8 Delivery of gas, title and risk
(i) the Day or Days on which non-compliant gas was delivered to the System;
(ii) the total quantity of non-compliant gas referred to in paragraph 7.2 and reasonable details of the respect(s) in which the non-compliant gas did not comply with the applicable Gas Entry Conditions;
(iii) reasonable details of the costs and expenses referred to in paragraph 7.1 and the purposes for which they were incurred; and
(iv) each Delivering User's Delivery Proportion.
(b) the amount payable by each Delivering User shall be invoiced and payable in accordance with Section K.
7.4 Any dispute as to anything specified by the Operator under paragraph 7.3(a) shall be referred to Expert Determination.
7.5 Paragraph 6.5 and this paragraph 7 do not apply and Delivering Users shall not be liable thereunder to the extent that the failure (of gas delivered or tendered for delivery) to comply with Gas Entry Conditions was a failure to comply with a requirement as to pressure; and references in those paragraphs to non-compliant gas shall be construed accordingly.
7.6 Where for the purposes of clearing non-compliant gas from the System delivered at a given System Entry Point it is necessary for the Operator to vent gas from the System, each Delivering User's Delivery Proportion of the quantity of gas so vented shall be determined with reference to the relevant formula under paragraph 5.2 pro-rate to the quantity vented and treated as having been offtaken from the System and accordingly deemed to be a part of the UDQO of the Delivering User under Section D paragraph 2.1; and in such circumstances the Operator will inform all Users as soon as reasonably practicable after such venting.
8 Delivery of gas, title and risk
8.1 The applicable Network Entry Provisions will identify (by description or diagram or both) the point of delivery at a System Entry Point.
8.2 Title and (without prejudice to any other provision of this Section G) risk in gas delivered to the System shall pass to the Operator at the System Entry Point.
8.3 The quantity in which a User shall be treated as having title and risk to gas delivered at a TSEP shall be determined as a User’s final TDQD at that TSEP in respect of a Day.
8.4 The quantity in which a User shall be treated as having title and risk to gas delivered at a BSEP shall be determined as a User’s final BDQD at that BSEP in respect of a Day.
8.5 To the extent that it is necessary to determine, in respect of a Gas Flow Day where a User’s BDQD is greater than its final DN Exit Allocation (and its TDQD is therefore a zero under Section D paragraph 3.2) such User shall be treated as putting gas into the NI Gas Transmission Network at the TSEP. The quantity for which the User is treated as transferring title and risk to the gas in the NI Gas Transmission Network as a result of this provision shall be determined as the quantity which is the difference between its final BDQD and its final DN Exit Allocation.
8.6 Each User warrants to the Operator:
