If you have been a hospital patient during the past decade, you are familiar with the question: “On a scale of one to 10, how would you rate your pain?” Recognition and assessment of pain has become a national standard of care. Pain is the main complaint in any hospital’s emergency department, involving 50 to 80 percent of all visits. It also is the most common reason that people go to physicians. Pain affects more Americans than diabetes, heart disease and cancer combined. “Untreated or under-managed pain takes a high economic toll when measured in the cost of medical care and days lost from work,” Steamboat Springs pain medicine specialist Brian Siegel, M.D., said. “People who suffer from pain also have a reduced quality of life. “Especially in these difficult economic times, we need to do a better job of identifying and treating people for pain.” Siegel has been the medical director of Yampa Valley Medical Center’s Pain Management Program since its inception in 2000. He is board-certified in anesthesia and pain medicine. “There are two basic types

If it is not addressed right away or treated properly, it can lead to chronic pain.” Chronic pain generally is more difficult to treat. “You can’t see, touch or hear pain, and that is a big barrier to treatment,” Siegel said. “Pain is a perception and can be defined as ‘an unpleasant sensory and emotional experience associated with actual or potential tissue damage.’ There is often a psychological, as well as a physical aspect to pain.” Siegel uses a variety of techniques and modalities to treat chronic pain. “There are people who have one intervention and it succeeds

Slipping into wetsuits and jumping into the pool may not be the typical way to start a high school class, but for Hayden High School teacher Dean Massey’s students, scuba diving is just what they expected. “It’s the reason I joined the class,” junior Kolton Miller said Sunday. The Natural Resource Science class was created by Massey two years ago to give students an option other than collegelevel science. Students complete a project each quarter of the school year, and they can prove useful once a student graduates. One course grad went on to become an underwater welder with the experience he gained, and a current student plans to do the same. “Prior to that, we didn’t have many options. We didn’t have a place for kids who wanted to look for more science but didn’t want to go to college courses,” Massey said. “The whole concept is to get out and see the science behind everything else.” For their final lesson this year, the students will take two classroom sessions and two pool sessions with Bottom Time Divers dive masters Rodney Herman and shop owner Chip Beebee. The instructors will bring the students almost all the way through scuba certifica-

Until recently, Moffat County Court judge Sandra Gardner knew people brought weapons into her courtroom. Moffat County Sheriff’s Office deputies Lynn Schonert and Jarrod Poley are trying to change that. The deputies’ arrival is not a sign of paranoia, the judge said. It’s a way for officials to address the real possibility of disaster. “I have seen the knives, I have seen the X-actos, and I’ve assumed there were guns based on how people were clothed and how they carried themselves, trying to conceal it,” Gardner said. She understands why people

might want to bring their blades and other instruments of harm to her place of business, but that knowledge doesn’t make it easier to push the dread out of her mind. “We deal with very, very delicate issues up here on the third floor,” Gardner said. “People’s liberty issues are at stake, their financial interests, their family. Candidly, we do not see people at their best.” That’s where Schonert, a 53year-old veteran of private and courthouse security duty, and Poley, who, at 26, has worked in Moffat and Rio Blanco county jails, come in. Since the beginning of April, it has been their task to keep weapons out of Gardner’s courtroom and the entire third floor of Moffat County Courthouse as

safe as possible with a standing metal detector, a roped-off elevator and their own sensibilities. The security measures aren’t everything Gardner hoped for when she pressed the Moffat County Commission to do something, but she said Schonert’s and Poley’s commitment to their duty is above reproach. Gardner said she is at ease entrusting her well-being to them. She has not always had the same comfort at work. Gardner remembered being an attorney in a divorce case some years back in the same room she now wears her black judge’s robe. How quaint. The Republicans are concerned about checks and balances. The specter of Specter helping the president have his way with Congress actually has made conservatives remember why they respected the Constitution in the first place. Sen. Mitch McConnell, the leader of the shrinking Republican minority, fretted that Dowd there was a “threat to the country” and wondered if people would want the majority to rule “without a check or a balance.” Sen. John Thune worried that Democrats would run “roughshod” and argued that Americans wanted checks and balances. Sen. Judd Gregg mourned that “there’s no checks and balances on

