(Seguin) -- "The bottom line today is that they got water." Those are the words of Attorney Douglas Sutter, of Houston, as he better defines the details behind Monday's settlement agreement between two separate groups of lakefront property owners and the Guadalupe-Blanco River Authority. The groups, on Monday, returned to the courtroom of visiting Judge Stephen Ables after beginning a temporary injunction hearing on the dewatering of area lakes last Wednesday. The judge also tentatively set a trial date for one year from now. That means the lakes will be safe until at least that scheduled date of Oct. 5 2020. The hope is for GBRA and the plaintiffs from both suits to work to reach a consensus on the safety of the dams and a pathway forward or find themselves back in the courtroom. Sutter says agreeing to a temporary injunction is just a "narrow" piece of a much bigger hurdle. See SETTLEMENT, page 2

(Seguin) -- The attorney for the Guadalupe-Blanco River Authority is describing Monday's temporary settlement agreement to not dewater area lakes as a "good faith agreement� entered into by both parties. GBRA Attorney Lamont Jefferson says it's not only a good first step to finding a solution but it also initiates action to keep people safe. "I think it recognizes and does a good job of balancing the interests of all parties -- the property owners and the interest of GBRA in protecting the public from what it perceives as a real hazard," said Jefferson.

"The other thing that is important to remember in this is that this does not affect our lawsuit whatsoever. The lawsuit goes forward to trial. We'll have a trial setting in one year and what people have to recall is that the lawsuit that I have filed is to require GBRA to meet their statutory duties which we believe are to maintain, repair and more importantly, replace the dams. So we are going to forward with the discovery, our paper discovery, deposition discovery and whatever is necessary to that end because that is the end of our lawsuit -- the end goal of the lawsuit. Now the owner's associations, they have things that they are working on themselves. That is separate and distinct in the lawsuits. But what we want at the end of the day is to force GBRA to meet its statutory duties to replace these dams at their expense," said Sutter. Details of this settlement prevents the lakes from being dewatered for 12 months while creating additional assurances to prioritize the safety of those on and around the lakes. According to the courts, those assurances are expected to come from a panel of three experts. The experts will be appointed to decide what, if any, areas of each lake would be safe for activity given even described "compromised nature of the dams." GBRA and the plaintiffs will each appoint an expert to the panel. Those two experts will then select a third-party expert to assist with the effort, creating the panel of three and who in the end will help designate what areas or zones of the lakes would be safe for activity. All parties agreed that the panel will be appointed and will have 30 days in which to determine what zones are safe. An additional window of 30 days would also be provided if necessary. As part of the effort, the lakes will be closed to all activity beginning this Thursday and until the panel has reached a decision on what areas, if any, are safe for activity. Sutter says both sides spent most of the end of last

week and the weekend reviewing the proposed agreement. As of court Monday morning, both sides felt they hadn't reached a deal, finally agreeing to negotiations at around 2:30 p.m. "They approached us after the first day of hearings and wanted to discuss settlement. We spent the next two days negotiating a settlements as well as today and they had agreed they would not dewater or drain the lakes and that was the issue that we had. The important thing is we did not want to go out and say that we were going to have these experts look for unsafe zones and leave these lakes closed for an indefinite period of time so we have a very specific period of time of 30 days and maybe an additional 30 days for the closure of the lakes. After that, they are going to be open with the exception of the unsafe zones," said Sutter. In the meantime, Sutter says he will continue to work for his clients while others pick up the ball and handle what they believe is important to them. "The bottom line today is that they got water," said Sutter. "Starting on the 16th, they were not going to have water. You've got to remember that's why we were here for today is to stop the draining of these lakes. So, they are going to have the water. They are not going to be able to as they say -- I don't like this word -- recreate for 30 to 60 days but they are

