Storm in Indian judiciary To resolve the burning issues relating to the allocation of cases and the functioning of the Supreme Court, Chief Justice finally meets four rebel SC judges IANS, NEW DELHI

hief Justice Dipak Misra met the four rebel judges — Justices J. Chelameswar, Ranjan Gogoi, Madan B. Lokur and Kurian Joseph – on January 18 to resolve issues relating to the allocation of cases and the functioning of the court. The meeting that was expected to take place on January 17 did not materialize as Justice Chelameswar did not attend the court because of his indisposition. An uneasy truce was reached earlier this week after the CJI reached out to the four dissenting judges to resolve a rift with them over the allocation of cases in the Supreme Court. Recusal of Justice Arun Mishra from hearing the matter of Judge Loya’s death is seen by some as an indication of thaw between the CJI and the warring judges who had raised the issue of important cases being listed before judges who are

ney General K.K. Venugopal had said that the events since January 12 were a “storm in a tea cup” and that “everything is settled”. An informal full court meeting of all the judges took place on Monday when they came to the Judges’ lounge for the customary morning

The country’s top court was hit by unprecedented crisis, after the four senior most judges at a press conference last week expressed their unhappiness about the functioning of the court and how cases were being allocated arbitrarily. They complained that “administration of Supreme Court is not in order and there have been things less than desirable that have happened in the court”. The judges also released a letter they had written to the Chief Justice questioning how he was arbitrarily deciding which bench should decide which case and though he is the “master of the roster” that did not make him a “superior authority”. “The Chief Justice is only the first amongst equals — nothing more or nothing less,” the letter said. The Bar Council of India met Justice Misra and 14 other judges. The Supreme Court Bar Association also met the Chief Justice and other judges to resolve the issues.

Charges filed against Kashmiri separatists NEW DELHI: The National Investigation Agency (NIA) on November 18 filed charges under anti-terror laws against seven jailed Kashmiri separatist leaders for allegedly conspiring with Pakistan-based terrorist leaders Hafiz Saeed and Syed Salahuddin to wage war against India to secede Jammu and Kashmir. The agency has named Saeed, the Lashkar-e-Taiba founder and alleged mastermind of the 2008 Mumbai terror attack, and Salahuddin, the Hizbul Mujahideen chief, as the accused in its nearly 13,000page chargesheet. Others accused are Altaf Ahmad Shah, son-in-law of hardline Hurriyat Chairman Syed Ali Shah Gee-

lani, Aftab Ahmad Shah, a close aide of moderate Hurriyat chief Mirwaiz Umar Farooq, and well-known businessman Zahoor Ahmad Watali. In all, 12 persons have been accused of “carrying out terrorist attacks and orchestrating violence, stone-pelting and other subversive and secessionist activities in Jammu and Kashmir”. ndia is missing the Asian Financial Forum (AFF) event, ostensibly because its ministers and officials have opted for the World Economic Forum (WEF) at Davos in Switzerland later this month, an official said. “Indian ministers and officials declined our invite citing lack of time as they have to go for Davos for the four-day WEF from January 23-26,” a Hong Kong Trade Development Council (HKTDC) official told IANS. Preparations and meetings for the 2018-19 Union Budget presentation on February 1 has also been cited as another reason for the conspicuous absence of India at the 11th edition of the two-day financial summit being held at Hong Kong Convention Centre in downtown. Nearly 100 speakers from the global financial community and about 3,000 delegates from around

nlike most countries, the budget is usually an eventful affair in India and is a heated topic of national conversation around the time of its release. The underlying national interest behind it is mostly because the budget holds something for everyone — ranging from a small farmer to a big industrialist. However, from this year onwards, much of its sheen will be off by a bit. The tinkering of indirect taxes, which was an aspect of the budget that affected everyone in all corners of the country, is not within the Centre's domain anymore. Since the implementation of the Goods and Services Tax (GST), all indirect taxes — except for customs duty — have to be decided upon by the GST Council instead of being annually altered based on shortterm political interests. Therefore, the first budget after the GST reform will be a challenging one for the government. The fact that this will be the last

