Darlings, Last month, while listening to the news of record-breaking temperatures and outof-control fires in the West and Southwest, my thoughts turned to my old friends, Joe Hoffman and John Day, who were once upon a time Santa Fe Realtors and who are now Happy Palm Springs Residents. I envisioned them riding out the heat wave — or should I say floating out the heat wave — in their pool, decked out in nothing more than their altogether and sipping mojitos. Well, Love Bugs, I was wrong. It was too hot in the pool, so they got married instead! Yes, as soon as DOMA was struck down by the Supreme Court at the end of June, they made their wedding plans, and on July 2, they were in the Indio courthouse saying their vows. Joe and John (together 26 years) had a double wedding with their two best friends, who have been together for 43 years. But the record holders that day were another couple who have been together 67 years. What a landmark day for all these people. The only thing that upsets me about this is that I wasn’t there. (Cupcakes, when will I stop being so selfish? Never?) Another event that I won’t get to attend is the 65th Annual Primetime Emmy Awards Ceremony in September. Why is that, you’re dying to know? It’s because Jama Fontaine (Keller Williams Santa Fe) is taking her best friend instead of me. (Always the brides-

maid, never the maid of honor, sob.) Yes, Dear Hearts, Jama, forever the enthusiastic participant in every event she attends, was the highest bidder for the two tickets to the Emmys auctioned off at the Buckaroo Ball in June. Now her big decision is what to wear, because these tickets include a walk on the red carpet, and she knows we’ll all be waiting to hear her answer when the interviewer yells out to her, “Jama, darling, who are you wearing?” Uh-huh, the pressure is on. Butter Beans, it seems that Keller Williams has been adding a few new names to its roster lately. Freddie Sue Gatewood returned to KW after leaving a few years ago. She came to her senses about how good her orange motorcycle looks parked on Lincoln Ave. Connie Young (formerly a one-person company, Connie Young Real Estate) loves KW because she has access to up-to-the-minute technology, and there are more Realtors to lunch with. Paul Duran (formerly Sotheby’s) really liked the idea of riding the old escalator every day, but it’s been removed in favor of a new elevator. In the meantime, he finds the enthusiasm in the KW offices so energizing that he runs up and down the stairs several times a day just to calm himself down. Andy Ault (formerly Santa Fe Properties) likes new challenges — he was on his way to climb a Fourteener mountain peak in Colorado when I caught up with him — so he’s excited about accessing new marketing techniques, plus he likes the KW profit-sharing business model. (Paul does, too, Petunias, I was just kidding about the escalator.) Breaking the mold of the traditional brick-and-mortar real estate office is the new kid on the block, eXp Realty. A new business model, yes, but it still has an attraction for seasoned Realtors. Including ones

we know. Julee Brooke, Peter Kahn, Robbie Dobbins, Anthony Atwell, Fran Hill, and Suzanne Fuqua, to name a few. She told me that when she recently turned 60, she felt bad about her neck, so she naturally did something about it. The Lifestyle people were so pleased with her results that they want to show her off. PROFILE Patrick Walker
This interview series focuses on the people in Santa Fe’s real-estate industry. Patrick Walker is a broker at Karen Walker Real Estate; in fact, he and his brother Jim are both brokers at the firm, and both sons of its owner, Karen Walker.
Where did you grow up, Patrick? I was born in Santa Monica and raised in the Valley, in Sherman Oaks, then Karen kind of dragged myself and my brother here in 1970. I was 10. Talk about culture shock, from freeways and swimming pools and manicured lawn to a dirt road and a very old adobe on Abeyta Street. My mom came here with $500 in her pocket and we rented from Don Van Soelen. The house in California was very middle-class, but my mom’s parents lived in Bel Air so we used to love visiting their house. We have a great photograph of my grandfather’s golf team at the Bel Air Country Club and it’s Dean Martin and Ray Bolger and Lex Barker. Then suddenly we’re in Santa Fe with — from a kid’s perspective — one McDonald’s, three TV stations, and your phone number was five digits. Karen is a big advocate for historic preservation, which is so important on the Eastside. It’s huge. Basically she kind of took over Sara Melton’s mantle, although in a lower key, as a keeper of records. The city has not been the best at that. She gets and I get inquiries from a lot of brokers about what can and cannot be done on the Eastside. We’ve seen numerous times permits were either not taken out at all or they were given for changes to properties that basically took them out of historic status. When I first started in the early 1980s, some national lenders didn’t want to lend on Eastside properties because of the lack of paving and gutters and streetlights, yet these were some of the most expensive properties in the state. Where did you go to school? I went to Acequia Madre School, then Harrington Junior High School, which is now a playground for Wood Gormley Elementary, then to mid high school. That was pretty interesting because it brought all the junior highs together for one year. At the time it was Harrington, Harvey, DeVargas and Young junior high schools and they all were together for the 9th grade. Then I went to Santa Fe High, which was the largest high school in the state when I graduated in 1978. What did you want to do? I wanted to have some career tied to athletics: an agent, a broadcaster, a writer. Jim Murray was the guy I looked up to at the LA Times, and Chick Hearn, the play-by-play announcer for the Lakers. I was the co-captain of the only 26

