Things to know about creating a will METRO SERVICES
Drafting a last will and testament is an essential component of estate planning. Despite the importance of having a will, a recent survey from AARP found that two out of five Americans over the age of 45 do not have one. Estate planning can be tricky, which is why many people turn to attorneys to get the job done right. Attorneys who specialize in estate planning will no doubt discuss the following topics with their clients. ASSETS OWNED
Make a list of known assets and
figure out which are covered by the will and which will have to be passed on according to other estate laws, such as through joint tenancy on a deed or a living trust. For example, life insurance policies or retirement plan proceeds will be distributed to your named beneficiaries. A will also can cover other assets, such as photographs, clothing, cars, and jewelry.
or property to help care for those pets. However, pets do not have the legal capacity to own property, so one shouldn’t gift money directly to pets in a will. FUNERAL INSTRUCTIONS
Settling probate will not happen until after the funeral. Therefore, funeral wishes in a will often go unnoticed, states the legal advisement resource Find Law.
PETS
Some people prefer to use their will to also dictate guardianship for their pets and to leave money
EXECUTOR
An executor is a trusted person who will carry out the terms of the
will. This person should be willing to serve and be capable of executing the will. People who die without a valid will become intestate. This means the estate will be settled based on the laws of where that person lived, and a court-appointed administrator will serve in the capacity to transfer property. This administrator will be bound by laws and may make decisions that go against the decedent’s wishes. To avoid this outcome, a will and other estate planning documents are crucial. HOW TO HANDLE
BEREAVEMENT Help yourself and your loved ones grieve as they (or you) need to
BY PATTY TOMSKY, PATTY.TOMSKY@GAZETTE.COM
No two bereaved people will grieve the same way. The idea is to keep cognizant of a person’s cues and to try to be there the best way you can. Individuals will often retreat and that’s okay, too. Just be sure to monitor for signs of depression and don’t take anything for granted — the calm silence of a person sitting beside a bereaved person can go a long way to soothe loneliness and offer solace. HelpGuide.org offers useful advice for those who are going through a loss or love someone who is. Keep in mind, there are many people grieving for the way “life used to be” before the pandemic. That’s an entirely different kind of loss, yet not unlike the loss of a person. In this case, however, we’re 18 | IN LOVING MEMORY | JANUARY 2021
specifically speaking about those mourning a death. AFTER THE FUNERAL
There’s an old adage among grieving families: Long after the funeral is over and the phone calls trickle away, the silence can be deafening. Grief tends to last much longer than most people expect it to last. Loved ones should check in regularly and offer practical help, as well. Many bereaved feel unable to tackle even the most common tasks. A grocery run or a visit to help clean or organize the lost loved one’s personal effects may be exactly what they need. One should also avoid thinking that because a person looks good
they feel okay, too. Telling the bereaved that they seem so great can make them feel like they have to keep up a strong front and not share their real feelings. Sometimes it’s hard to tell people that life will never feel the same. It’s true though. The psychologists at the Help Guide counsel: “You don’t “get over” the death of a loved one. The bereaved person may learn to accept the loss. The pain may lessen in intensity over time, but the sadness may never completely go away.” In addition, grief experts will often counsel the bereaved to find a way to spend time with loved ones on special anniversaries — birthdays, wedding or death anniversaries. “Let the bereaved know you’re there in whatever way they need.” Some
people would prefer to be alone and privately mourn on these days. The important thing is to reach out and be a welcome ear if they need one. RESIST THE URGE
The American Hospice Association has a list of things to avoid saying to the bereaved: “It’s part of God’s plan.” This platitude can anger people. Often, they’ll respond with, “What plan? Nobody told me about any plan.” “Look at what you have to be thankful for.” They know they have things to be thankful for, but right now they are not important. “He’s in a better place now.” The bereaved may or may not believe this. Keep your beliefs to yourself unless asked.
“This is behind you now; it’s time to get on with your life.” Sometimes the bereaved are resistant to getting on with because they feel this means “forgetting” their loved one. Besides, moving on is much easier said than done. Grief has a mind of its own and works at its own pace. Statements that begin with “You should” or “You will.” These statements are too directive. Instead you could begin your comments with: “Have you thought about …” or “You might try …” The other important thing is to be aware of how clinical depression can pose dangers to the bereaved. Helpguide.com offers the following warning signs of depression for friends and loved ones to track — as well as tactful ways to voice your concern: DANGER SIGNS
Encourage the grieving person to seek professional help if you
observe any of the following warning signs after the initial grieving period — especially if it’s been over two months since the death: • Difficulty functioning in daily life • Extreme focus on the death • Excessive bitterness, anger, or guilt • Neglecting personal hygiene • Alcohol or drug abuse • Inability to enjoy life • Hallucinations • Withdrawing from others • Constant feelings of hopelessness TALKING ABOUT DYING OR SUICIDE
It can be tricky to bring up your concerns to the bereaved person as you don’t want to be perceived as invasive. Instead of telling the person what to do, try stating your own feelings: “I am troubled by the fact that you aren’t sleeping — perhaps you should look into getting help.”
Take threats of suicide very seriously. In the U.S., call 1-800273-8255. FIND OTHERS WHO CAN HELP
Joining a bereavement or grief group can often help. These groups are often run by professionals and will offer help to deal with several specific types of loss. For example, the national group, The Compassionate Friends, offers group meetings for those who are working through the loss of a child. If you’re the bereaved person, no matter how long ago the loss was, be gentle with your progress. There is life “before” a loss of a loved one and life “after” — these are not going to be the same and it’s okay for you to ask for help at any time during the “after.” A lost loved one’s birthday might not make a big difference in how you feel or it may; seeing a person playing with a child or when you
smell a certain flower might cause you to feel overwhelming sorrow. Be patient with yourself and with your bereaved friends and family. Most of us have experienced the loss of a loved one; we know your journey is your own and that it will likely look different for everyone. And even if you don’t want the attention, let your inner circle help you, accept their care and offers of practical help. It’s okay to feel terrible and to ask for what you need. There are many types of professional help to pursue. In the U.S. the Crisis Call Center at 775-784-8090 will connect you with a therapist. You may find a GriefShare group meeting near you. Contact support groups for children experiencing grief and loss at the National Alliance for Grieving Children. Or go online to locate a chapter of The Compassionate Friends for help while grieving the loss of a child.
