Travel: Know yourrig ht s A client guide to Travel Law Despite competition, holidays are not cheap Some of us save for many years for that ‘once in a lifetime’ holiday or a special event such as a honeymoon. The most important factor that differentiates a holiday from any other product is that you cannot see it, experience it or inspect it before you buy it. If it all goes wrong, you cannot take it back to the shop and exchange it for another one. You can only rely, therefore, on what you are told by a travel agent or what you see from a holiday brochure or over the Internet.
What you should do when things go wrong Whatever the problem, it is important to bring it immediately to the tour operator’s notice or report it to the local representative. If you wait until you arrive home before you complain, you could technically be in breach of contract. If the representative acknowledges your complaint, obtain proof by getting a copy of the complaint form. Record dates and time and make a note of any person (hotel manager, staff and representatives) that you speak to.
Keep evidence of your problem Take photographs or a video. This is crucial if you feel you have a complaint. 14 SCENE
Retain receipts if you incur unnecessary expense. If you are ill or have an accident, try and obtain medical evidence. If you are too ill, try and get a friend or relative to get this information for you. Make sure you get names of any doctors who treat you and the address of any clinic or hospital.
What you must do when you arrive back in the U.K. You must immediately put your complaint in writing to your tour operator. The booking conditions usually specify a time limitation in which to register your complaint with them. It may be anything from 6-8 weeks from the date that you return to the UK.
Bringing a claim Generally, if you wish to recover damages under the holiday contract then you can sue the tour operator for breach of contract. It is possible to bring a claim for what is known as “loss of bargain”. This means what you actually received compared with what you contracted and paid for. In holiday contracts, the law has recognised a claim for loss of enjoyment. This may include anxiety, distress and inconvenience. This is especially important in respect of holidays involving honeymoons and anniversaries.
A fair solution You may also be able to claim out of pocket expenses, for example, the cost of a taxi fare when airport transfers have not been provided. In many situations, it is a case of negotiating a level of compensation with your tour operator. Remember though, that a tour operator is a business and it will not pay any more than it has to. If you feel particularly aggrieved and feel that you are getting nowhere, you should have the choice of pursuing your case through the Court system. However, the standard booking conditions may include an “Arbitration Clause” in the contract. It is therefore advisable to always seek legal advice before issuing court proceedings.

Best known for their roles as judges on BBC’s Masterchef and Celebrity Masterchef, John Torode, and Gregg Wallace took time out of their busy schedules to speak directly to Scene giving us an insight into their lives and backgrounds, what 2012 has to hold for them and BBC’s Good Food Show that is to be held in Bluewater, Kent, this April.

ohn torode and gregg wallace have become household names and faces through their years co-presenting the popular masterchef programme and are now influential figures in the uk’s culinary circuit. now in their 8th series, the phenomenal success of the show has sent the masterchef brand global with countries such as australia, india and israel, to name but a few, now hosting their own versions of masterchef, inspired by the uk’s format. John torode grew up in australia and moved to the uk in 1990. beginning his british television career in 1996 he spent 4 years as the chef on itv’s, this morning, serving up his culinary creations to the nation. opening his first restaurant in 2000, smiths of smithfield quickly became a successful fixture of the london food and bar scene with its fantastic choice of food and fabulous location. the lux, in old spitalfields market, is John’s latest acquisition and the complex, offering food, drink, music and much more, is once again in a trendy, historical london location. his love for food and passion for british produce has not only inspired him as a great chef and presenter but also as a well-known Food writer and published author. gregg wallace grew up in peckham, south east london, and opened his own company selling fruit and vegetables in 1989 at the age of 24. beginning his radio/television career on bbc radio 4 co-presenting talk veg for 7 years, he then went on to be the original presenter of saturday kitchen in 2002. in 2010 he opened wallace and co a cafe retail project in south west london, and has just opened his latest restaurant, gregg’s table, in the bermondsey square hotel, se1, where we wish him every success. gregg has co-presented masterchef: the professionals with michel roux Jr. uniting as co-presenters on masterchef goes large in 2005, John torode and gregg wallace have now become the recognised duo of food, the ant and dec of the kitchen some might say. so well known for their pairing, John and gregg found themselves the first duo to ever present have i got news For you in 2011. loved, feared and admired for handing out their brand of criticism, feedback, advice and support

