Breuder is out, audit upcoming and reimbursements suspended at COD By NATHAN LURZ nlurz@shawmedia.com The College of DuPage could be on its way to a Clean Slate, but the cleaning may not come too easy if the new Board of Trustees’ second meeting April 30 is any example. The board includes three new faces after the April election – Deanne Marie Mazzochi, Frank Napolitano and Charles Bernstein – united under a shared platform of reform and behind newly selected Chairwoman Kathy Hamilton. With the majority of the seven-member board on lock, the four pushed through an aggressive special meeting agenda the three remaining trustees consistently voted against, citing a lack of transparency and inclusion in its drafting.

leaked email in July 2014 that advised trustees to find “politically attractive” ways to spend $20 million in state funding promised to the school. His tenure was later punctuated by the board’s approval of a nearly $763,000 buyout for his early retirement in March 2016 and several DuPage County and federal subpoenas looking into his on-campus spending and that of trustees and administrators under his watch. Breuder beat the board to his proposed ouster, announcing April 28 he would be taking medical leave, but trustees still put him on administrative leave with pay during the meeting. New college attorney Tim Elliott, who also serves as a Glen Ellyn village trustee and has been involved in cases against the college twice in the past year, said the move gave the board control over the timing of Breuder’s return. Audits and legal action The board also moved on several looming issues regarding legislation and legal action against the school April 30. After months of foot-dragging, trustees authorized a state-run audit of the school’s finances from 2009 to 2014 by the Illinois Auditor General’s Office. Earlier this year, several members of the General Assembly asked for the audit, including state Rep. Jeanne Ives, R-Wheaton. Ives originally gave the college a March 12 deadline to accept terms for an audit dating to 2011 and agree to pay for the estimated $144,000 to $234,000 project. The board also authorized an internal investigation into the college’s accounts April 30, directed staff to provide the board and college’s client files from several law firms, and formalized a litigation hold in light of the federal investigations against the school. Additionally, it hired new temporary legal counsel – Elliott’s Rathje & Woodward and Schuyler, Roche & Crisham – for the board. Both were retained to guide the board during the next four months, although the three old guard trustees questioned the latter’s hire, as one of its attorneys, Dan Kinsella, represented Hamilton after the board censured her last year.

The board has previously received criticism about lavish spending accounts held by Breuder and trustees, including several thousand dollars spent at campus restaurant Waterleaf, but it moved April 30 to suspend all travel and entertainment reimbursements for trustees, as well as all “house” accounts on or off campus. When several trustees voiced concern, particularly student trustee Gloria Roark, Hamilton said the board would evaluate each case individually and that it represented a stop until the board looked over its policies. The board also hired a transition team led by Donald Haider, professor of strategy at the Kellogg School of Management. The team will guide new board members and possibly interim administrative leadership through the legal action against the college and recommend ways to improve operations and governance. Hamilton said she was already looking at filling it with volunteer local stakeholders from across the district.

What some believe to be a new era at the College of DuPage started off with a rocky first few votes April 30. The Board of Trustees chose a new chairwoman, vice chairwoman and secretary – all affiliates of the triumphant Clean Slate candidates – during its organizational meeting. All three votes were passed 4-3, split each time between the new majority reformers and the old guard of previous Chairwoman Erin Birt, Joseph Wozniak and Dianne McGuire. “The College of DuPage has been through tough times, times marked by extended and continuous denial,” Hamilton said. “Those troubles are not yet over, but the causes of those troubles are. This institution faces criminal investigations, legislative disdain and alienation from constituents.”

