T

his house in the Los Cerros Colorados subdivision is a unique gem, the vision of owner Frank Sconzo. It’s the third house he has built, following one in Hawaii and his last abode in Seattle. This one boasts warm and extravagant touches such as the sculptured, rounded fireplace surrounds and kitchen countertops; a pair of big, circular windows over the spa tub in the master bathroom; and custom, carved doors throughout. The 3-bedroom house, built by Bruce Thompson for Frank and Susan Sconzo, was completed in 2002. It’s 3,153 square feet, but none of the rooms are of the vast, cold type; rather, they are on the cozy side and designed to showcase art and artifacts. The various spaces are brightened by 11 skylights. Inside the front door, four steps lead down to the level of the living room, media room, kitchen, and dining room. A handrail at the steps is anchored in a big boulder harvested from the site. Floors in the public spaces are either concrete, in acid-wash black and brown, or hardwood. The bedrooms are carpeted.

The architecturally rich kitchen has an arc of maplewood cabinets with black-granite tops, plus an elegant, wood island. Above, a circular ceiling sports a lamp and beams in a wheel-and-spokes pattern. The master bedroom has one of the home’s five fireplaces and a vaulted, beamed ceiling. Doors lead out to the patio with covered portal and, beyond, a xeric but lush landscape. The 1-acre homesite adjoins city-owned open space and trails in the Dale Ball system. There is a 3-car garage; one third of it has been converted for use as an art studio/workshop. Slowly climbing back to prosperity By Paul Weideman

T

he hikes and falls and spasms that describe various moments in the real-estate industry during the last five years make market analyses and predictions in “the old days” seem like child’s play. It’s no wonder that experienced professionals like Cate Adams (in the Santa Fe office of Sotheby’s International Realty) find themselves relying on one simple statement when asked why Santa Fe is taking so long to recover from the crash: “I don’t know.” The fourth-quarter report from the Santa Fe Association of Realtors says both sales volume and home prices “were broadly higher across the nation, while foreclosure loads, the number of homes for sale and the number of days it took to sell a home were all much lower. Multiple-offer situations became commonplace again and prices in many areas rallied to multi-year highs.” Rising home prices based on stronger demand would signal recovery in this market, but that’s not yet happening in Santa Fe. “I see an improvement in the attitude of buyers and their confidence in the market, but there’s really very little improvement in pricing,” Adams said. “Prices are staying flat.” A year or two ago, many brokers said their clients were waiting for the market to hit the bottom, not wanting to buy if prices were going to sink more. That refrain is much less common today. “That’s right. Nobody’s talking about it anymore; everybody’s talking about the improvement in numbers,” Adams said. “Sales are up, prices are not. Everybody’s saying that across the board. Why is Santa Fe so slow to recover? I don’t know. We were obviously very much affected by the real-estate bubble, if there was such a thing.” As home sales began to fall off in many U.S. markets — after the subprime mortgage crisis and the September 2008 collapse of Lehman Brothers, AIG, and other investment firms — some began to worry that Santa Fe’s “bubble” was about to burst as most obviously happened in Phoenix, Las Vegas and other muncipalities that had seen dramatic housing-industry spikes. “Our market is not nearly as large as Phoenix and Las Vegas,” Adams responded. “We have a much smaller buyer pool, and we have a very specific appeal, which is why 18

we all live here. And I’m not sure we would want to get back to 2005/2006. The market was artifically inflated by the bad-mortgage issues. There was a bit of a frenzy, too, as prices continued to spiral upward: a frenzy to get into the market, which unfortunately too many people are paying for now. “I think the issue of why prices aren’t increasing commensurate with sales is that we have to look at price points, not the market as a whole. Looking at the overall median prices and average prices in Santa Fe doesn’t really tell you that much.” Another window into Santa Fe’s realestate scene is the construction business. Builders have not responded to the idea of a healthier market; this is evident in the low numbers of building permits issued recently by the city of Santa Fe and Santa Fe County. Adams said it is an unfortunate reality that home prices have dropped and the cost of building materials has gone up. “That is a significant factor in new construction. Also, the banks are much more careful” than they were before about financing homebuilding and homebuying. Her husband, owner of Ron Adams Construction, has compensated — as have most other builders — by focusing more on remodeling jobs. “There’s a wonderful market for remodeling in Santa Fe,” she said. Cate Adams is optimistic about 2014. “Actually 2013 was a great year for me — not what I would have called great in 2007, but I was busy the entire time and successful in getting things closed, which had been an issue.” That’s a positive sign, that buyers are deciding to complete the process, and that banks are permitting it. “It’s a complicated issue,” Adams said about Santa Fe’s recovery. “We can look at the statistics and talk about what we believe is going on, but that’s about it.” It’s always fun to look at stats and try to figure everything out. Here are a few highlights from Santa Fe County Real Estate 2000-2013, a report released recently by Barker Realty: • Real estate sales have increased the last four consecutive years; • 2013 was the first year since 2009 that realized price stabilization, or slight increases, in every segment; and • The number of luxury sales ($1 million

and up) in 2013 was over 100, the first time that number has been surpassed since 2008. According to Barker figures, residential sales decreased by 47 percent from the 2005 high of 2,290 sales to just 1,213 in 2009, the year after the onset of the recession; home sales had climbed back up to 1,767 last year. The shift in sales of land parcels was even more dramatic: an 80 percent drop (658 to 133) from 2005 to 2009, and the activity level increased only to 195 sales in 2013. In his blog, Realtor Alan Ball (Keller Williams Realty) recently wrote that 2013 “came out a bit better than 2012, but only in small increments. The fact that we had positive numbers is not to be missed, but they were not big numbers and the improvements were in single digits.

