4 Local Operating Procedures BSEP

Any comments provided by the Registered User pursuant to paragraph 3.3(b) may be shared by the Operator with the Delivery Facility Operator as the Operator seeks to agree on the proposed amendment.

3.4 Where a proposed amendment under paragraph 3.2(b) may, in the sole opinion of the Operator, have an impact on any User or any other party, the Operator:

(a) shall inform all Users and provide relevant information about the proposed amendment and the nature of the potential impact; and

(b) ask such Users to provide any comments within 10 Business Days on the proposed amendment.

Any comments provided by the Registered User pursuant to paragraph 3.4(b) may be shared by the Operator with the Delivery Facility Operator as the Operator seeks to agree on the proposed amendment.

3.5 Once the outcome of a proposed amendment under paragraph 3.2(b) has been determined, where the Operator requested comments from a Registered User under paragraph 3.3, or all Users under paragraph 3.4, the Operator shall provide a report on comments received and the outcome of the proposed amendment to such Registered User or all Users respectively.

4 Local Operating Procedures BSEP

4.1 For the purposes of the Code in respect of a BSEP, “Local Operating Procedures” in respect of a BSEP are procedures for coordination between the Operator and the Delivery Facility Operator in connection with the operation of the Biomethane Delivery Facility and the System including:

(a) the exchange of information between the Operator and the Delivery Facility Operator;

(b) provisions for the closure of the remotely operated valve in the event of excursion from the required gas specification including the acceptable range for calorific value.

4.2 A Network Entry Agreement may contain Local Operating Procedures.

4.3 Local Operating Procedures may provide for the Delivery Facility Operator to provide information to the Operator as to the rates at and quantities in which gas is expected to be delivered to the System at the BSEP and such information may be relied upon by the Operator in the operating and planning of the System.

4.4 Except with the prior written consent of the Delivery Facility Operator, the Operator will not, and will not be required to, provide any information provided to the Operator under any Local Operating Procedures to any User.

4.5 Local Operating Procedures may provide for the Delivery Facility Operator and the Operator to agree at any time (in such circumstances as may be set out in the Network Entry Agreement) the