this massive expansion on the size of government.” Bill Kristol, the editor of The Weekly Standard, tried to put the best face on it, noting, “This will make it easier for GOP candidates in 2010 to ask to be elected to help restore some checks and balances in Washington.” This is quite touching, given that the start of the 21st century will be remembered as the harrowing era when an arrogant Republican administration did its best to undermine checks and balances. (Maybe when your reign begins with Bush v. Gore, a Supreme heist that kissed off checks and balances, you feel no need to follow the founding fathers’ lead.) After so many years of watching a White House upend laws, I now listen raptly when President Barack Obama plays the constitutional law professor. He was asked at his news conference Wednesday night about the Republican fear that he will “ride roughshod over any

opposition” and establish one-party rule. “I’ve got Democrats who don’t agree with me on everything,” he said. “And that’s how it should be. Congress is a coequal branch of government.” You almost thought the professor in chief was going to ask the assembled students to please turn to page 317 in their Con Law book. He went on to reassure Republicans that his vision of the presidency is very different from the imperial view held by the Boy Emperor and his regents. “I do think that, to my Republican friends, I want them to realize that me reaching out to them has been genuine,” the president said, adding, “The majority will probably be determinative when it comes to resolving just hard-core differences that we can’t resolve, but there is a whole host of other areas where we can work together” and “make progress.” The officials who actually repreSee Dowd, page 9

Is the South still more racist than the rest of the country? Malcolm X used to say in that regard that there was only “down South” and “up South” for black folks. Times have changed. The question has reached the Supreme Court — and each side is using President Barack Obama’s election to back up its case. One side argues that Page Obama’s election means that the 1965 Voting Rights Act can stop imposing special penalties on the South. The other side argues that the special provisions in question make racial breakthroughs such as Obama’s election possible. In fact, both sides are right. Legal

experts have warned Congress repeatedly that, if they didn’t update the law to take its own success into account, as well as the nation’s changing racial and ethnic landscape, the Supremes might well change the law for them — or even strike it down. It is important for me to point out, contrary to pernicious urban legends flying around the Internet, that we’re not talking about the entire Voting Rights Act. Voting rights for African Americans are not in danger of being repealed. At issue is one controversial provision called “Section 5.” It requires nine mostly Southern states and “covered jurisdictions” in some other states to submit any proposed redistricting plans or changes in voting rules to the Justice Department’s Civil Rights Division for an approval process called “preclearance.” These rules can include changes as

local as the location of polling places to the makeup of districts in state legislatures. Since Section 5 was the deepest and most drastic federal intrusion into state and local government affairs since Reconstruction, Congress made it temporary. Yet it has been extended repeatedly and even broadened to protect Hispanics and other “language minorities,” most recently in 2006. The new question before the Supreme Court is whether this special Southernonly “pre-clearance” provision still is needed. “The America that has just elected Barack Obama is not the same America that existed when Section 5 was put into place,” argues Gregory S. sented a threat to the country while they were running the country are continuing to defend themselves. But they just end up further implicating themselves. Condi Rice, who plans to go back to being a professor of political science at Stanford, got grilled by a student at a reception at a dorm there Monday. I’ve often wondered why students haven’t been more vocal in questioning the architects of the Iraq war and “legal” torture who landed plum spots at prestigious universities. Probably because it would have taken the draft, like the guillotine, to concentrate the mind. But finally, the young man at Stanford spoke up. Saying he had read that Rice authorized waterboarding, he asked her, “Is waterboarding torture?” She replied: “The president instructed us that nothing we

would do would be outside of our obligations, legal obligations, under the Convention Against Torture. By the way, I didn’t authorize anything. I conveyed the authorization of the administration to the agency.” This precisely was Condi’s problem. She simply relayed. She never stood up against Cheney and Rummy for either what was morally right or what was smart in terms of our national security. The student pressed again about whether waterboarding was torture. “By definition, if it was authorized by the president, it did not violate our obligations under the Conventions Against Torture,” Rice said, almost quoting Nixon’s logic: “When the president does it, that means that it is not illegal.” She also stressed that, “Unless you were there in a position of responsibility after Sept. 11, you cannot possibly

