that doorway would have told me the secret—that almost ephemeral king, Tut.ankh.Amen, in accordance with the religion he reverted to, and under the Theban traditions, had made his grave in the Valley of the Tombs of the Kings.” The text is interspersed with slide listings providing an outline for the lecture’s visuals—chronicling the Valley of the Kings, the excavation, the discovery of the tomb, and the antechamber and its precious objects, which have been annotated in pencil

and red crayon in Howard Carter’s hand. An inserted page, employing a different typeface, provides his famous account of his first sight of the tomb’s interior: “As my eyes grew ac customed to the light, details of the room within emerged slowly from the mist, strange animals, statues and gold, everywhere the glint of gold…I was struck dumb with amazement, and when Lord Carnarvon unable to stand the suspense any longer, inquired anxiously, ‘Can you see anything?’ It was all I could do to get out the words, ‘Yes wonderful things.’” The second lecture “The Royal Burial and Innermost Treasury,” dated May 1930, offers biographical commentary on Tutankhamun and documents the excavation of the burial chamber. The third The third lecture, entitled “Colour,” hand-annotated in pencil, “Lecture Colour, V&A Oct. 17, 1934,” departs from his archaeological interests and provides an interesting discus sion of color from artistic and scientific perspectives. In part: “I think a letter should be written to Mr. Ogden…requesting him to contradict publicly with an apol ogy…the statement he made during his lecture at Cambridge, published in the Cambridge Evening News…In the par. referring to Mr. Ogden’s disclosure as to how the discovery of the tomb of Tutankhamen was made there is not one word of truth, and I think you will agree that it is detrimental to me. Howard Carter’s personally-owned brown leather briefcase by Drew & Sons Ltd of Piccadilly Circus, boasting his initials monogrammed on top, “ƆHC,” so as to be read in both directions. Carter’s briefcase measures 16˝ x 11˝ x 5.75˝, and has a built-in file folder system inside. In good to very good condition, with moderate to heavy wear to leather, and clean splits along the bottom panel such that the case is separated into two parts; the piece could likely be restored by an expert craftsman. A rather compelling object, likely to have accompanied the Egyptologist on some interesting journeys.

142. Howard Carter: Letter from Mother, Martha Joyce Carter. ALS signed “Your loving & devoted Mother,” one page both sides, 8 x 9.75, July 26, 1917. Handwritten letter to Howard Carter (“My dearest boy Howard”) from his mother, Martha Joyce Carter, in part: “Your welcome letter received this morn, have been most anxious to hear from you by what you say I feel you do not receive my letters.” She updates him on forthcoming visitors and domestic life, and continues: “I so often wish I could have a talk with you as you are so good & sensible—about all things.” In fine condition.

In 1914, Lord Carnarvon received permis sion to dig in the Valley of the Kings. Carter led the work, undertaking a systematic search for any tombs missed by previous expeditions, in particular that of the Pharaoh Tutankhamun. However, excavations were soon interrupted and delayed by World War I. Carter spent the early war years working for the British government as a diplomatic courier and translator. He would enthusiastically resume his excavation work towards the end of 1917. Starting Bid $200

143. Howard Carter: Letter from Solicitor on Carnarvon’s Payment. TLS signed “Alfred W. Fryer,” two pages, 8 x 10, personal letterhead, September 22, 1930. Letter to Howard Carter, in part: “On Lady Carnarvon’s instructions I am sending you herewith my cheque for £8,012.0.0. As you know her Ladyship has recently received a sum of money from the Egyptian Government and she wishes to give to you one quarter of the net amount which will remain to her thereout after discharg ing the various expenses in connection therewith. Lady Carnarvon, as I think you know, greatly appreciates the distinguished service you have rendered in the cause of scientific research and has many gratifying memories of your association with her late husband.” He adds a handwritten postscript: “For your information the gross amount paid by Lady Carnarvon to the Trustees Solicitors is £2952 English money.” In fine condition, with rusty paperclip impressions to the top edges. In part: “Having had the honor of addressing you so late as the 13 May last on the subject of my claims on government for cash advanced for the Public Service in the Wt. Indies more than seven years ago: I had hoped from the sacrifices I have made and the services I have rendered to the Public, that some attention would have been thought due… Were my finances such that I could with justice to my family make a further sacrifice of this money to the public, I should not again trouble you.” Docketed on the reverse, “Copy to Mr. Pitt, Aug’t 8th.” In fine condition.

After spending several years in Canada, Arnold returned to England in 1791, but he left to spend several years privateering in the West Indies before permanently settling at Gloucester Place in London, from where he penned this letter. His work in the West Indies was dangerous due to the hostilities of the French Revolution, and was imprisoned by French authorities on Guadeloupe amid accusations of spying for the British. Arnold narrowly eluded hanging by escaping to the blockad ing British fleet after bribing his guards. He helped organize militia forces on British-held islands, receiving praise from the landowners for his efforts on their behalf. He hoped that this work would earn him wider respect and a new command; instead, it earned him and his sons a land-grant of 15,000 acres in Upper Canada. Plagued by debt and poor business decisions, he here reaches out to the British prime minister in hopes of receiving his pecuniary due. Starting Bid $1000

296. Benedict Arnold Autograph Document Signed. Major General in the Continental Army during the American Revolution who distinguished himself at Saratoga (1741-1801). One of Washington’s most skilled and able generals, he turned traitor in an infamous plot to turn over the fortress at West Point to the British. Third-person ADS, one page, 7.25 x 4, June–July 1773. Handwritten financial document by Benedict Arnold, headed “Dr. Mr. Silas Marsh to Benedict Arnold,” detailing money lent and interest paid, amounting to a total of £10.0.9. The most notable line item is “Johnson’s Dictionary, 2 Vols.,” sold for £1, evidently an early edition of Samuel Johnson’s influential Dictionary of the English Language. Benedict Arnold had established himself as pharmacist and bookseller in New Haven, Connecticut, in 1762, and expanded his mercantile empire over the course of the decade—by the time he penned this document, he was a partner in multiple trading ships that conducted a lucrative West Indies trade. However, he also operated his business on the brink of insolvency and openly defied Parliamentary Acts levying unjust taxes—which led to his joining the infamous ‘Sons of Liberty’ in opposition.

300. Napoleon Letter Signed. Signifi cant LS in French, signed “Np,” one page both sides, 7.25 x 9, January 24, 1812. Untranslated letter about the organiza tion of his Grande Armée troops for the invasion of Russia, giving orders for the recruitment of 120,000 soldiers. In fine condition, with a thin old mounting strip along the back left edge.

By 1812, after decades of perpetual war, enlistment in the French army was severely diminished and left Napoleon struggling to fill his ranks. With conscription laws plac ing virtually every able-bodied Frenchman in the service of the army, desertion and evasion became a sweeping problem. As he prepared his campaign against Russia, the state began using mobile col umns—temporary organizations of armed men—to locate and arrest the thousands avoiding recruitment. These draft-dodgers, combined with large numbers of troops drawn from conquered states, formed an uncommitted army that became a key factor in the disastrous invasion that followed. Working draft outline for Napoleon’s memoirs, penned while exiled on Saint Helena

299. Napoleon Bonaparte Handwritten Manuscript. Rare handwritten manuscript in pencil by Napoleon Bonaparte, one page, 8 x 12.5, no date. A significant document prepared by Napoleon while living in exile at Longwood House on Saint Helena, regarding his proposed memoirs. Napoleon famously dictated his memoirs to Emmanuel, comte de Las Cases, who had accompanied him to Saint Helena and served as his secretary there. Las Cases published the admiring work under the title Le Mémorial de Sainte-Hélène (The Memorial of Saint Helena) in 1823. Here, Napoleon writes out what is essentially a working draft of a table of contents or outline for his memoirs in thirteen chapters.

The manuscript begins, “Ch. 1, 18 Brumaire,” referencing the French Republican calendar date of November 9, 1799, when the ‘Coup of 18 Brumaire’ brought General Napoleon Bonaparte to power as First Consul of France. The list goes on to men tion the actions of the government in 1800, tasks of the legislative body in 1800–1801, finances in 1800–1801, the War in the Vendée, defense, armies, the preliminaries of Saint-Julien, Holland, Italy, negotiations for the return of peace in 1800–1801 (with reference to treaties signed at Lunéville and Amiens), and revolts of the populations in Italy, Holland, Switzerland, and Genoa. In very good to fine condition, with multiple horizontal folds, and small splits to the ends of the vertical fold.