“‘Increase in annual unit sales for Santa Fe residential real estate,’ said the headline. How much of an increase? For unit sales, it was 7 percent,” Ball wrote. “This is considered a good number for most. Some might wish to see a double-digit increase, as has taken place in other markets. But Santa Fe is just a tortoise compared to the hare of Phoenix or Denver. Our increases are steady and historically have built a solid foundation for future growth rather than race up and down the course setting higher and lower records every few years. “A growth in home sales is a sign that some sellers were finally able to get beyond the burden of owning a home that they formerly could not sell. And since very few new homes are being built, the inventory

that did sell had a very high percentage of existing homes.” What to expect for 2014? “The real estate experts all agree that interest rates will climb, which will certainly keep a lid on our ongoing market recovery,” Ball continued. “The pressure for newly built housing will increase as the “quality” homes in the existing inventory continue to sell. The best ones sell first, you know. And land sales and spec building will still be virtually dormant as mortgage lenders are still hanging back and builders still are nursing wounds from recent market conditions.” David Dougherty, Dougherty Real Estate, is principally involved in the commercial real-estate realm. That’s been all about “musical chairs” lately, he said, “people moving around Santa Fe because of better prices and better locations, but I wouldn’t say the market is healthy because there’s no new demand. Part of the problem is that there is

a lot of really aged product out there that is becoming obsolescent. In the historic district it’s going to take enormous amounts of money to either remodel it or refurbish it, or it just has to be torn down. It can be two or three times more expensive to refurbish than to tear down and rebuild.” Also in the Dougherty firm are brokers Clara Dougherty, Jennifer Tomes, and Warren Thompson, who concentrate on the residential segment of the market. About that, David said he has a theory: “We are dependent on other markets and always have been. It takes the other markets improving over a period of time and a development of comfort there before people can sell their homes in Chicago or LA and find that Santa Fe is a real bargain. That’s how we started in the 1990s, particularly the California buyers who were selling their houses for terrific amounts of money and seeing Santa Fe as a wonderful bargain. I’m

slightly optimistic that as those markets improve we will see improvement here.” At present, inventory is just under 2,000 homes on the market in the Santa Fe area (down from about 3,300 before the crash). “From what I’m hearing from our agents, it seems to me that the very good stuff has been bought up and now we’re getting to where finding quality product — well-designed, well-built homes — is a little more difficult.” Santa Fe’s draw — hinging on the climate, the unique architecture, the intermingling of three cultures, the art market, the Santa Fe Opera, and other factors — is a powerful constant. There are few negatives, but one of them that has become more significant in recent drought times is the impact of forest fires: definitely bad publicity for people thinking about buying in Santa Fe. “Yeah, if we have another bad fire season, all bets are off,” Dougherty said. “The reason a lot

of people come here is the beautiful blue skies and clean air, and fires just eliminate all that.” Asked for his outlook for 2014, he said he is not optimistic about the commercial real-estate market. “In the residential, I’m cautiously optimistic that those buyers in other markets will perceive our value and become more serious buyers.” The lookie-loo phenomenon — people going out to look at houses with no real intention of buying, basically making a hobby out of it — appears to be subsiding. “I do think the lookers got a little spoiled in 2009, 2010 and 2011 in that they would go out to look at houses thinking the market was still going down so they weren’t that serious. I do think we’ve reached the bottom, but some potential buyers aren’t convinced. They’re still thinking, ‘It’s overpriced. I’ll wait a while for it to come down.’ But I think those days are gone. Darlings, Before you do anything else, I want you to get your calendar out and circle the upcoming date, Monday, March 3. Then start thinking about what you’re going to wear to the Masquerade Charity Ball at The Club at Las Campanas 6-10 p.m. that evening. Kiddos, when I first heard about this event, I immediately knew what I’d wear. But then I realized that if I didn’t lose my proverbial 10 pounds, I’d be choking myself to death in my Spanx (egads), so I had to rethink my outfit. That led me to a better idea: wear something unstructured (a stylish fashion term for shapeless) that flows on the dance floor, and concentrate on the mask itself. Which then led me to the next step, finding the perfect mask. Wow. I spent hours online (Vivo Masks, Chicago Costumes, Oriental Trading Co., Party City, Pier One Imports, Amazon, etc.) looking at the most dizzying array of fabulous masques — feathered, glittered, bronzed, gilded, Venetian carnival masks, Mardi Gras masks — in all prices ranging from $7.99 to $79.99. Well, wouldn’t you know, kittens, I had to buy several, because they were simply too beautiful. But I justified it by saying that a mask is easier

