Life-changing bespoke support AFTER SERIOUS INJURY
Expert legal advice and an empathetic approach are at the heart of Slater and Gordon’s work with families after traumatic brain and spinal injuries.
Helping individuals at what is often the worst time of their and their families’ lives is a responsibility we do not take for granted. It is important that a specialist solicitor, is appointed in such a case – someone who understands the many nuances of complex injuries and can navigate the claim successfully. The priority is to secure interim funding at the earliest possible stage to fund a package of specialist rehabilitation. I have represented many individuals who have sustained life changing injuries often with a team of lawyers. One recent example involves a young man with a severe brain injury. He was a pedestrian struck by a car whilst crossing the road.
The case has presented multiple challenges in respect of proving full liability and also dispute surrounding the extent of the rehabilitation required. We commenced Court proceedings at the earliest opportunity to make sure this young man and his family had the resources they needed to support their son with rehabilitation and a return to the community.
We secured interim payments approaching £2million which meant this young man and his family were able to move into a fully adapted property, with a full case managed care package and ongoing therapy. ■

STEPS Rehabilitation CASE STUDY
Mike Howarth suffered a life-changing upper-limb amputation and brain injury when he was knocked from his motorcycle on August 2nd, 2019. He was an experienced motorcyclist and had ridden for over 30 years.
Prior to his accident, Mike had built up a successful business and was working as a business improvement and strategy deployment consultant, a job that he loved and that enabled him to travel the world.
He lives in Sheffield with his wife, Helen, and their two children. This case study, written in May 2024, provides an account of his rehabilitation journey so far and Mike’s hopes for the future.
MOTORBIKE ACCIDENT RESULTING IN AN AMPUTATION AND BRAIN INJURY
Mike was 49 when he was knocked off his motorcycle after being struck by a car that turned right across his path. His injuries included a traumatic amputation of his left arm, a brain injury, fractured femurs, fractured ribs, a fractured collarbone, a fractured shoulder blade, a brachial plexus injury, and a fractured spine. An off-duty police officer witnessed the accident and was able to keep Mike’s airwaves open until an air ambulance arrived, some 20 minutes later. Looking back, Mike knows that without that police officer being on the scene, it’s likely he wouldn’t be here now.
Mike’s injuries were of the utmost severity and he had a Glasgow Coma score of 3. He was airlifted to Stoke Hospital, where he was placed in a coma for two and a half weeks. Due to Stoke’s military connections, the staff there are used to treating military-style wounds, and knew exactly what to do to help him. He is especially glad that he was airlifted to this particular hospital, where the medical team have good experience of these kind of life-threatening injuries.

During his stay at the hospital, his wife appointed specialist solicitor Matt Brown at Irwin Mitchell, who engaged the services of a case manager on their behalf, to coordinate Mike’s rehabilitation. Due to Mike’s crippling pain, a key priority was pain management, his case manager therefore put him in touch with Dr. Liz Iveson, a consultant stroke and neurorehabilitation physician, who supports many of the residential clients at STEPS Rehabilitation.
Dr. Iveson recognised that Mike’s difficulties with fatigue, pain, and insomnia, were having a detrimental effect on his rehabilitation and recovery. She recommended that Mike come to STEPS Rehabilitation for a period of intensive rehabilitation, and his solicitor, Matt Brown at Irwin Mitchell, secured the interim payments to make it possible.
REHABILITATION AT STEPS
Looking back, Mike knows that without that police officer being on the scene, it’s likely he wouldn’t be here now.
He remained in the ICU for a month and a half with a tracheostomy before being transferred to Sheffield ICU, where
Mike describes his time at STEPS as his ‘circuit breaker’; after just 3 weeks, he saw massive improvements in his recovery and requested to extend his stay to 5 weeks. His rehabilitation began with making it a priority to improve his posture and manage his pain. Through the combination of therapies available at STEPS and medical cannabis Dr. Iveson prescribed, his body has returned to a more natural position, his pain has reduced, and he was able to reduce his reliance on the exceptionally strong painkillers being used to cope with his injuries.
“I was in an enormous amount of pain and it was impacting negatively on my recovery. Liz was critical to my engaging effectively in rehabilitation, because having one key medical expert to oversee all the therapies from pain management perspective meant I could achieve more.”

I had a busy schedule, and I think I really needed that as it meant I was concentrating on something other than the pain. Also, the activity was making me physically tired which went someway to helping me improve my sleep.”
His intensive rehabilitation timetable included regular aquatic therapy sessions, physiotherapy, acupuncture, hypnotherapy, speech and language therapy, and massage. The improvements and progress in his rehabilitation journey are testament to Mike’s determination and perseverance.
OPERATION AND PROSTHETIC TECHNOLOGY
In October 2021 Mike underwent an operation on his shoulder to help alleviate the stress and pain that was being caused by the downward pull of his stump from a shoulder that had no muscle structure to support it. In a twist of fate, this operation was prompted following a fall at home, which saw him fracture some of the remaining bone. After meeting an experienced consultant at the fracture clinic, Mike investigated to see if he also did work privately. After a private consultation, the consultant suggested he underwent arthrodesis to stabilize his shoulder and arm.