full budget before the 2019 elections and that the government has already spent all of its budgeted expenditure for this financial year will further complicate matters. First, if the Gujarat election results are to be taken as indicative of the national sentiment, the BJP government is more popular in urban areas than it is in the countryside. The recently released CSO

growth estimates show why. The farm and allied sector grew at 2.1 percent in the current fiscal as compared to 4.9 percent in the preceding year. So, the ailing agricultural sector will receive much-needed redressal in the upcoming budget. Reviving growth in the sector can also be a viable mechanism for job creation — another economic aspect that the government will be looking to address with the budget. Second, with the elections

around the corner, firming up economic growth will be foremost on the government's agenda. Investments have declined from 34.3 percent of the GDP in 2011-12 to 27 percent in 2016-17. They still do not seem to have picked up. First advanced estimates show that this has further fallen to 26.4 percent in 2017-18. Estimates of the Centre for Monitoring Indian Economy (CMIE) show that new investment proposals are likely to amount to

around Rs 8 trillion ($126 billion) in 2017-18, which would be merely 60 percent of the new proposals made in 2016-17 which would also be the lowest since 2004-05. Third, the government will be in a tight conundrum to balance the budget between going populist in an election season and sticking to the fiscal deficit target. It is almost certain that the government will breach the fiscal deficit target this year after revenue collection in the new tax regime is mostly turning out to be lower than expected, forcing the government to borrow an additional Rs 500 billion. This puts the government's net borrowing at the highest level since 2013-14. Moreover, it needs to be pointed out that this figure does not include the Rs 800 billion meant for bank recapitalization this fiscal. All factors considered, this budget presents the biggest challenge to the Modi government since coming into power. Low growth numbers, subdued investment sentiment and a widening deficit leave a Herculean task at hand.

lmost a decade after he narrowly survived the November 26, 2008 Mumbai terror attacks, the orphaned Moshe Holtzberg arrived in Mumbai this week on his first visit to India. Then a toddler on the verge of turning two and now an 11-yearold, the bespectacled Moshe, sporting a T-shirt and shorts, landed at Chhatrapati Shivaji International Airport (CSIA) along with his grandparents, with whom he grew up in Israel. Appearing a tad bewildered by the presence of a large media posse outside the CSIA, he kept close to his grandmother, with his grandfather following nearby. Accompanying them was his savior and Indian nanny, Sandra Samuel, who has lived with and looked after him in Israel since the harrowing experiences of 26/11 in the Chabad House, which is inside Nariman House in Colaba, in the southern tip of Mumbai. At the media’s insistence, Moshe managed to say: “Shalom... Bahut khush” (Greetings, I feel very happy)”. He religiously sported a

small brimless cloth cap, called ‘kippah’ — which he kept on all through the day in Mumbai. “I want to pray in Nariman House, where Moshe’s parents were killed... House, in Nariman House, Colaba, which was under siege by two Pakistani terrorists who gunned down seven persons there, including Moshe’s young parents. Moshe and his grandparents offered a brief but solemn prayer at the small synagogue here, visited the library and various other rooms, including the one in which his parents were felled by the terrorists bullets during the November 26-29 strikes. Samuel took them around the room where Moshe’s parents were killed, and recounted the chilling events of that day to him and his grandparents, against the backdrop of the bullet-ridden walls, damaged plaster and floor, some telltale reddish-brown stains (probably blood) of the dance of death in the building exactly nine years and three months ago. At one point, Rabbi Kozlovsky, his wife and Samuel posed before a large portrait of Moshe’s parents which hangs in Chabad House.

