Most home owners like their home owner association

My picture, is replaced this time with a new poster that will be distributed throughout El Paso County. If you had the opportunity to read my last column in The Gazette, you’ll remember I made a commitment to come up with a better way to educate our elderly population about repair and remodeling scams and hiring out work to be done on their homes in general. Regional Building Department is collaborating with HBA Cares, Silver Key, and the Better Business Bureau. Additionally, we will have support from the Council of Neighborhood Organizations. There are over a hundred neighborhood organizations that are members of CONO. In addition to having information on the CONO web page we will be working on getting all of the neighborhoods involved in the distribution of the handouts Innovations in Aging Collaborative and the Senior Resource Council also have shown interest in adding the information to their websites. Currently there are over 77 million seniors in the United States and 10,000 baby boomers turning 65 years old every day. It’s predicted that within the next 5 years the retirees will control 70 percent of the disposable income in the Country, making this group prime targets for any scam that people can dream up. Through the 8 years I have been the ‘complaint guy’ at RBD it has become evident that the most vulnerable citizens in our community to scammers are the elderly and first time home owners. The goal is to encourage anyone, if they are approached by a contractor or solicitor, to call one or all of the agencies listed. If their question can’t be answered by one member of the group the caller will be directed to a

different agency that may be able to help. If we can get all of our citizens to call before they get scammed the result is not only saving the victim money and aggravation, but a cost savings to the community as a whole. There are many organizations/ agencies in our community designed to assist our growing elderly population. Working independently they all have, while doing great works, limitations on what they can do. My hope is that by combining forces we can jointly have a far greater impact in the community. This effort will continue to evolve as we move forward and I am excited to be a part of it. A recent study found that those who have a home owners association are quite happy with their community, citing HOA rules as a way to protect property values. Home owner associations are often seen as a necessary evil. Despite the occasional (but dramatic) headlines about conflicts between owners and their associations, it turns out that HOAs are far more necessary than evil. And owners are far more satisfied with their associations than not. According to the Community Associations Institute (CAI), a non-profit dedicated to building better communities, some 62 million people live in an estimated 315,000 associationgovernment communities, from townhouses to detached single-family homes to apartments. In the case of big master-planned communities, which encompass all kinds of housing, the property can be as large as a small city. With that many people coming under the umbrella of a community association, which are also known as home owners associations, property owners associations and condominium associations, among other names, there are bound to be some malcontents, as well as those who have legitimate grievances. But according to independent research conducted for the CAI by IBOPE Zogby International, seven out of 10 people who live under owner associations are happy with their communities. Only 8 percent expresses some level of discontent, while 22 percent were neither satisfied nor dissatisfied. The survey was taken in 2012, and the result is strikingly similar to studies by Zogby in 2005, 2007 and again in 2009. Still, the Internet is filled with complaints of overly aggressive, unresponsive associations that allegedly overstep their bounds, make decisions that on the surface appear to be completely irrational and otherwise flaunt their authority. But while some gripes certainly have merit, and courts have occasionally said an association has overstepped its bounds, they often are filed largely by people who just didn’t get their way. When asked by Zogby to name the worst aspects of their associations, 15 percent named restrictions on exterior improvements as their chief complaint, while 9 percent said paying dues or assessments to cover their share of the services and amenities provided by the association. But 34 percent said there is nothing bad about their association. Zogby also asked residents to name the best aspect of living with an association, with these results: Neighborhood attractiveness, 24 percent; less maintenance for individual owners, 17 percent; community safety, 13 percent; and property values, 12 percent. No one keeps count, but as a general rule, three-quarters of all new development in metropolitan areas come with an owner association of one kind or another. Typically, these projects feature not just well-designed houses or

apartments, but also more efficient land planning and a host of amenities — pools, tennis courts, clubhouses, walking trails, wide-open green spaces and even golf courses — that other communities don’t or can’t offer. Your community — you and all other owners — owns these amenities as shared facilities. But you don’t have to pay for them, or take care of them, at least not directly. Rather, you and everyone else will pay monthly or quarterly dues or assessments to the association of owners, of which you all are members, whether you use the amenities or not. You and your fellow owners elect a board of directors that will be responsible for operating your community. And while some boards will hire a management company to handle the day-to-day chores, others prefer to do it themselves. While the creation of an association allows builders and developers the opportunity to offer more amenities than they might otherwise feature, they are often required to do so if they want to build at all. That way, fiscally challenged municipalities can delegate many of the responsibilities that belong to state and local government — road maintenance, for example, or snow removal and trash pickup — to the community’s owners. So developers build the infrastructure, the owners are responsible for the services and localities can continue to permit needed housing without having to pay the cost. Americans have largely accepted the collective management structure of community living. The covenants and rules are no longer novel — in fact, they are quite similar to those that exist in rental apartments — and are spelled out in the documents new owners are given at closing. The rules are there to ensure the collective rights and interests of all owners, protect and enhance property values and provide and protect the services and amenities that have been promised. Still, there are disputes. Some are small, like whether bird feeders are allowed in the backyard, and some are not-sosmall, like painting you house a particular color. Typically, if there is an issue, it is because someone is not familiar with the rules or chooses not to follow them. Sometimes, the issue arises because the board isn’t doing its job. Every once in a while, the problem is with an overzealous board that is trying too hard to do its job. If that’s the case, and other owners disagree, they can either vote the rascals out or change the rules. After all, owner associations are the most local form in representative government, a democracy in which leaders are elected by their neighbors in the best interests of everyone living there.  Lew Sichelman is a nationally syndicated housing and real estate columnist. Pace of US home price growth slows in September BY JOSH BOAK  THE ASSOCATED PRESS

