Advice for new landlords

NOTICE: The Landlord Association of the Inland NW has moved from its previous location in the Hutton Building to the new address at 225 E. 3rd Avenue, Suite 2, Spokane, WA 99202. During The street repair on 3rd avenue, our new office is best accessed from 2nd Avenue and Spokane Street. 1. Treat landlording as a business. Develop a system with a set of written procedures for all steps in your rental process. If you aren’t sure about how to do that, talk with an experienced landlord, find a landlord mentor, or join a landlord association to get the training for free as part of the membership. 2. Get a copy of the Washington State Residential Rental Laws, commonly known as the LandlordTenant Law Act (LTLA), which is a part of the Revised Code of Washington. Learn the rights and responsibilities of landlords and tenants both, how to serve notices, and how to accomplish what you need to do. 3. Use state-specific leases always, and be sure that you attach any other forms required by the state in which your rental is in. Washington State requires a Property Condition Report (walkthrough checklist of some kind), a Smoke-Detector form and a Mold Addendum. These forms protect the landlord in several ways, so don’t neglect to use them. If the rental property is older than 1978, a LeadBased Paint form and booklet is also necessary and protects the landlord from future lawsuits or complaints. 4. Put in writing a list of your screening criteria. This is an absolute must to protect a landlord from claims of discrimination because it describes the criteria that an applicant must meet to be considered for lease-up, and demonstrates that your choice is based on factors other than discrimination against a protected class. 5. Verify every item on the application. 6. Thoroughly screen your applicants! In Washington State, the tenant pays the screening costs. Be sure to check rental history back beyond the current landlord. Ask about evictions, suits against previous landlords, habitually late rent, damages, noise, pets, complaints, smoking, criminal background, or other items on your criteria. 7. Keep the relationship between you and your tenants business-like and treat all
residents with respect. Develop good listening skills, but do not become involved with personal problems or become a sounding board for chronic personal complaints. 8. Enforce the terms of the lease and your rental rules consistently and immediately when there are problems with noise, parking, unauthorized occupants, late rent, pets, etc. 9. Conduct regular inspections of your properties. Every 3-4 months is not too often to check for residents living on your property that are not on the lease, damages, pets or smoking, if they are not permitted. Spring and fall are good times to check on the smoke detector batteries. Summer and winter should be a time to check for leaks, change the filters in the furnace. Serve the 48-Hr Notice of Intent to Enter prior to any inspections. 10. Keep good records and document all calls, all visits, maintenance, everything. 11. Fill vacancies faster by reaching out and serving a niche market. The location and amount of rent will impact that choice, but there are many niches to target and can lead to shorter vacancies and better return on investment. 12. Look for ways to reward your long-term residents, even if it is just a small plant in the spring, a small ham or turkey at Thanksgiving or Christmas, or a gift card for a local coffee shop. Lower turnover results in higher revenues. 13. Seek further training and education about landlording. It’s a profession, even if you do it only in addition to a “day job.� Read books like “Landlording,� and “The Landlord’s Kit.� There are even landlord cruise conferences that sound like lots of fun. 14. Keep some capital in reserve for those unexpected repairs, damages, vacancies, perhaps even an eviction. The important part of capitalism is capital – the capital to get started and the capital to carry you through slow times. Borrowed money is not capital, it’s debt, so be sure you have some funds put away. Landlording is not a get-rich-quick venture. It generally takes years to accumulate equity in rental property, but done correctly, is an excellent investment and creates wealth. “Keys to Renting� content is for informational purposes only and not meant as a substitute for legal advice.