to change several times during an evening than an entire outfit. Now, pumpkins, I can hardly wait for the ball. Oh, yes, the Masquerade Charity Ball. It’s hosted by the Santa Fe Association of Realtors, and it’s the brainchild of SFAR’s Community Services Committee, which is chaired by the most energetic and upbeat woman I’ve met in a long time, Donna Delgado (escrow officer, Rio Grande Title). She, in turn, appointed the second most energetic human being, her committee member, Yancy Whittaker (Coldwell Banker Trails West), to spearhead the gala. Tickets are $100 per person or $175 per couple (just like with Noah’s Ark, love bugs, couples get preferential treatment), with 100 percent of that money going directly to Dollars 4 Schools, a tax-deductible Santa Fe Community Foundation charity. Dollars 4 Schools is a favorite recipient of the Community Services Committee’s fundraising events, because the real estate community believes so strongly in the education of young people as our guarantee to a successful future. If you remember, gumdrops (and if you don’t, I’m here to remind you), Dollars 4 Schools was started a few years ago by longtime Realtor Pat French. So, butter beans, how do I love this event? Let me count the ways. 1) March 3 is the day before Fat Tuesday, so this counts as our Mardi Gras party. 2) It’s an event for the whole town, so we can get down and party with Realtors while getting the inside scoop on the state of the market. 3) Lots of dancing, kind of like Michelle Obama’s 50th, but with more food and an auction with great stuff thrown in. 4) $1,000 prize for the best costume (uhoh, I may have to rethink “unstructured”). 5) After enjoying a fun-filled evening, you can feel good knowing that (I repeat) 100 percent of all proceeds from ticket sales will be going directly to Dollars 4 Schools. Okay, okay, okay, dear hearts, what else is new? One sign of our improving real estate market is the increase in the number of new Realtors, as well as the return of old ones. Don’t get me wrong, cupcakes, Lisa Bybee,

(formerly Santa Fe Properties) isn’t old in the chronological sense, but she did take a break during this last downturn, and now she’s back with a newly formed company of her own, the Meridian Property Management Group. During her break, Lisa taught English at St. Michael’s High School for 2 1/2 years. Back in the ’90s, she spent time in Germany and the Czech Republic teaching English as a second language. Much as she likes English, she’s glad to be speaking the language of real estate again, and we’re glad she’s back. Kudos to my good friend Candy Brenton (marketing director, Santa Fe Properties). Yes, buttercups, with 278 entrants from 28 states and four countries, and with 1,670 photos submitted, our Candy came in third. Just in case you were unaware of this little known fact, New Mexico Mag was launched in 1923 and is the first state magazine founded anywhere in the nation, preceding Arizona Highways. (My god, creampuffs, finally, we’re first in something!) Candy has been a photography buff since she was a teenager (I know, I know, she’s barely beyond that now). It all started in Homer, Alaska, where she captured frozen landscapes with her first camera, a Pentax ME Super. Her winning picture for NM Magazine, Moon Over Loretto Chapel, was taken with Candy’s newest and (she thinks) dreamiest camera ever: a Canon 5D Mark III. I’m very impressed with this, shutterbugs, because I’m still using my Samsung 5X Zoom (I haven’t even graduated to my iPhone yet). So long, sweetpeas. A helical pier is comprised of a solid steel shaft with one or more helices attached. A helix is one pitch of screw; imagine a wood screw that instead of having a continuous thread, has only one full turn. The advantage of having individual helices is that, unlike an auger, the soil is not displaced. We screw the piers into the earth beneath a house using hydraulic equipment that can fit in very small spaces. Once in place, a bracket slides over the pier shaft and bolts to the footing. We can then use hydraulic jacks to transfer the load from the bad soils to the shaft of the pier. A pier every 8 feet or so along a concrete footing will support even the heaviest wall. Because piers are installed below grade, the appearance of your home is not altered.

UnderstandingAdobe

Let it move “Those who survived the San Francisco earthquake said, ‘Thank God, I’m still alive.’ But, of course, those who died, their lives will never be the same again.” — Senator Barbara Boxer, D-Calif. Senator Boxer is indisputably right. Well, correct. Earthquakes change things. They have also led to more research, engineering fees, and escalated insurance premiums than any other building challenge on the planet. Discussing earthquakes right now is as timely as it has ever been. There has always just been one, somewhere. I have long been intrigued by the performance of adobe buildings in earthquakes. Contrary to accepted dogma, a well-designed and well-built earthen building will behave really well in a tremor, even a big one. This is because, being the oldest building material on earth, people have had a lot of time to perform due diligence as to its limitations through trial and error. There are many, many aseismic elements found in ancient, standing earth and stone buildings as well as in archeo-

logical sites. They usually occur either as slip-joints between horizontal sections of masonry, or as mechanisms to bind corners of walls. In a 1990 paper, Lazar Sumanov refers to “wooden belts” in the earthen buildings of Macedonia. The wooden grid in those applications consists of two parallel beams that are connected by smaller cross-pieces forming a horizontal “ladder” that is embedded in the perimeter adobe walls. Those buildings, all with multiple stories and well over 100 years old, have been subjected to repeated seismic events. They have withstood the shocks practically with impunity. The timber-lacing functions by lending a degree of flexibility to otherwise extremely inflexible and friable walls. The division of the mass into several planes tends to allow the segments to work independently of one another during an earthquake. Because the belts are embedded in the walls and tied at the corners, the weight of the adobe above and the joining of the beams where they meet combines the advantages of gravity and tensile strength to diminish the threat of shear cracking and wall separation.

