Working beauty in glass By Paul Weideman SPIN DUNBAR IS WELL KNOWN FOR RESTORING STAINED-GLASS WINDOWS IN AREA CHURCHES, BUT HE ALSO LOVES THE CHALLENGE OF NEW PROJECTS, AND WORKING WITH CLIENTS TO FLESH OUT IDEAS. One example he showed in his Nambé studio was for a doctor who had worked in New Orleans after Hurricane Katrina. “He was also a novice blues piano player with a beautiful Steinway. What to do? I asked him about his favorite song and it was Bonnie Raitt’s ‘Nick of Time.’” The window is a collage with notes from the chorus, a piano keyboard, a wavy line representing the Mississippi River, and instruments from the New Orleans music. “He moved again, to Portland, Oregon, so he wanted me to go to his house in Santa Fe, take the window out and make a frame for it and ship it out for him.” The work keeps him busy. His resumé is wide-ranging, including artistic, wavy privacy glass for bathrooms; medieval-theme windows for George R.R. Martin of Game of Thrones fame; restoration work at the Scottish Rite Temple; and the design and construction of new confessional windows for the San Juan Episcopal Church at San Juan Pueblo. A round window made by Dunbar Stained Glass for Southern Methodist University in Taos has a dove on a star design. A stained-glass window for the Villa Therese Catholic Clinic shows St. Therese of Lisieux, the clinic’s patron saint, standing in a field of flowers — with a depiction of the clinic in an arched panel at the top. 22

Dunbar was born in Ventura, California, and grew up in the Golden State. He moved to Vermont to raise goats and started doing glass work. He would take the Greyhound bus to New York City, excited to return home with a few small pieces of colored glass. He won an Art in Public Places grant from the National Endowment for the Arts to do the state pavilion for the Vermont capitol, then used that to attend Bennington College. “I studied music,” Dunbar said. “I came here to play music.” From 1987 to 1992, he ran a stained-glass gallery on Canyon Road, but he was also a jazz bassist. “I had the El Farol Blues All-Stars in the 1980s and 1990s. A piece of glass hurt me and ended that.” When he was helping to unload a large piece of glass, it shattered over his head and shot an 8-inch dagger through his thigh. “I went to all kinds of doctors because I thought I was going to lose the leg. One doctor I paid with a window.” The incident points to an idea of glass as less stable than most of us think. “Glass can have a life of its own. It can have a lot of tension in it if it wasn’t annealed properly. You can fuse glass, but the pieces have to have the same coefficient and it has to cool down slowly. Glass is not a solid,” Dunbar said. “It’s held together by surface tension. That’s how I’m able to cut, because I’m making a score and when I put pressure on either side, you can control the break. In the old days, glass artists would use cow urine or even their own urine to draw a line across the glass and apply heat; the urine would heat up first and it would break along that line.”

We were talking in his Nambé studio, which he and his wife bought in 2002. “I had a studio at the Design Center in downtown Santa Fe until 2010; I was there for 14 years, then my wife became ill and I needed to take care of her.” Sebia Hawkins (Greenpeace International, New Mexico Environmental Law Center) died in April 2012. In his studio, Dunbar points to arched panels of leaded glass windows that have grids with grape patterns at the top in lead. “I had to teach myself how to cast lead. For this I took a piece of sheet lead, cut it out, then put modeling clay on top, and painted it with Elmer’s glue and water to make a hard shell. You use green sand, basically fine sand that you have impregnated with bentonite.” Those windows were destined to be set in huge interior doors for a home theater. He does a lot of residential stained glass. Former clients include Dan Fogelberg and Robert Redford. The high-end Santa Fe contractor Woods Design Builders has used Dunbar’s commissioned stained-glass pieces for more than 15 years. For a recent job creating wine-room doors for a new home, he worked with Sharon Woods on design possibilities, showing her a series of sketches. The chosen design was an arched top with crystalline star/flower forms inside concentric squares. Dunbar is always on the hunt for arresting images, like the face of an elderly Kosovo woman he may want to work with in the future. He will put tracing paper over the image, concentrating on rendering the dark and light values. That drawing is put underneath a piece of glass on a light table and he works on a reproduction utilizing glass paint he makes himself.

