What a year! We have bargained together for new Agreements. We’ve campaigned together to Change the Rules for fair workplace laws; to demand respect and an end to customer abuse; to work through the bag ban with Don’t Bag Retail Staff; to keep pushing for the return of Boxing Day in Take The Time; and for penalty rates, including very recently actually winning an increase in penalty rates for casuals on weeknights and Saturdays in the Retail Award and in new Agreements! We’ve fought together for individual members’ issues. All the thousands of roster disputes we take up together. The tens of thousands of members’ questions we answer. The underpayments we fix (into the millions of dollars reclaimed). Helping injured workers with workers compensation. The unfair dismissals, the redundancies and the reinstatements. In all of these issues, members’ needs have been the focus of the SDA. And what are our members’ key needs? They need fair pay. They need safe and respectful workplaces. They need time away from work with loved ones. That is what we are focused on!

Bargaining Thanks to members and Delegates strong and united support we have been delivering new Agreements based on SDA members’ four key priorities: Ê Protecting take-home pay Ë Improving penalty rates Ì Securing hard-won SDA Union conditions Í Ensuring pay rises for all members throughout the life of the Agreement. All of our new Agreements have delivered on these four key priorities, and won new conditions too. First we delivered it in Coles, then in Woolworths, Priceline, The Reject Shop, various IGAs, David Jones and Kmart.

I would like to thank all SDA Delegates for their hard work and strong workplace leadership in securing these new Agreements. Levels of support for the new Agreements have been overwhelming because they are good Agreements. There are so many more Agreements to renegotiate, too.

Customer Abuse Customer abuse is a problem in our industry, and it is not acceptable. Abuse is not part of the job! Last year, we launched a campaign to address customer abuse — No One Deserves a Serve. The first stage was a public awareness campaign online, on radio, on billboards, on trains and on TV. In the lead up to this Christmas, we are again running a public awareness campaign. Keep an eye out for the campaign. Customer abuse is a complex problem to address. To get real change requires the public to change their behaviour and employers to accept there is a problem of customer abuse. We recently brought together our members with major employers, industry peak bodies, community groups and government organisations from across NSW to work towards industry-wide solutions. The aim is to run trials early next year of practical methods to reduce customer abuse. This is the next step in what is a long and ongoing campaign to address customer abuse, and return respect to the shop floor. Christmas Day and Boxing Day Trading Hours Part of customer disrespect comes from some customers’ sense that we should always be there at their beck and call whenever they feel like shopping, even on days when we should be home with our families. The fight is not just about Boxing Day — now Christmas Day is under threat as well. Not satisfied with Boxing Day trading, Woolworths has applied to have people working on Christmas Day! We have strongly opposed their outrageous application.

Woolworths profits from the idea of big family gatherings on Christmas Day, making it even more disgraceful that they are cutting out their employees from Christmas and making them stack shelves. We will not stop until Woolworths give their workers back their Christmas. Gladys Berejiklian and her NSW Government has to take responsibility for this situation. They have made it very clear that they want to remove trading restrictions on important days like Boxing Day, and they know that retailers will not stop until they can trade 365 days a year! This Woolworths application is an example of that. You work so hard in the lead up to Christmas Day that you deserve, and need, two days off to properly celebrate with family and friends — both Christmas and Boxing Day. The only way we can fix this is to shut the shops again. thank you 2018 has been a busy year, a year where the SDA has delivered for members. Together we have been bargaining, campaigning, taking up issues and winning. Together, every day, we work for dignity and respect for all members in all workplaces, for all retail, fast food and warehouse workers. None of this is possible without the loyal members, the supportive Delegates and the dedicated staff. I thank all of you for your support this year. We finish this year a bigger and stronger Union than at the start of this year as we engage in bargaining across our industry. I wish you and your families a very happy Christmas and an even happier Boxing Day. If you are travelling over Christmas or the New Year, may it be a happy and safe time. While most people across NSW are spending valuable time with family and friends this Christmas, many thousands of workers will be compelled to give up their family time as a direct result of the Berejiklian Government’s decision to allow trading on Boxing Day.

