What are ‘qualified mortgages’ and what purpose do they serve?

In 2013, the Dodd-Frank Wall Street Reform and Consumer Protection Act introduced the qualified mortgage concept, which was designed to eliminate the market abuses that had led to the financial crisis a few years earlier. Like most crisis-induced legislation, Dodd/Frank is replete with flaws, and the qualified mortgage concept (henceforth QM) is one of them.
RATIONALE OF THE CONCEPT
One striking feature of the financial crisis was the extraordinarily high default rates on all the high-risk mortgage types that had emerged during the preceding go-go years. These included a variety of approaches designed to keep mortgage payments low in the early years of the loan. Option ARMs, for example, allowed
borrowers to make payments that did not cover the interest, resulting in negative amortization. When house prices started to decline, the default rate on option ARMs exploded. The QM was a reaction to that experience. The idea was to define a class of mortgages that contained only low-risk features, which would constitute the core of a market that would
be invulnerable to the forces that had generated the crisis. As inducement to participate, lenders were offered liability protection: “If the loan goes bad but it is a QM, you won’t be held liable.”
DEFINING A QUALIFIED MORTGAGE
QMs are defined in terms of features that they must have and features they
cannot have. The most important feature they must have is compliance with an ability-to-repay rule or ATR. In making a reasonable good-faith determination that a mortgage borrower has the ability to repay, the lender must consider eight features of the loan specified in the rule, document compliance and retain documents for three years. Indeed, the legislators who drafted Dodd-Frank CONTINUED ON PAGE 5

Mulch is available in various forms. Like other land and garden products, mulch can go a long way toward helping plants thrive. Mulch comprises just about any material that is spread over the surface of soil. Its purpose is primarily to help soil retain moisture. In addition, mulch can staunch weed growth, keep soil cool, improve the aesthetics of garden beds, and even improve soil nutrient composition. When the right mulch is chosen, it can reduce the amount of time homeowners spend watering and weeding their gardens and insulate plants from dramatic changes in weather. Gardeners may not realize that mulch also can prevent garden soil from becoming overly compacted, according to HGTV. This can mean beneficial earthworms can move easily through the soil, creating channels for water and depositing their nutrient-rich waste products. Gardeners can choose organic or inorganic mulch. Organic mulches are derived from natural materials that will decompose over time, lending organic matter as well as various nutrients to the soil. Organic mulches also may contain beneficial microorganisms that can fight against plant diseases. Inorganic mulches may be made of stones, landscape fabrics and plastic. Both types will need to be amended or replaced as they degrade. Those who want the most environmentally-friendly
mulching materials can choose allnatural mulches instead of synthetic alternatives. To work effectively, mulch should be applied in a two- to three-inch layer of material, state the experts at Old World Garden Farms. This is the ideal amount to retain soil moisture and suppress weed growth without choking plants. Also, mulch that is too thick may make it impossible for water to penetrate, or