In this extraordinary manuscript, Napoleon dismisses the early years of his life and concentrates on this decisive period of his career: just a few years, where he seizes power as First Consul in 1799 before rising to Emperor of the French in 1804. Napoleon had little else to do while exiled than to reflect on his triumphs, and this documents Napoleon’s own thoughts on the main steps of his rise to power. It is a critical manuscript that offers insight into Napoleon’s understanding of his life and career. Starting Bid $1000

Superb original sketch by Italian Jewish painter and sculptor Amedeo Modigliani entitled ‘Cariatide’ (1913), accomplished in graphite on an off-white 16.75 x 10.5 sheet, which is signed vertically in the lower right, “Modigliani,” and inscribed on the reverse, “a Madame Hastings.” An example from his ‘Caryatid’ series, the sketch depicts a human figure, either a child or a woman, with head turned towards the observer. Framed to a slightly larger size and in fine condition.

From 1909 until 1914–15, Modigliani made more than seventy sketches of Caryatids, which he originally conceived as pre paratory drawings for an ambitious sculpture project that he called ‘colonnes de tendresse’ (columns of tenderness). The Caryatids—stylized representations of women that functioned as columns or pilasters in an architectural setting—were notably influenced by African art, which is evident in the poses of the figures and their mask-like faces. These Caryatid sculptures were planned for a secular temple devoted to the beauty of humankind. The recipient of this drawing was Beatrice Hast ings, an English writer, poet and literary critic, who shared an apartment in Montparnasse with Modigliani and became

his model for countless paintings, including the 1916 work, ‘Seated Nude.’

Edouard Manet’s painting ‘Olympia,’ an arrestingly bold nude of a reclining prostitute, immediately sparked controversy upon its unveiling at the 1865 Paris Salon. Later recognized as one of the artist’s true masterpieces, Monet spearheaded a public campaign to raise money for the French government to purchase the painting. Monet’s letters on the subject—gen erally sent to those within his artistic circle—are highly coveted, and this example is dramatically enhanced by the list of subscribers. By February 1890, Monet had raised about 20,000 francs to purchase the great work and announced its donation to the French national museums. As the law prevented the Louvre from exhibiting works until their creators were ten years deceased (Manet died in 1883), ‘Olympia’ was first shown at the Mu sée du Luxembourg, then at the Musée de l’Art Contemporary of Paris. 439. Margaret Mitchell Archive of (7) Typed Letters

Signed. Superb collection of seven TLSs from author Mar garet Mitchell, each signed “Margaret Mitchell Marsh,” all of which have been folded and tipped neatly into a hardcover copy of Gone With the Wind (November 1936 printing). Typed on her personal letterhead between 1937 and 1941, Mitchell touches upon her health and travel plans, sends thanks for compliments and gift baskets, talks of “sacrifice and courage” during wartime, and remarks on the historical accuracy and impact of her novel. The most interesting letter relates to Mitchell’s Civil War research.

December 10, 1937: “In reply to your remarks about the blame for the failure to exchange prisoners being laid on President Lincoln—that calls for an explanation of my method of han dling the ‘contemporaneous’ angle of ‘Gone With the Wind.’ I attempted to write it not from the viewpoint of a person living in the sixties. To this end I put into the minds and the mouths

of characters beliefs, rumors and prejudices (some which have been proven right and some wrong in the light of his tory). I gathered from reading letters of that day, newspapers, memoirs et cetera, that President Lincoln bore the blame for many things in the minds of Southern people. Prejudice as well as death loves a shining mark and, rightly or wrongly, Southerners, for the most part, believed Lincoln responsible for the failure to exchange prisoners.”

Letter to Prof. William Curry at Adelphi College, declining an invitation while noting: “I prefer not to do any public speaking.” In fine condition. Accompanied by the original mailing envelope and a full letter of authenticity from JSA. Salinger retreated from public life after the publication of The Catcher in the Rye in 1951, shunning most forms of public attention. He had first come to literary prominence with ‘A Perfect Day for Bananafish,’ published in The New Yorker in 1948, and came to rely on that magazine as an outlet for much of his later short fiction. Salinger’s last published work, the novella Hapworth 16, 1924, appeared in The New Yorker on June 19, 1965. A highly desirable letter that associates his reclusive demeanor with the primary publisher of his short stories.

In part: “They appeared to suffer more than any trees, except the white ash. Their leaves (and also those of the alders, hickories and grapes, and even oaks more or less) were so curled on the upper 3/4 of the trees, that their foliage had a singularly glaucous hue. Seen at a distance in rows along the river, they had somewhat of the same effect with the silvered tip of the swamp white oak...I went ashore & felt of them. They were more or less crisped &

Incredibly rare 1748 receipt signed by Johann Sebastian Bach as Kapellmeister at St. Thomas Church

487. Johann Sebastian Bach Document Signed. Manuscript DS in German , signed “J. S. Bach,” one page, 4 x 2, circa June–July 1748. Receipt headed “Legatum Lobwasserianum, 1748,” by which Bach confirms receipt of two guilders from the Lobwasser Bequest at St. Thomas’s in Leipzig. Following his signature, Bach writes: “acc[epi] - 2 fl.” Above and below Bach’s signature, his colleagues Conrad Benedict Hülse and Abraham Kriegel sign for their payment of the same. This sum was paid out around every July 2nd to the cantor, deputy headmaster, and third teacher (tertius) at St. Thomas. It represents one of Bach’s several sources of supplementary income which together made up a substantial part of his Leipzig salary, roughly equivalent to an organist’s weekly wages. The “Legatum Lobwasserianum,” a legacy of 1000 guilders, was bequeathed in 1610 by a Leipzig lawyer’s pious widow, Maria Lobwasser; the 50 guilders of annual interest, paid on the Feast of the Visitation, went toward supporting St. Thomas’s church and school personnel. This is one of only two known receipts from Bach receiving his Lobwasser funds. A long-awaited reunion: Beethoven’s emotionally charged first sketch of “Neue Liebe, neues Leben,” a setting of Goethe’s 1775 love poemh

488. Ludwig van Beethoven Autograph Musical Manuscript. Significant autograph musical manuscript by Ludwig van Beethoven, unsigned, three pages on two 12 x 9 sheets, no date but circa 1798–1799. Beethoven’s first draft for the lied ‘Neue Liebe, neues Leben’ [New Love, New Life], a setting of a 1775 poem by Johann Wolfgang von Goethe, begun in late 1798. The present sketch, jotted down without interruptions in a very cursory, almost rushed hand, already contains the melody and the words with no expression mark ings, but includes occasional bass sections as well as parts of the piano accompaniment at the end of verses. It shows several important departures from the version printed in 1810. At the head of the first page, written in a different ink and pen and comprising the first four staves, are the first eight bars of the finale of Beethoven’s String Quartet No. 1 in F major (Op. 18, No. 1, composed between 1798 and 1800, published in 1801), providing the violin voice with the theme chorus of triplets.

The lied in its present version (WoO 127) was published in early 1808, nearly a decade after this first sketch, by Simrock in Bonn as the first part of the ‘III deutsche Lieder,’ apparently without the composer’s consent. Beethoven subsequently revised his work and published it the following year with Breitkopf & Härtel in Leipzig as part of his ‘Sechs Gesänge’ (Op. 75, No. 2); the manuscript of that revision, dated 1809, is today kept at the Beethoven Haus in Bonn. In 1811 Beethoven presented a manuscript copy of that second version, the first leaf of which is also kept in Bonn (while most of the remainder is at the Pierpont Morgan Library in New York), to Bettina Brentano on the occasion of her wedding to Achim von Arnim. Nohl has pointed out that the present first draft with its ‘dramatic, aria-styled phrasings’ retains a somewhat ‘grandiose and dark quality’ as compared to the reduced later version, and ‘if one were to interpret the urgent stride so vividly apparent in this sketch, dashed off, as it seems, without a single interruption and in a mood of deep emotional excitation, then one feels instinctively that forces of an even greater passion than such

as Bettina could have aroused in Beethoven must have been at work here’ (cf. p. 695).

In fine condition, with occasional quite insignificant brown staining; altogether very crisp. Both leaves annotated with Beethoven’s name in a near-contemporary hand. At the head of the first page is the ‘mysterious caption’ (cf. Nohl), also by a different, early hand: “Der Schluß von seinem letzten Septuor als Motto für den Text” (apparently referring to Beethoven’s Septet, Op. 20, also written in 1799; a tentative explanation is advanced by van der Zanden, p. 168). The second leaf is mounted to a cloth stub with another, blank sheet of contempo rary paper. Housed in a handsome red morocco presentation folder with ornate engraved plate on the front: “Beethoven, Neue Liebe, Neues Leben, WoO 127.”