THE FUTURE
Moving forward, Mike wants to actively continue his relationship with STEPS. He is passionate about supporting others who have been through similar traumatic experiences, and to give back to the organization that has helped transform his life. On the first Friday of every month, he returns to STEPS to chat with other clients that are going through the recovery process. Mike recalls the genuine motivation he felt when he talked to people who had experienced similar things to himself back in the early months and years after his accident. Now he wants to do the same for others.
“There is a real sense of community at STEPS. You are joining people in similar circumstances to you, and you are all here to get better and regain some semblance of their life before your accident or illness. There is a collaborative approach to everyone’s rehabilitation, with clients encouraging one another to get the very best results. At dinner time, we can talk and share our experiences, and it helps to know you are not alone; we all have the drive to improve.
At STEPS, I was able to focus fully on my rehabilitation and concentrate on getting fit and well. In just 5 weeks, I saw amazing changes. I had a busy schedule, and I think I really needed that as it meant I was concentrating on something other than the pain.
This is done by connecting three pins from the humeral head/ arm bone into the shoulder blade. The results have been transformative in the sense that the stump is now well supported, which has reduced a considerable amount of Mike’s pain. Mike is considering further surgery, using osseointegration. This would allow Mike to easily put on and take off a prosthetic, attaching directly to the arm rather than using a shoulder harness and straps. He is keen to get a powered arm which he believes could transform his functionality, but accepts that osseointegration major surgery and not something to be taken lightly.
Recently, Mike took a trip to the USA to explore Mobius Bionics and their leading-edge technology in the prosthetics industry. He was able to have a trial of the Luke arm for 10 days, which allowed him to explore the functionality of the arm, and was a great learning curve! The Luke arm enables Mike to rotate his arm from his elbow, raise his forearm, and the hand has six different types of grips. As Mike has so much nerve damage, using a myo-electric connection was not possible. One of the benefits of the Luke arm

Not only this, but Mike has also become a Trustee for STEPS Rehabilitation Foundation, a charitable trust that launched in Autumn 2023 which is dedicated to providing support and funding for individuals recovering from complex trauma injuries and illness.
The foundation aims to improve the quality of life for people with disabilities following injury or illness, to help them access specialist rehabilitation services and equipment.
Mike is hoping to speak at more conferences, where he is able to share his lived experiences with others as a brain injury survivor and amputee.
Above all, Mike is just looking forward to living his life again with his wife and two children. He’s forever grateful to his “understanding” wife, and he explained that the silver lining of his injury was that it brought his family much closer. Ian Westgate (64), from Eastbourne, was diagnosed with Multiple Sclerosis more than 30 years ago, but has always fought against the illness’ impact, to the extent he is a leading campaigner for accessibility in the area, and chair of Eastbourne Access Group.
As his condition deteriorated, requiring greater input from his wife Clare, he purchased a Closomat Palma Vita wash & dry toilet.
“I wish I’d got it years ago!” Ian says. “I made every excuse under the sun against having a shower toilet, but realised that I wanted to keep my dignity, safety and independence in this most private of functions. I was getting more and more worried about transferring to and from the toilet, about falling, but didn’t want to rely on Clare to help me. And I was having problems with constipation. The Care and Rehabilitation Centre in Surrey, provided by disability charity Queen Elizabeth’s Foundation for Disabled People (QEF), now offers technology-assisted therapy as part of their neuro rehabilitation and complex neurological care service.
The combination of motion sensors and interactive balance board helps clients significantly improve their range of movement, core stability and balance. The addition of visually engaging gamification techniques also add fun and purpose to repetitive exercises prescribed by their physiotherapist or occupational therapist.
Sensors can be placed on different parts of the body depending on the prescribed exercises, such as the chin, feet, thighs, hands and arms and the balance board measures changes in weight distribution.
For hand and arm rehabilitation sensors measure the strength of the hand and the active range of motion the in arms;
movements that are frequently used in daily living skills such as eating or dressing. Sensors can also be used for gait analysis as part of a therapy programme to improve walking skills. The foot board has pressure sensors which can be used to train balance and postural control through specifically adapted gaming challenges.

The value of a combined MDT process and having MULTIPLE VOICES ROUND THE TABLE
By Lyndsey Urry, Clinical Lead at Askham RehabAt Askham Rehab, Multidisciplinary Teams (MDTs) are an essential part of our rehab model, bringing together specialist team members to collaborate in the assessment and management of patients.
This approach is widely used and successful in the rehabilitation of patients with brain and spinal injuries, as by bringing together experts from different fields, a MDT ensures that a patient receives a comprehensive care.
He was assessed by all four of Askham’s multidisciplinary teams; clinical psychology, physiotherapy, occupational therapy, and speech and language therapy, before working with them to design an individualised programme. Eventually, Josh was able to return to the airwaves and regained his voice — and in some ways, his identity.
MDTs can include specialists such as neurologists, physiotherapists, occupational therapists, speech and language therapists, and clinical psychologists — each bringing a unique perspective when addressing differing and complex needs.
Brain and spinal injuries can have wide-ranging effects, and a collaborative approach allows you to consider all aspects of the patient’s condition, including physical, cognitive, and emotional wellbeing — before developing an optimal rehabilitation plan.
After assessing a patient, MDT’s might also set SMART (Specific, Measurable, Attainable, Relevant, and Time-Bound) goals, which again, is a fundamental way of maintaining a positive improvement trajectory.
A shining example of this rehab model in action is Joshua Donlon, a Cambridgeshire community radio presenter who lost his ability to project his voice due to a rare brain tumour.
The MDT process is also beneficial in addressing any potential complications that may arise, and as brain and spinal injuries can have unpredictable effects, they can work together to monitor the patient’s progress and adjust the treatment plan as needed — identifying the cause and developing a plan to overcome this and push forwards.
However, while this multidisciplinary approach certainly creates better outcomes for patients, it comes at a cost. Intra-discipline communication together with holistic reporting and shared goal setting takes more time than it would if done in a siloed fashion.