Gladys Berejiklian and her NSW Liberal Government has to take responsibility for this. They made it very clear that they want to remove trading restrictions on important days like Boxing Day, and they know that retailers will not stop until they can trade 365 days a year!

Opening stores on Boxing Day just robs people of valuable time with their families. There is no economic argument for opening shops on 26 December. While work on Boxing Day is meant to be ‘voluntary’, the reality is that’s not the case. Getting together on Boxing Day is a great Aussie tradition — playing backyard cricket, or heading to the beach, or sharing a BBQ snag with family and friends. It should not be a day when workers are forced to work a cash register or stock shelves. The sales can wait until 27 December. your public holiday entitlements The following is a general explanation of public holiday entitlements and trading hour arrangements for shop assistants working in general by Robert Tonkli, shops in NSW this Assistant Secretary festive season.

CHECK YOUR AGREEMENT It is most important to note that the specific entitlements with respect to public holidays are governed by the Agreement or Award applicable to your employment. Depending on which company you work for, there may be some differences in the rights outlined below. Check your specific Agreement or Award or contact the SDA to ensure your workplace entitlements are observed. If you have any questions about your public holiday entitlements or trading arrangements, please speak to your Delegate, contact your Organiser, or phone the SDA on 131 SDA (that’s 131 732). CHRISTMAS DAY Christmas Day, Tuesday 25 December is a public holiday in NSW. The Retail Trading Act provides that only shops with a valid trading exemption can open for trade on Christmas Day. In addition, the Retail Trading Act provides that all work performed on this day is strictly voluntary. This includes take away shops and service stations. If your shop is permitted to open, you can only work if you choose to volunteer. It is not permitted by the Retail Trading Act to roster you to work on Christmas Day unless you volunteer to do so.

Where a shop does not have an exemption to trade on Christmas Day, it is not permitted to engage a shop assistant to perform work behind closed doors. BOXING DAY Boxing Day, Wednesday 26 December is a public holiday in NSW.

The Retail Trading Act provides that where shops open, they must do so on the strict condition that employees have freely elected to work on the day. This includes take away shops and service stations. If your shop opens on Boxing Day, you have an absolute right to refuse to work on the day. NEW YEAR’S DAY New Year’s Day, Tuesday 1 January is a public holiday in New South Wales. AUSTRALIA DAY PUBLIC HOLIDAY Monday 28 January is the Australia Day public holiday in NSW. Saturday 26 January is not a public holiday in NSW. This is because the Public Holidays Act 2010 provides that where Australia Day falls on a Saturday, the following Monday is declared a public holiday. DO you HAVE TO WORK ON A PUBLIC HOLIDAY? Most Agreements negotiated by the SDA provide that all work on a public holiday is voluntary for all employees, including casuals. Full-time and part-time employees who are rostered on but refuse to work receive the benefit of the public holiday at their ordinary-time rate of pay. For employees covered by the General Retail Industry Award, public holiday entitlements are covered by the National Employment Standards (‘the NES’).

The NES provides that an employee is entitled to be absent on a public holiday, however, an employer may request that an employee work on a public holiday if the request is reasonable.

If your roster is changed to your detriment over the Christmas/New Year period, or if you are not paid correctly, you should contact the Union immediately. If you are rostered to work on a public holiday but you are sent home early, it is the Union’s position that you must still be paid for the total number of hours that you agreed to work. This applies even to casuals. If you are sent home early and not paid for the full hours you were contracted to work, you should contact the Union without delay. PUBLIC HOLIDAYs FALLing ON NON-ROSTERED DAYs If you are covered by a Collective Agreement, this will depend on the specific provisions in your Agreement. However, for members employed under the General Retail Industry Award, no non-working-day benefit applies. This means that if you are not rostered to work on a public holiday, you will not be entitled to the payment of an additional day’s wages. Retail workers work so hard in the lead up to Christmas Day that you deserve, and need, two days off to properly celebrate with family and friends — both Christmas and Boxing Day. You need two days for so many reasons: So you can travel safely to enjoy time with family who live some distance away;

Maybe you spend one day with Mum and one day with Dad;

u

Maybe it’s one day with your immediate family and the next with extended family; or

u

Simply because you want two days off in a row with your family to relax and enjoy each other’s company.

u

Whatever the reason, retail workers need two days off because Christmas just isn’t Christmas without Boxing Day!

