Losers win fowl war At the peak of this election season, it’s encouraging to remember that no matter who counts the ballots in Ohio, we here in Santa Fe are blessed with the results of a vote as profound as any could ever be. I refer, of course, to the battle for Eldorado’s soul. Last month a slim majority of Eldorado residents said it did not want chickens (other than packaged ones) to exist within the boundaries of its fabled utopia. Fortunately, this narrow margin was not enough to win the day. Pro-chicken forces, even though they lost by a small percentage, no longer have to live like the folks who hid Anne Frank. You see, the anti-chicken flock needed to get a majority of landowners, not merely voters, to the polls. Thanks to the 1,000 people who chose not to vote, Eldorado’s bylaws will remain sloppily written and completely unchanged. Here’s why the outcome of Eldorado’s Fowl War is so wonderful: fresh

eggs have the best flavor on Earth, and they deliver a nutritious breakfast-alternative in an age of boxed waffles. Chickens provide local food security and add nutrients to our increasingly degraded soils. Most breeds are good weed-eaters and are easy to care for. Studying fowl habits and habitats is a cost-effective way to teach biology, chemistry, and physics to children of all ages, and chicken husbandry has become a fashionable hobby. (Did I mention that climate change is real, food prices will be going up, and our ability to create a sustainable society is critical to ensure a future for our species?) Finally, let’s not forget that sometimes birds really are pets. Other times they’re pests. A neighbor recently complained about my boisterous flock, and as it turned out, the best thing to do was to chop the head off one of them. (The chickens, not the neighbors, silly!) Last year, at the beginning of winter some coyotes got into our coop and left

one lonely bird behind. I bought four almost full-grown ladies to keep Blacky company, but after a winter of détente, spring came and the flock got increasingly noisy. I mean awful, loud-mouthed, and outright rowdy. The din was insane, and my neighbors were right to complain. And I was right to choose ole Blacky. For who would want a lonely, pissedoff hen who’d grown ornery and shrill? Perhaps I should have found her a home. Maybe I could have taken her up to the headwaters of Apache Creek and let her run free for about an hour until something got her. But it seemed like the right thing to do, so I sharpened my ax and said a long, thoughtful prayer. Then, she was gone — flopping around, headless and dumb. I soon found myself dunking her warm body into a tin bin of hot water. That’s how you make it easy to pull off the feathers. Heated and wet, they slide right off. Then, stripped bare, you gut it, clean it,

and start making your soup. Know this, Eldorado, chicken owners sometimes must be brave. Dress your ‘nest’ for the cool seasons Now that it is fall and we are retreating into our nesting mode, it is important to think about making small changes to your interior to reflect this natural cycle and enhance your living quality. We often find that slipcovers have a bad reputation when we mention them as an option to clients. They do not have to be the sloppy ones you often see in do-it-yourself catalogs or college dorms. When done professionally, tailored slipcovers can instantly give your furniture a new life. Not only can you introduce another color or texture, but you can add or change details such as a contrast welt or no welt, kick pleats or not, trims or hide them. A

slipcover opens the possibilities to experience something new in your interior. We also tend to keep our window shades and draperies drawn to seal in heat, so window treatments become areas of focus and a potential for beauty in our interior landscape. This presents an opportunity to select a pattern or texture adding richness to your environment. Think large-scale print for drapery or a surprise pattern on a Roman shade. Darlings, I am so sorry for skipping out on you last month, but I was on a little excursion through Yellowstone. Cornflowers, I was so awestruck by the park that I was rendered speechless. Fortunately, I recovered, and I’m rather embarrassed to tell you that this was my first visit to Old Faithful. (Spank me for not taking advantage of more of America’s treasures, our National Parks.) We had a day in Jackson, Wyoming, trying to view the Grand Tetons through a smoky forest-fire haze, then it was on to our base camp, a friend’s cabin on the Gallatin River in Big Sky, Montana. Each day, instead of lolling around on the cabin’s sunny deck, we drove, walked, and hiked through as many of the 2,219,789 acres of Yellowstone as possible. (Only extreme athletes could have done better.) We spent a day in Bozeman and thought about enrolling in some classes at Montana State because the students looked so outdoorsy, but instead opted for lunch at Ted’s Montana Grill, one of those restaurants started by the great activist and environmentalist Ted Turner. My food was delicious, even though I forgot to have a bison burger. One thing is certain: a week is not enough time in Yellowstone. Another thing is uncertain… and disconcerting. Yellowstone is actually a massive caldera of a super volcano. Cataclysmic eruptions have historically occurred every 600,000 to 800,000 years. The last one was 640,000 years ago, with an eruption 1,000 times larger than the 1980 eruption of Mt. Saint Helens. The thermal energy released from St. Helens was equal to 1,600 times the size of the atomic bomb dropped on Hiroshima. Without getting too dramatic about this, Butterbeans, I ask you to do the math. Seriously, I don’t want to sound like Chicken Little, but the sky could be falling any day now (after all, it’s already been 6,400 centuries), and I don’t know of a hiding place. So I got as far away as I could, and I came to Florida. Just to be on the safe side. (Even though chances are I may not be able to stay