to hundreds of hopefuls, John, Gregg and Masterchef have become addictive viewing across the nation. I asked them both why they felt Masterchef had become so popular and their answers were very similar. “We all have an association with food in some form as we all eat, its as simple as that” and “The show is a celebration of people’s success, proof that anyone can achieve their goals and most importantly, it’s honest, what you see is real, not staged. We put a camera in their faces and say cook”. When speaking to John, I was curious to find out where this passion for food came from. I was told he grew up with his grandmother and she was a great influence. John said, “I always cooked with my grandmother, from the age of five and she taught me the basics. From there I realised it was something I enjoyed”. Asking Gregg the same question, he said, “When I started selling my produce to restaurants, I got my first taste of the restaurant scene and I realised I loved it, it opened doors to food for me I hadn’t necessarily considered before”. I was curious to know more about John and Gregg, so probed a little deeper into their lives. Asked their favourite foods, John replied, “Beef is my thing, I love it in any form: cooked, raw, sliced or whole, any form will do. I also love Thai food. Growing up in Australia it had an influence on me, similar to growing up in the UK where you are influenced by European food”. Gregg is known from the show as the pudding man so he surprised me with his answer, “My favourite is a leg of lamb with rosemary”. I then asked, “if you could have any 4 people for a dinner party, dead or alive, whom would you invite?” John told me he has cooked for Princes, Prime Ministers and Celebrities and, if he were to sit down for a meal with 4 people,
he would like them to be good friends and family. Gregg on the other hand answered, “I would choose Alexandra The Great, The Duke of Wellington, Marilyn Monroe and The Cadbury’s Bunny!” Asking them both what advice they would you give to someone aspiring to enter the food industry and become a chef, Gregg replied, “get a job in the best kitchen you can, work for free if you have to, struggle and suffer and work your way up”. John’s response was similar. “knock on ever door, start at the bottom, wash the pots, do the clearing up, listen and watch, take everything in and work your way up”. Finally, I asked what does 2012 have in store for the both. John told me he was concentrating on Masterchef, on enjoying what he does and on the BBC’s Good food Show coming up in April. For Gregg 2012 is a big year, his newest restaurant opened at the end of February and he has an autobiography coming out, due to hit the shelves in time for Christmas. When speaking about April’s BBC Good Food Show, Gregg said, “I am excited about the event being held at Bluewater as I shop there myself”. BBC’s Good Food Spring show will be held in Bluewater on April 12th-15th. The show will bring to life some of the nation’s favourite TV programmes. Saturday Kitchen Live sessions, hosted by James Martin, will feature celebrity guests to give visitors their food heaven and food hell. MasterChef will be brought to life with live sessions from John Torode, Gregg Wallace and a whole host of past contestants and winners. There will also be producers of fine food and drink, ultimate suppliers of the best kitchenware and live cookery demonstrations from some of the countries best loved Chefs, including, of course, John and Gregg themselves.

e have all seen the adverts on tv about digital switch over but what does it really mean? on the 4th, april 2012, london is going digital. the existing analogue tv signal will be switched off and replaced with a new, stronger digital tv signal. it will mean that almost everyone will be able to receive digital tv through an aerial (Freeview). digital tv also uses less broadcast space which means that after switchover, there will be more room for new services such as wireless broadband, local tv and high definition television (hdtv). to keep your tv service, you will need to convert your tvs to digital before your area’s switchover date. however, this will mean you will have a separate box plugged into your existing tv set and you will require another remote control. at rgb they pride themselves on service and helping their customers every step of the way towards purchasing their new tv. the majority of people like things simple and don’t like the idea of two separate remote controls for their television. this is why all sets at rgb are fully digital ready and only require one remote control. on selected tv sets, you can also receive high definition channels