Jayalalithaa, the brother of her close aide, now jailed, V.K.Sasikala this week said that she died on December 4, 2016 and not on December 5 as officially announced by Apollo Hospitals. Participating at the AIADMK founder and former Chief Minister M.G.Ramachandran birth centenary celebrations in Tiruvarur district, V.Divakaran said Jayalalithaa died at 5.15 p.m. on Dec 4, 2016 and not the next day late night and the official declaration was delayed by a day so as to provide adequate security to the chain of Apollo Hospitals across the state. His statement comes at a time when a Commission of Inquiry is probing into the circumstances that led to the hospitalization of Jayalalithaa. She was admitted to Apollo Hospital on September 22, 2016 for dehydration. Later her condition got complicated. On December 5, 2016, rumors were floating about Jayalalithaa’s death in the evening which Apollo Hospital denied but later it was announced that she died at around 11.30 pm on that day. —IANS

amil Nadu’s traditional Jallikattu or bull taming sport got off to a great start this week as part of Pongal celebrations in Madurai district. After mass protests last year against banning the sport, Jallikattu was held following the passing of an ordinance amending the Prevention of Cruelty to Animals Act. The Madurai district administration had made elaborate security arrangements at Avaniapuram

where 625 bulls and an equal number of bull tamers participated in the event. Both were subjected to fitness tests. The rules of the sport say that a bull tamer will be awarded a prize if he hangs on to the hump of the animal for a certain period of time. The prizes include consumer durables, cash and more. Around 60 bull tamers were injured in the sport and were provided medical assistance at the venue. Jallikattu was held at Alanganallur in Madurai district where

The Shahs, who currently live in Tampa, Florida, were residents of the Youngstown community for 20 years prior to relocating to Florida. Airline denies re-entry into US to couple

BY A STAFF WRITER AIRFAX, VA -- An Indian American couple from Fairfax, Va., on January 7 was allegedly denied re-entry into the country after an encounter with an Aeroflot staffer escalated. Shahana Islam, 26, and Marc Fernandes, 27, attempted to board a US-bound flight with Aeroflot in Moscow, Russia, after a vacation with family and friends. The couple was stuck in New Delhi, India, however, after the encounter with a staffer resulted with them allegedly being sent back to India. Islam and Fernandes begged to be sent back to the US after the airline employee claimed that “all citizens of the country that need visas in our country after 24 hours will be deported,” according to a video of the incident that was shared on Facebook. The incident was captured on video by Islam, who later shared the footage on January 7 on Facebook. The video, which generated more than 28,000 views, showed the couple pleading for Mikhail--the Aeroflot worker--to allow them to be “deported to the US.” Mikhail stormed off after the couple continued to assert they were American citizens, but he refused to believe them and referred to them as “Indian passengers,” the video showed. “This guy is discriminating against Indians and trying to ‘deport’ us all back to India,” Islam wrote on Facebook. “As a US citizen per International Air Transport Association regulation, they need to send us to the US, not back to India. He literally looked at people and decided who needs to go back to India. Can I sue him and Aeroflot?” IATA, which represents Aeroflot among 280 other airlines, works towards maintaining order for passengers like Islam and Fernandes in scenarios like these. The organization also disputes unreasonable rules and charges, hold regulators and governments to account, and strive for sensible regulation, according to its website. Aeroflot confirmed that an internal investigation is under way as the airline strives towards providing “the highest standards of customer service, even in the midst of major travel disruptions due to weather, and we regret the tremendous inconvenience caused to passengers in this case.”

Several clubs in District 1A took part in this magnificent celebration where Past International Director Dan O’Reilly gave an impressive message even as American, Filipino and Indian national anthems were sung with Pledge of Allegiance to the US flag. “100 years ago, our founder Melvin Jones asked his friends to be the volunteers to help the needy in their communities as

there were thousands of soldiers from World War I were wandering around without jobs, families and shelter. This concept of serving the needy today spread all over the world and filled with more than 1.4 million members and more than 210 countries and geographical areas,” he said. After a sumptuous dinner, Filipino American Lions Club members enacted a skit on unity, and donations were collected with the money being given to battered women in Chicago who have small babies. One new Melvin Jones Fellow Junior Roque was recognized by District 1A Lions Clubs International Foundation Chairperson Wes Salsbury. Director O’Reilly presented Wes with a Chairman’s Medal for reaching more than $30,000 in contribution for last Lionistic year.