Beethoven manuscripts written before 1800 almost never come to market; no other complete autograph manuscript of this version is known. The two leaves formerly were a single bifolium owned by baroness Anna von Gleichenstein, the sis ter of Beethoven’s friend Therese Malfatti (remembered as a possible dedicatee of ‘Für Elise’), which was soon separated. Even in 1865, when Nohl edited the first leaf, its counterpart was no longer in the possession of the Gleichenstein family. The first sheet later surfaced in the archives of the music publisher Schott in Mainz and was sold at Sotheby’s in 2002 (6 December, lot 14: £65,725). The second leaf was offered in 1968 by Hans Schneider of Tutzing in his catalogue 136 (lot 37, DM 17,800; then again in cat. 142, lot 266, with illustration on p. 45) and was acquired in 1969 by a private collector who had it auctioned by Venator & Hanstein in Cologne in 2011 (cat. 118, lot 861: EUR 108,000). Now that both leaves have been reunited, Hans Schneider’s words, written half a century ago about only the final 62 measures, are no less true: ‘Through Beethoven’s synthesis of his own music with a text by Goethe we are presented with a musical autograph as desirable as it is beautiful’ (cat. 136, p. 37). AMS signed “Leonard Bernstein” (once) and “Bernstein” (three times), seven pages on four sheets, 6.5 x 8.5, January 7, 1935. Handwritten essay by Leonard Bernstein entitled “Rolland: Jean-Christophe,” penned while a freshman at Harvard. Romain Rolland’s ten-volume novel centers on Jean-Christophe Krafft, a composer of genius whose life is depicted from cradle to grave—a fascinating topic for the young Bernstein to explore. He notes, in part: “’Jean-Christophe’ is my favorite book. It has every reason to be. Primarily, it harmonizes with my tastes and offers a character which I can understand and sympathize with. Secondly, the book is incomparably well written. The word-pictures and disserta tions never tire one—a rare thing for long books…Rolland has an uncanny sense of human values and inner motives; and this, together with his extensive knowledge of music, well qualifies him to produce a ‘chef d’oeuvre’ such as this.” In fine condition. The piano manufacturer and music publisher Camille Pleyel (1788-1855) and his wife Marie were among the most important people in Chopin’s time in Paris. Chopin gave his first concert in Paris on February 25, 1832, and his last on February 16, 1848, on the company’s premises. He visited Hamburg in late January of 1888 where several musicians and critics (to quote his diary) ‘paid me flattering attention, awoke my warm sympathy, and thereby left me with indelible memories.’ One such person was the well-respected music critic and virtuoso organist at St. Peter’s Church Carl Armbrust, who made him feel quite at home there, and with whom he stayed in touch and held as a good friend upon his departure for Berlin in early February. 518. Elvis Presley Document Signed. Important partly-printed DS, signed “Elvis Presley,” one page, 8 x 5, January 10, 1956. Incredibly historic Radio Corporation of America employee’s withholding exemption certificate filled out in another hand and signed at the conclusion in blue ballpoint by Elvis Presley. The document notes his full name, “Elvis Aron Presley” (the second ‘a’ crossed out—this version famously recorded on his birth certificate), his address at 1414 Getwell St. in Memphis, his social security number, and his number of withholding exemptions. This document dates to one of Elvis’s most legendary recording sessions—on this day, January 10, 1956, he made his first recordings for RCA Records at The Methodist Television, Radio and TV Studios in Nashville. ‘Heartbreak Hotel’ was one of the songs recorded during this session, and released as a single just seventeen days later. The single topped the Billboard Top 100 for seven weeks and became Presley’s first record to reach a million sales. A remarkable document representing an important day in music history. ANYONE EITHER REGISTERING TO BID OR PLACING A BID (“BIDDER”)

ACCEPTS THESE CONDITIONS OF SALE AND ENTERS INTO A LEGALLY, BINDING, ENFORCEABLE AGREEMENT WITH R&R AUCTION COMPANY OF MASSACHUSETTS, LLC (“RR AUCTION”) TOGETHER WITH BIDDER, THE “PARTIES”).

This Agreement contains important provisions that control rights and liabilities, and specifically has provisions governing how disputes are handled as well as LIMITATIONS OF LIABILITY that can be imposed upon RR Auction, WAIVER OF JURY and ARBITRATION PROVISIONS. This acknowledgement is a mate rial term of these Conditions of Sale and of the consideration under which RR Auction agrees to these terms. PLEASE READ CAREFULLY.

The following terms and conditions (“Conditions of Sale”) constitute the sole terms and conditions under which RR Auction will offer for sale and sell the property on its website, and/or described in the catalog of items for auction (the “Catalog”). These Conditions of Sale constitute a binding agreement between the Parties with respect to the auction in which Bidder participates (the “Auc tion”). By bidding at the Auction, whether in person, through an agent or rep resentative, by telephone, facsimile, online, absentee bid, or by any other form of bid or by any other means, Bidder acknowledges the thorough reading and understanding of all of these Conditions of Sale, all descriptions of items in the Catalog, and all matters incorporated herein by reference, and agrees to be fully bound thereby.

Section 1

The Parties1.1 RR Auction and Auction

This Auction is presented by RR Auction, a d/b/a/ of R&R Auction Company of Massachusetts, LLC, as identified with the applicable licensing information on the title page of the Catalog or on the www.RRauction.com Internet site.

The Auction is conducted under these Conditions of Sale. Announcements and corrections from the podium at live auctions and those made through the Condi tions of Sale appearing on the Internet at RRauction.com supersede those in the printed Catalog.

1.2 Bidder

Bidder shall mean the original Bidder on the property offered for sale by RR Auc tion and not any subsequent owner or other person who may acquire or have acquired an interest therein. If Bidder is an agent, the agency must be disclosed in writing to RR Auction prior to the time of sale, otherwise the benefits of the warranty shall be limited to the agent and not transferable to the undisclosed principal.

The rights granted to Bidder under these Conditions of Sale are personal and may not be assigned or transferred to any other person or entity, whether by operation of law or otherwise without the express written assent of RR Auction. Bidder may not transfer, assign, or otherwise convey these Conditions of Sale or any of the rights herein, and such purported transfer, assignment, or convey ance shall be null and void. No third party may rely on any benefit or right con ferred on any Bidder by these Conditions of Sale, and no third party is intended as a beneficiary of these Conditions of Sale.

Bids will not be accepted from minor persons under eighteen (18) years of age without a parent or legal guardian’s written consent containing an acknowledg ment of the Conditions of Sale herein and indicating their agreement to be bound thereby on behalf of the Bidder.

All Bidders must meet RR Auction’s qualifications to bid. Any Bidder who is not a client in good standing of RR Auction may be disqualified at RR Auction’s sole option and will not be awarded lots. Such determination may be made by RR Auction in its sole and unlimited discretion, at any time prior to, during, or even after the close of the Auction. RR Auction reserves the right to exclude any person from the Auction.

If an entity places a bid, then the person executing the bid on behalf of the entity agrees to personally guarantee payment for any successful bid and agrees to be bound by these Conditions of Sale in addition to company for whom the Bid der is acting

By accepting the Conditions of Sale, Bidder personally and unconditionally guar antees payment.

Section 2

Bidding Privileges

2.1 In order to place bids, Bidders who have not established an account with RR Auction must either furnish satisfactory credit information (including two collect ibles-related business references) or supply additional information if requested, well in advance of the Auction. Bidders who are not members of RRAuction.com should pre-register before the close of the Auction to allow adequate time to con tact references. Privileges will be granted at the sole discretion of RR Auction. Additionally, Bidders who have not previously established credit or who wish to bid in excess of their established credit history may be required to provide a cash deposit prior to RR Auction’s acceptance of a bid. Check writing privileges and immediate delivery of merchandise may also be determined by pre-approval of credit based on a combination of criteria: RRAuction.com history, related in dustry references, bank verification, a credit bureau report and/or a personal guarantee for a corporate or partnership entity in advance of the Auction venue.

2.2 Bidder providing any false or misleading information provided in connection with the registration shall be a material breach of the Conditions of Sale and in addition to any other remedies at law shall excuse RR Auction from performance under these Conditions of Sale, including the right to any refund.