here long enough for the next eruption). I rented a house in The Villages, a place that has intrigued me ever since one of the residents (with a great tan) told me that 365 evenings a year they have live music and dancing at the town squares. That’s what they call them down here: squares, not plazas. I had to experience this for myself — much to the dismay of many of my friends who think (rightly so, of course) that Santa Fe is paradise and there’s really no need to go someplace where it’s so humid that it causes a person to perspire. (Just the other night, Lovebugs, I sweatingly slipped right through this guy’s arms as he tried twirling me around the dance floor.) But here I am, anyway, despite the long drive to get here and the high humidity after arriving. Within 48 hours, I made a Santa Fe connection, which once again proves how small the world really is. Al Cotoia (from Rhode Island and a resident here for the last 6+ years), when he saw my NM license plate, said, “New Mexico! I have a nephew who lives in Santa Fe. He went out there from Rhode Island 45 years ago to go to college, the College of Santa Fe, or something like that, and he never came back. Loves it.” That’s John Cotoia, CSF graduate and previous owner of Chateau Construction (now owned by Arthur Seligman). John retired from the building business in 2000. Pumpkins, was he smart or was he psychic? Either way, he was too young for assisted living (after all, he was only 50). After a year of getting a little bored playing golf, he took up driving a taxi for Capital City Cab. So, if you get John the next time you call for a cab to take you to the Santa Fe Airport, you might also be able to get some good advice on remodeling the crumbling adobe you bought for an exorbitant price because of its location, location, location. While I’m down here dancing and drinking, going to classes in water aerobics, yoga, qigong, pilates, NIA, low-impact strength and toning, BS zumba (Cupcakes, if I do all that, I’ll be unrecognizable next time you see me), I’ll be missing some of my favorite events in Santa Fe. Santa Fe Concorso Rare Car Event (Sept. 28-30), held this year at Las Campanas. I especially wanted to be there on Sunday when the classic cars and motorcycles were displayed on the 9th fairway. Rey Post (associate broker at Sotheby’s) hosted a special two-hour remote broadcast of his “All Things Real Estate” radio show from The Club at Las Campanas, and since I forgot to stream it via SantaFe.com, Rey emailed the video to me, so I got to see his interview with race car legends Denise McCluggage and Sir Stirling Moss. Kittens, the bazaar is where I always buy my Christmas presents and all the homemade sweets that I’m too lazy to bake myself. What is social networking? Social networking is the new buzzword for many of us, but it remains challenging to many and a mystery to some. Yet it is simply nothing more than a stream of conversations with your online friends, fans and followers. Only five years ago, these people were known as family, partners, customers, colleagues, spouses, clients, kids, peers, classmates, co-workers, acquaintances and even strangers. Today, they are your online sphere of connections on Facebook and Twitter. These free social-media websites help you create online connections and virtual communities with people who share common interests. Imagine them as an online fiesta party, gallery opening, networking event, job fair or your last conversation online. They are a place to learn new things, find lost friends and share information. It is how nonprofits promote their cause and raise money. Using Facebook and Twitter, you can market your business and listen to your customers. These sites

can be the source of a laugh, a lead, an idea, a new friend or customer. You can stay in touch, reach out, reconnect and make a difference. Social networking is what happens when people connect online. The magic begins by simply answering the “What’s happening?” question. What is different? What you say on Twitter or Facebook is public and appears in real time to your followers and fans instantly. Your online conversations are never truly private. Facebook and Twitter do not make your conversations public. You do when you post them online. The bottom line is you are in control of your social networking presence, reputation and experience. You chose who you follow, like and friend. Facebook and Twitter do not control your friend choices, write your profile or post your pictures and videos. You do. Both Twitter and Facebook are different things to many different people. You can use Facebook to stay in touch with your

family. Your Facebook “wall” is the center of your universe. It is where you write comments, share information links, post images and share what is important in your life to your sphere of friends. They will do the same. These are the people you know, like and trust. All your conversations are shared with each other. Twitter is a social-messaging center where you can micro-blog your ideas, information, and comments to others in less than 140 characters. It is an easy way to say something quickly to broadcast to your followers. Like Facebook, you chose who you follow and you can block who follows you. Now everyone running for office tweets for your vote. You can promote your brand, product, art or cause. Like The New Mexican, you can broadcast breaking news tweets to your followers. Social networking is how millions of people learn new things, communicate ideas and help each other. Avoid posting when you are angry, bored or speechless.

Median prices down, closings up It’s that time again to take a look at current market trends as published by the Santa Fe Association of Realtors. Overall, our biggest gain was the number of closed sales. Year to date we experienced a 19 percent increase over last year and the current supply of homes fell to 18.5 months. The drop in inventory is significant, a 41 percent reduction, which is the golden ticket to a balanced market. This increase in sales could be attributed to yet another decline in our median sales price. Down 4 percent from last year, the $306,250 remains above the 7 year low of $300,000 from 2005. But, there were shining spots of appreciation across Santa Fe as we look at the various areas. Is this an indication we have hit bottom? Let’s talk about those few areas that saw an increase in the median sales price. The city limits northwest saw a 25 percent increase in sales price to $335,000 and a 73 percent increase in closed sales which translates to nine months of inventory. The far south city and county had a 18

modest increase in price, $464,000 up from $448,000 last year. New listings here increased 1.3 percent to 12 months of supply. The area of Old Las Vegas Highway had a 3.4 percent increase in price to $385,250 with 22 homes selling. Highway 285 saw a 10 percent increase in sales price to $430,000 with an 8 percent increase in sales over 2011. Inventory here hovers at 18 months. Let’s look at the areas with the largest declines in sales price. Sales increased in the Tesuque and northeast county year-to-date, but the price fell 17 percent to $575,000. The southwest county along Highway 14 had a 21 percent decline in sales price to $220,000 and inventory here still runs almost 14 months. Pecos had a 28 percent decline over last year with the median sales price at $172,000. Inventory here exceeds 26 months. Northwest county had a 12 percent drop in price from $637,500 in 2011 to $559,500 but inventory has decreased from 185 homes for sale to 113.