He often works with lead. There’s no way around it. “The lead acts like a flux. The gum arabic becomes the binder, and the vehicle can be water or clove oil or alcohol or vinegar, depending on what you plan to do.” But lead is toxic. “I have lead poisoning. My feet are hot because I have neuropathy from it. But I have good work habits. I just won’t be able to find my home some day.” His portfolio of restoration work for churches includes nine windows for Holy Cross in Santa Cruz and also Nuestra Señora de Los Remedios church in Galisteo, working with Deacon Tom Baca. “We’d take a window out and restore it, put it back in and that would be part of their fund drive.” I’ve been restoring windows for the Church of the Holy Faith. The wood framework that holds those 14-foot windows was laid in before the stone. That front wall was tilting toward the road because of water leakage from old mains and we had to get an engineer to make a frame to hold up the rocks. “I took them apart and releaded everything. First I lay it down, do like a gravestone rubbing so I’ll have a map to get it back together. Then I take my lead nippers and cut and roll off the lead strips [“cames”]. Then I take each piece out and remove all the old putty. Then I rebuild it on the map on another table.” Just as lead is an crucial ingredient in the stained-glass process, restoration is an important part of the business for a glass artist like Dunbar. “It’s necessary when the lead falls apart after 80 years or so. This profile series focuses on the people in Santa Fe’s real-estate industry. Lynn G-Scott and Rachael Baca are Realtor partners with Logic Real Estate, Santa Fe. Lynn, how long have you had this company? Lynn G-Scott: About three years. I designed this building, but that was back in 1999 when Dennis Branch and I were partners in ReMax of Santa Fe. Before this I had GMAC Real Estate and before that it was Realty 3000. Do you own this complex (at the corner of Roybal Street and St. Francis Drive)? Just our building. Where were you born and raised? Richmond, Virginia. I went to college at the University of Richmond then I had a business degree and I went into property management. I moved to Washington, D.C., and worked for R&B Enterprises, which owns Oakwood Apartments across the country. I kind of started a program where we turned 80 percent of the apartments into shortterm furnished apartments on a month-to-month basis and we rented to companies like Xerox. That’s what got me into real estate because half the people I was renting to wanted a house, so I thought I’d get my real-estate license and I could sell them a house on the weekend. Rachael Baca: Real estate is very demanding! Trying to sell someone a home on the weekend is almost impossible. Where did you grow up, Rachael? I was born and raised in Santa Fe. I got into real estate at 19. I was at GMAC and I’ve been with Lynn ever since. I deal with a lot of the bank-owned properties. How did you two do in the recession? G-Scott: Rachael was just starting. I lost my ass. I worked my butt off for years, did extremely well building up the company and opened a second office by Target. I wrote $1.6 million on that building and I ended up paying it almost all myself because no one could produce. Baca: She was working until 10 o’clock every night. Now she only works ’till 8 o’clock. I got into the business when everything was going south, so that’s all I ever knew. We started getting into the bankowned and short sales to adapt and we’ve done pretty well. A lot of the agents have suffered because they were used to easier deals and not dealing with all the issues. For me, when that’s all you’ve ever known, you have to just make it work. G-Scott: We’re still going to expand that business, when we can get a few spare moments. But each deal takes time, and there’s more paperwork than ever. Do you have help on that? We have two assistants and we’re in the process of bring-

ing in another who will be a transaction coordinator. Our goal is to provide beyond over-the-top customer service, no matter how busy we are. Whether we sell 200 or 300 homes a year, we don’t want to sacrifice that level of service. That’s why we also have a title company and a mortgage company right here in the building. The Bank of Albuquerque is now renting space. They have some of the best rates and lowest fees, and Kevin Moores [the company’s senior mortgage banker] is phenomenal. Baca: The truth is that getting a loan these days is never completely smooth, so you need someone available at all times to help you make the deal work. Kevin has been really good at making some of our more difficult deals work and making the buyers feel comfortable and get to closing on time. The world has changed since 2007, huh? G-Scott: It has. I think bank-owned and short sales are at least 30 percent of the market. We get a lot of referrals from other Realtors because they don’t want to deal with them. Baca: Or they don’t know how to deal with them. Short sales take a lot of time and the agents work harder and get less in commissions. And many companies don’t have assistants to help out. G-Scott: We have two and we’re bringing on another. We’re also in the process of bringing on a buyer’s agent. What will you do more of then? Prospecting. There are so many things you can grow and

