Market accident enters legal arena Expected lawsuits will likely last for years BY JOHN WOOD Daily Press Staff Writer
Lawsuits stemming from the farmer’s market accident last week that left 10 dead and 79 injured may take years to go through the court system. While police officers continue an estimated seven-week investigation, victims and their family members have hired lawyers and are
preparing for a protracted civil battle. No criminal charges have been filed against Russell Weller, the 86-year-old Santa Monica man who last Wednesday apparently lost control of his vehicle and sped through a crowded farmer’s market. But Santa Monica trial attorney Brian Panish said Wednesday he has been retained by several of the victims and their family members, who will now pursue Weller for compensation in civil lawsuits. Panish said the city of Santa Monica, which is responsible for the twice-weekly market,
and General Motors, which manufactured the 1992 Buick LeSabre Weller drove, will likely also be sued. Experts said establishing liability against those deeper-pocketed entities will be a crucial factor in any pending litigation, as the assets of Weller, a retired wholesale grocer, are likely to be easily exhausted. “Those will be hard-fought battles and if you get those resolved, the suits will probably settle fairly quickly,” said Stephen Yeazell, a civil litigation professor at UCLA.

■ When a pair of bald eagles at Kentucky’s game farm in Frankfort produced an extremely rare (for incaptivity eagles) egg in April, officials destroyed it because to allow it to hatch would have violated their federal permit; a federal official said the Kentucky officials should have just shipped it to them. ■ In May, Laurie Hanniford, of Carlisle, Pa., was fined $352 for failure to file a state tax return in 2000, when she was 14, on total earnings of $316, for which no tax was due, anyway.
As I walked down the same path to Wednesday’s memorial as I did last week when I responded to the farmer’s market tragedy, an overwhelming sense of anxiety, grief and sadness overcame me. I watched hundreds of people gather at the farmer’s market just like they do every Wednesday. But this week was different. While I was standing in the middle of Arizona Avenue, I thought about how many times I

The community continued the healing process Wednesday during a day of remembrance on the week anniversary of the farmer’s market tragedy. Hundreds of people showed up during the farmer’s market to listen to more than a dozen clergy and members of the community
offer words of wisdom and prayer about what happened last week. “I thought it would be easier to do this, to talk about this, as the days went by,” said Santa Monica Mayor Richard Bloom to hundreds of people gathered at the shrine located at Arizona Avenue and Third Street on Wednesday. The date and location of the Dead’s original show is kept a secret by the Dark Star Orchestra right up until the performance. The Dark Star Orchestra provides clues that true Dead fans will pick up on,
including the number and placement of microphones, a “midi guitar” and the chatter. At the end of the evening, the band will reveal which show it tried to re-create.