Eldorado had a 6 percent decrease in sales price over last year, from $319,000 to $299,000, with inventory levels running just over seven months. The city limits northeast median sales price dropped from $556,200 in 2011 to $525,000. Inventory here is just over a year with approximately 203 properties for sale. The Rancho Viejo area experienced a drop in selling price from $295,000 for 2011 to $275,000. Inventory levels here are at fiveyear lows with roughly 54 homes for sale. The Airport/Agua Fria neighborhoods also fell 6 percent with the median selling price $173,500. Inventory here is just a 7 months supply. A few areas stayed about the same: the city limits southeast had a 1 percent decline in selling price to $390,000 with over 11 months of inventory. The southwest city limits median selling price of $205,000 is down from $208,000 in 2011 with over nine months of supply. And lastly, the Las Campanas area had relatively no change in the median sales price at $857,500 but the inventory of homes

shrank to just over 14 months. While prices are still sliding in certain neighborhoods, the continued decline in inventory is the best indicator we have that the housing market is on the rebound. Apartments coming to historic motel site By Paul Weideman

T

he glorious, old neon sign for the Stage Coach Motor Inn will live on as the property at 3360 Cerrillos Road is redeveloped as a 60-unit apartment village. The only change will be the word “Apartments” replacing “No vacancy.” “The Housing Trust is doing this, all affordable apartments,” said Steve Larson, project superintendent with Pavilion Construction. “It will be 44 units in nine new buildings plus 16 units in the three remodeled buildings of the motel.” Integrated Design & Architecture, the Albuquerque firm that has designed the project, put together a history of the property. It begins by noting that the alignment of today’s Cerrillos Road shows up as the Camino de los Carros on a 1767 map of Santa Fe. A little over a century later, another map identifies this as a stagecoach route. “One could imagine that some of those coaches stopped at the property, only 10 miles from Santa Fe, to water horses and passengers from an old stone-lined well still located on the site.” The old camino was absorbed into Route 66 in the mid-1920s, but that designation — which brought a number of distinctive

motels to the Santa Fe stretch — only lasted 12 years. Route 66 moved south when a shorter road was established between Tucumcari and Albuquerque. There have been lodgings at this site going back at least to 1944. Two buildings known as The Westerner were probably built at that time as a boarding house for visitors to, or employees of, the Bruns Hospital for World War II soldiers. By the 1960s, it was the Stage Coach Motor Inn, expanded to three buildings with 16 units. Those three structures, all stuccoed concrete block, are known as the Big House, the Inn, and the Casita. All will be preserved in the remodeling effort now under way. The old ceiling vigas, fireplaces, and saltillo-tile bathrooms will be saved, but insulation will be added in both walls and roofs. That’s just one of the sustainability features to be addressed in the Stage Coach project. The Housing Trust, Pavilion Construction, and the architects are going for top “Platinum” designation in the home category of the U.S. Green Building Council’s LEED (Leadership in Energy & Environmental Design) certification. When it’s complete, the Big House will have eight dwelling units, as well as a com-

munity hall, a common den and kitchen, and a management and leasing office. The Inn will have six apartments, a community laundry, and maintenance facility for the entire development; and the Casita accommodates two dwelling units. The site is 4.4 acres, with access to Arroyo de Los Chamisos park and trails, but it’s also right on Cerrillos Road. High traffic volume and highway noise were considered in the site and building design of this compact infill development. The developers intend to provide “a playful and cohesive community for individuals with children, as well as people transitioning out of homelessness,” say the architects’ documents. There will be kitchen gardens, turf and sand interpretive play areas, and tree-lined outdoor seating. The historic well house shows up as a water feature with outdoor seating. Rainwater harvested from parking areas and rooftops will be stored to irrigate drought-tolerant trees, grasses, and other landscaping plants. At the office of The Housing Trust, controller Justin Robison took out a site plan, showing how the new units will be clustered around courtyards/play areas, creating several mini-neighborhoods. He said the majority of the financing for the

project — estimated to cost $13,354,000 — is from tax credits, awarded by the Mortgage Finance Authority and purchased by UnitedHealth Care. The apartments will be subject to limits based on area median income. The new buildings, one and two stories, will be designed in “a modern reflection of Northern New Mexico vernacular style,” according to the Integrated Design & Architecture. They will feature a variety of stucco colors offset by recessed windows and areas of corrugated metal siding. “All the new dwellings units have direct solar access with weathered corrugated metal awnings above windows to ensure that residents have warm, comforting sunlight in winter, while minimizing unwanted glare and heat gain in the summer.” The units also will have private back yards, balconies, and semi-private patios. The architects’ plans include a Community Building providing a meeting and gathering room, a day care center, a computer room, a kitchen, and an office for a social service coordinator. Larson said his crews are aiming for completion of the Stage Coach Apartments in January 2013.

Recycled memories One of the nicest things about being a gardener is that we can make something grow when it seems everything around us is struggling to survive. Being immersed in a season of less sunshine and an economy whose fate hinges upon an upcoming election, we know our passion for playing in the dirt is what sustains us through life’s uncertainties. If you are like most gardeners, you started out with an opulent vision for your flower beds but ended up with a slightly different version, one that consists of volunteers and “adopted” varieties. While not part of the plan, you know your oath to care and “make it grow” was larger than your possible disdain for the plant. Perhaps gardeners are like animal rescuers: we see a stray and just can’t turn our backs. Richard Balthazar knows this better than anyone. His former recycled plant business, Babylon Gardens, was a fixture at the Santa Fe Farmers Market for years. But after a downturn in the

economy, Balthazar had to close his greenhouse doors this past June, leaving the business of plant rescue up to nature and man, which often leads to the dump, or even worse, the hands of neglectful plant owners. Balthazar started his botanical rescue mission 15 years ago when he became known as the go-to guy for unwanted plants, usually due to someone moving. He saw an opportunity to recycle the plants; after all, says Balthazar, “We rescue unwanted animals and children, why not plants too?” Enjoying his status as the ASPCA guy for plants, Balthazar also enjoyed several successful seasons at the Farmers Market at the Santa Fe Railyard. He received nicknames like “Iris Guy” and “Plant Man,” monikers he says he misses hearing to this day. The idea to call his business Babylon Gardens came from his love of the “Hanging Gardens of Babylon,” one of the seven wonders of the ancient world, even