expand in this business and that’s what makes it so exciting. Rachael and I have sold 144 houses so far this year, and there’s potentially another 25 outside of the Santa Fe MLS. The agent who is next closest in number of transactions has sold 56. And 95 percent of the agents aren’t even selling 10 homes a year. Why not do that in one month and take 11 months off? Tell us about your private lives. I’ve been married around 20 years and I’ve been in real estate around 20 years. My husband, Randall G-Scott, is our qualifying broker. We have a 19-year-old daughter and a 22-year-old son and three dogs and one python. Baca: I’m married and I have two daughters, one 8 years old and one a month and a half. My husband is Lenny Quintana. What do you like doing in your spare time? Rachael’s enjoying her baby. Baca: I am. G-Scott: Randall and I do a lot of hiking with the dogs. I bought a Harley which I need to figure out how to ride. And we have a Kawasaki Ninja 250 that we rode last weekend. Randall’s idea was you can’t answer the phone that well on a motorcycle, but that thinking is probably shifting considering the fact that Rachael’s baby stroller has an iPhone charger on it. You two are both go-getters. We really love helping people. It’s problem-solving. There’s nothing more fun than affecting somebody’s life in a huge way. We’re not the hotty-totty agents who are out in their high heels and on the golf course. We also have million-dollar properties, but we help a lot of people who have never lived out of a trailer to get into a home and we really teach them about building equity and getting their finances together and enhancing their lives. Baca: It’s also about buying smart, so when they call us a couple years from now we’ll actually be able to make them money. The last thing you want to hear is a repeat client call you when theyr’e ready to sell the property and they didn’t buy smart enough so they don’t have enough equity to be able to sell without writing a check. Also, a lot of first-time buyers have a hard time seeing past the little things, like the paint and carpet that looks beautiful in the staged model. But if you buy a bank-owned that might have some ugly carpet and a few other problems, we help the client find good contractors to help them fix it up. What’s your take on the market outlook? G-Scott: We’re gradually heading back up, and that can be a good five, seven years to get back to where we were.

Darlings, Here it is, almost Halloween, and I still haven’t lost those 20 lbs. so that I can fit into my Xena Warrior Princess outfit. I guess I may have to settle for my sterling silver breastplate over a flowing black gown. Hubba hubba. If only I were disciplined enough to plan ahead. Discipline. Gumdrops, that’s what Judy Garcia (office manager at the Sotheby’s Palace Ave. office) has. She might disagree. She might think it’s just longevity. But she’s been taking care of us in the real-estate biz for more than half of her life. How can that be, you’re asking yourself (and me)? She looks so young in her picture. You’re right, she is young, but she started when she was much younger. When most teenagers wanted to be goofing off after school, Judy, at 14, wanted a job, so she helped her mother, Dorothy Gonzales (personal assistant to Ray Rush and Tim VanCamp at Sotheby’s Washington office) at the now-defunct Town & Ranch Realty when it opened back in the previous century. In 2001, when Judy graduated from high school, turned 18, and no longer had to pay attention to child labor laws, she went to work full time at Santa Fe Properties. In 2005, she moved to Sotheby’s where she worked with the famous Linda Varela (office administrator, Washington Ave. office), who taught Judy to say the two magic words, “No problem,” to every request a Realtor might come up with. (Oh, those prepositions at the ends of sentences!) Then, in August, Judy was promoted to office manager at the Palace Ave. office. Judy exemplifies what our office managers do to make our lives easier, saner and more orderly. She has the discipline to stay in there and remain cool, calm, and collected while we have our meltdowns. Kittens, in thinking about Judy, I wish that weren’t her very own

long, black hair, because otherwise I could borrow it for my Xena outfit. In addition to Halloween, the other main event this month (aside from Yom Kippur, Thanksgiving Day in Canada, and United Nations Day) is the Richard Jay ALS Research Golf Tournament and Benefit Dinner at Marty Sanchez Links de Santa Fe on Friday, Oct. 17. Because Richard is one of Santa Fe’s most beloved Realtors, the SFAR’s Community Services Committee planned this event to honor him and to funnel all the proceeds from it directly to the ALS Research Foundation of New Mexico. Tee time for the golf tourney is noon, and the buffet dinner is served from 5:30 to 7:30. In addition to various prizes for the golf tournament, there will be a silent auction. Tickets are $125 for golf, dinner and auction, OR $50 for the dinner and auction. Pumpkins, I think I’ll hang around the golf course to see if anyone wins the Hole-InOne prize of a brand new car donated by Furry’s Buick GM (can you believe it??) and I know I’ll be there for the dinner because there are several items I want in the silent auction. Leah first came to New Mexico from New York in 1975 while at CBS to work on a film project in Los Alamos (about author, Judy Blum, Lollipops, not about nuclear energy). Naturally, as a visual artist (film, video, photography and digital media), she fell in love with NM for all the reasons artists do, but it wasn’t until 1995 that she would return. Recently, she has put real estate on the back burner and is letting her right brain take charge while she utilizes her drawing, photography and imaging techniques to produce stunning contemporary landscapes in 2D. You can see several

of them at Chiaroscuro Contemporary Art Gallery on Canyon Rd. Cupcakes, I just hope my sharing this with you won’t push us into a bidding war at Richard Jay’s event. Wally Sargent, man on the run, is living proof that old Realtors never die, they just book longer cruises. Because Wally gets it: life is a cabaret, my friends. Regarding ‘emerging contaminants’ Emerging contaminants are chemicals that have been detected at trace levels in drinking-water supplies (but not in Santa Fe, to my knowledge) and for which the risks to human health are not established. Included in this category are human and veterinary drugs, OTC drugs, natural and synthetic hormones, personal-care products, endocrine-disrupting compounds, herbicides, pesticides, and fire retardants. What is actually “emerging” about these contaminants, which have been present in our water as long as people have been using these products, is our developing contaminant awareness made possible by advances in analytical detection. For some consumers, the potential presence of such contaminants in drinking water adversely affects their confidence in water safety because there are no testing or reporting requirements for unregulated contaminants. These compounds are measured and expressed in parts per trillion, whereas constituents in water are typically expressed in parts per million or parts per billion (representing higher concentrations). Attention was drawn to this topic after

