Under new rules, agents working with buyers will be required to enter into a written agreement outlining the relationship and compensation.

YOU’VE LIKELY HEARD ABOUT THE SETTLEMENT reached with the National Association of Realtors® (NAR) and how buyers should both work with and compensate their agent. New rules pending court approval would create additional transparency and could alter the way some deals are put together. As your trusted agents, we feel it’s important to help answer some of the most frequently asked questions you might have regarding this settlement:

What is the biggest change for buyers?

Agents working with buyers will be required to enter into a written agreement, outlining the relationship and compensation. Previously this was optional.

Will it make buying a home more expensive? The settlement does not fundamentally change the cost associated in working with an agent. The changes would simply create more transparency around compensation.

Will it affect the price of a home?

No. Home prices are determined by market supply and demand. Traditionally, the commission for both the seller and buyer side has come out of seller’s proceeds and

been included in the “overall value” of the home. Moving forward, some sold prices will include buyer’s agent compensation— and some may not—if the buyer pays out of pocket (like comparing apples to oranges so this one will be tricky from an appraisal and comparative value perspective).

Will the seller still have the option of offering compensation to the buyer’s agent? Yes! This will be a way for sellers to appeal to a segment of buyers who’d rather include their agent’s compensation in the price of the home so they don’t need to use liquid resources (meaning sellers can simply factor that into the price they are willing to sell for; it’s a win-win and they net the same amount).
