Assumed by both buyers and sellers to be a reliable source for the latest news about our local real estate market, Zillow is advertised as “the leading real estate and rental marketplace dedicated to empowering consumers with data, inspiration and knowledge.” Disappointingly, however, Zillow is notorious for inaccurate, inconsistent and unreliable data. Under the perception that they can utilize Zillow’s database while remaining “invisible,” buyers and sellers eagerly surf through “Zestimates.” At the same time, Zillow is capturing whatever data is entered during these searches and selling it to local Realtors. “Zillow does an amazing job displaying photos of homes for sale with the ease of a simple search,” said Mike MacGuire, broker/owner with The Platinum Group Realtors. “What many folks don’t know is that Zillow is first

and foremost a lead generation tool for real estate professionals.” Additionally, “When a property is listed for sale, the data hits the local Multiple Listing Service (PPMLS), in a matter of minutes,” MacGuire said. “But, it can take as long as nine days to populate on nationally syndicated sites like Zillow or Trulia.” This results in a lot of misinformation in the hands of consumers. A study by Redfin determined that while brokerage-sourced listings displayed 100 percent of the MLS homes listed for sale, Trulia only displayed 81 percent, and Zillow just 79 percent. What’s more, when the CEO of Zillow, Spencer Rascoff, was questioned about Zillow’s reliability and accuracy of information, his statement was that “while Zestimates are a good starting point, nationwide Zestimates have a “median error rate” of about eight percent.”

Basically, on a $500,000 home, that disparity would be $40,000 ... a significant disparity. In fact, the localized median error rates regularly exceed the national median. Because national syndicators like Zillow, gather information not only from MLS systems but also from third party sites, they can post information that has been entered by anyone, regardless of authenticity. “It’s also important to keep in mind that these national syndicators are not required to follow the extensive and strict standards required by the MLS,” MacGuire said, “so the information tends to be very misleading with virtually no accountability.” Remarkably, similar to data found on Wikipedia, the public is capable of updating data found in Zestimates, adding another level of fallibility to the information. Local real estate markets transform from month to month, and more

specifically from neighborhood to neighborhood. Many factors are taken into consideration when assessing value, such as the location, condition, and improvements in a home. It is simply not reasonable for an algorithm like Zillow’s, to quantify the value of a kitchen that was just remodeled, or a yard that is poorly maintained, among other variables. To offer some perspective, MacGuire looked at 15 random sales in Colorado Springs and 100 percent of Zillow’s values were inaccurate. “In one case, a home that recently sold for $575,000, had a Zestimate of $322,960,” MacGuire said. “That’s a difference of $252,040 — or 56 percent!” Another example is a home listed in Colorado Springs for $3,200,000. The Zestimate assigned to this home was $1,800,000 — another substantial difference. “As the CEO of Zillow has indicated,

the data provided on Zillow is a good starting point. Period.” MacGuire said. “It is a great place to look at photos of homes. Owner can’t sell home until long-lost ex is off the deed

Q:

I have owned my home for more than 20 years and now want to sell it. When I did a simple divorce from my husband a decade ago, he never deeded his half of the house back to me. I haven’t seen or heard from him since we split up. How can I sell my house? – Susan

A:

I see this problem often in my practice. I can’t emphasize enough the

importance of removing a soon-to-be ex before the divorce is final. While it can be difficult to deal with at that time, it’s much more of a hassle to deal with years later. Your first step in clearing this up will be to see if you can find your ex. If not, check if he is deceased. If you can find him, you should negotiate with him to deed his portion of the property back you. If he had agreed to do this in the divorce papers, but just never did, you may be able to go back to the judge to

make him, if necessary. If it is not addressed in the divorce agreement, and you can’t agree on a deal, you’ll need to file a partition lawsuit, in which the court will come up with a fair split for the property. Because lawsuits are expensive and time-consuming, it’s usually better to work things out. If you can’t find him, or found him deceased, you’ll need to file a different type of lawsuit. Depending on the situation, you may be able to

file a Quiet Title lawsuit to have him removed from the title, or you may have to find his heirs, go through a simplified probate for the property and then deal with them. Like I said, a hassle. Each situation is different. The good news is, for every case that results in a quagmire, there usually are half a dozen that can be easily resolved. If you own property with another person, you should have a coownership agreement in place to deal

with disagreements, death and other contingencies. Life happens, and you need a way to deal with that. ■ Gary M.