though it may have been a legend. Legend or not, Balthazar wanted to recreate that famous image where plants of all kinds drape from structures and buildings. He came close with his own version after designing his greenhouse and garden out of recycled materials like street concrete and local wood. It seems he has a knack for giving things another chance, but after his business ended, he is curious if the concept of plant recycling will ever come back. He believes the Farmers Market’s change of venue coupled with an unstable economy led to the demise of his business. Regardless of why, Balthazar’s memories of his adopt-a-used-plant days will always be with him, and he deeply misses interacting with his customers and vendors. On his last day, he made a Going Out of Business sign and brought all of his plants to the market, giving them away for free. In a small donation box next to the sign, he said people gave him over $320.

New problems in appraisal process The real-estate market is recovering but still faces hurdles, notably from tight mortgage credit, but problems with a sizeable share of appraisals also are holding back home sales, according to survey findings by the National Association of Realtors (NAR). Most appraisers are competent and provide good valuations that are compliant with the Uniform Standards of Professional Appraisal Practice. However, appraisals generally lag behind market conditions and some changes to the process have been causing problems in recent years, including the use of out-of-area valuators without local expertise or full access to local data, inappropriate comparisons, and excessive lender demands. Major problems reported by Realtors include: • Some appraisers are using foreclosures, short sales and run-down properties as comparable homes, and are not making adjustments for market conditions or the condition of the property. • Appraised values that do not reflect 20

market conditions such as rising prices, the presence of multi-bidding, and low inventory. • Appraised values are very inconsistent and fluctuate widely. • Out-of-town appraisers, who are not familiar with the area or local market conditions, are being used. • Turnaround time by both appraisers and banks is slow, which delays closings. A large concern is that some appraisers working for an appraisal management company (AMC) are operating under strict and limited parameters due to bank lending criteria, which appear to be related to banking regulations or risk aversion on the part of the lender. Furthermore, unreasonable “put back” risks imposed by Fannie Mae and Freddie Mac could also cause banks to set unrealistic requirements for appraisers. NAR has long advocated an independent appraisal process and enhanced education requirements that allow appraisers to produce the most accurate reports possible. However, appraisers have faced

undue pressure — whether from a lender or an AMC — to complete appraisals using distressed sales as comps, to complete them in unacceptably short timeframes, and to complete scopes of work that are not justified by the fee being offered. These are major problems. In addition, some appraisers are required to provide as many as 10 comparable sales, which almost guarantees the use of distressed properties as comps in many cases. The appraisal industry has made strides in adapting to market conditions, expanding education and making appropriate adjustments for distressed homes that are used as comps. It appears that many of the remaining problems are tied to appraisals made through AMCs. Fortunately, the level of distressed sales is trending down: they accounted for about one-third of all sales in 2011, but have averaged roughly a quarter of sales in recent months. By 2013, NAR expects the distressed market share to decline to about 10 to 15 percent. As distressed inventory is cleared from the market over

the next two years, it should help to correct ongoing problems. In the meantime, buyers, sellers and real-estate agents need to be aware that there are problems with some appraisals, but also be aware of their rights to communicate with appraisers and lenders about errors or concerns with individual valuations. n a hill just outside the village of Los Cerrillos, Michael Lancaster and Barbara Harnack built a solar home that doesn’t look like a solar home. In the wintertime, the thick flagstone floors and double-adobe walls serve as thermal mass, absorbing the sun’s heat during the day and slowly radiating it at night. Roof overhangs prevent direct solar gain in the summer. The north side is super-insulated with sprayed foam up to 30 inches thick and a trombe wall warms the adjacent kitchen in the wintertime. The main house boasts an entrance façade that recalls the mission church at Laguna Pueblo. Nearby are a guest house, a studio, a gatehouse, and an iglesia-theme tool shed. “I designed and engineered everything,” Lancaster said during a recent tour of the property. “I wanted the effect of a little village on top of the mesa.” This is the type of property that could only have been designed by an artist, although the level of the finishes is more that of a skilled craftsman. Witness the copper patina on the metal roof, the beautifully plastered interior walls, and the tall, narrow slit windows on one living-room wall. Opening into a sun room (which is equipped with a fountain and built-in adobe benches), the light and heat from these slits are controlled by frosted-glass panels that swivel open or closed. Begun in 1994, the main house on Vista Del Mar, off of Gold Mine Road, was completed in 2000. Three-quarters of the materials used in the house project came from within 75 miles. Twenty thousand adobe bricks were used for the main house, and another 7,000 for the outbuildings. The studio with sliding barn doors features straw-bale construction. The front doors, made from local wood, are accessed by steps on stacked stone. The hall-like living room with a 19-foot ceiling and sealed-flagstone floors is brightened by clerestories: a few as slots in the churchlike facade and a few more from dormer elements on one side. At one end of the living room is an adobe stairway and a gorgeous, blacksmith-crafted railing to a loft library, media room, and the master suite. Each downstairs bedroom has its own entry and portal. A powder room sports a faucet of an extraordinarily simple design — a length of copper pipe — and a pot sink thrown by Lancaster. In fact, the house is peppered with the couple’s ceramics: Harnack’s statues and faces and his sculptures and “industrial objects.” Both are also painters. Lancaster, the great-grandson of American circus innovator Charles Ringling, is the author of a fictionalized biography, Ringling: The Last Laugh, published this year. He and Harnack are at work on The Boys from Baraboo, a children’s book telling the story of the Ringling Bros. and illustrated with photographs of Harnack’s ceramic figures in settings. There are built-in artistic touches throughout the house, for example the rust-patina’d inserts in the pantry doors, and the sherds of old Indian pottery, collected on the property, set into a partial wall in a bathroom. Lancaster is a cook and paid special attention to the design of the kitchen, with tile countertops and practical access to pots and pans, food, and dishes. The kitchen ceiling is tongue-and-groove decking on vigas. An attached greenhouse gives the couple winter tomatoes and greens, all irrigated with stored rainwater. Three subterranean water tanks outside have fountains on top; one of those bubbles over a face from a broken Harnack sculpture. Household water is from a shared well. The house is warmed in the winter by means of an in-floor radiant-heat system on five zones. A cozy patio with bancos and a fireplace offers the relaxing homeowner terrific views — you can see six mountain ranges from the 13-acre property. It’s a short drive to the historic mining town of Madrid (now full of folk-art shops, cafés, coffee shops, galleries, and the renowned Mine Shaft Tavern), less than a mile from state park and BLM land for hiking and horseback riding, and 25 minutes to Santa Fe. About domestic wells in the city Owning a private domestic well in the City of Santa Fe has many of the same benefits recited by well owners outside the city: the water is “free” (except for the maintenance and repair of the well and the infrastructure), it tastes better, and it is exempt from “government” interference by monitoring or treatment. Private wells enable some city residents to live completely on well water (and some residents do exercise that option), or to use city water within the home and well water for irrigation. Some private wells within the city are used for excessive irrigation and lush landscaping. One residence in the South Capitol district has such verdant vegetation that neighbors refer to the “gardens of Babylon” behind its walls. Owning a private well can also be a value-added commodity in a real-estate transaction. And it is not just estate-sized, high-end properties that have grandfathered wells. But if we subscribe to the “we’re all in this together” doctrine, shouldn’t we be 36

