Keys to Renting What you should know before signing a lease or rental agreement. By Joy Peck, Executive Director

prospective tenant that the unit was built before lead-based paint was taken off the United States market, and that the tenant should refrain from letting children and pets chew woodwork or other painted surfaces in the unit, and to avoid permitting children, pets or yard workers from disturbing the dirt around the unit without gloves or other protections. Before you sign: • Be sure you know when the rent is due, if there is a grace period, if there are late fees. And by the way, a grace period does not apply to the day the rent is due. A grace period is the number of days before late fees kick in. A grace period does not allow or suggest that the rent may be paid late, but if it is, the late fee will begin to apply after the grace period has expired. A landlord or property manager can still record that the rent was late on credit reports if it is not paid on the date it is due. • Where is the rent paid, to whom, and to what address it can be mailed. • Will there be carpet cleaning or other expenses automatically deducted from the security deposit? • Are utilities included in the rent or must utilities they be put in the tenant’s name? • Who maintains the appliances or pays for repairs to toilets, dishwasher, stovetop, etc. • Are there parking issues, assigned spaces, limits about where guests park? • Are there pet fees or pet deposits if pets are allowed? • Is there a policy about long-term guests, even if they are visiting family members? • Clarity that there must be advance notice before not renewing a lease (30 days required for a lease), or a 20-Day Notice if it is a month-to-month rental agreement. • All parties to the lease should be clear that the Landlord-Tenant Law Act requires that a security deposit disposition form must be given by the landlord to the tenant within 14 days after vacating the rental showing how much, if anything, was deducted from the deposit. • Is the tenant required to have renter’s insurance? • What are the noise level restrictions in this apartment/duplex/house? • Are there restrictions about painting, hanging items on the walls, or other decorating? This may seem like some unnecessary extra bother, but by getting all the required paperwork completed and all the questions answered clearly, the landlord-tenant relationship can start off well and eliminate misunderstanding and problems later. “Keys to Rentingâ€? content is for informational purposes only and not meant as a substitute for legal advice. W

hen a tenant moves into a new place means that both the tenant and the landlord have a million things on their minds and a lot to accomplish in a short time. For the landlord, there is the last minute cleaning, getting the paperwork in order, getting new keys made and arranging for the walk-through before handing over those keys. For the tenant, there is the packing, moving, unpacking, contacting the Post Office about the address change, getting the refrigerator re-stocked and settling in. What all this means is that the actual reading of the lease gets lost and tends to be rushed through as quickly as possible. But knowing the terms of the lease or rental agreement is actually the most important thing that needs to be done! We have a checklist that will help with this process and even though not all of it may apply to every situation, take the time to read the lease, don’t feel pressured to sign until you understand something you may not be sure of, and ask questions. And be sure to get a copy of the lease and the other documents for your own records and keep it in a safe spot so you can refer to it later, if you want to. For a legal rental lease-up process, there will be at least four, and possibly five, documents: • The Lease (for a set term of rental) or Rental Agreement (for a month-to-month term). • A Walk-Through Checklist or Property Condition Report is the form that is filled out as the landlord and tenant inspect the rental unit and is the document upon on which the security deposit is based. Cleaning costs and damages will be deducted according to the information on this checklist when compared to the condition of the unit when the tenant leaves. This form is required for a security deposit to be legally collected. • Smoke Detector/Carbon Monoxide Form, acknowledging that the rental unit has a smoke detector and carbon monoxide detector, at least one on each level, and that it is operational. These are required by Washington State Law. • Mold and Mildew Addendum, an informational form that states there is no mold or mildew or water intrusion at the time of lease-up, and how to avoid moisture problems in the rental unit. This is required by Washington State Law. • If your rental unit was built prior to 1978, a Lead-Based Paint Disclosure Form is required by Federal Law to be signed by the tenant and landlord and a Lead-Based Paint Booklet given to the tenant. This discloses that housing built prior to 1978 may still have varying amounts of lead remaining in old paint and in the ground surrounding the outside of the house or rental unit. This is because decades of old paint scraped off may be in the dirt and can affect children, gardeners, lawn care workers, and of course, any pets that are let outside. A landlord is not required to test for lead, only advise the

