Owning a home with son not worth the risk

Q:
Ten years ago, I bought a rental home with my son, but I was the only one who signed the loan papers. We are both on the deed. My son has been handling the day-today issues and paying the mortgage, but lately the mortgage payments have been late. I would like to sell the property, but my son is not cooperating and, to make things worse, we owe
more than the property is worth. What are my options? – Jim
A:
Your best bet is to persuade your son to cooperate in a short sale. Because you are the only person on the loan paperwork, you are the one on the hook for the mortgage payments, regardless of the deal you made with your son. However, because your son is on the deed, he owns half the property and has as much say in what happens as you do, so you will need your son’s approval to complete a short sale. This is not a good
position for you. I advise clients who own real estate never to co-sign a mortgage for a home they don’t at least co-own and never have a co-owner who also is not on the hook to the lender. Both scenarios create situations in which you owe money on a property that you can’t control without the permission of someone who has nothing to lose by not making payments. In a short sale, you will need the lender to agree to sell for less than you owe on the mortgage. That’s certainly doable, but it is more complicated than a traditional sale. If your son doesn’t cooperate, you will be left to decide between the status quo and suing your
son to have the court force him to work with you. It’s time to sit your son down for a heart-to-heart talk. ■ Gary M. The Peak Producers real estate group helped significantly this year to raise funds, donation and awareness of the Springs Rescue Mission. Their efforts continue with the Take Action Drive. The Mission shelter opened on November 18 and is currently looking for sturdy coldweather gear. The items needed most are warm coats, socks, gloves and hats. Hygiene products and coffee are always

Besides, the job search slows in December, right? Newsflash: It’s a total myth that companies aren’t hiring right now. In fact, employers are scurrying to fill jobs with qualified candidates by year-end. As a former corporate recruiter, I can tell you — the pressure was on in December. If job openings didn’t get filled by the end of the month, the finance department typically questioned why and wrongly assumed that the reason the position was still open was because the department didn’t really need the additional headcount. Bottom line: Recruiters need to find you as soon as possible. I extended countless job offers during many Decembers, so new hires were sitting pretty in their new office by the time the new year rolled around. Your confidence should soar simply knowing you’re in demand. Follow these steps and you won’t just be toasting to a brand new year on New Years’ Eve — you’ll be toasting your brand new job.

Fewer resumes equate to less competition for you, as applications trickle in at a slower pace compared to January when an influx of resumes pummels hiring managers. So in the middle of all the holiday madness, set aside some quiet time every single day to focus on your job search. Recruiters are waiting.

Keep applying to new opportunities as soon as they become available. Essentially, December is one of the best times of the year to get a job. Don’t wait until the new year to tackle all of your new year’s goals. Get on to employers’ radar screens — now.