publication of the 1999-2000 USGS inventory of 95 chemicals in 139 streams in 30 states. Steroids, non-prescription drugs, and insect repellant were the chemical groups most frequently detected, while detergent metabolites, steroids, and plasticizers generally were measured at the highest concentrations. (A useful resource is the USGS Toxic Substances Hydrology Program website, http://toxics.usgs.gov/ index.html. Water-quality contaminants may enter a municipal sanitary system or a home wastewater (septic) system, become concentrated, and subsequently enter surface waters and aquifers. Other sources of contaminants are industrial discharges, agricultural runoff, concentrated animal-feeding operations, spills, landfills, and roadside dumping. In many cases, the detection of contaminants in the water is actually easier than identifying the point sources. The EPA database includes more than 200 contaminants of emerging concern. At trace concentrations, they are not currently regulated as either health risks or chemicals of aesthetic concern (affecting

water taste, odor, color), but they are being monitored because of consumer preference and demand that they not be present in public water supplies. Wastewater-treatment plants and residential septic systems are not able to effectively remove emerging contaminants (if present). So what is being done with respect to regulatory measures to monitor emerging contaminant occurrence and to assure their removal? To meet the need for a separate standard for product testing, National Sanitation Foundation International (NSF) worked with regulators and industry experts to finalize NSF/ANSI (American National Standards Institute) Standard 401: Drinking Water Treatment Units – Emerging Compounds/Incidental Contaminants. NSF is an independent public health organization that certifies the safety of materials used to convey, store and treat potable water as well as the performance of water treatment equipment. NSF/ ANSI have developed analytical criteria and certified devices for reduction of 15 emerging contaminants in Standard 401. You will probably recognize some of the

contaminants on the list, including DEET, Ibuprofen, Estrone, and Bisphenol A (BPA). NSF/ANSI Standard 401-certified devices are not yet widely available. If emerging contaminants are of great concern to you, the best drinking water protection in the interim is from granulated activated carbon (GAC) adsorption combined with reverse osmosis. Designer ShowHouse a benefit for kids By Paul Weideman he second annual Designer ShowHouse, where the public can tour a standout home dressed up by many of Santa Fe’s best interior designers, will be held on two weekends in October. Organizers hope to raise tens of thousands of dollars for Dollars4Schools and for the Lensic Performing Arts Center’s children’s programs. The inaugural event in 2013 raised some $21,000 for Dollars4Schools, which helps local schoolteachers buy supplies. “This is a website where teachers can list what they need, and these requests are only for $50, $100, $200,” said David Naylor, ShowHouse Santa Fe partnership coordinator. “This is for art programs, music programs, and P.E.” “And basic supplies to decorate their rooms, to do bulletin boards,” said Lisa Barker. “All of that has been cut back and teachers have been using their own money.” Barker Realty/Christie’s is a major underwriter of the ShowHouse at Casa La Luna, 10 Altazano, off of Old Santa Fe Trail. In 2013, a dozen designers prepared rooms in a house of 3,000 square feet. This year, 19 designers are working their magic in 19 different rooms in a house of nearly 16,000 square feet. (Stephanie Duran, Barker Realty/Christie’s, currently is listing the house on 10 acres for $5,850,000.) The ShowHouse theme is “Ancient Futures.” “All of the designers have their own personalities and their own approaches, but what we’re seeing is so cohesive,” Barker remarked. Naylor said the designers have been working with metallic colors — “bronzy silvers and coppers, and the one color that’s being featured, in, say, the entry, the pool area, and the butler’s pantry, is a great shade of peacock blue. “Were also having a boutique in the house, and all the furniture is for sale; that also will beneift the nonprofits.” Touring the 19 rooms promises to resemble a museum experience. “Our designers have gone to tremendous expense to put these rooms together,” Barker said in mid-September. “Every time I’ve been to the house, I’ve seen electricians, painters, faux-finishers. And I’ve seen amazing camaraderie and collaboration among these designers.” “That’s what happens when people have a higher purpose,” Duran added. Facebook has changed the world Facebook began as a way to connect with college friends and then as a way to reconnect to old friends. It has grown from one million users in college dorm rooms in 2004 to over 1.23 billion people around the globe in 2014. Marshall McLuhan believed that “we shape our tools and thereafter they shape us.” The ways in which we have been affected by social media are becoming more important than the tools we use to communicate with each other now in real time. Think of the ways Facebook has changed the way you communicate, socialize, and do business. Our instant online social web of friends and family is now connected to our neighbors, customers, acquaintances, friends of friends, LIKES, and the public. This has changed more than we know or even imagine. More than other social-media sites, Facebook has reshaped the way we make friends and meet customers and support each other. It has transformed the way we consume news and in real time