2.2 Bidding privileges may be revoked without notice, for any reason, at the sole discretion of RR Auction .

Section 3

Buyer’s Premium

3.1 The Bidder acknowledges and agrees that a 25% buyer’s premium will be added to the hammer price on all individual lots sold in timed and live Auctions. . For payment other than by cash, delivery will not be made unless and until full payment has been received by RR Auction, i.e., check or wired funds have fully cleared. Unless otherwise agreed in writing, signed by RR Auction, payment in full is due within thirteen (13) calendar days of the Auction or within twelve (12) calendar days of the invoice date, whichever is earlier. Bidder’s failure to pay any payment in full when due required shall constitute a material breach, and in addition to other damages available under contract or law, at RR Auction’s elec tion, RR Auction may cancel the sale and require full premium still be due along with interest at 1.5% per month from the date of breach, or at the maximum legally allowable rate.

Section 4 Bidding

4.1 Each Bidder’s determination of its bid should be based upon its own exami nation of the item(s) and independent investigation, rather than the any reliance as to what is represented in the Catalog, online or elsewhere. Bidder affirms that it regards any statements made by RR Auction concerning the item as solely opinion and that Bidder is making its own inspection and independent evaluation of the goods, and is not relying upon any description or statements by RR Auc tion (including as to quality, authenticity, provenance, ownership, liens existing, on goods legality, or value) in making its determination to bid on or purchase an item. In any purchase or sale, the value of the item(s) is determined by the price. THE BIDDER HEREBY ASSUMES ALL RISKS CONCERNING ANY AND ALL PURCHASES TO THE FULLEST EXTENT UNDER APPLICABLE LAW.

4.2 RR AUCTION IS NOT RESPONSIBLE FOR ERRORS IN BIDDING. A Bid der should make certain to bid on the correct lot and that the bid is the maximum (plus the Buyer’s Premium) that the Bidder is willing and able to pay. Since other Bidders (by mail, facsimile, online, and in person) will be present, and since a reoffering could damage the momentum of the sale, once the hammer has fallen and RR Auction has announced the winning Bidder, such Bidder is uncondition ally bound to pay for the lot, even if the Bidder has made a mistake.

4.3 All prospective Bidders who examine lots in person prior to the sale shall personally assume all responsibility for any damage they cause in so doing. RR Auction shall have sole discretion in determining the value of the damage caused, which shall be promptly paid by the prospective Bidder.

4.4 Title to any lot remains with Consignor, any secured party of the Consignor, or assignee of Consignor, as the case may be, until the lot is paid for in full by Bidder and Bidder has fully satisfied any outstanding financial obligations to RR Auction (including as it concerns aby other lots). RR Auction reserves the right to require payment in full before delivering any lot to the successful Bidder.

4.5 It is the Bidder’s responsibility and obligation to have the lots fully insured while in their possession. Bidder assumes any and all risk of loss upon the earlier of shipment to Bidder or in Bidder’s possession.

4.6 Bidder grants to RR Auction or its assigns the right to offset any sums due, or found to be due by RR Auction, and to make such offset from any past, sub sequent or future consignment, or items acquired by Bidder in possession or control of RR Auction or from any sums due to Bidder by RR Auction. Bidder fur

ther grants RR Auction a lien consisting of a senior security interest (or purchase money security interest to the extent applicable) in such sums or items to the fullest extent applicable, authorizes RR Auction to file documents concerning the interest, and Bidder agrees to execute any further documents as may be reason ably necessary to grant RR Auction such security interest. Bidder agrees that RR Auction and its assigns shall be a secured party with respect to items bought by Bidder and in the possession of RR Auction, to the extent of the maximum in debtedness, plus all accrued fees and expenses, until the indebtedness is paid.

4.7 By bidding in this sale, Bidder personally and unconditionally guarantees payment. The authorized representative of any corporate Bidder who is present at the sale shall provide RR Auction or its agent, prior to the commencement of the bidding (or at the time of registration), with a statement signed by a principal, director or officer that they he or she personally and unconditionally guarantees any payment due RR Auction.

4.8 RR Auction may at its sole and absolute discretion, make loans or advances to Consignors and/or prospective Bidders.

Section 5

Bidding Options

5.1 Non-Internet bids (including but not limited to in-person, facsimile, phone and mail bids) are treated similarly to floor bids in that they must be on-incre ment. Any in-person, facsimile, phone, or mail bids that do not conform to a full increment will be rounded up or down to the nearest full increment and this revised amount will be considered Bidder’s high bid.

5.2 When identical bids are submitted, preference is given to the first received. To ensure the greatest accuracy, written bids should be entered on the standard printed bid sheet and be received at RR Auction’s place of business at least twenty-four (24) hours before the Auction start. RR Auction is not responsible for executing mail bids or facsimile bids received on or after the day the first lot is sold, nor Internet bids submitted after the published closing time; nor is RR Auction responsible for proper execution of bids submitted by telephone, mail, facsimile, e-mail, Internet, or in person once the Auction begins.

5.3 In all Auctions, bids on an item must raise the current high bid by at least 10%, or as specified on a per-Auction basis. Bids will be accepted in whole dol lar amounts only. No “buy” or “unlimited” bids will be accepted. In a live sale, bids on an item can change at the discretion of RR Auction.

5.4 RR Auction reserves the right to accept or decline any bid. Bids must be for an entire lot and each lot constitutes a separate sale. All bids are per lot unless otherwise announced. Live auction lots will be sold in their numbered sequence unless RR Auction directs otherwise. It is unlawful and illegal for Bidders to collude, pool, or agree with another Bidder to pay less than the fair value for lot(s). For live auctions, RR Auction will have final discretion in the event that any dispute should arise between Bidders. RR Auction will determine the successful Bidder, cancel the sale, or re-offer and resell the lot or lots in dispute. RR Auc tion will have final discretion to resolve any disputes arising after the sale and in online auctions. If any dispute arises, RR Auction’s sale record is conclusive.

Section 6 Payment

6.1 Subject to fulfillment of all of the Conditions of Sale set forth herein, upon the sooner of (1) the passing of title to the offered lot pursuant to these Conditions of Sale, or (2) possession of the offered lot by the Bidder, Bidder thereupon (a) assumes full risk and responsibility (including without limitation, liability for or damage to frames or glass covering prints, paintings, photos, or other works), and (b) will immediately pay the full purchase price or such part as RR Auction may require. In addition to other remedies available to RR Auction by law, RR Auction reserves the right to impose from the date of sale a late charge of 1.5% per month of the total purchase price if payment is not made in accordance with the conditions set forth herein. All property must be removed from RR Auction’s premises by the Bidder at his/her expense not later than sixty (60) business days following its sale and, if it is not so removed, RR Auction may send the purchased property to a public warehouse for the account, at the risk and ex pense of the Bidder.

6.2 Payment is due upon closing of the Auction session, or upon presentment of an invoice. RR Auction reserves the right to void an invoice if payment in full is not received within thirteen (13) calendar days of the Auction or within twelve (12) calendar days of the invoice date. In cases of nonpayment, RR Auction’s election to void a sale does not relieve the Bidder from their obligation to pay RR Auction its fees (seller’s and Buyer’s Premium) on the lot and any other dam ages pertaining to the lot.

6.3 All sales for total invoices greater than $1,000 are strictly for cash in United States dollars (including U.S. currency, bank wire, cashier checks, eChecks, and bank money orders), and are subject to all reporting requirements.

6.4 All deliveries are subject to good funds; funds being received in RR Auc tion’s account before delivery of the Purchases; and all payments are subject to a clearing period. RR Auction reserves the right to determine if a check con stitutes “good funds”: checks drawn on a U.S. bank are subject to a ten (10) calendar day hold, and ten (10) business days when drawn on an international bank. Clients with pre-arranged credit status may receive immediate credit for payments via e-Check, personal or corporate checks.

6.5 In the event that a Bidder’s payment is dishonored upon presentment(s), Bidder shall pay the maximum statutory processing fee set by applicable state law. If Bidder attempts to pay via check and the financial institution denies the transfer from Bidder’s bank account, or the payment cannot be completed using the selected funding source, Bidder agrees to complete payment.

6.7 If RR Auction refers any unpaid invoice to an attorney for collection, the Bidder agrees to pay and shall be liable for RR Auction’s attorney’s fees, court costs, and other collection costs incurred by RR Auction in addition to the invoice amount and interest the greater of 1.5% per month or at the maximum legally allowable rate from date of invoice to collection. If RR Auction assigns collec tion to its house counsel, such attorney’s time expended on the matter shall be compensated at a rate comparable to the hourly rate of independent attorneys.