On January 14, the temple celebrated Makar Sankranti with temple priests greeting the devotees with their good wishes and thanked them for valuing the cultural heritage. Raj Mukherji is majority whip in NJ assembly BY A STAFF WRITER ERSEY CITY, NJ -- Raj Mukherji, an Indian American state assemblyman in New Jersey’s 33rd Legislative District, on January 12 was named by Assembly Speaker Craig Coughlin as majority whip of the General Assembly. The appointment is expected to help shepherd Coughlin’s agenda through in the current legislative session, according to a news release. Mukherji is a partner in the Jersey Citybased law firm Mukherji Wolf LLC and coowns several healthcare businesses. He becomes the first Asian American in state history to serve in this role. He is presently the only former Marine and the only Asian American serving in the New Jersey General Assembly. The son of immigrants, Mukherji supported himself through high school, college and grad school as an emancipated minor when economic circumstances forced his parents to

return to their native India. After suffering a pituitary tumor, stroke and other ailments, Mukherji’s father could

Indian makes calculator for house tax plan cost BY A STAFF WRITER ERKELEY, CA -- Indian American graduate student at U.C. Berkeley Vetri Velan, along with fellow grad student at Berkeley Kathy Shield, created a calculator that will estimate the cost of the House tax plan. Velan, a graduate student in physics, and Shield, a graduate student in nuclear engineering, created the online calculator in response to concerns of how much the Republican tax plan would cost them, according to a university report. The House version of the Republicans’ major tax code revision would remove a deduction graduate students can use to deduct the value of their tuition in exchange for working or doing research. Taxes for graduate students could climb by hundreds, and in some cases thousands

of dollars. Velan said the calculator estimated that his taxes would raise by $1,100, or 30 percent. Shield said the calculator is designed for

students who file singly, and, therefore, have relatively simple taxes. “In each case, our calculator indicates that their taxes will increase if the changes in the House version of the tax bill go through,” says Shield. Velan also took part in a recent protest by graduate students on the steps of Sproul Hall, done in a broader effort by graduate students across the country to draw attention to the impact the tax plan would have on them and on higher education. Zed had last fortnight urged the retail giant to remove the doll of Lord Ganesh, who is highly revered in Hinduism and is meant to be worshipped in temples or home shrines. The society president also urged WalMart chief executive Doug McMillon and board chairman Gregory Penner to offer a formal apology, besides withdrawing the Ganesh Plush Doll from its website. The Ganesh Plush Doll, earlier selling for $18.94 at Walmart.com, now shows up as ‘This item is no longer available’ when a customer tries to purchase it online. Indian’s bid to flee to Equador foiled

BY A STAFF WRITER ISSIMEE, FL -- An Indian American man from Florida who pleaded guilty in Chicago to a giant real estate investment fraud to the tune of $179 million has been arrested while attempting to flee the country for Ecuador just days before he was to be sentenced. Nikesh Patel, 33, who was free on bond pending his sentence, was confronted by FBI agents monitoring him as he attempted to board a private jet around 7 am on January 6 at the Kissimee Gateway Airport in Florida. According to a criminal complaint, Patel told the agents he was planning to board a chartered flight to Ecuador where he had been “granted political asylum”. He also said he paid his travel companion--identified only as KT-$40,000 to arrange the trip. Patel was arrested and appeared January 8 before a federal magistrate judge in Orlando who ordered him held without bond before his transfer to Chicago.

