Housing & Services Descriptions Look for these color-coded housing types on the map & pages of this magazine …

Active Adult Living Active Adult Living communities can be either “For Sale” or “For Rent” and are age qualified communities. In some communities, the minimum age is 55 while in other communities, the minimum age is 62. These communities are focused on an active lifestyle meaning they may have a golf course, swimming, tennis, clubhouse and are usually filled with daily and weekly activities. These communities typically do not offer services and meals.

Independent Living Independent Living Communities offer all the amenities of regular apartment communities but have a minimum age requirement. In some communities it is 55 years of age, in others it is 62. Many of these communities offer reduced rent for those who qualify, they are identified as “affordable.” There are also market rate communities that mirror the rental rates of standard apartment communities. Both types of senior communities offer many amenities such as pools, community rooms, and lots of activities. They may or may not offer meals.

Retirement with Service Communities Retirement Communities offer many amenities such as social activities, exercise rooms, planned activities as well as resident clubs and interest groups and services. Some communities offer health care services, and can accommodate older residents with chronic health problems. Most communities offer restaurant-style meals, frequent events.

Residential Care Living Residential Care Homes offer a home like setting usually in a single family home.

They typically provide meals, laundry, house keeping, medication supervision, assistance with activities of daily living. Transportation may also be offered at some facilities.

Personal Care Homes (Unlicensed and Unregulated Homes in Texas Legally Operating) This is a home in a residential care setting equipped to give adequate care to three residents. A fourth person may be added if it is a close relative to the owner. Personal care services may be delivered, i.e. Assistance with bathing, dressing, moving, feeding, general oversight of the physical and mental well-being of a person who needs assistance.

Boarding Home Facility An establishment that; 1. Furnishes, in one or more buildings, lodging to three or more persons with disabilities or elderly persons who are unrelated to the owner by blood or marriage. 2. Provides community meals, light housework, meal preparation, transportation, grocery shopping, money management, laundry services, or supervision of medication but cannot provide personal care services as defined in Section 247.002 to those persons.

Housing & Services Descriptions Assisted Living Assisted Living Communities offer help with all aspects of daily activities (bathing, grooming and dressing assistance, perhaps) in an atmosphere of semi-private or private living units. There is a wide range of services and amenities offered in this category.

They provide many activities, meals and beautiful appointments. All are currently licensed by the state as assisted living communities.

What are Types and Sizes: TYPE A: Resident must be physically and mentally capable of evacuating the facility unassisted. This may include the mobile non-ambulatory persons such as those who are in wheelchairs or electric carts and can transfer and evacuate themselves in an emergency.

Does not require routine attendance during nighttime sleeping hours.

TYPE B: Resident may require staff assistance to evacuate and may be incapable of following directions under emergency conditions. May require attendance during nighttime sleeping hours. Residents may not be permanently bedfast.

TYPE C: Four-Bed facility which meets the minimum standards and programs rules for enrollment with DADS as an adult foster care facility. (Requires a contract with DADS).

All residential care homes and assisted living facilities that provide services of a personal nature to more than three (3) residents, unrelated to the owner, must be licensed under the DADS licensure requirements.

Memory Care Communities can be a special unit or a free-standing community designed to care for those with Alzheimer’s or memory-related disorders.

A (Type B) Assisted Living that is certified to provide specialized services to residents with Alzheimers or a related condition.

Small: Small facilities are defined as those with 16 or less beds. (A/B).

Large: Large facilities are defined as those with 17 or more beds. (A/B).

Skilled Nursing / Physical Rehabilitation Communities These communities offer hospital like attention in a community environment. These communities offer 24-hour care. The level of services can very from each community. Community may also offer short term, acute nursing care, intermediate care and long term nursing care.

Adult Day Stay Adult day care is a planned program of activities designed to promote well-being through social and health-related services. Adult day care centers operate during daytime hours, Monday through Friday, in a safe, supportive, cheerful environment. Nutritious meals that accommodate special diets are typically included, along with an afternoon snack.

Hospice Hospice care may be provided in the home or a community. Services can include pain management, a variety of emotional, spiritual and physical support needs.