Ladder belts, as they have come to be known, are an effective method of bonding corners of walls that are differently loaded or have been separated for whatever reason. In New Mexico we have modified the technology slightly by using 4 x 6 beams. The four-inch dimension allows for the adobe coursing to be vertically uninterrupted. Instead of mortising and bolting, we lap and drop a single, loose fitting pin at each joint. The idea is not to make a rigid structure, but to allow for whatever flexibility local conditions require, now or in the future. We anticipate movement. Timber lacing does not have to be continuous to be effective for tying corners at intermediate heights, but should extend at least six feet into each wall. At changes of story or at bond beam height, the lacing should be continuous. We have done this, even in retrofits of very old buildings, very successfully. The lessons we have learned from vernacular builders are ignored at our own risk. One of the greatest killers among buildings, if I may anthropomorphize them, are the ones that have been built

rigidly. Those that purposefully or inadvertently are allowed to rock out, even when built of soft materials like adobe, are the safest and most successful. There are two reasons to pursue stability in structures during earthquakes. The lesser of the two is to minimize repairs. The greater of course is life-safety, as Sen. MortgageMatters

What is QM? Oh boy, more government regulations affecting consumers seeking mortgage loans that are eligible for Fannie Mae, FHA and Freddie Mac pricing. Could this be the last? We can only hope. However, for now the letters QM or qualified mortgage need to be understood and dealt with, like it or not. It is one of the final pieces of the Dodd-Frank Act. Whew! On Jan. 10, QM went into full swing. It contains two main terms we all need to understand: “ability to repay” and “qualified mortgage.” Ability to repay is merely a refocus, once again, on the borrower’s income, credit and liabilities. If you have a mortgage, you surely went through this taxing scrutiny. It is the name of the game. So, what’s new? Extra scrutiny on the borrower’s income calculations and a new limit of 43 percent debt-to-income ratio. A qualified mortgage is defined somewhat differently than mortgages have been for the last three decades. Negative-

amortization loans, interest-only loans, loans exceeding 30 years, and balloon loans are not allowed. Also, a limit has been set on the fees normally paid to the mortgage companies or banks and may not vary even for the benefit of the borrower. Generally, under QM, the limit of points and fees associated with a home loan is now 3 percent of the total loan amount. What is wrong with this? It sounds like these new QM rules will keep consumers from making unwise mortgage decisions. Yes and no. Qualified borrowers have long enjoyed the options of interest-only loans, balloon loans with lower rates, and amortizations longer then 30 years, but not any more. Remember, also, that these rules are only for loans eligible for Fannie Mae, FHA and Freddie Mac, which means that jumbo loans are not part of the QM definition.

Most of the details in the QM regulations test the resolve of lenders and homebuyers will never see the complexity involved. So what is the bottom line for the consumer? Associate yourself with a lender possessing experience and knowledge to guide you through any new regulation. All regulations that make the lending world more complex have the result of shrinking the available lenders that can complete your home loan. For the last three to five years, mortgage companies and loan officers have been leaving the business. Eventually, this trend may result in higher costs for loans because of less competition. For the family looking to buy or refinance, my continued advice is to find a trustworthy and knowledgeable loan officer as an ally and proceed to accomplish your goals. Ignore the new QM regulations implemented on a national level.

Water and energy - the future As we enter a new year and consider what the future may hold, many questions revolve around water and energy. Will the drought end? Will fire impact our watershed? Will the river flow this summer? Will the monsoons happen? How much will my utility bills go up this year due to increasing summer temperatures? Conservation has been a big part of the solution to our ever-increasing energy and water needs. Cities and private utilities across the country, including Santa Fe and PNM, have implemented conservation programs in an effort to reduce consumption, and they have played a role in reducing our daily intake. However, technology has also played a key role in both water and energy usage. Old washing machines used up to 35 gallons per load whereas new ones can use as little as 6.5 gallons. Old faucets and showerheads could use more than five gallons a minute; now new EPA Water Sense-approved

aerators can use as little as one gallon a minute. It is no different on the energy side. Old light bulbs used four times more energy than the newer CFLs and almost 10 times as the newer LED bulbs. Today’s water heaters can save up to 40 percent over older models. Improved efficiencies and lower prices (due to improved manufacturing efficiencies) have helped in part to drive down photovoltaic prices and thus spur demand for solar energy. In fact PV cells have dropped an astonishingly 99 percent since 1977. In addition to technological advancements, improvements in efficiency as well as re-using and recycling have reduced our water and energy footprints. Over the last decade prices for energy and water have gone up faster than the rate of inflation and this trend will likely continue. What alternative do we have for water, electricity or gas? essential if we are to continue reducing our carbon and water footprints. Technology alone can get us only so far. Behavior changes will also be required to sustain our ever-increasing population. The intent of the case study articles will be to highlight a few individuals who are thinking way ahead of their time — people who have employed old and new technologies to break away from the norm. These case studies are not intended to highlight what we all should do, but to showcase what is possible. As our population increases, it becomes more and more essential that we reduce our water and energy footprints. Santa Fe real estate a terrific value These are unprecedented times. In the past, we had to guess when the Federal Reserve would make changes that would affect interest rates and the bond/stock markets. Now the Fed has announced the tapering of the bond-buying program and the path is clear. Interest rates: Last May, the Fed clearly said it would end the government bondbuying program by 2015. This is the stimulus we have relied on for the last several years to keep rates in the 3’s, 4’s, and soon the 5’s. Without this stimulus, we expect to see 30-year, fixed-rate loans return to normal levels this year or 2015. What is “normal?” Mid 6’s. Over the last year, I wrote several articles urging you to grab the gold while rates were in the 3’s, and then to grab the silver while rates were in the 4’s. Now it’s Olympics time again: last call to grab the bronze while rates are in the 4’s. Bonds: When the Fed announced the prospective end of the bond-buying program last May, we saw interest rates on 30-year, fixed-rate mortgages climb 1 38