Sutter says temporarily stopping the drain was the initial plan behind the injunction. Now, he says it's about moving forward and holding GBRA accountable for its actions – actions that ultimately led to the spillgate failure in May and the one at Lake Wood four years ago. "It's our position and we would have put on evidence today, if you look at the condition of these dams, they have been horribly maintained. If you look at the photographs of them that we were going to put on -- I mean everything from not cutting the grass, not keeping the fences up, not repairing them. They do take the position that they have repaired but our position is it's woefully inadequate for 57 years of ownership and to answer your question, it's been a long time coming, a long time of basically not taking care of these assets," said Sutter. During this hearing against GBRA, Sutter, who represents 295 plaintiffs, aligned with Attorney Ricardo Cedillo, of San Antonio. Like Sutter, Cedillo wanted to put a halt to dewatering until a real solution could be found. Cedillo represents 10 residents in Lake McQueeney and Lake Placid. Again, effective this Thursday, all four lakes will be closed to all activity and or until the panel of experts has reached a decision on what areas, if any, are safe for activity. During this time period, both the plaintiffs' attorneys and the GBRA are asking lake residents to heed the warning to others. As part of the agreement, professional law enforcement, acting as lake patrol will be added to enforce the restrictions on each lake.

GBRA defends reasoning behind action to dewater despite temporarily settling with lakefront property owners GBRA, continued from page 1 "I think about the sequence of things, the second dam failed in May of this year, a very dramatic failure. We all saw it in court. Something needed to be done. After that was done, immediately homeowners were engaged and GBRA discussed different options. In July, they retained Black & Veatch to offer engineering reports. In August, Black & Veatch made the recommendations and their recommendations from GBRA's assessment was that there was a very serious threat to life and property on these lakes and so, GBRA made the decision to dewater the lakes and at that point, there was no cooperation by anybody. It was a decision that GBRA made. So things have moved pretty quickly since then and now all of the property owners are agreeable apparently to at least the ones that are plaintiffs in this case to closing the lakes so that there is no activity, we get a third party expert to opine on if there are unsafe or safe zones around the lakes and we go from there. It's a very reasonable solution in my mind," said Jefferson. Although it has agreed to hold off on the dewatering, Jefferson says their claims remain unchanged and defends GBRA's maintenance of the properties over the years. "I'll tell you what, it seems obvious to me that these spillgates can not and will not last so leaving the gates where they are indefinitely is not going to work. They will fail eventually just as we have seen two of them fail," said Jefferson. "I think if you look at the history and the records, yes, these dams were very well maintained. That's why they are still standing after 90 years. There are components to the dams that you cant' get to. They cant' be maintained. All they do is age. You can't make them stronger. You can't make them last longer so at some point, they run out of life and when that happens, they fail and we've seen that happen twice in connection with this system. ate. They do the job that they are designed to do and that doesn't happen by accident. It happens because there has been constant maintenance on these dams." Regarding statute, Jefferson says he defends GBRA's position and says the law is clear.

"If you look at the statute, it's an enabling statute. It says what it says and it does not say that GBRA is required to maintain dams or operate dams or even have hydro electricity. The statute grants the GBRA a very broad authority to do a number of things or not to do a number of things. It has to manage the waters of the state responsibly within its district and it has done that and that's about the only obligation that it has. There is no statutory obligation or any other lawful obligation requiring the GBRA to keep these hundred old spillgates in operation," said Jefferson. Attorneys for the plaintiffs Ricardo Cedillo and Douglas Sutter also felt that it was unfortunate that all good faith efforts to reach a settlement prior to last week were not seriously considered by GBRA. Cedillo stated his clients would rather have spent their money on finding a solution than on the cost of lawyers. Jefferson disagrees and says reaching a settlement until court is not unusual. "I'm not really privy to all of the reasons of (why) things went the way they did. I mean often times, it takes getting to court for both sides to become reasonable and to focus the mind. It's not unusual at all for cases to settle after trial start and after kind of the reality of court. There are no guarantees in litigation so if you can reach a result through an agreement that the parties can live with. That's almost always the best route to go," said Jefferson. Upon reconvening Monday, both sides announced to Visiting Judge Stephen Ables that GBRA had initiated a settlement discussion for the pair of plaintiffs who were

Jefferson at that time, stated that GBRA would agreed to the temporary injunction as so long folks would be kept off the lakes until the safety experts could provide more. Jefferson had also stated that while he felt that the plaintiffs seemed receptive in ordering the temporary injunction, he didn’t think they were in agreement with each other on some of the bullet items listed on that plan. Cedillo responded by saying that he wanted to make clear that he and Sutter, who is representing 295 plaintiffs, are 95 percent in total agreement and not so separate as Jefferson had alluded to He went on to state that "the devil is in the details" and felt that they could bridge that five percent gap when they returned back to the courtroom. All parties then left to further discuss the settlement coming back with the compromise after almost four hours in negotiations.

