ed. That board then failed to rule on the merits of those codes after a tied vote. The four Republicans on the board voted the committee violated election code, while the four Democrats voted there wasn’t enough evidence to do so.

Members of the board voting against violations suggested they did so because the campaign didn’t realize it was making the missteps.

Appellate judges ruled Monday the Board of Elections voted in error regarding the committee’s practice of not using mileage reporting to reimburse person vehicle expenses.

The court’s ruling states the campaign committee did not own or lease any vehicles and made expenditures to Happy’s for gas and vehicle repairs. This evidence was clearly sufficient, according to appellate judges.

The court also ruled the committee’s expenses were paid

for beyond a fair market value.

Schwab argued when expenditures are not paid by an exact measurement such as reported mileage, it stands to reason some of the gas goes for personal use, because a whole tank of gas wouldn’t be used exclusively for campaign activities, he said.

“Without needing to consider any possible adverse inference from Mautino’s refusal to testify, we find the manner in which the committee paid for travel expenses over a 15-year period inevitably led to at least some portion of the cash being used for personal purposes,” the appellate judges stated.

“By making expenditures to withdraw cash used for personal purposes, the committee made expenditures in excess of fair market value for what it received in exchange, which was nothing.”

The court also noted it was a violation to take money from the bank for travel expenses specifically.

SPRINGFIELD — Two years after an initial elections complaint, an Appellate Court ruled Aug. 19 former state Rep. Frank Mautino’s campaign committee further violated election codes.

The ruling stated the committee’s expenses at a bank and at a Spring Valley gas station for gas and repairs of personal vehicles were violations.

Mautino had no comment, according to Ryan Keith, his spokesman in the matter.

Election code states gas and repairs of personal vehicles should be reimbursed through mileage reporting, and should not exceed fair market value. Between 1999 and 2015, the campaign committee reported $225,109.19 in expenditures to a Spring Valley gas station for gas and vehicle repairs.

“Now it’s clear to any candidate in Illinois the way to handle vehicle expenses is through mileage, you can’t just fill up people’s gas tanks,” said Jeffrey Schwab, an attorney at the Liberty Justice Center, representing Streator resident David Cooke, who brought forward the appeal.

The appellate court said the Board of Elections must now consider further fines. The now-defunct committee was fined $5,000 in May 2017 by the Illinois Board of Elections for failing to produce records. The fine has not been paid, as the committee has disbanded.

Regardless of how the elections board rules on fines, Schwab said

the ruling was a victory. He said the appeal wasn’t about fines, so much as setting a precedent for political campaigns and rooting out the potential for corruption.

Mautino, of Spring Valley, now the state’s auditor general, represented LaSalle County as a Democrat in the Illinois House of Representatives for nearly a quarter century, until resigning to become auditor general in December 2015. The appointment to the post, which serves as a watchdog for the state’s tax dollars, is for 10 years.

The case went before the Illinois Fourth District Appellate Court in Springfield last month; the Illinois Board of Elections has avoided making findings in the case in respect to gas and vehicle expenses.

Vistra Energy to close Hennepin Power Plant

Four coal-fueled sites in Illinois will be shut down to meet pollutant standards; 60 jobs to be lost locally

BY DAVE COOK news@tonicanews.com HENNEPIN — Hennepin residents and the rest of Putnam County learned Aug. 21 that the 66-year-old Hennepin Power plant, operated by Luminant, a subsidiary of Vistra Energy, will be closed, resulting in the loss of approximately 60 jobs.

If all goes according to plan, the 294-megawatt plant could cease operations by the end of the year.

“This is sad news, it’s a real blow to our area, and I’m worried about their employees,” Hennepin Village President Kevin Coleman said Aug. 21 at the Hennepin Village Board meeting.

“This will be bad economically for the entire Illinois Valley,” board member Quentin Buffington added.

According to the company’s website, Vistra Energy and its subsidiaries have announced four coal-fueled electrical-generating plants, including Hennepin, will be retired in order to meet the requirements of the recently approved revisions to the Multi-Pollutant Standard (MPS) rule imposed by the Illinois Pollution Control Board (IPCB).

Without this rule change, according to the release, the company’s entire downstate fleet was at risk of near imminent retirement. The company will close the following plants in Illinois: the Hennepin Power Plant, the Coffeen Power Plant, the Duck Creek Power Plant in Canton and the Havana Power Plant.

Approximately 300 jobs will be eliminated across the four plant sites. Vistra is providing outplacement services and working with state workforce agencies to assist the employees impacted by the closures.