She said Rauner “inherited a big problem” requiring some deep cuts but was confident the task force would be able to create enough flexibility for the state budget, local municipalities, school districts and agencies that depend on state funding to mitigate some of the pain. She said removing or restructuring unfunded mandates would especially play a big role in the future of state finance under the Rauner administration, opening bodies of government up to spend money addressing their unique needs. “I think we all understand as Illinoisans that we all have to go on a fiscal diet – we get it,” she said. “Right now, we just need to create room so that our local bodies could make the decisions they need to make.” The task force recently conducted a slew of meetings through the state including stops in Springfield, Wheaton, Bloomington-Normal and Carbondale. She said the task force would “avoid a one-size-fits all approach” and consider each body and case individually to cater to each community’s specific needs. She said Rauner is serious about listening to the suggestions and expected it to be a key part of the financial picture moving forward. “This is not the first study of its kind when it comes to units of government,” she said. “Prior administrations have conducted these studies, and then nothing happens with them.” Missey Wilhelm, president of the League of Women Voters of Wheaton, said the nonpartisan organization wanted to hear Sanguinetti’s thoughts on the matter to help inform its members. Later this year, she said she hoped to draft a motion at the league’s statewide conference to help its members around Illinois navigate supporting specific consolidation projects – such as the possible consolidation of the DuPage Election Commission. “Don’t make up numbers, don’t project it based on future numbers,” she said. “Leagues throughout the state of Illinois, when they’re looking at consolidating units of government whatever they may be or dissolving units of government, the leagues can then advocate for or against them.”

Last year, the practice of union release time was found to be unconstitutional in Arizona. Maricopa County Arizona Superior Court judge Katherine Cooper ruled release time violates Arizona’s gift laws, which stipulate public funds cannot be used for private purposes. The Illinois Constitution has a similar provision, but the issue of union release time has not been litigated in the Land of Lincoln. “Like 40 other states, we have a gift clause in our constitution that just says government cannot give gifts or subsidies to private entities or corporations,” said Jon Riches, an attorney with Goldwater Institute, which successfully challenged the release time practice in Arizona. He said tax dollars must serve a public purpose. “And when you think about it, release time doesn’t even do that. When someone is negotiating at the bargaining table, they are the exact opposite – they are adverse to the government,”

In Glen Ellyn, where Holan lives, the Glenbard Township High School District 87 provides two-fifths release time to Tully, who earns $121,363 as a driver’s education teacher. The union receives the benefit of 40 percent of his salary or $48,545. “I do think there is value to having a full-time release person,” Schaumburg School Superintendent Andrew DuRoss said. “This is something that is negotiated into our contract. We have an excellent relationship with the union. I think having a good relationship with the union is of great value to the students and families of this township.” Schaumburg Education Association President Paul Beranek receives a salary of $106,989 plus benefits from the school district but works full time for the union. The union in turn reimburses the district for $45,191 leaving taxpayers on the hook for $62,798. Beranek declined comment for this story. At a time when school districts are facing cutbacks, questions are being asked whether this is the best use of taxpayer resources. “I think this would absolutely outrage taxpayers,” Holan said. “But I don’t think most taxpayers have any idea this is actually going on. There is

SPRINGFIELD – Imagine paying a teacher $121,363 not to teach. That’s what taxpayers in the Glenbard Township High School District 87 and other local school districts are doing. A practice called release time, in which government workers are paid a taxpayer-funded salary not to serve the public but to do union work, allows teachers to often collect a six-digit salary plus benefits to be president of the teachers union. In many cases, the school district employee that is granted release time forgoes several to all of their teaching responsibilities, instead serving as union president. But it is taxpayers – not union members – who pay her salary. The practice it is becoming increasingly common in the Chicago suburbs. The reason? Unions are demanding this perk at the bargaining table and it is being incorporated into school district labor agreements. “This is a plague on local, state and the federal governments,” said Trey Kovacs, an analyst with the Competitive Enterprise Institute in Washington, D.C. “Something that gets
under-reported is that these union presidents or vice presidents, who are 100 percent release time, are normally getting all of their benefits paid by the taxpayers, too, and they are also getting a pension.” The primary reason school boards agree to these provisions is to ensure labor peace, he said. But Tom Tully, president of the Glenbard Education Association, said the release time he receives enables him to work more collaboratively with school administrators. “I work on curriculum issues, evaluation issues and hear concerns from teachers,” he said. “That saves the human resources department a lot of time. I like to think by working collaboratively we are able to help taxpayers by coming up with ways to be more efficient.” But not everyone in Glen Ellyn views the release time as a benefit to the taxpayers. “This is just shocking. There is no reason taxpayers should be paying for the costs of a private entity like a union to administer itself. And that is what you are essentially doing,” said Heidi Holan, a Glen Ellyn resident who made an unsuccessful bid for the state legislature last year.