s spring approaches, many home owners grow eager to start remodeling projects to update their surroundings. Before getting started, it’s a good idea to hire a professional remodeler, according to the National Association of Home Builders. A professional remodeler knows how to translate a homeowner’s dreams and budget into reality. They have the expertise to work with a homeowner and make sure factors such as resale value, future uses for the space, whether the materials selected are appropriate for the family’s lifestyle, and other factors that a homeowner may never have considered are fully evaluated. Here are five tips for planning a successful home remodel that you can enjoy for many years to come: 1. Compile a list of home remodeling ideas and draft a budget for the work. You likely have projects in mind, such as modernizing the bathroom, renovating the kitchen, replacing windows or repairing the roof. Prioritize your wish list: Maybe you don’t have the budget for your dream remodel, but professional remodelers can maximize your dollars by phasing the work, suggesting budget-friendly materials, and implementing creative design solutions. 2. Look for a professional remodeler to help plan the project. Start by contacting the Spokane Home Builders Association at (509) 532-4990 or visiting our website at www.SHBA. com. You’ll get a list of nearby remodelers to contact. Asking friends and neighbors for names of qualified remodelers will also help you find a match for your project. 3. Check the references and background of the remodeler. After you speak with remodelers and find one or two who match your project’s needs, be sure to conduct background research by checking with the Better Business Bureau, talking to their references, and asking if they belong to a trade association such as the SHBA. Remodelers with these qualities tend to be more reliable, better educated, and more likely to stay on top of construction and design trends. 4. Agree on a contract. Talk over the details of the project and begin reviewing the contract. You’ll want to check the remodelers’ insurance coverage, ask about any warranties on their work, know who is responsible for obtaining any building permits, and understand the process for making any change orders after the contract is signed. Make sure that you and your remodeler see eye to eye before you sign on the dotted line. 5. Take advantage of the energy efficiency rebates and tax credits. If your remodel includes replacing windows or doors, adding insulation, upgrading heating or air-conditioning units, updating the water heater, or installing energy generating products (such as solar panels, heat pumps, or wind turbines) then you may be able to take advantage of rebates from your utility provider and possibly receive a federal energy efficiency tax credit. This will help defray costs and maximize your remodeling budget while reducing home energy bills. Question: I am widowed and own the house I live in. I might move in the next year or two. My house is assessed at $268,000. If I could sell the home on my own, would it be a mistake to avoid using a broker? What are the services that a broker offers that make them necessary for a sale?

Answer: As an owner, you always have the right to sell your own property. That said, you also have an obligation to act in your own best interest – and selling your own home is unlikely to maximize net sale results. For instance, the assessed value of your property is $268,000. That is the value for tax purposes – but not necessarily the current fair market price. Why? In some jurisdictions, assessment increases are limited to control property tax increases. In others, homes are only valued every three years. Basing a home sale on assessments is a way to potentially lose big money. Long ago, self-selling with the assistance of an attorney for legal work made some sense. Back in the 1970s, a real estate contract might run a few pages. Today, contracts with their related addenda and disclosures are lengthy enough to look like full magazines. Contracts are longer now because both sides want to reduce liability, maximize options and gain leverage in the transaction. Speak with local brokers to see what services are available and at what costs. Visit open houses to see which brokers best represent owners. Ask about education and experience. Have brokers look at your home and get a comparative market analysis (CMA) from each. Note that the CMA, which suggests the highest value, is not necessarily the best if it cannot be justified by recent, like and nearby sales. For most people, a home is their largest asset. It makes sense to protect what you have. In today’s marketplace, that typically means finding the best broker.
