hope in a difficult 2019 has been a difficult year in retail. Low wages growth across the economy has kept customers’ wallets tight, which has made for a difficult environment in many retail workplaces, as well as the warehouses that supply those workplaces. We have faced a lot of challenges together this year: u fighting for pay rises and new Agreements; u dealing with company redundancies and store closures in Target, David Jones, Noni B, Sussans and Big W; u the distressing processes around the Woolworths restructure and redundancies; u the much-publicised problems in the Noni B Group of even going to the toilet; u underpayments for too many, from vulnerable workers to salaried staff; and u the issue of customer abuse and respect.

Hope Throughout all of the challenges in 2019, I keep coming back to one word – HOPE! I believe the SDA has represented hope for members in retail, fast food and warehousing. Together, SDA members, Delegates and Officials have worked to bring hope in a difficult environment. We have won new Agreements with increased penalty rates and pay rises that are above inflation and above the average pay rises across the private sector (see page 11).

We have secured better redundancy entitlements including recently for long-serving David Jones members who received up to 34 weeks of redundancy pay, as opposed to the General Retail Award standard of 12 weeks. We are also working through underpayment issues for members in a wide number of companies (see pages 8-9).

In Noni B and other companies, we are tackling the issue of workload (see page 22). There is a lot more to do in this area, but I must admit I am pleased every time I walk past a Noni B shop with the doors pulled shut and a sign that says “Back in 5 minutes”. I’m tempted to write underneath “Back in 5 minutes. Thanks to the SDA.” We continue to fight for secure work for casual members (see page 19). Perhaps the biggest dispute this year was with Woolworths and the restructure that we opposed in the Fair Work Commission. I want to give a special thank you to all of the Woolworths Delegates; you were a beacon of hope in your workplaces this year as we dealt with these issues. Together, we secured additional payments for members changing jobs or taking redundancy. We secured early releases for members who found other work, and we fought for full-time jobs where sometimes only parttime work was offered. Well done to all the Delegates, like Francesca at Leichhardt, who through your actions secured full-time work for members and gave them hope.

Reducing Customer Abuse I am particularly proud of all the members who have got involved in the No One Deserves a Serve campaign (see pages 14-17).

There is so much work to do, but again the SDA is bringing hope. The industry now accepts there is a big problem and is committed to addressing the issue and rejecting the position that the customer is always right. Importantly, SDA-led trials designed and measured by Griffith University have shown that a combination of training, zero tolerance of customer abuse and in-store signage resulted in up to a 50% reduction in low to mid-level customer abuse. Family Time: Have Boxing Day Off Don’t forget that all SDA members in NSW are entitled to have Christmas Day and Boxing Day off with family and friends.

It is illegal to be required to work if you did not freely elect to do so, and your employer could be fined up to $11,000. You have worked so hard in the lead up to Christmas. Take the time to enjoy both Christmas and Boxing Day with family and friends with the full support of the SDA (see pages 4-7). Hope amidst Bushfires and Drought It has been an even more difficult year for those affected by the crippling drought and ravaging bushfires.

As a small gesture of our solidarity for those people in regional NSW, SDA Delegates in Sydney recently raised over $6,000 to be donated to the Salvation Army Disaster Appeal, with a raffle of a music box that was hand decorated by 104-year-old SDA life member Bert Collins. Thanks Bert, and thanks to our Delegates for your generosity. We hope Christmas can bring some joy to these communities. Thank You In a difficult year, I want to thank all SDA members, SDA workplace Delegates and SDA Officials for your strong and united support. Together, we have delivered a lot for members, but most importantly we have delivered hope. So for this Christmas in 2019: u I hope customers practice peace and goodwill towards all; u I hope all members who are travelling are safe; and u I hope you have a great Christmas with your family and friends, but I really hope you take Boxing Day off too! The simple rule in NSW is this: you have an absolute right to refuse to work on Christmas Day and Boxing Day – it’s the law! If you say “no” to work on Boxing Day, fines of up to $11,000 apply to anyone who makes you work on Boxing Day.

Say “no” to work on Boxing Day!

