In Ibiza, we have the widest and most modern fleet in the island, with sailing boats Jeanneau, Catamarans Lagoon. Our boats are from 6 to 17 mts. in length. DEPOSIT The CUSTOMER will pay a deposit ONLY by credit card (no AMEX) In case of damages or losses in the vessel or its components RUMBO NORTE will choose between: • Withhold the value of the damages or losses from the deposit on landing. • Withhold the deposit while the damages or losses are assessed. In case of delay in returning the vessel the day of landing, RUMBO NORTE will be entitled to totally or partially withhold the deposit as a compensation.
COMMISSION FOR AGENCY The agency will receive 20% of the charter amount as a commission. Extra services are not subject to commissions. CHECK IN TIME - CHECK OUT TIME Boarding & Check In: at 18.00h Landing at Base Port: the day before Check Out at 18.00h Check Out: at 08:30h Be so kind as to inform your customers about the boarding times. To avoid waiting times, we suggest the customers plan their arrival in Ibiza. RUMBO NORTE will contact their customers in case the boats are available before the programmed time, in which case the delivery could be advanced. Pack Comfort VIP: Timetables for boarding and landing (check-in / check-out): Boarding: at 14.00h Landing at Base Port: at 18.00h + Check Out at 10.30h (in case of overnight)
BOAT ACCEPTANCE During the boarding process, the customer will be able to ask for information about the boat and its operation, the client will have one program with all informations with videos, instructions, etc. The client will check and sing the inventory list, the boat conditions, components, equipments, gear, etc with the contract with our CHECK IN & CHECK OUT sheet. He will report all the questions or eventual failures of the boat or its components the same day, so that RUMBO NORTE is able to repair them or to explain its operation. Once the customer leaves the harbour, it is understood that all the boat equipment is in perfect condition and the customer accepts it as being in perfect condition without any complaints possible from that moment on.

GENERAL TERMS AND CONDITIONS 1.- THE CUSTOMER affirms that the skipper of the ship designated by this contract has the needed knowledge and experience to steer the rented ship, that he owns the required certification in Spain and that he will have it at disposal of the authorities during the term of this contract. 2.- RUMBO NORTE rents the barge-carrying ship described above for the period and price specified above, subject to the present conditions. 3.- THE CUSTOMER will pay at the moment of boarding a DEPOSIT described above, which will be returned at the end of the contract and once RUMBO NORTE has checked that the ship is in good condition. THE CUSTOMER is obliged to return the ship to RUMBO NORTE with full fuel tank or to pay the consumed amount, plus 200€ for the refueling service. 4.- THE CUSTOMER is obliged to use the rented ship as if it were his property, following the good seafarer rules and according to the regulations currently in force. THE CUSTOMER is obliged to keep the rented ship and its facilities in good condition. THE CUSTOMER will not exceed the authorized number of people. The ship subject of this contract will be used as a barge-carrying ship, and he is not allowed to use it for commercial or lucrative purposes nor is he allowed to sublet it. THE CUSTOMER is not allowed to participate with the ship subject of this contract in any kind of boat race or competition, as the insurance does not cover these events. The ship should only navigate within the Spanish jurisdictional waters and subject to the limitations of the navigation area specified above. THE CUSTOMER commits not to leave the ship moored or anchored without anyone on board, or open roadstead, in unprotected waters or anywhere not subject to mooring fee. IT IS WARNED THAT THIS CIRCUNSTANCE IS EXCLUDED FROM THE INSURANCE COVER. THE CUSTOMER commits not to steer the ship subject of this contract under the influence of alcoholic drinks, toxic drugs or narcotics and not to embark arms or illegal substances. THE CUSTOMER is responsible for any damage, harm, loss or breakdown occurred in the rented ship, or in any of its elements like for instance in the dinghy with the outboard engine, as well as for the delay in the delivery of the ship. Should any of the above circumstance happens, RUMBO NORTE will withhold the deposit to offset the material damage or harm or the loss of profits. In case of failure/damage of the outboard motor, RUMBO NORTE will assist with our technical staff to the customer in the Island of Ibiza (not Formentera). If CLIENT were responsible of damage or malfunction thereof, RUMBO NORTE has not obligation to deliver another outboard engine. If RUMBO NORTE gives other engine may collect rent from the engine and THE CUSTOMER will pay the repair of the engine In case RUMBO NORTE fails to provide the ship more than 24 hours from the agreed boarding date in the event of force majeure, THE CUSTOMER will be entitled to request the return of the amounts already paid corresponding to the delay with respect to the term of the contract. If force majeure does not occur, THE CUSTOMER will be entitled to request the cancellation of the contract and the return of any payments made to date, not being allowed to use the ship.
