ERA Shields Real Estate raises over $50,000 for MDA NEWSWIRE
Always willing to support a worthy cause, members of ERA Shields Real Estate recently achieved their fundraising goal of over $50,000 during the 8th annual “The Arts” Downtown MDA Banquet and Art Show to benefit the Muscular Dystrophy Association. Held on September 12, 2014 at the Pikes Peak Center in Downtown Colorado Springs, the fundraiser featured a banquet, grand piano performance by Rick Flaks, the event’s largest art show to date, which was expanded to two levels from the previous year, the ever popular wine pull, live and silent auction and a live performance by Swing Je T’aime, a Denver based Gypsy Jazz band. Over 500 people attended this year’s event and several hundred more donated to the cause. “This year’s goal was the largest in the eight year history of our event, and

Lakewood first to take on Colorado’s construction defects law BY JOHN AGUILAR THE DENVER POST
The Colorado General Assembly tried with three bills this year to amend a law that critics say is choking off the new condominium market in Colorado and endangering the viability of high-density developments along the metro area’s growing light-rail system. The legislature’s efforts were unsuccessful, prompting one community to take matters into its own hands. Lakewood City Council on Monday introduced an ordinance that would make it more difficult for homeowners associations to sue developers for construction defects and give builders more opportunity to fix problems before litigation begins. A public hearing and final vote on the matter is set for Oct. 13. Supporters of the current law say it provides necessary protection for homeowners who might have bought a home that was poorly built. The city is the first in the state to take on the 2005 law, which many builders say has made it exceptionally easy for homeowners to sue over property defects. That has forced up insurance premiums on new condo projects to the point where they are no longer feasible to build. Condos represented only 4.6 percent of total new home starts in metro Denver in the second quarter of 2014, versus more than 26 percent in 2008, according to Metrostudy. “If there are defects, we want to get
them fixed rather than dragging this through the courts for years,” said Lakewood Mayor Bob Murphy, who has long pushed for reform of the defects law. Lakewood’s proposed ordinance would give developers and builders a “right to repair” before facing litigation and require condominium association boards to get consent from a majority of homeowners before filing suit. Murphy said the ordinance is critical to bringing more diverse housing options to Lakewood, especially around stations along the Regional Transportation District’s West Rail line. Owner-occupied units at transit oriented developments planned for
those stops would be perfect for young professionals and empty nesters alike, he said. “We want to attract young millennials, and yes, they want to buy homes,” Murphy said. “We want to help fulfill the vision of FasTracks that was introduced in 2004.” But those condos aren’t coming and Lakewood City Planner Travis Parker said the defects law is to blame. Of the nearly 2,000 new multi-family units in the city’s pipeline, not one is a for-sale unit, Parker said. “Developers would love to include condos in their developments, but without exception they say they just can’t get financing or insurance
for it,” he said. “As we create new neighborhoods, we can’t do that successfully without condos as part of the mix.” But Molly Foley-Healy, an attorney who serves as legislative liaison for the Community Associations Institute’s Legislative Action Committee, said Lakewood is overstepping its bounds as a home-rule city. “What they’re trying to do is use an ordinance to circumvent state law in order to make it impossible for homeowners to seek redress against builders for defects,” Foley-Healy said. “Mayor Murphy needs to incentivize quality construction in Lakewood instead.”
She said there have been more than a few instances of shoddily built housing projects in the metro area over the years. Without adequate protections for homeowners written into state law, she said, repairing defects becomes an ongoing maintenance cost for the association. “Then that gets pushed on to homeowners via HOA dues,” FoleyHealy said. “Homeowners have got to have a voice in the process when defects exists.” She said Lakewood’s measure doesn’t address the possibility that developers will simply hold on to the units they build until a vote on defects is held, effectively forming a majority bloc against legal action. Murphy said what the ordinance does remedy are instances where homeowners suddenly find themselves unable to refinance or sell because their unit is enmeshed in litigation about which they never had a say. Whether the measure, if passed, serves as a model for other communities starving for owner-occupied multi-family housing is yet to be seen. Centennial Mayor Cathy Noon said she and many other mayors are watching Lakewood’s effort closely. Her city, too, has seen no proposed condo projects coming from developers. “We’d like to have a balance of housing options for people that live in our city,” Noon said.