state champion basketball team Santa Fe High has ever had and for basketball-crazed Northern New Mexico, that was a pretty big deal. I remember them saying that at the time the crowd for the championship game against Albuquerque High was the second biggest high school basketball crowd ever in the country. Then I went off the to University of Colorado and graduated four years later with a double major in economics and political science. Right before that, I had a sports-related shoulder injury that required surgery. During my recuperation I had no idea what I was going to do. My mom asked if I wanted to join the family business. She had started in 1973 and had her own firm, which was Walker and Dickerson at first, in 1975. I said sure and here I am 30 years later. You never did anything professionally in sports? Sports and politics is still what I love the most. For a couple seasons I did do some color commentary on local radio for high-school basketball games, but that was it. I do play a lot of golf and I like swimming and skiing. Are you married? I’m single, but I am getting married on Aug. 1 to Susan Loomis, who is a broker with Santa Fe Properties.
What do you think about our water-supply issues? New Mexico is pretty far behind the curve in water planning. One interesting angle is that about five years ago, there was a low- and slow-flying plane zig-zagging above Santa Fe for a few days. The New Mexican produced a 3-sentence paragraph saying they were mapping the underground water and we never heard anything more. About two years ago I went to the State Engineer’s Office and asked about this. The guy I found kind of winked at me and gave me the runaround that some “federal mechanism” had to kick in before they could reveal the results. I wanted to say that our firm was the first to get rid of agency and become simply transaction brokers. Can you talk about that a little? Realtors are commonly referred to as agents, but people don’t understand that even your attorney doesn’t have that leeway unless you give it to him. As an agent you can speak for and act for your clients; that is part of the legal definition of agency. You cannot do that if you are a transaction broker. The reason we made that change was to limit the liability of our buyers and sellers. In agency, if you make a mistake, the court will look at the buyer or seller with more culpability. There was a lot of resistance to this, but today agency is very rarely used. One thing I want to mention that I’m pleased about is that this firm has never been sued. I am not aware of another firm that’s been around as long as we have that hasn’t faced some kind of legal challenge. I’ve chaired the Santa Fe Association of Realtors Grievance Committee and I sit on the Professional Standards Committee and both deal with complaints, either public-to-broker or broker-to-broker. Aren’t many transactions simple and straightforward? My guess is that if you asked the average Realtor in Santa Fe what is the percentage of your simple, nonproblematic transactions, it will be under 10 percent. So what we do is try to do is to identify any and all issues as early as we can. It’s the 11th-hour when the real problems happen. The psychological element in real estate is huge. To me, it is imperative to know the background of the buyer and the seller. What do they do? What did they do for a living? What part of the country are they from? What are they used to? I want to know their tendencies. Is it an engineer at Los Alamos National Laboratory or an attorney from Houston or an artist on Canyon Road? Because they may look at the same property from totally different perspectives and if I know about this, I’m better prepared to assist them and to communicate what’s important to them. The ability to paint a big picture for both buyers and sellers is greatly enhanced when you know who they are and what they like.

Homegrown wisdom-buffet at SFCC There is a patch of ground near the southern edge of town. Not long ago, this landscape was a desolate embarrassment. Today, it’s exploding with food. What’s even better is that you can be part of it in a wide variety of ways. Smack dab on the backside of the Santa Fe Community College (SFCC) campus, a challengingly shaped triangle next to the Culinary Arts Café seemed to be the neglected stepchild of the campus-planning team. Now, in less than a year, a bountiful garden has produced 100 pounds of chard and kale, two crops of lettuce, and all sorts of edible alliums, greens, herbs, and root crops. One week last June, according to garden coordinator Erin O’Neill, they hauled out 30 pounds of beets. Fortunately, for the haulers, their harvests have come from 16 raised beds provided by Ken Kuhne. Raised beds are also great in hightraffic areas because they keep people from trampling all over your hard-earned soil. O’Neill admitted that aphids were a challenge early on, but as soon as her group got the hang of keeping the covered beds properly ventilated, the aphids disappeared. A wise and experienced high-mesa gardener, O’Neill will be teaching a class called Gardening in the Desert this fall as part of the SFCC’s continuing education program. Culminating in a big harvest party at the end of October, the class will meet for six Saturday mornings from mid-September through October. (Don’t worry, early birds can still hit the farmers’ market!) But if you can’t make the class, opportunities abound if you’d like to participate in this impressive volunteer-project. But that’s not all. This fall at the community college, you can also learn how to grow huge quantities of vegetables in closed-loop systems that are also connected to schools of delicious tilapia, trout, or bass. Yep, fish in the desert. John Eric Scholz, president of the Bioponics Institute, is teaching a relatively new technology in which hydroponics meets ichthyology and limnology — the studies of fish and ponds, respectively. (Don’t be ashamed; I had to Google them, too!) Bioponics claims to use 1/50th of the water that conventional farming uses, but it does take some knowhow: a 16-week college-credit course, to be exact. By December’s end, Scholz says graduates will be able to build their own bioponic systems and start making money by selling food to humans or even fodder to cattle. Scholz was also quick to point out that a significant part of the class will focus on the business side of a real-world bioponics venture.

HOA Act is now New Mexico law On July 1, the first Homeowners’ Association Act recently passed by the New Mexico Legislature became law. The act provides a framework for future amendments, but offers important protections to both homeowners and associations. The act applies to all homeowners’ associations, but not to condominiums governed by the Condominium Act. A homeowners’ association (HOA) is an organization of homeowners of a particular subdivision or planned unit development, its purpose to preserve, maintain and enhance the homes and property within the HOA. Generally, HOAs provide services, regulate activities, levy assessments, and impose fines. The rights and obligations of an HOA also are dictated by the HOA’s declaration, bylaws and policies (collectively “governing documents”). With the exception of rights and obligations as provided for in those documents, the HOA’s board of directors acts on behalf of the HOA. Here is a summary of key provisions of the HOA Act. 46

Recording or Filing of Homeowner Association Notice and Declaration. Each association organized after July 1, 2013, has 30 days to record a notice with its county clerk’s office. Associations organized prior to July 1 have until June 30, 2014, to record notice. Association Record Disclosure to Members. Associations must make available all financial and other records to a lot owner within 10 days of request. Associations may not charge a fee to review the records; however, they may charge reasonable fees for copies. Duties of Homeowner Associations. Associations shall exercise any powers granted to the association by the governing documents. Associations have a lien on a property with unpaid assessments or fines after the assessments or fines are due. Duties and Responsibilities of the Board Members. The board is to act on behalf of the association, adopt a budget annually, and provide a summary of the budget to the owners within 30 days.
Declarant Control. Except in masterplanned communities, the period of declarant control must terminate no later than the earlier of the following: • 60 days after 75 percent of the lots are owned by someone other than the declarant; • two years after the declarants have stopped offering lots for sale; • two years after the development right to add new lots was last exercised; and • the day the declarant gives written notice of surrendering their rights to the lot owners. Absentee and Proxy Voting. Associations shall provide for votes in person, by absentee ballot, proxy, or by some other form of delivery. Financial Audits. Associations consisting of over 100 lots must have an annual financial audit conducted by a CPA within 180 days of the end of the fiscal year. The audit must be made available to all owners within 30 days of completion. Disclosure Statements. Prior to closing, purchasers must receive a disclosure