Going from HERS to WERS In the 1980s, the energy rating of appliances became the law of the land. Consumers could consult the little yellow sticker on appliances for help deciding between the least to the most energy-consuming appliance. This simple sticker worked. The least efficient appliances quietly exited and more energy-efficient ones entered the market. In 2005, the Home Energy Rating System (HERS) was developed nationally with direction from Fannie Mae and Freddie Mac to provide uniform, reliable, unbiased information to homebuyers, sellers, Realtors, and the mortgage industry about the energy efficiency of homes. Since then, the HERS index has become the industry standard. The independent organization that maintains the HERS Standards and certifies professional energy auditors is the Residential Energy Services Network (RESNET). The projected HERS ratings give homeowners and builders an estimate of what a home’s efficiency will be after completion of construction or improvements. Manu-

facturers and builders competing to build the most energy-efficient products and homes use this tool. The rating provides a comparison of the home being tested to a home built to the 2004 International Energy Conservation Code. A home equal to the 2004 code would have a rating of 100. An older, less efficient home may have a rating of 145, which means that home is 45 percent less efficient than that standard. A newer, energy-efficient home with a 60 rating is 40 percent more efficient than the 2004 code built home. Build Green New Mexico uses the HERS Index to rate new housing construction across the state. To qualify for this program, homes must be rated by third-party auditors. New Mexico is now viewed as one of the leaders in building energy-efficient homes. This has created a whole new industry and additional jobs in the state. One company is now exporting talent to other states to assist them in training and auditing new construction. The City of Santa Fe’s mandatory Green Building Code requires HERS ratings,

and soon Santa Fe County will, too. Most houses on the recent Parade of Homes listed the home’s HERS score. The lowest rating was 13! HERS is a fact of life here. Local hardware merchants are carrying the latest and greatest energy saving devices. Realtors have familiarized themselves with HERS. Santa Fe Community College trains and certifies HERS raters; in fact, SFCC is the only RESNET-accredited training organization in the state and has trained more than 50 raters. There is a movement afoot to create a similar index for water: the Water Efficiency Rating System (WERS) index. (In full disclosure, I am one of the folks working on this.) WERS would provide a tool for consumers and builders to compare the water efficiency of homes. It is hard to believe almost 40 years after the introduction of the little yellow appliance stickers that there is still no simple way to judge a house’s water efficiency. If history is any indication, giving this tool to builders and manufacturers will spur competition

and innovation, leading to purchases of more efficient homes and saving water for decades to come. One idea is to ask your local florist to use only U.S.-grown flowers — good luck, however, with the grocery and large chain stores. Some California-grown product is sold to these larger retailers due to its proximity to the Southwest, lowering the shipping costs, but it’s a numbers game that South American farms are always willing to outbid. Fortunately there’s another way to help keep the U.S. flower farmers in business that’s even closer than you think: your local farmers market. The Santa Fe Farmers Market not only has the freshest produce in town, it also has fresh flower vendors, quite a few of them. These are Locally grown color from Mountain Flower Farm

Another local flower vendor, El Jardin de Flores de Chimayo, shares its flower farm with chiles. Owner Marie Carter says she is in charge of the flowers, a job she really enjoys. Her growing season is the same and Marie likes to dry her flowers at the end of the summer and arrange them into attractive small bundles combined with sage and juniper. Her selection of zinnias is as colorful as it is bountiful. Other vendors like Mountain Flower Farm, of Cedar Grove offer diverse floral choices, but owner Anne Sommariva

says she starts a little earlier with peonies and false indigo. Mixed bouquets are her specialty. The Santa Fe Farmers Market has locations at the Railyard and on the Southside. Supporting the flower growers at these markets is the very best way you can keep your flowers local while helping a small business. Whether you start your shopping in early spring for tulips and daffodils, there is a steady selection that continues until the last mum is sold in the fall. If you do buy flowers in late fall and winter at other locations, be sure to ask where they are from. It’s the least we can do to support U.S. flower farmers. Although there are only three causes, there are many more permutations than one would guess that can lead to disaster. In the case of soils, for example, sometimes they swell when they are wet, but often they collapse; sometimes they shrink as they dry and sometimes they “flow.” When poor construction practices are thrown in we find footings without reinforcement, footings on non-compacted fill and, a classic, slabs that are poured with the steel mesh left lying on the soil underneath, rendering the floor unreinforced. For each of the various combinations we have a solution. Where water from the surface or sub-surface is leading to uplift in expansive soils, we can install redundant interceptor drains and, over time, dry soils out. In the case of collapsed soils, we can underpin with the elegant helical pier system. We can even use piers to support and sometimes level broken slabs. Many violating rentals rules In October of 2009, the city of Santa Fe created and enacted an ordinance limiting the use of residentially zoned property as it relates to rentals of less than 30 days. Some of the most restraining rules outlined in the ordinance include limiting the number of permitted properties to no more than 350 (properties legally able to rent for periods of less than 30 days), restrictions on occupancy (no more than 17 rentals annually), and most importantly accounting for and paying of all applicable taxes including lodgers tax. The ordinance further goes on to state that violations are subject to prosecution in municipal court. Since the inception of the ordinance, there is no record that the city has ever taken action against violators beyond simple warning letters. This lack of enforcement has caused the number of violators to skyrocket over the last year. Currently