concerned that these wells are extracting water, without monitoring or adherence to whatever City of Santa Fe watering restrictions are in effect, from the same Tesuque Formation aquifer the city uses for its supply wells? The drilling of new or replacement wells in the city is highly regulated and the permit-evaluation process involves consideration of proximity to city water lines. Permits, if granted, mandate metering and reporting. When we conducted our well-publicized regional water-testing program in 2009, very few city well owners signed up for the free (and confidential) comprehensive water analysis due to suspicion that, because the city, county, and NM Environment Department were also involved in the testing program, disclosing the existence of a private well would somehow enable the city to find a way to prohibit them from using it. How many private domestic wells are there within city limits? When I first posed that question to city officials about

five years ago, I was told “probably three thousand plus.” The 2011 Annual Water Report lists 600 wells. Considering the age of many of the wells and the lack of required reporting, it seems improbable that either the City of Santa Fe or the Office of the State Engineer knows exactly how many active private wells there are within the city. It is reasonable to assume that some wells would be abandoned because of mechanical failures, but I would expect the count to remain relatively stable due to annexation. Many well owners also use their aquifer water to irrigate vegetable gardens. Some private wells within Santa Fe city limits have laboratory-confirmed high levels of uranium and the uptake of uranium (from both water and soil) in garden vegetables has been confirmed locally through a rigorous field study and laboratory testing program. An independent, specialized laboratory analysis recently revealed high levels of uranium in the homegrown potatoes, cucumbers and

beets of a local couple whose well water has elevated uranium levels (twice the drinking water standard). Watering vegetables with well water may pose a potential health risk. That’s the hard lesson that Santa Fe builders, architects and owners are finally coming to grips with. After years of taking a chance that one building site is as good as the next, reality has set in: We live in an old community that is confined topographically and bounded by lands upon which we cannot build. The result is that the good, sensible building sites were gone long ago and we are now challenging Ma Nature to let us reside in places that often make little sense. Well, they have good views and they are in Santa Fe, after all, so sense becomes a relative term. When building on the side of a mountain, in a flood plain, or in a mechanically created hollow in the foothills, approach your beautiful site with care and remember, it is out to get you. More than half our remedial underpinning volume is for homes that are under 12 years old and built on lovely, risky sites. For around $700 a pop in most places, we can install a helical pier before the house is built, on 10- to 12-foot centers. After the house is built, when the living room goes south or the kitchen becomes unexpectedly sunken, we can fix it, but the hardware and labor quintuple for the same span of wall. False economies prevail in the building industry. Naturally, I love that because it couples the challenge of a complicated structural retrofit with a good living. I would prefer, however, that the money saved by an early intervention find its way into a painting on the wall or an old Hopi pot on the shelf. And I still stay busy!

Rates are going up — fight back! Water, gas and electricity prices in Northern New Mexico are going up faster than inflation. This is all the more reason to look at how to reduce your energy and water footprint. Over the past five years, inflation nationally has been going up at a little over 2 percent per year. Utilities have been going up much faster. Water rates in Santa Fe have been going up 8.2 percent for the last four years and the new rate increase of 8.2 percent will go into effect in March of 2013. This is four times the rate of inflation! Gas prices increased $3.19 per month earlier this year and it is likely we will see another increase in late 2013. This of course does not include the natural-gas fluctuations that are not part of the base gas rate. Propane prices have been going up even faster. Electricity rates went up in 2009, then again in 2011 (9.2 percent) and again in August 2012. Besides fighting the local utilities on these increases, what can you

do? It is easy to fight back through conservation. With this approach, you don’t slow the increase, but it is possible to eliminate its impact on day one and every subsequent year. One of the simplest things to do to reduce your water bill is to install 1-gallonper-minute aerators on all your bathroom faucets. You will notice very little difference in the water flow rate, but these aerators will typically save 50-60 percent of the water being used. These are available at most local hardware stores and will typically pay for themselves in just a year. As far as natural gas savings, one of the easiest ways to save on your bill is to make sure your water heater is well insulated. If it doesn’t have a jacket, get one. Measure your water heater and go to a hardware store. This one little trick will cut your gas bill day one and pay for itself in about one year. Cutting your electrical is just as easy. The average household uses about 17 percent