packet. The packet must include the declaration of the association; the association’s bylaws; any covenants, conditions, and restrictions; the rules of the association; and the disclosure certificate from the association. Cancellation of Purchase. Purchasers have the ability to cancel a contract based on the association’s status. R.E. contracts and seller financing Are you thinking about entering into a seller financing situation? First thing, use a Realtor licensed by the New Mexico Real Estate Commission who is familiar with seller financing. There are forms produced by the Realtor’s Association of New Mexico (RANM). Hand-written contracts are the past. The Realtor can also supply a seller’s disclosure form that requires the seller to disclose in writing everything available to the property and any defects that exist. Do you know if you are purchasing in a legal subdivision? Does the seller have the right to sell the property? Are there any liens or lawsuits that possibly the seller did not disclose? A title company can tell you all of these things. For the closing, the title company can prepare a closing statement. It defines who pays for what
according to the Purchase Agreement. It prorates property taxes. The title company will provide the buyer with a title insurance policy. State law says that you must record with the county clerk any document that transfers property. You are putting everyone on notice that the buyer has purchased the property from the seller. The seller cannot sell this property again. It puts the county on notice who the new buyer is so it can assess the property and send tax notices to the buyer. The title company can issue a title insurance policy because it has a clear chain title. If real estate is conveyed using a real estate contract, New Mexico law requires deeds to be placed with an escrow agent. If the seller does not deliver a deed into escrow, the buyer does not have
to make any payments and can ask to rescind the contract and ask for all of the buyer’s money back. With the deed in escrow, there is a third party (the escrow company) that prevents the seller from improperly foreclosing or terminating the contract. The escrow company accounts for all of the buyer’s payments and delivers the deed to the buyer upon the completion of the contract. The buyer then records the deed with the county clerk notifying everyone that the real estate contract has been satisfied (paid off). As you will when making your choice for a real estate professional, be sure your choice of the escrow company is no less than the standards you require of your Realtor and title company: experience, integrity, license, and standing in the community.

Tips for choosing a company If you are the owner of an unfurnished investment home, how do you go about selecting the best property management company? Here are three tips for making an informed choice: 1. How many homes does the property manager have under management? Follow up with how many employees manage these properties. A trained employee with the right systems and support can manage up to 250 relationships effectively, assuming accounting and maintenance tasks are not part of their job duties. Most property management companies will charge between 8 percent and 12 percent of rental income for full service property management, and then charge leasing or renewal fees in order to facilitate a new tenant lease or existing tenant lease renewal. If a manager requires payment of monthly management fees even when the home is not rented, Buyer Beware. This should be a deal-breaker, since there is no incentive for the manager to rent the home quickly.
2. Make sure you understand how a property manager will take care of maintenance issues. There are many ways a property manager can resolve and pay for maintenance items that arise. A good property management company will have preferred relationships with trusted vendors holding the reputation of doing the job right the first time at a reasonable and competitive price. Expect the property manager will want to make maintenance decisions on your behalf, and understand that issues involving “health and safety” should be taken care of immediately without your approval. Most managers will hold a reserve amount in your trust account, likely between $200 and $500, in order to cover items arising between the time your monthly disbursement check is sent and collecting the following month’s rent. Also, a property manager may add a 10 percent mark-up or handling fee on top of maintenance invoices, which should be
negotiated to be waived prior to signing up with a manager. 3. Check the property manager’s licensing and review the management contract. New Mexico requires property managers to hold a broker’s license with the New Mexico Real Estate Commission in order to collect rental money as an agent and act in a homeowner’s best interest. Be wary of any unlicensed property managers as they will not be held to the standards of the Real Estate Commission. While a licensed property manager does not guarantee high ethical standards and acting in good faith, you can rest assured you have recourse with a state government body should the property manager not act in these ways. The contract with the property management company should clearly define the responsibilities of the homeowner and the responsibilities of the property owner. Verify that terms and fees are the same as discussed during your interview with the manager.

Pay close attention to any fees outside of the regular monthly management fee, as well as your responsibilities as a homeowner to comply with fair housing laws and quiet enjoyment privileges of a tenant. Quality varies with water sources If you are a customer of the City of Santa Fe Water Division, you should have received a copy of the 2012 Water Quality Report in the mail along with your July utility bill. The publication of this report, which is also known as a Consumer Confidence Report and is due by July 1 of the following year, is a U.S. Environmental Protection Agency requirement for public water systems. Water being delivered to utility customers is very closely monitored by Water Division staff and by the New Mexico Environment Department on behalf of the Environmental Protection Agency (EPA). The water is EPA-compliant with regard to both primary standards (legally enforceable) and secondary standards (non-enforceable guidelines for contaminants that may cause cosmetic or aesthetic effects). But two common constituents that may annoy customers, and cause damage within their households, are not regulated under either category and are therefore not treated. These are hardness (also known as lime scale and consisting
primarily of calcium and magnesium) and dissolved silica. The City of Santa Fe has four distinct sources of water supply: surface runoff from the Santa Fe Watershed into the Santa Fe River drainage (and stored in McClure and Nichols Reservoirs), the City Well Field (eight active wells), the Buckman Well Field (13 wells), and the Buckman Direct Diversion (BDD) project, which diverts native Rio Grande water and released water from the Bureau of Reclamation’s San Juan-Chama Project. (There are also the unofficial fifth and sixth sources of water: reclaimed wastewater and water saved by conservation.) In the past, when the Buckman wells made a much greater relative contribution to the water supply, we measured silica levels as high as 40-50 ppm (parts per million). Our experience is that the silica staining threshold is 15-20 ppm. Recent post-BDD tests run by clients confirm that the levels of both hardness and silica are lowest (with silica sometimes not detected) when the dominant percentage
of our water supply is surface water being diverted at BDD and highest when Buckman Well Field groundwater contributions dominate the supply. One of the objectives of the Buckman Diversion was to reduce pumping from the Buckman Well Field aquifers. But there are times when using this source is necessary, including periods of high turbidity (relative clarity) and low flow in the Rio Grande. During the summer peak irrigation system, it is likely that withdrawls from the well field will constitute a larger percentage of the total water supply, but it is anticipated that Buckman Well Field groundwater will constitute about 12 percent of the total supply in 2013, as in 2012. We should all be appreciative that the city does have a diverse water-supply portfolio and we should anticipate that water quality will vary as sources are switched. When the relative contribution of Buckman well water increases, such as during peak irrigation season, we should expect an increase in hardness and

