QUALITY STREET In 2006 demolition began at the London Arena, three years after it closed for development. Over the past three years the phoenix that has risen from the ashes is Ballymore’s Baltimore Wharf. Before the development launches to the public in February of next year, Louisa Castle takes a closer look at the skyline

F

ounded in Ireland in 1982 by chairman, Sean Mulryan, Ballymore has expanded to become one of Ireland’s most successful property developers based on the ethos of building high quality homes for people who know what they want out of life. Constantly evolving and looking to the future has kept the company going forwards through the tough times in the marketplace and there’s a definite company-wide pride in their achievements. Busy revelling in the towering limelight of Pan Peninsula you would have thought the developers would be having a short break before embarking on new projects. But no, set across the water from this striking addition to the skyline has risen Baltimore Wharf. Once complete the development will offer 972 apartments, 26,500 sq m of offices, 4,800 sq m of shops, cafes and restaurants, a 180-bedroom hotel, not to mention the Baltimore Club – an in-the-city country club style leisure facility and health club complete with virtual golf and claypigeon shooting – all providing the basis for a new community. Designed by skyscraper specialists Skidmore, Owings & Merrill (SOM), the first phase of the

development will offer 473 apartments for sale around the landscaped courtyard and with views to the water. Sales and marketing director, Michael Meanley is keen to explain the quality and pride that are at the core of the company’s success in light of many others taking the path of cutting corners: “We work by the three Ds – design, detail and deliver. And the only way to ensure that all three are met to a quality and standard that we are happy with is to have ownership of all the elements. We are the only developer I know of who manages their own assets and everything about Baltimore Wharf is under the Ballymore name to ensure we deliver our promises. “Quality is the key. The orange/red stone is handmade in Hampshire, the sets in the courtyard are granite, there is a true representation of the constellations on the ceiling of the archway and it is these touches and quality marks that make a development. Quality leads to good investors and investments and a good reputation which, in turn, saves money.” High quality design runs throughout the development, of that there is no doubt, from the architecture and balconies (all of which are angled for maximum privacy yet add to the art of the building) to the exterior to the leadingedge interiors with Bianco Assoluto stone flooring, Miele kitchen appliances and fixtures and fittings of style. The duplex penthouses have floor-to-ceiling glass with large terraces to welcome the outside in. Currently shells, there will be a selection of designs for owners to choose from, responding to the nation’s desire to be interior designers. The second phase of Baltimore Wharf will be a striking 45-storey twisting tower that will be only 10 centimetres short of skyscraper status. The structure is actually a straight up ellipse but the distortion of the building is, in reality, caused by rotating the balconies that wrap around the tower on each floor. It is a trademark of architects SOM who comment on their inspiration: “Baltimore Wharf gave an opportunity to design a landmark building which matches the

strong massing and robustness of historical dockside architecture whilst maintaining a contemporary expression and details. “The traditional handmade bricks are contrasted with fine anodised aluminium window surrounds and crisply detailed glazed balconies. The random pattern of windows and balconies across the facade expresses the variety of apartment types and layouts within. “The centre of the dockside building is pierced by a dramatic seven storey high opening which leads through from the water’s edge to the boulevard at the centre of the development and the two more private courtyards beyond. This series of new landscaped public spaces knits the new buildings tightly into the existing urban context.” Michael Meanley concludes; “We are very proud of all that we have achieved with Baltimore Wharf and look forward to showing people around the development. We’ve retained the high quality standard we are renowned for and look forward to being at the centre of a new community in the Docklands.” Ballymore will be releasing Phase One to the public over the weekend of 20 and 21 February, 2010. STATE OF THE MARKET NEW YEAR’S RESOLUTIONS