Retail workers work so hard in the lead up to Christmas Day that you deserve, and need, two days off to properly by Bernie Smith celebrate with Branch Secretary family and friends — both Christmas and Boxing Day. That is why it is your legal right in NSW to have both Christmas Day and Boxing Day off. You need two days for so many reasons: u So you can travel safely to enjoy time with family who live some distance away; u Maybe you spend one day with Mum and one day with Dad; u Maybe it’s one day with your immediate family and the next with extended family; or u Simply because you want two days off in a row with your family to relax and enjoy each other’s company. Whatever the reason, retail workers need two days off because Christmas just isn’t Christmas without Boxing Day!

You have the right to refuse! You shouldn’t have to close down your family life on Boxing Day just because your employer wants to open the store. You have an absolute right to refuse to work on Boxing Day.

While stores may be able to trade on Boxing Day this year across NSW, all retail and fast food workers have the right to refuse to work on Boxing Day. You have the right to have the day off. It is illegal to pressure you into working.

Your store is only allowed to trade if employees have volunteered to work. We understand there is real pressure to work on the day, but you will have the 100% support of your Union if you want Boxing Day off. If an employee is forced to work on Boxing Day, their employer may face a fine of up to $11,000 for each employee forced to work on the day. If you feel in any way pressured to work on Boxing Day, please report it to the SDA by email or by calling us on 131 732. Boxing Day belongs to you and your family. Just say “no” to work on Boxing Day.

your public holiday entitlement The following is a general explanation of public holiday entitlements and trading hour arrangements for shop assistants working in general by Robert Tonkli, shops in NSW this Assistant Secretary festive season.

CHECK YOUR AGREEMENT It is most important to note that the specific entitlements with respect to public holidays are governed by the Agreement or Award applicable to your employment. Depending on which company you work for, there may be some differences in the rights outlined below. Check your specific Agreement or Award or contact the SDA to ensure your workplace entitlements are observed. If you have any questions about your public holiday entitlements or trading arrangements, please speak to your Delegate, contact your Organiser, or phone the SDA on 131 SDA (that’s 131 732). CHRISTMAS DAY Christmas Day, Wednesday 25 December is a public holiday in New South Wales. In New South Wales, the Retail Trading Act 2010 provides that only shops with a valid trading exemption can open for trade on Christmas Day, 25 December. In addition, the Retail Trading Act 2010 provides that all work performed on this day is strictly voluntary. This includes takeaway shops and service stations. If your shop is permitted to open, you can only work if you choose to volunteer. The Retail Trading Act 2010 does not allow work on Christmas Day without your agreement. Where a shop does not have an exemption to trade on Christmas Day, it is not permitted to engage a shop assistant to perform work behind closed doors.

BOXING DAY Boxing Day, Thursday 26 December is a public holiday in New South Wales. In New South Wales, the Retail Trading Act 2010 provides that where shops open, they must do so on the strict condition that employees have freely elected to work on the day. This includes takeaway shops and service stations. If your shop opens on Boxing Day, you have an absolute right to refuse to work on the day. NEW YEAR’S DAY New Year’s Day, Wednesday 1 January is a public holiday in New South Wales. AUSTRALIA DAY PUBLIC HOLIDAY, Monday 27 January is the Australia Day public holiday in New South Wales. Sunday 26 January is not a public holiday in NSW. This is because the Public Holidays Act 2010 provides that where Australia Day falls on a Sunday, the following Monday is declared a public holiday. DO you HAVE TO WORK ON A PUBLIC HOLIDAY? Most Agreements negotiated by the SDA provide that all work on a public holiday is voluntary for all employees, including casuals.

The NES provides that an employee is entitled to be absent on a public holiday, however, an employer may request that an employee work on a public holiday if the request is reasonable. An employee may refuse an employer’s request to work on a public holiday if the employer’s request is unreasonable. In determining if a request, or a refusal of a request, to work on a public holiday is reasonable, the following matters must be taken into account:

the nature of the work; u the employee’s personal circumstances, including family responsibilities; u whether the employee is entitled to receive overtime payments, penalty rates or other compensation for work on the public holiday; u the amount of notice given by the employer; u the amount of notice given by the employee when refusing the request; u any other relevant matter. u

WHAT DO you GET PAID? Typically, SDA-negotiated Agreements and Awards provide for the following entitlements: Full-time and part-time employees who are rostered to work ordinary hours on a public holiday and who agree to work are paid time-and-a-quarter plus their normal day’s pay (this is equivalent to double-time-and-a-quarter).