imagine the dilemmas that you faced in trying to protect Americans.” Reyna Garcia, a Stanford sophomore who videotaped the exchange, said about Condi’s aria, “I wasn’t completely satisfied with her answers, to be honest,” adding that “President Obama went ahead and called it torture, and she did everything she could not to do that.” As Obama said in his news conference, it is in moments of crisis that a country must cleave to its principles. Asserting that “waterboarding violates our ideals,” he said he had been struck by an article describing how Churchill would not torture prisoners even when “London was being bombed to smithereens.” “And the reason was that Churchill understood, you start taking shortcuts and over time, that corrodes what’s best in a people,” he said. “It corrodes the character of a country.” Class dismissed.

In their questions, the court’s four conservative members plus swing-voter Justice Anthony M. Kennedy seemed to agree with him. Is the “sovereignty of Georgia” entitled to less respect than “the sovereign dignity of Ohio?” asked Justice Kennedy. “Why didn’t (Congress) extend Section 5 to the entire country?” asked Justice Samuel A. Alito Jr.

With that, Alito sounded almost like Malcolm X’s sarcastic observation. Yet he raised a good point. As Chief Justice John Roberts noted, court filings show liberal Massachusetts has a lower rate of registering Latino voters than conservative Texas. Even so, records also show the South is not quite out of the woods. The 2006 version of Section 5 was upheld by a special three-judge federal court in Washington with a very persuasive opinion by Judge David Tatel. Citing a large body of evidence compiled by congressional committees, Tatel found that old-style voting discrimination

still persists in at least some of the many localities covered by Section 5, and there might well be more were it not for Section 5. Other defenders point out that it passed the Senate and House overwhelmingly and that few of the “covered jurisdictions” have joined in challenges to it. If the Supreme Court were to strike down Section 5, the decision would not necessarily affect the remainder of the Voting Rights Act, but it would make local election changes in the covered states harder to challenge. That could give Congress an important opportunity. It could debate and update its voting rights laws to keep up with changing times.

But pain is complicated, and it doesn’t always respond to just one type of treatment.” YVMC’s Pain Management program offers acupuncture and Chinese herbs, as well as more-traditional Western medicine. Licensed acupuncturist Kelley McDaneld, L.A.c., Dipl.OM., explains how acupuncture relieves pain. “Acupuncture can facilitate tissue healing by promoting blood flow to the affected area,” McDaneld said. “It also stimulates the release of endorphins, which are the body’s natural pain-killers.”

McDaneld estimates that 75 percent of patients who come to see her have back pain. Other common complaints that can be successfully treated by Chinese medicine include neck pain, tendonitis of the elbow, headaches — including migraines — shoulder pain and fibromyalgia. Siegel said the Pain Management program is individualized and dedicated to education. It includes medication, injections and other treatment modalities. “We try to help the patient understand why they hurt and what we can do about it,” he said. “I explain procedures and give treatment options. That is what is so nice about our program at this hospital

— I have the time to talk to patients. We’re not like some high-volume pain centers where patients might not even meet the doctor.” Siegel’s goal is to reduce or eliminate pain when possible and increase the patient’s ability to function physically. “We can’t always cure pain, but we can have a positive affect on the indirect costs of pain,” he said. “When we help people function at a higher level, they can be productive at work and have a better quality of life.” Christine McKelvie is public relations director at Yampa Valley Medical Center. The memory is not lost on her when she takes her own seat on the bench, but it doesn’t seem to be the same menacing omen it once was. “When I take the bench, I can look out at the people, and I am much more confident there are not pocket knives, guns, Xactos,” Gardner said. Clerk of the Court Diana Meyer didn’t think much about court safety when she first starting working. “But that was 20 years ago,” she said. “Especially in the last 10 years, things are trending toward violence. You see it everywhere, in the schools, in the colleges and in the courts. When that’s your everyday place of employment, it’s kind of unnerving.” Meyer doesn’t find herself considering when somebody will try to hurt another person, or many people, now, for one reason.

