Volunteers needed for Da odil parade entry

New coordinators sought for next year

e current coordinators of the Da odil Festival Eatonville community oat have decided to continue organizing the annual parade entry for this year, but are seeking new organizers to take over beginning 2024. Initially, coordinators Sarah Cole and her husband, Brad, wanted to step down before the Da odil Festival on April 1, but decided to stay on as organizers through this year to ensure the community has a parade oat entry. ey are looking for a new coordinator to take over for the 2024

On March 8, the Eatonville School Board had a work study meeting at Weyerhaeuser Elementary School. Leadership students Hank, TJ, Van, Lily and Shepard made a presentation about the activities they have been involved with this year. Some of those activities included the campaign

process of getting elected as a school leader, their commitments to missing recess to hold meetings and doing the school announcements at the school’s Morning Meeting.

Savvy Senior: Getting paid as a family caregiver

Dear Savvy Senior, I have been taking care of my elderly father for over a year and it’s taking a toll on my nances because I can only work part-time. Are there any resources you know about that can help family caregivers get paid?

Dear Seeking, Caring for an elder parent can be challenging in many ways, but it can be especially di cult nancially if you have to miss work to provide care. Fortunately, there are a number of government programs and other tips that may be able to help you monetarily while you care for your dad. Here are some options to explore.

MEDICAID ASSISTANCE

All 50 states and the District of Columbia o er self-directed Medicaid services for long-term care. ese programs let states grant waivers that allow income-quali ed individuals to manage their own longterm home-care services. In some states, that can include hiring a family member to provide care.

Bene ts, coverage, eligibility and rules di er

from state to state. Program names also vary. What’s called “consumer directed care” in one state, may be called “participantdirected services,” “in-home supportive services” or “cash and counseling” in another. Contact your state Medicaid program to ask about its options or to start the signup process.

VETERANS BENEFITS

If your dad is a military veteran, there are several di erent VA programs he may be eligible for that provide nancial assistance to family caregivers, including:

Veteran-Directed Care: Available in most states, this program provides a needsbased monthly budget for long-term care services.

Aid & Attendance or Housebound bene ts: ese programs provide a monthly payment to veterans and survivors who receive a VA pension and who either need assistance with activities of daily living (i.e., bathing, dressing, going to the bathroom), or are housebound. Program of Comprehensive Assistance for Family Caregivers: is provides a monthly stipend to family members who serve as caregivers for veterans who need assistance with daily living activities because of an injury or illness sustained in the line of duty. (Caregiver.

OTHER OPTIONS

If your dad has some savings or other assets, discuss the possibility of him paying you for the care you provide, or talk to your siblings to see if they can chip in.

If they agree, consider dra ing a short-written contract that details the terms of your work and payment arrangements, so everyone involved knows what to expect. A contract will also help avoid potential problems should your dad ever need to apply for Medicaid for nursing home care.

Also, check to see if your dad has any long-term care insurance that covers inhome care. If he does, in some cases those bene ts may be used to pay you.

TAX BREAKS

ere are also tax credits and deductions you may be eligible for as your dad’s caregiver that can help.

For example, if your dad lives with you and you’re paying at least half of his living expenses, and his gross income was less than $4,400 (in 2022) not

counting his Social Security, you can claim him as a dependent on your taxes and get a $500 tax credit. If you can’t claim him as a dependent, you may still be able to get a tax deduction if you’re paying more than half his living expenses including medical and long-term care costs, and they exceed 7.5 percent of your adjusted gross income. You can include your own medical expenses in calculating the total. To see which medical expenses you can deduct, see IRS Publication 502 at IRS.gov/pub/irs-pdf/p502. pdf.

Or, if you’re paying for in-home care or adult day care for your dad so you can work, you might qualify for the Dependent Care Tax Credit which can be worth as much as $1,050. To claim this credit, you’ll need to ll out IRS Form 2441 (IRS. gov/pub/irs-pdf/f2441.pdf) when you le your federal return.