6.8 RR Auction shall have a lien against the merchandise purchased by the Bid der (as well as to the extent it is a consignor any other monies owed or due to Bidder) to secure payment of the Auction invoice. RR Auction is further granted a lien and the right to retain possession of any other property of the Bidder then held by RR Auction or its affiliates to secure payment of any Auction invoice or any other amounts due RR Auction or affiliates from the Bidder. With respect to these lien rights, RR Auction shall have all the rights of a secured creditor, in cluding but not limited to the right of sale. In addition, with respect to payment of the Auction invoice(s), the Bidder waives any and all rights of offset he might oth erwise have against RR Auction and the consignor of the merchandise included on the invoice (the Consignor”). If a Bidder owes RR Auction or its affiliates on any account, RR Auction and its affiliates shall have the right to offset such unpaid account by any credit balance due Bidder, and it may secure by posses sory lien any unpaid amount by any of the Bidder’s property in their possession.

6.9 All checks, cashiers checks, bank checks, or money orders are payable to R&R Auction Company of Massachusetts, LLC. RR Auction clients with an in voice totaling $1,000 or under will have the option to pay by VISA, Mastercard, Discover or Paypal. All Paypal payments must be sent to FinanceDepartment@ rrauction.com. Authorize.net, a third-party service provider contracted by RR Auction for processing on-line payments, charges a nonrefundable service fee of 3%, which will be added to your final invoice should you pay by credit/debit card.

Section 7 Sales Tax

RR Auction is a remote seller and we are now required to collect Sales/Use Tax from our bidders. The states that we have nexus in we will be required to col lect and remit sales tax on your behalf. Each state has different requirements to meet nexus. When RR Auction has achieved a certain monetary and/or invoice threshold in each state we will apply sales tax to your total invoice. If we have not achieved nexus in a particular state it is still your responsibility to pay sales tax on your purchases.

The sales tax rate is determined by the State, Country, and City where purchas es are shipped to. If you decide to pick up your purchases at our New Hampshire location you will not be required to pay sales tax. The State of New Hampshire does not have a general sales and use tax. All purchases picked up at our Mas sachusetts location will be taxed at the current rate of 6.25%.

Section 8 Delivery; Shipping; and Handling Charges

Bidder is liable for shipping and handling and providing accurate information as to shipping or delivery locations and arranging for such. RR Auction is unable to combine purchases from other auctions or affiliates into one package for ship ping purposes. Lots won will be shipped in a commercially reasonable time after payment in good funds for the merchandise and the shipping fees is received or credit extended, except when third-party shipment occurs. Bidder agrees that

service and handling charges related to shipping items which are not pre-paid may be charged to a credit card on file with RR Auction.

Successful international Bidders shall provide written shipping instructions, in cluding specified Customs declarations, to RR Auction for any lots to be deliv ered outside of the United States. NOTE: Declaration value shall be the item’(s) hammer price and RR Auction shall use the correct harmonized code for the lot. Domestic Bidders on lots designated for third-party shipment must designate the common carrier, accept risk of loss, and prepay shipping costs.

Section 9 Title

Title shall not pass to the successful Bidder until all invoices of Bidder (including those pertaining to the item(s) at issue) and amounts owed to RR Auction are paid in full. It is the responsibility of the Bidder to provide adequate insurance coverage for the items once they have been delivered to a common carrier or third-party shipper.

Section 10 Rights Reserved

RR Auction reserves the right, at any time before, during or after an auction has ended to: withdraw any lot before or at the time of the Auction, cancel any bid, and/or to postpone the Auction of all or any lots or parts thereof, for any reason. RR Auction shall not be liable to any Bidder in the event of such withdrawal, cancellation, or postponement under any circumstances. RR Auction reserves the right to refuse to accept bids from anyone at any time.

Section 11

Conducting the Auction

11.1 RR Auction reserves the right to postpone the Auction or any session there of for a reasonable period of time for any reason whatsoever, and no Bidder or prospective Bidder shall have any claim as a result thereof, including conse quential damages.

11.2 RR Auction’s Discretion: RR Auction shall determine opening bids and bid ding increments. RR Auction has the right in its absolute discretion to reject any bid in the event of dispute between Bidders or if RR Auction has doubt as to the validity of any bid, to advance the bidding at its absolute discretion and to determine the successful Bidder in the event of a dispute between Bidders, to continue the bidding or to reoffer and resell the lot in question. In the event of a dispute after the sale, RR Auctions record of final sale shall be conclusive.

RR Auction also may reject any bid if RR Auction decides either that any bid is below the reserve of the lot or article or that an advance is insufficient. Unless otherwise announced by RR Auction at the time of sale, no lots may be divided for the purpose of sale.

11.3 Reserves

Lots may be subject to a reserve which is the confidential minimum price below which the lot will not be sold. Consignors may not bid on their own lots or prop erty. RR Auction may, from time to time, bid on items that it does not own. RR Auction may execute bids consecutively or otherwise up to one bid increment below the reserve.

11.4 Off-Site Bidding

Bidding by telephone, facsimile, online, or absentee bidding (advance written bids submitted by mail) are offered solely as a convenience and permitted sub ject to advance arrangements, availability, and RR Auction’s approval which shall be exercised at RR Auction’s sole discretion. Neither RR Auction nor its agents or employees shall be held liable for the failure to execute bids or for er rors relating to any transmission or execution thereof. In order to be considered for off-site bidding in any manner, Bidders must comply with all of these Condi tions of Sale and the terms contained on the Registration Form.

11.5 Estimate Prices:

In addition to descriptive information, each item in the Catalog sometimes in cludes a price range which reflects opinion as to the price expected at auction (the “Estimate Prices”). In other instances, Estimate Prices can be obtained by calling RR Auction at (603) 732-4280. The Estimate Prices are based upon various factors including prices recently paid at auction for comparable property, condition, rarity, quality, history and provenance. Estimate Prices are prepared well in advance of the sale and subject to revision. Estimates do not include the Buyer’s Premium or sales tax (see under separate heading).

11.6 Owned or Guaranteed Property:

RR Auction generally offers property consigned by others for sale at public auc tion; in very limited occasion, lots are offered that are the property of RR Auction.

11.7 Before the Auction:

Bidder may attend pre-sale viewing for all of RR Auction’s auctions at no charge. All property to be auctioned is usually on view for several days prior to the sale. Bidder is encouraged to examine lots thoroughly. Bidder may also request con dition reports (see below). RR Auction’s staff are available at viewings and by appointment.

11.8 Maximum Bids In All Auctions:

To maximize Bidder’s chance of winning, RR Auction strongly encourages the use of maximum bids. RR Auction will then bid for Bidder until the lot reaches Bidder’s specified maximum. Maximum bids are strictly confidential. Placing ar bitrary, non-incremental bids on lots with prior maximum bids may result in these lots being sold for less than 10% above the under Bidder’s bid.

11.9 Successful Bids:

The fall of RR Auction’s hammer indicates the final bid. RR Auction will record the paddle number of the Bidder. If Bidder’s salesroom or absentee bid is suc cessful, Bidder will be notified after the sale by mailed or emailed invoice.

11.10 Unsold Lots:

If a lot does not reach the reserve, it is bought-in. In other words, it remains unsold and is returned to the Consignor. RR Auction has the right to sell certain unsold items after the close of the Auction. Such lots shall be considered sold during the Auction and all these Terms and Conditions shall apply to such sales including but not limited to the Buyer’s Premium, return rights, and disclaimers.

11.11 Bidding in Timed Auction:

Bidder may open, monitor, and/or raise bids at any time before the close of a lot through www.rrauction.com. RR Auction offers a callback service the day of the Auction, but Bidder is responsible for supplying a correct telephone number(s) where Bidder can be reached until the Auction closes. Bidder must request this service in writing. RR Auction will make reasonable efforts to ensure that Bidders who request a callback are contacted if outbid; however, RR Auction does not guarantee this service and it is merely a courtesy and not an enforceable right. The auctioneer may also execute a bid on behalf of the consignor to protect the reserve, either by entering a bid in response to salesroom, telephone or absen tee bids. Under no circumstances will the auctioneer place any bid on behalf of the consignor above the reserve. The auctioneer will not specifically identify bids placed on behalf of the consignor to protect the reserve.

To ensure proper registration, those Bidders intending to bid via the Internet must visit www.RRauction.com and register accordingly at least one full day prior to the actual auction. Winning bidders will be notified by RR Auction. RR Auction is not responsible or liable for any problems, delays, or any other issues or problems resulting out of use of the Internet generally or specifically, including but not limited to transmission, execution or processing of bids.