[mid-September] there are more than 50 listings on Airbnb that are room rentals within a residentially zoned property for 30 nights or less. All such listings are in violation of the rental ordinance and are failing to collect and pay the applicable taxes. There are an additional 200 listings on the site for full private homes, the majority of which are not permitted or at the very least are not disclosing their permit. These individuals are taking great risks not only through noncompliance with the city ordinance and tax code, but with their insurance providers as well. Typical insurance policies have a clause that voids coverage if the home is rented in that manner more than one time per calendar year. In addition there are a number of permitted homes that are not collecting the lodgers and other applicable taxes from guests. This should be the most inexcusable aspect as it pertains to

violations of the ordinance as it affects every citizen of Santa Fe. These taxes are important to our community and efforts need to be made to ensure they are being collected and the rental ordinance is properly enforced. Lodger’s tax is used primarily by the city to market Santa Fe as a tourist destination and bring tourism dollars to town. Lodger’s tax is also used to help cover expenses at the Santa Fe Convention Center and the CVB, as well as a percentage that goes to the arts in Santa Fe. Gross receipts tax is the number-one revenue source to the city and is used to help maintain roads, police and fire services, parks, and much more. Individuals failing to collect such taxes are essentially stealing from our community. Furthermore this lack of enforcement has created an uneven playing field for those that operate within the terms of the ordinance and causes loss

Bee wise Despite the naysayers of the world who express doubt about all things in vogue, there are some trends that we hope never go out of fashion. Take yoga, for instance. Could there possibly be a downside to having more Santa Feans practicing yoga? Another emerging activity that is gaining popularity is backyard beekeeping. Once the exclusive domain of commercial honey producers and esoteric, reclusive types, beekeeping is gaining mainstream popularity. It may be simply a passing fad, or a response to the shockingly abrupt decline of bees. Dramatic decreases in bee populations in the wild have been recorded for nearly half a century. Experts attribute this to a combination of loss of territory and an increase in pesticides. Few alarms were sounded, however, because commercial beekeepers were experiencing normal losses and stable bee populations. But between 2006 and 2007 a phenomenon referred to as “colony collapse” began to decimate commercial beekeepers, resulting in losses of over 50 percent, and 52

European countries reported similar losses. This is significant because many food plants are dependent on honeybee colonies for pollination. No bees, no crops. Scientific and agricultural communities around the world mobilized to solve the problem and grassroots organizations took action as well and bee populations have been increasing. The secret methods of keeping bees are now widely disseminated over the web and among local beekeeping organizations like our own New Mexico Beekeepers Association. Bees and equipment can be purchased over the internet and delivered to your front door. The benefits of backyard beekeeping are many. It is a peaceful practice that promotes pollination and produces health-promoting products: honey, pollen, and beeswax. The Santa Fe County Assessor even grants an agricultural tax status to serious beekeepers. However, that office is wise to people trying to exploit the tax code by simply placing a few hives on a property for the sole benefit of receiving tax relief.

Not everybody likes bees and backyard beekeeping is not without criticism. For people allergic to bees, they can be a frightening sight and a single sting can cause life-threatening anaphylactic shock for some. The Santa Fe City Council occasionally discusses regulating beekeepers. In 2011, Councilor Carmichael Dominguez proposed regulations but received little to no support; the proposals were referred to as solutions to a problem that doesn’t exist. Santa Fe beekeepers are a well-organized and caring group that creates public awareness about beekeeping and its members are readily available to help anyone who wants to become a backyard beekeeper. Keeping Santa Fe’s bees free is a matter of common-sense practices by city beekeepers. Before placing beehives on your property, meet with the other area beekeepers for advice. Talk to your neighbors and find out if anyone in your area has bee allergies and make certain that you have enough space for your bees. It’s also