Create ravioli with ease

Ravioli can tempt the taste buds. Ravioli are perfect pillows of pasta lled with cheese or other ingredients. Ravioli can be dressed with many di erent sauces, or even be battered and fried for a savory appetizer. is recipe for “Brown Butter-Balsamic Ravioli” from “Rachael Ray 50: Memories and Meals from a Sweet and Savory Life” (Ballantine Books) enables home cooks to be as invested in their ravioli meals as they care to be. e abbreviated version of this recipe below o ers the Brown ButterBalsamic Sauce, which can be served on top of store-bought ravioli. Otherwise, you can

make ravioli from scratch. e ingredients for a basic egg pasta follow.

BROWN BUTTERBALSAMIC RAVIOLI Serves 4

• 6 tablespoons butter

• Finely chopped fresh at-leaf parsley or 16 sage leaves

• 2 tablespoons balsamic drizzle (or reduce 1/3 cup balsamic vinegar and 1 tablespoon [packed] light brown sugar down to 2 tablespoons thickened vinegar)

• 1 pound ravioli, homemade or storebought

• Toasted pine nuts, chopped hazelnuts, or walnuts (optional)

• Grated Pecorino or Parmigiano-Reggiano

1. Bring a large pot of salted water to a boil. Cook ravioli until desired tenderness.

2. While ravioli are boiling, heat a large skillet over medium heat. Add the butter in 1-tablespoon tabs and melt. Add the sage, if using, and cook the butter for 2 to 3 minutes, until nutty and deeply golden.

3. Remove the sage to a paper towel-lined plate. Remove the butter from the heat and add the balsamic drizzle or reduced balsamic. Add the sauce and about 1/2 cup salty cooking water from the pasta to the ravioli to coat evenly. Top with nuts, if using, sage or parsley, and pass more cheese.

Start to knead the shaggy dough once you get to the outside of the well. If the pasta dough will not come together, add 1 to 2 tablespoons of warm water.

3. When the dough forms, place it in a bowl and then clean the work surface. Knead the dough on a lightly oured

Parade entry rules are:

• Each oat must be 9 feet in length, 6 feet in width and 6 feet in height.

• e oat must be driven by a motorized vehicle that is powerful enough to carry the weight, or it can be pulled by a motorized vehicle like a trailer.

• e most essential requirement is the number of da odils on the oat. ere must be a minimum of 2,000

Ball it up, knuckle-knead rmly, then repeat, turning the dough at a 45-degree angle, then starting the knead all over again. Knead the dough for at least 15 minutes, until it is smooth and elastic. (It will look shaggy for a while; don't worry, it will get smooth. Just keep at it!)

4. Cover the dough with a kitchen towel and let stand an hour or so, or wrap and chill it overnight, bringing it back to room temperature to prepare. Use this dough to make your favorite pasta.

Ames thanked the School Board, Interim Superintendent Lucy Fountain and district o ce sta for continued support seeking solutions for the transportation issues facing WES families and for helping solve security issues.

County Council delays vote on sales tax increase

e Pierce County Council unanimously voted at its March 7 meeting to delay consideration of an ordinance that would levy a 1/10 of 1 percent sales tax increase. e motion to continue was made by Councilmember Dave Morell.

e proposed tax hike would go toward a ordable housing and related services and is estimated to raise approximately $20 million a year.

“ is was moved and seconded from a previous meeting and continued to today’s meeting,” said Chair Ryan Mello.

A December vote on the tax was delayed until this month because the council did not have a supermajority vote to pass the ordinance

and protect it from a possible veto by County Executive Bruce Dammeier.

“I anticipate a motion to continue this at the meeting of March 21,” Mello said before the council voted to do just that.

A public hearing on the matter was held by the council, which saw two people speak on the issue.