on lighting. It is relatively painless to cut this one by simply upgrading your light bulbs from energy-inefficient incandescent bulbs to energy-efficient LED or compact fluorescent light bulbs. These bulbs will typically pay for themselves in less than two years and have a much longer life than incandescents. Water and energy prices will continue to increase and it is easy to fight back. Every year simply upgrade something small in each area: water, gas, electric. Technology is changing. Dinosaur 8-gallons-per-flush toilets have been superceded several times over just in the last decade. With a little planning and very little effort, it is possible to beat this cycle of price increases. Just with a little upgrading every year it is possible to keep your energy and water bills from growing. Remember saving water saves energy and vica versa. Fight back and save money.

Is ‘bait and switch’ for real? We have heard about a phenomenon in the lending world called “bait and switch.” Here’s how it goes. The consumer gets a quote for the interest rate and closing costs. Then as the closing draws near, the true rate and closing costs are disclosed. The crime is that both are now higher, more costly. You would think that after the close scrutiny the mortgage industry has endured over the last few years, this unethical practice would have completely disappeared. But, no, it is still around and consumers are still suffering. I have always said that honestly cannot be regulated. No amount of forms, disclosures and licensing will stop dishonest mortgage practices by those determined to lure you in with what seems to be the best rate and terms ever advertised. We all want to think that we have found the “deal of the century.” We love believing we are getting a better deal than our neighbors, but, as we all know, too good to be

true usually is just that. Recentl I learned of a borrower who was told that her refinance loan was at an extremely low rate and that the mortgage company would lock in that rate immediately. The lady agreed, but then at closing was told that they were unable to lock the loan (the investor had changed the rate) so the rate was higher. Nothing that the mortgage company could do. Right? After employing an attorney, she was able to get the agreed-upon low rate. The State of New Mexico and the National Mortgage Licensing System (NMLS) require strict disclosures for all home loans. Loan officers are required to be licensed and to take continuing education annually. However, as I said before, these standards merely serve to make good people better. The NMLS has a consumer contact number that can be used to inquire about all mortgage loan officers. So what should you look for when inter-

viewing a mortgage loan officer? How can you avoid being told one thing and then facing another? What are your remedies if you do indeed become a victim of the bait and switch? 1. Get a solid reference from a past client or from a Realtor for any loan officer you interview. Ask to see the officer’s license, or check the officer/company at www.nmlsconsumeraccess.org/ 2. Discuss the rate and terms of a new loan in full detail. Understand the impact of credit scores, loan-to-value percentages, and locking provisions. 3. Understand that a Good Faith Estimate is only an estimate. Your rate is not secure until locked. Get a written confirmation of your lock. 4. Remember that in New Mexico, prepayment penalties are not allowed. The bait and switch can still occur when the wrong mortgage person quotes one rate and

JIM G AY then after the homeowner has submitted all the paperwork and paid an application and appraisal fee, the interest rate increases to the detriment of the borrower. So be careful. Final on the escrow process This is the last in the series on escrow. We are scheduled for a closing, specific day, specific time, and specific title company. But has the escrow settlement agent prepared everything according to instructions? Has the escrow settlement agent communicated with all the parties of the transaction prior to the closing? If the answer is “yes,” then we may be ready. An escrow settlement agent works from specific instructions provided by the buyers, sellers, and lender(s) in the real-estate transaction. The agent will work from the purchase agreement and any loan escrow instructions provided, and/or separate escrow instructions prepared at the direction of the principals to the transaction. Instructions are written documents signed by the parties giving the instructions, which direct the settlement agent in the specific particulars of the transaction. The settlement agent follows those instructions without wavier to ensure the proper steps are completed so the escrow can be closed. Typical Instructions may include: • The method by which the settlement agent is to receive and hold the purchase price to be paid by the buyer. • The conditions under which a lapse of time or breach of purchase contract provision will terminate the escrow without a closing. 40

• The instruction or authorization to the settlement agent to disburse funds for recording fees, title-insurance policy, real-estate commissions, and any other closing costs incurred through escrow. • Instruction as to the proration of taxes, rents or association dues, as applicable. • Instructions on the payment of prior liens and charges against the property and distribution of the net sale proceeds. Since the settlement agent can only follow the instructions as stated, and may not exceed them, it is extremely important that the instructions be stated clearly and be complete in all details. The Seller deposits the executed deed to the buyer with the settlement agent; deposits evidence of pest inspection and any required repair work, if applicable; and deposits other required documents such as tax receipts, addresses of mortgage holders, any state or federal required documentation. The Buyer deposits with the settlement agent the funds required, in addition to any borrowed funds, to pay the purchase price; deposits funds sufficient for home and title insurance; and arranges for any borrowed funds to be delivered to the settlement agent. The lender on behalf of the buyer deposits any mortgage necessary to secure loans; approves any inspection reports, the Preliminary

Report for title insurance, called for by the purchase agreement; and fulfills any other conditions specified in the instructions. The Lender prepares the loan document package for buyer/borrower; deposits proceeds of the loan with the settlement agent; and directs the settlement agent on the conditions under which the loan funds may be used. The Settlement Agent opens the order for title insurance; obtains approvals from the buyer on the Title Commitment, pest and other inspections; receives funds from the buyer and/or any lender; prorates taxes, rents, etc.; disburses funds for title insurance, recording fees, real-estate commissions, lien clearance, etc.; prepares an estimated statement or HUD settlement statement, as required, for each party, indicating amounts to be disbursed for services and any further amounts necessary to close; records deed and loan documents, delivers the deed to the buyer, loan documents to the lender and funds to the seller, closing the escrow; issues the final closing statement/ HUD settlement statement and forwards to buyer, seller, and lender. Once all terms and conditions of the instructions of all parties have been fulfilled, and all closing conditions satisfied, the escrow is closed and the safe and accurate transfer of property and money has been accom-