While the visitors from New Jersey were without all of their World-Cupbound players, the home match served as the Send-Off event for five of the eight Chicago stars who will be competing in this summer’s tournament in Canada. The Red Stars put pressure on their opponents early and created the first close look in the 5th minute, as defender Taryn Hemmings sprinted up the right wing and sent a dangerous ball to the far post. Teammate Vanessa DiBernardo was unfortunate to see her header from a tight angle sail just over the frame. A mere four minutes later, the hosts’ aggressive approach nearly paid off, DiBernardo coming close to stripping goalkeeper Brittany Cameron of the ball for what would have been a certain tally. Chicago had its next quality chance moments later. Former Virginia standout Colaprico sent Lori Chalupny down the left and the 31-year-old’s centering pass seemed destined to be tapped home at the doorstep. Instead, it evaded both defenders and attackers, trickling just wide of the far post. Red Stars striker Christen Press, who came into the game as the newly crowned NWSL Player of the Month for April, had two opportunities to open the scoring in the 18th minute. After her left-footed attempt from 20 yards out forced a diving save, Press got back on the ball and fired just high from inside the penalty area. She caused havoc once again halfway through

elementary schools in Palatine, Rolling Meadows, Inverness, Hoffman Estates, Arlington Heights, Schaumburg and South Barrington. Nuss, a school librarian who earns $93,254 is released 100 percent of the time but the union only reimburses the district for 50 percent of her pay. Nuss did not immediately respond to a request for comment. “Clearly this only benefits the union,” Kovacs said. “This in no way helps students or taxpayers.”

about transparency and future policy changes and a heated awarding of certificates of appreciation for Savage and Svoboda. The certificates thanked the two for their service, as well as that of outgoing student trustee Omar Escamilla. Savage and Svoboda both spoke during the meeting, thanking those they worked with during their six-year terms and saying they were grateful for their time in office. “It has been an honor and privilege to serve as a trustee of the College of DuPage for the past six years,” Savage said, touting progress made in recent years. “I will always hold the college,
the people of the college in my heart and in high regard, as you do amazing work in the community.” Hamilton said she admired those who participate in public service and said the sentiment of gratitude should be honored, regardless of controversy surrounding the school. However, the meeting turned heated when Mazzochi asked whether passing the resolutions of appreciation was legally binding in any ongoing investigations. Both Wozniak and Birt bristled at her inquiries during what was supposed to be a moment of recognition. Birt said Mazzochi was “completely disrespectful” and Mazzochi was “showing [her] colors.” Savage and Svoboda both left during Mazzochi’s questions before the official vote.

This season, he is the unquestioned pitching ace for the Panthers. Orze continued his outstanding season on the mound Saturday, throwing a five-inning no-hitter in a 10-0 victory against Wheaton Warrenville South. That performance helped Glenbard North take two of three contests from the Tigers and move into a first-place tie atop the DuPage Valley Conference standings. Orze said he had no idea that he had

thrown a no-hitter, even after registering the final out. He struck out the side in the fifth to finish with nine strikeouts. “Coming off the field, the guys were screaming ‘no-no’ and I was like, ‘What are you talking about?’” he said. “I honestly had no idea what was going on.” An explosive offensive performance for the Panthers helped boost Orze in his bid for the no-hitter. “By far that was our best hitting day,” said Orze, who has given up only seven earned runs in 43 innings this spring. “It was good to see all the guys one through nine smoking the ball. That made my job really easy, just go out there and throw strikes. Like my coaches always say, keep the ball down
and keep your composure.” Glenbard North coach Rich Smelko has gotten used to solid performances game in and game out from his senior right-hander. “Obviously, Eric is our best and he threw a tremendous game,” Smelko said. “We also had a great approach at the plate and hit a lot of balls hard.” Luke Greenberg paced the offense with a 3-for-3 showing at the plate which included two triples, a double and three RBIs.