Last year, the council adopted the Comprehensive Plan to End Homelessness and e Housing Action Strategy. e Comprehensive Plan to End Homelessness estimated the county needs to spend an additional $117 million annually to fully fund the homeless crisis response system.

e Housing Action Strategy recommended imposing a 0.1 percent tax to fund a ordable housing solutions.

3. Defendant PETER KNOWLTON (hereinafter “Defendant” or “Knowlton”) is an individual who purchased the real property located at 216 Oak St E, Eatonville, WA 98328 with Plaintiffs.

II. JURISDICTION AND VENUE

4. This action concerns determination of questions affecting title to real property situated within Pierce County.

5. The real property at issue herein is situated within Eatonville.

III. STATEMENT OF FACTS

6. Plaintiffs along with Defendant hold fee-simple title to real property commonly known as at 216 Oak St E, Eatonville, WA 98328 (hereinafter referred to as “the Property”), which is otherwise legally described as:

SHORT PLAT RECORDED FEBRUARY 11, 1988, ACCORDING TO THE SHORT PLAT RECORDED UNDER RECORDING NUMBER 8802110312, RECORDS OF PIERCE COUNTY, WASHINGTON. SITUATE IN THE COUNTY OF PIERCE, WASHINGTON. TAX ID NO.: 3660000103.

7. Plaintiffs and Defendant acquired title to the Property in 2021 by statutory warranty deed.

8. Plaintiffs and Defendant acquired the Property at that time by using the Property to secure a note in the amount of Seven Hundred Twenty-Two Thousand Dollars and Zero Cents ($722,000.00) (hereinafter “Mortgage Loan”).

9. To complete this purchase, along with this Mortgage Loan, Thirty-Seven Thousand Three Hundred Seventy-One and NinetySix Cents ($37,371.96) cash was paid at closing by Plaintiffs and Defendant towards the sale price of the Property. Plaintiffs paid 75% of these closing monies and Defendant paid 25% of these closing monies.

10. The relevant history of the Property and the Parties is complex but, in summary, is that Mr. Knowlton agreed to remove himself from the title to the Property in exchange for a payment of $101,683.41 which payment was made by Plaintiffs to Defendant in August of 2022.

11. To date, Defendant refuses to remove his name from the title even though he has accepted the payment of $101,683.41 to do so months ago.

12. As such, Plaintiffs are forced to bring

this action for Quiet Title to have Defendant removed from title.

IV. CAUSES OF ACTION

FIRST CAUSE OF ACTION: FRAUD AGAINST DEFENDANT

13. Plaintiffs re-allege and incorporate by reference herein all of the allegations contained in Paragraphs 1 through 12 above.

14. When the parties were negotiating for Plaintiffs to enter into the buyout contract detailed above which included Plaintiffs paying Defendant $101,683.41 in exchange for Defendant removing himself from the deed to the Property, Defendant and his agents made representations that were not true at that time and which Defendant knew were untrue. The Defendant and his agents also and failed to properly make representations that were material to Plaintiffs’ decision to purchase the Subject Property. Those representation and failures to make material representations include, but are not limited to the following:

a. The Property would be deeded in full to Plaintiffs upon payment of the $101,683.41 by Plaintiffs to Defendant; and

b. Defendant would do so to allow Plaintiffs to eventually remove Defendant from the mortgage;

15. Each of these statements was untrue at the time they were made to Plaintiffs.

16. The misstatements of fact above by Defendant and his agents in their contract with Plaintiffs were intentional.

17. At all relevant times, Defendant and his agents aware that Plaintiffs would not reasonably be expected to discover the misstated facts until after Plaintiffs paid Defendant the $101,683.41.

18. Defendant, his agents, and representatives intended to deceive Plaintiffs when they misstated these facts. Plaintiffs did not know the misstated facts when they entered into the contract with Defendant.

19. Plaintiffs reasonably relied on Defendant’s deception when they entered into the contract.

20. As a direct and proximate result of Defendant’s deception, Plaintiffs suffered losses in an amount to be proven at trial.

