Keys to Renting Checking references equals increased revenues By Joy Peck, Executive Director Landlord Association of the Inland NW hy Any of This Really Matters As a rental property investor, you have probably put a great deal of your money, time, energy and emotion into your rental business. In return, there is the hope of financial reward and perhaps future financial security for retirement, a college fund for your children, health care funds in old age, or other dream fulfillment. By far the biggest risk to your investment involves to whom you turn over that investment. The mission of the Landlord Association is to train and support landlords and to help protect their rental investments through information, and part of that is learning how to obtain an applicant’s rental history. We know landlords that would never toss their car keys to a brother-in-law they have known 20 years, or to a friend or neighbor they have know for a decade, but they will give the keys to their $100,000 or $200,000 investment to someone they did not even cross-check phone numbers for on their application. Sounds crazy, right? It happens every month. The goal of checking rental history is to prevent large financial losses down the road. Rental history is as important as credit history in the screening process for rental property. In evaluating an applicant, their past use of credit may be used as a predictive model of future credit management. And similarly, the applicant’s past pattern of behavior with landlords, neighbors and fulfillment of lease obligations (rental history) gives clues as to how he or she will behave in their new rental location. It is extremely important to check each applicant’s rental history in addition to any credit checks that you perform, since many types of tenant problems do not make their way into a credit report will be discovered in their rental history. Some Basics In contacting previous landlord references, what you are trying to find out is whether the applicant paid rent on time, kept the rental property in good condition, was considered a good neighbor, and adhered to the lease agreement in other ways. Was there smoking in a non-smoking unit? Were pets brought in a no-pet rental? Did the tenant bring in unauthorized occupants to live there without notifying the landlord? Were there parking problems or noise issues with neighbors? Other than non-payment or late payment of rent, these are the top five problems landlords face, but are often the questions not asked of former landlords. Your Application to Rent states that the applicant’s signature should have wording that gives consent to obtain not just credit reports, but also character reports and rental history. Most applications have a statement or phrase authorizing the same thing. Rental history information can be obtained from current and previous landlords or property managers. As you already know, landlords and property management staff are very busy people and often put aside the task of returning calls, answering fax requests, or responding to emails to other landlords. But your rental investment is at risk and a significant part of your future income is at stake. Getting a clear picture of the tenant who will be assuming possession of your investment property may be the most

important thing you do for a long time. Be persistent! Follow through, even if it takes an extra few days to get responses from the second or even third landlord back, not just the current one. Many landlords prefer to use a written questionnaire rather than conduct an oral interview. The form serves as a written documentation of rental history and can be placed in the applicant’s file should there be any concerns later. Using a standard form also helps get all the important information without the chance of forgetting what you wanted to ask. It also eliminates any complaints that you asked different rental history questions for different applicants, opening the door to accusations of discrimination. Make out your list of questions, ones that are important to your rental business model. There are various types of formats for the questions, and most landlords like to make their own. Since you are unlikely to meet with references and former landlords face-to-face, this form will be the one used during the phone calls. Remember, there are instances in which, due to personal interaction, a previous landlord may think of things while talking over the phone that might not get into writing, whether via mail, fax or email replies, so phone interviews seem to be the preferred method of checking rental history for most landlords and property managers. Tips for Checking References The references you get from the applicant are possibly the most important information you can get and there are certain references a landlord should always include in your applicant process. 1. Previous landlords. They can tell you about what kind of tenant the applicant was. Even though many are hesitant to say anything negative for fear of retaliation or lawsuits, you can still learn an amazing amount of information simply by asking leading questions. The two to ask first are, “Did the tenant give you the required notice?� (Thirty days for a year’s lease, and twenty days notice on a month-to-month agreement.) And “Why are they moving?� Be sure to go back at least to the second to last landlord, not just the current one!! 2. Employer references. Employers can verify employment, an income range (many employers will not give a specific dollar figure); length of employment, ability to get along with others, and whether there has a wage garnishment in the applicant’s time there. If the applicant has been employed less than six months, it’s very important to check the next most recent employer. Skipping that step can cause a landlord to miss information about garnishments, lawsuits, poor attendance, job hopping, anger management problems, etc. 3. Personal references. These are almost always going to be friends or relatives of the applicant and they, too, may be hesitant about saying anything negative. But if there are pauses, tiptoeing around an answer, sidestepping a question, or other clues that they are uncomfortable, that deflection in itself is something to consider. The landlord can only work with the information he or she can get, but persons listed by the applicant in this category should be helpful and answer a few questions willingly, or it’s a clue that the applicant, for whatever reasons, does not have anyone that feels confident in providing a