Unless there is some special agreement between the buyer and seller as to how these charges are to be paid, local custom will generally be followed in drafting the instructions to the settlement agent as to how they are divided. Prorations are the responsibility of the escrow settlement agent an allocation between the seller and buyer for their proportionate share of an obligation paid or due. The commercial scene: slow progress By Paul Weideman

N

ot very long ago, empty storefronts right on the Plaza were bald reminders that Santa Fe, like the rest of the country, was in pain. Today, though, most of the more glaring retail wounds have been patched. One of the most obvious remedies happened over a year ago when Lucchese Boot Co. came into the Old Santa Fe Trail space left vacant by the departure of Eagle Dancer. The other big one came this past spring when the 107-yearold Plaza Café Downtown, closed following a September 2010 kitchen fire, finally reopened. An empty building next to Coldwater Creek was occupied in late May by Eastern Serenity, a company based in Chiang Mai, Thailand. Partners David Dolan and Adam Murray offer clothing and other hand-made goods from Thailand, as well as bronze and wood Buddhas and other statues, giant parasols, painted bamboo kathip khao containers, Burmese lacquered lamps, and a line of bags trunk-painted by Suda the elephant. In the 80 E. San Francisco Street space formerly occupied by Jewel Mark (which is now at 233 Canyon Road), Maverick’s of Santa Fe opened late last winter. The store sells Western wear, boots, and jewelry. The street level of the remodeled Lincoln Square building is just about full with Eileen Fisher, Pop Gallery, A Gallery Santa Fe, and a Santa Fe showroom for Vancouver, B.C.-based lululemon athletica, which opened in early August. Manager Dru Libby invites the community to visit this athletic-apparel shop, including to find out about free weekly yoga sessions. Toyopolis moved from its longtime storefront on Marcy Street around the corner to 150 Washington, merging with the children’s clothing shop Merry Go Round. At 124 West Palace Avenue, the 1890 Felipe Delgado House, left vacant after the departure of First National Bank of Santa Fe (which rented the building from the Historic Santa Fe Foundation for more than 30 years), now serves as the quarters of the S.R. Brennen Gallery. Brennen’s other locations are in Palm Desert, California; Scottsdale, Arizona; and 555 Canyon Road. Several vacancies have been filled on East Palace Avenue. One new biz is the fun Sock Magic shop that opened in March. The most recent newcomer in that retail stretch is Memories of Santa Fe, a new incarnation of the former Somé on San Francisco Street. Although the name of the new store is rather obscure, owner Judi Keith has unique jewelry and artworks, among them raptor sculptures handcarved from reclaimed chestnut by Lance Lichtensteiger; bronze sculptures by Richard Hayhurst of Deming; and paintings by Corrales artists. (Memories is at 109 E. Palace, the famous check-in location, staffed by Dorothy McKibben, for Manhattan Project personnel during World War II.) Michael and Jennifer Wurth’s Western Otter, 203 E. Palace, has an eclectic variety of objects for sale, including Peruvian painted hand mirrors, vintage turquoise jewelry, Chiapas blouses, and Michael’s wine-cork lampshade and painting of Pistol Pete. You’ll see it again in a gallery there once owner Barry Ellsworth completes a remodel (with design assistance from Architectural Alliance) that has included adding a second story. He hopes to be open early next year. Ellsworth Gallery will offer Japanese antiques, with a specialty in Samurai armor and accoutrements. Across the street, at the corner of Palace and Paseo de Peralta, Drury Southwest has been busy most of this year with a substantial hotel remodel of the old St. Vincent Hospital. The work so far has focused on construction of an underground parking structure and demolition of the interior walls. Much of the exterior, especially that facing on Paseo and Palace, is being preserved because of its value

as a historic John Gaw Meem-designed building. “We’re on schedule with a target opening of May 2014,” said Drury’s project manager, Brian Nenninger. “Beyond the underground parking, we’re substantially complete on the interior wall removals and we have started the additions.” There will be additions on the east and west wings on the building’s south side. “That will create a double-loaded hotel corridor, with rooms on each side: in the new addition and in the original building.” Nenninger said there will be a subtle stylistic tie-in with the 1954 Meem building, although the south side was more institutional — it does not have a lot of architectural flair, such as the ornamental brickwork on the Palace facade. The additions will increase the footprint from about 127,000 square feet to about