You have the right to refuse!

You shouldn’t have to close down your family life on Boxing Day just because your employer wants to open the store. You have an absolute right to refuse to work on Boxing Day. While stores may be able to trade on Boxing Day this year across NSW, all retail and fast food workers have the right to refuse to work on Boxing Day. You have the right to have the day off. It is illegal to pressure you into working. Your store is only allowed to trade if employees have volunteered to work. We understand there is real pressure to work on the day, but you will have the 100% support of your Union if you want Boxing Day off. If an employee is forced to work on Boxing Day, their employer may face a fine of up to $11,000 for each employee forced to work on the day. If you feel in any way pressured to work on Boxing Day, please report it to the SDA by email or by calling us on 131 732. Boxing Day belongs to you and your family. Just say “no” to work on Boxing Day.

Building on the support from running last year’s No One Deserves a Serve public awareness campaign, the SDA is again running a national advertising campaign calling on customers to check themselves before they checkout. This year’s campaign builds on last year’s and includes another ad which highlights that fast food workers demand to be treated with respect too! It’s disappointing that we need to run a campaign to remind people not to be abusive, but unfortunately it’s necessary — particularly during the Christmas period. The ads will run through the December Christmas rush and into the busy January sale period to remind customers to keep their cool. You can see the ads at http://bit.ly/NODASFastFood.

After being impressed by last year’s campaign, the ACT Government is joining forces with the SDA to remind shoppers to keep their cool at the check-out this festive season. In November, ACT Minister Rachel StephenSmith joined SDA Delegate Catherine Hooper and SDA NSW & ACT Secretary Bernie Smith in launching ACT materials to educate customers about the epidemic of workplace abuse and their responsibility to keep their cool. There are also materials to inform retail workers of their rights. All the material was co-badged with the SDA, Access Canberra and the ACT Government. The materials have also been made available in three additional languages — Hindi, Vietnamese and Chinese.

In the lead up to Christmas, we have

been very busy working with NSW safety regulators, the ACT Government, industry associations and concerned employers on ways to prevent bad customer behaviour in fast food and retail shops. We know that Christmas isn’t always all carols and mistletoe and that people get stressed and frustrated during the festive season, but we want to remind customers that they have no right to take their frustrations out on retail and fast food workers who are simply trying to do their job. An important part of the campaign is to remind workers of their rights in the workplace. Workers often feel intimidated and unsure as to what they can do if they’re abused by customers. The SDA will support you, and the ACT Government will, too. It’s great that the ACT Government has got behind this campaign — it just goes to show how seriously the government is taking the issue of customer abuse. SDA & iCare NSW host industry meeting

As part of our strategy to deal with the epidemic of abuse and violence in the workplace we recently brought together our members in NSW with major employers, industry peak bodies, community groups and government organisations from across NSW to participate in a landmark Roundtable meeting to work towards industry-wide solutions. The meeting was attended by iCare NSW, SafeWork NSW, the National Retail Association, the Shopping Centre Council, Woolworths, Coles, Kmart, Aldi, The Reject Shop, David Jones, McDonald’s, petrol station operators and many more retail and fast food employers.

