A safe place to play for children with special needs NEWSWIRE

Every child benefits from playing outside; it’s not only fun but play teaches children how to make friends and learn new social skills. Special needs children are presented with many challenges, especially on the playground. In many instances, special equipment is needed that is not found in traditional play settings. A special playground project was implemented by HBA Cares at Special Kids Special Families’ Zach’s Place program. HBA Cares, Inc., a non-profit organization founded by members of the housing and building

authority, assisted in the construction of a brand new playground with equipment specially designed for children with disabilities and special needs. This new equipment allows children with special needs that attend Zach’s Place to explore, develop and integrate all of their senses, while supporting motor skills and social play experiences. HBA Cares integrated play equipment that was simple and intuitive. Installing an accessible swing, interactive learning play panels and a safe surface allows children

of all ages and abilities to play in the same space. Mike DeGrant, President of HBA Cares, organized local companies to get involved in the project including but not limited to, C&C Sand and Stone Co., Robertson’s Landscaping, and Woods Site & Playscapes. “I’d like to thank Linda Warren of Warren Management Group for referring us to HBA Cares,” said SKSF Executive Linda Ellegard. “The dedication and hard work of everyone involved is greatly appreciated! We now have a safe place where our kids can play outside and have fun!”

Zach’s Place at the Laurie Hillyard Family Center is located at 4975 Granby Circle, in Colorado Springs and provides respite and daycare to children with disabilities and special needs. The center is only one of two licensed day care facilities that provides 24/7 specialty care — seven days a week. The center is a lifeline for families raising children with disabilities ages 2.5 through 21. HBA Cares, Inc. is a non-profit organization whose primary mission is to assist other non-profit agencies and programs with construction needs

that will further their ability to provide housing and living assistance to Pikes Peak region families in need. HBA Cares does not make contributions to other non-profits, but rather provides construction expertise and works to solicit donation of goods and services required for a construction project. HBA Cares also provides support for charitable activities of members of the Housing & Building Association of Colorado Springs. While most home sellers are highly motivated, they do sometimes change their mind. If they are unhappy about the sale price, or lost a job, decide not to relocate, or many other possibilities, a seller may try to cancel the sale. When buyers back out of a real estate deal, they can pay profoundly for that decision, if they are withdrawing for any reason not outlined in their contingencies. “In a market like ours with very low inventory, sellers in the under $450,000 price point have more leverage,” said Skip Johnson, Broker Associate with The Platinum Group, Realtors. “A savvy seller can try all kinds of things to make it difficult for a purchaser under contract, if they know they have a better offer waiting in the wings.” Even though sellers don’t extend any type of earnest money, they appear to have less on the line. However, backing out of a contract can carry consequences for them too. The following examples demonstrate some cases when sellers can get out of a contract. 1. THE CONTRACT HASN’T BEEN SIGNED Before a contract is officially signed, a seller can retract a deal at any time. A signed real estate contract is a legally binding document, so backing out after the contract is signed subjects the seller to certain legal ramifications. However, if the buyer sympathizes with the seller’s situation, they can choose to let the seller out of the contract. But, the buyer can also choose to enforce the agreement. 2. A CONTRACTUAL OUT FOR THE SELLER The seller can place an addendum within the contract that states they can back out without

Not so long ago many homeowners were racing to outfit their homes with home theater spaces. If spaces allowed, homeowners would transform rooms into dark, theater-like retreats, complete with large screens, surround sound and reclined seating. Interest in such spaces has waned in recent years, with many homeowners opting for media rooms instead. So what is the difference between these spaces? According to HGTV, a home theater is a room designed to replicate the experience of the cinema. A media room is a multipurpose space where people can gather to enjoy any type of media, from TV to music to gaming systems. Home theaters tend to limit activity to watching movies. However, homeowners interested in more versatile paces may find media rooms are much more practical. A media room is an option for families who want a theater experience in common areas or open-concept living spaces, said Digitech Custom Audio and Video System Integration Specialists. Media rooms frequently feature comfortable, customizable seating, rather than rows of seats facing the screen that are standard in home theaters. Guests can converse in media rooms while enjoying a show, streaming music or gaming. Various design layouts are possible, including furniture that conceals electronics so the media room can be an entertainment lounge one minute and a theater the next. Because media rooms are not as isolated as home theaters, the acoustics in such rooms may be compromised. That’s a disadvantage for homeowners who have invested heavily in sound systems for their media devices. Sound from media rooms also may filter out and disturb others in different rooms of the house. However, fluffy sofas, drapery and carpeting can absorb sound and keep it in the room. Homeowners who like to entertain while watching or listening to media may prefer the flexibility of media rooms, which make it easy to stream movies and music and play games. 

THE BUYER DOESN’T ADHERE TO THE CONTRACT TERMS A common buyer problem is failing to secure a mortgage within a particular time frame. The sellers don’t want to wait on the buyers to find financing elsewhere, so they choose to move on. 4. THE BUYER REQUESTS REPAIRS THE SELLER IS UNWILLING TO DO After the home inspection, buyers often request specific repairs are made, or request a “repair credit” to cover the costs. Sellers can always refuse, essentially forcing the buyer’s hand. This situation would require the buyer to either withdraw the requests or back out of the deal. Apart from the reasons above, a fully executed purchase agreement makes it difficult for sellers to back out of a contract without serious consequences. In Colorado, the contract is intended to protect the buyer. If a buyer withdraws, the seller still has a property to sell, whereas if a buyer purchases a lemon they are fundamentally stuck with it. “Purchasers may try to recover any damages from a seller who tries to cancel a contract, providing there aren’t any contingencies to let the seller ‘out,’” said Johnson. “I have experienced a seller trying to ‘foil’ a contract for my buyers because they received back- up offers for more money, but they lacked the contingencies in our agreed upon contact.”