I was extremely excited when I received the phone call asking me if I would like to review the famous French/seafood restaurant, La Rascasse, located on Beckenham’s High Street. Having regularly walked and driven past the restaurant, which always looked busy and glowing with atmosphere, dining at La Rascasse had been on my to do list for a while. The restaurant is best described as a trendy, Manhattan jazz bar meets modern, Parisian bistro .With its chocolate brown leather banquettes, exposed brick walls and simple bentwood chairs, this elegant spot is perfect for business entertaining, dates and get-togethers with friends. La Rascasse also has three bars and a covered terrace, which makes it popular with the glossy after-work cocktail crowd and the menu – from the natural oysters and classic moules mariniere to the roasted Burgundy snails and the fillet of seabass with a shrimp risotto and vanilla sauce – has a distinctly French flair. Connoisseurs adore the wine list, which has an extensive French-led selection of whites, red and champagne. Upon entering La Rascasse, we were greeted by our charming and friendly waiter for the evening who quickly showed us to our table in a comfortable corner of the restaurant. We were promptly asked by the waiter for our drinks order and presented with Melba toast and tapenade as an apéritif. Since it was week night, my collegue and I both opted for soft drinks. However, there SCENE 41
was a vast choice of beers, wines and spirits on offer should we have fancied an alcoholic beverage. Once settled in the cosy environment, we perused the menu and found we were spoilt for choice by the array of mouth-watering starters, mains and side dishes on offer. Once again, our waiter approached us to take our order and recommend his favourite dishes. We opted for the Black Tiger prawn, scallops and squid with aubergine compote and the grilled Quail Risotte with crispy pancetta and veloute sauce to start, followed by the Hanger Steak with red wine shallots and fat fries. Our food arrived quickly and was served steaming hot. Each dish seemed to be more flavoursome than the last with my personal favourites being the Quail Risotte with crispy pancetta and veloute sauce, which was incredibly tender and tasty, and the Hanger Steak which was yummy and complemented the starter perfectly. It is clear that La Rascasse pride themselves on friendly, professional service and the quality of their food made for a superb dining experience. With choices from Oysters, Seafood Platters and Sea Bass to Angus Fillet, Venison and Lamb, together with daily changing specials, there truly is something for everyone. On Sundays, you could sample the popular Three Course Sunday Lunch which is available from noon until 9.30pm. A perfect venue for entertaining with a winning combination of fine dining in the restaurant together with an ideal place to have fun in the bar. The lively bar serves food all day, ranging from delicious Baguettes and Salads to grilled Lamb Cutlets and Home-made Burgers. There is also a Patio Garden with an exclusive VIP area available for hire. La Rascasse is a friendly place for an intimate meal or a party with friends that should not be missed.

4.5 seconds and 299 km/h for the cabriolet. the overall appearance is low, wide and sleek. typically 911. so, is everything just the same as it has been since 1963? yes, and no. after all, only those who change will remain true to themselves – and they’ve changed. looking at the car’s exterior, the wheelbase of the new 911 is 100 mm longer for improved driving stability and cornering dynamics. overhang is now shorter at the front and rear, making the new 911 look even more compact. the sporty overall impression is emphasised by the lower roof line and a wider track at the front – 46 mm on the 911 carrera models and 52 mm on the 911 carrera s models. For improved aerodynamics, the exterior mirrors are now mounted directly on the doors. increased agility is just one of the results of all these refinements. on the inside in addition to the choice of black, platinum grey, luxor beige and yachting blue for the interior, there is a wide range of other personalisation options available, including two-tone colour combinations or special colours and materials such as carbon, aluminium or high-quality wood. engineering and style – and porsche identity on the inside, as demonstrated by the new elevated centre console. in typical porsche fashion, the use of form follows a basic principle: focus on the driver. this is why the distance between the gear lever or selector and steering wheel is extremely short and the operating logic, such as that of the two-zone air conditioning system or the suspension settings, is clear and uncomplicated. you shouldn’t have to browse one submenu after another. you should instead be able to concentrate on what’s important: the road. 46 SCENE