Full-time and part-time employees who are not rostered to work ordinary hours and who agree to work are paid at the rate of double-time-and-a-quarter with a minimum payment for three hours of work.

u

Full-time and part-time employees who are rostered on but who refuse to work, receive the benefit of the public holiday at the ordinary-time rate of pay. For employees covered by the General Retail Industry Award, public holiday entitlements are covered by the National Employment Standards (NES).

Casuals working on a public holiday are paid at the rate of double-time-and-a-half with a minimum payment for three hours of work.

company will start to assess the number of employee volunteers that will be required to work.

If there are not enough volunteers, the company will first ask

casual employees to work the hours, and will then ask full-time and part-time employees.

u

Five weeks prior to the days, the company will place a notice on the noticeboard asking employees to advise the company of

their preference not to work their normal roster at these times.

Where an employee takes the time off, the time is unpaid time

and the employee will only be paid for hours actually worked. An

employee can request to take paid annual leave for the hours not worked.

Part-time team members will also receive this benefit if they work 20 starts per four-week cycle, or are contracted to work a minimum of 32 hours per week, or if they work an alternating roster and the public holiday falls on a day on which they work in any week of their roster cycle. For a full-time team member working 20 starts per four-week cycle, ‘day’ means 7.6 hours. For a full-time team member working 19 starts per four-week cycle, ‘day’ means 8 hours. For a part-time team member, ‘day’ means the average number of hours rostered per day in the four-week cycle prior to the public holiday.

If you are rostered to work a set number of hours on a public holiday and you are sent home early by the company, it is the Union’s position that you must still be paid for the total number of hours that you agreed to work. This applies even to casuals. This does not apply where a team member makes the request to go home early. If you are sent home early and are not paid for the full hours you were contracted to work, you should contact the Union without delay. Team members are encouraged to speak to their Line Manager in the event of any concern about their pay or roster. Do I Get paID IF a publIc HolIDaY Falls oN mY NoN-rostereD DaY? No. Because the Fair Work Commission did not accept the SDA’s case to include the public holiday non-working-day benefit in the General Retail Industry Award, the Agreement does not contain a non-working-day benefit for public holidays. subpay? Don’t work no way. for free! Sometimes members who feel overloaded or stressed at work are working ‘off the clock’ or skipping their breaks. Sometimes managers ask workers to do this — it is not acceptable. When you work off the clock or miss breaks, you are not only losing money, you are also taking a shift from another worker. You can never be required to work for free. Working before or after your shift without pay also makes it appear that the workload is achievable, because the work got done and no overtime was paid for it — this often means the issue of workload gets worse. Going home on time and taking proper breaks are also an important part of maintaining good mental health. Let your manager know a reasonable time before the end of your shift if you can’t get all your work done and then go home. If they ask you to stay back, you must be paid for all hours workers.

Recent reports revealed that workers are being underpaid by some Subway franchisees. The SDA has been actively talking to Subway workers about their pay and conditions. The SDA and Maurice Blackburn Lawyers are following up cases of underpayment to secure backpay for our members as soon as possible. In other cases, Subway workers have been paid under a ‘zombie’ agreement. These are agreements that were negotiated under the Liberal Party’s WorkChoices legislation. Unfortunately, these zombie agreements are a legal way to pay workers less until they are cancelled. The SDA has been supporting workers in stores covered by zombie agreements to apply to cancel these agreements. the importance of working together Underpayments are much more likely in companies like Subway that have very low union density, where nobody is actively enforcing proper wages and conditions. If you know someone working at Subway, encourage them to join the SDA and to contact us if they think they have been underpaid.

the sda is here to help In one recent case the SDA dealt with, a group of nightfillers were consistently clocking off and working in their own time to finish loads. The Union became aware of this, and after the issue was dealt with, workers were backpaid a considerable amount for the times they worked back. Workers must not stay back and work off the clock. All extra work should be authorised and paid for. If this is an issue for you, please contact us for advice and support.