Greek Holiday IS A MILESTONE IN JOHN’S REHAB
John* who has an acquired brain injury, took his first foreign holiday last year at the age of 31. He travelled to Greece supported by a member of the care team at Richardson Care.
The goal of increasing independence and living an active and fulfilling life is part of the rehabilitation programme for service users at Richardson Care. Whenever possible, it includes an annual holiday in the UK or overseas.
John and Louise, a Senior Support Worker, flew from Luton to Heraklion in Crete and had the usual holiday stresses of a crowded airport, and a delayed flight (by four hours). This might not sound unusual, but it indicates just how far John’s come on his rehabilitation journey. He arrived at Richardson Care in 2017, at the age of 25, presenting with severe verbal aggression and made threats of physical violence towards others. He had also historically engaged in inappropriate behaviours and absconded.
After sustaining a traumatic brain injury at the age of five, John lived with his family until his late teens, then had numerous placements until he was admitted to Richardson Care. He is now stable and settled, enjoying new and exciting experiences. He is being supported to manage his complex emotional and behavioural difficulties, anxiety and ADHD.
INTERESTING AND VARIED ITINERARY
John and Louise planned the trip together in detail beforehand. John chose Crete as he is interested in history and had a full and varied itinerary with lots of trips: The highlight was visiting Knossos, where they had a guided tour and John maintained concentration for four hours, something that he has found difficult as a result of his brain injury. They also took a boat trip from the beautiful Pirate Bay, visited an army base and a WWII bunker, visited an art museum and an olive oil distillery. John learnt a lot about the country and its culture and has many happy memories of the trip.
John says: “I really enjoyed the trip and it made me feel more independent. It made me feel that I can do things on my own. We had a good time, I want to go back and learn more about the country, or maybe go to Rome next time.” ■

Sleep in People living with NEURODIVERSITY

There is a paucity of research available on the sleep of people who are living with neurodiverse conditions like Autism Spectrum Disorder (ASD), although that which is available does indicate that children with ASD sleep less well than those children without the condition; on both subjectively and objectively reported outcomes (Souders et al., 2009).
Sleep disturbances in children with ASD are reported to be particularly burdensome for parents and carers and this is especially prescient as 40% - 80% of children with ASD have been reported to experience sleep disturbances compared with 25% to 40% of typically developing children (Meltzer & Mindell, 2008; Reynolds & Malow, 2011). Children with ASD have also been reported to have more problems with initiating their sleep and have an increased number of night-time awakenings than typically developing children (Krakowiak et al., 2008). A reduced amount of REM sleep has also been reported in children with ASD compared with typically developing children (WilliamsBuckley et al., 2010).
With regard to treatment strategies for sleep problems
in children with ASD, melatonin has shown promise in a few studies at increasing total sleep time and reducing sleep latency (Wirojanan et al., 2009). However, there are a lack of large, well-designed studies examining the efficacy of melatonin (including the type (fast vs slow release), the dosage and the timing of administration). Therefore, the utility of melatonin in the management of sleep problems in this group remains to be fully explored (Guénolé, et al., 2011). Behavioural interventions for improving sleep in children with ASD have centred on exercise and parent-education programmes, both of which have shown positive effects on the sleep outcomes of children with ASD, although these studies are very few in number and much more work is required in this area to draw firm conclusions about their efficacy. Indeed, very few studies are available in the area of sleep in ASD with one recent review of behavioural interventions in ASD failing to find any (Weaver, 2015).
As with typically developing children, but potentially more of an issue for those with ASD, may be sensitivity to arousing stimuli in the late evening just before bed which has the potential to increase in self-regulatory behaviours (such as self-injury on the following day) in children with low functioning autism. Furthermore, there is potential for heightened sensitivity to light particularly blue-enriched light emitted from flat screened
devices which has been implicated in disrupting circadian timing and melatonin secretion, as well as the propensity for increased sensitivity to sound in children with ASD, potentially reducing waking thresholds and increasing sleep fragmentation (Cohen et al., 2014).
At the time of writing in 2023 there was no literature available to report on regarding the sleep and treatment of sleep disturbances in adults on the ASD spectrum.
A reduced amount of REM sleep has also been reported in children with ASD compared with typically developing children.

As a result of this lack of research in the field of assessment and treatment of sleep problems in people with ASD some caution is required in the delivery of any form of intervention, without a sound knowledge-base to which to refer. As such, a careful and thorough assessment is required involving the person with ASD (taking into account the capacity of the person to engage and comply with any suggested interventions), their family/carers and other treating professionals. This is essential in order to design appropriately paced interventions that are person-centred, sensitive to family situations, and which takes into consideration the number and type of other interventions that are in place. Of particular note here is the phenomenon of hyperactivity in some children with ASD which is a common behavioural manifestation in this group of clients. Excessive levels of daytime activity can lead to excessive tiredness and this can then have a negative impact on behaviour and mood. Sometimes attention to the reduction of daytime activity is warranted through the scheduling of rest-periods, or attenuating periods of activity so that the client is not excessively active for long periods. This approach has been acknowledged in the literature: that treatment approaches require individualised assessment in order to establish the relative impact of these factors on the sleep of children with ASD and to tailor interventions accordingly. For example, introducing more protracted and graded wind-down time in the evenings before bed, limiting exposure to bluescreened devices, and looking for opportunities to reduce sound pollution during the night within the bedroom and the wider household environment (Cohen et al., 2014).
Recent guidelines published in 2020 by the American Academy of Neurology for the treatment of insomnia and disrupted sleep behaviour in children and adolescents with ASD recommend that clinicians need to screen for medication usage and comorbid conditions that may be contributing to the sleep disturbance and address those identified issues first. It is further recommended that clinicians should council parents and/or carers in the use of behavioural strategies (especially the NICE recommended Cognitive Behavioural Therapy for insomnia - CBT-i) as a first line treatment approach for managing the sleep disturbance of the child in their care. The use of melatonin in managing the sleep disturbances is approved once behavioural strategies have been
attempted and not been successful, but these prescriptions should begin with a low dose of pharmaceutical-grade melatonin along with guidance and advice on potential side-effects. At the time of writing the use of weighted blankets or other specialist bedding materials (for example wedges/mattresses) do not have any evidence to support their use, however because of no serious adverse events have been noted with the use of these aids, these have the potential to be a useful nondrug approach for some people. With the added caveat that weighted blankets should not be used with very young children or those who may be quite frail so as to avoid the potential for asphyxiation underneath weighted bedding of this kind (Williams-Buckley et al., 2020). ■