important to have your own water source for bees; otherwise they may hang out at your neighbor’s koi pond. With autumn upon us, our local bees are busy harvesting the last stages of fall bloom. Land sales up for new Las Campanas brokerage By Paul Weideman SALES ARE GOING WELL IN LAS CAMPANAS, according to Realtor Sandra Halpin. “We’ve sold nine lots, and we have five pending, in four months, which is pretty amazing. And we’re seeing that everybody who has bought is pretty actively getting ready to build, which was surprising to us. We thought they’d sit on them.” Halpin is the qualifying broker with Las Campanas Realty, a new company that began operations in May at the community’s commercial center at 218 Camino La Tierra. It’s a two-broker office; sales in the upscale development are handled by Nancy Zepeda. Their building also has office space for their preferred builders: Tierra Concepts, Woods Design Builders, and Zachary & Sons Homes. “We’re not associated with them financially, but we’ve vetted them and we can recommend them,” Halpin said. In four months, besides homesite sales, the realty has managed the sales of 43 resale homes — compared to 16 resales in Las Campanas in all of last year. Halpin pointed out that nearly two-thirds of those 43 resale homes were purchased for under $1 million. “So the perception that you can only get a house out here for $2 million is no longer true. There are plenty at $700,000 or $800,000.” And Sivage Homes, which is under contract to Las Campanas Realty, is 54

now building homes in an enclave named Las Melodias de Santa Fe that are priced from the mid-$400,000s. Las Campanas was derived from a 31,000-acre ranch owned by the Frank Bond family and purchased in 1960 by Zannie Garcia. During the 1980s, she sold 4,700 acres to the Lyle Anderson Company, which began developing the luxury master-planned community. Anderson spent more than $150 million building roads, putting in utilities, developing water agreements, and preparing the amenities, which today include two 18-hole Jack Nicklaus Signature golf courses, a luxuriously appointed clubhouse, a state-ofthe-art equestrian center, and a spa and tennis center. Lot sales began in 1992. Most of the development’s 1,717 homesites had been sold before the onset of the financial crash, although fewer than 700 owners had built homes on their lots. That number has not changed dramatically during the past six years. Anderson is no longer in the picture. Las Campanas Realty is owned by Las Campanas Residential Holdings. The developer, Cienda Partners, Dallas, bought 300-some lots, including in chunks of undeveloped parcels, with no infrastructure. The realty is launching 76 finished lots in five phases, and 23 are available right now. Halpin said the Scottsdale marketing group DMB Realty Network has contracted with the owners to do all their

pricing and development timing, and they’re spending $700,000 a year to bring new leads into town. “Most of our clients are from out of town and most of our leads come from the web, and they are amazingly qualified. The people who actually contact us are serious, and a good percentage ends up buying.” Most of the new homesites in the various Las Campanas enclaves are selling in the $100,000-$150,000 range. Prospective buyers can take advantage of a “Discovery Visit” to experience Las Campanas up close. “For $499, you get three days and two nights in a 2,100-square foot casita, a round of golf for two, a $100 gift certificate for dinner at the Club at Las Campanas, and they have use of the facilities there. This is possible because Cienda Partners owns two casitas.” Zepeda can show prospects what’s available on a large Bright Door computer display. “It’s like a giant iPad in our main room and you can take the client to Santa Fe and then to Las Campanas and to a particular lot. It mainly provides context,” Halpin explained. “The Club is a big part of it. They are the lure, because it’s a golf community. About escrow services in our state An escrow agent will provide that no funds or property will change hands until all of the terms and conditions have been followed. The escrow holder has the responsibility to watch over the funds and/or documents and then pay out the funds and/or transfer the title only when all requirements of the escrow have been completed. Escrow can be very confusing. Escrow can be a closing title agent or escrow officer or it can be an escrow company. The escrow companies in New Mexico manage seller financing for the sellers. Many real-estate contracts in New Mexico are managed by escrow companies. As of January 14, 2014, the Consumer Financial Protection Bureau has issued new rules for seller financing. A title company licensed to do business in New Mexico provides escrow services when closing a real-estate transaction. Escrow services are regulated in New Mexico under the title insurance law by the Office of Superintendent of Insurance.

There are requirements for providing services. All title-insurance underwriters and agents only accept funds pursuant to escrow instructions. They cannot solicit or accept any material addition to, or alteration of, original, amended, or supplemental escrow instructions, unless the addition or alteration is signed or initialed, or consented to in writing or by electronic transmission by the affected parties or their duly appointed agent or attorney in fact. Minor additions or alterations to escrow instructions may be solicited or accepted, if consented to, by the affected, provided a written memorandum of instructions is prepared and maintained in the escrow file. All escrow accounts shall be fiduciary (accounts managed by another) separate from all operating accounts, and designated as a fiduciary account, an escrow account, a trust account, or a custodial account on the account signature card and in the books and records of the title insurer or title insurance agent. When you receive