silica. By Paul Weideman ia Realty Group, founded in Los Alamos one year ago, has expanded into Santa Fe. “It was just me and no listings and now we’re up to 25 agents and over 90 listings,” said broker/ owner James Chrobocinski. “We’re one of the fastest-growing real-estate companies in New Mexico.” He moved to New Mexico with his wife, Jacqueline, and two sons after 26 years in Corpus Christi, Texas, but he was coming home. “My mother and father met here at the College of Santa Fe, so I started my life here,” he said. “My mom, Jean Bramble, was in nursing school and my dad, Tom Chrobocinski, taught at Young Junior High School. It’s easy to assume that Chrobocinski timed the opening of Zia Realty Group with the easing of the recession impacts to the local market, but that is not the case. It had more to do with the death of Bramble (who was a Los Alamos High School graduate and worked as a nurse at Los Alamos Medical Center for many years) on Valentine’s Day 2012. “My mom was taking care of my grandfather, who is 93 years old now. We had wanted to get back to New Mexico for quite a while and after she passed we decided it was time to come and help with my grandfather. That was the only thing about the timing.” In Corpus Christi, James was a nurse, then moved into the business end of the field, working in health-care management for 15 years. He has owned several businesses over the years, including a restaurant, a purified-water business, car washes, a body shop, and a limousine company.

He opened the Los Alamos office of Zia Realty Group at 1460 Trinity Drive, soon afterward taking over the local firms REA and Los Alamos Properties. “Those Realtors, including their brokers, came to work for me. My goal when I started was to have offices throughout the state within seven years. Santa Fe is the next step after Los Alamos.” The Santa Fe office is at 433 Paseo de Peralta, in a handsome historic building that was once a dormitory for the AllisonJames School. “I’ve just been discussing with one of the top brokers in Santa Fe to bring him in as a market penetration person to get recruiting here and grow,” Chrobocinski said. “I think we’ll be very successful here. I’m real excited about the people I’ve met here.” Mandy Marksteiner, Zia Realty Group’s marketing director, gathered information about his four new brokers in Santa Fe. One is Sarah Cook, a retired attorney who has worked for the past 11 years has worked as a Realtor, most recently with Santa Fe Properties. “I like that Zia Realty is a small firm and there is more accountability,” she said. Pojoaque native Carrie Montoya-Pegg and her husband own the Los Alamos Fit-
ness Center; she previously worked there as well as at Los Alamos National Bank and Los Alamos National Laboratory. Charlie Khan has had his real estate license for four years. About Chrobocinski he said, “I like his track record and what he’s accomplished in Los Alamos in such a short amount of time.” Khan is among the top 10 professional squash players in the United States. Brock Salazar, who grew up in Española, has four years of experience in real estate. He also has worked as a mortgage broker and an insurance agent and is currently pursuing an MBA. Asked about the real-estate market on the hill, Chrobocinski said sales activity is stronger in Los Alamos, but added that White Rock has picked up. “I think the higher-dollar homes, from $450,000 up, are still slower than the $200,000 to $400,000 range.” One of the unique aspects about Los Alamos is that most of the landscape is owned by the U.S. Department of Energy. Because of that, there is little land available for development and the great majority of transactions are resales. However, Chrobocinski said there is a new development coming in White Rock.
The County of Los Alamos is now accepting requests for proposals for the 70-acre “A-19” site on the north side of N.M. 4. A master plan for the site was developed by Dekker/Perich/Sabatini, Albuquerque. “I’d like to see The New Mexican have more about Los Alamos real estate,” Chrobocinski said. “I delivered The New Mexican when I was in 5th grade up there; I was a paper boy. I really like the open house section you have on Sundays.” What sort of a niche does he see for his company in Santa Fe? “The reason I found success in Corpus Christi and in Los Alamos, I think, when I got into this business is that, unfortunately, there are individuals who give real estate a bad name. I really focus on treating our clients, our competition, and our vendors with kindness and respect and on creating more of a familystyle environment. “That has been very attractive to people and I think there is a need here for that style of business. Adding to the dangers is that as years of dirt and debris gather at wall bases, the grade around buildings gradually changes. Instead of water draining away, buildings are left in a crater, surrounded by a moat. Some of the more popular “high-tech” solutions we have developed for retarding the flow of moisture into wall bases rely upon a variety of synthetic materials known generically as “geo-drains.” When used correctly, these porous fabrics are used to trap water and carry it away. There is no limit to how these materials can be used; it only takes thinking like water to concoct them. For example, in the shallow, tight soils typical of canyon areas around Santa Fe, moisture is retained almost indefinitely, and a system must be designed to carry the water offsite. A 16” deep trench is dug along the base of the wall; geodrain material is laid facing away from the wall, with its edge inserted into a continuously slotted 4” PVC pipe. Trapped water drains into the pipe, which is sloped to drain to daylight or into a deep, gravel-filled drywell. Key to this system is positive site drainage, meaning that the trench is backfilled and compacted with clean, screened earth sloping away from the walls. This is just one example of the many different systems we have designed—each unique to the site’s particular conditions. In each case, common and inexpensive materials were manipulated to accommodate specific problems. n