Closure ‘inevitable’ “Even though today’s retirement announcements were inevitable due to the changing regulatory environment and unfavorable economic conditions in the MISO (Midcontinent Independent System Operator)

market, they are nonetheless difficult to make,” Curt Morgan, Vistra’s president and chief executive officer, said.

“By far, the hardest decisions we make in our business are those that significantly impact our people. As always, we will do right by those who are impacted by this announcement. Our employees take pride in the work they do, and we appreciate their decades of service providing reliable and affordable power to Illinois, particularly in years like this one with periods of extreme cold and heat,” Morgan said.

The four plant retirements are required by the revised MPS rule, which regulates emissions at eight power plants operated by Vistra subsidiaries.

The revised rule, which also calls for a reduction in annual mass caps for sulfur dioxide and nitrogen oxide, requires the company to permanently shut down 2,000 megawatts of capacity from the eight MPS group of plants by the end of the year, pending approval by grid operators, MISO and PJM Interconnection, and approval of the termination of certain tariffs by the Federal Energy Regulatory Commission.

In addition, the revised rule requires adjustments of these annual caps as additional power plant units are shut down or transferred.

As a result, the retirement of the four plants will further reduce annual allowable sulfur dioxide and nitrogen oxide emissions in the MPS group of plants, driving total allowable emissions down by 57 percent and 61 percent, respectively, from that allowed under the former MPS rule. While not explicitly required by the MPS, carbon dioxide emissions will also be significantly reduced by approximately 40 percent relative to 2018 levels.

The decision to retire the four plants resulted from a plant-by-plant analysis that evaluated several factors in making retirement decisions, including ensuring compliance with the new emissions caps set forth in the revised MPS rule, plant economics, federal energy regulations and MISO market rules.

In addition, consideration was given to prioritize retirement of higher emitting plants as suggested by the IEPA and IPCB along with the other factors listed above that resulted in a balanced mix of higher and lower emitting plant retirements.

As part of the closure process, the company is filing the required notices with MISO, PJM and the Federal Energy Regulatory Commission.

If it’s determined the units aren’t needed for reliability, Vistra expects to cease operations at all four sites by the end of the year. The company will take the necessary steps to responsibly decommission the facilities in accordance with all federal and state regulations.

Mitigating the impact Plant closures can have detrimental impacts to the communities in which they are located, the release stated, but Vistra stated it aims to mitigate this impact by growing its Illinois business with newer technologies.

To that end, the company stated it continues to strongly support legislation to provide a pathway to reinvest and repurpose its existing coal-fueled power plant sites into solar and battery energy storage facilities.

Vistra has a demonstrated a history of developing these new technologies in Texas and California and, through the Coal to Solar and Energy Storage Act of 2019, could do the same in Illinois.

This legislation would allow the company to reuse substantial transmission infrastructure and its existing footprint of available land at its coal-fueled power plants to develop renewable energy facilities, mitigating employment and property tax impacts to plant communities and helping Illinois meet its clean energy goals.

Vistra stated it is hopeful the Illinois General Assembly will take up the Coal to Solar and Energy Storage Act during its fall veto session.

Rezin and Yednock react to closure announcement State Sen. Sue Rezin, R-Morris, in a statement, said the closure will have a large impact on the small community, which is located in the 38th Senate District.

“The retirement of the Hennepin plant was something I had worked for several years to avoid,” Rezin said.

“This plant provides a huge economic benefit to the region, and while the news is sure to be devastating to the hard-working employees and their families, it is my hope that our area employers will have their backs so that they can continue to live, work and raise their families here.”

“Vistra Energy’s decision to close the Hennepin power plant, and several others across Illinois, will only hurt local employees and their families. Hennepin’s facility not only helped provide power to our communities, but is a major part of the local economy and the economic security of many families. I remain committed to working with local and state leaders to help ensure that these workers receive the assistance and support they deserve,” he said.

Plant’s positive impact on the region over the years The Hennepin Power Plant has made donations to the community in the recent past. In April, Luminant bought four bullet-proof vests for the Putnam County Sheriff ’s Office.

At the start of 2018, plant manager Byron Veech presented a $1,000 donation to the Putnam County Food Pantry. Money raised by power plant employees was matched by the company and donated to the pantry.

At the end of 2016, the Hennepin Power Station donated $3,000 for instructional equipment for Illinois Valley Community College’s revitalized agriculture program.

In August 2015, Veech, representing the power plant, presented a $15,000 donation to the Putnam County EMS ambulance service to help fund new LifePak 15 cardiac monitors.

And the Hennepin plant received a top safety award this summer from the Occupational Safety and Health Administration (OSHA), which gave the plant its Voluntary Protection Program Star Status certification.

OGLESBY — The Illinois Valley Community College board recently honored Dr. Rose Marie Lynch for the landmark contributions she’s made to the college since arriving in 1970.