ALASDAIR CARPENTER OF LOURDES ESTATES COMMENTS ON THE STATE OF THE RESIDENTIAL PROPERTY MARKET

The end of 2009 has seen some faint glimmers of an improving sales market but still has a long way to go before it can confidently be called “healthy”. Mortgage finance is still hard to come by, even with large deposits. I spoke to a lawyer last week earning a significant salary who was refused a buy-to-let mortgage on the basis that he’d missed a credit card payment for... wait for it... £9! This just goes to show how important your credit score is these days. Evidence from mortgage brokers suggests that lenders can change the credit score required for new mortgages by the hour depending on how much business they want to take on. January sees the completion of St Luke’s Square in Canning Town, a major development by Galliard Homes. History suggests that this development will be given the same treatment as previous Galliard developments at Wharfside and Deptford where many buyers were unable to complete and the stock came back onto the market at significant discounts. The common misconception is that buyers can simply walk away and lose their deposits. This is not the case if the buyer has exchanged contracts, they are legally obliged to complete. If the property is sold at a lower price than the amount outstanding from the original purchase price, the buyer is liable for the difference, as well as losing their deposit. Major regeneration is continuing in Canning Town with major investment in the town centre. Recent announcements include a realignment of the junction with the A13 to allow for a large pedestrian area around the station as well as new shops, restaurants and apartments. Development is also continuing in Canary Wharf with the development of the Millennium Quarter including Lanterns Court and Canary Quarter. 2010 certainly looks like being an exciting year for the Canary Wharf property market. Many of our corporate clients are planning to increase their staff numbers next year and will be requiring short lets and long lets for high quality employees.

The Tory party’s position on HIPs is now perfectly clear. Shadow Housing Minister, Grant Shapps, views them as “an unnecessary level of bureaucracy which has failed to make home buying and selling easier.” I have been involved in the property industry for a decade now and the introduction of HIPs has not made any significant difference to the amount of time involved in property acquisition. Not once has a potential purchaser asked me to review a copy of the HIP before committing to an offer on a suitable property. Industry professionals and the public alike have been disappointed that HIPs have failed to help buyers in making a more informed decision and reduce the time involved in purchasing a property. In contrast the EPC (energy performance certificate) that forms part of the HIP will survive, albeit with less demanding criteria. The EPC for residential sales currently lasts three years, this will be increased to ten under the Conservatives’ proposals and estate agents will be able to market a property once it has been commissioned. Many HIP providers are already testing something called an ERP (exchange ready pack), a product that offers a revised set of information with additional legal documents. These include a contract for sale and completed seller’s disclosures forms. This is in itself proof that even the people paid to produce HIPs admit their failure. The housing market is performing better than expected and recovery is in sight. First-time buyers and buy-to-let investors are returning to the market and repossessions are far lower than expected. So it would seem the future of the HIP hangs in the balance of the next general election and as it stands the Conservatives are the bookie’s favourite. I will leave you with a quote from Grant Shapps, shadow housing minister.... “HIPs are history under the next Conservative government. And Gordon Brown could be the first to benefit when his removal van pulls up outside Number 10.”

F

inding a Buyer. Once you have found a buyer, try and stay in contact with them directly. You may wish to swap telephone numbers or exchange email addresses. Your solicitor cannot speak directly to your buyer but only communicate via their solicitor or your own estate agent and therefore a simple direct call to your buyer can clear away any confusion and deal with non-legal matters swiftly. Is your property leasehold? If so, where is your lease? All properties now need a Home Information Pack (HIP) in place before they can be put on the market and this includes a copy of a lease, if applicable. The companies providing HIPs can get a copy of your lease from the Land Registry but on completion you will ideally need to provide the original. In addition, if your property is leasehold, you may also need to locate documents such as a share certificate in the freehold or management company, NHBC insurance papers, and any guarantees or warranties that may have been transferred to you when you originally bought. Have you carried out any alterations to your flat? This could be anything from moving an internal door or nonstructural wall, converting additional loft storage space to installing wooden 30 market comment

floors. Anything like this may very well need the freeholders or the management company’s consent and possibly planning permission and/or building regulations approval from the local council, especially if the property is listed. Mortgages. Apply for an up-to-date redemption statement from your mortgage company and familiarise yourself with any early repayment penalties and their expiry dates. Your solicitor will, of course, obtain one of these for you just before you exchange on your sale, but mortgage redemption departments are not renowned for their efficacy and if you request one at the outset this can be passed to your solicitor who will have your full account details to contact them to ensure they can act on their behalf in the sale, and request any deeds that they may still have. Fixtures. Take care when completing your fixtures and contents form. Most arguments that arise during and after a sale are not technical or legal but revolve around what people have or haven’t left behind. Ensure both you and your buyer have agreed this form well before exchange of contracts. Installations. Have you had new windows, central heating or electrics installed recently? If so, new legislation dictates that you should have certificates for all of these, which will be transferred to the new owner. Again, to save any unnecessary delays, you should ensure that the originals of all of these certificates and other such documentation that relates to modernising your house or flat is passed to your solicitors at the outset. Instructions. Be careful who you use to do your conveyancing. The term ‘lawyer’ is a generic term, which can cover not only solicitors, but also licensed conveyancers and non-qualified