The power of our members’ harrowing everyday stories pushed all those involved to work hard to come up with practical solutions to a complex problem. Much remains to be done, but significant progress was made. The aim is to run trials early next year of methods to reduce customer abuse. The trials will be run by Griffith University and the outcomes properly measured. This will enable us to thoroughly evaluate what works. What does work will then be promoted throughout the industry. SDA wins better penalty rates for casuals

In September, the SDA won a major case in the Fair Work Commission (FWC) to increase penalty rates for over 350,000 by Robert Tonkli, Assistant Secretary casual retail workers on Saturdays and on weeknights after 6pm. As a result of this win, casual employees covered by the General Retail Industry Award will now receive penalty rates in addition to casual loading. First lodged in 2015, the SDA’s application to lift casual rates in the General Retail Industry Award was part of the Commission’s long-running review of Modern Awards. The increases to the General Retail Industry Award started from 1 November 2018 and will be phased in incrementally over three years (see table).

Fairness for casuals The FWC’s decision to approve the proposed penalty rate increases put forward by the SDA brings casual workers into line with the loading that permanent employees already receive.

These measures go some way to addressing the unjust treatment of casual workers under the Award — workers who are not properly compensated for the absence of sick pay, annual leave and the insecurity of their work.

Working for casuals

This will result in significant pay increases for over 350,000 hard-working retail employees on the Award, and will have important flow-on effects for employees on enterprise bargaining agreements right across Australia’s retail sector.

The SDA continues to fight to improve the wages and conditions for all our members, including casuals. It pays to be a member of the SDA!

A wider impact

We welcome the Fair Work Commission’s decision as a major win that will result in significant pay increases for hundreds of thousands of retail workers.

The win will flow on to SDA-negotiated industry agreements including the Woolworths Supermarkets Agreement (if it is approved by the Fair Work Commission) and the Coles Supermarkets Agreement.

This win means that casual workers covered by the Retail Award will receive casual loading on top of penalty rate loadings for weeknights and Saturdays.

The increase to casual penalty rates is another example of the SDA and its members continuing to stand up for fair pay and for an increase in wages.

Earlier this year, the SDA, along with Australian Unions, also won the right for casual employees to formally apply for permanent work and overtime rates of pay for casual employees in relevant Awards.

The new recruitment drive, which is being rolled out via social media is a response to research which found young workers had very limited knowledge of their rights or the role of unions in helping them with their workplace problems. A large number of young people barely know unions exist, let alone how they can help, or why they should join one. Additionally, research from the University of Sydney found that 25% of student retail workers were being underpaid, and 35% were not receiving the correct weekend rates. The SDA has taken a ‘back to basics’ approach with our new campaign, providing simple, easy to understand information about workplace rights, what unions are, and what they do. social media campaign In order to provide this information, we want to reach young workers where they currently are, and that’s on Snapchat, Instagram and, to a lesser degree, Facebook.

Other videos explain basic workplace concepts like wages, weekends, annual and equal pay and are designed to speak with young workers at their level. young worker hub In addition to our activity on social media, the SDA has also developed a young worker hub called 100% Pay (100percentpay.com.au) to provide reliable information on workplace rights and how the Union can assist. The hub is a place where young retail and fast food workers can go for simple and clear information about their basic rights at work. To get them started, we’ve provided a quick quiz on their six basic rights at work. If a young worker finds they are not receiving what they’re entitled to, they can get in contact with the Union. The SDA’s new focus is consistent with the ACTU’s drive to recruit and assist young workers, which was discussed at the ACTU triennial Congress in Brisbane earlier this year.

SDA & TWU FORM ONLINE RETAIL & DELIVERY The SDA and the Transport Workers’ Union (TWU) have set up the Online Retail & Delivery Workers Alliance — an alliance aimed at bringing fair standards to the growing online industry. The move to build the Online Retail & Delivery Workers Alliance comes as: u The SDA starts proceedings in the Fair Work Commission for a member sacked from work at an Amazon Fulfilment Centre. u Retail unions globally in UNI, including the SDA, have formed the global Amazon Alliance. u The global unions for retail workers and for delivery workers, UNI and International Transport Federation, have agreed to work closely together to organise Amazon.