“There’s only one entrance to the courtroom floor, and they have to go past them,” she said. In her mind, Schonert and Poley are the perfect men for their position. Meyer was on the hiring board that brought them on staff. What makes them perfect, as opposed to simply doing their job well, is they seem to understand exactly what the job requires, Meyer said. There’s Schonert, who took charge and created a system that keeps people safe but doesn’t needlessly burden or harass the public. “He’s calm, he’s professional and he’s respectful of the people who come here,” Meyer said.

“Yet, he’s very careful, incredibly attentive and focused on what he’s doing, and he knows what he needs to do.” Next to Schonert is Poley, who Meyer said seems to match his colleague’s easy personality and vigilance, despite his young age. “He’s a likeable person, yet he’s firm about what needs to happen,” Meyer said. The guards themselves said they are only doing what they’re assigned to do. The job has become a lifestyle for both. Each man’s family has a history in law enforcement, and neither was sure what he would do if not serving and protecting.

Walking for fitness, fun and challenge Tamera Manzanares

Marlene Griffin always has enjoyed walking, but the opportunity to travel pushed her to join a walking class to improve her endurance. Griffin, 73, has participated in a walking class for older adults in Craig for more than a year. Since then, she’s easily kept up with her son and family during trips to the Grand Canyon and tackled many miles of walking in Hawaii with friends. Her overall health also is a testament to her fitness improvements. “I feel quite well,” said Griffin, who also participates in strength classes at Wellness Wednesdays, an Aging Well program offered through the Visiting Nurse Association. “I don’t take any medicine at all, and my goal is to keep it that way.” Whether taking daily walks around the block or an ambitious trek on a mountain road, walking accommodates a wide range of fitness levels and goals. A convenient and safe activity, walking bolsters muscle strength, balance, posture and other abilities we tend to lose with age. It’s also an ideal way for inactive older adults, who either have or are at risk for chronic conditions, to lose weight, lower blood pressure and become more fit. Individuals ages 50 and older in Routt County soon will have the opportunity to learn to walk toward better health or achieve additional walking benefits. The Aging Well program is planning beginning- and advance-level classes in Steamboat Springs and possibly Hayden and South Routt County.

Setting a pace The social benefits of walking with a group can motivate individuals to begin walking and maintain a regular routine. The walking class, in addition to other Aging Well exercise classes, has been an important social outlet for Griffin since her husband passed away. “I could’ve sat at home all winter long … I joined for the social part, but all the other stuff was a big bonus,” she said. The walking group meets twice per week walking a total of about 2.5 to 3 miles. They walk rain or shine. On nice days, they walk outside in areas such as Loudy Simpson Park; they walk in Ridgeview Elementary School on not-sonice days. Instructor Tammy Workman makes sure they get in about 20 to 30 minutes of cardio work during each walk. Adults ages 65 and older should aim for at least 150 minutes of moderate-intensity (medium level of effort) physical activity each week, according to 2008 Physical Activity Guidelines from the U.S. Department of Health and Human Services. To avoid injury, inactive older adults should start slow, gradually increasing the duration and number of days they walk as well as their pace. Individuals with chronic conditions always should check with their doctors about appropriate exercise and only do as much activity as their abilities allow. The advantage of walking in a class or group is individuals of similar levels can stick together, Workman said. Walking form is just as important as pace and distance. Workman keeps participants, whose ages range from 64 to 85, cognizant of their posture

and tendency to not pick up their feet. “I usually see that they are getting confidence in themselves … they are not shuffling anymore, their stride is better, their bodies are upright, and they can also keep a conversation instead of looking down,” she said. They also have set a goal to walk Cedar Mountain, a fourmile trail outside Craig that includes steep and rocky sections. “They really want to do it,” Workman said.