Any Bidder may bid on any lot prior to 6 pm EST/EDT. At that time, an extended bidding period goes into effect. If Bidder has not bid on a lot before 6 pm EST/ EDT, Bidder may not bid on that lot after 6 pm EST/EDT. Only those Bidders who have placed bids on a lot before 6 pm EST/EDT will be allowed to bid on that lot after 6 pm EST/EDT. If Bidder is the only Bidder on a lot at 6 pm EST/ EDT, that lot is awarded to Bidder. During the extended bidding period, a lot will remain open only to those who bid on that lot prior to 6 pm EST/EDT. All lots WITHOUT an opening bid at 6 pm EST/EDT will remain OPEN to ALL Bidders until 7 pm EST/EDT or until they receive their first bid. These lots will close immediately upon receipt of a bid or at 7 pm EST/EDT, whichever comes first. For all lots that are active after 7 pm EST/EDT, bidding will remain open until 30 minutes pass without a bid being placed on THAT lot (the “30 Minute Rule”). The 30 Minute Rule is applied on a PER LOT BASIS; each lot in the Auction closes individually based on bidding activity after 7 pm EST/EDT. On a PER LOT BASIS, the 30 minute timer will reset each time a bid is placed after 7 pm EST/EDT. If Bidder is the high Bidder, raising Bidder’s maximum bid will NOT reset the timer. RR Auction reserves the right to close the Auction at any time at its sole discretion.

11.12 Bidding - Internet Live Auction:

During live internet or live auction, property is auctioned in consecutive numeri cal order, as it appears in the catalog. The auctioneer will accept bids from those present in the salesroom or absentee bidders participating by telephone,

internet or by written bid left with RR Auction in advance of the auction. The auctioneer may also execute a bid or bids (successively or otherwise) on behalf of the consignor to protect the reserve, either by entering a bid in response to salesroom, telephone or absentee bids. Under no circumstances will the auctioneer place any bid on behalf of the consignor above the reserve. The auctioneer will not specifically identify bids placed on behalf of the consignor to protect the reserve. All auctions for lots are with reserve unless specifically stated otherwise.

During live Auctions, internet bids can be placed in real time through one or more of the following Third Party services: www.liveauctioneers.com, www.invaluable. com and www.icollector.com. RR Auction is not responsible or liable for any problems, delays, or any other issues or problems resulting out of use of the Internet generally or specifically, including but not limited to transmission, execu tion or processing of bids. RR Auction treats any third-party site bids as floor or telephone bids. Floor bids and telephone bids are always considered first over third party sites bids, and floor bids are considered earlier than telephone bids. All RR Auction lots purchased through the third-party sites carry an additional Buyer’s Premium.

11.13 Miscellaneous:

Agreements between Bidders and Consignors to effectuate a non-sale of an item at Auction, inhibit bidding on a consigned item to enter into a private sale agreement for said item, or to utilize RR Auction’s Auction to obtain sales for non-selling consigned items subsequent to the Auction, are strictly prohibited. If a subsequent sale of a previously consigned item occurs in violation of this provision, RR Auction reserves the right to charge Bidder the applicable Buyer’s Premium and Consignor a Seller’s Commission as determined for each auction venue and by the terms of the seller’s agreement.

Acceptance of these Terms and Conditions qualifies Bidder as a client who has consented to be contacted by RR Auction in the future. In conformity with ”donot-call” regulations promulgated by the Federal or State regulatory agencies, participation by the Bidder is affirmative consent to being contacted at the phone number shown in his application and this consent shall remain in effect until it is revoked in writing. RR Auction may from time to time contact Bidder concerning sale, purchase, and auction opportunities available.

11.14 Rules of Construction: RR Auction presents properties in a number of collectible fields, and as such, specific venues have promulgated supplemental Terms and Conditions. Nothing herein shall be construed to waive the general Conditions of Sale by these additional rules and shall be construed to give force and effect to the rules in their entirety.

Section 12

RR Auction’s Remedies

Failure of the Bidder to comply with any of these Conditions of Sale or the terms of the Registration Form is an event of material breach or default. In such event, RR Auction may, in addition to any other available remedies specifically including the right to hold the defaulting Bidder liable for the Purchase Price or to charge and collect from the defaulting Bidder’s credit or debit accounts as provided for elsewhere herein: (a) cancel the sale, retaining any payment made by the Bidder as damages (the Bidder understands and acknowledges that RR Auction will be substantially damaged should such default occur, and that damages under subpart (a) are necessary to compensate RR Auction for such damages); (b) resell the property without reserve at public auction or privately; (c) charge the Bidder interest on the Purchase Price at the rate of one and one-half percent (1.5%) per month or the highest allowable interest rate; (d) take any other action that RR Auction, in its sole discretion, deems necessary or appropriate to preserve and protect RR Auction’s rights and remedies. Should RR Auction resell the property, the original defaulting Bidder shall be liable for the payment of any deficiency in the purchase price and all costs and expenses associated there with, including but not limited to warehousing, sales-related expenses, reason able attorney fees and court costs, commissions, incidental damages and any other charges due hereunder which were not collected or collectable. In the event that such Bidder is the successful Bidder on more than one lot and pays less than the purchase price for the total lots purchased, RR Auction shall apply the payment received to such lot or lots that RR Auction, in its sole discretion, deems appropriate. If RR Auction does not exercise such discretion, the lots to which the payment shall be applied will be in descending order from the highest purchase price to the lowest. Any Bidder failing to comply with these Conditions of Sale shall be deemed to have granted RR Auction a security interest in, and RR Auction may retain as collateral such security for such Bidder’s obligations to RR Auction, any Bidder’s property in RR Auction’s possession or to which title has not yet passed to Bidder. RR Auction shall have the benefit of all rights of a secured party under the Uniform Commercial Code (U.C.C.) as adopted by the Commonwealth of Massachusetts.

13.1 RR Auction does not provide any warranties to Bidders, whether expressed or implied, beyond those expressly provided in these Conditions of Sale. All property and lots are sold ”as is” and “where is”. By way of illustration rather than limitation, neither RR Auction nor the Consignor makes any representa tion or warranty, expressed or implied, as to merchantability or fitness for in tended use, condition of the property (including any condition report), correct ness of description, origin, measurement, quality, rarity, importance, exhibition, relevance, attribution, source, provenance, date, authorship, condition, culture, genuineness, value, or period of the property. Additionally, neither RR Auction nor the Consignor makes any representation or warranty, expressed or implied, as to whether the Bidder acquires rights in copyright, trademark, or other intel lectual property (including exhibition or reproduction rights) related to the item, or whether the property is subject to any limitations or other rights. RR Auction does not make any representation or warranty as to title.

13.2 All descriptions, photographs, illustrations, and terminology including but not limited to words describing condition (including any condition reports re quested by Bidder, see also Terminology), authorship, period, culture, source, origin, measurement, quality, rarity, provenance, importance, exhibition, and rel evance, used in the Catalog, bill of sale, invoice, or anywhere else, represent a good faith effort made by RR Auction to fairly represent the lots and property offered for sale as to origin, date, condition, and other information contained therein; they are statements of opinion only. They are not representations or warranties and Bidder agrees and acknowledges that he or she shall not rely on them in determining whether or not to bid or for what price. Price estimates (which are determined well in advance of the Auction and are therefore subject to revision) and condition reports are provided solely as a convenience to Bid ders and are not intended nor shall they be relied on by Bidders as statements, representations or warranties of actual value or predictions of final bid prices.

13.3 Bidders are accorded the opportunity to inspect the lots and to otherwise satisfy themselves as to the nature and sufficiency of each lot prior to bidding, and RR Auction urges Bidders to avail themselves accordingly.

13.4 All lots sold by RR Auction are accompanied by an Auction Certificate (“AC”). On any lot presented with an AC issued by RR Auction, the certifica tion is only as to its attribution to the person or entity described or to the lot’s usage and only as explicitly stated therein (the “AC”), to the exclusion of any other warranties, express or implied, including but not limited to those pursuant to the Uniform Commercial Code. The AC inures only to the original Bidder (as shown in RR Auction’s records). Bidder may not transfer, assign, or otherwise convey the AC and such purported transfer, assignment, or conveyance shall be null and void.

Section 14 Firearms

RR Auction complies with all Federal and State rules and regulations relating to the purchasing, registration and shipping of firearms. A Bidder is required to provide appropriate documents and the payment of associated fees, if any. Bidder is responsible for providing a shipping address that is suitable for the receipt of a firearm.