positive recommendation. Check the addresses and phone numbers of the all the references given. If the employer, previous landlord and personal phone numbers are duplicates, then the applicant has used a friend or relative to impersonate an employer or former landlord. Use the phone book or directory assistance to verify that all the names, addresses and phone numbers on the application match up. If the calls are long distance, remember that this is money well spent. Some landlords let applicants leave parts of the applicant form blank if they say they don’t remember, have lost the information, or that the former employer is out of business or has moved, or that a previous landlord has moved away or died. Of course, these things may be true on occasion, but go ahead and check out the move, death, or whatever. If you want to make sure you are talking to the real landlord, call the customer service department of a title company, the county tax assessor’s office, go online to the assessor’s office, or check the county records in person. Just give the address of the property, and you can get the name and address of the property owner. Check that against the name of the landlord reference. Of course, if the previous landlord is a property management company, that information is very easily verified by cross-checking the phone number in the yellow pages. All this does take time and extra effort, but you invested in rental property to get a return on that investment, didn’t you? If the prospective tenant says they have just sold his house, ask for the name of the real estate agent, title company, attorney or closing agent. Even “Owner Private Sales� have a closing agent and title company that must be involved. Or you can ask for the name of the buyer. All this may seem so intrusive. Just a few questions, however unaccustomed you are to asking them, can spell the difference between a good return on your investment and a financial hole that will take several years to dig out of. When you call the previous landlord or property management company if the applicant was a renter, or the real estate agent or buyer if they just sold their house, ask about the condition of the property and sales price. This will give you information about whether the house was left with severe damage or in good condition and will tell you a lot about how they will leave your investment when they vacate. It is an important first step to getting a good tenant. It is not a substitute for the second step – sending the application to a professional screening company for a background check, credit report, more detailed eviction and criminal record searches. The pros have experience, contacts, and a sophisticated network that has been built over many years. In Washington State, the Landlord-Tenant Law says it is the applicant who should pay the application fee specifically for professional screening, and a landlord or property manager, no matter how long in the business, should not forego the added information and protection that a screening companies can provide. “Keys to Renting� content is for informational purposes only and not meant as a substitute for legal advice. H
omeownership is the foundation of the American Dream, and in today’s doit-yourself culture where how-to advice for just about anything can be found on the internet, many people think they could save a lot of money by building their own home. But your home is likely the single largest investment you will make in your lifetime, and not hiring a professional homebuilder could be a costly mistake for many reasons – financial, emotional, and physical. Getting financing is an important consideration. As a self-contractor, lenders have strict guidelines and limits on how much money they will give you, and they will require that you provide house plans, specifications and an itemized list of documented costs and bids beforehand. Even if you feel that you have enough cash to do the job, it is wise to get a loan to cover material or labor cost increases, upgrades or material overruns. Many mortgage companies will not lend money to cover unanticipated costs on a home when construction has already begun. There is a huge amount of bookkeeping if you act as your own general contractor. The IRS requires that you send anyone you hired to work on your home – subcontractors – who earned over a certain amount a 1099 form at the end of the year. You’ll have to be on site to document delivery slips, check for inaccurate billing and track material returns in order to stay on budget. Professional homebuilders are experts at the logistics and timing of building a home. It is an exact science to make sure permits are applied for, materials are ordered and delivered, subcontractors are hired, utility deposits are paid, and inspections are scheduled at exactly the right time. Even if you’re very organized, it is a process where many things can go wrong and a delay could cost you thousands of dollars and a lot of stress. Building your own home is a risky proposition from a legal standpoint, as well. Homebuilders carry Builder’s Risk, General Liability and Workman’s Compensation insurance on their building projects. As a self-contractor, you will have to assume most, if not all, of the same liabilities. You may want to consult with an attorney regarding potential liability issues, and with an insurance agent concerning appropriate insurance coverage. Homebuilders have staff to take care of all the details of building a home, and established relationships with other professionals to complete the job, which is why they can build a home in a relatively quick timeframe. To build an average 1,500 sq. ft. home, you need to be prepared to spend at least 35 hours per week for at least five or six months, and most people don’t have jobs with that kind of flexibility. You will also need the time to determine and order the materials, evaluate bids, and hire and schedule qualified, licensed, insured and/or certified subcontractors. Finally, if you sell the home you’ve built, you may be responsible for any defects that are discovered afterwards. As the home’s builder, you or your estate will be responsible for claims brought by subsequent owners of the home. By hiring a professional homebuilder, you will get quality of workmanship, building code compliance and an outstanding level of knowledge. Question: We co-signed a mortgage with our daughter, but the value of the property has fallen more than 50 percent. Her credit is excellent and she has never missed a payment. But because the mortgage is not with Fannie Mae or Freddie Mac, she can’t reduce her interest rate from 6.125 percent. Soon after she obtained the mortgage, it was re-sold to another company. Was it just “luck of the draw� that the company that bought it was not Freddie Mac or Fannie Mae? Answer: Once originated, a loan is simply an asset that a lender can either keep in portfolio or sell in the secondary market, depending on its financial strategies and preferences. The secondary market is an electronic platform where various buyers and sellers deal in loans. While Fannie Mae and Freddie Mac are important players in the secondary market, they are not the only ones. It is estimated that the government now backs as much as 90 percent of all mortgage loans. Your daughter’s property lacks equity. Since she cannot qualify for assistance under the government’s Home Affordable Refinance Program (HARP), your next option is to contact the state attorney general to see if there is a state program that might help. Unfortunately, the federal programs currently in place are only available for government-backed loans, such as Fannie Mae, Freddie Mac, FHA and VA loans. Can the government do better? You bet. Of $45.6 billion of stimulus funds set aside for “housing support programs,� only $5.5 billion has been spent. I believe that those who have paid in good faith for at least three years should be able to refinance at today’s rates. With lower rates, borrowers would have more disposable income and less incentive to walk away from the property. Universal refinancing would mean fewer foreclosures, more local spending and a stronger economy.