Stepping up challenge Nordic Walking, which engages the upper body for a more vigorous workout, is a popular activity in Europe and gaining a foothold in the U.S. The activity involves special poles sized to a person’s waistline and equipped with comfortable hand straps and removable rubber tips for pavement. Nordic Walking is a common activity among cross country skiers who want to maintain upper body strength and endurance in the off-season. The number of confirmed swine flu cases in Colorado has doubled to four, including one case in a middle-school student whose school will close for a week as a precaution. The two new confirmed cases were in a middle-school-age boy and a man in his 20s, both from Jefferson County, Colorado Chief Medical Officer Ned Calonge said Sunday. Both had traveled to Mexico or areas in the U.S. where the flu has been found, Calonge said. Neither was hospitalized. The boy had gone on a school trip the week of April 20 with close to 45 students, and his sibling has a suspected case of swine flu, said Mark

Johnson, executive director of the Jefferson County health department. Health and school officials declined to release more details, saying they wanted to protect the victims’ privacy. Jefferson County Public Schools Superintendent Cindy Stevenson said that after talking with health officials, she agreed to close the boy’s school, Excel Academy in Arvada, for a week to help prevent the illness from spreading. The school was closed last week for spring break, and the infected student has not been to school since becoming ill. “When it comes to children’s health, it’s better to overreact than underreact,” she said. Teachers at the school attended by 450 students from kindergarten through eighth

grade will do as much classwork as possible online, Stevenson said. Calonge urged the students to stay home. The school’s Web site said sixth-graders traveled to Dana Point, Calif., the week of April 20, and seventh- and eighthgraders went to New York City that week. Calonge, Johnson and Stevenson all urged anyone showing signs of flu like cough, headache and fever to stay home, so that other schools won’t have to close. Earlier, the Aspen school district asked about three dozen students returning from Mexico and a school-sponsored trip to San Diego to stay home from school for a week as a precaution against spreading the swine flu. Both areas have high incidences of the illness.

Colorado may abolish death penalty State hopes to use financial savings to investigate cold cases DENVER

Colorado and nine other states considered abolishing the death penalty this year to save money, but Colorado’s proposal has a twist: It would use the savings to investigate about 1,400 unsolved slayings. The measure has sparked a fierce debate between prosecutors and some victims’ families. Prosecutors want to keep capital punishment as an option for heinous crimes, and they say the bill has raised unrealistic hopes about solving cold cases. Supporters of the bill say it’s more important to find and prosecute killers still on the loose than to execute the ones already tried and convicted.

“The death penalty is not relevant without a murderer brought to trial,” said Laurie Wiedeman, the older sister of 17-year-old Gay Lynn Dixon, whose 1982 slaying remains unsolved. “I would like to see the person who killed my sister put to death. But to have that person free to run

around and committing other crimes?” Abolishing the death penalty would save an estimated $1 million a year in Colorado now spent on prosecutors’ time, public defenders’ fees and appeals, according to a legislative analysis.

As it prepares to celebrate the 50th anniversary of hosting the Winter Olympics, a tightknit Sierra Nevada ski community is mourning another loss in an unusual string of tragedies this season. A skier’s deadly collision with a tree Thursday at California’s Squaw Valley USA resort is the latest in the series that involves two other skiers killed in avalanches and nine deaths in all. Off the slopes, a shuttle bus crash killed a resort employee in April, and three young women hoping to get seasonal jobs died

of carbon monoxide poisoning in December while sleeping in a car just outside the resort. Extreme skier Shane McConkey of Squaw Valley died in March while jumping off a cliff with a parachute in Italy. And Dave Pedersen, the resort’s race services director, died of cancer in February. “To say this has been a year of tragedy is an understatement,” said Savannah Cowley, a resort spokeswoman. “It has been tragedies that have really, really struck our community. This is unprecedented as far as the grief this mountain has gone through.” Pete Bansen, Squaw Valley’s fire chief, said he can’t recall as many different kinds of fatali-

ties in his 30 years in the Lake Tahoe-area resort community. The avalanches — one killing ski patrol member Andrew Entin, 41, in March, and the other killing Randall Davis, 21, of Tahoe City, Calif., in December — were especially rare for Squaw Valley, he said. They were the first avalanche fatalities at the resort since 1963. The latest accident on the slopes killed Thomas “Spyder” Johnson, 69, of San Bruno, Calif., a longtime season-pass holder. “There have certainly been a lot of unusual accidents this year,” Bansen said. “Each is profound in its own way, and each deeply affected a different group of people.”

