ne type of rental form that is very useful for both landlords and tenants is the Holding Agreement (sometimes called an Agreement to Enter into a Lease). It can feel exciting for both parties when an applicant finds just the right rental unit and the landlord finds the right person to move in. But if the applicant can’t sign the lease that very day, it can be a sudden letdown, too. Perhaps he needs just the required number of days to give notice to their current landlord, to get deposit money together, or has travel or scheduling problems. Experienced landlords, property managers and renters know that the Holding Agreement can help make this situation less risky. If a prospective tenant can’t write a check for the whole rent and security deposit on the spot, but can put an appropriate amount of money down to hold the unit, then using the Holding Agreement can make things very easy for everyone involved. The landlord gets a guarantee that the unit will be rented, and the tenant gets an agreement that the vacancy will be held for him or secures a spot at the front of the line – whichever the agreement states. But if its only a verbal agreement that underlies that the tenant will come back at or before the designated time with the full rent and security deposit, and that he or she has passed the background check, things that can go awry: • The applicant finds another rental they decide to take • The applicant cannot get the security deposit and rent in full together by the designated time • The credit check or rental history indicates problems • If there is an undisclosed criminal record that shows up in the background screening and the owner’s rental criteria does not allow for exceptions In such cases, if everything has been handled only in an oral agreement, then a landlord could be stuck with honoring the verbal promise. Should the tenant present persuasive arguments that the oral agreement was with no stipulations, the landlord may have to rent to the applicant even though they did not pass the screening process. On the other hand, an oral agreement to pay the security deposit and rent by a certain date can be taken to Small Claims Court or other courts by a property manager or property owner. And if there is convincing evidence, the applicant could be held to paying the money even though he found a different place to rent or other circumstances prevented him from moving in. Both situations indicate how complicated it can be for an agreement to be made without having a clear written Holding Agreement that protects both landlord and applicant should

tenant gives money or a landlord accepts money to hold a vacancy. There are two basic ways that using this form will protect the parties when an applicant would like to offer a deposit to hold the unit. First, if the applicant later decides that they’re no longer interested in the rental unit after they have given the landlord or property manager money to hold the place, the agreement states that a tenant’s failure to sign a lease with the landlord or indication that they will not be occupying the property, the money is forfeited. This is considered compensation or a damage award to the landlord for lost rent or lost time to re-advertise and re-interview for a replacement prospective tenant. This part of the Holding Agreement ensures that a tenant is serious about signing a lease. Also, by signing the agreement with a tenant, the acceptance of the deposit will not automatically guarantee their right to the unit should there be unfavorable information from the credit check, rental history or references. Many times, simply taking money from someone, regardless of what the background check turns up after the fact, can automatically bind a landlord to an agreement to rent to that applicant … unless there is specific exceptions in writing. The wording in the Holding Agreement guarantees that any money accepted as a deposit on a rental unit is conditional upon the applicant passing a background check. Should the applicant subsequently fail the background check, the landlord or property manager will still have the right to decline them and return their deposit check. At this point, an applicant could ask if a larger security deposit, a co-signer, or renting on a month-to-month basis rather than on a year’s lease might be considered as a way to overcome whatever credit or rental history problems are on the screening report. Some landlords are willing to do this is their financial risk is lessened. Having a few copies of the Holding Agreement on hand is a good way for a landlord if not miss an opportunity to fill a rental vacancy, or for an applicant to get just the right place to rent, while being clear about the terms of holding it open. A Holding Agreement protects everyone’s interests so that the potential renter knows he or she has a place to move to, and the property owner doesn’t lose a lot of money if the applicant changes his mind. “Keys to Renting” content is for informational purposes only and not meant as a substitute for legal advice. n February 2010, President Obama initiated the Hardest Hit Fund for homeowners struggling to pay mortgage bills in certain states after the housing crisis. While the program had assisted 94,000 families by December 2012, “We think the program can reach about 400,000 families,” says Andrea Risotti, spokesperson for the U.S. Department of Treasury. The regions where residents can apply for Hardest Hit Fund assistances are Alabama, Arizona, California, Florida, Georgia, Illinois, Indiana, Kentucky, Michigan, Mississippi, Nevada, New Jersey, North Carolina, Ohio, Oregon, Rhode Island, South Carolina, Tennessee and the District of Columbia. A total of $7.6 billion was divided amongst their local Housing Finance Agency to distribute to struggling homeowners based on local needs. Each HFA has until 2017 to spend all their funds, but Risotti says most of the states will probably be out of money by 2014. “If you’re struggling with your mortgage – especially if you recently lost your job – don’t wait,” Risotti says. The federal program originally intended to support struggling homeowners. “We were seeing more and more homeowners struggling because of unemployment or because they were underwater on their loans,” Risotti says. Each HFA determines the specific eligibility criteria for local homeowners. Rhode Island was the first state to use all their funds. “We spent all the money so we’re stopping the program at the end of the month January,” Faye Zuckerman, a spokesperson for Rhode Island’s HFA, says. Still, real estate experts say other states are still not reaching the majority of local struggling homeowners – many don’t know the funds exist. Some groups, like the nonprofit Help Share the Word, are working to raise awareness. According to Risotti, they are not affiliated with the treasury or HFA in any way. “What they’re trying to do is just really educate homeowners about free resources for help, warn them against scams and encourage them more about the Hardest Hit Fund,” Risotti says. Already there has been a tremendous growth in families applying for aid from the Hardest Hit Fund; in fact, there have been 27,000 applications since December.

Question: We have spoken with several lenders recently about a reverse mortgage. Our property is worth roughly $400,000 and we have been told that we could get a $200,000 lump-sum payment or monthly payments ranging from $700 to $1,200. Why can’t we get a bigger loan and why are the monthly payment possibilities so different?

Answer: Reverse mortgages insured by the FHA come in two forms. The “standard” reverse mortgage allows you to borrow more but has high up-front fees. The “saver” program has far-smaller up-front fees, but you cannot borrow as much. Interest quotes, of course, can vary. With a reverse mortgage, you are not required to make monthly payments for principal or interest – but you must continue to pay for such things as property taxes and insurance. Reverse mortgage borrowers who do not pay taxes, water bills or association fees can face foreclosure and the loss of their property. Depending on the equity available, you might use a reverse mortgage to receive a monthly stipend. However, interest is being charged and the loan balance grows each month. When you move, sell or die, the loan must be repaid. The home secures a reverse mortgage and there can be no other claims against the borrower or the estate. If the value of the home is insufficient to repay the debt the lender then turns to the insurer (the FHA) for the balance. If your heirs want to keep the property, they must repay the debt, perhaps by refinancing the home. Reverse mortgages are complicated and part of the bigger issues associated with financial and estate planning. Given such complexities, it’s important to speak with fee-only financial planners and attorneys who specialize in elder law before agreeing to any reverse mortgage proposal. A less-tangled alternative to a reverse mortgage may be to sell the present property and to then use the check from closing to buy something less expensive – and perhaps mortgage-free.