Home Health Home health care is a wide range of health care services that can be given in your home for an illness or injury. Home health care is usually less expensive, more convenient, and just as effective as care you get in a hospital or skilled nursing facility (SNF).

Senior Services Senior Services includes an array of services for seniors and their family that may include but are not limited to providers of licensed health care services in the home and in the communities. They can provide non-medical, services durable medical equipment, transportation and other valuable services.

The Importance of Advance Care Planning As hard as it may be to face the idea of death, it is important to plan how we want to live our final days. This includes thinking about what kind of end-of-life care we wish to receive and planning how to pay for it.

According to the National Institutes of Health (NIH), people in the U.S. enjoy one of the best life expectancy rates in the world. Barring sudden events such as an accident or heart attack, the end of life will arrive gradually for most.

It is likely that each of us will face many decisions about the dying process, for ourselves and possibly for others.

The following information from the NIH is designed to help you consider your end-of-life wishes. Then make sure you talk about what you want with those close to you. This will not only give them peace of mind, but will also help them communicate your wishes to your health care team in the event you cannot.

INSTRUCTIONS FOR END-OF-LIFE CARE It is important to have your wishes written down. Instructions that let others know the type of care you want if you are seriously ill or dying are called advance directives.

Advance directives typically include a: • living will, • health care proxy and/or

• Do Not Resuscitate (DNR) order.

• Living will A living will, in Texas called a Directive to Physicians, records your end-of-life care wishes in case you are no longer able to speak for yourself. It spells out what life-sustaining treatment you do or do not want if you are terminally ill, permanently unconscious or in the final stage of a fatal illness. You may wish to meet with your health care provider before preparing a living will to discuss treatment options for a variety of medical situations.

TEXAS ADVANCE CARE DIRECTIVES FORMS Advance directives are legal documents that allow you to convey your decisions about end-of-life care ahead of time. They provide a way for you to communicate your wishes to family, friends and health care professionals, and to avoid confusion later on. These forms are available in both English and Spanish on the DADS website.

You can name a health care proxy in an advance directive or in a durable power of attorney for health care, a legal document in which you name someone your health care proxy.

“Durable” means it remains in effect even if you become unable to make decisions. If the person you choose is not your legal family member, it is important to use a durable power of attorney for health care to name him or her.

Do not confuse a durable power of attorney for health care with a durable power of attorney, which allows someone to make decisions on your behalf regarding property or financial matters in addition to health care.

Make sure to spend time talking with your health care proxy about your wishes, so he or she can feel confident speaking on your behalf if needed.

DO NOT RESUSCITATE ORDER A DNR order tells health care providers not to perform CPR or other life-support procedures if your heart stops or if you stop breathing. A DNR order is signed by a health care provider and put in your medical chart. Hospitals and long-term care facilities have DNR forms that a staff member can help you fill out. You do not have to have a DNR order.

Often these documents need to be witnessed, usually by a public notary, a person who is licensed by the state to witness the signing of legal documents.

Once signed and witnessed, make sure your health care proxy, alternates, and primary health care provider have copies. Hospitals may also request a copy when you are admitted, even if you are not seriously ill.

REVISIT YOUR ADVANCE DIRECTIVES It is a good idea to review decisions made in your advance directive from time to time and make changes if your views or health needs have changed. Be sure to discuss any changes with your health care proxy and primary health care provider.

If you live in one state and spend a lot of time in another, make sure your forms are legal in both states. If not, make an advance directive for your non-home state as well. Make sure any family and health care providers there have a copy.

Essential Points About Texas Guardianships Guardianship will not fix all of a person’s problems. Responsibilities and limitations applicable to guardians and guardianship are discussed below.

RESPONSIBILITIES OF A GUARDIAN OR GUARDIANSHIP A guardian: • Must meet the legal responsibilities established by the court, which may, depending on the type and limitation of guardianship, include: • Paying the ward’s bills.

• Making decisions about, and maintaining, the ward’s assets to the greatest extent possible.

• Ensuring the ward’s medical and living needs are met to the extent allowed by the ward’s funds and resources.