Mastering Balance: THE SUBCONSCIOUS SCIENCE OF STABILITY
THE KEY TO EVERYDAY FUNCTIONING
Balance is more than just a physical act; it’s the silent conductor orchestrating our every move and ensuring seamless functionality in our daily lives.
We all know what good balance looks like and what the consequences of losing our balance are. Sure, there are some superhumans who have developed their balance mechanisms to an elite level to do some extraordinary stuff, but for most of us Earth dwellers, balance is a vital component of our everyday lives to which we give minimal conscious effort.
Balance is not a specific activity or exercise; it is the subconscious puppet-master that enables us to function as human beings. For example, you stand up to walk to the kitchen to make a coffee during the adverts. The doorbell rings. Your balance enables you to change your intention and direction in an instant, and your body, without conscious thought, organises itself to get you to the door safely.
However, it’s precisely in these everyday scenarios that many struggle. In moments requiring quick reactions and adjustments, the inability to recalibrate swiftly can lead to falls.

SENSORY SYSTEMS AND MUSCLE FUNCTION
Balance isn’t just about staying upright; it’s an intricate process of interpreting information about ourselves, the task (both planned and unplanned), and our environment, all without conscious effort. Balance works subconsciously, effortlessly, and is switched on all the time.
SIGNS OF BALANCE STRUGGLE
Some balance problems are easily observable; a person will appear unstable as they move through their environment. However, reliance on aids like sticks, linked arms, or furniture indicates deeper balance challenges.
The cognitive load required to manage these aids is substantial. Even without such aids, individuals may be consciously focusing on maintaining their balance.
This conscious effort often impairs multitasking abilities; individuals may stop walking to respond to a question. Consciously managing balance drains cognitive resources,
Achieving balance requires orienting your centre of mass over your base of support and stabilising it. This involves a deep awareness of your position in space. We are all aware of the importance of visual and vestibular systems, but one of the most significant inputters of sensory information to the cerebellum are areas of the body that we do not normally associate with sensationour joints and our muscles, referred to as our somatosensory systems. Both our joints and muscles possess sensory receptors that inform the cerebellum about our spatial location, surface contact, joint position in space relative to other body parts, and muscle activity (active and static, or active and moving). This wealth of information, combined with visual and vestibular input, is consistently being relayed to the brain which constantly adjusts the body to ensure our centre of mass remains within our base of support, whether the base of support is moving (e.g., walking) or being moved (e.g., on a train).
Achieving balance requires orienting your centre of mass over your base of support and stabilising it. This involves a deep awareness of your position in space.
Our bodies are made up of two primary types of muscles: stabilisers and movers. These muscles have distinct roles, locations, and microscopic structures. Stabilisers are located in the trunk and proximal parts of our limbs, while movers are more distal.
However, issues with joint mobility, muscle tone, length, or strength can change how the body uses a particular muscle.
A muscle intended as a mover may need to act as a stabiliser, even though its location and structure aren’t optimised for this role. For example, when using a walking frame, hand muscles, typically movers, become stabilisers for the entire body.
Consider a child with cerebral palsy who has poor trunk stabilising muscles and, to sit upright, uses his arms to prop himself up. If muscles designed to be movers act as stabilisers for poor balance, then the individual’s capacity for releasing the arms for functional tasks is also dramatically reduced.
For individuals living with acquired brain injuries, muscle function can be further complicated by issues such as joint mobility problems, muscle weakness, spasticity, and impaired coordination. These challenges can significantly impact their ability to maintain balance and stability.
By understanding the important role muscles play in maintaining balance, we can better appreciate the silent heroes that enable us to move through the world with confidence and stability.
To achieve balance, our bodies must orient our centre of mass over our base of support and stabilise it. This requires precise coordination between our joints, muscles, and sensory systems. Both our joints and muscles possess sensory receptors that provide essential information to the brain about our position in space, our contact with surfaces, and the activity of our muscles.
When these sensory inputs are disrupted, as is often the case in individuals with acquired brain injuries, maintaining balance becomes even more challenging. Damage to the brain can interfere with the communication between the brain and muscles, leading to difficulties in coordinating movement and maintaining stability.

Community neurophysiotherapy focuses on providing specialised rehabilitation within the community setting, helping individuals regain movement, function, and independence in their daily lives. Riley’s story: ONE YOUNG MAN’S DETERMINATION TO WALK AGAIN
From its centre of excellence in Tadworth, just outside of London, The Children’s Trust operates the UK’s largest paediatric neurorehabilitation service. Here they provide the most complex rehabilitation to children and young people with acquired brain injury outside of a hospital setting.
Twelve-year-old Riley was enjoying a normal New Year’s Day when he suddenly experienced an aneurysm. He underwent life-saving surgery at Great Ormond Street Hospital, where he spent the next fiveweeks recovering before coming to The Children’s Trust to begin a specialist, residential rehabilitation placement.
RILEY’S GOALS
Riley, his family and our expert staff worked together to set his rehabilitation goals. He wanted to be able to complete self-care tasks, return to gaming and mainstream education, and, most important to him, be able to walk again.