Gold has passed; go for the silver It’s official Federal Reserve Board chairman Ben Bernanke announced last month that the Fed bond buy-back program ends mid-2014 AND the Fed will decrease bond buy-back activity this year through mid-2014 as the economy continues to strengthen. Continued increases in realestate sales and real-estate prices, as well as rapid growth in consumer confidence, led to this decision. The Fed projects continued modest growth in the months and year ahead and forecasts increasing employment. It was the Fed program of buying $85 billion a month in Treasury and mortgage-backed securities which caused rates to hit their 2013 lows through the spring, with 30year fixed rates in the 3’s. As a result of the announcement, interest rates on fixed-rate mortgages increased almost a full point last month and moved into the mid to high 4’s. Bond funds saw enormous liquidations given that the bottom of interest rates seemed to have passed.
For all of you who heeded the hints and warnings that this announcement was soon to come, congrats! You may have just won the gold medal by crossing the finish line by early June with 15- and 30-year fixed-rate mortgages in the 2’s and 3’s. If you are sitting on the sidelines waiting for a return to rates in the 3’s, this writer believes the gold medal has already been awarded and you need to go for the silver and grab rates in the still-record 4’s to 5’s while you can. Remember: In 2008 the 30-year fixed was 6.57 percent before the government bond-buy program and quantitative easing began. The difference on a monthly loan payment is… not that bad! For example, on a $300,000, 30-year, fixed-rate loan: • A 1/8-point difference in rate = approximately $25 a month difference in payment (principal and interest); and • A 1/2-point difference in rate = about $100 a month difference. And you bet it still is a great time to refinance. Here are two scenarios when
refinancing makes sense: 1. Reducing your interest expense. Moving from a 30-year, fixed-rate loan with APR’s in the high 4’s to a 15-year, fixed-rate loan in the high 3’s can save tens of thousands of dollars of interest over the life of the loan — and on your bottom line. 2. Debt consolidation. Paying off high credit-card debt, higher-rate land loans, and other higher-rate debt instruments by refinancing can work by refinancing your current first mortgage to a lower rate or obtaining a second mortgage (a home equity line of credit, or HELOC) to 85 percent or 90 percent of the home value and using the funds to pay off debts and to lower interest payments. If you have investment accounts, beware. As bonds sell off and values fall, be sure to contact your financial advisor for updates on your portfolio holdings. Statistics continue to flow in strongly suggesting that Santa Fe real estate is in recovery mode. Grab the opportunity while we

Market improving slowly but steadily There have been a lot of crazy stories in the news about double-digit appreciation and bidding wars in markets around the country, but sellers in Santa Fe are not finding the market quite as robust. The Santa Fe Association of Realtors just released its second-quarter reports and it looks, overall, as if the real-estate recovery is ongoing but it’s going to be a bit bumpy. The current market is a study in opposites. While the average sales price for the second quarter is up over this same time last year, $401,000 from $376,000, the overall average sales price year to date is down. This time last year we had an average sales price of $385,000 while it is presently at $379,000. A similar phenomenon is occurring with our inventory levels. The month’s supply of homes fell from this quarter last year by almost 25 percent. However, Santa Fe has experienced an 18 percent increase in new listings in that same time frame. Bolstered by the activity from the last quarter of 2012 and the first quarter of 2013, we saw inventory levels increase in 56

the spring from optimistic sellers. However our pending activity fell from March to June. The 2013 pending sales to date is 14 percent less that 2012. So despite the great activity and the huge decline in inventory that we experienced only a few months ago, we are back to a buyer’s market with over 11 months of supply. There are some exceptions, with pockets of robust activity, and in some instances multiple-offer situations. We see the most activity at $300,000 and below. Buyers in that price point are the most serious and the feeling is that the best inventory is quickly being bought up, urging buyers to make quick decisions and not dicker too much about prices. If a property in that market segment is in good condition and priced well, it will sell in a matter of weeks. The northwest city limits had an 18 percent increase in price to $385,000 but a decline in closed sales of 13 percent. The southwest city limits experienced only a marginal price increase to $215,000 from $209,000 but sales dipped 1 percent. The
northeast and southeast city areas both saw gains. The northeast had a 20 percent increase in closed sales and a 7 percent increase in median sales price to $687,500 while the southeast had a 35 percent increase in sales and movement in price to a median of $570,750. Eldorado showed big gains in median sales price, now up to $348,000 and a 33 percent increase in closed sales. The Highway 285 corridor along with Old Las Vegas Highway had an increase in median sales price to $390,000 with a big increase in closed sales over last year, from 59 to 76. But the northwest county had a 36 percent decline, from 49 homes sold last year to 31 for the same quarter. Southwest county also had a 25 percent decline in sales but a small increase in the median sales price to $300,000. Be clear, just because the median price rose in certain areas, it does not suggest that overall values went up by that percentage. Purchases of homes in the higher price points has helped move the median upwards as have the decline in bank

