last month’s rent for those costs? (A few landlords have been known to wrongly think of the last month’s rent as a “super depositâ€?). No. The last month’s rent is solely that ‌ the last month’s rent and nothing else. If the tenant pays the last month’s rent at lease-up, then it cannot be asked for again at the end of the lease – even if there are excessive damages or unpaid utilities. Damages must be taken out of the security deposit. When a tenant has lived in a unit several years and the rent is raised, can an additional amount of money be required from a tenant for that last month’s rent? No. For example, a tenant has been in a single-family rental for several years and is now on a month-to-month basis. When she moved in, a security deposit equal to one month’s rent was collected and also the last month’s rent was collected. During her residency the rent was raised $50/mo. Now that she is moving out, the landlord might want her to pay an extra $50 for the last month’s rent? The short answer is no. That last month amount was agreed to and paid for prior to the raise in rent, so the extra $50 is NOT due. When the last month’s rent is collected, and it is clearly labeled as such, then the tenant has paid for the last month in full, regardless of when that last month occurs. At the precise time the rent was raised and the tenant notified, that additional $50 could have been obtained, but once that time has passed, it is too late. One way to just make things easier may be to just not collect a separate amount of money labeled last month’s rent. It might be clearer to collect an ample security deposit. This way, it can be used to remedy damage, perform necessary cleaning, and cover unpaid rent, unpaid utilities, etc. “Keys to Rentingâ€? content is for informational purposes only and not meant as a substitute for legal advice. oth tenants and landlords sometimes question what the last month’s rent can be used to cover. Of course, the short answer is that by definition when a tenant gives the landlord or property management company an amount called “Last Month’s Rent,â€? it may be used ONLY for the rent for what is agreed upon as the last month, and nothing else. If the tenant and landlord have a month-to-month rental agreement, then the last month’s rent is for the last month the tenant lives in the unit, a simple situation. If a tenant has signed a year’s lease (or any set period of rental time), then the last month’s rent will be the specific month the lease was to have expired. As an example: A tenant signs a year’s lease and moves into the unit in June, so the last month’s is specifically for the next May, no other month. Should the tenant break the lease and move out early, that last month’s rent payment is still for May, not for the last month the tenant lived in the rental property prior to breaking the lease. The reasoning behind this is that an unexpected vacancy has a great impact on a landlord paying the mortgage payment to the bank that owns the rental property. The landlord or property management company also will have to clean, repair, perhaps repaint and clean the carpet an additional time during what was to be a year’s leasing period. There will be additional advertising costs and additional time spent finding a new tenant, items that can’t be avoided and add to the cost of the tenant breaking the lease early. So a tenant will have to pay for their last physical month in the unit and also lose the rent for what was to have been the agreed upon last month in the contract. Also, what if the damages, cleaning costs, unpaid utilities, or unpaid late fees add up to more than the security deposit? Months of on-time bill payments and low credit balances (relative to the card limit) are the keys to boosting scores over time. However, “sometimes there are ways to ‘tweak’ things and see an immediate benefit to a score,� Chedester says. A loan officer might suggest moving a balance from a low limit card to one with a higher limit, for instance, he says. Rating Options Transparency has its benefits. If you share with your lender how you plan to allocate the dollars you have for your purchase, he or she may provide you with more rate options, Theisen says. Typically, the higher the down payment a borrower makes, the lower the interest rate he’ll be charged. Borrowers, however, can “buy down� a rate, Theisen explains, by paying a percentage of the loan amount upfront. That means someone planning a 15 percent down payment might be able to secure a lower rate by reducing the down payment slightly and using the funds for a “point� to be paid upfront. This point (1 percent of the loan) typically lowers the rate a quarter of a percent, Theisen says. Dan Gjeldum, senior vice president of Guaranteed Rate in Chicago, however, says borrowers will rarely recoup those upfront dollars in points through reduced monthly mortgage payments in a matter of a few years. Those who choose this route should plan to stay in the home long-term. Shopping List When rates are on the rise, how’s a buyer to know what he can afford when his mortgage pre-approval was rendered in a lower rate environment? “I don’t think [pre-approval] should be based on one current rate,� says Chedester. “I tell borrowers to look at a range, with one end based on slightly higher than what they can currently get.� When buyers finally find a home and make a formal mortgage application, they are locking in rates “almost 100 percent of the time now,� Gjeldum says. Locks guarantee that borrowers will receive the rate at application when the loan closes, which may be anywhere from 10 to 75 days. “The shorter lock (10 days) is typically 0.125 percent better in rate than a longer lock – 45 to 75 days,� Gjeldum says.