21. As a direct and proximate result of Defendant’s deception, Plaintiffs have been deprived of their monies as detailed above.

22. Defendant’s wrongful acts were carried on with the intent to cause injury to Plaintiffs. Additionally, the Defendant acted with malice, fraud and/or oppression and, thus, Plaintiffs are entitled to an award of punitive damages. SECOND CAUSE OF ACTION: BREACH OF CONTRACT

23. Plaintiffs re-allege and incorporate by reference herein all of the allegations contained in Paragraphs 1 through 22 above.

24. Defendant breached his contractual duties when Defendant purposely misstated facts to Plaintiffs as detailed above.

25. Plaintiffs bring this claim for the monetary losses, lost interest, attorney’s fees, costs, and other damages that Plaintiffs experienced as a direct and proximate result of Defendant’s breach of contract.

THIRD CAUSE OF ACTION: BREACH OF DUTY OF GOOD FAITH AND FAIR DEALING

26. Plaintiffs re-allege and incorporate by reference herein all of the allegations contained in Paragraphs 1 through 25 above.

27. At all material times, the parties’ contract contained an implied covenant of good faith and fair dealing.

28. Defendant breached his implied duty of good faith and fair dealing when Defendant purposely misstated facts to Plaintiffs as detailed above.

29. Plaintiffs bring this claim for the monetary losses, lost interest, attorney fees, costs, and other damages that Plaintiffs experienced as a direct and proximate result of the Defendant’s breach of his implied duty of good faith and fair dealing.

FOURTH CAUSE OF ACTION: QUIET TITLE

30. Plaintiffs incorporate herein by reference the allegations made in paragraphs 1 through 29, inclusive, as though fully set forth herein.

31. Plaintiffs must be declared the OneHundred Percent (100%) of the Property based on the contract detailed above which Defendant has breached by not signing a deed transferring his fi fty percent (50%) interest in the Property to Plaintiffs after receiving the agreed upon $101,683.41 from Plaintiffs.

32. Plaintiffs seek to quiet title against the claims of Defendant.

33. Plaintiffs seek a judicial declaration that the title to a One-Hundred percent (100%) interest in the Property is vested in Plaintiffs alone and that the Defendant and each of them be declared to have no interest estate, right, title or interest in Plaintiffs’ One-Hundred percent (100%) interest in the Property and that the Defendant, his agents and assigns, be forever enjoined from asserting any estate, right title or interest in Plaintiffs’ One-Hundred percent (100%) interest in the Property.

Concerns about personal safety were also raised by state legislators. Rep. Michelle Caldier, R-Port Orchard, told colleagues on the House oor that she recently had a stalker who pled guilty a er trespassing on her father’s property three times.

“For the rst time ever in my life I’m thinking about owning a gun to protect myself, because it is my right to bear arms," she said. “ is bill would make it so I would not be able to protect myself. is bill will inherently prevent individuals with disabilities from getting a gun to protect themselves if they have a stalker. is is wrong. It’s not fair, it’s not right.”

Republicans also warned the bill is likely to be struck down by the U.S. Supreme Court, which in 2022 issued a decision overturning a New York state law requiring residents to have a permit to carry their rearms in private or public. In the original version of HB 1143, a person would have had to obtain a permit in order to purchase a rearm, but that section was removed before the nal House vote.

At the state level, the courts could also nd it in violation of the Washington State Constitution, which states “the right of the individual citizen to bear arms in defense of himself, or the state, shall not be impaired, but nothing in this section shall be construed as authorizing individuals or corporations to organize, maintain or employ an armed body of men.”

Under HB 1143, a person would not only have to wait 10 business days before obtaining a rearm they purchased, but they would have to provide proof of completion of a rearms safety training program.

Another provision requires gun stores to keep records of all gun transfer and turn that data over to DOL for retention, a proposal Republican lawmakers sought to remove prior to the March 7 vote. e amendment was among many introduced by Republicans but ultimately rejected.