WASHINGTON — The U.S. housing market cooled off in September, as home prices rose at an ever slowing pace. Prices increased 5.6 percent in September compared to a year ago, real estate data provider CoreLogic said Tuesday. That’s down from annual gains of 6.4 percent in August and 6.8 percent in July. Home prices had been climbing by as much as 12 percent annually toward the end of last year. But the acceleration out of the housing crash that triggered the Great Recession has become unsustainable. Wages have barely budged after inflation and lending standards remain relatively strict. This makes it difficult for families to pay the higher home prices. CoreLogic forecasts that the slowdown will continue, with annual home price growth slipping below 5 percent by September 2015. This should help bolster home sales for first-time buyers with adequate incomes and down payment savings, yet there are few signs that younger Americans are buying real estate. The share of homes bought by firsttimers fell to 33 percent this year from 38 percent in 2013, according to a

report released Monday by the National Association of Realtors. That share of sales was the lowest since 1987 and significantly below the historic average of 40 percent. Higher rents, meager incomes and student debt have minimized how much money millennials can save. A typical first-time buyer earned $68,300 and purchased a 1,570 square-foot home worth $169,000. Part of the problem is that fewer households are forming since the recession struck in late 2007. Nearly a third of adults are living with roommates or family, compared to 27.4 percent in 2006, according to the real estate firm Zillow. As a result, the United States contains 5.4 million fewer households than it otherwise would. The individuals living in a doubled-up household have median incomes of $29,000, less than half of what a median first-time homebuyer earns. Every state registered a price gain in September, according to CoreLogic. Prices reached new peaks in Colorado, North Dakota, South Dakota and Texas, while prices are within 10 percent of their previous highs in 28 other states. 

Fannie, Freddie post profits in 3Q; pay dividends BY MARCY GORDON  THE ASSOCIATED PRESS

WASHINGTON — Governmentcontrolled mortgage companies Fannie Mae and Freddie Mac posted profits for the July-September period as the U.S. housing market continued to recover. Gains in recent years have enabled them to fully repay their government aid after being rescued during the financial crisis in 2008. Fannie Mae reported Thursday that it earned $3.9 billion in the third quarter. Washington-based Fannie will pay a dividend of $4 billion to the U.S. Treasury next month. With its previous payments totaling $134.5 billion, Fannie has more than fully repaid the $116 billion it received from taxpayers. Freddie Mac posted net income of $2.1 billion for the latest quarter. Freddie, based in McLean, Virginia, will pay a $2.8 billion dividend to the government. Freddie will have paid $91 billion in dividends, exceeding its government bailout of $71.3 billion. Freddie had fully repaid as of last year’s third quarter, and Fannie as of the fourth quarter of 2013. The government bailed out Fannie and Freddie at the height of the crisis in September 2008 when both veered toward collapse after piling up losses on risky mortgages in the housing market bust. Together the companies received taxpayer aid totaling $187.3 billion. The gradual recovery of the housing

market has made Fannie and Freddie profitable again. Their repayments of the government loans helped make last year’s federal budget deficit the smallest in five years. The market’s revival beginning in 2012 has been fitful, and housing has lagged behind the rest of the economy. The market remains hampered by tight mortgage credit, rising home prices and stagnating incomes. Together Fannie and Freddie own or guarantee about half of all U.S. mortgages, worth about $5 trillion. Along with other federal agencies, they back roughly 90 percent of new home loans. The two companies don’t directly make

loans to borrowers. They buy mortgages from lenders, package them as bonds, guarantee them against default and sell them to investors. That helps make loans available. The latest reports of profitable quarters for Fannie and Freddie came two days after midterm elections that throw control of the Senate to Republicans. The transfer of majority power in the Senate could affect work on legislation to phase out the two companies, and instead use mainly private insurers to backstop home loans. Two key senators reached agreement in March on a bipartisan proposal that was endorsed by the Obama White House, but it has stalled in Congress.

The senators’ plan would create a new government insurance fund. Investors would pay fees in exchange for insurance on mortgage securities they buy. The government would become a last-resort loan guarantor. With the chairmanship and majority membership of the Senate Banking Committee expected to switch from Democrats to Republicans, lawmakers may end up reworking the proposal. President Barack Obama has proposed a broad overhaul of the U.S. mortgage finance system — including winding down Fannie and Freddie. The goal is to replace them with a system that would put the private sector, not the

government, primarily at risk for the loans. Last month, the head of the federal agency overseeing Fannie and Freddie announced an agreement between the companies and major banks that could expand lending. Mel Watt, director of the Federal Housing Finance Agency, said the deal clarifies conditions in which banks could be required to buy back mortgages they sell to Fannie and Freddie for misrepresenting the loans’ risks. Fannie’s earnings of $3.9 billion in the third quarter was down 55 percent from $8.7 billion in the same period of 2013. Earnings for Fannie and Freddie can fluctuate widely due to changes in interest rates and home prices. Fannie said Thursday it expects to remain profitable “for the foreseeable future.” Freddie’s net income of $2.1 billion was far smaller than the $30.5 billion it earned in the third quarter of 2013. But the year-earlier amount reflected an accounting move that allowed Freddie to capitalize on tax benefits it had saved up from its losses on mortgages during the financial crisis. Under a federal policy, Fannie and Freddie must turn over their entire net worth above $2.4 billion in each quarter to the Treasury. Fannie and Freddie said their net worth in the third quarter was $6.4 billion and $5.2 billion, respectively. 
