Gardeners, farms, businesses: they all go digging at Marshall Machinery By Kathy Daley armers shop here for huge tractors. Homeowners buy rototillers or small tractors with loaders. Beekeepers and growers of organic fruit and vegetables stop by for earth and rock moving equipment as they plan beehives and start-up farms. Marshall Machinery on Route 652 near Honesdale – with offices in Middletown, N.Y. and in Swiftwater, Pa. – serves as a lively landmark and champion of the Honesdale area. “It's a family-run business,” said Matt Coar, assistant branch manager at the Honesdale site. “When you work here, you feel like you're part

of the family.” In 1959, John E. Marshall launched the company, now run by his son Earl. John’s daughter, Barbara Diliberti, heads up the human resources department. In the late 50s through the 70s, the company focused on the agriculture business. Now, it's directed at selling, renting and servicing important equipment for all purposes, farmers included. That includes the everpopular Kubota stock: small tractors with loaders; mowers; brush-hogs; rototillers and skid steers for excavating and moving material in buckets. “In the 70s and 80s, Marshall was selling mostly the 100 horsepower tractors needed by farmers,” said
Coar. “Now, for the homeowner doing maintenance, we sell 40 to 50 horsepower tractors.” Still, “farmers are a significant part of our population,” said Coar. “They are very much involved here.” Tabbed an essential business during COVID, Marshall Machinery's parts, service and rental departments have roared with business since March. “People were stuck at home home doing doing projects around the
house and property,” noted Coar. “They'd call us up, we'd send out, for example, a small excavator they wanted to rent. Our trucking department would bring them the piece of equipment that had been cleaned with disinfectant and then go back and pick it up for it to be cleaned and disinfected for the next person.” “At first it was awkward to not let people in the building,” said Coar. “But we got used to it.” Even now, with the store reopened, many customers find CONTINUED ON PAGE 6H

How can landlords and renters navigate the current pandemic? BY SAMUEL C. BERGSOHN, ESQ. ASSOCIATE ATTORNEY, JACOBOWITZ AND GUBITS, LLP ince mid-March, the Hudson Valley, New York State, the nation and the world have been coping with the COVID-19 pandemic. Across the state, one of the most significantly impacted areas has been residential rental agreements. Albany has taken important steps to address the crisis renters have been and will continue to face. On March 20, Governor Cuomo issued Executive Order 202.8, which stopped all eviction matters and service of eviction warrants for 90 days, through June 20. Then on May 7, the Governor issued Executive Order 202.28, which extended the pause on evictions for another 60 days to August 20, but only for renters who can show that they have been impacted directly by the pandemic. The state has not provided direction on how renters will be expected to make that showing. Many local justice courts throughout the region remain closed and eviction filings in those jurisdictions will be predicated on when those courts can open back up and in what capacity. Another important provision from Executive Order 202.28 is that tenants may now choose to have their security deposit applied toward overdue rental

payments. If the tenant chooses to do this, the landlord must agree, the agreement must be in writing, the tenant must replenish the deposit at a rate of 1/12 the deposit amount applied per month, any remainder is forgiven if the agreement does not cover the entire amount applied, and the repayment shall not become due until 90 days after the deposit is applied. Recently, on June 18, the Chief Administrative Judge for the New York State Courts, Lawrence K. Marks, provided further instructions for eviction filings as the courts begin to re-open. First, all proceedings may only be filed by mail or the state’s electronic filing system. Next, all eviction filings

will require either an attorney’s affirmation or a petitioner’s affidavit stating that the filing is in compliance with all of the Governor’s Executive Orders, as well as a notice to the tenants stating, in part, “during the coronavirus pandemic, you may be entitled by law to take additional days or weeks to file an answer to this petition.” Finally, the memorandum continued the Chief Administrative Judge’s pause on all eviction proceedings in the State, which is actually separate from the Governor’s Executive Orders. And so even after August 20, when the Governor’s pause on evictions ends, justice courts will still need direction from the Chief
Administrative Judge that such proceedings may resume. Now, with all of the uncertainty surrounding eviction proceedings, what should landlords and renters do? My first suggestion is always to tell landlords and renters to talk with each other! If possible, try to work out an agreement so that both parties can hopefully continue with their contractual relationship on good terms. If there is no avoiding an eviction, landlords may still send out the initial notices required to begin such summary proceedings. It is important for renters to realize that rental payments due during this time have not been forgiven and will still be owed to their landlord.

Horton-Malone Architecture anticipates growth, and finds it

by Matt Shortall hile the COVID-19 pandemic may have negatively affected some businesses, there are hopeful signs of growth in Sullivan County. Horton-Malone Architecture, DPC is a family-owned business in Wurtsboro that has not only survived but recently expanded. They work with both residential and commercial clients through all aspects of the building process - from a simple residential design to the final stages of commercial construction.

Established by Architect John C. Horton, the firm has been working in Sullivan County and the surrounding areas for over 30 years. They recently expanded from Horton & Associates to HortonMalone Architecture with the addition of Architect Kevin Malone joining the team. Jaclyn Horton-Jennex took over the business when her father, John, passed away in 2014. Since that time, she’s kept the family business going while remaining true to John’s vision. “It’s getting better and better each year,” said Horton-Jennex. “They were large shoes to fill,” said Malone about John. “Everybody
loved him. If we can carry half as much love into Horton-Malone then we’re doing alright.” Malone agreed that they carry much of the same spirit and vision of the original firm that John started, and he would be the first to say he shares a similar design sense and a deep-seated respect for clients. “That’s why it’s been a perfect fit,” Horton-Jennex agreed. “The business has seamlessly run in the same manner it did for all those years when my Dad was running it.” Horton-Malone Architecture may be a smaller firm, but HortonJennex believes that works in their favor. “We can work with our clients more one-on-one and on a regular basis,” she said. “We’ve been lucky to have some really intriguing projects and clientele,” Malone concurred. Horton-Malone Architecture was chosen to construct the new Wurtsboro firehouse in the Village of Wurtsboro. The new 17,000-squarefoot firehouse, approved by fire district voters in 2019, will be about double what the fire department previously had. It will be OSHA compliant, feature bathrooms and showers for men and women, a HAZMAT wash area and an improved exhaust system, as well as parking for the ever-growing equipment needs.
For Horton-Jennex, being able to help build a new firehouse in her hometown is particularly fulfilling. “It’s nice that the commissioners and the fire department recognized that they wanted to work with a local firm. It benefits them (and us) having the architect across the street from the job site,” Malone said. The things they build are meant to last. Horton-Jennex said she enjoys all the projects they work on, but being able to drive around and see the buildings that they’ve designed, gives a deep sense of satisfaction. Malone said when he was in school he had a vision of getting a large map of the tri-state area and placing a pin next to every project he’d worked on. “It didn’t take long before that became an impossibility because there have been so many projects over the years,” said Malone. And the number of projects they’re taking on at Horton-Malone Architecture has only been growing. “We’re going gangbusters,” said Malone. “There hasn’t been any slow down whatsoever,” Horton-Jennex affirmed. According to Malone, they’re already seeing more people and more development moving up from New York City from people recog-