I

t wasn’t hard to find reasons last season why the Steamboat Springs High School girls soccer team finished second in the Western Slope League. The team had given up its crown and perch at the top to Battle Mountain the season before. Steamboat came into the season with a young team and had only two seniors on the roster. Most of the positions were filled with freshmen and sophomores. Save for a few juniors, Steamboat essentially was playing with a new team. That team still made the playoffs and finished second in the league. But flash-forward to this season, and there is something special brewing with Sailors soccer. Those freshmen and sophomores are a year older, a year more experienced and are the nucleus of a team set to not just make the playoffs but also to potentially make a run. With Friday’s tie at Glenwood Springs — a place that has been Steamboat’s Achilles heel for years, thanks to a CrackerJack-box field — Steamboat is in line for a home playoff game. Beyond that and beyond the Western Slope League, Steamboat seems to have turned a corner when it comes to teams on the Front Range. It’s no secret the strength of girls Class 4A soccer lies in the Denver area and specifically the Northern Conference. For most of those teams, not making the Final Four each year constitutes a disappointment. If not for Nene’s breakout first half, Carmelo Anthony’s fourth-quarter fireworks and Anthony Carter’s defensive deftness wouldn’t have mattered much. Nene kept Denver in it until his teammates could turn this one into another laugher, scoring 18 of his playoff careerhigh 24 points in the first half of the Nuggets’ 109-95 rout of the Dallas Mavericks on Sunday in the opener of their second-round series. “’Melo in foul trouble and kind of searching for an offensive confidence, we got it from Nene,” Nuggets coach George

Karl said. “The balance of our team has quietly been a strength of who we are. In the second half ’Melo got into the game, J.R. (Smith) jumped into the game, and our defense was fantastic.” Nene, who beat testicular cancer last year, played more minutes than ever this season and during the last month he really hit a wall. In the Nuggets’ five-game dispatch of New Orleans in the first round, he averaged 9.0 points and 7.8 rebounds. His fantastic first half saved the Nuggets, who poured it on the second half thanks to 20 Dallas turnovers, eight by Jason Kidd, who turned over the ball just three times in the first round.

“Offensively, we were good,” Karl said, “but defensively we were really good.” Thanks to their stifling defense, the Nuggets outscored the Mavericks, 29-4, on fast breaks, but the disparity that really bothered Dallas coach Rick Carlisle was the 36-13 advantage Denver had at the line. “We’re going to have to raise our level of aggression if that’s what’s going to get us to the free throw line,” said Carlisle, who particularly was bothered that Dirk Nowitzki took just four foul shots plus a technical.” Anthony found it funny the Mavs were complaining about whistles because he was in early foul trouble for what he considered questionable calls.

The Steamboat Springs High School girls soccer team wrapped up the Western Slope League championship more than a week ago, but it didn’t reap all the awards of its powerful season until Sunday. The Sailors earned the No. 11 seed in this month’s Class 4A state girls soccer tournament. On Wednesday, the squad will host Thompson Valley at Gardner Field in a home playoff game. The time of that game will be announced today. “The girls are ecstatic,” Steamboat coach Rob Bohlmann said. “It was our goal all season to get a home playoff game, and they are thrilled that all that hard work paid off.” Bohlmann said he was pleasantly surprised how highly his team was seeded in the 32team bracket. Thompson Valley is the 22nd seed. “I was thinking somewhere between 12 to 16,” he said. “Coming in at 11, that’s solid. That shows a lot of respect from the various leagues towards our league, and obviously towards us having won the league title and having some solid performances outside the league.” Thompson Valley, a Loveland high school, enters Wednesday’s game with a 8-6-1 record, a couple wins behind Steamboat’s 11-3 mark. Steamboat lost, 2-1, to Centaurus, 3-1, to Ponderosa and, 1-0, to Grand Junction Central. Consider that Ponderosa is 9-2-2 and ranked 10th in Class 5A. Central is 10-1-2 in 5A, and the loss to Centaurus came early in the season, when Steamboat still was trying to discover what type of team it would be. In each of those early sea-

son games, Steamboat had its chances. Say those games are played today, and it’s likely the outcomes might be different. The challenge facing Steamboat early in the season was complex. The Sailors always are regarded as a team that maintains possession but has trouble finishing. The trick is balancing rhythm with an aggressive attack.