owned properties and short sales, which were roughly 35 percent of the market this time last year. Overall, our market is steadily improving and that is the best news yet. Homewise busy in Tierra Contenta By Paul Weideman
T
he Old Las Vegas Place project is complete — 50 houses built and sold during the recession-fueled construction slowdown — and its developer is busy on three other fronts. The Santa Fe nonprofit Homewise, Inc., has another hot success with the northside project called Piñon Ridge. “As of July 15, after just over a year, we have 100 percent of our 39 homes at Piñon Ridge under contract,” said Rob Gibbs, the organization’s real estate development manager. The homes there are priced from $265,000 to $350,000. The newest project for Homewise is Las Palomas, which has a grand opening this month in the southside Tierra Contenta subdivision. “This will be 46 homes,” Gibbs said. “We have four floor plans, both 2- and 3-bedroom models, with some pitched-roof elements that include some vaulted living-room ceilings.” Prices at Las Palomas run between $212,000 and $224,000, with square footage ranging from 1,300 to 1,700. The third project, also in Tierra Contenta, is ongoing. Rincon del Sol is a 38-home development and 22 had been sold as of mid-July. “We should be built out there in another year,” Gibbs said. “Las Palomas will be built out in 18 months.” Built out and sold. “That’s right. Most everything we do is pre-sold. “One thing that’s unique about Homewise is that we have this steady pipeline of people who are working with our home advisors and that’s generating about 21 ‘buyer-ready’ families per month who then meet with our sales team to find what they want and what they can afford.” Some Homewise clients choose a pre-existing home. “The reason why we started building houses ourselves is that there was not enough inventory,” said Sonja Kalyani, Homewise marketing associate. The advantages of a new Homewise house are simply freshness and significant green qualities. For a few years now, every one of its new homes has been built to the BuildGreen New Mexico “Gold” standard. A wall chart at the nonprofit’s Siler Road office shows that a new Homewise-built house can save the owner more than $4,000 a year compared to what Gibbs calls a typical “used” house. This is achieved both through lower monthly payments with the Homewise financing and through savings on utilities bills and maintenance costs. “One couple previously lived in a mobile home and she was really excited about the energy efficiency after they bought a new house in Rincon del Sol,” Kalyani said. “I asked her what the best thing was and I thought she would say having the space or having a yard, but she said it was the energy savings, for both water and heat.” Homewise is a member organization of Washington, D.C.-based NeighborWorks America, which creates opportunities for people to live in affordable homes, improve their lives and strengthen their communities, according to the mission statement. In line with its annual NeighborWorks Week in early June, Homewise held a “Happy Trails” event in Tierra

Contenta. “We had an event at the Zona Del Sol community center and we invited all of Tierra Contenta as well as Homewise customers for a walk on their nice trail system, then we had dinner and just got to know each other,” Kalyani said. “There are more than 7,000 residents in Tierra Contenta, including about 60 percent of Santa Fe’s young people. A lot of Tierra Contenta homeowners went through the Homewise program, where they meet with our home-purchase advisors and take our classes and use our brokers, and take advantage of our lending.” Homewise offers free financial fitness classes every other month. These are useful for people who are thinking about
buying a house, but also for anyone interested in improving her or his budgeting. The next one is Saturday, Aug. 10, from 9 a.m. to 4 p.m. Call 983-9473. Kalyani said another example of the Homewise emphasis on the local community is its Artisan Project. It recruits local artists to produce hardware, lighting, and other fixtures for Homewise homes. The three model homes at Las Palomas also will feature local artists’ work as part of its decor, she said. “Our Las Palomas grand opening is 5-7 p.m. on Wednesday, Aug. 21, and we’ll have another event for customers and neighbors to tour the three model homes and have dinner.” H OME

Shooting for resorts, hospitality This month I’d like to discuss the photography of resorts and the hospitality industry. As with the real estate and building sectors, the focus on shooting resorts and related businesses of the hospitality industry has its own needs and requirements in assisting these businesses in gaining notice, and attracting potential clients. Its called the hospitality business for a reason, and the obvious key here with imagery is accentuating that, so potential clients see themselves at the resort or hotel or motel, in a comfortable way, that they feel “at home,” or better than at home. You’d think that would be fairly obvious to anyone in the industry, and certainly it is evident in many hospitality marketing campaigns around the world that do a beautiful job in communicating and branding their products, but it’s not apparent when looking at the campaigns of
some. Although I’m a part of the industry and shoot resorts internationally on a regular basis, there are times I’m just simply another traveler looking for a nice place to go, whether on vacation or for business. I often go online and read travel publications, both as that vacationer, as well as professionally, keeping up with the business and seeing what others are doing. I’m often very impressed with what I see, but occasionally surprised at how unappealing some marketing can be. I wonder how much potential business that resort may have lost due to not putting in the proper effort to convey their assets and hospitality in their imagery. The photographing of a resort encompasses many aspects of the photography business into one big shoot. A resort photographer needs to be adept, a specialist, in many areas, including architecture and interiors, interior design and décor, food
and drink, lifestyle and fashion, fitness and spa, and travel reportage. He or she needs to convey, in an extremely hospitable way, the many interests and needs a traveler has when booking a trip. The photography is a big part of the client’s decision to book your resort or hotel, or your competition’s. We are “visual animals.” Our sense of sight is our most prominent sense, and photos that convey elegance, comfort, professionalism, cleanliness, taste in design, organization, and security — that is, HOSPITALITY — are very often the difference between a hospitality business having a high occupancy rate or not. Further put, a business in the hospitality industry needs to be hospitable to themselves, and one of the integral ways to execute that is through good marketing and photography.

A lush August in the high desert Welcome, August! While this month may not boast the grandiose fanfare of July or offer Americans a three-day weekend like September, there is something August is known for that you may not be aware of: National Water Quality Month. This holiday was established with the help of the U.S. Environmental Protection Agency to remind people of the importance of protecting our water supplies. August is typically the month with the most water concerns and its scarcity is seen globally on a monumental scale. Being in the Southwest, we know all too well the effects of living with less water each season, but thankfully July came through and provided Santa Fe enough showers to keep things blooming until the end of the summer. In honor of National Water Quality Month, I am foregoing my usual column where I highlight a particular flower or garden and dedicating this space to the beauty of moisture or, better said, the beautiful effects of moisture. I am encouraging my readers to get out and play, discover, admire and become inspired by 58

the lushness that has managed to cover our town’s once lethargic flower beds. There is plenty of flower spying to do now that the desert dust is damp. A visit to Santa Fe’s new, beautiful Botanical Gardens just one month ago revealed early plants that seemed doubtful they would bloom much this season. But after attending the opening gala the end of July, the

change was surreal. Geraniums, sages and salvias almost doubled in size, the colorful penstemons were thick and bushy, and
woolly thyme had all but filled in the sidewalk cracks — pretty impressive for just one month’s worth of moisture. Drought-tolerant, xeric and native plants are also doing happy dances all over town, with blossoms at the Railyard Park, Audubon wildlife garden, and Cornell Rose Gardens nothing less than bodacious. Even the State Capitol seems to be covered in a lushness not seen earlier in the season. There’s a jungle like quality as you walk around the buildings, making you wish you had that kind of view from your office window. Hollyhocks sneaking out of unexpected places were a common feature in July, only to be replaced by prolific Russian sages that are literally pouring onto sidewalks and streets now. The adopted median strip on Paseo de Peralta is an excellent example of how consistent amounts of moisture can transform a community garden into an abundant wildflower field. So thank you, Mother Nature, for painting Santa Fe once again in the perfect shade of green. Happy National Water Quality month! Keep in mind that