paralegals. If you feel more comfortable knowing that a solicitor will be dealing with your sale, double check the firm’s website carefully before going ahead with the instruction and make sure that the firm is registered with the Solicitors Regulation Authority. Fees. When comparing quotes from law firms, look for the hidden costs. Some firms may quote substantially lower than others at the outset and in order to secure you as a client. However, further costs are then added on during the transaction as a matter of course, for dealing with standard unavoidable precontract steps to include for example, writing to your management company for service charge information to actually seeing you in their office for a meeting. Completion. The day of completion itself can be stressful enough. Therefore, you should make sure that you are totally packed and ready to leave at least the day before your sale completes. Contractually, you will usually be obliged to hand over keys by midday. This may sound obvious but if I had a pound for every completion held up due to last minute packing problems with bored removal men setting outside watching their charges go up by the hour I would be much the richer! AN OWNER OCCUPIER’S MARKET

I

n the face of what has been a turbulent market for the last year there has been a turnaround in who’s buying new developments, according to the latest figures from Savills Residential Development & Investment team. The team has noticed, from firsthand experience, that 90% of their buyers for new build developments are now owner-occupiers, contrasting dramatically to the 80% investors who were buying before the onset of the credit crunch. Luke Mills of Savills Residential Development and Investment comments; “Investors didn’t want to buy off-plan in such an uncertain market and therefore we advised our clients who had commenced construction on their projects to stay off the market until the development was completed, including the landscaping and amenities. “As a result, we were able to present new schemes as a desirable living environment to the owner occupier market. This meant that for the first time in many, many years the best plots had not already been secured by off-plan investors. Furthermore, owner-occupiers can see the quality of actual apartment they are buying and not base

such a significant purchase just on one show flat and a model.” When Savills marketed the Hornsey Road Apartments N7, a Grainger development, as a completed project in March this year it was the first major new build project to test the market and nearly 120 apartments have now been sold with 95% being bought by end users. “For end user purchasers it’s a win-win situation. The premiums paid for new builds have been eroded since the credit crunch and come in line with the second hand sales market so you can buy new for second hand prices with the added benefits of concierge services, underground parking, security and private gardens. New build also carries the advantage of being chain free, thus avoiding many of the frustrations of a slow second hand market,” added Mills. Lending? Ron Radway, mortgage consultant at OneCall Financial Advice Centre brings us up to date with the mortgage market

T

he short answer is a resounding yes but there are provisos... As we come to the end of the second full year of the credit crunch, there is clear evidence that mortgage lenders are, at last, getting their act together. Rates are coming down, margins reducing to be more reflective of unprecedented low base rates, and loan to values have increased in line with the confidence of sustainable property values. That’s the good news, now for the reality. Having spent the past two years acting like headless chickens, lenders are now busy chasing their tails. Service levels are patchy, ranging from adequate to appalling; the process works on a timescale unrelated to the pressures of the transaction; underwriting is unreliable; and credit scoring is pedantic in the extreme. In all fairness to lenders, in general these are still difficult times for them. Not only has their whole business model had to be restructured following the devastation caused by the credit crunch, but they are under extreme scrutiny and pressure from the FSA to ensure robust procedures and capital adequacy (or to put it another way, locking the stable door after the horse has bolted!). Then, of course, there is a lack of funding. (To be precise, there is a lack of replacement funding, which will provide a natural ceiling to availability.) Last, and probably most importantly, is the dearth of competition: There are only about halfa-dozen high-street lenders left and a few direct providers dealing with main stream applicants. Building Societies have been marginalised as a direct result of the transgressions of the larger brethren, and there are very few lenders prepared to accept non-conforming applications. It is

understood that there are up to 30 new lenders waiting on the wings, and when, and if, they come on board things should liven up. So, on balance, the situation is improving slowly but surely, and I feel that we will continue to see advances as the year unfolds.

ASK THE EXPERT Q: I’m a first-time buyer, what level of deposit will I need? A: A few lenders are offering deals with a 10% deposit, however, the terms are spectacularly unattractive and very few applicants meet the required criteria. A deposit of 15% opens far more doors at far better rates and if you could find 25% you have access to the best deals. Q: I have been declined a mortgage on the grounds of adverse credit history. I have checked my credit file to discover this amounts to one late payment on a credit card – is this correct and is it fair? A: Yes and no. Yes it is correct and no it’s not fair – but it is the reality of current lending policy almost across the board. It is always best to obtain your credit file prior to application as even the ‘cleanest’ are likely to have some minor blemishes.