5.- THE CUSTOMER will inform RUMBO NORTE immediately of any accident, sinister, breakdown or incident regardless its nature. IF THE CLIENT DOES NOT REPORT INMEDIATLY ANY INCIDENCE OCCURRED, THEN THE DEPOSIT WILL BE LOST COMPLETELY, AS PER NEGLIGENCE FROM THE CLIENT. In case of accidents a written report should be completed detailing the causes, circumstances and consequences of the accident, as well as the name, surname and address of the originator if he is known, as well as of any witness or injured people in case they are known. Any fortuitous, spontaneous, external or violent event will be considered an accident. 6.- The Customer must take special care use and handling of the W.C. (Water Closed) to avoid any obstruction or clog of the drain. Can not be throw toilet paper, sanitary towels, cotton, tissue or hands paper and any other element that could clog it. Do not move or change valve position of sewage tanks. Any breach of these rules producing any kind of clogging in the toilet, during the boat rental, the customer must pay €300 for damages caused to the charter company. If no address of such payment, the charter company may deduct from the deposit or charge this amount to trough the customer’s credit card. 7.- Should this contract be cancelled for any cause attributed to THE CUSTOMER, the cost to cancel the reservation would be as follows: more than 30 days before boarding: 50% of the price; less than 30 days before boarding: 100% of the price. 8.- At the moment of boarding, THE CUSTOMER will be handed an inventory of all household included in the ship and detailed in Schedule I as part of this contract, for his checking and acceptance. At the moment of landing, the inventory will be checked and any loss or damage due to misuse will be offset with the deposit. 9.- THE CUSTOMER gives his consent for his personal data to be collected and processed in accordance with the data protection laws. The records are stored and used according to the limits and terms of the laws and THE CUSTOMER has the right to access them and to request modification or to withdraw his consent. 10.- This contract is translated as accurate as possible to English, to whom prefer or better understand such language. However in case of doubts, misunderstandings or discrepancies of interpretation of any of the clauses of this contract, the Spanish version will always prevail in front of the translation of the contract. 11.- All claims relating to this contract shall be interpreted only by the Court of IBIZA (Spain), renouncing both parties to their own jurisdiction. In witness here of the parties here to have here unto and to the duplicate here of set and subscribed their respective hands and seals the day and year first hereinafter written:

CONDICIONES GENERALES 1.- EL CLIENTE asegura que el patrón del barco designado en este contrato, posee los conocimientos, y la experiencia necesarios para el gobierno de la embarcación alquilada, que es poseedor del título legalmente exigible en España y que lo tendrá durante la duración de este contrato a disposición de las autoridades pertinentes. 2.- RUMBO NORTE arrienda la embarcación de recreo descrita en las Condiciones Particulares, por el periodo y el precio anteriormente descritos, con sujeción a las cláusulas de este contrato. 3.- EL CLIENTE entregará en el momento del embarque, en concepto de FIANZA, la cantidad descrita en las Condiciones Particulares, la cual le será devuelta en el momento en que finalice este contrato y se haya comprobado por parte de RUMBO NORTE el estado de la embarcación. EL CLIENTE se obliga a devolver la embarcación a RUMBO NORTE con el depósito de combustible lleno o a pagar la diferencia consumida, mas 200€ por el servicio de repostado. 4.- EL CLIENTE se obliga a utilizar la embarcación arrendada como si fuera de su propiedad, según las normas del buen navegante, y respetando la legalidad vigente. Será obligación de EL CLIENTE mantener en buen estado de uso la embarcación arrendada, así como todas las instalaciones en ella existentes. EL CLIENTE no superará el número autorizado de personas en el certificado de navegabilidad. La embarcación objeto de este contrato será destinada a la navegación de recreo, no pudiendo ser utilizada ésta para llevar a cabo operaciones comerciales o lucrativas así como el subarriendo. EL CLIENTE se compromete a no participar con la embarcación objeto de este contrato en ninguna regata, ni en ninguna competición deportiva ya que el seguro no cubre estas actividades. La embarcación deberá navegar únicamente dentro de las aguas jurisdiccionales españolas y sujetas a las limitaciones de la zona de navegación descrita en las Condiciones Particulares. EL CLIENTE se compromete a no dejar la embarcación amarrada o anclada, sin ninguna persona a bordo, en rada, o aguas no protegidas y que no requiera pago de derecho de amarre. SE ADVIERTE QUE ESTA CIRCUNSTANCIA ESTÁ EXCLUIDA DE COBERTURA EN EL SEGURO DE LA EMBARCACIÓN. EL CLIENTE se compromete a no gobernar la embarcación objeto de este contrato bajo la influencia de bebidas alcohólicas, drogas tóxicas o estupefacientes, ni embarcar armas o sustancias ilegales. EL CLIENTE es responsable de cualquier perjuicio, daño, pérdida o avería que se produzca, tanto en la embarcación arrendada como de cualquiera de sus elementos auxiliares como por ejemplo la embarcación auxiliar con su fuera borda, así como de los retrasos en la entrega de la embarcación. De darse cualquiera de las circunstancias anteriores, o retraso en la entrega programada, RUMBO NORTE retendrá la fianza hasta compensar los daños o perjuicios ocasionados tanto materiales como de lucro cesante. En caso de avería del motor fuera borda, RUMBO NORTE asistirá técnicamente a EL CLIENTE en la Isla de Ibiza (no Formentera). Si EL CLIENTE fuese responsable del daño o avería del mismo, RUMBO NORTE no tiene ninguna obligación de entregar otro motor alternativo o de hacerlo podrá cobrar el alquiler del mismo más la reparación del motor averiado Si RUMBO NORTE se retrasa en al menos 24 horas en la entrega de la embarcación en la fecha indicada de embarque por causas de Fuerza Mayor, EL CLIENTE podrá solicitar la devolución de las cantidades proporcionales correspondientes a la demora con respecto al periodo de contratación. Si no fuese por causas de Fuerza Mayor, EL CLIENTE podrá solicitar la rescisión del presente contrato y la devolución de la totalidad de las cantidades entregadas hasta la fecha no pudiendo hacer uso de la embarcación.