Section 15

Unauthorized Statements

Under no circumstances is any employee, agent or representative of RR Auction authorized by RR Auction to modify, amend, waive or contradict any of these Conditions of Sale, any term or condition set forth on a registration form, any warranty or limitation or exclusion of warranty, any term or condition in either the Registration Form or these Terms and Conditions regarding payment re quirements, including but not limited to due date, manner of payment, and what constitutes payment in full, or any other term or condition contained in any docu ments issued by RR Auction unless such modification, amendment, waiver or contradiction is contained in a writing signed by all parties. Any statements, oral or written, made by employees, agents or representatives of RR Auction to Bid der, including statements regarding specific lots, even if such employee, agent or representative represents that such statement is authorized, unless reduced to a writing signed Bidder and by an authorized officer of RR Auction by all par ties, are statements of personal opinion only and are not binding on RR Auction, and under no circumstances shall be relied upon by Bidder as a statement, representation or warranty of RR Auction.

Section 16 Bidder’s Remedies

16.1 Except as stated expressly herein, Bidder’s sole and exclusive remedy related to or pertaining to items it bids upon, views, or purchases from RR Auc tion, and any claims by Bidder related to authenticity, ownership, condition, title or value, shall be against Consignor only.

16.2 This section sets forth the sole and exclusive remedies of Bidder as against

RR Auction (inclusive of its affiliates, officers, managers, employees or agents), or in any way arising out of, related to, or in connection with these Conditions of Sale, , and is expressly in lieu of any other rights or remedies which might be available to Bidder by law. Time is of the essence with respect to these procedures.

16.3 Title to Items

The Bidder hereby accepts the benefit of the Consignor’s warranty of title and any other representations and warranties made by the Consignor for the Bid der’s benefit. In the event that Bidder demonstrates in writing, satisfactory to the sole discretion of RR Auction, that there was a breach of the Consignor’s warranty of title concerning a lot purchased by Bidder, RR Auction may make demand upon the Consignor to pay to Bidder the Purchase Price (including any premiums, taxes, or other amounts paid or due to RR Auction). Should the Consignor not pay the Purchase Price to Bidder within thirty days after such demand (if any made), RR Auction may disclose the identity of the Consignor to Bidder and may assign to Bidder all or some of RR Auction’s rights against the Consignor with respect to such lot or property. Upon such disclosure and/or assignment, all responsibility and liability of RR Auction, if any, with respect to said lot or item shall automatically terminate related to or arising from these Con ditions of Sale or such transaction operating as a complete waiver and general release by Bidder as to RR Auction and its agents, contractors, and affiliates, as to any and all claims concerning or related to the item, if any . RR Auction shall be entitled to retain the premiums and other amounts paid to RR Auction by Consignor only. The rights and remedies provided herein are for the original Bidder only and they may not be assigned or relied upon by any transferee or assignee under any circumstances.

16.4 Authenticity Challenge Process

(1) If Bidder wishes to dispute or challenge the Authenticity of the lot or item (in cluding asserting that it is incorrect), Bidder must adhere to the following proce dure: Within 30 days of the Auction Date, Bidder must present written evidence to RR Auction, that the lot is not authentic as determined by a known expert in the field (and one recognized by RR Auction within its discretion) and send the physical item or lot at issue to RR Auction along with all evidence relied upon by Bidder for contesting the Authenticity. (“Authenticity Challenge Process”) “Au thenticity” shall mean a gross discrepancy in the between the description, genu iness, or attribution of the item as represented by RR Auction in the Catalog or at the auction, and the item. If RR Auction concurs that the lot is not Authentic as was represented (it is sole discretion), Bidder’s sole and exclusive remedy as against RR Auction (inclusive of its affiliates, agents, employees, and contrac tors) shall be a refund of the purchase price of the subject item paid by Bidder, with no other costs, liabilities or amounts recoverable by Bidder. If RR Auction does not agree with the assertion by Bidder, then the Parties shall follow the dispute resolution procedures of these Conditions of Sale. Strict adherence to the Authenticity Challenge Process is a condition of standing for Bidder to initi ate suit or claim.

(2) So long as Bidder has complied with the Authenticity Challenge Process, any claim, suit or action, by Bidder concerning an AC or Certification of Authenticity, or related to the authenticity of the item must, without any exception, be brought within one (1) year of Auction Date and is subject to the other limitations and conditions stated in the Conditions of Sale.

16.5 Other Issues. Any dispute or claim by Bidder against RR Auction (or its affiliates, directors, employees, officers, agents, or contractors)) other than Au thenticity, concerning any item or lot bid upon, or purchased, including value, title, condition, bidding process, or description must be asserted (if at all) in the following manner:

(1) If the description of any lot in the Catalog is materially or grossly incorrect (e.g., gross cataloging error), or there is any other gross material issue pertain ing to the item or lot, the item or lot may be returned if returned within five (5) calendar days of receipt, and received by RR Auction no later than twenty-one (21) calendar days after the Auction Date with explanation in writing.. If there is any discrepancy between the description in the Catalog and a certificate of auc tion, then the description in the certificate of auction (“Lot Challenge Process”). This paragraph shall constitute Bidder’s sole right with respect to the return of items, and no refunds shall be given for any items not returned to and received by RR Auction within the period of time stated herein or not materially or grossly in deviation from the description. Such a refund is subject to RR Auction’s sole discretionary review, and any request for refund must be made concurrently with returning the physical item or lot to RR Auction. Any item not returned within said frame will constitute acceptance of the item and a waiver and release of any and all claims by Bidder pertaining to the item other than with respect to authenticity; and

(2) Provided that the Bidder has engaged in the Lot Challenge Process, any

claim concerning such must be brought no later than one (1) year of the Auction Date for the item or lot at issue and is subject to the other limitations and condi tions stated in the Conditions of Sale.

NO RETURN OR REFUND OF ANY AUCTION LOT WILL BE CONSIDERED OR PROVIDED EXCEPT AS PROVIDED IN THESE CONDITIONS OF SALE AND BIDDERS OR AS MAY BE REQUIRED BY LAW. FAILURE TO COMPLY WITH SUCH SHALL BE A COMPLETE DEFENSE TO ANY CLAIMS BY BID DER RELATED TO THE CONDITIONS OF SALE, ANY AUCTION OR BID.

16.6 LIMITATION OF LIABILITY. For any and all claims by Bidder arising out of or related to this Agreement, Bidder’s viewing, bid, or purchase of items, or any agreement between the Parties, or otherwise, Bidder agrees that to the fullest extent such can be limited under the law, Bidder shall have no right to recover and hereby waives any and all rights to recover from against RR Auction or its affiliates, directors, employees, officers, agents, or contractors, consequential or indirect damages, lost profits damages, punitive, exemplary, statutory (or mul tiplier damages), physical or emotional distress damages, general or special damages of any kind (beyond amounts actually paid by Bidder for item(s) at issue), and in the event of recovery of any damages whatsoever, such shall be limited by the amounts actually paid by Bidder to RR Auction for the item(s) at issue in such claim, or if no money was paid to RR Auction by Bidder for items at issue, or there items are at issue, the amount of $150.00.

Section 17

RR Auction’s Additional Services

For Bidders who do not remove purchased property from RR Auction’s premis es, RR Auction, in its sole discretion and solely as a service and accommodation to Bidders, may arrange to have purchased lots packed, insured and forwarded at the sole request, expense, and risk of Bidder. RR Auction assumes no and disclaims all responsibility and liability for acts or omissions in such packing or shipping by RR Auction or other packers and carriers, whether or not recom mended by RR Auction. RR Auction assumes no and disclaims all responsibility and liability for damage to frames, glass or other breakable items. Where RR Auction arranges and bills for such services via invoice, RR Auction will include an administration charge.

Section 18

Headings

Headings are for convenience only and shall not be used to interpret the sub stantive sections to which they refer.

Section 19

Entire Agreement

Except to the extent Bidder is also a consignor (in which case the terms of the consignment agreement shall also govern), these Conditions of Sale constitute the entire agreement between the Parties together with the terms and conditions contained in the auction Registration Form. They may not be amended, modi fied or superseded except in a signed writing executed by all parties. No oral or written statement by anyone employed by RR Auction or acting as agent or representative of RR Auction may amend, modify, waive or supersede the terms herein unless such amendment, waiver or modification is contained in a writing signed by all parties.

If any section of these Conditions of Sale or any term or provision of any section is held to be invalid, void, or unenforceable by any court or arbitrator of com petent jurisdiction, the remaining parts of the agreement and remainder of the sections or terms and provisions of the section and all sections shall continue in full force and effect without being impaired or invalidated in any way.

Section 20

Governing Law and Enforcement

20.1 The Parties agree that all agreements between the Parties including but not limited to these Conditions of Sale are entered into in Boston, Massachusetts, no matter where Bidder is situated and no matter by what means or where Bid der was informed of the Auction and regardless of whether catalogs, materials, or other communications were received by Bidder in another location.