• Is responsible for filing annual reports and/or annual accountings with the court appointing the guardian.

• Is required to ask for the court’s permission and approval for many of the actions he or she will take.

LIMITATIONS OF A GUARDIAN OR GUARDIANSHIP A guardian: • Cannot prevent a ward from making bad decisions and choices.

• Is not responsible for bad decisions and choices the ward may make or for illegal acts they may commit • Is not responsible for personally funding the ward’s living

• expenses or for the ward’s past debt.

• Cannot use force to make a ward take medication.

• Does not personally supervise the ward around the clock.

• Cannot place a ward in a mental health facility.

IS GUARDIANSHIP THE BEST CHOICE? Because having a guardian takes away a person’s rights, it should be the last and the best choice. Before deciding to seek a guardianship, you should examine all other options or alternatives. In certain situations, guardianship is the best choice. But, you cannot be certain unless you look at other options and rule out less restrictive alternatives, which may allow the person being protected to maintain some or all of their independence. Consider the following before making the choice: • Is a less restrictive alternative available?

Has another option been tried but was unsuccessful? If so, might it possiblywork now?

• What alternative resources are available to support a less restrictive alternative?

• Is the person in question unable to make his or her own decisions or to provide for himself or herself?

• Is this person nonverbal, unable to communicate with caregivers, and unable to make responsible decisions?

• Is a surrogate decision-maker or agent under a power of attorney available to make decisions for the person?

Helping an Aging Family Member Plan for the Future

T

he importance of advance planning for aging adults (especially those suffering from chronic illnesses) cannot be overstated.

Without the right legal and financial documentation, caregivers and their loved ones could be faced with a host of problems in an emergency. Doctors may refuse to discuss important medical information with a caregiver, a dying elder may not get the end-of-life care they desire, and control over an incapacitated loved one’s bank accounts and property could be given to a complete stranger.

Six must-have legal documents for family caregivers You can help a loved one plan for their current and future medical and financial needs by working with them to prepare six essential legal documents, described in further detail below.

Important documents for managing medical care • HIPAA Authorization: The Health Information Portability and AccountabilPage 84

ity Act (HIPAA) aims to protect medical record privacy. This law prevents doctors and other medical professionals from discussing an individual’s health information with anyone but that person. Even caregivers can’t to access an elderly loved one’s medical records, or talk to their doctor, until they sign a HIPAA form. Fortunately, this document is easy to obtain; most doctor’s offices have extra copies on hand.

• Healthcare Power of Attorney (POA): This document allows an individual to grant legal authority to a trusted relative (i.e., the family caregiver), or friend, to make healthcare decisions on their behalf. A person with healthcare POA can determine (among other things) where an elder lives, what they eat, who bathes them and what medical care they receive. (*see note below) • Advance Healthcare Directive: An advance healthcare directive combines a healthcare POA with a living will. A living will outlines how an individual wishes their end-of-life care to be managed (i.e., aggressive medical care versus hospice care), and may also include a Do Not Resuscitate (DNR) order, or instruction not to insert a feeding tube if they become incapa-

Important documents for managing finances • Financial Power of Attorney (POA): A financial POA gives a trusted family member, or friend, the ability to make legally-binding decisions about a person’s financial assets. An individual with financial POA has the authority to manage their loved one’s finances, which may include paying bills, liquidating assets to cover expenses, or making other investment decisions. (*see note below)

As previously mentioned, a will can only be activated by the death of the individual.

An elder law attorney can assist with the preparation of these documents; as well as valuable guidance for taking into account your loved one’s individual situation and preferences when planning for the future.

Getting the necessary documents in order before a medical or financial disaster strikes can make an extremely difficult situation just a bit easier to navigate.

• Trust: Trusts — essential estate planning documents that specify how a person wishes certain assets to be disbursed — come in several different varieties. Each type of trust has its own rules and requirements that affect how funds will be distributed after a loved one passes away. The main difference between a will and a trust is that a trust can be enacted while a person is still alive, or after they have died. A will only goes into effect after an individual has passed on.