OUTCOMES
With the support of his family and our multidisciplinary team, Riley achieved all his goals during his five-month placement at The Children’s Trust. Upon admission, Riley’s rehabilitation complexity score, a measure which is used to determine a patient’s level of need, was high. At the point of discharge, Riley’s level of need had decreased to low, showing greater independence, improvement in meeting his own self-care needs, and mobility.
To work towards these goals, Riley had an individualised rehabilitation plan including speech and language therapy, music therapy, physiotherapy, occupational therapy, hydrotherapy and more. He also received botulinum toxin treatments to improve the function of his left arm.

Alongside this and complementing his therapy programme, Riley had access to cutting-edge neurotechnology to help him achieve his goals. Upper limb robotics were used for high intensity movement practice and task training to improve the

Following his residential rehabilitation placement, Riley received support from The Children’s Trust’s Community Rehabilitation Service, in particular, ongoing specialist physiotherapy to further progress his mobility skills. With this continued support, Riley can now walk without stopping for up to 5 minutes with the aid of a bespoke ankle foot orthosis. He can also climb stairs with the assistance of one person.
Improvement in his left upper limb coordination also meant Riley learnt to swim independently again and he now has the confidence to visit his local swimming pool. He is back in school on a phased return and is enjoying being back with his friends. ■

Victims of catastrophic injuries require the highest level of rehabilitation. There is a real necessity to ensure they receive the support they need to meet their functional and psychological goals in order to help improve their overall quality of life. We set up this expert witness service to better support personal injury lawyers in their endeavour to implement music therapy into their client’s rehabilitation packages.
As the benefits of music therapy continue to present themselves, more and more legal teams are experiencing
the impact it can have upon the functional, cognitive, and psychological well-being of their clients. With this service, we are able to support and strengthen personal injury lawyers and case managers’ cases for rehabilitation packages suitable, necessary, and essential to improving their clients’ quality of life.
Survivors of a serious injury may not be able to verbally communicate their thoughts and feelings about the drastic changes to their lives, their hopes for the future, or what goals they want to achieve through rehab, so it is our duty as music therapy expert witnesses to determine their rehabilitation needs, so that injury lawyers can ensure their client’s needs can be met.
WHAT MAKES US EXPERTS AND WHAT DO WE DO?
For quality assurance to this service, all Chroma experts are HCPC-regulated music therapists and/or neurologic music therapists who have also achieved the Cardiff University Expert Witness Diploma, with at least 10 years’ experience in the field.
We provide face-to-face assessments or desktop reports to assess and determine the impact of music therapy/neurologic music therapy on clients, including costing structures for future work. We work on behalf of both claimant and defendant parties, ensuring independent and robust reports and recommendations.
Once determined, we provide expert, court-approved reports outlining the need for music therapy to be implemented into their rehabilitation, the benefits, and the total cost so that legal teams can present all the information proficiently in court.
HOW DOES THE PROCESS ADHERE TO DATA PROTECTION?
We have implemented a number of technological approaches to this service, firstly through the introduction of ALLDOQ - a workspace built specifically for medico-legal expert witnesses that allows us to securely store, organise and complete medico-legal work in the cloud. It allows us to generate, GDPR compliant, courtapproved reports that are safe and secure.1
Case managers and personal injury lawyers appreciate our use of ALLDOQ as they recognise its benefits within the expert witness medico-legal sector and how comprehensive the system is. Its built-in features improve communications between all parties involved, meaning no one misses any important information related to the case.
ALLDOQ is designed solely for expert witnesses, with niche features incorporated. It is GDPR compliant. The platform itself makes case management efficient and ensures final reports are court-approved.
INTRODUCING TECHNOLOGY TO SUPPORT MUSIC THERAPY BENEFITS
Secondly, we are adopting new technologies within our music therapy sessions. Music technology is constantly developing to ensure music therapy can be delivered in increasingly personalised ways. Such software aims to empower music therapists to use music technology more accurately and efficiently within therapy practice.
Technology is advancing the benefits of music therapy in neurorehabilitation, and these new approaches are especially pertinent for case managers and injury lawyers to be aware of because of their positive impact on the rehabilitation of brain injury survivors.
To support clients in rehab after brain injury, we have begun implementing music software ISOFI2 and MediMusic3 . This software can work alongside current music therapy/neurologic music therapy (NMT) techniques to help clients develop evidencebased strategies for common mental health scenarios. We do this by using the client’s favourite music to set personal goals.
Personalised music offers the best reach to brain injury survivors and proves to be a vital mood enhancer.(4,5,7,8,10) Mood enhancement improves rehab engagement, which in turn improves goal outcomes, and music therapy is one of the most motivating therapies to support this.
The software analyses a client’s own music tastes from their preferred streaming platform. It generates personalised playlists based on, for instance, artist, genre, commonly used words/ phrases etc, to then be utilised as a coping strategy for common mental health issues such as stress, anxiety and depression. Many populations use music to relieve depressive symptoms, but the music they choose, although they may enjoy, does not have the desired mood enhancing effect they desire.9 This is why song choices and musical preferences are of the upmost importance when supporting mental health and wellbeing.
It has been suggested that the influence of music is dependent on extrinsic factors that connect a person with the music personally (memories/associations with different parts of their life) and intrinsic elements within the music (such as rhythm, melody, and harmony).11 Therefore, personalised music is the best approach to achieving a desired mental state, and we use technology to support this process.
Both platforms use personalised music as a motivational, mood-enhancing tool to help survivors navigate and express their emotions without the need for words.
The software is implemented during sessions, but with 24/7 availability to the generated personalised playlists, it can also be accessed by Physiotherapists, Occupational Therapists, and Speech and Language Therapists during rehab to act as a mood improver and support the client’s participation in rehabilitation. Seeing positive results in rehab will ultimately also help to improve the client’s mental state.
These playlists can also be accessed by carer’s and loved ones, so they can be played throughout the day when their mood needs to be lifted—improving not only the quality of their own daily life but that of their loved ones and their carer’s, as well.
CONCLUSION
The aim of this Music Therapy Expert Witness service is to help secure the best rehabilitation package for clients and enable legal teams to access independent expert witness testimony to help put forward a compelling case for the benefits of music therapy, including the latest technological approaches, within rehabilitation programmes for victims of a catastrophic injury, and help make clear to the courts, how such therapies ‘will’ improve victims’ quality of life. ■