Hendrix spoils Texas Lutheran football opener with 26-23 victory at Bulldog Stadium

(Seguin) - Sandy Burks kicked a 31-yard field goal as time expired to lift the Hendrix College (Ark.) Warriors to a 26-23 non-conference road win over Texas Lutheran, spoiling the Bulldogs' season opener Saturday. At TLU's Bulldog Stadium (Frank L. Dunne Field), Burks shook off a missed PAT with 1:32 to play that would have given Hendrix the lead after a Kip VanHoose 1-yard touchdown run. The Warriors got the ball back in TLU territory with 35 seconds remaining in regulation after a Bulldog fumble. TLU fumbled four times and lost two against Hendrix. TLU also was hurt by 14 penalties for 150 yards. "You can't make those critical mistakes against a good football team, especially against a good quarterback like that," said Carl Gustafson, TLU's third-year head coach. "(Miles Thompson) is going to make you pay. All credit to Hendrix. I thought those kids played really hard, but we have to get out of our own way. We just shot ourselves in the foot." "We did a lot of good things, and then about the time we thought we were going to finally get it all together and find our rhythm, we would do things that as a good team you can't do. You can't make those critical mistakes. We have to learn from them. Conference play starts next week, and that is where it counts. Our

guys know we have a good football team, but we just have to correct those mistakes." The Bulldogs dominated time of possession (36:21 to 23:39) and out-gained the Warriors 505 to 350. TLU ran 84 plays, rushed 52 times, and gained 310 yards on the ground. The Bulldogs had three running backs gain at least 87 yards and average at least 6.7 yards per carry. Ian Leslie, back in fine form after missing eight games with an injury last season, rushed for 109 yards on 16 carries. Austin Mathews carried the ball 14 times for 96 and had a 10yard touchdown run, and Chris Monroe, also back from injury after missing five games in 2018, tallied 96 yards on 14 carries and had a 13-yard scoring run. TLU led by six points in the second half on two different occasions. The Bulldogs took a 23-17 lead on a Juan Ocampo 28-yard filed goal with 4:10 to play in the fourth. Ocampo made field goals of 30, 31, and 28. TLU quarterbacks Wade Freeman and Andrew Lotz split time

throughout the game and combined to go 23-for-32 for 195 yards. Freeman was 12-for-18 for 117 yards, and Lotz was 11-for-14 for 78 yards. Freeman rushed eight times for 32 yards. Strong showing for Seguin cross country teams at "Animal" Zoo Run Relay (San Antonio) - Seguin's "Team Matadors" finished first in the high school boys division and first overall among 108 teams with an eight-mile course record time of 45:56 in the 35th "Animal" Zoo Run Relay on Friday at hte San Antonio Zoo. Team Matadors members include Cheney Stephenson, Jerry Garcia, Louis Flores, and Aidan Flores. Stephenson logged the top individual time in his two-mile leg at 10:58.

Seguin had three other teams compete in the event. Team Seguin took third in the boys high school division with a time of 51:42. OxyContin Purdue Pharma Files For Bankruptcy (Stamford, CT) -- The manufacturer of the opioid painkiller OxyContin is filing for bankruptcy. Purdue Pharma is looking for bankruptcy protection as it faces thousands of lawsuits over accusations of fueling the opioid crisis. Across the U.S., thousands of cities and counties, as well as most states, have filed lawsuits against Purdue and its owners, the Sackler family. They're accused of downplaying the risks of the highly addictive drugs and of pushing them through an aggressive marketing campaign. The company recently reached a tentative deal worth billions of dollars to settle some of the lawsuits.

New York Governor Calls For Vaping Ban (New York, NY) -- New York Governor Cuomo is announcing an emergency ban on flavored e-

cigarettes. Cuomo says he put the ban in place to protect the people of New York, noting that children are especially attracted to flavored vape products like bubble gun and cotton candy. Cuomo says the ban will take effect in about fourteen days. He does not want to wait for the federal governemt to put in its own ban. Six people have died in relation to vaping according to the CDC.