The SDA has recently been winning on wages, with quite a few new Agreements being finalised for members.

The Kmart EBA has finally been approved! After a tortuous journey through the Fair Work Commission, including an appeal, the Kmart Agreement was finally approved and came into force on 27 November. The new Agreement secures pay and conditions over the next few years including: New and increased pay rates on weeknights and weekends; New right for casuals to formally apply for permanent work; New paid family and domestic violence leave; New laundry allowance (subject to certain criteria). Dan Murphy’s EBA approved! The new Dan Murphy’s Agreement came into force on 28 October and will ensure a number of superior conditions, including: Regular pay rises; Higher weekday pay rates; New and increased penalty rates; New laundry allowance payable to everyone in preferred dress; Phasing out of Junior Rates by 1 July 2020.

Natural disaster leave is available in floods or bushfires even without an officiallydeclared state of emergency. The natural disaster leave entitlements under some of the larger SDA Enterprise Agreements are as follows:

The relevant clauses also make it clear that employees are entitled to leave work early if, during the course of their shift, the need to be home to care for children or a threat to property arises.

Natural disaster leave can (depending on your company’s entitlement) cover absences from work due to the disaster affecting your property or children. Exclusions

It’s important to know that natural disaster leave is available only in those specific situations. Here are some situations caused by flooding where it does not apply: u Store closure. This is a separate issue, usually dealt with under a standing down provision in the enterprise agreement; u Road flooding that prevents you from reaching your workplace does not create an entitlement to natural disaster leave. However, there have been occasions where the SDA has negotiated paid leave to cover such absences on a case-by-case basis. You may also be able to access some other form of leave. If you are impacted by a natural disaster it is best to contact the SDA for advice.

During the summer months, many SDA members may be faced with having to work in very hot environments.

The majority of problems that occur are related to a build-up of heat, that has the potential to increase the temperature of a building or other area. Health and safety effects Heat and uncomfortable temperatures can have different effects on different people. Working in hot conditions may result in health effects, ranging from mild discomfort and headaches to lifethreatening problems.

The type of work being undertaken, humidity, air temperature, sun penetration, clothing and air movement should always be taken into account when considering the health and safety risks associated with heat. The more serious health affects of heat stress are: u reduced ability to concentrate causing more risk of accidents; u increased discomfort in using protective clothing and equipment; u aggravation of pre-existing illnesses, e.g. heart disease; u heat cramps (painful spasms in one or more muscles); u heat exhaustion characterised by weakness and fatigue, vomiting, headaches and giddiness as well as unconsciousness and, in some cases, death.

Working in hot conditions not only affects a person’s physical health but can also affect a person’s mental state, and often contributes to stress levels. What can be done?

Your employer has a duty of care to provide you with a workplace that is safe and healthy, particularly in extreme conditions. Heat risks must be identified, assessed and controlled within the workplace when they can affect the health and safety of employees. Your employer must ensure that your workplace has: adequate ventilation and air movement,

and appropriate special work and rest

u

breaks set in hot conditions that are tailored to the physical needs of each employee exposed to heat. Issues relating to heat in the workplace, particularly over the summer months, must be addressed immediately and resolved effectively. If you find yourself working in an uncomfortably hot situation, follow the grievance procedure contained in your Enterprise Agreement or Award. If you don’t get a solution, contact the SDA. safety demands action week The SDA has been leading the campaign to stop customer abuse and violence at work.

In an industry first that coincided with this year’s SDA Safety Demands Action Week, retail and fast food employers, peak retailer groups, shopping centres, regulators and government joined forces with the SDA campaign and commited to by Jane Lui WHS Officer

eradicating customer abuse and violence in Australian shops.

The SDA’s industry statement has been signed by a range of industry groups including the National Retail Association and the Australian Retailers Association. The statement has also been signed by major employers including Coles, Woolworths Group, Aldi, Kmart, Hungry Jack’s, Bunnings, Myer, David Jones, The Reject Shop, and many more. The statement is a great step forward, but safety demands action, so the SDA has been in stores and shopping centres raising awareness about the physical and mental impact abuse can have, and calling for action to stop the abuse.