Doesn’t Santa Fe have a reputation of being difficult for new business? “I tell people all the time that that is no longer the case,” Johnson responded. “And a lot of that I think has to do with the mayor. The bad news is that it’s just a very slow go.” There are a few new businesses, however, at Plaza Santa Fe (home of Target, PetsMart, and other firms). The former Borders space will soon be taken by Ulta Cosmetics. Already at the shopping center are Select Comfort and Wow Dogs. “We’re also working on a restaurant for one of the pads in front of T.J. Maxx, but, really, the bulk of my activity is at DeVargas Center, where there will be, with any luck at all, a whole lot of change. A lot of real cool stuff is happening there; it will be a very changed property by the time we have this conversation next year.” The old Mervyn’s building at Santa Fe Place has a sign advertising, “Sports Authority Coming Soon,” but one new retailer there now is Toys R Us Express. An employee said she read that Toys R Us opened 2,500 of these around the country for the holiday season. The company announced it would operate about 600 during the 2010 Christmas season, so it must be well-patronized model. A Doubletree by Hilton opened earlier this year in a remodeled, former Holiday Inn at 4048 Cerrillos Road. A different scenario — a corporate acquisition/merger — resulted in Santa Fe’s two Sunflower Farmers Market stores being rebranded as Sprouts this summer. “That’s a good thing; Sprouts is a stronger company,” said Mark Ruhlman of Columbus Capital Corporation. An expectation that Ashley Furniture would come in next to the Sunflower market at San Isidro Plaza never materialized, but the firm did manage to bring in a Papa Murphy’s in mid-September and a UPS Store and a San Q Japanese restaurant in October. “Restaurants in general in this part of town are down 8-10 percent, but it seems like it’s starting to get better,” Ruhlman said. “In general, we’re getting more calls, and from national franchises, so we’re showing more space than we were.” Branch Design & Development, which is affiliated with Columbus Capital, is building San Isidro Apartments just north of San Isidro Plaza, behind Lowe’s Home Improvement. Ruhlman expects the first buildings to be ready in the early fall of 2013. The gated development will be 176 market-rate apartments, plus a pool and fitness center, with rents in the $700-$1,300 range. New affordable-market apartments are being developed by The Housing Trust at the site of the vintage Stage Coach Motor Inn. [See story on Page 19.] Looking at the office scene, although there is a good supply of quality properties available, the office-for-lease market is still very soft, according to Leon Mellow at Grubb & Ellis. But he is busier than ever. “A lot of my practice is situations that are either distressed or the owners are needing to get something going on them and the problem in both cases is that we’re missing is a lot of prospective tenants and a lot of prospective owners. We do have a lot of properties that are priced properly because most owners have gotten realistic at this point.” Real-estate activity, in general, slows down in election years, but it’s difficult to know how much it will bounce back after Nov. 6. “Elections always create the unknown situation and the real-estate market stops when things are 44

unknown,” Mellow said. “Real estate understands yes and no, but it doesn’t understand possibly and maybe. The other thing is you don’t turn on the market with a switch, so we’re going to be well into 2013 before we see the results of the election, if there are any.” Grubb & Ellis’ Santa Fe listings include 6.5 acres on Governor Miles Road on sale for $3.9 million; the century-

old Fiske House on Don Gaspar Avenue [for office use], $2.35 million; 5 acres next to the new Beaver Toyota site off Beckner Road, $2.1 million; and 4.6 acres on Airport Road for $1.8 million. Late last month, Robin McKinney Martin announced plans to sell the Santa Fe New Mexican Building at 202 E. Marcy Street. In the mid-2000s, Martin, owner of the newspaper, built a new printing/distribution building at the south end of town, purchased a KBA Comet printing press, and did a substantial remodel of the Marcy Street building — just before the world financial crash. The newspaper’s 150-some employees will be consolidated in the new building at One New Mexican Plaza, just west of the Cerrillos Road/I-25 intersection. The 29,500-square-foot downtown building, the paper’s headquarters for 70 years, is listed for $6.2 million by John Hancock, Barker Realty. Included are two parking lots that accommodate 100 vehicles. A few years ago, Santa Fe brokers David Oberstein, Oberstein Properties, and Marc Bertram, SF Brown Real Estate, were among the developers of Hotel Parq Central in Albuquerque. Bertram said that was a very successful venture and noted it’s number one at TripAdvisor.com. The two have recently converted a large office space at 215 Lincoln Avenue (vacated when Thornburg Companies move into its own building on Ridgetop Road) into single offices. “These are executive suites,” Oberstein said. “They’re single offices with shared reception areas, shared kitchens, shared waiting and conference rooms. We have about a dozen individual tenants in there now. “So we are finding that there is demand for single-office users, small independent businesses, and we also have parking, lots of parking: between Marcy Plaza and 215 Lincoln, we have probably 300 parking spaces downtown. I’m encouraged to see that leasing activity is picking up. I’ve shown space three times this week. There are people out there looking.” The state apparently is also out there looking — for new office space at the huge, potential Las Soleras development just north of I-25 and east of Cerrillos Road. A mass relocation of state employees from existing offices around Santa Fe “would do nothing but put this market into a deeper recession for a much longer time,” Bertram said. “Thornburg vacated two of my buildings — Marcy Plaza and 215 Lincoln — and we’re stll feeling the effect five years later. I think that’s also true at the First Interstate Building, which is owned by Trammel Crow. Thornburg vacated about 60,000 feet, but the state is talking about 230,000 square feet in the first phase of Las Soleras. Can you imagine the impact?” Meanwhile, Las Soleras has seen significant site work during the past year or two. There is a long, paved road to

There have also been quite a few openings of locally owned restaurants. At the corner of Cerrillos Road and Christos, The Ranch House was opened by Josh Baum and Ann Gordon, who before this had Josh’s BBQ at San Isidro Plaza on Zafarano Street. In February, Bill Healy opened the Green Owl Café in a remodeled gas station at 1698 St. Michael’s Drive. A soup-specialty restaurant named Sup opened last spring at 559 W. Cordova Road. The Nile Café,

featuring “extraordinary Egyptian cuisine,” landed at 620 Old Santa Fe Trail. Real Burger, last seen at 2239 Old Pecos Trail (previously home to Pepper’s, Fresh Peppers, El Milagro, and other restaurants), is opearting at the corner of Maez and Cerrillos roads since last January. And at 2239 Old Pecos Trail since February is the Pecos Trail Café. In the old Real Food Nation location on the Old Las Vegas Highway near Eldorado, restaurant veterans Annamaria and Murphy O’Brien opened Cafe Fina. Their suppliers include Niman Ranch and Talis Wind Ranch (meats) and Taos Cow Ice Cream, so you can depend on the food being local and yummy.