conservation is key. A little bit of moisture can go a long way. And remember to keep a pair of clippers in your car. Gardens are made for admiring and cutting. esigned by Jake Rodriguez and built by Sharon Woods, this house is accessed by a porphyry-paved drive and turnaround with stacked-stone borders. The gorgeous plantings, designed and installed by Chamisa Landscaping Inc., include blue spruce here and, through a gate into the front courtyard, aspen trees and mugo pines. The 9,939-square-foot residence, with walls of energy-efficient Rastra block, was completed in the summer of 2009. The property of nearly 6 acres is located on Buckskin Circle in the Ranch Estates community of Las Campanas. Horses may be kept at the Equestrian Center that is almost adjacent to the homesite. With Territorial Revival-style features including brick coping on the parapets and garden walls, and an entry hall running the house’s full length, a grand sense of symmetry prevails. Forge. A wonderfully comfortable window seat at one end of the long library is a magnet. The gallery of built-in bookshelves boasts squared, fluted columns and dentil cornices. This and the woodwork in several other rooms is by David Samora. His craft shows in the deeply coffered ceiling in one of the two offices, which also has a wood floor set in a handsome, squared pattern. In the other study are mesquite floors, bullet-carved ceiling beams, and wooden shutter blinds. The spacious kitchen is outfitted with granite countertops except on the 10-foot, bluepainted island, which has a butcherblock top. The appliance package is in multiples: double Viking ranges/ovens (also blue and nestled in a nook of rustic brick, from which sprouts a handy pot-filler faucet); double Bosch dishwashers; and three Sub-Zero refrigerators, one of them in a large pantry with soapstone countertops. Among other standout features are a formal dining room that may be closed off to traffic by means of pocket doors; Robern medicine cabinets and crema marfil marble countertops in the master bathroom; wall panels offering easy control of lights, security, and outdoor water features; and hand-forged exterior lighting fixtures. Parade of Homes set for Aug. 9-18 Story and photos by Paul Weideman Fourteen houses are highlighted on this year’s self-guided Haciendas — A Parade of Homes. The fact that there are two spec homes on the tour indicates an uptick in optimism about the market. One, in Las Campanas, is by Tierra Concepts, a high-end builder that has two homes in the Parade. The other, by John Di Janni, is on Valle Chamiso, closer to downtown. There are two whole-home remodels this year. One is by Shane Woods of Woods Design Builders and the other is by D Maahs Construction. However, the latter is in The Compound on Canyon Road and it turns out The Compound won’t allow Parade of Homes visitors. The house will be part of the Parade of Homes competition aspect, but it will not be on the tour, according to Kim Shanahan, director of the Santa Fe Area Home Builders Association, sponsor of the annual event. Fourteen is a record low for the Parade, which typically boasted 30 to 40 houses in the decade before 2009. “Last year we really felt like there were a lot of people coming into town who were finally getting off the fence and saying, We’re going to move forward,” Shanahan said. “And they did, but the thing is they made their decisions and hooked up with their architects early this year, at the beginning of the building season, and they’re simply not ready for the 2013 Parade. A lot of these homes are really two-year projects. Now we have a hunch that 2014 is going to be the year where the Parade really takes a jump in the right direction, based on the fact that in 2012 the market finally did change. “I also think it’s time now for the banks to start recognizing that specs are viable, because we have visitors on the Parade who can literally write a check right now for a completed home. It will be interesting to see if the homes on the tour that have prices sell. If they do sell during the Parade or soon after that, it could very well tell our banking community that it’s time to get back in this game.” Also notable is that the 2007 Parade of Homes featured 31 houses, 17 of them carrying prices of over $1 million. This year there are none priced that high — the range is $234,900 for a Homewise model to $889,000 for the spec home by Tierra Concepts — although a few that are already sold or that were built as homes by the builders, would be over a million dollars if they were on the market. The Parade is open from 11 a.m. to 6 p.m. on Fridays, Saturdays, and Sundays, Aug. 9-11 and 16-18, plus several of the homes are open for a twilight tour from 4 to 9 p.m. on Friday, Aug. 16. Appraisal procedures are broken Licensed appraisers are required to be educated and competent in the real-estate market that they service. They have a code of ethics and are accountable to their clients to perform their services professionally. This was the old tried and true way of doing business. But, as usual, what is not broken, the government immediately tries to fix and for the past several years everyone involved in home purchases have faced the current appraisal nightmare. Bureaucracy has become the name of the game in the appraisal world. Realtors, mortgage companies and banks do not order appraisals directly from the licensed appraiser, nor can they discuss the property with the appraiser. Appraisals are ordered by entities known as appraisal management companies (AMCs). Appraisers are now accountable to appraisal-management companies, not their clients. Look at how many bureaucracies are involved in setting up this redundant system. There is the Federal Reserve, Fannie Mae, Freddie Mac, AIR legislation that replaced the Dodd Frank legislation, AMCs and the State of New Mexico. How incredible. The AMC receives the appraisal order from the underwriting department. Then the problems arise. The appraiser may be from a city outside Santa Fe and not familiar with the local market. Some appraisers are not competent but have been able to secure business with the AMC involved. The appraiser is only accountable to the AMC and not the Realtor or the mortgage company. The work can be slow and poor in quality. Values can be significantly inaccurate. The New Mexico Board of Real Estate Appraisers is responsible for overseeing their licensing and regulations. Ron Blessey with Home Buyers Mortgage, a director with the New Mexico Association of Mort-