Don’t support it – report it! Remember to report all incidents of abusive and violent customer behaviour. Keep these things in mind: u If you’re unsure what to do if a customer is abusive or violent: call your supervisor or manager to help. u Report when incidents happen and if you’re unsure about how to report, ask your supervisor or manager. Reporting is key to action. Reporting helps determine how often abuse and violence is happening in your store. Reporting means your employer should provide you with appropriate support. Reporting will provide useful data to inform action on preventing the abuse and how to handle incidents and protect the health and safety of workers. A quick guide to parental payments Every year, many hundreds of SDA members go on parental leave. A summary of the payments that are available from the Department of Human Services following the birth or adoption of a new child is set out here. We recommend that you familiarise yourself with the various payments that are available and start making your claims prior to the birth or adoption to ensure that your claim can be processed as soon as possible. Paid Parental Leave: The Government Paid Parental Leave scheme provides eligible working mums (primary carers) with a maximum of 18 weeks’ pay at $740.60* per week (a total of $13,330.80* before tax). This may be in addition to any employer payments. Dad and Partner Pay: Eligible working dads or partners can receive up to two weeks of government-funded pay at $740.60* per week (total of $1,481.20* before tax). To be eligible, working dads or partners must be on unpaid leave from their work. Newborn payments: The Newborn Upfront Payment and Newborn Supplement provide eligible families with an increase to their Family Tax Benefit Part A payment following the birth of a baby or adoption of a child. Eligible families may receive a maximum increase to their Family Tax Benefit Part A of up to $1,679.86 for a first child or up to $560.56 for subsequent children.

You can only claim the Newborn Upfront Payment and Newborn Supplement if you are not eligible for the Government’s Paid Parental Leave scheme. Family Payments: The Family Tax Benefit is a payment to help families with the cost of raising dependent children. It is split into two parts: Family Tax Benefit Part A helps families with the cost of raising children. It is generally paid for dependent children under 19 years of age who are not receiving Youth Allowance or similar payments. Family Tax Benefit Part B gives extra assistance to families with one main income, including sole parents, where the youngest dependent child is under 16 (or up to 18 if they are a full-time student and do not receive Youth Allowance or a similar payment). Parenting payment provides assistance to the primary carer of a child under the age of 6 or 8. You may qualify for Parenting Payment as a parent, grandparent, or foster carer, whether you are single or have a partner. The Family Tax Benefit Part A Supplement replaces the Maternity Immunisation Allowance, and provides a supplementary payment to parents who have had their children fully immunised. .

It’s a fleeting concept in today’s society — but vital for job security in our workplaces. by Joel Tynan Organiser One in four Australians undertake casual work, with an even higher proportion found in the retail industry. While for some, casual work provides the flexibility they desire, for many more, the stability and certainty of permanent employment is vital for a stable and financially-secure life. Bank mortgage payments or rent, bills piling up and other financial burdens make getting permanent work so important for so many. By being present in your workplaces and listening to your stories of why you want permanent work, the SDA, along with the ACTU, took strong action to give casual workers a path from casual work to permanent work. The SDA ran a case in the Fair Work Commission which proved to be a success. Now, the General Retail Industry Award and the Fast Food Industry Award have a ‘casual conversion’ clause. This clause gives casual employees doing regular and systematic work the right to request conversion to part-time or full-time work. An employer can only refuse this request on reasonable business grounds, and must respond to the team member in writing within 21 days.

This win has now flowed into many of our recent Agreements including Coles, Woolworths, Big W, Officeworks and Kmart, just to name a few. Our members have been using this clause to great success. Just recently, a member at a Coles store in my area successfully used this clause to go from casual work to permanency. She was working 20 hours a week in her store on regular and systematic basis, and approached the company to be placed on a permanent contract.

Previously, her requests had been pushed aside, but with the assistance of the SDA, our member was given a permanent contract. Our elated member now has the certainty and the income she needs to continue effectively with her studies. If you’re casual wanting regular hours, and you want permanent work, don’t be shy! Contact the SDA and see if you qualify for permanent work. If you know a casual who isn’t a member, ask them to join the SDA. For casual workers who want secure work, it pays to be in the SDA!