a check from a title insurer or title agent, verify the check is drawn on one of the designated accounts listed above. Title insurers and title insurance agents are prohibited from receiving for their own use, interest from escrow accounts or money accepted for escrow. They must disburse or deliver funds only in accordance with escrow instructions. They may disburse funds out of an escrow account only if the funds are available. If there are disputes or conflicts by parties to an escrow, the title insurer or title insurance agent cannot disburse funds until all parties consent in writing. Modern Home Tour open on Oct. 18 By Paul Weideman A HANDFUL OF SANTA FE’S NEW HOMES BOASTING CLEAN, CONTEMPORARY DESIGN — or at least contemporized variants of Santa Fe Style — will be open for touring from 11 a.m. to 5 p.m. on Saturday, Oct. 18. It’s the 2014 offering from Modern Home Tours. The organization, headquartered in Austin, Texas, also did tours last month in Houston, Vancouver, and San Diego, and plans the final 2014 tour on Oct. 25 in Denver. “Our Modern Home Tours give people a chance to explore and view some of the greatest examples of modern architecture right in their own city via self-guided driving tour,” according to company materials. “The tour offers participating homeowners the chance to show off their cool, modern dwellings to neighbors for a day; while local 60

architects get some much deserved time in the spotlight.” Local nonprofit partners are the Friends of Architecture Santa Fe and the Santa Fe chapter of the American Institute of Architects. In late September, Ken Shallcross, a Modern Home Tours vice president, said there were three confirmed homes for the Santa Fe tour, but he hoped there would be as many as six lined up by tour day. It’s right next door to another Oles design, the “Sundial House” at 1602 City Lights. It’s named for a figure the architect drew on an exterior wall near the entry; over the diagram, a protruding, black rod casts a shadow, accurately indicating

the solstices and equinoxes. He said it’s “a child of SketchUp,” referring to the 3-D modeling program in which he is proficient — although the diagram actually was plotted over a year’s time as he placed pins in the stucco during the significant solar moments. The house at 1602, sporting a fanned plan to open the home to the wonderful eastern vista, was built in five levels stepping down a steep lot. “This is the superior house, because it’s a superior site,” Oles said about 1600. “While 1602 has only about 41 percent on one level. 1600 has about 81 percent all on one level.” Inside, six risers lead up to the master suite and the only exception to the 81 percent. In the living room, he slides open glass pocket doors and we step onto a spacious, biconvex (lens-shaped) patio

that he calls “the heart, the point, of the house” and it offers great views of the city. The integral-color concrete floor continues from inside to outside. “It’s completely right, it’s the right notion of minimizing the differences between in and out,” he said. On the patio, a feature wall by Kevin Avants has a neat pattern in sandstone rectangles. Also catching the eye in this LEED “Silver” house is the kitchen’s elegant cabinetry (pickled oak) and a large photo of the Louvre disguising the flat-screen television. There’s a basement he admits is “a New England conceit.” On one wall is a 12-footwide print of a onetime plan for a Bill Gates house. The tour is self-guided, with the help of a map and GPS (if you have one). Tickets are $30 in advance and $40 on the day of the tour. Kids under 12 are free.

On Wednesday, Oct. 15, Friends of Architecture Santa Fe opens Truth in Architecture, an exhibition of drawings by Paul Stephenson “Steve” Oles, cofounder of the American Society of Architectural Illustrators. Oles, a longtime Santa Fe resident, earned a bachelor of architecture degree from Texas Tech University and his master’s in architecture at Yale University. He went on to work for many years with I.M. Pei, and to teach at Rhode Island School of Design, Yale, MIT, and Harvard; as well as publishing Architectural Illustration: The Value Delineation Process (1987). Today Oles is a devotee of SketchUp, the 3-D modeling program that has a freeware version. The company selected him to be its SketchUp avatar for the next release in 2015. SketchUp is also in the process of doing a promo video that was made during a couple of days at his house at 1600 City Lights. The exhibition at 217 E. San Francisco Street will display about 50 Oles drawings, including 17 originals. Among them is a drawing of the Ronald Reagan Building

and International Trade Center in Washington, D.C. The architect told a story involving Lensic Performing Arts Center founding director and chairman Nancy Zeckendorf and architect Craig Hoopes, who did the 2000-2001 renovation of the Lensic. “Nancy is one of the exhibition supporters, thanks to Craig. He asked me, ‘Did you do a drawing for Pei of the Ronald Reagan Building?’ I didn’t know. I couldn’t even remember that name, but I recalled that it’s in the Federal Triangle in Washington. So we got busy. We went to the Pei office and they found the negatives and this is going to be in the show. Nancy’s late husband, Bill, was one of the building’s developers. I was thinking: Bill’s father made I.M. Pei. No question. It was a totally pure thing. Pei was in in his 20s, just out of school, and William Zeckendorf said, ‘I have a lot of work I want you to do.’ Zeckendorf made Pei and Pei made me.