5.- El CLIENTE deberá notificar inmediatamente a RUMBO NORTE de cualquier accidente, siniestro, avería o incidencia independientemente de su naturaleza. EN CASO DE NO INFORMAR CON CARÁCTER INMEDIATO, EL CLIENTE PERDERA LA TOTALIDAD DE LA FIANZA POR INCUMPLIMIENTO MUY GRAVE DEL CONTRATO. En el caso de accidentes se deberá formalizar un parte de accidente por escrito, las causas, circunstancias y consecuencias de lo ocurrido, así como, de ser conocidos, nombre, apellidos y domicilio del causante del hecho y de los testigos e igualmente los nombres y direcciones de los perjudicados si los hubiera. Se entenderá por accidente, a efectos del presente contrato, cualquier hecho fortuito, espontáneo, exterior o violento. 6.- El cliente deberá tener especial cuidado en el uso y manejo del inodoro para evitar cualquier avería o atasco del mismo. No podrá tirar, papel higiénico, elementos de higiene intima, algodones, papel tisúes o de manos, ni cualquier otro elemento que pueda atascar el mismo. Así mismo no deberá mover o cambiar de posición las válvulas de los tanques de aguas grises. Cualquier inobservancia de estas reglas que produzca un atasco de cualquier naturaleza en el WC, durante el periodo de alquiler del barco, el cliente deberá abonar el importe de 300 € por los daños ocasionados a la empresa de charter. En caso de no hacer frente de dicho pago, la empresa de charter podrá descontarlo de la fianza o pasar el cargo a la tarjeta de crédito del cliente. 7.- Si el presente contrato fuese resuelto por causa imputable a EL CLIENTE, el coste de la anulación de reserva sería: Antes de 30 días del embarque, 50% del alquiler. En los 30 días anteriores al embarque, 100% del alquiler. 8.- En el momento del embarque, se hará entrega a EL CLIENTE de un inventario con los enseres que se le entregan, que formara parte de este contrato y se detalla en el Anexo I como parte de este contrato, para su comprobación y aceptación. Posteriormente en el momento del desembarque, se procederá a revisar el inventario y a compensar con la fianza cualquier falta o deterioro fruto de un mal uso. 9.- En este acto, EL CLIENTE presta su consentimiento para que sus datos de carácter personal sean integrados por RUMBO NORTE en ficheros automatizados con los límites previstos en la legislación sobre protección de datos y bajo su responsabilidad. Los datos podrán ser tratados de forma automatizada y conservarlos, de acuerdo con los términos de la ley, teniendo EL CLIENTE derecho de acceso a los datos y, en su caso, de pedir su rectificación o cancelación. Si desea ejecutar sus derechos de acceso, rectificación, cancelación u oposición debe dirigirse por escrito a info@rumbonorte.es RUMBO NORTE informa a EL CLIENTE que el barco está equipado con un localizador GPS y sistema global de control y EL CLIENTE acepta que RUMBO NORTE tenga acceso a todos los datos del mismo durante el periodo de arrendamiento 10.- El presente contrato se traduce lo mas fielmente posible en lengua inglesa, para quienes prefieran o entiendan mejor dicho idioma. Sin embargo, en caso de dudas o discrepancias de interpretación de cualquiera de las cláusulas de este contrato, la versión española siempre prevalecerá ante la traducción del mismo. 11.- Para cualquier interpretación del presente contrato son solamente competentes los Tribunales de Ibiza, renunciando ambas partes al fuero que pudiera corresponderles.

CANCELLATIONS Once the reservation is closed with the customer, it will be considered firm and should the customer become unable to perform the charter, he will lose all the payments already settled to date. In case the agency propose an alternative customer, we will charge 5% as cancellation and change of customer fee.
CLAIMS All eventual complaints made by customers will be informed to Rumbo Norte at the moment or at the check-out day, and will be recorded at RUMBO NORTE local site. Upon submission to the local site, Management will decide and send a written response within 7 days.