The SDA and the TWU will work together to organise online retail and delivery workers to secure collective bargaining, fair pay, secure work, workers compensation, leave entitlements and a safe working environment. The Alliance will bring together all workers in the online retail businesses, no matter how they are hired, to improve their working life. Already over 2,000 workers in online retail in NSW have joined the SDA, the online retail workers union. Combining this with delivery drivers, the Alliance takes co-operation between the SDA and the TWU in this area to a new level, as part of global union moves to provide security for workers in the online retail industry. While new and innovative ways of working are always welcome, what will never be welcome is old-fashioned exploitation dressed up in shiny ‘new economy’ clothing. we don’t want this here The Friday after Thanksgiving is called ‘Black Friday’ in the United States, and is associated with retail discount sales both in stores and online. It is a phenomenon that has recently spread to Australia. This year, Black Friday across the world was not just about mark downs, it was also marked by protests. Amazon was particularly in the spotlight over poor working conditions, with workers across Europe and the US holding demonstrations on Black Friday. The UK’s GMB union revealed that ambulances were called out 600 times to 14 Amazon warehouses over three years, with one pregnant woman forced to stand for 10 hours a day. We’ve seen shocking examples of workers in online retailers overseas subjected to appalling working conditions.

We can’t afford to let that happen in Australia, which is why we’re taking the unprecedented step of joining together with the TWU to maximise our capacity to protect workers in the industry. Workers at Amazon Fulfilment Centres in Australia have been joining the SDA, despite employment arrangements where online retail workers are employed in insecure work through a labour hire agency, Adecco, rather than being directly employed by Amazon. They are joining the SDA even after the labour hire agency made it clear that they didn’t want any caps or lanyards with union logos on the premises. Underpinned by a healthy labour market and strong consumer confidence, the US recovery is now the second longest on record. However, valuations of almost every asset type seem expensive in the context of both the long-term economic outlook and historical averages. This makes the investments susceptible to volatility. At the same time, ongoing US-China trade tensions, as well as inflation and interest rate hikes thanks to unexpectedly strong US growth, could pose a key threat to the global economic outlook. In Australia, record household debt and a cooling housing market are good reasons to stay vigilant and adopt more defensive investment settings. Currently, the Rest Core Strategy has about 10% less exposure to share markets in comparison to the median balanced superannuation fund. Rest is also holding 4% more in cash than the median fund. These positions mean, that if and when markets correct (fall), this will reduce the impact of share market losses to members and allow Rest to purchase shares and other assets at cheaper prices, thereby setting members up for stronger gains when the market rises again.

Myth busting long service le Most people know

However, there are some aspects of long service leave that a lot of people have misconceptions about. Below we deal with three myths relating to long service leave in NSW. Please note: the information in this article relates to long service leave in NSW only — see box below for ACT arrangements.

MYTH

1

Only permanents get long service leave

Wrong! In NSW all employees are entitled to long service leave. Casual service counts towards service for the purpose of long service leave. So if you work for two years as a casual and then eight years as a permanent, that counts as ten years’ service and you are entitled to long service leave.

Payment is based on the hours you have worked over your employment

When you accrue long service leave, you accrue it in weeks, not hours. So after 10 years’ service, you have 8.67 weeks long service leave. When you take long service leave or have it paid out on termination, it is paid out on the basis of your “ordinary pay”.

Ordinary pay does not include any overtime, penalties or loadings. For full-time employees, your ordinary pay is the greater of the following: u your weekly pay at the time the leave is paid; or u your average weekly pay for the past five years. For casual and part-time employees that work irregular hours, your ordinary pay is the greater of the following: u your average weekly pay for the past twelve months; or u your average weekly pay for the past five years. The upshot of this is that it doesn’t matter how many hours you were working 10 years ago. It only matters what hours you have worked recently.

Facts about long service leave in the ACT In the Australian Capital Territory, all employees are entitled to long service leave, including casuals. When? Employees are entitled to long service leave after seven years’ continuous service. Employees are entitled to the equivalent of one month long service leave for every five years of service.