Neurons that fire together, wire together HARNESSING THE POWER OF NEUROPLASTICITY AFTER BRAIN INJURY
One of the key concepts underpinning neurorehabilitation is neuroplasticity. The more a neural network is used, the stronger it becomes and the more resilient it is to deterioration.
THE 10 PRINCIPLES OF NEUROPLASTICITY
1. Use it or lose it – neural circuits that are not actively used will deteriorate, and the brain can ‘forget’ how to use the affected hand or limb.
2. Use it to improve it – repetition of movement is needed for long-lasting neuroplastic change.
3.
Time since injury – there is a window of great opportunity for neuroplasticity in the sub-acute phase but changes can also be seen years after injury.
4. Age – it is thought that neuroplastic potential declines with age, and changes may become slower and less profound.
5.
Transference – the effects of neuroplasticity can spill over into other areas of the brain.
6.
Interference – neuroplasticity is not always positive. The brain is shaped by an individual’s environment, and we must consider the impact of stress and other daily activities being carried out.
7. Repetitions – the more repetitions of a movement, the more neuroplastic changes will be laid down and strengthened. Dose and duration also play a role, with the best results delivered through high-intensity therapy over a short period of time.

Intensity – it is important to get the intensity of the activity ‘just right’ and gradually increase it through ‘growing’ the challenge, combining increased coordination, sensory input, and strength to create a demand for better performance and achieve systematic progression.

Specificity – making exercises task-orientated helps ensure they are relevant, interesting, challenging, and goal-directed for the patient.

Salience – being able to gain and maintain a patient’s attention, motivate them and induce a sense of ‘flow’ are also key factors that can influence neuroplasticity.

Expertise and timing are integral to case management and in achieving the best rehabilitation outcomes for clients. Identifying needs is one thing, but knowing how and when to address these, is the difference between good case management and excellent case management.

THE RIGHT PEOPLE
In the first instance, it’s about appointing a case manager with the specific expertise who can enlist specialist therapists and professionals as part of a wider MDT to support all aspects of the client’s rehabilitation. Defining goals and identifying treatments involves communication with the client, their family and a range of MDT professionals to understand and prioritise what is right for the client at that time. Case managers take the time to get to know the client and understand what life was like pre-injury, what is important to them and what they want to achieve. Establishing a good relationship enables the client to feel comfortable enough to let their case manager know when they are struggling or when they feel they can achieve more.
successful outcomes for the client. While the initial plan may meet the client’s every need, trying to implement everything all at once is unlikely to support the safe, sustainable recovery of a client. The goal of one of our clients who sustained a traumatic brain injury was to return to university. Working closely with the client, we found that focusing on one intervention at a time ensured the client didn’t feel overwhelmed. This approach supported the client to progress more effectively, and in this case, the client was able to return to university, despite initial medical opinion that he would be unlikely to achieve this goal. The case manager and MDT are crucial in recognising the signs of overwhelm, and work together to adjust the programme. By taking a stepped approach, the case manager can evaluate the success of each intervention and be prepared to change the rehabilitation programme to prioritise what’s important in the client’s recovery and plan the next intervention accordingly.
Working closely with the client, we found that focusing on one intervention at a time ensured the client didn’t feel overwhelmed.
THE RIGHT GOALS FOR THE CLIENT
Case managers make sure clients see life beyond injury and understand rehabilitation must fit in with the client’s life. For some, spending an hour on the sofa watching a film with their kids supports their wellbeing more than an hour of formal therapy at that particular point in their recovery. Clients often have specific goals, and the case manager has the opportunity to think beyond the usual constraints to find a way for the client to achieve even the most ambitious of goals. Sometimes the client has moderate expectations of what they can achieve, and their case manager can help empower them to achieve much more than they thought possible. ■

This summer, a client’s mum approached us to arrange the trip of a lifetime for her son to Disneyland Paris. An incredible amount of planning behind the scenes went into the trip, from finding accessible, appropriate accommodation (harder than it seems!) to writing countless risk assessments, making sure medication is legal
in the destination country, and providing hospital passports and information in the correct languages, as well as finding English speaking pharmacies and GPs just in case. Through sheer determination and an incredible team, we made this happen and it was such a success that we are taking it one step further and going to Florida this year!

HOW PERSON-CENTRED CARE LEADS TO SUCCESS
We support a male who suffered a brain injury in a car accident, leaving him immobile with complex care needs and behaviours. Before his discharge from the Queen Elizabeth Foundation, we organised a training day involving his family, the entire Multi-Disciplinary Team, and his Team
Brain Injury Support team. The day focused on his specific needs, with input from various specialists and his family sharing insights into his history, goals, and adapted vehicle. The guidance from this team shaped our person-centred care plan. Initially, we provided double up care during the day and waking nights, thanks to everyone at Team Brain Injury Support, we’ve reduced support to one worker during the day, with plans to further reduce to sleeping nights. Remarkably, the individual now walks with a pole and no longer requires a wheelchair, often using a rollator in the community. To say this individual has grown in confidence is an understatement as he has now also transitioned from male to female. We are exceptionally proud of how far they have come, and it has been a privilege to support them on their incredible journey of rehabilitation. ■