20.2 The Parties agree that these Conditions of Sale, any other related agreement(s), along with all claims between the Parties, including those arising out of or related to such are governed by the laws of the Commonwealth of Mas sachusetts, without regard for its conflict of laws principles. The Parties agree that any dispute between the Parties, including but not limited to those related to or arising out of these Conditions of Sale, or related to or arising out of any other related agreement(s) shall be submitted to confidential binding arbitration (the ”Arbitration”) before a single Arbitrator of the American Arbitration Association

(the “AAA”) The Parties agree that the Arbitration shall be conducted pursuant to the commercial rules of the AAA in Boston, Massachusetts, unless the Con sumer Arbitration Rules apply, in which case, such rules and venue will govern. In the event that the Parties cannot agree on the selection of the Arbitrator, then the Arbitrator shall be selected by the AAA. The prevailing Party in the Arbitra tion shall also recover all of its related fees and costs, whether before or after the formal institution of the Arbitration, including but not limited to its reasonable attorneys’ fees and costs, if RR Auction prevails, such recovery, in addition to all remedies available at agreement or law, shall include the Buyer’s Premium as defined in these Conditions of Sale. Federal arbitration law, including the Fed eral Arbitration Act apply to this agreement to arbitrate and its related provisions. The arbitration and all related proceedings shall be held strictly confidential and all documents and discovery shall be held confidential and not used, published or disclosed publically or to anyone outside the Parties or expert consultants or counsel who shall agree to hold such confidential.

20.3 The Parties consent to the Commonwealth of Massachusetts as exclusive jurisdiction and venue for all claims between the Parties except as provided specifically herein and may seek confirmation of the decision in the Arbitration pursuant to the Federal Arbitration Act in any Court of competent jurisdiction, in cluding the courts of the Commonwealth of Massachusetts or the United States District Court for the District of Massachusetts. To the extent such is necessary under the law, RR Auction may enforce the Arbitration award against Bidder and any related Party in any court of competent jurisdiction. Nothing in this Agree ment shall be construed as RR Auction consenting to jurisdiction or venue in any location outside of the Commonwealth of Massachusetts.

THE PARTIES MAY NOT BRING CLAIMS AGAINST EACH OTHER AS A CLASS OR CLASS MEMBER IN ANY CLAIMED CLASS, OR IN A REPRE SENTATIVE ACTION UNLESS OTHERWISE AGREED. UNLESS OTHERWISE AGREED, THE CLAIMS AGAINST EACH OF THE OTHER CANNOT BE CON SOLIDATED OR JOINED WITH MORE THAN ONE ADDITIONAL PERSON OR ENTITIES’ CLAIMS. NO INJUNCTIVE OR DECLATORY RELIEF SOUGHT BY BIDDER IF ANY, CAN AFFECT OR BE ORDERED TO AFFECT ANY OTHER BIDDERS OR PERSONS.

20.4 Except as provided specifically in these Conditions of Sale in Bidder’s Rem edies against RR Auction (along with its affiliates, directors, agents, officers, employees, and contractors) for any dispute, claim, cause of action related to or arising out of these Conditions of Sale or any other related agreement(s), brought by Bidder must be brought within the earlier of the Auction Date as it pertains to the item(s) at issue or no later than one (1) year of the acts, omissions or circumstances occurred giving rise to the alleged claim, without exception. This provision is intended as a full, complete and absolute bar to and release of any claims by Bidder initiated after one (1) year of such acts, omissions or cir cumstances. The Parties agree further that these waiver provisions are intended to be binding in the event of any dispute, specifically including but not limited to third party claims and cross-actions brought by Bidder. These provisions are consideration for the execution of these Conditions of Sale.

20.5 To the fullest extent under applicable law and except as specifically stated herein Bidder hereby holds harmless, releases and discharges RR Auction and its agents, officer’s directors, affiliates, successors, and assigns from any and all claims, liabilities, obligations, promises, agreements, damages, causes of ac tion, suits, demands, losses, debts, and expenses of any nature whatsoever, known or unknown, suspected or unsuspected existing prior to these Conditions of Sale. Bidder agrees to the Conditions of Sale and upon each instance that Bidder participates in any auction, bids, or otherwise agrees to such terms and reaffirms this release as of the date of so participating or agreeing unless Bidder otherwise provides clear written notice to RR Auction prior to so bidding.

20.6 The Bidder hereby agrees that RR Auction shall be entitled to present these Conditions of Sale to a court in any jurisdiction other than set forth in this para graph as conclusive evidence of the Parties agreement, and the Parties further agree that the court shall immediately dismiss any action filed in such jurisdic tion.

20.7 Liquidated Damages for Specific Breaches

In the event that Bidder provides false information in connection with registering for bidding, fails to correct or update information or breaches the Conditions of Sale by failing to pay the purchase price when due after becoming the winning bidder, as liquidated damages associated with such breaches, R&R may obtain from Bidder the greater of (1) 150% the reserve of the item (if any); (2) the amount bidder bid; or (3), the full amount that bidder would have otherwise paid. Bidder will also be liable for an additional 20% of such amount to account for additional administrative costs, shipping, additional advertising, and other dam ages and liabilities fees that are difficult to calculate on an item-by-item basis.

20.8 Indemnity. Bidder agrees to defend, indemnify, hold harmless RR Auction

(along with its officers, directors, agents, contractors, and affiliates) from and against any and all claims, costs, fees, damages, and liabilities arising out of or related to these Conditions of Sale, view of items, or lots, bidding, or participa tion in any auction by RR Auction, and/or or in any way connected to any item you viewed, bid upon or purchased through RR Auction.

Section 21: State-by-State Law Issues

This Auction is being conducted in and the sale shall take place in the State of Massachusetts. Notwithstanding, the foregoing, should these terms and condi tions violate the law of any State should that state’s law be found to govern, or any provision herein determined to be invalid, the clause itself and the remainder of the Agreement shall be valid to the fullest extent allowed. Also, to the extent other states law apply to any transaction arising out of the Agreement (without admitting such), RR Auction states:

For Residents of California:

SALE OF AUTOGRAPHED COLLECTIBLES: AS REQUIRED BY LAW, A DEALER WHO SELLS TO A CONSUMER ANY COLLECTIBLE DESCRIBED AS BEING AUTOGRAPHED MUST PROVIDE A WRITTEN EXPRESS WAR RANTY AT THE TIME OF SALE. THIS DEALER MAY BE SURETY BONDED OR OTHERWISE INSURED TO ENSURE THE AUTHENTICITY OF ANY AU TOGRAPHED COLLECTIBLE SOLD BY THIS DEALER.

A written express warranty is provided with each autographed collectible, as re quired by law. This dealer may be surety bonded or otherwise insured to ensure the authenticity of any autographed collectible sold by this dealer.

Section 22 Glossary of Condition terms

Information provided to prospective Bidders with respect of any lot, including any pre-sale estimate, whether written or oral, and information in any catalogue, condition or other report, commentary or valuation, is not a representation of fact but rather a statement of opinion held by RR Auction.

Use of the following terms constitutes an opinion as follows:

VERY FINE describes an item believed to be in virtually flawless condition, and is used sparingly for items of exceptionally attractive appearance.

FINE is the most common statement of condition, and applies to most items that we offer. It describes items that we believe to show expected handling wear, generally acceptable random flaws (such as light creases, small bends, etc.), and an overall appearance that is pleasing to the majority of collectors.

VERY GOOD describes an item that we believe exhibits more moderate flaws (such as toning, light staining, professional reinforcements or repairs, etc.). Most collectors would be comfortable with items in very good condition, and this would be the expected condition for many formats (early presidential documents, for example).

GOOD describes an item which we believe to have obvious visible flaws, includ ing heavy wear, missing portions, or repairs that affect appearance; generally items in this condition are offered only if an item is otherwise believed to be exceedingly rare or important.

Bidder may call and request further details and information about RR Auction’s opinions concerning any item via phone or email which shall provided in RR Auction’s discretion.

Certificate of Auction, Certificate of Authenticity and Goods Acquired:

Bidder warrants that Bidder (and its agents, assigns, successors, and affiliates) shall not purposely deface, destroy, dismember, cut-up into parts the item or Lot purchased at auction from RR Auction and in the event such shall occur whether purposefully or accidently, Bidder (and its agents, assigns, successors, and af filiates) shall refrain from advertising, promoting, or marketing the item as having been purchased from RR Auction and shall in no event display, expressly claim, or imply that the item was certified or auctioned in such state by RR Auction. As liquidated damages for such breach, Bidder agrees to be liable to RR Auction for the greater of the amount of three (3) times the hammer price of the item along with all other fees and costs as otherwise provided in this Terms of Sale.