percent and more. However, something even bigger occurred as a result: there was a sell-off of long-term Treasury bonds, causing a drop of nearly 16 percent in prices over five months in 2013. As a rule, Americans hold conservative bonds in their AAA-rated U.S. government bond funds, municipal bond funds, corporate bond funds, and balanced and income funds. 2014 is not going to be pretty. Economic forecasters suggest that it’s time to sell bonds. Who can afford a loss of 15 percent, 20 percent, or even 50 percent in 2014? For every 1 percent increase in bond rates, you can anticipate a 10 percent drop in values. Many speculate that the bond bubble will burst as the Fed begins its announced “Taper.” This gradual end to the bondbuying program begins with a reduction of $10 billion per month this year. Markets are anticipatory: they often react to projections. We saw a 52-week high on the 10-year bond cross 3 percent recently. There are more increases to come. As bond prices reach highs and as

stocks flirt with record highs, consider cashing out, profit taking, and buying Santa Fe Real estate. It remains undervalued and presents a great opportunity. Don’t just take my word for it. Last March CNN Money called Santa Fe one of the five best markets in which to buy a home and said prices are forecast to rise 9.1 percent annually over the next five years — the second highest price gain in the nation. In an earlier article, CNN Money quoted a Fiserv-Case Shiller estimate that the Santa Fe market would be one of the strongest in the nation, with an annualized increase of 7.6 percent through 2016. Lawrence Yun, chief economist for the National Association of Realtors, projected continued growth for local real estate during a December address to the Santa Fe Association of Realtors. He pointed out that median prices increased 16 percent in 2013, the market bottomed out in 2010-2011, and there is inventory to support increased sales. No need to pull out the crystal ball on

this one. The Fed has stopped hinting and announced the taper. Buy Santa Fe real estate while it is still a terrific value. This interview series focuses on the people in Santa Fe’s real-estate industry. Patrick Thomas is the new qualifying broker at Coldwell Banker Trails West Realty.

You were formerly in charge of sales out at Rancho Viejo — since the late 1990s? I was there for 14 years. They began building houses in 1999. I was with them starting in early 2000. The property was an old ranch, wasn’t it? It was ranchland and five families bought it [from the Jarrott family] in 1981. That was Larry Myers, Leland Thompson, and others. Warren Thompson, Leland’s son, is still very much involved. There were a lot of houses built out there. Maybe 800 homes before the recession hit. In 2009, I had 72 closings. That’s when we had the federal credit for first-time homebuyers. The original developer was Sun Cor, which was owned by Pinnacle West [Capital Corp.], which also owns Arizona Public Service Company. A few years ago, the Pinnacle West board decided to get out of real estate; Sun Cor had projects all over the West. They actually shut me down from executing any new contracts in mid2010. The deal was supposed to be done in the summer, then it was Halloween, but it ended up not closing until Dec. 27. They had me twiddling my thumbs for six months. And now? The owner/developer now is Univest Rancho Viejo LLC. Warren, who grew up in Santa Fe, is one of the principals, so now it is more back in local control, which is a good thing. How did you make this switch? Quite honestly, my intent was to stay there until I retired. Jonnalyn Grover needed to step down as qualifying broker here to focus more on family and I was approached by Mike Nelson, who is the owner of Coldwell Banker in Alamogordo, Ruidoso, and Santa Fe. I was ambivalent over making that change, but they made me an offer I couldn’t refuse. It was a big change after being part of a big project like Rancho Viejo. Yes it was. It was under wraps until the day I was announced, Nov. 19, 2013. I came in for the typical Tuesdaymorning meeting and got this very long standing ovation. I was overwhelmed. Did some of the brokers know you? There was a small group — including Suzanne Field Kelly, Carol Day, Colleen Dearing, and Suzanne Brandt — who were at Coldwell Banker the first time I worked here. I moved to Santa Fe in 1995 and I was with Coldwell Banker for five years, first with John Grover, then Chuck McKinley. In 1999 I was in the top 5 percent of all Coldwell Banker

agents and that’s why I was recruited by Rancho Viejo. How many agents were there at CB back then? And how many are there now? In 1999 there were 45 or 50 and now we have about 30. I’d like to grow us back to around 50. The company lost about 20 agents in the financial crash. Yes. I think we all remember September 2008, the Lehman Brothers, AIG, and Goldman Sachs all practically went belly-up and that was all closely linked to real estate. I don’t think any of us as Realtors could have predicted how deep and long the market downturn would be. If you look historically, they’ve only lasted a couple of years. Even places like Phoenix, Las Vegas, and Florida that were hit hardest are booming again. I think our market has stabilized. I think we will see slight, incremental improvements. The initiatives opening up homeownership to more people sounded good, but there was more danger that some would not be able to keep up with payments. That was it. I remember I had one couple in their 20s, all starry-eyed, saying they were prequalified to spend $450,000. I became very parental, saying, ‘This is your first home and I don’t want you to be house-poor. Come the weekend, it might be nice to go out for a burger and a movie.’ I tried to talk them out of it. At Rancho Viejo we