FUNCTIONAL ELECTRICAL STIMULATION (FES) for correction of dropped foot
FES is increasingly being seen as a first line intervention to improve the mobility of people with neurological disability. Paul Taylor has pioneered its use within the NHS.
Dropped foot is the inability to lift the foot as the leg swings forward when walking. It is caused by weakness in the muscles that lift the foot and/or excessive activity (spasticity) in the antagonist muscles. Dropped foot increases the risk of falls, reduces mobility and participation in activities of daily living.
WHAT IS FES AND HOW DOES IT WORK?
Functional Electrical Stimulation (FES) is the production of functional movement in paralysed or weak muscles by the application of small pulses of electrical current to the nerves that supply them. The Odstock Dropped Foot Stimulator (ODFS®) Pace was developed at Salisbury District Hospital. It stimulates the common peroneal nerve at its most superficial point where it passes the head of fibula, using self-adhesive skin electrodes. Stimulation is timed to the walking cycle by using a pressure switch placed in the shoe under the heel. Stimulation begins when the heel is lifted from the ground and ends just after heel strike. Stimulation causes the foot to lift and stabilises the ankle when it is returned to the ground. Stimulation feels like pins and needles and most people quickly become used to the sensation.
I have been using a single channel stimulator for foot drop, due to MS, for 5 years. I wear it every day and it has allowed me to carry on working full-time. It is the single most helpful thing in this journey as a patient, and has allowed me to remain as active as possible.
The ODFS® Pace is primarily used as a long-term assistive device. However, therapeutic training benefit has been demonstrated in people who have a dropped foot due to stroke, spinal cord
injury, Parkinson’s and some people with MS. It can also be used in early gait re-education to help facilitate a normal gait pattern, including the retraining of knee and hip control. Because FES can reduce spasticity though activation of reciprocal inhibition, it is often a more effective mobility intervention than passive orthotics and can enable greater range of movement and ground clearance.

The ODFS® Pace is a practical device with adherence to treatment at one year of 86%. FES can be used to assist walking in any neurological condition resultant from an upper motor-neuron lesion (lesion within the brain or spinal cord above T12). This includes stroke, MS, spinal cord injury, traumatic brain injury, cerebral palsy, hereditary spastic paraplegia and Parkinson’s disease.
FES for correction of dropped foot is a recommended treatment in NICE guidelines IPG278, ACPIN and ANPT clinical guidelines.

The Case for 24-hour POSTURAL MANAGEMENT
A growing body of research and consensus supports the effectiveness and importance of 24-hour postural management to enhance the well-being and quality of life of individuals with movement disorders, writes Marcin Paszenda, Clinical Assessor at Wheelfreedom.
-hour postural management is a comprehensive and holistic approach that focuses on assessing and improving body positions, over a full 24-hour period when lying, sitting and standing. It will often involve a team effort, to promote good posture - both night and day, enhance function, encourage participation and prevent issues related to movement conditions.
THE RISKS AND CHALLENGES OF INADEQUATE POSTURAL MANAGEMENT
Lack of adequate postural support can affect function of all the vital body systems and profoundly affect the quality of life. As a consequence individuals with poor postural support might be exposed to pain, discomfort, musculoskeletal disorders and other secondary complications.
In some instances, advocates of 24-hour postural management encounter resistance due to a lack of awareness or even scepticism. At first sight a user might think a prescriptive wheelchair is the cause of postural problems or pain, however, a 24-hour postural management approach is likely to reveal contributing factors like standing or lying down
when out of the wheelchair, throughout the 24-hour period. Despite these challenges, 24-hour postural management is a powerful tool for clinicians and its benefits can clearly be seen in daily practice.
A COMPREHENSIVE, PERSONALISED AND HOLISTIC APPROACH
A well-designed 24-hour postural management program can help prevent long-term changes to body shape caused by gravity’s continuous impact on the body. Combined with a personalised care plan assessing body symmetry, pain levels, sleep quality and utilising the appropriate equipment, like prescriptive wheelchairs and sleep systems, 24-hour postural management can maximise function and well being.

It can be such a relief when a litigation claim comes to an end. However, the next step following receipt of an award can sometimes be just as daunting.
GERALD’S STORY
Consideration may need to be given to what impact a lump sum may have on a claimant’s benefits or care funding position. Even if the claimant is not in receipt of means tested support, there can still be good reasons to consider a personal injury trust.
Gerald sustained significant spinal injuries as a result of an accident at work. Gerald was unable to return to work and subsequently pursued a personal injury claim, resulting in a significant lump sum settlement.
Gerald and his wife, Jenny owned their own home together. Gerald also had a moderate amount of savings that meant that he was not entitled to any means tested benefits once he had stopped work. Jenny provided most of the dayto-day care for Gerald following his injury however a private care package was put in place and was funded by interim payments and subsequently, Gerald’s final award.
Wrigleys were asked to provide advice to Gerald regarding the benefits of putting a personal injury trust in place. Although there may not be an immediate financial benefit in Gerald considering a personal injury trust, it was still important to consider whether a client may choose to hold their award in trust.
Even when someone is not in receipt of means tested support, placing an award into trust still can have long-term advantages. The future is unpredictable and circumstances can change. Over time, Gerald’s personal savings could decrease below the relevant threshold for means tested benefits or local authority funding.
A personal injury trust can also offer peace of mind whereby trustees could assist Gerald in making difficult decisions about investments and budgeting. A trust could
also protect Gerald from any pressure to make gifts from his award.
WHAT HAPPENED NEXT?
Despite there not being an immediate financial benefit in setting up a trust, Gerald proceeded to put a personal injury trust in place appointing his wife, Jenny and Wrigleys as a professional trustee.
As it happened, four years after setting up the personal injury trust, Gerald moved into long term residential care. Gerald’s personal savings quickly depleted paying for this care, however, as Gerald had elected to pay his award into trust, the award was disregarded in the local authority’s means test. Gerald was therefore entitled to a contribution towards his residential care costs.
Gerald’s trustees were able to top up his care costs and provide ongoing funds for additional therapies from his trust. Had the award not been held in trust, the local authority would only have begun to contribute towards Gerald’s care costs once his assessable assets fell below the local authority threshold for care funding.
This case study highlights that even when a claimant does not receive means tested support it is always worth considering how a client’s position may change in the future. It can often be favourable to have funds paid directly into a trust to ensure that personal injury funds would be disregarded if necessary should the client’s circumstances change. ■