BE SMART ON SOCIAL MEDIA Be careful what you say on social media. Comments on social media (including other people’s Facebook pages) are regarded as public comments – they are not private. Avoid negative comments about your company, your manager or other employees on social media. Better not to mention them at all. Some members have come to us after “official warnings” or worse following unwise comments on social media. Be smart. When you go home, leave work behind you. Enjoy your social media for your social life, not your work life.

The SDA is proud to help SDA members who are studying at a tertiary level with their education costs. The Union has $1,200 TEAP packages for SDA members to assist them with expenses relating to their university studies in 2020. There are also six $600 TEAP packages to help those studying at TAFE and other tertiary colleges in 2020. Full details are set out in the “Conditions of Entry” on the back of this leaflet.

Applications must be received by the SDA’s Sydney office no later than 31 January 2020, and successful applicants will be notified by post in February 2020. review of retiremen Australia’s changing superannuation system is due to change again with the Commonwealth by Gerard Dwyer Government National Secretary recently announcing an independent review of retirement income. The review will look at how the super system will meet retirement income needs as Australians live longer and the population ages. The Government has asked the reviewers to focus on three key areas: the Age Pension, compulsory super and voluntary savings, including home ownership. The final report is due to be provided to the Government by June 2020. What is often lost in political debates on superannuation is that Australia has a world-class retirement income system. In October 2019, a world review of superannuation systems ranked Australia at third, behind only the Netherlands and Denmark (Mercer Global Pension Index 2019). Our super system is a strong one, and it is important that we highlight at every opportunity what we expect reviewers and the Government to prioritise in any review that they now undertake. Firstly, you and your workmates deserve that any review focuses on the need for a strong superannuation system. Super needs to stay compulsory, because super is an industrial right for all workers and is deferred earnings designed for dignity and justice in retirement. The McKell Institute has shown that over

many years wage growth has risen and fallen completely independent of super increases, so the promised increase to 12% should happen. Secondly, many retail workers are women who retire with less super than their male counterparts, and those under 18 years of age are not universally entitled to super. All payments, whether we get them as wages or payments from the Government or an insurer, should have super applied. This includes the Government’s paid parental leave scheme and family and carer payments, all wages for those under 18 years of age and those earning under $450. If an employer goes under, the fair entitlements guarantee should guarantee super as well as other unpaid wages. Finally, the Retirement Income Review must prioritise the interaction between Age Pension, super and the housing market.

If home ownership is to be considered, rent and mortgage payments need to be acknowledged as a large and increasing cost during retirement.

The stated aim of the legislation is to prevent low super balances being eaten into by insurance premiums and fees, but it will undermine insurance cover.

Further insurance changes being implemented While the review could lead to future changes, a big change to the current super system will come into effect from 1 April next year.

Under new ‘Putting Members Interests First’ (PMIF) legislation recently passed by the Commonwealth Government, if you’re under the age of 25 or your super account balance is below $6,000, you’ll be required to opt-in to receive life insurance cover through your super, which is currently provided automatically. This follows changes that require some accounts with no activity in the last 16 months to move to the ATO, which may result in changes to investment returns and would result in any insurance being cancelled.

Should something happen to you, not having this insurance can be just as, if not more, costly. Rest will be communicating with all members about the changes in December so that you can make an informed decision that’s right for you and your family. Annual statements from REST Annual super account statements were recently sent out by Rest. Rest’s Core Strategy delivered 5.96% for the year ending 30 June, and 8.95% p.a. over the 10 years to the end of June 2019. Rest’s investment approach is different from some other super funds with a focus on long-term performance above shortterm growth.

With the share market volatility expected to be ongoing, Rest’s current exposure to the share market is quite cautious, which means that while Rest members may not benefit as much as some other fund’s members from any short-term share market rises, it also means they won’t be as impacted should a significant downturn occur. Rest followed a similar strategy during the Global Financial Crisis, which served members well. Insurance provider changes Finally, as I mentioned in my last update, Rest now has a new insurance partner in TAL as of 1 December 2019. While Rest will provide more information on the changes, members will automatically be transferred to its new, lower cost and more tailored insurance products on 1 April 2020 when PMIF changes take effect. The change in insurance provider won’t affect any members with current insurance claims.