gage Professionals, is working to amend the rules for appraisals at the state and national levels. Ron says,” Changes must be made. Consumers and loan professionals need to object to this appraisal process directly with state and federal officials.” The worst-case scenario in this current process consists of the hiring of an appraiser from a far-off city. The AMC gets paid a portion of the fee normally sent to the appraiser, who does the work quickly. Being responsible to none of the parties in the transaction, the appraiser is not too concerned about the quality of work and sometimes produces an inaccurate report. This procedure has become a weak link in the real-estate financing process. It frustrates mortgage companies. Realtors and clients hold their breath until the appraisal is completed, fearing some inaccurate value that will harm the purchase transaction. I recommend that home buyers, sellers, and Realtors complain whenever the opportunity arises. I believe it will change but slowly. In the meantime, my message to all concerned in the purchase of a home is to understand that obtaining an appraisal is a winding process. In the habit of ‘LinkingIn’ Ten years ago, LinkedIn was born in an entrepreneur’s living room. Today, it is the social network for professionals and entrepreneurs to expand connections and build new business. According to a recent portrait of the 2013 LinkedIn user, 84.5 percent use the free user account and 35 percent of the over 250 million users are in 1-9 groups. In addition, over 50 percent say these features are most helpful: groups, who viewed your profile, and people you may know. If you originally created your profile and have done nothing else since then, it’s time to get in the habit of LinkingIn. Why? Your connections most likely see you as someone with a resumé-type profile rather than a person worthy of connecting with for business. If you are tired of seeing vacation pictures posted to your other social networks, the new LinkedIn features give you more direct opportunities to build your network business community and reach your long-term career goals. Like face-to-face non-digital
networking, the bottom line is about transforming those LinkedIn connections into real business relationships, referral sources, and professional resources. Yet today many customers and colleagues often check your LinkedIn profiles before doing business with you or hiring you. This is the major reason why you need to keep your profile up-to-date. Here are some tips on staying current. Post a recent professional image and not a vacation photo. Complete your profile in details with information about your education and professional background. Avoid saying what you did and instead tell your audience why you did it. LinkedIn gives you the tools to transform your career. The math is simple. A more complete profile equals more views and future connections. Next, collect recommendations graciously from customers and clients without sending them email blasts. The way forward Santa Fe is in the midst of one of the worst droughts in recorded history and city officials have announced that they’re considering new water-conservation measures. The above-normal precipitation we experienced in recent decades does not seem likely to return anytime soon. So where do we go from here? Santa Fe water officials and folks living here have already done a splendid job reducing the gallons used per capita per day (GPCD). This number when we first started recording it back in 1998 was 168 and it is now around 109, a stunning decrease of over 35 percent. Historically, Santa Fe has maintained a low GPCD that other cities have struggled to achieve — for example, Las Vegas, 222 GPCD; Phoenix, 185; and Tucson, 177. Our historically low GPCD is most likely due to a historical culture of water conservation. We also don’t have much agriculture or industry within the city limits that require a lot of water. Santa Fe has used many methods to 66

achieve our enviable results, including education, rebates, regulations, and pricing. Of these, regulations have played an especially important role. Data shows that regulations are one of the primary reasons we are where we are without experiencing noticeable lifestyle impacts. These conservation ordinances touch almost every aspect of life in Santa Fe, though not many people have an awareness of them. They include residential and commercial building codes (for example requiring EPA Water Sense-approved appliances and other products), landscaping ordinances (including limiting the type and amount of cool-season grasses), business regulations (restaurants cannot serve drinking water unless requested and hotels must limit sheet-washing to four times a week), and development codes (requiring large developments to obtain water rights). Our city officials have also used rebates and pricing to incentivize water conservation. Rebates have been in use in Santa Fe
since 2004. Thousands of rain barrels have been installed and hundreds of washing machines and toilets have been swapped out, resulting in the savings of millions of gallons of water. Lastly, education and outreach programs have been staples of our waterconservation efforts. These wonderful long-term programs, such as the Children’s Water Fiesta and Children’s Water Conservation Poster Contest build ongoing awareness about water conservation. While we are fortunate to live in a city that is uniquely beautiful, we are highly dependent upon a secure source of water. Without long-term water security our tourism would suffer, our local economy would be dramatically impacted, and of course the value of our homes would decline. We should all care about this precious commodity that for the most part we all take for granted. To maintain our lifestyle we need to continue to move forward on all water conservation fronts. We have already

implemented many of the easy solutions. To become even better conservers of water we must plan, think creatively, and engage the whole community. Hoods are integral to the design given their structure, and all of the options for housing them — wood, plaster, or metal-clad. Other appliance decisions from the design perspective are proportion relative to room size, and available
options for panel fronts, handles, controls and finishes to maintain continuity. For sink and faucet fixtures, we consider use needs, finish durability, and style in relation to the overall design concept. In conjunction with appliances and fixtures, cabinetry enters the conversation as the framework that holds all the pieces together. At this stage in the project (if not before) it is good to turn to a knowledgeable kitchen designer who can offer an array of cabinet options and suggest layouts that both accommodate needs and take advantage of every inch. A quality cabinet is important to prioritize as you will most likely have it for a long time. Design considerations such as glass doors and the myriad of finishes (stains, glazes, distressing) must be coordinated with the countertop, tile and flooring selections to create a perfect balance of texture, contrast and color. Functional and decorative lighting must provide quality illumination for all tasks and food presentation. Some combination of recessed, surface-mounted, track, and undercabinet is optimal. LED and fluorescent recessed fixtures are ideal for their energy savings, but it is important to include bulbs in a warm but neutral range of 2700-3500 degrees Kelvin. Decorative lighting can provide a splash of color and make an individualized statement. Countertop options range from granite and quartz to copper, zinc and stainless steel, all having advantages and disadvantages depending on intended use. An island might beg a more unique pattern or color while the perimeter counters

step back with a subtler pattern or color. Backsplash choices can be fun with layering tile sizes, shapes, materials, finishes and patterns; they are an opportunity to create art on the kitchen walls with color and texture. Cabinet hardware adds the “jewelry” and should be selected thoughtfully to reflect the overall design concept, blending or adding bling. The decisions can seem overwhelming, and often more than one choice per element can be applied.