viewed this rule as so essential that they decided to apply it to all home loans, not just QMs. Features that QMs cannot have include mortgage payments that are not fully amortizing, which eliminates negative amortization or interestonly payments. Terms cannot exceed 30 years, lender fees cannot exceed 3 percent of the loan amount, and the borrower’s debt-toincome ratio cannot exceed 43 percent. I ignore the many qualifications and exceptions to these rules, because they are not germane to the issue in question: Does the QM approach to market regulation make sense? In my view, it does not, for three reasons: 1. QM WASN’T NEEDED TO PROTECT THE SYSTEM AGAINST ANOTHER FINANCIAL CRISIS. The financial crisis reflected an unusual set of conditions: a sustained house price rise for more than eight years and the absence of a national decline in house prices for over 70 years. This combination underlay the mindset that house prices could only continue going up, and therefore all mortgages were good. It is unlikely that that mindset will emerge again for at least 30 years, when the current generation of lenders is gone from the scene. 2. QM WOULD NOT PROTECT THE SYSTEM IN ANY CASE. Dodd-Frank did not eliminate risky mortgage loans; what it did was segment the market between lenders who make QMs and lenders who make non-QM loans. If I am wrong and the mindset of perpetual house price increases takes hold in the near future, the non-QM sector would take off just as the subprime sector did in the early 2000s. The only significant difference would be that the large mainstream institutions would be mainly QM lenders, though nothing would prevent them from having non-QM affiliates. There is a way to protect the system against a new crisis episode, but the QM approach is not it. 3. QM DISTORTS THE MARKET, TO THE DISADVANTAGE OF WEAKER BORROWERS The probability that a loan will be repaid as scheduled depends on many interrelated factors. A weakness in one factor does not mean that the probability is low if that factor is offset by strength in other factors. Balancing the various factors that affect this probability is what underwriters (and automated underwriting systems) do. QM, in contrast, deals in absolutes. If the debt-to-income ratio is 44 percent, the loan does not qualify, even if the borrower is putting 40 percent down and has a perfect credit record. The borrower in this case would have to go to a non-QM lender. Based on a comparison I did yesterday of QM vs. non-QM prices, the rate penalty would be about 1.5 percent. The same point can be made about all the QM requirements. Before Dodd-Frank, for example, interest-only payments for the first 10 years of a 30-year fixed-rate mortgage was a common provision, for which the borrower paid 0.125 percent or 0.25 percent more in rate. Today, she will pay about 1.5 percent more. The difference can be viewed as a Dodd-Frank-induced private tax. Perhaps the worst consequence of the Dodd-Frank absolutist approach to mortgage quality is its requirement, imposed on all mortgages, that borrowers fully document their income. One result has been to deny credit to many self-employed borrowers with excellent credentials in all respects except that they cannot document much income. The University of Connecticut Home & Garden Education Center says mulch should not be placed directly against plant crowns or tree bases, as this can promote the development of disease. It may also serve as a habitat for barkand stem-eating rodents. The center also suggests watering newly installed
bark or wood mulches to prevent fungi from colonizing in dry mulch and causing problems like a water-repellent surface on the mulch. Home landscapers considering mulch types may find that compost, manure and grass clippings (from non-pesticidetreated lawns) can be inexpensive and versatile in garden beds. The home advice site The Spruce notes that newspaper may also be effective. Many
newspapers have switched over to organic dyes, especially for their black and white sections. Newspapers are an inexpensive way to suppress weeds and act like organic mulch in beds. They can be covered with other organic mulch, like shredded bark, for more visual appeal. Mulch can be a versatile asset when doing gardening projects around home landscapes. And the benefits are more than just aesthetic.

2. KEEP IT CALM
1. LOOK UNDERFOOT While hardwoods are my favorite kind of floors, they often need to be warmed up (and protected) with area rugs. I think of them as artwork for the floor. You can use a lot of pattern and color in those rugs because they get quieter when laid down. Plus, there are often pieces of furniture on top, like coffee tables, dining tables, chairs and sofas. I’ll always be a sucker for a gorgeous Persian rug — they work in every decor — but any kind that makes your heart beat faster is a winner. Invest in a wool rug. It cleans well and should last
What a wonderful, busy world we live in. In my own home — and that of the majority of people I work with — we want a peaceful retreat. A calm palette on the walls lays the foundation for thoughtful details and offers the flexibility to change it up when desired. However, “calm” can turn “boring” if we don’t add contrast and texture. Using a neutral color is fine, but the same shade of that neutral, spread all over the room, is blah. Do you like beige (or gray) on your walls? OK, then use a lighter tone for the sofa upholstery, a darker shade on the floor, maybe a wood and metal coffee table and a couple of accent
pillows with graphic patterns, bold stripes or exotic prints. Choose your color, then find every variation of it: pale, medium and dark. Include a fabric pattern that has your neutral color in it as well as other colors. Oh, you will love how that looks.
3. BIG OR SMALL, DETAILS ALL I go for contrast welt on upholstered furniture every time. Welt is that little tube-like trim that follows the outline of your upholstered seating. It looks very fresh when it’s a strong, contrasting color, like blue trim on a white chair. However, a much softer contrast can also look great, so feel free to use just a shade darker than your primary sofa fabric. This sharpens up the outline and makes the piece look a little bit different from everyone else’s.

Many people trust new-home builders, and as a result there are a lot of buyers looking at new homes without an agent. Purchasing new construction can be more complicated and overwhelming than buying a resale home. Being represented by a real estate professional who is a local expert and has experience with builder contracts and the building process is a big advantage to new-home buyers. “A local builder came to one of our sales meetings recently. He was talking about what a wild and crazy market we’re in, and mentioned that they have had some instances where multiple offers had been coming in on vacant lots. So it’s a bidding war on the lots — with two, three or four potential buyers who

As the Responsible Official, Oscar Martinez has prepared a draft Decision Notice/Finding of No Significant Impact (DN/FONSI) selecting the proposed action of the Pikes Peak Ranger District’s Priority Permits Project Environmental Assessment (EA). Under this decision a priority outfitter and guide permit would be issued to Hike for Life LLC for 300 service days annually for guided hiking, and a priority permit would be issued to Great Outdoors Adventures for guided OHV and e-bike tours and rental delivery. Modifications were made to the OHV routes and number of service days annually, and one rental delivery location was eliminated.