Board Chairwoman Jane Goetz unveiled a plaque topped with a photo from the 1970s of Lynch and mentor Dr. Mary Margaret Weeg.

Goetz then read the plaque text: “Illinois Valley Community College expresses its profound gratitude to two of its preeminent humanities leaders: Dr. Rose Marie Lynch and her mentor, Dr. Mary Margaret Weeg. Hired by Dr. Weeg in 1970, ‘Rosie’ went on to become an award-winning IVCC journalism and English instructor over a 32-year career. As executor of Dr. Weeg’s estate, Rosie skillfully handled the largest gift in IVCC’s history, a $1.2 million bequest. IVCC named its beautifully-refurbished auditorium the Dr. Mary Margaret Weeg Cultural Centre in 2017. We will always remember and cherish Rosie for her continued role in that unprecedented donation and for the countless other kindnesses she graciously performed for IVCC and its students.”

The plaque will be displayed near the entrance of the Weeg Cultural Centre.

After a public hearing, the board adopted the 2020 budget. Operating revenues and expenditures are balanced at about $22.3 million.

Revenues increased less than 1 percent, and expenditures decreased slightly less than 1 percent from the 2019 budget.

Total budget revenues are about $32.1 Dr. Rose million, a 1.4 percent Marie Lynch increase, and expenditures are $32.3 million, a decrease of 6 percent, from last year’s budget.

The $220,000 deficit is in the tort and auxiliary enterprises funds and is covered with existing fund balances in those funds.

The Lostant School District is in what Superintendent Sandra Malahy described as “the very beginning stages of looking at the intergovern-

mental agreement with L-P High School, because a dearth of Lostant students attend L-P. This year, the district has two students doing so.

A more certain change is in regard to the school’s financial software, as the current provider will no longer be available in June 2020.

While a number of districts changed companies for financial software last school year, Lostant has waited to do so. Malahy described the decision as holding out “for the kinks to be worked out.”

Sometime during this school year, the district needs to make a decision regarding new software, she said.

LASALLE COUNTY SHERIFF’S OFFICE Motorist strikes cow At 9:15 p.m. on Aug. 25, deputies investigated a single-vehicle accident at North 1850th Road and East Eighth Road in Vermillion Township.

Viviana Escatel, 23, of Bureau was eastbound on North 1850th Road when she struck a cow on the road.

No injuries were reported, and no citations were issued.

LASALLE COUNTY CORONER Fatal accident On Friday, Aug. 16, a single-vehicle accident occurred at the intersection of North 3150th Road near 300 E. Road in Livingston County. A female subject was transferred to OSF Center for Health in Streator. She was later

pronounced deceased by the LaSalle County Coroner’s Office at 5:15 p.m.

She was identified as Amy L. Craft, 37, of Streator. The accident is under further investigation by the LaSalle County Coroner’s Office and the Livingston County Sheriff’s Office.

LASALLE COUNTY SHERIFF’S OFFICE After investigation, no abduction LaSalle County Sheriff Tom Templeton released the following statement: On Aug. 19 at approximately 8:26 p.m., deputies received a report of a child abduction attempt. Information regarding the incident and suspect vehicle was disseminated to area law enforcement officers, as well as through social media.

On Aug. 21, investigators followed up on information received from a parent regarding his juvenile son and their vehicle that matched the description given. Detectives interviewed the vehicle’s owner, as well as the juvenile son whom they learned had been using the vehicle at the time of this incident.

Detectives learned the juvenile son was driving south on Hoxey Road, just

south of the Somonauk park, when he saw a young boy walking barefoot on the shoulder of the road. The boy also appeared to be limping. The juvenile driver stopped on the side of the road and asked the boy if he was all right.

When he did this, the boy took off running.

Investigators also spoke to a witness who observed a boy running northbound without shoes on, on this same date, time frame and location. The witness also described a similar truck stopped in the area. The vehicle reportedly drove off toward Lake Holiday.

At this time, it appears there was no attempted child abduction, that this situation was a misunderstanding, and that there is no immediate danger to the public.

Choir members from the United Methodist churches in Tonica and Hennepin performed during a combined service on Aug. 11 at the Tonica United Methodist Church. The event was attended by 72 people. The service was followed by a potluck meal, which had to be moved from the park to McFerson Hall because of rain. Special guests attending the event were the Rev. Jim Barnett, Vermilion River District superintendent; Sandy Shay, administrative assistant VRD, and her husband; and retired Pastor Larry Collins, an old friend of Rev. Barnett, and his wife, Susan. The two churches hope to have joint services quarterly and have the joint choir often.