had estate lots typically $650,000 to over $1 million and we would have people come out wanting an acre of land and here’s our budget and I would say, ‘We can’t fulfill that; you should go check out Eldorado.’ I try to instill in our people here that we’re experts. People come to us the same as they would a doctor or an attorney looking for advice. It’s our responsibility to be the experts and offer sound advice. Not unlike when you go to an attorney, you want to know your options. Where were you born? Las Vegas, Nevada. When I was 12, my parents decided that wasn’t a good place to raise teenagers so they moved us to Lubbock, Texas. I graduated from high school there and I left. I graduated in communications from Abilene Christian University, moved to Dallas, and got a master’s at University of North Texas in counseling psychology with an emphasis in family therapy. I was in private practice as a family therapist for 23 years. I was on staff at three different psychiatric hospitals, then managed care hit the mental health part of the health-care industry like a tsunami and it soon got to feel like my main job was fighting with number-crunchers to get treatment for my patients. It was no fun any more and I decided to move. I wanted a smaller city with an arid climate, close to mountains, and with cultural amenities, and it was that fourth component that set Santa Fe apart. My first idea was to be a corporate trainer, but ultimately I chose real estate. I did my coursework in Dallas and started here at Coldwell Banker on March 1, 1995. Northern New Mexico is a unique market. My first year I closed $2.2 million but I was butchering the names of all the streets. One day someone stuck a Postit note about that on my computer and I turned around smiling and said, ‘I may not be able to say it but I can sell it!’ Why Coldwell Banker? This company has a ton of educational programs for new agents and great statistical information and marketing tools. If you ask our agents what they like about Coldwell Banker you hear that it’s like family, the most supportive, collaborative company they’ve ever worked at. Are you married? I’ve been married for 20 years. This was my second marriage; I was single for 10 years before Sarah and I got married. She was a social worker and clinical director at a shelter for battered women in Dallas. We have a 12-yearold and a 9-year-old, and six grandchildren. It’s a modern family. After our youngest started school, Sarah decided to get a second master’s, in education, and she’s a teacher at Turquoise Trail Charter School. We both have second careers. HOME

About encroachment issues Home ownership means many responsibilities and opportunities, including designing your own landscape and remodeling the interior of your new house. Your home becomes an expression of you and it very much affects your neighbors. Renovation changes and view must be within guidelines of property encroachment law. Home ownership represents limitations when property lines are in question. Every single home has boundaries. They can be found on your survey. Knowing these measurements and knowing the limits can save you stress, disappointments, and broken relationships with your neighbors, especially about where your property ends and theirs begins. Real estate encroachment happens when one property has its home or other property, personal or real, such as fence, bushes, or garage that extends from one property over another property. If you are

buying a property and the encroachment exists before you purchase, the owner that has the encroachment is not required to remove it. Both you and the property owner with the encroachment have rights. Only the court can make that ruling if everything else fails. Title insurance may help if the encroachment is not an exception in the policy. The survey will reveal the encroachment. The encroachment may be disclosed prior to closing or at closing. If you are the owner of the encroachment as the buyer you may want to take actions before the closing to remove your encroachment. If your new neighbor is the owner of the encroachment it will be revealed on the survey and it will appear as an exception in the title policy. Before you take any legal actions against your neighbor consider the following: • Have a face-to-face visit to discuss

your reasons to remove the encroachment. • Listen to your neighbor’s reasons for the need of the encroachment. • Consider a new survey to define the boundaries and share the survey with your neighbor. • Attempt to resolve the issue peaceably where both sides win. • Always consider the impact that will be made if you force your neighbor to pay the cost for removal. Title insurance is a valuable resource to resolve this issue. If the encroachment is an exception in the policy you may not have any recourse but to attempt to work it out with your neighbor personally or wait for the court to decide. An exception to the encroachment may be made in the policy if the encroachment appears on the survey. Even if the encroachment is disclosed in the purchase money agreement the issue needs satisfaction.

Kurt Hill named ‘Realtor of Year’ The Santa Fe Association of Realtors awarded Kurt Hill ABR, AMS, CNE, CMCA, CRS, owner/broker of Adobes & Dirt LLC, with the 2013 Realtor of the Year award. Kurt is a third-generation New Mexico real estate broker. His grandfather sold real estate well into his nineties and his mother continues in her 54th year in the industry. Kurt served as a member of the association’s board of directors, chair of the Multiple Listing Service Committee, and as a member of the grievance committee. The Realtor of the Year award is one of the highest honors given to a Realtor. The selection is based on how he/she upholds and exemplifies the Realtor Code of Ethics, industry professionalism, participation in local, state and national Realtor associations, and community service. Coming from a family with deep roots in the New Mexico real estate industry, it’s not surprising that Kurt is known for his integrity, passion for professional service, and strong knowledge of the market. Kurt

worked at his mother’s agency, Hill & Hill Real Estate, at Christopher Webster Real Estate, Sotheby’s International, and with Dougherty Real Estate before starting his own company in 2008. Kurt is an active volunteer at First Presbyterian Church, served as the Realtor representative for United Way of Santa Fe, and is known for his devotion to his wife of 17 years, Christina, and their two children, Sadie and Drew. Upon receiving the award, Kurt shared, “Many do not understand that the Realtors Association is a volunteer-run organization. It is not a state licensing commission. Wayne Nichols, owner/broker of Nichols Agency Real Estate, was honored with the Lifetime Achievement award for his service to the association at all levels, his pioneering work to advance passive solar design in home construction, and support for historic neighborhoods. Wayne and his wife, Susan, moved to Santa Fe in the early 1970s and together designed, built and sold one of the earliest solar communities in the nationm winning many awards from the U.S. Housing and Urban Development and the Dept. of Energy for their innovative developments. Colorado River water a key source As drought conditions persist, we will all be learning a lot more about the importance of San Juan-Chama Project (SJCP) water to the Buckman Direct Diversion (BDD) and the relevance of SJCP water levels in Heron Reservoir. One of the objectives of the BDD was to divert and treat water owned by the city and county but not accessible through unsustainable groundwater pumping. Renewable surface water diverted at the BDD includes both native Rio Grande water and SJCP water. The latter comes from a system of diversions, siphons and tunnels designed to deliver to the Rio Grande Basin (via the Chama River) the 11.25 percent of Upper Colorado River Basin water allocated to New Mexico under provisions of the Upper Colorado River Basin Compact. The SJCP is a participant in the U.S. Bureau of Reclamation’s Colorado River Storage Project and it is managed by the bureau. Of the 8,730 acre-feet per year (afy) the BDD is permitted to divert from the