Why the relationship between solicitors and case managers is key to REHABILITATION AND SUCCESSFUL CLAIMS
In catastrophic injury claims, there is a large team around the injured claimant. The legal team consists of the lead solicitor and colleagues working on the case at the solicitors’ firm. In addition, one or more barristers will present the case in court if it goes to trial. There will also be medico-legal experts reporting on the claimant’s condition and prognosis to the court.
The rehabilitation professionals are a vital part of the claimant’s team. This will consist of the case manager and other rehabilitation professionals working with the claimant to maximise the claimant’s recovery and the speed at which it takes place. Depending upon the issues the claimant faces, a few professionals may be working with them.
This article is written on the assumption that the claimant has instructed the case manager singly. If the case manager is instructed on a joint basis, then similar considerations will apply. However, communication will then be between the case manager and both the claimant’s and defendant’s solicitors.
COMMUNICATION
The main conduit for communication between the rehabilitation and legal teams will be between the case manager and the solicitor. This relationship is of fundamental importance to any catastrophic injury claim. There must be clear communication channels between them, which need to be used regularly throughout the case. For reasons of space, this article concentrates on communications from the case manager to the solicitor. While it is just as important for the solicitor to keep the case manager informed as the case proceeds, actions the solicitor needs to take may have much longer lead times than those of the case manager.
KEY ISSUES TO CONSIDER
It is vital the case manager feels that any issues they raise with the solicitor will be taken seriously. By the same token, the solicitor will want the case manager to raise important issues with them in a timely manner as the case proceeds. These issues may include the following:

A change in the claimant’s presentation. If the claimant’s presentation has deteriorated or improved, the claimant’s solicitor will need to know about it, as the change must be reflected in the evidence. In particular, changing symptoms may warrant the claimant’s solicitor introducing new types of medico-legal experts to the case. The solicitor may want to arrange re-examination of the claimant by the existing experts. Given the long lead times there can be with medico-legal expert appointments, the claimant’s solicitor must be notified about any change in presentation as soon as possible so that the necessary expert appointments can be arranged.

Rehabilitation strategy. The case manager may change their approach to rehabilitation, perhaps because they feel the current approach is not working for the claimant. The claimant’s solicitor’s job is not to tell the case manager how to approach rehabilitation, but they will have informed the medicolegal experts about the rehabilitation strategy and sought their endorsement of the approach being taken by the case manager and the rehabilitation team.
If the strategy is changing, the solicitor needs to know. Again, this change may require an update to the expert evidence. A different strategy may also warrant a request for further funding from the defendant’s insurer, for instance, to pay for a more intensive approach to rehabilitation. Either way, the claimant’s solicitor must be given early notification of this. Seeking further money for funding may take months, particularly if court proceedings need to be started and a contested application made to the court to force the defendant to make a payment.

Safeguarding concerns. Claimants are often highly vulnerable, and it is not unusual for there to be safeguarding concerns relating to people who have contact with them. The solicitor must know about any such concerns. Firstly, this is because there will need to be a pooling of information around the concerns. Secondly, a strategy in relation to informing the claimant and their family of those concerns will be required. Statutory authorities may have to be notified. The solicitor will need to be aware of this as it will generate further information and documents relevant to the claim. Depending on the identity of the person on whom the safeguarding concern centres, the solicitor may decide that the issue should be brought before the court, especially if the concerns relate to close family members. Either way, it is important the legal team is aware of such concerns.

Behavioural approach. Brain injury survivors, in particular, often display challenging behaviour. The case manager and the rest of the rehabilitation team will need to work out its approach to solving such issues. For a couple of reasons, it is vital that any such approaches are discussed with the solicitor. First, it is useful for the legal team to be aware of the approach the rehabilitation team takes with behavioural issues. Also, the legal team should reinforce that approach or, at the very least, ensure they are not doing anything to actively undermine it.

There are often difficult issues raised during a catastrophic injury claim for the rehabilitation team. The case manager is a rehabilitation professional well used to dealing with tricky issues. Indeed, you may argue that the case manager’s job is to solve problems. However, it is always useful to have another professional to bounce ideas off and the case manager should feel able to discuss issues with the solicitor as part of a mutually supportive approach.

By producing regular paperwork, the case manager will keep the legal team well informed about what is happening with the case. However, disclosure of case management records is not a substitute for having regular case management reports, as case management records can be very in-depth. It can be difficult for the legal team to sort the wood from the trees as to the rehabilitation team’s strategy and approach. Similarly, it is not always clear from the case management records what the reasoning behind any approach being taken by the case manager is. Regular reports from the case manager are vital for the legal team for their own purposes and to keep the defendants updated on what is happening.
In conclusion, it is difficult to overestimate the importance of the relationship between the claimant’s solicitor and the case manager. They both need to work on it to ensure a consistent proactive approach to the claimant’s litigation and rehabilitation, as ultimately the claimant is the beneficiary of their hard work together. ■