NJ Governor Murphy Establishing Vaping Task Force (Trenton, NJ) -- New Jersey Governor Phil Murphy is establishing a vaping task force as concerns mount over the safety of e-cigarettes. He's signed an executive order giving a newly-created Vaping Task Force three weeks to come up with suggestions. Nationwide, there've been six deaths linked to vaping, plus more than 470 cases of severe respiratory illnesses, including 19 in New Jersey. The FDA is concerning a ban on all flavored e-cig products, convinced that kids are attracted to the flavors.

Lottie May Henke Lottie May "Nene" Henke, age 89 of Seguin, TX formerly of New Braunfels, went home to be with her Lord and Savior on September 13, 2019. Visitation will be held on Wednesday, September 18, 2019 from 5-7 p.m. at Tres Hewell Mortuary. Funeral services will be held on Thursday, September 19, 2019 at 1p.m. at Tres Hewell Mortuary with Reverend Megan D. Elliott officiating. Interment will follow at Comal Cemetery in New Braunfels. Lottie was born on May 1, 1930 in Redwood, TX to Hugo and Lottie (Loep) Bartling. She married Ervin L. Henke on July 25, 1948. Lottie was manager of Shoeland, and then worked at Bruner's Department Store in the shoe department. Lottie and Ervin were owners of Henke's Ice Haus for 18 years. They loved to dance and fish, and were always holding hands. Lottie 'Nene' also loved to cook and bake for her family and friends. In her final years, her constant companion was her beloved pug, Lilly. Lottie is preceded in death by her loving husband Ervin, her parents and her son-in-law Chuck Cannon. Survivors include her daughters Sharon CannonWhite and husband Charlie, Carol Alex and husband George, and Susie Winterhalter and husband Gary; grandchildren Mike Cannon and wife Stephanie, Sarah Alex Johnson and husband Ryan, JJ Winterhalter and wife Sandra; great-grandchildren Colby, Madison and Abigail Cannon, and Ava and Olivia Johnson; brother-in-law Johnny Henke and wife June; and sister-in-law JoAnn Schaefer; many nieces, nephews, cousins, other loving family members and many friends. Betty Joyce “Lala” Schriewer Betty Joyce “Lala” Schriewer, age 84 of Seguin, passed away on September 10, 2019. Betty was born on March the 10th 1935 in Seguin, TX., to Eugene and Allie (Buerger) Blumberg. She married her love Allen (Buster) Schriewer in 1953. Her most important job in life was a wife and loving mother to her five children. Through the years she took on many jobs. She was a seamstress and a cake baker for the public, making anything from wedding dresses and wedding cakes to simple alterations and family dinners. Buster and Betty also had a hobby of dealing antiques. In Betty’s later years she helped cater with the John Nash family and taught stained glass classes. Betty was preceded in death by her parents, two precious aunts, Julia Blumberg and Bobbie Buerger that helped raise her, her husband of 38 years Buster, her daughter Amy Boyer and great-grandson Jax Kopecky. Michael Castillo Sr. Michael Castillo Sr, age 56, peacefully entered into in eternal rest Saturday, September 14, 2019. Michael was born November 7, 1962 in Seguin, Texas and was a lifelong area resident he was a hard-working carpenter and construction worker. Michael was known to offer a helping hand to anyone who needed it. He enjoyed spending time with his grandchildren, barbecuing, watching the Dallas Cowboys and taking country drives. He is preceded in death by his father Marcello Castillo and his brother Eddie Castillo. He is survived by his mother Mary Sanchez Castillo; Daughter Stephanie Castillo and husband Michael McKnight; Son Michael Castillo Jr and wife Amanda Castillo; grandchildren Michael Castillo III, Maddix Castillo and Amelianna McKnight. Siblings Albert Alcala, Josie Mayes, Ydelia Velasquez, Donna Lopez, Maryann Garcia, and Patricia Castillo. Visitation will be held on Thursday, September 19, 2019 at Tres Hewell Mortuary from 5 to 7 p.m. A memorial rosary will be held on Friday, October 18, 2019 at 10 a.m. at Our Lady of Guadalupe Catholic Church followed by the Mass of Christian Burial at 10:30 a.m. Private interment will be held at a later date.