Killer of infant, grandma to die on February 23 BY A STAFF WRITER AY N E S B U R G , P A - Raghunandan Yandamuri, convicted of the 2012 brutal murders of 61-year-old Satyavathi Venna, and her 10-month-old granddaughter Saanvi Venna, in Pennsylvania, will be executed on February 23. According to a statement issued by the Pennsylvania Department of Corrections, Yandamuri is being held at the Greene State Correctional Institution, a maximum security prison in Waynesburg, Pennsylvania. Yandamuri will be the first Indian American to receive the death penalty. He is scheduled to die by lethal injection. Following his conviction in 2014, the Andhra Pradesh native–who came to the US on an H-1B visa–asked that the death penalty be imposed upon him. “I don’t want this hearing. I would rather take the death penalty,” Yandamuri told Montgomery County Common Pleas Court Judge Steven O’Neill before he was sentenced. Indian in fraud case faces ‘honor killing’ BY A STAFF WRITER LINT, MI -- Jatinder “Bobby” Singh, a former Flint, Mich., liquor store employee, will be deported and targeted for an “honor killing” in India if he pleads guilty to aiding a $1.3-million food stamp fraud scheme, said Kimberly Stout, Singh’s attorney at a January 4 hearing in Flint US District Court. Stout argued that the 31-year-old Indian American worker did not fully understand the repercussions of pleading guilty to a charge of conspiracy to commit wire fraud at Paradise House of Liquor in Flint, asking a federal judge to allow Singh to withdraw his plea. Singh pleaded guilty to aiding the food stamp scheme in April 2017 under

the assumption he would be allowed to stay in the US due to the “horrendous circumstances” he faced if he returned to India, the filing said. The immigration court ruled otherwise. Now, Stout says, if Singh returns to India, he will be killed by his wife’s family. Singh fled to the US from India in 2008 after being targeted by his wife’s family for

an “honor killing”—a murder meant to “avenge a sense of insult”–for marrying outside of caste. Because Singh’s wife was of a different culture than him, the pair was not permitted by the family to marry, the court filing states, adding that when Singh proposed to the woman, she was beaten by her father and Singh was threatened with death. Eventually, with the help of Singh’s siblings, the couple ran away and married. With no former criminal history, government guidelines recommend Singh spend four to 10 months behind bars, according to records. Singh is currently free on a $10,000 unsecured bond. His sentencing is scheduled for February 21.

BY A STAFF WRITER ASHINGTON, DC -- A prestigious scientific panel is recommending that states significantly lower their drunken driving thresholds as part of a blueprint to eliminate the “entirely preventable” 10,000 alcohol-impaired driving deaths in the United States each year. The US government-commissioned, 489page report by a panel of the National Academies of Sciences, Engineering and Medicine throws the weight of the scientific body behind lowering the blood-alcohol concentration threshold from 0.08 to 0.05. All states have 0.08 thresholds. A Utah law passed last year that lowers the state’s threshold to 0.05. The amount of alcohol required to reach 0.05 would depend on several factors, including the person’s size and whether the person has recently eaten. A 150-pound man might be over the 0.05 limit after two beers, while a 120-pound woman could exceed it after a single drink, according to the American Beverage Institute, a national restaurant group. The panel also recommended that states significantly increase alcohol taxes and make alcohol less conveniently available, including reducing the hours and days alcohol is sold in stores, bars and restaurants. Research suggests a doubling of alcohol taxes could lead to an 11 percent reduction in traffic crash deaths. It also calls for cracking down on sales to people under 21 or who are already intoxicated to discourage binge drinking, and putting limits on alcohol marketing while funding anti-alcohol campaigns similar to those against smoking. The report points out that “alcoholimpaired driving remains the deadliest and costliest danger on US roads,” accounting for 28 percent of traffic deaths. Each day, 29 people in the US die in alcohol-related crashes and many more are injured. Forty percent of those killed are people other than the drunken driver. Rural areas are disproportionately affected. In 2015, 48 percent of drunken driving fatalities occurred in the rural areas.

For the study, published in the journal Frontiers in Psychology, researchers tested their hypothesis in third graders in a school.