Rio Grande, about one-third of the total water rights is native Rio Grande water rights and two-thirds is San Juan-Chama Project contract water (rights for 93 percent of which are held by the City of Santa Fe and 7 percent of which are held by Santa Fe County). The city and county contract for a combined total of 5,605 afy of the 110,000 afy average diversion from the SJCP. The project was conceived after World War I and surveys began in 1933. Only the first phase was approved by Congress and signed into law in 1962. Construction of the various facilities began in 1964 and the first water was diverted to the Chama River in 1971. San Juan-Chama Project water is gathered from three headwater streams (the Navajo, Little Navajo and Blanco rivers) of the San Juan River, which itself is a tributary of the Colorado River. The water flows through the concrete-lined, 12.8-mile Azotea Tunnel, under the continental divide, into Willow Creek near its confluence with the Chama River,

and then into Heron Reservoir. It then flows through El Vado Reservoir (originally built as storage for the Middle Rio Grande Conservancy District) and then through Abiquiú Lake (originally built behind a dry Chama River flood-control dam and later redesignated for storage of SJCB water for Albuquerque). There are no carry-over provisions, with the result that contractors must take delivery of annual water allotments by Dec. 31 or store unused water in other reservoirs downstream of Heron. Historically, the San Juan-Chama Project has never curtailed deliveries. If cutbacks were required, they would be shared proportionally by all contractors. In late 2012, weather models predicted a drier-than-normal winter in the San Juan River watershed and also diminished native Rio Grande flows. Fortunately, unanticipated late-winter and early-spring precipitation and runoff precluded any curtailment of water to SJCP contractors in 2013. But at the present, Heron Reser-

voir is at historic low levels (30 percent of capacity). Let’s hope for a repeat of last spring: precipitation and runoff in Colorado along the continental divide south of Wolf Creek Pass. Market: positives outweigh declines The quarterly statistics released by the Santa Fe Association of Realtors are the best indicators of our unique market. The real estate market around the nation continued to improve by leaps and bounds in the last quarter. Let’s see how Santa Fe fared. According to the SFAR report released on Jan. 16, the city’s total closed sales were up marginally from 187 in 2012 to 189 sales in the final quarter of 2013. The median sales price for the city was almost even, from $279,990 in the final months of 2012 to $280,100 in the fourth quarter of 2013. The county saw a slight dip in closed sales, from 162 in 2012 to 158 in 2013. The median price in the county, however, slipped in the fourth quarter from $440,000 in 2012 to $379,000 in 2013. Overall inventory increased in 2013 from 3,408 homes for sale at the end of 2012 to 3,882 at the end of 2013. The northeast city limits had big gains in median sales price for the fourth

quarter. From $569,500 to $717,500, this 26 percent increase reflects more sales of million-dollar homes than in the previous year but closed sales dipped year to date by 9 percent. Northwest city limits had a modest increase in the median sales price for the quarter, from $322,400 in 2012 to $327,500 but closed sales increased by over 18 percent. The southeast city limits had an overall decline in sales from the previous year of 7 percent and a decline in median sales price from $545,000 to $475,000. The southwest city limits had a 20 percent increase in closed sales over the previous year and the median sales price here jumped to $229,250 from $195,000 in 2012. The north county of Santa Fe had a busy fourth quarter with a 16 percent increase in sales. Overall, however, sales in this area declined almost 40 percent from the previous year and it is no wonder that the median sales price also declined by 30 percent, from $635,000 to

$443,750. The northwest county was also down overall for the year in closed sales by 7 percent but the median sales price did increase modestly from $675,000 in the 4th quarter of 2012 to $695,000 in 2013. The southeast county was also down for the year in closed sales by 8 percent and the median sales price dropped from $383,250 in 4th quarter 2012 to $353,750 in 2013. The southwest county saw a huge increase with closed sales almost doubling from the previous year. The median sales price, however, did decline from $320,000 in the fourth quarter of 2012 to $274,000. Eldorado, which is typically a more consistent market, had a rocky 2013 with a 30 percent decline in overall sales. Median sales price, however, stayed relatively even at $339,000 from $338,425 the previous year. What does all of this mean? We believe that the positive factors outweigh the declines and that 2014 should continue to be an improving market. We do not

