Real estate contracts are among the most confusing and misunderstood documents around, but certainly play a vital function on the propertybuying process. Typically the process starts with a buyer presenting an offer to purchase a property from a seller. The offer can then be accepted or rejected. Once a seller accepts the buyer’s offer, a real estate contract makes it official. Once both parties have signed the offer it becomes a contract and is binding for both the seller and buyer. Contingencies can sometimes be
included to ensure one party isn’t on the hook if something unexpected comes up. A contingency describes a condition or action that must be met in order for the contract to be binding. These stipulations are part of the contract when both parties agree to the terms and sign the contract. While there are a considerable number of possible contingencies the most common usually include: • Financing contingency agrees to the buyers ability to procure financing for the property • Appraisal contingency declares the