How much? Payment of long service leave is at the employee’s “ordinary remuneration”, which does not include penalties or loadings, but does include some allowances and bonuses. For a full-time employee, ordinary remuneration means their weekly wage or salary at the time the leave is paid.

Leave is taken at a time agreed between the employee and the employer.

For a part-time or casual employee, ordinary remuneration is based on the average number of hours worked by the employee over the last 12 months.

However, an employer can give an employee notice in writing that they must take leave after 60 days from the date of the notice.

If a casual or part-time employee has been employed full-time sometime in the last two years, then the ordinary remuneration is based on an average over the last five years.

So be careful about when you take your long service leave to make sure you maximise the benefit. For example, you could have spent the first 20 years of your employment working full-time, then decide as you reach retirement to drop to part-time for your last five years. In that circumstance, your long service leave is paid out using an average of your part-time hours, not your full-time hours. You would receive more pay if you took the long service leave before dropping your hours. Long service leave MYTH only gets paid out on if you have 3 termination been employed for ten years or more

Usually this is right. However, there are some circumstances where you can get your long service leave paid out if you leave after five years. If you have between five and ten years’ service and you resign, your long service leave should be paid out if you have resigned because of: illness or incapacity; or u a “domestic or other pressing necessity”. u

A domestic or other pressing necessity can include things like having to take care of a sick or injured family member, or having to move interstate due to family circumstances. You can also be paid out long service leave if you have between five and ten years’ service and you are dismissed by your employer. As long as the dismissal is not for serious and wilful misconduct, the long service leave should be paid. If an employee dies with more than five years’ service, their pro rata long service leave should be paid to their estate.

Often this can mean reducing hours of work, changing rosters or changing the type of job. It is important for workers in these positions to understand their rights and obligations. Changing between full-time, part-time and casual work Generally, workers are employed on either a full-time, part-time or casual status. Your contract of employment will usually state under which status you are employed. If you want to change your status, you will need to talk to your employer about the process. Unless there is a specific provision in an enterprise agreement, you will not usually have a ‘right’ to switch between full-time, part-time and casual employment. So you will need to reach agreement with your employer to do so. The same goes if you want to change the amount of hours you are employed for under a part-time contract. Even if your employer agrees to let you change to a casual status, remember that casual workers do not have a ‘right’ to be rostered for shifts. So be careful if you are changing your status to casual. What rights do workers have to change? Sometimes there are provisions in enterprise agreements and Awards that assist workers in changing their employment status. For example:

For example, a Department Manager who wants to step down to a shop assistant would not have a right to do so. They would have to get agreement from the employer first.

Stepping down Another situation that can arise is when a worker wants to step down from one classification to another. Unless there is a specific provision in an enterprise agreement, you will not usually have a ‘right’ to step down to a lower classification.

Only resign if you are certain that is what you want to do. Make sure you contact the SDA for advice before you resign. In a recent unfair dismissal case, a leisure centre worker had decided to take up university study and asked her employer if she could change the hours she worked. The employer refused to give the worker the exact hours she requested because the business needs could not be met at those times. However, the employer offered to accommodate the worker by proposing new hours of work that fit with the worker’s availability but under a lower classification. The worker then resigned. The worker argued in the Fair Work Commission that she had been forced to resign because the employer acted unreasonably. The Fair Work Commission found the worker had not been unfairly dismissed because it was the worker who sought the change and the employer acted reasonably by taking into account the needs of the business. contact the sda Always contact us before you make a change. In addition to by Monica Rose, purchasing pink Industrial Officer ribbons for our Delegates, the Union held a fundraiser at the union offices. On the Friday before Grand Final Day, we held a charity breakfast in the SDA Training Rooms with special guest speaker Greg “Brandy� Alexander and Pink Ribbon Ambassador Karen Foster. This event raised over $5,000. Thank you to our many supporters. Thank you to all Delegates for helping this great cause. In total the Branch raised more than $10,000 for needed research.

The SDA has secured the use of the Park’s barbeque area for a BBQ lunch for our members, which will be held between midday and 1.30 pm.