Water wisdom brewing in NM Senate Even though I design and install cistern systems, I talk many clients out of owning one. The average property owner often can’t afford the pipes, filters, tank(s), pumping system, and distribution lines required in active water-harvesting systems. Fortunately there are plenty of other meaningful and less expensive forms of collecting and using stormwater runoff. Passive systems such as fish-scale swales, rain gardens, wicks, and sheet mulching are excellent investments, but they can never be as efficient and productive as cisterns. Cisterns store runoff from impervious surfaces for long periods of time, and they allow water to be used where and when necessary. Whether connected to a hose or drip irrigation system, harvested runoff form cisterns is a resource that we’ve neglected for too long. Cisterns can also be valuable during emergencies. You never know when your well will run dry or when your community water system

is going to be rationed — or worse. Just ask 300,000 West Virginians or the many people whose lives have been destroyed by fracking. Cisterns are nothing new. Aristotle in his Politics encouraged the installation of water-storage tanks in cities. They would be useful during a siege. It can also be critical to have a cistern during a wildfire. Fire departments love them. As drought persists and demand for jobs and growth does the same, communities are seeing how water harvesting can provide myriad benefits. Perhaps the least well known of these is that cisterns not only increase the quantity of usable water in a watershed, but they also improve local river-water quality by reducing the sediment that typically runs off of developed land. This year, Governor Susana Martinez wants to spend $112 million on conventional water projects for some droughtstricken New Mexico communities. Although these expenditures certainly

seems necessary, on a more creative and uplifting level, State Senator Peter Wirth has introduced SB16 and SB91. The former offers annual income-tax credits up to $5,000 for water-harvesting projects. The latter opens the door for water catchment financing districts that could issue bonds and lend money to property owners who want to install water-catchment systems. The landowner’s payments would be made with property’s annual tax assessment. Modeled after New Mexico’s clean energy program, which was set up to finance solar panel installations (also initiated by Wirth), SB91 would provide financing opportunities that are currently unavalable. Our state’s similar solar program was initially derailed because Fanny Mae and Freddy Mac objected to solar-panel payments (as tax payments) getting in the way of people paying their mortgages. It seems we will have to organize first to turn these bills into laws. Then, in the case of SB91, we will also have to extract a cou-

ple of bloated agencies out of our essential work to diversify our water portfolio in the Land of Enchantment. This seems doable, but the movement will need your help. small but interesting piece of Santa Fe’s built environment has been saved and memorialized out at the Randall Davey Audubon Center. The property, loved by local historians as well as birders, is named for the artist who bought it in 1920 and lived and worked there until his death in 1964. A few preservation-minded residents recently created a replica of Davey’s studio door, which the artist adorned with painted animals that are now faded. “Mac Watson’s generosity made this studio door project possible,” said Steven J. Cary, operations and resource manager for Randall Davey Audubon Center. He was referring to Alan “Mac” Watson, Watson Conserves, LLC, who led the conservation effort. “I felt that the best preservation strategy was to remove the original door and display it inside the studio, calling attention to the fact that the replacement door is a reproduction,” Watson said during a mid-December visit to the property. “Fortunately we have sufficient evidence to be able to reproduce the colors and figures that Davey painted on the door.” The original door from Davey’s patio into the studio suffered from about 90 years of exposure to the sun and weather. It is now on display inside the studio. Master woodworker Grey Howell built the reproduction door and installed it in mid-December. Gretchen Overman painted the frog, deer and bird figures, copying the faded decorations on the original door and using an old, black-and-white photograph that was taken of the painted door when it was new. Overman thinks Davey probably used his oil paints on the door. She employed “a combination of exterior-grade sealers and pigments and flat house paint, then at the end a bioshield exterior-grade oil,” she said, exclaiming, “It’s sealed!” The frog, deer and bird motifs Davey copied from a Zuni pot that is still in his studio, amid a litter of brushes and partially used tubes of paint. “The studio feels like he just left,” Watson said. “He just put his brushes down to go and have a drink downtown and didn’t come back. Of course, that’s not exactly the way he departed.” Davey died in a wreck — he was fond of driving really fast — near Baker, California, on his way to visit his lover, Alice Primrose, according to Debbie Lawrence, who is researching the property. Davey created his painting studio by converting an old mill storeroom. The first known building on this Santa Fe Canyon property, part of the Talaya Hill Grant given to

The mill was built and outfitted to provide lumber for Fort Marcy. It ran on water flowing through what today is known as the Acequia del Llano, fed by the Santa Fe River. It is not known what the original mill looked like. “It was wood, then it was a fieldstone mill before it was plastered over,” Lawrence said. “You get a glimpse of the fieldstone in the bar in the house. We read recently that this was the first American grist mill. Shortly after it was a sawmill, they turned it into a grist mill.” Lawrence is docent for the weekly Randall Davey House tours. “It’s the only regular historic-house tour in Santa Fe,” Watson observed. According to Lawrence, the Randall Davey House docent manual states that the painted studio door shows up in two movies: And God Created Woman (1956) with Brigitte Bardot and Twins (1988) with Arnold Schwarzenegger and Danny DeVito. “Debbie is one of our very valuable volunteers,” Cary said. “Volunteers also run our store, we have volunteers leading Saturday birding walks, nature walks, plant walks, astronomy programs, and helping with the grounds. nation to the Randall Davey Audubon Center in hopes of generating further preservation support for the property.” One near-term goal is conservation work on Davey’s collection of Hispanic art. Included are 19th-century chests, trasteros, benches, tinwork, and the painted religious pieces known as retablos and bultos.

“One of our objectives in the next year is to develop a plan to better take care of this place,” said Steven Cary. “It’s a challenge for us because it’s not part of the Audubon mission, but we are obligated as the owner to take really good care of the property.”
